Which Document Does an NRI Heir Need in Indore? The Short Answer
In Indore the usual order is a heirship document from the tehsil office, fauti namantaran on the revenue record, then the Indore Municipal Corporation and association records, with a registered release deed or family settlement only where shares move. Probate was never compulsory by statute here, since Section 213 of the Indian Succession Act reached only presidency-town Wills and was removed in December 2025, yet banks and registrars still commonly ask for it. An NRI can run all of this through a power of attorney and papers signed before a notary abroad.
- Heirship paper: a waris praman patra from the tehsil office through MP e-District or a Lok Seva Kendra, the base for most Indore filings
- Revenue record: fauti namantaran before the Tehsildar, shown afterwards on MP Bhulekh as the khasra and B-1 extract
- City records: Indore Municipal Corporation property tax, then the owners' association, colony society or IDA scheme file
- Bank and demat: a succession certificate from the Indore District Court where the institution will not settle for a heirship paper
Flat, Plot, House or Farm Land: Which Route Fits Your Indore Property?
Indore estates rarely hold one kind of asset. A family may own a flat in a Vijay Nagar tower, a plot on the Sanwer side and a deposit at a bank near Palasia. Read down the situations, find the closest match, and note the route, the issuing office and the likely pace.
| Your situation | Document you likely need | Issued by | Typical time |
|---|---|---|---|
| Flat in an apartment building, parent died without a Will | Heirship document, then association and IMC records The waris praman patra proves who the heirs are; the owners' association then records them as members. Our NRI legal heir certificate guide explains the first step. | Tehsil office covering the flat for the heirship paper; the association for membership; the Indore Municipal Corporation zone office for the tax record | A few weeks for the tehsil step, then it depends on when the association meets |
| Plot or house in a colony, an old city lane or an IDA scheme | Fauti namantaran, then municipal and scheme records Namantaran updates the revenue record and gives no title by itself. A plot held on an IDA lease also has a file at the Authority. See NRI property mutation. | Tehsildar, after a Patwari or Nagar Sarvekshak report; the Indore Municipal Corporation; the Indore Development Authority for scheme properties | Several weeks to a few months, depending on notice and any objection |
| Agricultural land on the city's edge, around Sanwer, Depalpur, Hatod, Rau or Mhow | Fauti namantaran on the khasra and B-1, partition if shares must separate NRI and OCI heirs may inherit farm land under FEMA but cannot buy it, so a later sale generally goes only to a resident Indian citizen. | Tehsildar of the tehsil that holds the village; MP Bhulekh shows the result | Several weeks to a few months; longer if the heirs want a partition |
| A Will exists, registered or not | Will-based namantaran, with probate only if an institution asks Probate is optional by statute, and it never was compulsory by statute for Indore. Some banks and registrars still prefer a probated copy. Read NRI property inheritance in India. | Tehsildar for namantaran; the District Court at Indore for any probate petition | Weeks for namantaran; several months if probate is pursued |
| Bank deposits, demat holdings, fund units or a locker alongside the property | Succession certificate A court order under Part X of the Indian Succession Act, 1925, for debts and securities. It does not move land. See NRI succession certificate. | District Judge, Indore District Court | Several months, since public notice invites objections |
| Sale planned soon, or one heir will keep the property while others step aside | Registered release deed or family settlement, then the sale deed Shares move only by a registered deed. A sale by a non-resident also brings tax deduction at source; our blog on FEMA rules for selling inherited property covers it. | Sub-Registrar office under the Registration and Stamps Department; Sampada 2.0 for e-stamps and appointments | Weeks once every heir has signed; longer if one hesitates |
Treat the table as a map and not a verdict. Indore offices sometimes alter counters, forms and the order in which they like documents, and each bank sets its own rules. After the assessment call we confirm the current requirement with every office and institution, then sequence the filings.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentWhich Indore Office Covers Which Address: A Working Map
Indore is a city, a district and a divisional headquarters at the same time, so the address on a tax bill does not reveal where a file belongs. For succession paperwork three layers matter: the revenue office that records land and issues heirship papers, the local body that taxes the building, and the registration office that sees only deeds. They overlap on the map but do very different jobs.
The Collector heads the district, and published tehsil lists name Juni Indore, Malharganj, Kanadia, Bicholi Hapsi, Khudel, Rau, Hatod, Sanwer, Depalpur and the Dr. Ambedkar Nagar (Mhow) tehsil. Which of them holds your colony is not obvious from a postal address, so we confirm it from the khasra number or the property tax ID before anything is lodged.
