Does an Estate Without a Will Need a Court Grant in Kolkata? The Short Answer

Short answer

Heirs inherit under the succession law of their community whether or not a court has issued anything, so letters of administration are never a precondition for inheriting. They help when a bank, buyer or registrar wants court authority, when heirs disagree about who should act, or when the estate mixes many kinds of asset. In Kolkata the petition goes to the Calcutta High Court original side, the City Civil Court or a district judge, depending on address and value. Section 213 of the Indian Succession Act, removed in December 2025, dealt with Wills only and never touched estates without one.

  • Court choice: The Calcutta High Court original side, the City Civil Court, or a district judge at Alipore, Barasat or Howrah, according to address and estate value.
  • Court sequence: Petition with an asset schedule, citation to heirs and the public, any caveat, a hearing, then a bond before the grant issues.
  • After the grant: Deposits, shares and policies can be claimed, and the administrator can approach KMC for mutation with a certified copy.
  • Not the same as: A Warish affidavit or a succession certificate, each of which covers less ground than a full grant.

Which Paper Fits Your Kolkata Estate: Affidavit, Succession Certificate or Letters of Administration?

Families often jump to the heaviest document. The six rows below pair common Kolkata situations with the lightest paper that usually works, and show where letters of administration genuinely earn their place. Read the row closest to yours and let an advocate test it against the office concerned.

Your situationWhat you doOffice or authorityTypical time
One parent, modest savings account, every heir agrees, and the branch has said an affidavit will doLighter paper
Prepare an heirship affidavit and the other heirs' consents. A court petition would be more than the branch has asked for.
The bank branch, with an affidavit sworn before a Judicial Magistrate and, in practice, a ward councillor's endorsementA few weeks, set mostly by the ward office
Only deposits, shares and units must be collected, and no flat or plot is involvedSuccession certificate
Petition for a succession certificate under Part X of the Indian Succession Act. It covers debts and securities, not land.
A civil court with jurisdiction over the deceased's last residenceSeveral months, since notice is published
A flat, deposits and shares together, and a buyer or lender wants court authority behind whoever signsLetters of administration
Petition for a grant that appoints one administrator for the whole estate, with the other heirs named and noticed.
Calcutta High Court original side or City Civil Court inside the city; a district judge elsewhereSeveral months when uncontested, longer if anyone objects
A Will exists but names no executor, or the executor has died or declines to actGrant with Will annexed
A beneficiary petitions for letters of administration with the Will annexed, so that a person has court authority to carry the Will out.
The same forums as above; the advocate confirms which applies to the addressSeveral months, longer if the Will is challenged
Heirs disagree on shares, or one heir has gone silent and a sibling is unwilling to signContested route
Expect a caveat or objection. The notice stage lets each heir be heard, and a family settlement may still end the dispute sooner.
The court hearing the petition, with the advocate for each sideMany months, sometimes years, depending on the hearing list
A leasehold plot in Salt Lake or a flat in New Town, with no dispute among heirsCheck the lease office first
Ask the lease authority what heirship proof it will accept. A court grant may be unnecessary if its own format is satisfied.
Urban Development and Municipal Affairs Department, Bidhannagar Municipal Corporation, or New Town Kolkata Development AuthorityDepends on the file; confirm with the office

Time ranges are soft and describe files where every heir cooperates. A missing death certificate, mismatched names or arrears on the property tax can push any row into the slower column, which is why our first call is about papers and addresses, not forms.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

When a Kolkata Estate Needs Letters of Administration, and When It Does Not

A person who dies without a Will leaves property to the heirs that law names. For a Hindu, Buddhist, Sikh or Jain, the Hindu Succession Act, 1956 fixes those heirs, with the spouse, children and mother in Class I under Section 8. Christians and Parsis follow the intestate rules in Part V of the Indian Succession Act, 1925, and Muslims follow their personal law. In every case the heirs hold their shares from the moment of death. What they usually lack is one person with paper authority to collect, protect and deal with the whole estate.

