Which Document Does an NRI Heir Need in Coimbatore? The Short Answer
Coimbatore was never one of the old presidency towns, so probate was never compulsory by statute here, and Section 213 of the Indian Succession Act was removed in December 2025 in any case. Even so, banks, depositories and some buyers still commonly ask for a court-backed document. The house, flat or land itself usually moves through the Tahsildar's Legal Heir Certificate, the patta transfer and the Corporation tax records. An NRI can run the whole process through a power of attorney and papers signed before a notary abroad.
- Heirship: Legal Heir Certificate (Varisu) from the Tahsildar, after a Village Administrative Officer and Revenue Inspector inquiry
- Land record: patta and chitta transfer through the Revenue Department, on the Tamil Nilam portal or at the taluk office
- Tax record: name transfer at the Coimbatore Corporation zonal office, or the local body outside city limits
- Courts: Coimbatore district court for succession certificates and probate, with appeals to the Madras High Court in Chennai
Flat, Plot, Farm or Will: Which Route and Which Paper Fits Your Coimbatore Property?
A Coimbatore family estate often mixes a city flat, a plot in a layout on the edge of town, a garden in the Pollachi belt and an account at a Race Course Road branch. Each leads to a different desk. Find the row nearest to yours, and we confirm it with the office or institution before anything is signed abroad.
| Your situation | Document you likely need | Issued by | Typical time |
|---|---|---|---|
| Flat in an apartment complex, the parent's name on the registered deed, no Will | Apartment route Legal Heir Certificate first, then the heirs' names on the owners' association roll, the Corporation tax book and the electricity service. See NRI property transfer. | Tahsildar for the certificate; Corporation zonal office; the apartment owners' association | A few weeks once every heir has signed |
| Independent house or plot inside the Corporation area, patta still in the parent's name | Patta transfer and tax name change Legal Heir Certificate, then patta and chitta in the heirs' names, then the Corporation assessment. How NRI mutation works. | Tahsildar of the taluk; Corporation zonal office | Several weeks, and longer if the survey number has to be sub-divided |
| Garden, farm or coconut grove near Pollachi, Annur, Mettupalayam or Sulur | Rural patta and adangal update NRI and OCI heirs may inherit farm land but cannot buy it, so plan any later sale early. See the FEMA rules for selling inherited property. | Village Administrative Officer, Revenue Inspector and the Tahsildar of the taluk | Longer when several heirs or an old patta are involved |
| A Will left by a Hindu, Christian or other testator | Will, and probate if asked The Will decides who inherits. Many banks still ask for probate although no statute requires it. Read about succession certificates and letters of administration. | Coimbatore district court, only if a grant is sought | Several months whenever a court is involved |
| Bank accounts, deposits, shares or fund units alongside the property | Succession certificate A court order under Part X of the Indian Succession Act for debts and securities. See the NRI succession certificate service. | Civil court at Coimbatore with jurisdiction over the deceased's last residence | Several months, since notice to objectors is part of the process |
| Sale planned soon after the transfer | Heirs' deed and clean records first A buyer's lawyer will look for every heir's signature, a current Corporation tax receipt and a plan for TDS. Background in NRI property inheritance in India. | Sub-Registrar for the deed; the Income Tax Department for any lower deduction certificate | Set by the buyer's timetable and the TRACES application |
Rows often combine. A Coimbatore family may need one Legal Heir Certificate for the flat and the patta, a registered release deed where one sibling keeps the house, and a court certificate for the deposits. We sequence the filings so that one set of papers signed abroad serves all of them.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentCorporation Zone, Taluk or Town Panchayat: Mapping a Coimbatore Address to the Right Offices
A Coimbatore address on a letterhead does not say which offices will handle the file. The city corporation, the revenue taluk and the planning authority each draw their own map, and the lines do not always agree.
