What Must Be True Before a Power of Attorney Signed in Dubai Works in India?
A power of attorney from Dubai for property in India works once three things line up. The wording names the property and each act. The signing is one Indian offices accept: before a consular officer, or before a UAE notary followed by MOFA and Indian mission attestation. And the paper is stamped in the state where it is used, then registered where that state expects it. Rules differ by state, so the draft starts with the property. Our guide for NRIs in Dubai with property in India covers the wider picture.
- Best fit: A specific power that names the property and each act the holder may perform
- Signed in the UAE: Before a consular officer in Dubai or Abu Dhabi, or before a UAE notary, then MOFA and the Indian mission
- Stamping in India: Set by state law; the three-month window is verified for Maharashtra only, so other states are checked one by one
- Ends when: You revoke it, you pass away, or the task named in it is complete
Match Your Plan to the Power: Six Common Goals of UAE-Based Owners
Owners in the UAE rarely need one document for everything. Find the plan closest to yours. Each row shows the kind of power we draft, the office in India that reads it, and what normally follows once the signed original reaches the holder.
| Your plan in India | Power we draft | Who reads it in India | What usually follows |
|---|---|---|---|
| Sell a flat, house or plot while you stay in the UAE | Sale power Names the single property, the buyer-side acts, where the money goes, and bars the holder from buying it. | Sub-registrar of the area, the buyer's bank, the housing society or builder | Stamping by state rule, registration of the power where the state expects it, then the sale deed is presented. |
| Rent out the property and collect what it earns | Management power Lets the holder sign a tenancy, receive rent, pay local dues and deal with the tenant. Sale wording is left out. | Tenant, society office, local body, the bank holding the NRO account | Usually authentication and stamping only; rent is credited to an NRO account with tax at source. |
| Pay property tax, update records, handle utilities | Filing power Covers applications, receipts, name changes and collection of certified copies, with no authority over title. | Municipal or village office, electricity and water boards | Offices differ on what an attorney may sign, so we ask for their written position first. |
| Buy a flat or plot from the UAE | Purchase power Covers the agreement, payment through banking channels, and presenting the deed for registration. | Seller or developer, sub-registrar, the lending bank if any | Stamping, then registration; agricultural land is outside what an NRI may buy. |
| Deal with a builder, society or housing board | Dealing power Covers the allotment letter, possession papers, share certificate and no-dues letters for one named unit. | Builder's office, managing committee, housing board | The body may insist on its own form, signed by you, with the power supporting it. |
| Run a tenant dispute or a pending court matter | Court support power Lets one person run the file and receive papers. The advocate acts under a separate vakalatnama that you sign in the same sitting. | The court concerned, through the advocate on record | Affidavits are sworn and authenticated the same way as the power itself. |
Counter practice changes from one office to the next, and an office can ask for one more paper after a file is lodged. Treat the last two columns as a guide, not a promise, and expect us to confirm the current requirement with the office before you sign anything in the UAE.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentSpecific or General: How Wide Should the Authority Be for Property in India?
A specific power of attorney names a property and the acts the holder may perform on it. A general power hands over a long run of acts across many matters. When the owner lives in the UAE and the relatives live in Kochi, Bengaluru, Chennai or Hyderabad, the general form is tempting because one document seems to cover everything. In practice, the narrower document travels further, because a sub-registrar, a society or a buyer's bank can see at a glance what the holder may and may not do.

There is also a legal limit that every owner should know. In its 2011 decision in Suraj Lamp and Industries, the Supreme Court held that a sale built only on a general power of attorney does not pass title to immovable property. A sale is completed by a registered sale deed. The power is therefore authority to act, sign and present papers for you. It is never proof of who owns the property.
For an owner abroad we usually draft one instrument per purpose and keep each one short. The clauses that matter most are these:
Exact description
Door number, survey or khata or patta details, society and flat number, and the share concerned, copied from the title paper.
Named acts only
A list such as sign the agreement, present the deed, collect the registered original, and nothing outside the list.
Where money goes
Proceeds are paid by banking channel to your own account, not to the holder.
No self-dealing
The holder may not buy, mortgage or gift the property to himself or herself, or to a relative, unless you say so in writing for that one deal.
No substitution
The holder may not hand the authority to someone else without your written approval.
