Which Document Does an NRI Heir Need in Mumbai? The Short Answer

Short answer

In Mumbai the Tehsildar's heirship certificate usually satisfies pension offices and utility companies, while banks, registrars and housing societies often ask for a court order: a succession certificate, or probate and letters of administration where a Will or immovable estate is involved. Probate is no longer compulsory by statute, because Section 213 of the Indian Succession Act was removed in December 2025, yet institutions still commonly insist on it. An NRI can run any of these routes through a power of attorney and documents signed before a notary abroad, without flying to Mumbai.

  • Heirship certificate: Tehsildar of Mumbai City or Mumbai Suburban, mainly for pensions and utilities
  • Succession certificate: a Bombay court order for bank balances, deposits, shares and fund units
  • Probate: a Bombay High Court grant when a Will exists, still widely requested
  • Society flat: transmission through the cooperative housing society, backed by every heir's consent

Which Document Fits Your Mumbai Asset: Heirship Certificate, Succession Certificate or Probate?

Mumbai institutions are particular about paperwork, and a certificate that one office accepts may be turned away by the next. Match each asset you want to move with a row below before spending months on the wrong application. A family holding several kinds of asset will usually fit more than one row.

A building sits in one revenue district and one BMC ward, and these do not always match what the postal address suggests. Confirm both for the deceased's last residence before filing. Applying at the wrong office is one of the commonest reasons a Mumbai file is sent back.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

Which Office Handles Your File: Mumbai City, Mumbai Suburban or Thane?

Greater Mumbai has one municipal corporation but two revenue districts, and a heirship certificate follows the revenue map, not the BMC map. Mumbai City district is the old island city, running from Colaba up to Mahim and Sion: Fort, Cuffe Parade, Malabar Hill, Girgaon, Byculla, Worli, Dadar, Matunga and Wadala. Its Collectorate is at Old Custom House in Fort.

Mumbai Suburban district takes in everything beyond that line: Bandra, Santacruz, Juhu, Andheri, Goregaon, Malad, Kandivali, Borivali and Dahisar on the western side, and Kurla, Chembur, Ghatkopar, Powai and Mulund on the eastern side. Its Collectorate is in the Administrative Building in the government colony at Bandra East, and the district works through three tehsils: Andheri, Borivali and Kurla. Which tehsil owns your file depends on how the locality is recorded in the revenue papers, so we check that against the property documents before filing.

The BMC is a different layer. Its twenty-four administrative wards, lettered A to T, register deaths and hold the property tax record. A flat on Malabar Hill is in D ward for the BMC and in Mumbai City for the Tehsildar. A flat in Andheri West is in K West ward and in Mumbai Suburban. One address, two offices, and each wants different papers.

The usual rule is to apply where the deceased last lived. When the asset is elsewhere, for instance a Dadar resident who owned an Andheri flat, we ask both the revenue office and the receiving institution which certificate they will honour before choosing. Addresses beyond the city limits, such as Thane and Navi Mumbai, run on a different map altogether, covered in a later section of this page.

How a Mumbai Housing Society Actually Transmits a Flat, Step by Step

Most Mumbai flats are owned as shares in a cooperative housing society registered under the Maharashtra Co-operative Societies Act, 1960. Section 30 of that Act directs the society to transfer a deceased member's share and interest to the nominee on record or, where there is none, to the person who appears to the managing committee to be the heir or legal representative. That sounds quick, and it can be, provided the file is built the way committees expect.

  • Written intimation. The family writes to the secretary with a copy of the BMC death certificate and asks for the society's record of the member: share certificate number, nomination form on file and the latest maintenance statement.
  • Identify the heirs. Without a Will, heirs of equal rank under the applicable personal law all take a share. A nominee does not push them aside.
  • Consents and releases. Each heir who does not want the flat signs a no-objection or a release. Heirs abroad sign before a notary and have the paper legalised.
  • Indemnity bond. An undertaking on stamp paper that protects the society if an unknown claimant appears later. Heirs overseas execute it abroad.
  • The transmission request. A letter to the secretary with the heirship document or court order, the bond, the consents and the nomination papers. Some societies also advertise the claim and wait for objections.
  • Committee resolution. The managing committee records the transmission in a resolution, updates the register of members and issues a fresh or endorsed share certificate.
  • Fresh nomination. The new member files a new nomination at once, so the next family does not face the same ordeal.
  • Downstream updates. Parking allotment, BMC property record, electricity account and any redevelopment papers are then brought into the new name.

