Which Document Does an NRI Heir Need in Nagpur? The Short Answer

Short answer

No single paper settles a Nagpur estate. For society transfers, NMC records, pensions and utility connections the Tehsildar's Vaaras (heirship) certificate often does the job, whereas a bank or fund house may demand a succession certificate from the Nagpur court. By statute probate was never compulsory for an ordinary Nagpur Will, since Section 213 of the Indian Succession Act touched only presidency-town Wills and was removed in December 2025, yet many institutions still ask for it. An NRI can see the whole job through with a power of attorney and affidavits executed before a notary abroad.

  • Heirship (Vaaras): Tehsildar of Nagpur Urban or Nagpur Rural, after a Talathi inquiry
  • Succession certificate: granted by the Nagpur court; often asked for by banks and fund houses
  • Probate: court proof of a Will; optional by law, still requested by many institutions
  • Flat, lease or land: society transfer, NMC or NIT record, Ferfar on the 7/12 for farm land

Matching Your Nagpur Asset to the Right Certificate

Nagpur estates tend to mix a city flat, a plot held from an authority, bank balances and sometimes land in the district. Read down the rows to see what each asset usually needs, then let the institution confirm its own requirement before anything is signed overseas.

Most Nagpur families land in more than one row. A pension may need the Vaaras certificate, a plot an NIT transfer, a fund folio a court certificate, and an orchard a Ferfar. We order the filings so that a single signing pack covers them all.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

Which Body Governs Your Nagpur Address? A Plain Map

On an envelope Nagpur is one city. For succession paperwork it is a handful of offices sharing a map, and the first job is to learn which of them holds each record. Getting this wrong at the start sends a file back and loses weeks.

Inside the municipal limits. The Nagpur Municipal Corporation (NMC) runs the city through ten zone offices, among them Dharampeth, Laxmi Nagar, Dhantoli and Mangalwari. Its Birth and Death Registration Department records deaths inside the city, and its property-tax department keeps the assessment list for houses and flats. The death certificate you need comes from the registrar of the place where the person died, not where the family lived. A parent who lived in Manish Nagar but passed away in a hospital in Kamptee or Wadi leaves a certificate from that local body, while the flat stays on the NMC list.

The Improvement Trust layer. The Nagpur Improvement Trust (NIT) laid out many residential layouts and still manages the leases on land it allotted. A single plot can therefore sit on the NMC tax roll and on an NIT lease at once. That is normal, and it is explained in the next section.

Beyond the corporation. The Nagpur Metropolitan Region Development Authority (NMRDA) plans the wider region around the city, including the fast-growing belts outside the municipal boundary. Smaller towns in the district have their own municipal councils, and villages have gram panchayats that keep a house assessment register, usually called Namuna 8. A house in a village is a panchayat record, not an NMC one.

The cantonment. Kamptee, to the north-east, has a Cantonment Board with its own death register and its own property records. Confirm the Board's current process directly, because cantonment practice differs from the corporation's.

The revenue office. The Tehsildar is chosen by the deceased's address or by where the land lies. Nagpur Urban and Nagpur Rural are separate tehsils within a district of fourteen, and two addresses with the same postal code can fall in different ones. An application lodged at the wrong office is usually returned, not forwarded.

Electricity and water. Power is supplied by MSEDCL, commonly called Mahavitaran, and water inside the city is run under the NMC's arrangement with Orange City Water. For a change of name after a death, the electricity company's guidance points to the latest bill, the death certificate and one proof of heirship, such as a legal heir certificate, a registered Will or a mutation in municipal or land records. Water and tax departments set their own lists, so we ask each one for its current requirement and put the answers into one plan.

NIT Leasehold and Nazul Plots: The Nagpur Wrinkle

Many Nagpur families believe they own their plot outright because they pay municipal tax on it and hold a registered deed. A large number of those plots are in fact leased from the Nagpur Improvement Trust, and some older central plots are Nazul land, meaning government land held under a lease from the Collector. The difference matters on the day an heir tries to change the record.

What a lease changes. On leasehold land the family holds the rights of a lessee. After a death, those rights do not pass on quietly: they have to be recorded in the heirs' names with the lessor. NIT and the Collector's office each keep their own checklist. It commonly includes proof of death, proof of who the heirs are, the original lease papers, receipts for ground rent and consent letters from co-heirs. Treat that as a likely list, not a promise, and ask for the current one in writing.

