Five Documents Decide a Mumbai Property Estate: Which One Is Yours?
A family abroad with property in Mumbai usually needs one or more of five papers: a will, a power of attorney, probate or letters of administration, a heirship certificate, or a succession certificate. Which one depends on whether a will exists and what the asset is. Probate is no longer compulsory by statute, because Section 213 of the Indian Succession Act was removed in December 2025, though societies and banks may still ask for it. Each paper can be arranged from abroad with documents signed before a notary or consular officer.
- Flat in a society: moves through the managing committee, backed by written consent from the other heirs
- Bank balances and shares: usually need a court order, or a heirship paper that the institution agrees to accept
- Will: probate is optional by law, yet a court grant is still the strongest proof of a will
- Power of attorney: signed abroad, then stamped in Maharashtra within three months of first arriving
Which Situation Are You In? Find the Row That Matches Your Family
Mumbai families rarely face just one question. A flat, a savings account and a folder of shares can each need a different paper. Read down the first column, find the story closest to yours, and follow the link to the page that explains that route in detail.
| Your situation | Where to start | Office or authority | Typical time |
|---|---|---|---|
| A parent died and left a will covering a Mumbai flat | Probate or direct transfer Often optional now, but ask the society what it needs. See probate in Mumbai for NRIs. | Housing society first; the Bombay High Court if a grant is needed | Weeks with the society; several months through court |
| A parent died without a will | Heirship certificate Read the Mumbai heirship certificate guide before filing anything. | The authority that handles it for your purpose, either a revenue office or a civil court; confirm before filing | A few weeks to a couple of months, depending on the route |
| You need to claim bank deposits, shares or mutual funds | Succession certificate Details on the succession certificate in Mumbai page. | City Civil Court or Bombay High Court, depending on value and the notifications in force | Several months, because public notice is part of the process |
| You want to sell, rent out or register Mumbai property from abroad | Power of attorney See power of attorney for Mumbai property. | Sub-registrar for registration; stamp office for adjudication | A few weeks from drafting to a stamped document |
| You want to protect your own Mumbai flat for your family | Will Start with will drafting and registration in Mumbai. | Signed before two witnesses; registration at a sub-registrar is optional | A few weeks, mostly drafting and review |
| The society has a nominee on record, but the heirs are not all in agreement | Society transmission A registered release deed often settles who keeps the flat. See the NRI release deed in Mumbai. | Managing committee; the co-operative registrar or court if the dispute continues | Weeks if all heirs sign; longer if anyone objects |
A family with several kinds of asset will usually fit more than one row. The order of filing matters: a certificate accepted at one desk often supports the next, so we sequence the steps after the first call.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentKey Facts for Mumbai Property Owners Abroad (October 2026)
Anyone looking for NRI legal services Mumbai property work can cover usually starts with the same handful of questions. Five points answer most of them, and each is explained in more detail further down.
Probate is optional
Section 213 of the Indian Succession Act used to make probate compulsory for Hindu, Buddhist, Sikh and Jain wills tied to the old presidency towns, Mumbai among them. The Repealing and Amending Act, 2025 removed it, with assent on 20 December 2025. A society, bank or buyer's lender may still ask for a court grant.
Heirship papers depend on purpose
A certificate that names the heirs is issued by the authority that handles it for your purpose, which may be a revenue office or a civil court. Confirm the right one with the receiving institution before filing.
A power of attorney signed abroad has a deadline
In Maharashtra it should be stamped within three months of first being received in the state, under Section 18 of the Maharashtra Stamp Act. Close family members usually attract concessional stamp duty, while a broad power in favour of a stranger is treated much more strictly; check the current position on the state portal.
A nominee is not the owner
The society admits the nominee as a member, but the nominee holds the flat subject to the rights of every legal heir.
Most of the work happens without you
You sign once abroad. A family member in Mumbai or your representative under a power of attorney deals with the society, the ward office, the sub-registrar and the court.

Probate is a court's confirmation that a will is genuine and that the executor may act on it. Letters of administration do a similar job where there is no executor or no will. For Mumbai estates the petition goes to the Bombay High Court or the City Civil Court, depending on the value of the estate and the notifications in force, and your advocate confirms the forum before drafting. Since December 2025 probate is optional, but it remains the safest protection when the flat is valuable, when heirs disagree, or when a society or buyer's bank insists. Full detail is on our page about probate in Mumbai for NRIs.