Inside the Corporation. The Coimbatore City Municipal Corporation runs 100 wards grouped into five zones: East, West, North, South and Central. Each zone has its own office under an assistant commissioner, and the property tax name transfer is lodged at the zonal office that holds the assessment. Tax is collected half-yearly, in April and October, so a transfer left pending can mean notices still arriving in a dead person's name. Deaths inside the city are registered with the Corporation's birth and death registrar, and the state's civil registration system carries the record online. Check the ward number printed on the tax bill, because suburbs such as Thudiyalur, Saravanampatti, Kuniyamuthur and Vellalore are commonly listed under the north or south side of the city.
The taluk map. Revenue records follow the taluk. City addresses fall mainly under Coimbatore North or Coimbatore South taluk, while the wider district has taluks such as Sulur, Perur, Madukkarai, Kinathukadavu, Annur, Mettupalayam, Pollachi and Valparai. Three revenue divisions sit above them, Coimbatore North, Coimbatore South and Pollachi, each under a Revenue Divisional Officer to whom an appeal or an unusual file may travel. The Legal Heir Certificate is issued by the Tahsildar of the taluk where the deceased ordinarily lived, so we confirm the taluk from the patta and the survey number, not from the postal line.
Outside the Corporation. Suburbs beyond the city boundary and the towns of the district run on a separate local body: a municipality, a town panchayat or a village panchayat. Each keeps its own house tax register and its own forms. A house near Sulur or Madukkarai may therefore have a Tahsildar at the taluk office, a panchayat for the tax record, and no Corporation involvement at all.
The planning layer. The Coimbatore Local Planning Authority, chaired by the District Collector, grants planning permission in the notified planning area under the Town and Country Planning Act, 1971, and layout approvals trace back to it or to the Directorate of Town and Country Planning. The state has spoken of a separate metropolitan development authority for Coimbatore, but its present standing should be confirmed before anyone relies on it. For an heir the practical point is simple: a plot's approval status surfaces later, when a buyer or a lender reads the papers.
Where the death happened. A parent who lived in Peelamedu but died in a hospital in Tiruppur or Palakkad leaves a death certificate from that place, while the house stays on the Coimbatore tax roll. Both records are valid. The Tahsildar and the Corporation only need to see that the name and identity details match.
Apartments in Coimbatore: Registered Deed, Undivided Share and Owners' Association
Most modern flats in Coimbatore are held as an individual apartment together with an undivided share of the land, conveyed by a registered sale deed. Ownership does not hang on a society share certificate, as it does in some other cities, so the heirs' title rests on the deed and the law of succession rather than on a committee resolution.
The Tamil Nadu Apartment Ownership Act, 2022, which the state brought into force in March 2024, now frames how owners' associations work, and your complex may follow it or its own registered bye-laws. The association keeps the owners' list, the maintenance ledger and the parking and common-area records. It cannot decide who the heirs are, but it will want to update its register, and it usually asks for the death certificate, the Legal Heir Certificate or the Will, and a letter from heirs who step aside.
A working order for a flat:
- Gather the registered deed, a current encumbrance certificate and the latest maintenance receipt.
- Obtain the Legal Heir Certificate, or rely on the Will.
- Agree who holds the flat. Where one heir keeps it, the others sign a registered release or settlement deed.
- Move the Corporation tax name, then the electricity service and the water connection.
- Ask the association to record the new owners and, if a sale is planned, to issue a no-dues letter.
Housing Board flats and cooperative societies. Some Coimbatore flats were allotted by the Tamil Nadu Housing Board or belong to a cooperative house-building society. Those bodies have their own transfer rules, and a flat still under an allotment or a running loan may not yet have a registered conveyance. Ask the allotting body how it treats an allottee's rights after a death before assuming the apartment route applies.
Builder and loan trails. Heirs sometimes discover that a flat was bought under an agreement that was never registered, or that a home loan still sits against it. The encumbrance certificate and a letter from the lender show which. A lender holding the original deed will normally release it only when the loan is closed and a document names the heirs.