Letters of administration supply exactly that. A court appoints an administrator, usually an heir, to hold the estate for everyone entitled and to account for it. For Hindus and several other communities, Section 218 of the Act lets a person who would take a share under the distribution rules apply. The grant does not make the administrator the owner. It makes the administrator the person the world can safely deal with.

Kolkata families tend to need a grant in a handful of situations:

Equally, many estates never need one. A modest balance at a branch that accepts an affidavit, a policy with a clear nominee, or a flat whose mutation KMC will carry out on heirship proof and consents, can all be settled without a court. A petition is a months-long process with notice to everyone, so it should be a decision, not a reflex.

Two side notes. First, where a Will exists but names no executor who can act, the same court route is used under the name letters of administration with the Will annexed. Section 213, which once tied many Calcutta Wills to a court grant, was removed in December 2025, and it never applied to estates without a Will. Second, if a minor is among the heirs, a guardian selling the minor's share in land needs the court's permission under the Hindu Minority and Guardianship Act, 1956, and an administration grant does not replace that step.

  • A buyer's lawyer or a housing lender will not accept a sale of the flat by the heirs unless court authority stands behind the signature.
  • The estate mixes a flat, deposits, shares, a locker and perhaps a shop, and the family wants one authority in place of five separate papers.
  • The heirs disagree about who should act, or one heir cannot be traced, and the notice stage of a petition is the orderly way to give each person a voice.
  • A bank or insurer has already turned away an affidavit and a succession certificate does not reach the asset.
  • The deceased left loans or other liabilities, and someone must settle claims in a sensible order.
  • Part of the estate sits outside West Bengal and needs a grant that is extended to reach it.

Court and Authority Map by Kolkata Address

A Kolkata postal address can sit in a municipal corporation, a development authority, a different district or a panchayat, and the judicial district does not always match the municipal one. The map below shows the bodies a family meets most often. Confirm the current position with each office, since boundaries and practice shift over time.

Inside the KMC area

Deaths are registered with the KMC birth and death registration unit, assessment sits with the KMC Assessment Department through the borough and ward offices, and the corporation has 144 wards today, with a 2026 amendment that would raise the number once new boundaries are notified. For the court, the choice is the Calcutta High Court original side or the City Civil Court at Bankshall, and the split has moved over the years with the valuation of the estate.

Salt Lake (Bidhannagar)

Property tax belongs to Bidhannagar Municipal Corporation. Many plots are leasehold from the state, so the Urban Development and Municipal Affairs Department publishes the procedure for changing the lessee after a death, with separate formats where a Will was probated and where it was not. The judicial district is North 24 Parganas, whose district judge sits at Barasat.

New Town

Administered by the New Town Kolkata Development Authority. Read the deed to see whether land is held on lease and ask the authority for its own mutation format. Court matters again fall within the North 24 Parganas district.

Howrah

A separate district with its own municipal corporation and its own district court, so a Howrah estate is not a Kolkata court matter at all.

The southern and eastern fringe

Garia, Sonarpur, Baruipur and similar areas fall under South 24 Parganas, where the district judge sits at Alipore. Some places near the KMC boundary look like Kolkata but belong to a different judicial district, and the advocate checks the notified limits for the exact address.

Panchayat areas

Land beyond municipal limits is recorded by the Block Land and Land Reforms Officer and the Gram Panchayat, with Banglarbhumi carrying the record.

Section 270 of the Indian Succession Act lets a district judge grant letters where the deceased had a fixed place of abode or any property, movable or immovable, within that judge's area. Section 300 gives the Calcutta High Court concurrent power, and in the city the City Civil Court Act of 1953 later shifted part of that work to the City Civil Court. Because more than one forum can be open, the advocate chooses one, discloses all assets in it, and avoids parallel proceedings over the same estate.

Other counters complete the picture. The Registrar of Assurances or the district sub-registrar records any deed that follows, CESC holds the electricity connection for most of Kolkata and Howrah, and the owners' association or cooperative society keeps its own register of members. None of these is bound by the grant until a certified copy reaches them, which is why we order several.