When there is no will, many Mumbai offices want something that formally names the heirs. The certificate comes from the authority that handles it for your purpose, either a revenue office or a civil court, and the choice depends on what you will use it for. It is the usual starting point for the society, the BMC property tax record, pensions and utilities. Heirs abroad sign consents and affidavits there, and a relative or attorney in India handles the filing. Read the heirship certificate in Mumbai guide for the office-by-office detail.
A succession certificate is a court order that lets an heir collect debts and securities such as fixed deposits, savings balances, shares, debentures and mutual fund units when the person died without a will. The court advertises the petition so that anyone with a claim can object before it is granted. It does not move the flat itself. The succession certificate in Mumbai page walks through the petition and what the court asks for. A national overview sits on our NRI succession certificate page.
A power of attorney lets someone in India sign and appear for you. For a Mumbai matter it should be specific, naming the acts it allows, such as dealing with the society, filing a petition, signing a release deed or completing a sale. A power that authorises a sale or other registrable act is normally expected to be registered, and one signed abroad has to be stamped in Maharashtra within three months of first arriving. Our guide to the POA for overseas legal heirs in Mumbai explains the drafting, and the blog on what to include in a power of attorney lists the clauses.
You can make a valid Indian will in Dubai, London or New Jersey. It needs your signature and two witnesses, who should not be beneficiaries. There is no stamp duty on a will, and registration at a Mumbai sub-registrar is optional, though a registered will is harder to dispute and easier for the family to find. If you also hold a UAE or DIFC will, the two documents should be worded so that neither cancels the other. See will drafting and registration in Mumbai and the wider NRI will drafting and registration page.

Mumbai's Map: BMC Ward, Revenue District and City Survey Office
A Mumbai address sits on three overlapping maps, and each answers a different question. Mixing them up is the most common reason a file is returned.
The BMC ward
The Brihanmumbai Municipal Corporation divides the city into 24 administrative wards, lettered from A to T, with some split into east, west, north, south or central parts. The ward registrar of births and deaths issues the death certificate, and the ward's assessment and collection department holds the property tax record. Death registration has a statutory window of 21 days, and a later entry takes extra steps, so register early and ask for several certified copies.
The revenue district
Greater Mumbai is made up of Mumbai City and Mumbai Suburban, each with its own Collector. A revenue paper such as a heirship certificate follows this map, not the ward map. A flat on Malabar Hill is in D ward for the BMC and in the city district for revenue purposes; a flat in Andheri West is in K West ward and in the suburban district. One address, two sets of offices.
The City Survey Office
Land in Mumbai is recorded under City Survey numbers, and the property card is the record of who holds the land. For a flat in a cooperative society the card usually stands in the name of the society or the landowner, so an individual flat owner may not appear on it at all. It matters more for a bungalow, a plot, a chawl room or a ground-floor shop. Ask the city survey office for the card early. If the card is out of date, correcting it can take longer than the society step.
Beyond the city limits
Thane, Navi Mumbai, Mira-Bhayandar and Vasai-Virar each run on their own municipal corporation and revenue district. A family that says it is from Mumbai may therefore need two sets of filings. We map every asset to its ward, district and court before drafting anything.
Transferring a Mumbai Society Flat After a Death, Step by Step

Most Mumbai flats are held as shares in a cooperative housing society registered under the Maharashtra Co-operative Societies Act, 1960. Section 30 of that Act deals with what happens to a deceased member's share and interest. This is the task we handle most often for NRI families, and the sequence below holds in most buildings.
Check the society's records
Ask the secretary in writing whether a nomination is on file, whether the share certificate is complete and whether the member left a will.
If a nominee is on record
the society can admit that person as a member. The nominee holds the flat subject to the rights of all legal heirs, so get the other heirs' consent in writing.
If there is no nominee
the society usually asks for the will or probate, or a heirship document, together with an indemnity bond and no-objection letters from the other heirs.
Heirs abroad sign abroad
No-objection letters and affidavits are executed overseas and attested by the route that suits the country, described in the section on signing abroad below.
The managing committee passes a resolution
updates the register of members and issues a fresh or endorsed share certificate. Some societies wait for objections before they meet.
Update every record
The BMC property tax entry, the electricity and piped gas accounts, and where relevant the property card at the City Survey Office should all carry the new name.