What the nominee can and cannot do. The Bombay High Court has repeatedly held that a nominee represents the heirs for the society's purposes and does not take the flat for himself or herself. A brother in Mumbai who is named as nominee can start the paperwork, but buyers' lawyers and lending banks will look for every heir's signature before a sale or mortgage.

Redevelopment and older buildings. In many older Mumbai buildings the conveyance of land to the society is still pending. That does not stop transmission of the shares. If redevelopment is under discussion, however, the heirs' names must be on the society's records before anyone can sign the development agreement or the permanent alternate accommodation agreement. Flats allotted under MHADA or slum rehabilitation schemes may carry their own transfer conditions, and a deceased tenant's rights in old rent-controlled premises raise separate questions; we flag these early.

The Bombay Court Route in Plain English

Two judicial addresses matter. The Bombay High Court at Fort retains an original side that hears testamentary and intestate matters for Greater Mumbai, which means probate and letters of administration for Mumbai estates usually go there. The City Civil Court sits at Fort and at Dindoshi, and succession certificate petitions can land in either that court or the High Court, depending on the notifications in force and the value of the estate. Our advocate confirms the forum before drafting a single page.

Succession certificate authorises collection of debts and securities: bank deposits, shares, units. Probate is the court's seal on a Will. Letters of administration are granted where there is no Will, or no executor, and are the court-backed way to deal with immovable property in the deceased's name. See our pages on the NRI succession certificate and the Mumbai letters of administration route.

What happens after filing. The petition lists the assets and every heir, supported by affidavits. The court directs notice to the family and a public advertisement inviting objections. If nobody objects, the matter is heard and the order follows. For letters of administration the court may ask for an administration bond, and for a succession certificate it may ask for security. Anyone with a claim can lodge a caveat or file an objection, which turns the matter into a contested proceeding that takes much longer.

For an overseas heir. Affidavits are sworn before a notary abroad and apostilled or attested. The advocate acts on a vakalatnama signed by you. In an unopposed petition your own appearance is seldom needed, and the courts in Mumbai have at times allowed video attendance, though this is never guaranteed. If a judge asks for you, we tell you as soon as we know and plan your travel around the date.

The Bombay court route is slower than a Tehsildar file, but it is the one that banks, registrars and depositories trust most, which is why it is often worth doing alongside the revenue certificate and not instead of it.

Changing Names After the Certificate: BMC, Electricity, Gas, Banks and Lockers

The certificate or court order is only the key. Each Mumbai institution then has its own door, and keeping a running list saves months.

  • BMC property tax. The Assessment and Collection department of the ward office changes the name in the tax record on application, with the death certificate, the heirship or court document, the society's transmission letter and the latest tax receipt. Depending on how the building is assessed, the bill may be in the society's name or the member's, so ask the secretary which applies.
  • Electricity. Supply in Mumbai comes from BEST in much of the island city, from Adani Electricity across most suburbs, from Tata Power in some pockets and, in parts of the eastern suburbs such as Mulund and Bhandup, from Mahavitaran (MSEDCL). Each asks for a change-of-name application with the society's no-objection letter and the heirs' documents.
  • Piped gas. Mahanagar Gas, where the building has a connection, updates the account on a similar set of papers.
  • Bank accounts and lockers. Branches follow their own settlement policies within the Reserve Bank of India's framework. Lockers are usually opened only in the presence of the bank's officers and, in many cases, all claimants, with an inventory prepared on the spot.
  • Demat accounts and mutual funds. Transmission goes through the depository participant or the registrar and transfer agent. For larger holdings they commonly want a succession certificate or probate.
  • Insurance and provident fund. Claims are made with the insurer or the regional Provident Fund office, and many accept the Tehsildar's certificate alongside their own forms.

Where an NRI is the only heir who will keep the flat, we recommend updating every account to the same spelling of the name, since mismatches between PAN, Aadhaar and passport slow Mumbai bank desks down more than any other single issue.