Arrears and renewals. Older leases may be due for renewal, and unpaid ground rent can hold up a transfer. We look at the lease position early so that a surprise does not surface after the certificate is already in your hands.

Where the survey office fits. The city survey record, the Property Card, is updated by the land records office. Whether that office asks for a no-objection letter from NIT or the Collector has been argued in court before, so we ask what it requires today and do not assume.

The policy still in motion. The state's plan to convert NIT leases into full ownership was still awaiting a final decision in the latest reports we saw. We plan every NIT matter on the rules in force today and revisit the plan if a notification arrives.

Why this matters to an heir abroad. A buyer's lawyer reads the lease first. If the heirs' names are missing from it, a sale stalls and the buyer's bank may decline the loan. A tidy NIT or Nazul record is often what turns an inherited plot into one that can actually be sold. If you plan to keep the property instead, the same record protects every heir's share against later disputes.

For the national picture on moving title after a death, see NRI property inheritance in India.

Flats in Nagpur: Society Shares, Apartment Deeds and the Nominee Question

An inherited flat is often the largest asset an overseas family faces in Nagpur. How it moves depends on how the building is organised, so the first question to the family is always the same: is it a society or an apartment association?

Co-operative housing societies. Older residential areas such as Dharampeth, Ramdaspeth, Sadar and Civil Lines include many societies where each owner holds shares and a membership. After a death, the managing committee takes up the transfer of that share. It typically wants a written application, the death certificate, the share certificate, the latest maintenance receipt, a no-objection letter from every other heir or an affidavit naming them, and often an indemnity bond. A running home loan or a quarrel between heirs can push the committee to ask for a court document instead.

Apartment associations and registered deeds. Many newer buildings along Wardha Road and in Manish Nagar, Besa, Trimurti Nagar and the Hingna Road belt are sold as apartments under a registered deed, not as society shares. The deed is the proof of title, so the heirs show their right through the heirship document, and any transfer between co-heirs is made by a deed registered with the Sub-Registrar. The association then updates its own bills and records according to its bye-laws.

What a nominee really is. A nominee named on a share certificate or in society records is someone the society may deal with for all the legal heirs. The nominee is not automatically the sole owner. A widow and the children keep their legal shares, which is why committees ask for consents. A nomination makes the committee's first step simpler. It does not settle who owns what.

After the building agrees. The name on the NMC tax record is changed through the zone office, and where the land is under the city survey the Property Card may need its own entry. Electricity and water connections are changed one at a time, usually on the same set of papers.

Decide early whether to keep or sell. If a sale is likely, the cleanest path is to move the flat into the names of all heirs first, then sell with every heir's signature on the deed. A buyer's lawyer will trace the chain from the deceased to the sellers and will not accept gaps. A flat that is going to be rented out needs the same clean chain, because tenants, tax records and later banks all rely on it. Tell your representative your plan at the first call so that the papers are drafted for it.

The mechanics of changing the name in municipal and land records are explained in our NRI property mutation guide.

Orchards, Fields and Layout Plots Beyond the City Limits

Many Nagpur families also hold land elsewhere in the district. The orange belt around Katol, Narkhed and Kalmeshwar is a regional feature, and a field or orchard may have stayed in a grandparent's name for decades. That land lives in the village revenue system, not in the municipal one.

The 7/12 and the Vidarbha vocabulary. The 7/12 extract (Satbara) records who holds the land and what is grown on it. Records in Vidarbha districts often speak of the mauza, meaning the revenue village, and of the khasra number, and old entries can reflect earlier tenure arrangements. The digital copy on the state's Mahabhulekh portal is convenient to download, but it can only repeat what the record already says. Read the oldest available extract before planning anything.

How the Ferfar moves. Heirs inform the Talathi of the death and hand over the death certificate and proof of the family tree. The Talathi enters a mutation, notice is sent to those with an interest, and the Circle Officer certifies it if nobody objects. Contested entries go up to the Tehsildar. A Ferfar tidies the revenue record without deciding who truly owns what, so a family dispute still belongs in a civil court.

Non-resident heirs. FEMA allows a person living abroad, whether NRI or OCI, to receive farmland through inheritance although not to purchase it. A later sale generally has to be to an Indian citizen resident in India, and Maharashtra's tenancy and farmland laws can reduce the pool of eligible buyers. Wait until the 7/12 shows every heir before planning a sale.