Petition, Citation, Caveat and Bond in Calcutta Practice

The steps below describe how a letters of administration petition ordinarily moves through the Calcutta courts. Local rules and registry practice are specific, so the advocate confirms each stage with the court concerned.

The petition

It names the deceased, the date and place of death and the last residence, and sets out who the heirs are and how each is related. It carries a schedule of assets with their value and a statement that no Will is known after a search. The petitioner swears the contents on affidavit. On the original side, testamentary petitions are handled under their own chapter of the High Court rules, and the registry is particular about the form of schedules and valuation.

Valuation and stamp

The stamp payable on the petition follows the declared value of the estate under the court stamp law of the state, which is why complete asset lists matter. We do not state amounts here. Ask the advocate for the figure that applies on the day of filing, and treat it as a reason to value assets honestly: an understated schedule can be challenged later.

Where the grant reaches

On the original side a grant is usually framed to take effect in West Bengal unless the petition seeks an extension. If the family holds shares in another state, or a plot elsewhere, the petition should say where each asset is so the court can decide how far the grant should travel.

Citation

In broad terms, the court calls on persons whose right to the grant is equal to or better than the petitioner's, unless they have already consented in writing. Section 283 of the Act also lets the court issue citations to anyone claiming an interest, and notice is published so strangers to the family can come forward. A signed consent from each heir shortens this stage, so it pays to collect them early.

Caveat and objection

Anyone who fears a grant may lodge a caveat. If the caveator then supports it with an affidavit, the matter commonly stops being a routine petition and is treated like a suit, with the petitioner and the caveator as opposing sides, pleadings and evidence. Sibling disputes over shares usually reach this point. An early conversation about a family settlement often saves more time than any hearing.

Hearing

If no one objects, the court normally proceeds on the affidavit and documents, sometimes after brief oral evidence on the family tree. Petitioners are seldom questioned at length, but the judge may call for a clearer asset schedule or for proof of a relationship.

Bond

Before the grant is sealed, the court usually directs the administrator to give a bond with one or more sureties, tied to the value of the estate, which protects other heirs and creditors if the administrator mismanages the estate. The registry prepares the bond in its own forms. Sureties are persons or institutions the court accepts as sound, and finding them is a practical task to begin early.

What the Grant Allows, and How It Meets KMC Mutation

Once letters of administration are sealed, the administrator can collect debts due to the estate, claim deposits and policies where no nominee takes them, ask a depository to transmit shares, open a locker with the bank's procedure, and represent the estate in disputes. Section 307 of the Indian Succession Act describes the power an executor or administrator has over the estate, but a particular grant or bond may carry conditions, for example about selling land without leave. Read the order carefully before acting on the property.

The administrator is a trustee in practice. Heirs remain entitled to their shares, and the Act expects an inventory of the estate and later an account to be placed before the court on the timetable it sets. A grant is also not a partition. It does not divide the flat among the heirs or record anyone's name in a municipal register on its own.

Where KMC comes in

Mutation is the entry in the KMC assessment register that shows who is liable for property tax on the premises. It records the payer, it does not create title, and a deed or grant of administration stays the source of the right. For many estates inside the city, KMC will act on a death certificate, an heirship affidavit sworn before a Judicial Magistrate, consents from the other heirs, the title deed and clear tax receipts, without any court grant. KMC may also send an inspector to see the premises.

A grant of letters of administration becomes useful when the file is contested, when the heirs cannot agree in writing, or when the officer wants a stronger paper before changing the assessee. Then a certified copy of the grant goes in with the application. Ask the ward or borough office whether it will record the administrator as representative or each heir by share, because practice has differed between files and officers.

Order of work

Most families do better to start both tracks together. While the petition is waiting for notice to run, the mutation papers can be assembled: arrears cleared, deeds copied, consents signed. After the grant arrives, the application can be filed straight away instead of months later, and the electricity connection, association records and any sale deed follow it.

Sale after the grant

A buyer will still want clear title, a registered deed and tax records in order. The grant helps a buyer's lawyer see who may sign, but it does not replace a registered sale deed. In Salt Lake and New Town, the lease authority's own transfer process may apply first.