If the Deceased Lived in Thane, Navi Mumbai or Mira-Bhayandar

Many families who say they are from Mumbai actually lived in Thane, Navi Mumbai, Mira-Bhayandar or Kalyan, and the legal map changes the moment the city limit is crossed. Thane and the northern Navi Mumbai nodes (Airoli to Belapur) fall in Thane district under a different Collector and Tehsildar from the two Mumbai districts. Panvel and the southern nodes such as Kharghar, Kamothe and Ulwe sit in Raigad district, and Vasai-Virar in Palghar district.

Municipal records change too. A Thane flat is entered in the Thane Municipal Corporation's property tax register, a Vashi or Nerul flat in the Navi Mumbai Municipal Corporation's, and a Mira Road flat with the Mira-Bhayandar Municipal Corporation. Navi Mumbai plots and flats originally allotted by CIDCO may also need a transfer step with CIDCO, in addition to society transmission, so we check the allotment papers early.

The Bombay High Court's original side covers Greater Mumbai. A petition concerning a Thane address is therefore normally filed in the district court that has jurisdiction there, and we confirm this before drafting. The housing society rules under the Maharashtra Co-operative Societies Act apply across all of these areas, so the transmission steps described above stay the same.

Families with property on both sides of the city limit, for example a Powai flat and a Thane plot, should expect two sets of filings. We map each asset to its revenue office, municipal body and court at the start, so the heirship documents and consents are drafted once and used for both.

Pitfalls That Catch Overseas Heirs of Mumbai Estates

  • Late stamping of the power of attorney. A power signed abroad generally has to be stamped under the Maharashtra Stamp Act within three months of first being received in Maharashtra, or it is treated as not duly stamped and cannot be registered or relied on until the deficit duty and a penalty are paid. Couriers lose time, so the arrival date is tracked from the day the parcel lands.
  • Late presentation for registration. A deed signed abroad, such as a release, can be presented for registration within four months of arrival in India under Section 26 of the Registration Act, which leaves acceptance to the registering officer. Missing that window can mean starting the signing round again.
  • Treating the nominee as the owner. Heirs sometimes sign everything over to a nominee out of trust and later discover that they cannot undo it. Decide deliberately, and record the family arrangement in a deed.
  • Missing heirs. Daughters, a widow and children of a predeceased child are easy to forget. An omitted heir can later challenge a certificate, and the society or bank may be left holding a defective record.
  • Name mismatches. The deceased may appear as one name on the share certificate and another on the bank passbook. A short affidavit of identity usually resolves it, but it is better done before filing.
  • Wrong notarisation format. A notary stamp without the correct apostille, or an apostille from the wrong authority, forces a second round. We give you a signing sheet that matches your country's rules.
  • Ignoring society dues and redevelopment notices. Arrears or a pending redevelopment resolution can freeze a transmission. Ask the secretary for a written position at the outset.
  • Selling in a hurry. A buyer's bank will want clean title, and tax deducted at source on a non-resident seller's sale can lock up cash. Plan the sale after the paperwork is complete, not alongside it.

Why Mumbai Estates Stall When the Heir Lives Overseas

Mumbai is a city of gatekeepers. The society secretary wants originals, the bank branch wants a signed claim form, the BMC ward wants a stamped application and the depository wants its own forms, and almost all of them expect someone to turn up in person. An heir in Sydney, Dubai or Toronto cannot do that, so files stall long before any law is in dispute.

The legal position for an NRI heir is straightforward. Your residence abroad, or an OCI card, does not alter who inherits. The Foreign Exchange Management Act lets a non-resident Indian or OCI cardholder receive any immovable property in India by inheritance from a resident, and that includes agricultural land. Who the heirs are is decided by the deceased’s personal law: for Hindus, Sikhs, Jains and Buddhists, the Hindu Succession Act, 1956, which ranks the widow, children and mother together in the first group of heirs; for Muslims, their personal law; for Christians and Parsis, the Indian Succession Act, 1925.

High property values add caution. Mumbai committees and bank managers are wary of a stray claimant appearing later, so they ask for more proof than a smaller town would. Our guide to transfer of property after death shows how that proof is assembled when you are not in the room.