Plots and Houses: Patta, Chitta, the Survey Number and the Layout Question
In Tamil Nadu the revenue records stand apart from title. The patta names the person the Revenue Department treats as holder of the land. The chitta extract summarises the survey number, the extent and the holder. The A-Register carries the village-level detail behind it, and the field measurement sketch shows the boundaries. For city land a Town Survey register may sit beside these. An heir's first job is to read all of them and compare each name with the registered deed.
Transfer without division. When the heirs keep a plot jointly, the application is for a transfer that does not involve sub-division of the survey number, and the patta moves to the heirs as joint holders. When the heirs split the land, sub-division is involved, a survey visit follows and the file takes longer. The Tamil Nilam portal treats these as two kinds of application, and filing is also possible through the taluk office or a common service centre. Confirm which route the Tahsildar's office currently prefers.
Joint patta as a first step. Naming every heir avoids a rejection when someone is missing, and a later release deed can concentrate the property in one name. Heirs who do not want a share should still sign a release, because an informal remark that someone does not want the plot carries little weight with a registrar or a buyer.
Layouts. Many plots around the city were sold in layouts of uneven approval status. Plots in layouts approved through the planning authority tend to carry cleaner records, while plots in unapproved layouts have been the subject of a state regularisation scheme and can meet patta, building-permission or loan hurdles. Inheritance does not repair a defect in the layout. Ask early for the approved layout number and the planning authority's record.
The old chain. A plot bought in the 1980s may still show the original seller on the patta, or a grandparent who died long ago. The heirs then trace the chain through the registered deed, the encumbrance history and the patta history. Where the patta never moved, one application can cover both generations, but the Tahsildar's inquiry will take longer.
The tax record. Alongside or after the patta, the Corporation's name transfer asks for the prescribed application, copies of the title documents, up-to-date tax and water receipts and the heirship paper. Tell the zonal office at the start whether the heirs rely on a Will or on a certificate, since the checklist treats them differently.
Gardens, Farms and Hill Holdings: Rural Patta, Adangal and the Sale Question
Families rooted in the district often hold land far from the city: a coconut garden toward Pollachi, a farm near Annur or Mettupalayam, a banana patch beside a canal, or a plot in the Valparai hills. That land sits in village revenue records, not in the Corporation's.
The village trail. The Village Administrative Officer keeps the village accounts, including the adangal that records who cultivates what. The Revenue Inspector supervises a group of villages, and the Tahsildar decides the patta. On an inheritance transfer expect the officer and the inspector to verify the heirs on the ground, which is why an overseas heir needs a representative who can be present.
Read the entries first. Look for a crop entry in a tenant's name, a pump-set service connection still in the old owner's name, a bank crop loan or mortgage noted in the extract, and extents that differ from the registered deed. Such points can be explained by affidavit or corrected through a revenue application, but they should surface before the heirs sign.
Wells and electricity. A farm's agricultural service connection with the electricity distribution company is separate from the land record and needs its own name change, so list it alongside the patta work.
NRI and OCI heirs. FEMA allows an NRI or OCI heir to inherit agricultural land even though buying it is not permitted. A later sale generally has to be to a resident Indian citizen, which narrows the field of buyers. Plan a sale only after the patta shows the heirs' names. Our guide to the FEMA rules on selling inherited property covers the exchange-control side.
When one family member farms. A sibling who stayed in the district may want to keep the farm running while a brother in Dubai or Houston steps aside. The usual tool is a registered release or settlement deed signed by the overseas heir before a notary, followed by the patta transfer. A deed signed abroad can be presented for registration within four months of reaching India under Section 26 of the Registration Act, 1908, at the registering officer's discretion.
Land across district lines. Many Coimbatore families also hold land in Tiruppur, Erode, the Nilgiris or across the border in Palakkad. Each district has its own Tahsildar and its own district court, and Kerala land follows Kerala's revenue system, so one signed set does not automatically serve all of them. Plan one row per district.