End point
A completion event or a stated period, so the authority does not drift on for years.
Revocation route
How you will cancel it and whom you will notify.
Two holders are sometimes named. If they must act together, every signature needs both of them, which slows a file when one is travelling. If either may act alone, the risk is higher. We explain the trade-off and write whichever you choose clearly.
A general power still has a place when many small tasks will arise across several accounts during a long absence. Even then we prefer to list the tasks, and we tell you honestly that a broad power is harder to supervise from another time zone. The authority also ends when the principal passes away, as the Indian Contract Act provides, so the holder cannot use it afterwards. Inherited property then moves through heirship papers instead, covered in our power of attorney for overseas legal heirs page for Mumbai.
Two Ways to Sign in the UAE: Before a Consular Officer, or Before a UAE Notary Plus MOFA
The UAE is not a member of the Hague Apostille Convention, so there is no single apostille stamp that Indian offices will accept from you. Papers signed in the UAE reach India by one of two routes, and both are recognised in law for a principal who lives abroad.
Route one: sign before a consular officer
The Embassy of India in Abu Dhabi and the Consulate General of India in Dubai perform notarial functions, and their own guidance says the original is presented with a photocopy and signed in front of the consular officer, who checks identity against the passport. The Dubai consulate lists power of attorney, will execution and gift deed among its attestation categories. You can read the mission's wording on its Dubai attestation page and on the Abu Dhabi embassy page. Appointments are booked online through the outsourced consular centre. The consulate also mentions outreach attestation in the northern emirates on set days and home service for medical cases and elderly applicants, so Sharjah, Ajman and Ras Al Khaimah residents do not always need to travel to Dubai.
Route two: notary, MOFA, Indian mission
You sign before a UAE notary, whether a Dubai Courts notary or a licensed private notary. The notary usually asks for identity papers and often for an Arabic translation. The signature is then attested by the UAE foreign ministry, MOFA, and finally by the Indian mission in the UAE. Three offices are involved, each with its own queue, so this route usually takes longer. It suits a signer who cannot get a consular slot, or a document that also has to be used in the UAE.
Section 33 of the Registration Act recognises a power signed outside India that was executed before and authenticated by a notary public or an Indian consul, among other officers. In practice, sub-registrars and buyers' banks tend to be more comfortable with the consular route, because the Indian official is the one authenticating. Ask us which route your property state prefers and we will say so before you book.
A note on BLS
BLS ran the Indian passport and visa centres in the UAE for years, while a separate operator handled attestation. Reports in mid-2026 say the outsourced contract moved to a new operator and that appointment portals changed. The centre books your slot and receives your file. The attestation itself is the consular officer's act. So never sign the draft at home or at a typing office and expect a centre to accept it. Sign only when and where the mission's slot tells you to, and confirm the current centre and portal with the mission before you go.
Whichever route applies, bring the original passport, match every name to the passport spelling, and sign exactly as the passport signature appears.
Adjudication and Stamp Treatment by State: What Changes After the Papers Land in India
Stamp duty on a power of attorney is a state subject. A paper signed in the UAE usually reaches India as a document that either carries no Indian stamp or carries the wrong one, so the holder takes it to the stamp authority for adjudication, which means the authority decides what duty the instrument attracts and endorses it. This page gives no amounts. Duty is set by each state and changes, so we point you to the state portal and confirm the position in writing before signing.
Maharashtra
This is the one state where the window is verified: under section 18 of the Maharashtra Stamp Act, an instrument signed outside India is stamped within three months of first being received in Maharashtra. The clock starts on arrival, not on signing in Dubai, so the arrival date of the courier is logged. Duty depends on the kind of power. A power given to close family is treated more gently than one that lets a non-relative sell, so the stated purpose and the relationship between the two people matter. Late stamping is normally met with a penalty fixed by the Act. Confirm the current rule on the state's stamp department portal.
Kerala
The Kerala Stamp Act, 1959 has its own provision for instruments executed outside India, and Kerala courts have considered when adjudication is needed and when a power already on proper Indian stamp paper can be used without it. Because the practice has been tested in court, we ask the registration department for its current stance before choosing between signing on stamp paper and adjudicating a plain-paper original.