Where a Mumbai Heirship Certificate Gets Used, and Where It Falls Short

  • Society transmission: the committee passes the flat's shares and membership to the heirs, usually on the heirship document, an indemnity bond and consents from heirs who step aside.
  • Utilities: BEST, Adani Electricity, Tata Power and Mahanagar Gas generally accept it for a change of name on the connection.
  • Pension and provident fund: family pension claims and the regional Provident Fund office commonly rely on it.
  • Smaller bank balances: some branches accept it, often with an indemnity bond. Others ask for a court order.
  • BMC property tax record: the ward office can use it with the society's letter to update the owner's name.

Where it falls short: depositories and fund registrars, larger bank balances, a locker with disputed claimants, and any later sale that a buyer's bank will scrutinise. For those you should plan a court-backed document in parallel, and our team will tell you early which assets need it.

Applying for the Heirship Certificate: Mumbai City and Mumbai Suburban Compared

In Maharashtra the revenue department issues the document through the Tehsildar of the district where the deceased last lived, after an inquiry by a Talathi or revenue officer. Mumbai has two such districts, so the first task is to place the address on the right side of the line. The certificate is an administrative record naming the surviving heirs. It is not a court order, and it does not by itself transfer property.

The table compares the two districts side by side. Offices sometimes change counters, timings and forms, so we confirm the current position before filing.

From Overseas to Mumbai Filings: The Eight-Step Route

You sign once abroad. Our Mumbai advocate and team take care of every counter, inquiry and hearing that needs someone present.

1

Assessment call

A short call in your time zone. We ask where your parent lived, what they owned and whether a Will exists, then tell you which Mumbai office or court each asset needs, and in what order to approach them.

2

Collect the papers

You receive a two-column checklist. Your column covers passport, OCI and PAN. The Mumbai column covers the BMC death certificate, society share certificate, bank papers and tax bills that relatives or our team can retrieve from the ward and the society.

3

Sign abroad

We prepare the power of attorney, affidavits and any release or consent. You sign before a notary, and the paper is apostilled in Hague countries such as the USA, UK, Singapore and Australia, or attested by the Indian mission elsewhere, as in the UAE, which is not a Hague member.

4

Originals reach Mumbai

Originals travel by courier to our Mumbai team. A power of attorney signed abroad is stamped under the Maharashtra Stamp Act within three months of first being received in Maharashtra, and a deed signed abroad is presented for registration within four months of arrival in India, so we log the arrival date.

5

File and give notice

Our advocate lodges the Aaple Sarkar application with the Tehsildar, or the petition in the Bombay court if the asset needs it. Tehsil files go through a Talathi inquiry; court files carry notice to the heirs and an advertisement inviting objections.

6

Inquiry or hearing

Your advocate attends the Talathi inquiry or the court date for you. In unopposed matters your own presence is usually unnecessary. If an officer or judge asks for you, we give advance notice and plan around your calendar.

7

Certificate, then use

When the certificate or order arrives, we carry it to the society secretary, bank branch, BMC ward, electricity and gas utilities and the depository, ordering the submissions so that one office's approval supports the next.

8

Money home

Proceeds from a sale or a maturing deposit go into an NRO account. Remittance of up to USD 1 million per financial year is possible with Form 15CA and 15CB (renumbered Forms 145 and 146 from 1 April 2026) prepared through a chartered accountant, and we coordinate with your CA on the tax side.

Illustration: A Sydney Heir Moves Her Mother's Borivali Flat Through the Tehsildar and the Society

This is an illustrative example. The family, dates and timings are fictional; the offices and documents named are real. Nisha Kulkarni lives in Sydney. Her mother, Sunanda, a widow, died at her flat in a housing society in Borivali, leaving no Will. The heirs are Nisha, her brother Aditya in Dubai and her sister Rekha, who lives in Borivali and is the nominee on the society’s records. The estate is the flat, a savings account and term deposit at a Borivali bank branch, a locker, and some mutual fund units.

Week 1: the plan. The three children inherit equally under the Hindu Succession Act. The flat is in Borivali, so the revenue file goes to the Borivali tehsil of Mumbai Suburban. The siblings agree that Rekha will keep the flat. The bank accepts a heirship certificate with an indemnity bond for the balance; the fund house, on the other hand, will ask for a succession certificate, a separate court matter.