A Realistic Timeline for a Kolkata Petition, in Soft Ranges

No honest timetable can promise a date, because the registry's list, the notice period and the family's own cooperation set the pace. These ranges describe an uncontested file and should be read as a guide.

Preparing the petition

A few weeks, mostly spent on death registration, collecting every heir's details and settling the asset schedule. Missing papers are the usual reason this stage stretches.

Filing and citation

A few weeks to a couple of months, since the registry has to scrutinise the petition, the court has to issue citation, and the notice has to run.

Waiting for objections

The notice period set by the court. If nobody lodges a caveat, the file moves on. If someone does, the timetable changes completely and the matter may run many months or more.

Hearing and order

Usually one or a few listings in an uncontested matter, with a few weeks between them.

Bond and sealing

A few weeks, longer if sureties are hard to arrange.

Mutation and bank claims

A few weeks to a couple of months after the grant, faster when the papers were prepared in parallel.

Taken together, a straightforward Kolkata petition usually spans several months from the first call to a usable grant. Contested petitions can take much longer, and a settled family agreement sometimes shortens the road more than any hearing date.

Mistakes That Stall Kolkata Letters of Administration Petitions

Filing in the wrong forum

A Kolkata postal address does not guarantee that the City Civil Court or the High Court original side is competent. Residence, assets and value all count.

Leaving out an heir

A Class I heir missing from the petition invites a caveat and may lead to the grant being revoked later.

Understating the estate

Omitting a locker, a share folio or a small account to keep the stamp lower invites a challenge, and a grant that rests on a hidden asset is open to attack.

Mixing up the papers

A Warish affidavit names heirs, a succession certificate lets a holder collect debts and securities, and a grant of letters of administration gives wider authority. Each is useful and none replaces the others.

Spelling mismatches

Chatterjee and Chattopadhyay, Banerjee and Bandyopadhyay, or a daak naam used in one deed and a formal name in another, hold up many files. One reconciliation affidavit settles it.

Ignoring a Will that turns up later

A grant can be revoked for just cause, which includes a Will surfacing after the petition said none was known. Search the house, the locker and the family advocate's records first.

Selling before reading the grant

Some grants or bonds restrict dealing with land. Read the conditions before signing an agreement for sale.

Leaving tax arrears pending

KMC and the other municipal bodies expect dues to be cleared, and a pending arrear stops mutation even after the grant.

Assuming mutation gives ownership

It records who pays the property tax. Title rests on succession, a registered deed or a court grant.

Eight Steps From a Kolkata Estate Without a Will to a Grant in Hand

The sequence below keeps the court track and the municipal track moving together so that neither waits idly for the other.

1

Map the estate and the heirs

We list every asset with its holder: the flat, accounts, shares, policies, locker and any dues. Next comes a family tree showing every heir by class, because a petition that leaves out one person invites a caveat and later revocation.

2

Gather death and identity papers

Death registration comes first, since every later paper rests on it. We check names across the death certificate, deeds, passbooks and identity cards, and record the place of death separately from the place of residence.

3

Test the lighter routes first

Before drafting a petition we ask the bank, registrar, association and KMC in writing what each will accept. Their replies show whether an affidavit or a succession certificate is enough, or whether a full grant is truly the sensible step.

4

Choose the forum and draft the petition

The advocate picks the Calcutta High Court original side, the City Civil Court or the district judge, based on residence, assets and value. The petition states the heirs, assets, valuation and the reasons the grant is sought.

5

File, pay the stamp and cite

The petition goes in with a valuation affidavit and the stamp worked out on the declared estate value. The court then directs citation to heirs who have not consented and public notice for anyone else with a claim.

6

Deal with caveats and objections

If nobody objects, the matter usually moves on the papers. If a caveat arrives, the proceeding changes character and evidence is led. We keep every heir informed and look for a settlement that closes the dispute.

7

Furnish the bond and take the grant

Once the court is satisfied, it directs an administration bond, usually with sureties. After the registry accepts the bond, the letters of administration are issued, and we order several certified copies so that each bank, office and association receives its own set.