Land taken for public projects. Where a road, a rail line or a township scheme takes part of a holding, compensation follows the names on the record. Heirs who have not yet been recorded can find it hard to claim the money, and the amount may sit in the deceased owner's name. If you hear that part of the family land was acquired, check this before anything else.

Plots in unapproved layouts. Around Nagpur many plots were sold in layouts that never received formal approval, widely known as Gunthewari developments. Maharashtra has a law to regularise them, and NIT and NMRDA take applications in their areas, but reports in 2026 describe progress as slow. An heir should not assume such a plot can be sold or built on without problems. Record the heirs on whatever title papers exist, then ask the planning authority about the regularisation status.

For the exchange-control side of a later sale, read our blog on FEMA rules for NRIs selling inherited property in India.

Succession Certificate and Probate: The Nagpur Court Route

If a bank, fund house or depository will not move without a court order, the petition is generally lodged in the Nagpur civil court, typically before the District Judge or a judge assigned to such matters. The Bombay High Court bench sitting at Nagpur serves the Vidarbha region, yet it is not where such a family usually starts.

A city outside the old Section 213 rule. Nagpur served as the capital of the Central Provinces and Berar, and it was never a presidency town. Section 213, the old rule that made probate a precondition for enforcing some Wills, was written for Bombay, Calcutta and Madras. A Will made in Nagpur could come within it only through immovable property located in one of them. Parliament has now deleted the section through the Repealing and Amending Act, 2025, so what a given institution asks for is a question of its own policy, not of statute.

How a petition moves. The advocate lodges the petition with the heirs' affidavits, the death certificate and an asset list. The court orders public notice so that objectors can appear, and may call for security before it issues a certificate over debts and securities. For probate the original Will and the attesting witnesses' evidence come in as well, followed by the same notice stages. Our post on succession certificate versus letter of administration explains which suits which case.

What your part looks like from abroad. Affidavits, consents and the power of attorney are signed in front of a notary and then apostilled or attested. The Nagpur advocate does the filing and attending. If you are the executor named in a Will, the court may wish to hear your own statement, and we say so early if that looks likely. A short video appearance can sometimes stand in for a journey, where the court allows it.

Picking the route. Many Nagpur banks will act on the Tehsildar's certificate for a modest balance and reserve the court document for large deposits, lockers or shares. Co-operative banks and fund houses apply their own rules. Because a wrong turn can lose months, we ask each institution in writing which paper it accepts, and we lodge a court petition only when one of them insists.

For the full picture of the court document, see NRI succession certificate.

Vidarbha Names, Scripts and Family Records That Trip Up Files

Most delays in Nagpur files do not come from the law. They come from small differences between documents that were made years apart by different offices.

Name order. Marathi names usually run first name, father's name, surname. A passport may carry only two of the three, while Aadhaar, the 7/12 and the bank record carry all of them. The office then asks whether these are one person, and the file waits for an affidavit.

Script and spelling. Nagpur speaks Marathi and Hindi side by side, and a surname written in Devanagari becomes several different Roman spellings. Wankhede appears as Vankhede, and Bawankule as Bavankule. A school record may use one spelling and a ration card another. Line up one standard spelling before anything is signed, and keep the other forms ready as supporting copies.

Married women. After marriage a Marathi woman's middle name often changes from her father's name to her husband's, and the surname may change too, so two of the three parts differ between her birth record and her later papers. Her link to the deceased is shown by her school or birth record in the earlier name together with the marriage certificate.

Religion and personal law. The Hindu Succession Act, 1956 applies to Hindus and also to Buddhists, Jains and Sikhs, which covers many Nagpur families, including the city's large Buddhist community. Muslims follow their personal law, and Christians and Parsis are governed mainly by the Indian Succession Act, so the shares differ between these systems. Older school or revenue records sometimes show a different religion entry or name from the present one. The heirship affidavit should say plainly which law governs the family and explain any change in the records.

Foreign documents. A marriage certificate, a name-change deed or a death certificate issued abroad needs an apostille or Indian mission attestation, and a document in another language needs a translation. Gather these before the application so that the tehsil does not return the file halfway.

We place every name on one grid before you sign, so that the notary, the tehsil and the court all see the same person.