Mills, Sheds and Workshop Land: When a Family Business Sits Beside the Family Home
Coimbatore is known for textile mills, pump and motor makers, foundries and a dense belt of small workshops. When a parent ran one, the inheritance covers more than a house, and property tied to the business needs its own treatment.
Keep the files apart. The family home, the factory land and the business shares or partnership interest rarely follow the same route. Mixing them in one application slows every one of them. We usually run the home and the land as one track and the business as another.
Who owns the shed. Check whether the land stands in the parent's personal name, in a partnership or company name, or on lease or allotment from an industrial estate agency such as SIDCO. An allotted plot normally carries conditions on transfer, and a lease may need to be endorsed in the heirs' favour by the allotting body. A company's property does not pass by inheritance at all. The parent's shares do.
Shares in a private company. Moving a parent's shares needs the company's transmission procedure, proof of heirship and sometimes board approval, and the articles may restrict transfers. A partnership may end or be reconstituted on a partner's death depending on its deed, so read the deed before assuming anything.
A proprietorship. The business has no existence apart from its owner. GST and Udyam registrations, bank accounts, machinery loans and licences each need their own steps through the issuing office.
Heirs overseas. An NRI heir does not have to run the unit, but should say early whether to keep, lease or sell it. A buyer of an operating unit will want every heir's signature on the property, and the exchange-control and tax position should be settled before any sale terms are discussed.
Coimbatore Courts, Names on Paper and Family Law: Three Things That Catch Overseas Heirs
The courts. A succession certificate or probate for a Coimbatore estate is normally sought from the district court at Coimbatore, which may assign the petition to a sub court or another judge on its roster. Coimbatore was never a presidency town, so the Madras High Court's original side in Chennai ordinarily has no role in a Coimbatore estate, and Section 213 of the Indian Succession Act never applied here. The Madras High Court has no bench at Coimbatore: the district falls under the principal seat in Chennai, which hears appeals and writ petitions. Which court takes a petition depends on where the deceased lived or held property, so we confirm the forum before drafting.
A petition travels through the heirs' affidavits, a list of assets, notice to anyone who may object and the petitioner's evidence. For a certificate over debts and securities the judge may ask for a bond. An overseas heir signs the affidavits and consents abroad, and the Coimbatore advocate files and attends.
Names on paper. Tamil naming habits cause the most common mismatches. A name may be written with the father's initial in front, or a village initial, in the Aadhaar and the patta, while the passport carries the same person as a given name and a surname with the initials expanded. Spellings drift between Palanisamy and Palaniswamy, Subramanian and Subramaniam. Old deeds may add a community suffix that no modern document shows. The patta may be in Tamil script and the death certificate in English. A married daughter's surname changes, so her link to the parent is proved with a school or birth record in her earlier name together with the marriage certificate. A one-and-the-same-person affidavit is the usual repair, but it is cleaner to send a scan of the passport name page first so mismatches are found before anyone signs.
Family law. Most Coimbatore families are Hindu, and the Hindu Succession Act, 1956 governs Hindus, Buddhists, Jains and Sikhs. Christians and Parsis succeed under the Indian Succession Act, 1925, and Muslims under their personal law. Tamil Nadu also amended the Hindu law in 1989, adding Section 29A to give daughters coparcenary rights in joint family property, with limits tied to earlier marriages and partitions, and later national changes strengthened daughters' rights further. In an ancestral farm that was never partitioned, a daughter's share may therefore be larger than the family assumes. Families with roots in Kerala or another state may follow different tenure rules for old holdings. We read the family tree with an advocate before any heir is named in an application.
Why Is Property Transfer After Death Different in Tamil Nadu?
Tamil Nadu does not have one “mutation”; it has separate records kept by separate offices, and updating one does not update the others. The Revenue Department keeps the patta and, for city land, the Town Survey Land Register (TSLR), and a patta transfer is applied for on its land e-services through the Tamil Nilam portal. The Coimbatore City Municipal Corporation keeps the property tax assessment. The Registration Department only registers deeds, and it never sees a death.