8

Use the grant and update the records

The administrator claims deposits, shares and policies, then applies to KMC or the relevant body for mutation. The grant is shown to each institution in turn, and an inventory of the estate is kept for the court.

Documents for a Kolkata Letters of Administration Petition

No list is final. The court registry, a bank or a municipal office may ask for one more paper. Treat this as the opening set and send photographs first, so a spelling mismatch is fixed before any original leaves the family.

From the family

  • Identity and address proof of the petitioner and of every other heir, with the family tree
  • Marriage certificates, birth certificates or school records that link each heir to the deceased
  • A statement, sworn by the petitioner, that no Will is known to exist after a proper search of the home and lockers
  • Written consent from heirs who agree to the petitioner acting, signed and witnessed as the advocate directs
  • A list of every asset and debt with approximate values, including items outside the city
  • For a family member living overseas, a power of attorney and affidavits signed before a notary and legalised for India

From Kolkata offices and records

  • Death certificate from the KMC birth and death registration office, or from the registrar for the place of death
  • Title deeds for the flat, house or plot, with the latest KMC assessment bill and tax receipt
  • Bank passbooks, fixed deposit receipts, locker agreement, demat statements and insurance policy papers
  • Nominee details recorded on each account or policy, so the advocate can see which asset needs no petition
  • Association dues clearance or the cooperative society share certificate for a flat
  • CESC electricity bill and any tenancy papers that show how the property is being used

Why Kolkata Families Hand Letters of Administration Petitions to PropResolve

  • The petition is chosen, not assumed. Each file begins with a written check of what the bank, registrar and KMC will accept, so a family files only when the route is truly needed.
  • The address picks the court. KMC wards, Salt Lake, New Town, Howrah and the district fringes are sorted out before drafting, so nothing is filed at the wrong counter.
  • Court and mutation run together. While the petition is pending we prepare the KMC papers, so mutation can start as soon as the grant is certified.

Frequently Asked Questions

Is a letter of administration compulsory after a death in Kolkata?

+
No. Heirs inherit under the succession law that governs their community, and that happens at the moment of death without any court order. A grant is a tool, not a condition. It is useful when a bank, buyer or registrar insists on court authority, when heirs cannot agree who should act, or when many kinds of asset must be dealt with together. Many Kolkata estates are settled with lighter papers, so we first ask each institution in writing what it will accept before recommending a petition.

What is the difference between letters of administration, a succession certificate and a Warish affidavit?

+
A Warish or heirship affidavit is a statement of who the heirs are, often sworn before a Judicial Magistrate and endorsed by a ward councillor in Kolkata practice. A succession certificate, under Part X of the Indian Succession Act, lets its holder collect debts and securities such as deposits and shares, but it does not deal with land. Letters of administration appoint an administrator for the whole estate, including immovable property. The right choice depends on the assets and on what the institution concerned will accept.

Which court hears a letters of administration petition for a Kolkata address?

+
It depends on where the deceased lived, where the assets are and how the estate is valued. Inside the city, the Calcutta High Court original side and the City Civil Court share testamentary and intestate work, and the split has changed over the years. Areas on the fringe, and places such as Salt Lake or Howrah, can fall under a district judge at Alipore, Barasat or Howrah instead. Section 270 of the Act lets a district judge act where the deceased lived or held property. The advocate confirms the forum for the address.

Does the Calcutta High Court still take these petitions on its original side?

+
Yes. The original side retains testamentary and intestate jurisdiction in Kolkata and has its own rules for how such petitions are filed, cited and heard. In the city, the City Civil Court Act of 1953 later gave the City Civil Court part of the work, depending on estate value, so the High Court is not the only city forum. Practice and valuation limits are revised from time to time, which is why we check the current position with the registry before drafting any petition.

How does citation work, and who gets notice?

+
After filing, the court directs notice so that people with a stake can come forward. In broad terms, those whose right to the grant is equal to or better than the petitioner's are cited personally unless they have already consented in writing. Notice is also published so that any other claimant can appear. A signed consent from each heir shortens this stage, and it is the most practical thing a family can prepare while the petition is still being drafted. Notice requirements differ between courts, so the advocate confirms the order of each.