Why does the right body depend on the plot in Nagpur?

Death is registered with the NMC, whose Birth and Death Registration Department serves the city’s ten zones, Dharampeth among them. The Tehsildar then issues the heirship certificate. Nagpur district has separate Nagpur and Nagpur Rural tehsils, so the address decides the office.

Property is the second layer. Many Nagpur plots are leasehold from NIT, an authority independent of the corporation. Press reports from 2025 and March 2026 describe a state proposal to make NIT plots freehold, and the latest report we found called it pending. We check the plot’s lease status with NIT before planning any transfer.

What do you need an NRI legal heir certificate in Nagpur for?

  • Housing society transfer: the society re-registers the flat's share certificate and membership in the heirs' names. Expect requests for the heirship document, an indemnity bond and co-heir NOCs.
  • NMC property-tax record: the name on the assessment changes on the strength of the heirship papers. We confirm NMC's current document list.
  • NIT leasehold plots: moving a lease into the heirs' names is NIT's own process, and it names its own documents.
  • Bank, mutual-fund and demat claims: institutions differ. Some pay out on the heirship certificate, others require a Succession Certificate, and we find out which before you sign anything.
  • Pension, insurance and utilities: claims and connections normally need proof of who the heirs are.
  • Farm land in the district: a Ferfar mutation entry adds the heirs to the 7/12 extract.

Which office issues the legal heir certificate in Nagpur?

The Tehsildar of the area where the deceased lived issues the certificate, which Maharashtra calls the Heirship Certificate or Vaaras Pramanpatra. It is a revenue-department record, and no court is involved. Applications are typically made at the Tehsildar office, where a Setu Suvidha Kendra operates inside the tehsil campus. Guides differ on whether the certificate can be filed on the Aaple Sarkar portal, so we check with the office which channel is live.

Settling a Nagpur Estate From Abroad in Eight Steps

You sign once overseas, and a Nagpur advocate and our representative do everything that needs someone in the room.

1

Assessment call

We start with a conversation about what was left in Nagpur and where: flat, NIT plot, bank accounts, orchard. From it we list the tehsil, office or court for each item, and the institutions that must state their own requirements before any drafting begins.

2

Gathering papers

Two checklists go out, one for what you can locate overseas and one for relatives in Nagpur, covering items such as the NMC death certificate, society share certificate, lease papers and 7/12 extract. Both halves proceed in parallel, so neither side holds up the other.

3

Signing abroad

A heirship affidavit, consent letters and a power of attorney in favour of our Nagpur representative are drafted for you to sign before a notary at home. Apostille applies for the US, UK, Singapore and Australia; papers from the UAE or Germany instead go through attestation at an Indian mission.

4

Originals to Nagpur

Scans travel first, letting a Nagpur advocate compare each name against Aadhaar, tax and land records, before the originals follow by courier. Maharashtra stamping of a power of attorney signed abroad must happen within three months of its first arrival in the state, a date we watch.

5

Filing and notice

A Vaaras application is lodged at the Nagpur Urban or Nagpur Rural tehsil, or online where that office takes it, and the Talathi starts the local inquiry. A court certificate begins with a petition in Nagpur and a published notice inviting objections.

6

Inquiry and hearing

Our representative meets the Talathi, answers queries and joins any site visit. In court, your advocate appears on your behalf through the power of attorney. Should an officer or judge want to hear from you directly, we raise it well ahead and fit it to your time zone.

7

Certificate issued, then put to use

With the certified copy we move to the society transfer, the NMC tax entry, the NIT lease or the Ferfar, plus bank claims and fund folios, taking each in the order its institution will accept. You hear from us as each office finishes its part.

8

Money home

Sale or maturity proceeds reach your NRO account first. Remitting abroad is generally possible up to USD 1 million in a financial year against Forms 15CA and 15CB, renumbered 145 and 146 from 1 April 2026, after any buyer's tax deduction has been dealt with.

Your Nagpur Paper Trail: What Sits With You and What Family Can Collect

Before you sign anything, line up your documents so that each name reads identically. Differences between Devanagari and Roman spelling, a dropped father's name or a changed surname most often prompt queries from offices. Tell us about any mismatch early, because an affidavit can usually bridge it.