A patta is a revenue record, not a title deed. The heirs inherit whether or not the patta changes, but banks, buyers and the Corporation work from the records, so we update them in order. Our guide to NRI property mutation explains the difference between a record and title.

What Changes in an NRI Property Transfer After Death in Coimbatore?
- Revenue record: a patta transfer to the legal heirs, or a TSLR entry for city land, decided by the Tahsildar of the taluk.
- Corporation property tax: a name transfer at the Coimbatore Corporation zonal office, so tax notices and receipts carry the heirs' names.
- Registered family deed: a release, settlement or partition deed registered at the sub-registrar's office when heirs divide the property or one heir keeps it.
- Utilities, loan and association records: electricity, water, any home loan and any apartment owners' association, each under its own rules.
- Sale readiness: buyers want the heirs' signatures and clean records. See how an NRI inherited property sale works, including tax.
Who Records What in Coimbatore, and What Do They Ask From Heirs?
Three offices record the change: the Tahsildar for the patta, the Corporation zonal office for property tax, and the Sub-Registrar for any deed. Coimbatore district has 11 taluks, and city addresses fall under Coimbatore South or Coimbatore North taluk. Race Course sits in Coimbatore South, but we confirm by survey number before filing.
The heirship document comes first. In Tamil Nadu that is usually the Legal Heir Certificate (Varisu) from the Tahsildar, as our NRI legal heir certificate page and the e-Sevai application guide explain. A Will replaces it where there is one.

| Record | Who keeps it | Local term or portal | What heirs provide |
|---|---|---|---|
| Revenue land record | Revenue Department; Tahsildar of the taluk | Patta, chitta, TSLR for urban land; patta transfer on Tamil Nadu land e-services (Tamil Nilam) or a Common Service Centre | Heirship certificate, death certificate, title deed, and release deeds from heirs who do not keep a share |
| Property tax | Coimbatore City Municipal Corporation, zonal office | Name transfer of property (assessment) | Prescribed form, up-to-date tax book copy, affidavit, document copy, death certificate and heirship certificate |
| Registered deed | Registration Department; Sub-Registrar office | Release, settlement or partition deed; TNREGINET for registration and encumbrance certificates | Signatures of all heirs, signed abroad before a notary and apostilled where an heir is overseas |
| Utilities and association | Each service provider or association | Name change on its own form | Death certificate, heirship proof and the new owners' identity papers |

From Your Overseas Desk to the Coimbatore Records: Eight Steps
You sign once abroad, and a Coimbatore advocate and our representative handle every counter that needs someone present.
Assessment call
We ask what the parent left, in which Corporation zone, taluk or town, whether a Will exists and who the heirs are. After one call you know which of the Tahsildar, the zonal office, the apartment association or the court each asset needs.
Collect records in both countries
You receive a list for what you hold abroad and another for relatives in Coimbatore. Family fetches the death certificate, patta, chitta, encumbrance certificate and tax receipt while you assemble passport and PAN, so neither side waits on the other.
Sign before a notary abroad
We prepare the power of attorney, affidavits and any release or settlement deed, and you sign before a notary where you live. The US, UK, Singapore and Australia use an apostille. The UAE and Germany go through Indian consular attestation instead.
Originals travel to Coimbatore
Scans go first so an advocate can compare every name with Aadhaar, the patta and the deed. The originals follow by courier. We note the date the papers first reach India, because stamping and registration windows are counted from it.
Filing and notice
Our representative applies for the Legal Heir Certificate through the e-Sevai route or the taluk office, then files the patta transfer and the Corporation name change. Where a court grant is needed, the petition goes to the Coimbatore district court.
Inquiry or hearing
The Village Administrative Officer and the Revenue Inspector verify the family locally, and the Tahsildar decides. In a court matter, notice goes out and the advocate appears under your power of attorney. Video attendance is possible only where the court permits it.
Certificate issued, then put to use
Once the certificate arrives, the patta, the Corporation tax book, electricity and water connections, the association roll and any bank or demat claim move in whatever order each office accepts, so one document serves many counters.