Weeks 2 and 3: signing abroad. Nisha signs a power of attorney, an heirs’ affidavit and a release of her share in the flat before a notary in Sydney, and the Australian authority apostilles it. Aditya signs in Dubai and has the set attested at the Indian Consulate there, since the UAE is outside the Hague Convention. Rekha signs in Mumbai. The parcels are couriered to our Mumbai team, which records the date of arrival so the power of attorney is stamped within three months of first being received in Maharashtra and the release is presented for registration within four months of arrival in India.

Weeks 4 to 6: filing and inquiry. Our representative files on Aaple Sarkar with the BMC death certificate, relationship proofs and the affidavit. The Talathi visits the Borivali address, hears from Rekha and the society secretary, and checks the family details.

About week 8: certificate in hand. The Tehsildar issues the certificate, and certified copies are couriered to Sydney and Dubai.

After the certificate. The society receives the certificate, the indemnity bond and the registered release. At its next meeting the committee records the transmission, issues a new share certificate to Rekha and takes her fresh nomination. The electricity account and the BMC record follow. The mutual fund units are handled by a separate succession certificate petition, which the siblings decide to file once the flat is settled.

If the family later sells, read about mutation and sale of inherited property by NRIs in Mumbai and the release deed option first.

Frequently Asked Questions

Can I obtain the certificate for my Mumbai parent's estate without travelling from abroad?

+
Usually yes, where nobody contests the matter. You sign a power of attorney and an heirship affidavit before a notary in your country, the documents are legalised, and our Mumbai advocate files, attends the Talathi inquiry or the court date and collects the result. Travel becomes necessary mainly if a sibling objects, or if a judge or officer specifically asks to see you. We tell you early when that looks likely, and where the court permits, we explore video attendance so you can stay where you are.

Will a bank branch in Mumbai accept a heirship certificate?

+
Sometimes, mostly for modest balances. Branches follow their own board-approved settlement policies, and many ask for a succession certificate once the balance, a locker or the investments cross internal thresholds, or when family members disagree. Others pair the Tehsildar certificate with an indemnity bond and a claim form. Ask the branch manager for the written checklist for deceased-customer claims before filing anything, because that single page decides which document you really need.

Is probate compulsory in Mumbai if my parent left a Will?

+
No longer by statute. Section 213 of the Indian Succession Act, which for decades required Hindus, Sikhs, Jains, Buddhists and Parsis in the former presidency towns, Mumbai included, to obtain probate before enforcing a Will, was removed by the Repealing and Amending Act 2025, which received assent on 20 December 2025. In practice, banks, depositories, registrars and societies still commonly ask for a probated Will to be safe. We check each institution's written requirement and advise whether a Bombay High Court petition is worth filing.

My mother nominated my brother for the society flat. Does he now own it?

+
Not on his own. Under Section 30 of the Maharashtra Co-operative Societies Act the society deals with the nominee after a member's death, but Bombay High Court rulings treat a nominee as holding the flat for all legal heirs, who keep their succession rights. Your brother can complete the transmission formalities, yet selling or mortgaging generally needs every heir's consent or a court-backed document. A registered release deed is the clean way to record that you are stepping aside, if that is what the family wants.

How do I sign documents from the USA, UK, UAE, Singapore or Australia?

+
Sign before a notary or equivalent officer, then have the notarisation apostilled by the competent authority in that country. The USA, UK, Singapore and Australia are all members of the Hague Apostille Convention, so Indian offices accept their apostilles without a further consular step. The UAE is not a member, so a document signed there, like one from any country outside the convention, is attested by the Indian Embassy in Abu Dhabi or the Consulate in Dubai instead. Always sign in the notary's presence, with the same name as your passport, and never date or fill blanks beforehand.

What exactly can my representative do under the power of attorney?

+
A well-drafted power lets one named person in India file the Aaple Sarkar application or court petition, sign vakalatnamas, attend the Talathi inquiry, receive certified copies, and deal with the society, BMC, bank and depository. It covers only the purposes you list, so a sale or gift needs express wording. Because it is signed abroad, it must be stamped under the Maharashtra Stamp Act within three months of first being received in Maharashtra. Read more in our guide to the power of attorney for overseas legal heirs.

Can an NRI or OCI inherit agricultural land left in Maharashtra?