From you (abroad)

  • Passport, together with the visa, residence permit or OCI card showing your country of residence
  • PAN card, which banks and fund houses request and any later sale requires
  • Heirship affidavit and power of attorney signed before a notary, then apostilled or attested by an Indian mission
  • Signed consent letters from any co-heir who also lives outside India
  • A recent utility bill or bank statement for your foreign address, spelt as in the passport
  • A specimen signature sheet matching the signatures on each affidavit

From family or records in India

  • Death certificate from the registrar of the place of death: NMC, the Kamptee Cantonment Board or a municipal council
  • The deceased's Aadhaar, PAN and address proof, with spellings checked against bank and property records
  • Any Will with witness details, or a brief statement that none was made
  • Flat: society share certificate, recent maintenance bill and nomination record, or the registered deed for an apartment
  • Plot: NIT or Nazul lease papers, the latest ground rent receipt and the NMC property-tax receipt
  • Land: current 7/12 extract with earlier Ferfar entries, or the Namuna 8 extract for a village house
  • Proof of each heir's relationship through birth, school-leaving or marriage records, plus bank, demat, insurance and fund folio details

Example: an heir in Singapore settles a father's Dharampeth flat and mutual-fund folio

Illustrative example with fictional people. Real cases differ, so treat the timings as a guide, not a promise.

Sneha, 36, is a product manager in Singapore and holds an OCI card. Her father Prakash was a Hindu and left no will when he died in Dharampeth, Nagpur. He left a flat in a cooperative housing society and a mutual-fund folio. The heirs are Sneha, her mother Sunita and her brother Nikhil, who lives in Nagpur. Under Section 8 of the Hindu Succession Act, 1956, the three of them rank as Class I heirs.

Days 1 to 3: map the bodies

Sneha sends the death certificate, which the NMC registered. We ask the society for its papers and check whether the land under the building is NIT leasehold, since an NIT lease would add a separate transfer step. The fund house says it wants a Succession Certificate for the folio, so that becomes its own court track.

Days 3 to 14: signing in Singapore

We prepare the application, the heirs’ affidavit and a Power of Attorney in our representative’s name. Sneha signs before a notary public in Singapore and has the papers apostilled, since the Singapore Academy of Law is the apostille authority there. She couriers the originals to Nagpur.

Days 15 to 21: filing in Nagpur

Nikhil signs his consent. Our representative lodges the file at the tehsil with the stamp-paper affidavit and Sneha’s legalised Power of Attorney.

Days 22 to 52: inquiry and issue

A Talathi or revenue officer inquires into the family. Our representative attends the visit, and Nikhil confirms details when asked. The Tehsildar normally signs the certificate within 15 to 30 days of filing, and the certified copy lands with Sneha around day 52.

After day 52: using the certificate

  • Flat: the society takes up the share transfer, and NMC changes the name on the property-tax record. For a future sale, see our NRI property transfer service.
  • Mutual-fund folio: an advocate petitions the District Judge, Nagpur, for a Succession Certificate. The public notice step means months, not weeks.

If Sneha sells the flat later

Section 195 (Section 393(2) of the Income-tax Act, 2025 from 1 April 2026) requires the buyer to deduct tax at source on the full sale consideration, unless Sneha first holds a Lower or Nil Deduction Certificate (Form 13 (now Form 128), TRACES). Sending the proceeds abroad is limited to USD 1 million a financial year and needs Forms 15CA and 15CB (Forms 145 and 146 from 1 April 2026), under FEMA rules from the Reserve Bank of India. A document signed outside India can be presented for registration within four months of reaching India (Section 26, Registration Act, 1908). Our blog on FEMA rules for NRIs selling inherited property covers the rest.

Sneha’s route took about seven weeks from first message to certified copy, and she never left Singapore. An actual NRI legal heir certificate in Nagpur can be quicker or slower, depending on the case.

What is the difference between a legal heir certificate and a succession certificate in Nagpur?

The Tehsildar's certificate records who the heirs are. A succession certificate is a court order that lets heirs collect the deceased's money and securities. In Nagpur, the petition goes to the District Judge, not to the Bombay High Court bench. The court route is covered in our NRI succession certificate service, on the succession certificate page and in the post legal heir certificate vs succession certificate.