If siblings step aside
a registered release deed puts the flat in one name and makes a later sale much easier.
Older buildings add wrinkles. Where the conveyance of land to the society is still pending, share transmission can usually proceed, but a redevelopment agreement cannot be signed until the heirs' names are on the society's records. Flats allotted through MHADA or a slum rehabilitation scheme may carry their own transfer conditions, and a deceased tenant's rights in old rent-controlled premises raise separate questions. We flag these on the first call, before any paper is signed.
Bombay High Court or City Civil Court: Who Hears What
Mumbai has two judicial addresses that matter for succession work. The Bombay High Court at Fort has an original side that hears testamentary and intestate matters for Greater Mumbai, which is why probate and letters of administration for Mumbai estates usually go there. The City Civil Court sits at Fort and also has a branch for the suburbs at Dindoshi, and succession certificate petitions can be filed there or before the High Court, depending on the value of the estate and the notifications in force.

We do not rely on a rule of thumb for this choice. The pecuniary limits have been revised from time to time, and a petition filed in the wrong forum loses months. Our advocate checks the current position against the asset list and confirms the forum in writing before a single page is drafted.
Whichever court is used, the pattern is similar. The petition lists the assets and every heir, supported by affidavits. The court directs notice to the family and a public advertisement inviting objections. If nobody objects, the matter is heard and the order follows. A caveat or an objection turns it into a contested proceeding, which runs far longer. For an unopposed petition an overseas heir seldom needs to appear in person; the advocate acts on a vakalatnama that you sign abroad.
Signing Abroad: UAE, USA, UK and Other Countries
Mumbai offices accept documents signed abroad only if they carry the right attestation, and the route depends on the country.
United Arab Emirates
The UAE is not a member of the Apostille Convention, so an apostille will not do. Papers are usually either signed before a consular officer at the Consulate General of India, Dubai (or the Embassy in Abu Dhabi), or notarised in the UAE and then attested through the UAE foreign ministry (MOFA) and the Indian mission. The embassy site has posted a public notice that consular services, which an outsourced centre used to handle, are now provided directly by the missions, so confirm the current counter and appointment process with the mission before you travel to sign.
USA, UK, Singapore and Australia
These countries are members of the Apostille Convention. Sign before a notary and obtain an apostille from the competent authority, and Indian offices will normally accept it without a further consular step.
Elsewhere
Practice varies. Some countries objected to India's accession to the convention, and for others the position has changed recently. We tell you the route for your country before you book an appointment.
A few habits save a second round of signing: sign in front of the notary with the same name as on your passport, never date or fill blanks in advance, keep every page of a multi-page document together, and send originals by tracked courier so that the arrival date is on record for stamping purposes. Official reference pages are linked in the sources at the end of this page.
Documents NRI Families Usually Need for a Mumbai Matter
The exact list depends on the route, and a society, bank or court may add to it. This table shows where each common document comes from and whether it needs attestation abroad.
| Document | Where it comes from | Attested abroad? |
|---|---|---|
| Death certificate | BMC ward registrar of births and deaths | No |
| Will (original) or probate | The family, or the court that granted it | No |
| Heirship or succession certificate | Revenue office or civil court, depending on the paper | No |
| Passport, visa page and overseas ID of each heir | Each heir | Copies, often self-attested |
| No-objection letters and consent affidavits from heirs abroad | Signed abroad | Yes |
| Power of attorney for the heir in India | Signed abroad | Yes, then stamped in Mumbai |
| Share certificate, agreement for sale and BMC tax receipts | Society and the owner's records | No |
Keep several certified copies of the death certificate. Each office keeps one, and getting more later is slower than asking for them at the start.
How Long Each Mumbai Route Usually Takes
Timing in Mumbai is set by committees, notice periods and courier schedules more than by the law itself. These are soft ranges for uncontested matters, and we give a firmer schedule after the first call.
| Matter | Typical time in Mumbai |
|---|---|
| Society transfer with a nominee and agreeing heirs | A few weeks once the society holds every consent |
| Heirship certificate | A few weeks to a couple of months, depending on the route and the office |
| Succession certificate (uncontested) | Several months, because of the public notice |
| Probate (uncontested) | Several months, and longer if anyone objects |
| Power of attorney, from drafting to stamped in Mumbai | A few weeks, mostly signing and courier time |
The usual delays are the same everywhere: a document from an heir abroad that was attested the wrong way, a society committee that meets only occasionally, and a court's notice period. Choosing the right route on day one removes the first, and sequencing the filings reduces the others.