+
Inheritance is permitted: FEMA lets NRIs and OCI cardholders receive Indian immovable property, farmland included, from a person who was resident in India. Keep two things apart. Receiving land by succession is allowed, but selling it later has limits, because many agricultural land sales under state law are open only to eligible resident buyers, and a sale to another non-resident is generally not allowed. Farmland is more likely around Thane, Palghar and Raigad than inside Mumbai itself. Have the land records checked before any sale discussion.

How do I bring the inherited money back overseas?

+
Proceeds from an inherited Mumbai asset normally land in an NRO account. From there, an NRI or OCI can remit up to USD 1 million in a financial year, subject to the documents the bank and the Reserve Bank of India require, including a chartered accountant's Form 15CB with your own Form 15CA. Tax on any sale gain should be settled first. Keep the heirship papers, the Will or court order and the sale deed ready for the bank's remittance team. The FEMA guide for NRIs explains the rules.

Is there inheritance tax on a Mumbai flat I inherit?

+
India has no estate or inheritance tax today, and receiving property from a parent or another specified relative is not taxed in your hands as income. Tax arises when you sell: capital gains, with the previous owner's holding period and acquisition value generally carried forward to you. Rent from the flat is taxable too. Your country of residence may have its own reporting rules for foreign inheritances, and some countries do tax them, so check there, preferably before you sell.

What if my brother in Mumbai refuses to sign the consents?

+
Without his consent the society will not usually move the flat to one heir alone, and the Tehsildar may issue a certificate that simply lists everyone. Disputes move to the Bombay court, where every heir is served notice and may object, and the order then settles the question. This is slower, so a family settlement recorded in a registered deed is worth attempting first. We prepare the notices and, if needed, the court papers, while keeping the tone civil as long as possible.

How long will this take?

+
For a straightforward Tehsildar file, think of a few weeks after the Talathi inquiry, plus the time you need to sign, legalise and courier your papers. Court routes for a succession certificate, probate or letters of administration usually run for several months, because public notice and hearing dates set the pace. Society transmission can be quick if every heir signs and slow if anyone hesitates. After the first call we give you a realistic schedule for your particular set of assets.

Can the heirship application be filed online in Maharashtra?

+
Yes. The Revenue Department's heirship service is listed on the Aaple Sarkar portal, where the applicant registers, enters the details of the deceased and the heirs, and uploads the death certificate, relationship proofs and an affidavit. Offices can still call for originals, a Talathi inquiry and a hearing, so online filing speeds up submission, not the inquiry. Overseas applicants usually authorise a representative in Mumbai, who files under the power of attorney. Confirm the current form with the Tehsildar before uploading.

How is a heirship certificate different from a succession certificate?

+
The heirship certificate is a revenue-office record, prepared after an inquiry, naming the family members who survive. A succession certificate is a court order under Part X of the Indian Succession Act authorising the holder to collect specified debts and securities, such as bank deposits, shares and units. Neither transfers a flat: that goes through the society or, if needed, probate or letters of administration. Institutions choose what they accept, so we ask them first. See succession certificate in Mumbai.

My father owned a flat in Mumbai and another in Thane. Is one certificate enough?

+
Often one heirship document can support both, but acceptance is up to each office, and some insist on a certificate from their own district. The flats also follow different paths: the Mumbai society, BMC and revenue district on one side, and the Thane society, Thane Municipal Corporation and Thane Collector on the other. Court petitions depend on where the property sits as well. We list each asset against its office before filing, so you do not repeat paperwork.

Who deducts tax when I sell the inherited flat from abroad?

+
The buyer must deduct tax at source on payments to a non-resident seller under Section 195 of the Income-tax Act, 1961, a provision now found in Section 393(2) of the Income-tax Act, 2025 from 1 April 2026. Without a lower or nil deduction certificate, buyers usually deduct on the whole sale consideration, not just the gain, which can lock up your cash. Apply for the certificate (Form 128, earlier Form 13) before completion and discuss it with a chartered accountant. See sale of inherited property in Mumbai.

Does the deceased's religion change the Mumbai process?

+
It changes who inherits, not the offices you visit. Hindus, Sikhs, Jains and Buddhists follow the Hindu Succession Act; Muslims follow their personal law; Parsis and Christians are governed by the Indian Succession Act. Mumbai families come from many communities, so the family tree and each heir's share can differ sharply from one household to the next. We identify the governing law first, because it decides what the certificate or petition must say.