What Working With Us Looks Like for a Nagpur Estate

  • One map, every office. We work out which body holds each record, from the Tehsildar and NMC to NIT and your society, before you sign a single page.
  • Signing done once. Your affidavit, consents and power of attorney are drafted to cover the tehsil, the court, NIT and the society together, so you are rarely asked to sign twice.
  • Nagpur desks, not guesswork. Advocates and representatives who deal with Nagpur offices regularly confirm each current requirement in writing before anything is filed.

Frequently Asked Questions

Can the whole heirship process happen without my flying to Nagpur?

+
In most uncontested families, yes. Your part is signing: an affidavit, consents and a power of attorney, executed before a notary in the country where you live. After that your Nagpur representative lodges the file, deals with the Talathi's inquiry and collects the certified copy. A journey becomes necessary mainly when a relative disputes the claim, or when an officer or judge specifically wants to see you, and we point out that possibility on the first call. Family members in the city might be asked to confirm facts during a visit by revenue staff.

Would my father's Nagpur bank pay out on a Tehsildar's certificate?

+
It depends on the bank, the branch and the balance. Small savings accounts frequently close on the heirship certificate plus an indemnity letter. Fixed deposits, locker contents, shares and mutual fund units are likelier to meet a demand for the court's succession certificate. District and co-operative banks, widespread across Vidarbha, often apply internal rules of their own. Get the branch to state, preferably in writing, what its legal desk will take for the amount involved. Doing this first can spare months spent on the wrong document, and it is part of our assessment call.

Is probate mandatory for my father's Will in Nagpur?

+
No law makes it so, and for an ordinary Nagpur Will no law ever did. The old Section 213 rule linking a Will to probate was confined to the three colonial presidency towns, and Parliament deleted it through the Repealing and Amending Act, 2025, which received assent on 20 December 2025. Nagpur sat outside that group. Even so, some banks, depositories and buyers still prefer a probated Will because a court has tested it. We find out what each counterparty actually requires before deciding whether a petition is worth filing.

I am the nominee on my mother's Nagpur flat. Does that make the flat mine?

+
Not by itself. In a housing society the nominee is the person through whom the society recognises the transfer on behalf of everyone entitled, so a spouse and brothers or sisters keep their legal claims. For that reason Nagpur committees commonly request consent letters from every heir, an affidavit naming them and, at times, an indemnity bond. Being the nominee can speed the committee's first decision. If another heir objects, though, the committee may hold the file until a court rules, so it is wise to settle the family position first.

What must a notary or consulate do for my papers to work in Nagpur?

+
Begin with a notary in your country of residence. What follows depends on the country. Americans, Britons, Singaporeans and Australians obtain an apostille, because their countries are party to the Hague Convention. From the UAE the route is different: the UAE is outside that Convention, so papers are attested at the Indian Embassy in Abu Dhabi or the Consulate in Dubai. In Germany, which objected to India's accession, attestation by the Indian mission also replaces the apostille. We circulate drafts beforehand and brief the notary, so no page is signed twice.

Which acts can I delegate to a Nagpur representative?

+
The document should name one person and spell out each permitted act: lodging applications, swearing affidavits, attending the tehsil, the Talathi, the NMC, NIT, your society, the Sub-Registrar and the court, and receiving certificates. A sale is not covered unless the text says it is. Papers executed abroad need Maharashtra stamping within three months of first arriving in the state. Separately, Section 26 of the Registration Act, 1908 lets a deed executed outside India be presented for registration within four months of reaching India, at the registering officer's discretion. As an OCI holder, may I take my father's orange orchard near Katol by inheritance?

+
You may. Exchange-control rules let non-residents receive farmland through succession even though they cannot purchase it, and the Ferfar entry then adds your name beside the other heirs on the 7/12. Selling is where limits appear: the buyer generally has to be a resident Indian citizen, and state tenancy and farmland laws can narrow the pool. Finish the record work first, then consult a lawyer and an accountant before approaching any buyer.

What is the route for sending Nagpur sale proceeds to my foreign account?

+
Sale or maturity money lands in an NRO account in your name first. Out of that account, remittances of up to USD 1 million a financial year are generally permitted against Form 15CA and the accountant's Form 15CB, now numbered 145 and 146 from 1 April 2026. Banks ask for the heirship papers, the sale deed and tax proofs, so file them together. Anything larger or unusual may require Reserve Bank approval, which is why your accountant should see the whole picture early. Our blog on FEMA rules for selling inherited property adds detail.