Mistakes That Delay Mumbai Families by Months
Most delays we see are avoidable. The table lists the five that come up most, with the fix for each.
| Mistake | What happens | Fix |
|---|---|---|
| Treating the nominee as the owner | Other heirs challenge a later sale | Get release deeds or written consents before transferring |
| No-objection letters signed abroad without attestation | The society or bank rejects them | Use the consular or apostille route that fits the country |
| Stamping the power of attorney after three months | Penalty, or the document cannot be used until it is regularised | Log the arrival date and adjudicate at the stamp office promptly |
| A broad general power in favour of a non-relative | Heavier stamp treatment and a risk of misuse | A specific power to a family member where possible |
| A DIFC or UAE will only | Indian institutions hesitate to act on it | A separate Indian will covering the Mumbai assets |
Two quieter mistakes deserve a mention. The first is leaving out an heir, often a daughter, a widow or the child of a predeceased sibling, which can invalidate a later transfer. The second is mismatched names across the share certificate, the passbook and the passport; a short identity affidavit fixes it, but it is easier before the file goes in than after.
After the Transfer: Records, Utilities, Sale and Sending Money Abroad
The certificate or court order is a key, and each institution then has its own door. Keep a running list so nothing is forgotten.
Utilities and records
Electricity in Mumbai comes from BEST in much of the island city, Adani Electricity across most suburbs, Tata Power in some pockets and MSEDCL in parts of the eastern suburbs. Each wants a change-of-name application with the society's letter. Mahanagar Gas does the same where the building has a piped connection. The BMC property tax entry is updated at the ward office.
Banks, lockers and investments
Branches follow their own settlement policies within the Reserve Bank of India's framework, and lockers are normally opened only in the presence of bank officers, often with every claimant. Depositories and fund registrars generally want a court-backed document for larger holdings.
If you plan to sell
The buyer deducts tax at source on a non-resident seller's sale under Section 393(2) of the Income-tax Act, 2025 (earlier Section 195). A lower or nil deduction certificate, applied for on Form 128 (earlier Form 13), can avoid locking up the whole sale amount. Plan the sale after the paperwork is complete, not alongside it. See mutation and sale of inherited property by NRIs in Mumbai.
Sending money home
Sale proceeds of inherited property normally go into an NRO account, and remittance abroad is subject to the annual ceiling set by the Reserve Bank, with Forms 145 and 146 (earlier 15CA and 15CB) prepared with a chartered accountant. Our blogs on repatriation of sale proceeds and tax on the sale of inherited property cover the mechanics.

From Your Home Abroad to Mumbai's Counters: Eight Steps
You sign once abroad, and our Mumbai team takes every counter, inquiry and hearing that needs someone present.
Assessment call
A short call in your time zone. We ask where the owner lived, what they held and whether a will exists, then tell you which Mumbai office or court each asset needs and in what order to approach them.
Choose the documents
We match each asset to one of the five papers, decide whether probate is worth pursuing or the society will accept a direct transfer, and confirm which heirship route the receiving institution wants.
Collect the papers
You receive a two-column checklist. Your column covers passport, OCI and PAN. The Mumbai column covers the death certificate, share certificate, bank papers and tax receipts that relatives or our team collect.
Sign abroad
We prepare the power of attorney, affidavits and no-objection letters. You sign before a notary or consular officer, with an apostille where the country is a member and mission attestation where it is not, as in the UAE.
Originals reach Mumbai
Originals are couriered by tracked service. We log the arrival date because the power of attorney should be stamped within three months of first reaching Maharashtra, and a deed signed abroad has its own registration window.
File and give notice
The society application, the revenue file or the court petition goes in, depending on the asset. Court files carry notice to the heirs and an advertisement inviting objections, so we track that period closely.
Hearing, inquiry or committee meeting
Our advocate or representative attends on your behalf. In unopposed matters your presence is rarely needed, and if an officer or judge does ask for you we say so early so you can plan around it.
Records, sale or remittance
The new owner's name goes onto the society register, BMC tax record and utilities. If you plan to sell, we coordinate tax deduction and remittance with your chartered accountant, so the money reaches you cleanly.