- Old city: Rajwada, Juni Indore, Malharganj, Chhatripura and the Sarafa lanes. Narrow plots, houses held jointly across generations, shops at street level. The paper trail is long, so the first stretch of work is reading deeds and tax receipts, not filing.
- Central and eastern Indore: Palasia, Sudama Nagar, Khajrana, Bengali Square. A mix of private colonies, society plots and older bungalows, most of them taxed by the Indore Municipal Corporation through the zone office for the ward.
- Vijay Nagar, Bhawarkuan and the blocks around them. Laid out by the Indore Development Authority, so a flat or plot may trace back to an IDA scheme file as well as a sale deed.
- The Super Corridor, Bypass and Sanwer Road belt. Newer townships, many carved from farm fields, where the revenue record can still run on a khasra number while the municipal record is catching up.
- Mhow and Rau. Rau has its own municipal council, and Mhow includes a cantonment area where the Cantonment Board and the defence estates office, not the Indore corporation, handle many building records. We confirm which body applies to the exact lane.
- Depalpur, Sanwer, Hatod and the villages beyond. Small towns with municipal councils, and farm villages where the Patwari halka is the unit that matters.
The place where the deceased lived is not always the place where the assets sit. A retired parent in Palasia may have held a shop in Malharganj, a plot near the Bypass and a field in Hatod. Each asset is mapped to its own tehsil, its own tax or scheme record and, where a court is needed, one court. Clerks search by khasra, plot or property ID, so those are the numbers we work from.
Flats, Colony Societies and Owners' Associations in Indore
Most Indore flats are bought by registered sale deed and run by an owners' association, while many older houses stand in colonies laid out by a cooperative housing society or a private developer. The route after a death differs between the two, so work out which one you have before anyone writes to a secretary.
Apartment buildings. The deed names the owner, the association keeps a membership and maintenance record, and the Indore Municipal Corporation keeps the tax record. Ask the association for a statement of dues, a note of any parking or terrace rights, and its own list of papers for a deceased member. Associations differ: one wants an indemnity bond, another a short declaration from the heirs.
Colony and society plots. Some Indore colonies were developed by cooperative housing societies under the Madhya Pradesh Co-operative Societies Act, 1960. The society's register may still list the original member, and the plot's papers may be a lease or a sub-lease rather than an outright sale. We read the society file with the registered deed side by side, because the two are not always consistent.
Joint names. Spouses often buy a flat together. Ownership is then usually held in the shares shown on the deed, so only the deceased's own share passes to the heirs, who may include children and a parent as well as a surviving spouse.
A workable sequence for an Indore association or society looks like this.
- Write to the secretary with a certified death certificate and ask for the member's record and a statement of dues.
- Hand over the heirship document with a plain list of every heir, so the committee can see that nobody has been left out.
- Collect a consent or release from each heir who will not hold a share. Heirs overseas sign before a notary and have the paper legalised.
- Ask the committee to record the new members, and request a fresh membership entry or endorsed share paper.
- Take the updated membership letter to the zone office of the Indore Municipal Corporation, and then to the utilities.
On the utilities, electricity in Indore comes from the Madhya Pradesh Paschim Kshetra Vidyut Vitaran Company, the West discom, which asks for a change-of-name application with proof of heirship and clear dues. The Indore Municipal Corporation also runs water connections and the property tax record, and a piped gas supplier may hold a third account. Bring all three into the same spelling of the heirs' names.
Old Indore, Joint-Family Houses and Names Never Updated
Lanes around Rajwada hold some of the city's oldest private property. A house may have been bought by a great-grandfather, passed through two or three deaths and never been mutated since, so the revenue and tax entries still carry a name that nobody alive answers to. Each of those deaths opened its own set of heirs, and a clean file must deal with them in the order they happened.
Daughters and widows. Older family notes sometimes list only sons. Under the Hindu Succession Act, 1956, as amended in 2005, daughters share equally, and a widow shares with the children. An omitted heir can challenge a record years later, so we trace every branch before drafting a single consent.
Informal family divisions. Many Indore families divided a house by agreement long ago, with each branch taking a floor or a shop. Unless that arrangement was written and registered, offices may not accept it, so a registered family settlement or release deed is often the tidy way to record what the family already believes.
Hindu undivided family property. Marwari, Gujarati and other business families sometimes hold property in the name of a Hindu undivided family and keep a separate PAN for it. Such property follows different rules from an individual's estate, and we read the documents before saying how it devolves.
Tenants in shops. A ground-floor shop in an old city building may have been let decades ago. Tenancy rights are governed by the lease and the state's accommodation control law, and a landlord's heirs step into the landlord's position. Check what the tenant actually holds before a sale is discussed.