What happens if a relative files a caveat?

+
A caveat is a formal objection lodged to stop a grant being made without hearing the objector. When the caveator supports it with an affidavit, the matter commonly turns from a routine petition into a contested proceeding, with sides, written statements and evidence. That takes longer and calls for more of the family's attention. Many such disputes end in a family settlement after the first round of hearings, so we advise keeping communication calm and written, since messages sent now can matter in court later.

What is the administration bond, and who can stand surety?

+
Before the grant is sealed, the court usually directs the administrator to give a bond, normally with one or more sureties, tied to the value of the estate. It protects other heirs and creditors if the estate is mismanaged. The registry prepares the bond in its own forms, and sureties are persons or institutions the court accepts as financially sound. Finding sureties takes time, so we raise the point early and the family can think about who might stand surety long before the order is made.

What can an administrator do once the grant is issued?

+
With certified copies in hand, the administrator can collect debts due to the estate, claim deposits and policies where no nominee takes them, ask a depository to transmit shares, deal with a locker under the bank's procedure and apply for mutation. Dealing with land is subject to the Indian Succession Act and any condition in the grant or bond, so the order should be read before a sale. The administrator holds the estate for all entitled heirs, and the court can ask for an inventory and an account.

Does the grant mutate the property in KMC automatically?

+
No. Mutation is a separate application to the KMC Assessment Department through the borough or ward office, and it records who pays the property tax. Many files are mutated on a death certificate, an affidavit of heirship, consents from the other heirs, the deed and clear tax receipts, without any court grant. A certified copy of letters of administration is the stronger paper to attach when a file is contested. Tax arrears, mismatched names or an unsigned heir are the usual reasons for delay.

Does the 2025 removal of Section 213 change anything for an estate without a Will?

+
Not directly. Section 213 of the Indian Succession Act, which once tied many Hindu, Buddhist, Sikh and Jain Wills linked to Calcutta to a court grant, was removed by the Repealing and Amending Act, 2025, with assent on 20 December 2025. It concerned Wills, so an estate without one was never affected. What the change does mean is that probate on a Will is no longer compulsory by statute, although a bank or registrar may still ask for a court order. Letters of administration remain a choice for the family.

Can a heir living abroad take part in the petition?

+
Yes. An NRI or OCI heir can be a petitioner, a consenting heir or a person who receives notice. Papers signed abroad, such as a power of attorney, an affidavit or a consent, are notarised and then apostilled or attested at the Indian mission, depending on the country. A representative in Kolkata attends hearings. Our guide to the power of attorney for overseas heirs explains what such a document should cover before any signing begins.

Can a grant be challenged or revoked after it is issued?

+
Yes, in limited cases. Section 263 of the Indian Succession Act allows revocation for just cause, for example where the petition concealed something material, the grant was obtained by a false statement, or a valid Will surfaces. That is why the petition should list every heir and every asset known to the family, and why a thorough search for a Will matters. A grant obtained on a complete and honest petition is much safer for banks, buyers and the administrator.

How long will a Kolkata petition take, in plain terms?

+
An uncontested petition usually takes several months from the first call to a usable grant. Preparing the papers takes a few weeks, citation and the notice period take a few weeks to a couple of months, and the hearing, the bond and the sealing add a few weeks more. A caveat can stretch the matter by many months or more. Mutation and bank claims follow, and move faster when the papers have been prepared in parallel. The advocate gives a more precise view after the registry has listed the matter.

What should we bring to the first call about a Kolkata letters of administration petition?

+
A death certificate, if registration is complete, and the names, ages and relationships of every heir. Add whatever you have of the title deed for the flat or plot, the latest KMC bill, the bank and share statements, the insurance papers and any Will you have found. Tell us the ward or neighbourhood, and what the bank or buyer has said so far. With that, we can tell you which court has jurisdiction, whether a lighter paper might do, and what to prepare first.