Karnataka
The Karnataka Stamp Act, 1957 treats a power of attorney by its purpose and by the relationship of the parties. A power that authorises a sale for consideration, one given to a close relative and an ordinary power are not handled alike. Registration and e-stamping run through the state's online system, and we check the sub-registrar's expectation for papers signed abroad before the signing date is fixed.
Tamil Nadu
The state amended the Registration Act in 2012 so that powers relating to immovable property are expected to be registered, which brings stamping and registration close together at the registration office. Offices can ask additional questions about a principal who lives abroad, so we ask the sub-registrar in advance.
Telangana
The Indian Stamp Act, 1899 continues to apply with state adaptations. Treatment follows the kind of power and the stated authority to sell. The sub-registrar in the property's area is the practical gatekeeper, and we obtain the office's checklist for a document signed abroad before drafting.
Outside Maharashtra, we do not assume that a three-month window applies. Several state laws carry a provision modelled on the central Act for papers signed abroad, but the period and the authority differ. Our habit is simple: stamp as soon as the original arrives, wherever the property is.
Registration, Authentication and the Offices That Read Your Power in Each State
Three words are often mixed up. Authentication is what the consular officer or notary does in the UAE. Adjudication and stamping happen with the state stamp authority. Registration happens at the sub-registrar under the Registration Act, 1908. A power that has cleared one step has not necessarily cleared the others.

The Act does not make every power of attorney compulsorily registrable. A holder who simply files a tax form may not need a registered power. But a power used to present a deed for registration on your behalf must be authenticated as section 33 requires, and many registrars expect a registered power before a sale deed is presented. Some states go further. Tamil Nadu made registration of such powers compulsory in 2012, and a 2026 Kerala High Court decision reported in legal media holds that a power signed abroad on immovable property must be registered before it is used to sell. Treat this as the direction of travel and check the rule in your state.
Section 26 of the Registration Act is a separate relief. A deed that was signed outside India can be accepted for registration after the usual period if it is presented within four months of reaching India, at the registrar's discretion. It is useful for a release deed or sale deed signed in Dubai, but we never plan around discretion.
The holder usually attends the sub-registrar's office. You do not, provided the authentication is in order. Here is who reads the paper in each state:
Maharashtra
The sub-registrar under the Inspector General of Registration, the Collector of Stamps for adjudication, the housing society's managing committee, and records such as the 7/12 extract or the property card.
Kerala
The sub-registrar's office, the village office that keeps the thandaper and land tax records, and the panchayat or municipality for building tax.
Karnataka
The sub-registrar through the state's registration portal, the local civic body for khata, and the land record portal for RTC extracts.
Tamil Nadu
The sub-registrar's office through the registration department's portal, the taluk or village office for patta and chitta, and the local body for property tax.
Telangana
The sub-registrar, the tahsildar's office for land records, and the municipal body or GHMC for property tax in the city.
Names and portals are renamed from time to time, so every line above is a pointer to ask about, not a script. Our format and registration guide goes further into what a registered power should contain.
How Long Each Stage Usually Takes: Soft Ranges from the UAE to the Registrar
No one controls every office on the route, so we do not promise dates. We describe how long each stage tends to run and what slows it.
Scoping and drafting
Short, once you send the title papers and the holder's details. Delays come from missing property descriptions.
Your review
Ours to prompt, yours to complete. We keep a simple list of questions so it does not drag.
Appointment and signing
Depends on slot availability at the consular centre. It can lengthen around public holidays, school holidays and peak travel months.
Notary route
Longer, because the notary, MOFA and the Indian mission are three separate queues.
Courier to India
A short stretch when tracked and sent to a fixed address, with the arrival date recorded.
Stamping or adjudication
Varies by state. A straightforward stamping is quicker than an adjudication with queries.
Registration
Depends on slot booking at the sub-registrar and on whether the power is registered before the deed.
A clean file with a single holder often takes a few weeks from the first call to a registered, usable power. A file with a notary route, a translation or an adjudication query can take several weeks longer. Eid, Diwali, Onam, Ugadi and other holidays in either country add waiting time, so we flag them when planning your dates.
The delays we see most often are mismatched names, a property described by street name only, an unsigned page, and an original left in a courier warehouse. Each of them is avoidable with a checklist before the signing appointment.
Mistakes That Send a Dubai-Signed Power Back for Re-signing
Signing before the appointment
The consular officer must see you sign. A power signed at home beforehand has to be signed again.