Leased or nazul land. Some central properties stand on land held on lease from the Collector or a local body. The lease terms can add an approval to the chain, and we ask for the lease papers at the start instead of discovering them at the Sub-Registrar's counter.
None of this is unusual, and none of it needs you to travel. It does need a patient reading of old paper, which is why overseas heirs of Rajwada houses are best served by a short assessment call and a clear list of what the family can still find.
Farm Land, Fringe Tehsils and Plots Carved From Fields
Around Indore, land that looks residential on the ground can still be farmland on paper. The Madhya Pradesh Land Revenue Code, 1959 and the namantaran rules made under it govern how such land moves, and the tehsil's Patwari keeps the records that MP Bhulekh displays as the khasra and the B-1.
Reporting a death. Section 109 of the Code asks a person who acquires rights in land to report the acquisition within six months to the Patwari, Nagar Sewak or the Tehsildar. Courts have treated late reporting as a lapse that does not bar mutation, but we still prefer to start early, because delay muddies the record.
The namantaran case. The report becomes a case on the Revenue Case Management System. The Patwari, or the Nagar Sarvekshak in urban areas, prepares a report, notice goes to interested persons, and the Tehsildar passes an order after hearing any objection. The order is then reflected on MP Bhulekh.
Partition among heirs. Namantaran records who holds rights, not who gets which part. Where heirs want separate parcels, a partition by consent before the Tehsildar, or a registered family settlement, divides the land. Where they cannot agree, a court decides.
Check the land's status. Land recorded as agricultural, land already diverted for a colony and land inside a municipal limit are treated differently on sale. Near the Super Corridor and the Bypass, plots have often changed hands through agreements to sell and powers of attorney that never produced a registered title, so the chain must be read before anyone relies on it.
The NRI position. An NRI or OCI heir may inherit agricultural land from a resident Indian under FEMA but cannot purchase it. A later sale generally has to be to a resident Indian citizen, which narrows the buyers and is worth planning around.
Offices sometimes ask for the Samagra IDs of heirs who live in Madhya Pradesh. We confirm that with the tehsil before filing, so a missing number does not stall the case.
Courts for Indore Estates: District Court, High Court Bench and Revenue Appeals
Indore was never a presidency town and has no original side of a High Court, so succession matters begin in the district court. The District Judge at Indore hears petitions for a succession certificate, probate and letters of administration where the deceased lived or the assets lie within the district. We confirm the exact forum before drafting.
What each order does. A succession certificate lets the holder collect debts and securities such as deposits, shares and fund units. Probate is the court's seal on a Will. Letters of administration are the court-backed route where there is no Will or no executor. None of them replaces namantaran for land. Our note on the difference between a succession certificate and letters of administration compares them.
How a petition runs. It lists the assets and every heir with supporting affidavits. The court issues notice, and a public advertisement invites objections. If none arrives, the matter is heard and an order follows. The court may ask for a bond or security. Any person with a claim can file a caveat or an objection, and that turns the case into a contested proceeding that takes much longer.
The High Court bench. The Madhya Pradesh High Court sits principally at Jabalpur and has a permanent bench at Indore, which hears matters from the region around the city. It is where writ petitions against revenue or municipal orders and appeals from district court orders are taken, usually only when something has gone wrong below.
Revenue appeals. An order of the Tehsildar on namantaran is typically open to appeal within the revenue hierarchy, starting with the Sub-Divisional Officer and going higher if needed. We check the current forum for the order in question and advise the family before a deadline runs.
An overseas heir. Affidavits are sworn before a notary abroad and legalised, and the advocate acts on a vakalatnama you sign. In an unopposed petition your own appearance is seldom needed. Video attendance is sometimes allowed but never guaranteed, and we tell you promptly if a judge asks for you.
A court order is not compulsory for every estate. It earns its place where a deposit is large, a locker is claimed by several people, a demat account is involved, or a buyer's bank will examine the title closely.
Names, Spellings and Family Patterns That Trip Up Indore Files
Indore families come from many traditions. Malwi, Marwari, Gujarati, Maharashtrian, Sindhi, Jain, Bohra and Memon households all live side by side, and each has its own habits in naming and in dividing property. Most delays on an Indore file come from small mismatches between papers, not from any dispute.
- Hindi and English forms of a name. The MP Bhulekh entry may be in Devanagari, the bank passbook in English, the passport in a third form. Shrivastava and Srivastava, Chaudhary and Choudhary, Agrawal and Agarwal: each pair can look like two different people to a clerk. We list every variant and settle it by one affidavit of identity.
- Father's name versus surname. Revenue records often give the father's name in a separate column, and some communities use a given name, a father's name and a family name. Make sure the heirship paper repeats the same sequence as the land record.