Money home
Sale or maturity proceeds reach an NRO account first. Up to USD 1 million a financial year can be remitted with Forms 15CA and 15CB (Forms 145 and 146 from 1 April 2026), after any buyer's TDS has been settled.

Example: A Singapore Software Architect Inherits His Mother's House in Race Course, Coimbatore
This is an illustrative example. The family, dates and timings are fictional; the offices, documents and steps are real.
The situation
Suresh is a software architect in Singapore. His mother, Parvathi, died at her house in Race Course, Coimbatore, leaving no Will. His father had died earlier. The heirs are Suresh and his sister Divya, who lives in Coimbatore; as Hindu children of a Hindu woman they inherit first under Section 15 of the Hindu Succession Act, 1956. The patta and the property tax are still in Parvathi’s name.
Step by step
- Day 1: Suresh writes to us after work. We ask for the survey number, the names on the patta and tax record, any Will, and whether he wants to hold or sell.
- Days 2 to 6: Divya collects the death certificate from the Coimbatore Corporation. We pull the patta and TSLR extract and an encumbrance certificate.
- Days 7 to 14: Suresh signs the Power of Attorney and affidavit before a notary in Singapore. The Singapore Academy of Law issues the apostille, and he couriers the originals.
- Days 15 to 20: our representative applies for the Legal Heir Certificate from the Coimbatore South Tahsildar, with Divya’s declaration naming both heirs.
- Weeks 5 to 8: the certificate is issued. We file the patta transfer on the land e-services and the name transfer at the Corporation zonal office, with the death certificate, heirship certificate and affidavit.
- Months 3 to 5: after the local enquiry the patta and the tax record move to both names, since the heirs keep the house jointly. If one heir wanted to keep it, a registered release deed would come first.
What Suresh did and did not do
He signed once before a notary, sent one courier parcel and joined three video calls. He did not fly to Coimbatore, but could not skip the notary, apostille or originals, and neither can you.
If Suresh later sells the house
An NRI or OCI heir may inherit any immovable property in India, including agricultural land. On a sale, the buyer deducts TDS under Section 195 (Section 393(2) of the Income-tax Act, 2025 from 1 April 2026) on the full sale consideration unless a Lower or Nil Deduction Certificate (Form 13 (now Form 128), on TRACES) is obtained. Proceeds can be repatriated up to USD 1 million per financial year, with Forms 15CA and 15CB (Forms 145 and 146 from 1 April 2026), under the FEMA framework published by the Reserve Bank of India. See TDS on sale of inherited property and the documents required.

What Is the Difference Between Mutation, a Registered Deed and a Legal Heir Certificate?
A patta or tax-name change updates a record, a registered deed records what the heirs agreed, and a Legal Heir Certificate names the family. None of them is a title deed by itself.
| Feature | Patta transfer and tax name change | Registered release or settlement deed | Legal Heir Certificate |
|---|---|---|---|
| What it does | Updates the revenue and Corporation records | Records how the heirs divide or hand over shares | Names the surviving family members |
| Issued by | Tahsildar; Corporation zonal office | Executed by heirs, registered by the Sub-Registrar | Tahsildar of the taluk |
| What it does not prove | Ownership or title | Anything about heirs who did not sign | Title, or who inherits under personal law |
| Usually needed for | Bank, loan, sale and tax notices | Division of property among heirs | Starting the patta and tax filings |
| Gives title | No | Passes the signing heir's share | No |

Why Overseas Families Hand Their Coimbatore Records to Propresolve
- Local filing, remote signing. Advocates and a representative who file at the taluk office, the zonal office and the district court make sure papers reach the desk that will actually accept them.
- One set of papers for every office. The power of attorney and affidavits are drafted once for the Tahsildar, the Corporation, the association and the court, so you are not asked to sign twice.
- Honest sequencing. Flat, plot, farm and business assets rarely share a route, so we tell you which comes first and what each office is likely to ask.