Names that do not match
Initials, a missing middle name or a spelling that differs from the title deed make offices pause. We record both forms where papers differ.
A thin property description
Street and landmark are not enough. Use the survey, khata, patta or flat details that the record office uses.
One broad power for every task
A query on one clause then holds up all the others.
A UAE-style power for Indian property
A power drafted under UAE practice, often in Arabic, rarely carries the clauses an Indian sub-registrar looks for.
Not logging the arrival date
In Maharashtra the stamping window runs from first receipt in the state, so the courier slip is evidence.
Waiting to stamp
A late paper can attract a penalty and cannot be relied on until the stamp position is cured.
Letting proceeds go to the holder
Pay the sale consideration to your own account and write that into the power.
Assuming one state's rule applies everywhere
A Maharashtra window is not a Kerala or Telangana rule.
Forgetting to revoke an old power
If a holder is no longer trusted or the task is done, cancel it in writing and tell the offices where it was used.
If a power has been lost in a courier or signed in the wrong form, tell us before doing anything else. A short call often saves a second trip to the consular centre.

Eight Steps from a WhatsApp Message in Dubai to a Registered Power in India
Here is how a file normally moves, with the UAE steps first and the Indian steps after the original lands.
Tell us the goal and the property
Message us on WhatsApp or book a call at UAE hours. Share the title papers, the survey, khata or flat details, and who you want to appoint. We confirm the goal so that the power matches it.
We choose the state route
The state decides stamp treatment and registration practice. We check the sub-registrar's current expectations for a paper signed in the UAE, note which offices will read it, and tell you what to expect before you book any appointment.
Advocates draft the power
The draft names the property, the acts, the end point and where money goes. If you have several goals, we draft separate instruments and explain why, so that a query on one never holds up the others.
You review and correct
Read it slowly. Confirm that names match your passport and the title deed, that the holder's details are right and that no clause goes further than you intend. We answer every question before the draft is finalised.
Book the signing
We help you choose between the consular route and the UAE notary route, prepare the checklist for your emirate, and explain how to book the slot on the portal the mission currently uses for appointments.
Sign and attest in the UAE
Sign in front of the consular officer, or before the notary followed by MOFA and the Indian mission. We tell you what to carry, and we check the finished pages with you before the original leaves your hands.
Courier and log the arrival
The original travels by tracked courier to the holder in India, never by hand through a third party. The arrival date is recorded with the courier slip, because stamping windows, where they exist, run from receipt.
Stamp, register and hand over
The holder lodges the original with the state stamp authority and, where needed, the sub-registrar. You receive scanned copies, each acknowledgement and a short note on how the power may be used, so the next task starts cleanly.
Ready to start? One call confirms your next steps.
Book an assessmentWhat to Prepare in the UAE and What the Holder Gathers in India
Each state asks for its own mix, so the lists above are a starting point. If a paper is missing, tell us early. A missing survey number or a differently spelt name is far easier to fix before you sign in the UAE than after the courier has left.
Signing in the UAE
- Original passport and a photocopy of the pages the mission asks for, including the UAE residence visa page
- Emirates ID and residence details, which the notary route usually asks for
- The final draft printed and unsigned, so you sign only in front of the officer
- OCI card copy, PAN and Aadhaar if held
- Recent photographs, which registration offices often ask for
- The consular or notary appointment confirmation
- The courier address and phone number of the holder in India
Offices and records in India
- Title paper for the property: sale deed, allotment letter, share certificate or lease deed
- Survey, khata, patta, 7/12 or flat details, matching the record office of the state
- Latest property tax receipt and a recent utility bill for the address
- The holder's identity proof, address proof, PAN and photographs
- Index or encumbrance extract where the state provides one
- Society or builder letter where the unit is in a managed complex
- Heirship or succession papers if the property was inherited
Why Families in the UAE Ask PropResolve to Run This
- The draft is built around the state. We write for the stamp and registration practice of the state where the property sits, instead of reusing one template for all of them.
- The UAE steps are walked through with you. You are told what to carry, which route to use and what the officer will check, so a signing slot is not wasted.
- One point of contact on UAE time. Updates on WhatsApp, calls at hours that suit Dubai, and a record of every step through to registration.