Is there any Indian tax on simply inheriting my parents' Nagpur property?

+
No. India levies no estate or inheritance duty, so receiving property on a death creates no tax bill for you at that moment. A liability appears only when you sell, in the form of capital gains, computed with the deceased's original purchase value and holding period carried forward. Rent earned on the property is taxed year by year. Your country of residence may impose its own reporting or inheritance rules on overseas assets, so check there before deciding whether to hold or sell.

A brother in Nagpur refuses to cooperate. Is the matter stuck?

+
Not stuck, but slower. Societies rarely transfer a flat without every heir's consent, and a Tehsildar faced with an objection may close the file and direct the parties to a civil court. In a court petition each heir is served with notice and may object, and the judge weighs evidence. Often a patient discussion in which a lawyer sets out each person's legal share brings agreement back before anyone files anything, and that is our first move. Keep correspondence courteous and written.

How long will a Nagpur matter take from first call to final transfer?

+
Think in stages, not one number. The Talathi's inquiry sets the pace of a Vaaras certificate, a notice period governs a Ferfar, and the court's calendar governs a petition. Your notary, apostille and courier time abroad sits in front of all of them, and the society, NIT or bank stage follows once the document exists. At the assessment we sketch the probable sequence for your assets, then report as each stage closes, so you always know who is waiting on whom.

Is there an online route for the heirship certificate in Maharashtra?

+
It depends on how the Nagpur office is working. Certain sources show the certificate among Aaple Sarkar offerings, others describe a counter application at the Tehsildar office or Setu Suvidha Kendra, so we check the live channel first. Even if the form goes online, the stamp-paper affidavit, the Talathi's visit and the Tehsildar's signature remain. As the login and verification are all in Maharashtra, overseas heirs usually work through a Nagpur representative. Forms change, so we use the current version.

How does the Tehsildar's heirship certificate differ from the court's succession certificate?

+
One is a revenue record, the other a court order. The Tehsildar names the heirs after inquiring, with no judge involved. A succession certificate follows a civil court petition under Part X of the Indian Succession Act, 1925, after notice and a hearing, and lets the holder collect debts and securities, for instance deposits, shares and fund units. Which one an institution wants is its own call, and some ask for both. Our NRI succession certificate page covers the court track.

My father's flat is in a Nagpur society but his plot is on NIT lease. Do I need two certificates?

+
One certificate can generally serve both assets, because it simply records the heirs, yet each body runs its own transfer. The society handles the flat's shares and membership, NIT records the heirs against the plot's lease, and the NMC updates its tax roll for each property separately. Offices differ on whether they accept certified copies or insist on a recent issue. We collect every office's list at the outset so one signing set covers all of them and you are not recalled for further signatures.

Who withholds tax if an NRI sells an inherited Nagpur property?

+
The purchaser. Payments to a non-resident attract withholding under Section 195 of the Income-tax Act, 1961, carried into Section 393(2) of the Income-tax Act, 2025 from 1 April 2026, and the rate is generally applied to the full sale consideration instead of only the gain. A lower or nil deduction certificate, Form 13 in the old numbering and Form 128 now, can be requested on TRACES before completion to avoid an over-deduction. Sending the proceeds abroad afterwards is subject to the annual remittance ceiling mentioned above.

Do my family's religion and personal law affect who inherits?

+
Yes, they decide the shares. Where there is no Will, the Hindu Succession Act, 1956 governs Hindus and extends to Buddhists, Jains and Sikhs, covering a large part of Nagpur including its sizeable Buddhist community. Muslim heirs follow Muslim personal law, while Christians and Parsis mainly fall under the Indian Succession Act. Because spouse, children and parents receive different proportions under each system, the heirship affidavit has to name the correct law, and any older religion or name entry in school or revenue records should be explained there.

My late father bought a plot in an unapproved layout around Nagpur. What should I know?

+
Plots in unauthorised layouts, often called Gunthewari plots, are common around Nagpur. Maharashtra has a law to regularise them, with NIT and NMRDA handling applications in their areas, but reports in 2026 describe progress as slow. Heirs should not assume such a plot can be sold or built on without problems. Begin by recording the heirs on whatever title papers exist, then ask NIT or NMRDA about the regularisation status. A buyer's lawyer and bank will look at that status, so it shapes your plan as much as the heirship certificate does.