- Suffixes in Gujarati and Marwari names. Bhai, Ben, Lal and Chand are sometimes written as part of a name on one document and dropped on another.
- Married daughters. A daughter may appear under her maiden name in a family register and under her husband's surname on her passport. The relationship proof then needs a marriage certificate to connect them.
- Samagra ID entries. Family and member IDs built for welfare schemes can carry old spellings. Where an office asks for one, we check it against the other papers first.
- Units and descriptions. Land may be described in hectares, acres or square yards, and a house by plot number, khasra number or property ID. Descriptions must agree across the deed, tax receipt and revenue extract.
Personal law matters as well. Hindu, Sikh, Jain and Buddhist heirs follow the Hindu Succession Act, 1956, and Muslim heirs follow their own personal law, which gives different shares. We identify the governing law first, because it decides who must sign and what the certificate must recite.
Spend a little time on this early. A mismatch caught before filing is settled with one affidavit. The same mismatch caught after a notice has run may mean beginning the signing round again.
Why an Indore Property Needs More Than One Update
An Indore property is recorded in several places, and a death changes none of them on its own. The revenue record, meaning the khasra and B-1 extracts that MP Bhulekh displays, sits with the Tehsildar. The property-tax assessment sits with the Indore Municipal Corporation. Vijay Nagar was developed by the Indore Development Authority, so many flats and plots there also trace back to an IDA scheme file.
Heirs abroad usually find this out late, when a buyer, bank or tax office asks for a name that does not match the title. We read every record first, then update them in an order that keeps each one consistent with the next.

What Must Change After a Death in Indore
- Revenue record: the Tehsildar records the heirs through fauti namantaran, and MP Bhulekh then shows the updated khasra and B-1 extract.
- Property-tax record: the Indore Municipal Corporation assessment moves into the heirs’ names, so receipts, notices and no-dues letters reach the right people.
- IDA and society files: a flat or plot from an IDA scheme, or a flat in an apartment association, keeps its own owner register.
- Electricity connection: the Madhya Pradesh Paschim Kshetra Vidyut Vitaran Company, the Indore discom, keeps the deceased’s name until it is changed.
- Bank, loan and insurance: each institution wants its own heirship paper, and some ask for a succession certificate.
- Sale readiness: buyers expect mutation entries, tax receipts and every heir’s consent, and an NRI seller also faces TDS and repatriation rules.
Who Records What in Indore
In Indore the Tehsildar and the Indore Municipal Corporation keep separate records, and the Registration Department matters only when a deed is signed. The district revenue office lists 10 sub-divisions, 46 RI circles and 335 Patwari halkas, so the first task is finding the tehsil and halka that cover your property. The result of a mutation then shows on MP Bhulekh.
Applications go through MP e-District or the Lok Seva Centre at the tehsil office. MP e-District signs in with Aadhaar and an OTP, so an applicant abroad usually acts through an authorised representative; we confirm this with the office before filing.

| Record | Who keeps it in Indore | What heirs usually give |
|---|---|---|
| Revenue record (khasra, B-1) | Tehsildar of the tehsil covering the property. The Patwari or Nagar Sarvekshak reports the acquisition, and the application is filed on RCMS | Death certificate, heirship document, ID of each heir, and a relinquishment document if an heir steps aside |
| Public view of that record | MP Bhulekh, the state land-records portal | Nothing to file; we pull the extracts before and after the update |
| Property-tax assessment | Indore Municipal Corporation, normally through the zone office for the ward; tax is also payable on e-NagarPalika | Death certificate, heirship document, latest tax receipt and title papers; forms confirmed with the zone office |
| Scheme file | Indore Development Authority, where the plot or flat came through an IDA scheme | Allotment or lease papers and heirship proof; requirements vary by scheme |
| Registration | Sub-Registrar office under the Registration and Stamps Department, with Sampada 2.0 for e-stamps and appointments | Needed only when a deed is signed: a release deed, a family settlement or a later sale |
| Building records | Apartment owners association or housing society | Heirship proof, any indemnity it asks for, and updated contact details |
From Overseas to an Indore Order: The Eight-Step Route
You sign once abroad, and our Indore team handles every counter, field visit and hearing that needs someone in the room.
Assessment call
A call at an hour that suits your time zone. Tell us the neighbourhood, who survives, whether a Will exists and what your parent held. We sort each asset to its tehsil, municipal zone, scheme file or court, and agree the order of filing.
Gather the papers
Relatives or our team collect the death certificate from the Indore Municipal Corporation, the title papers, the latest tax receipt and the khasra and B-1 extract from MP Bhulekh. You gather passport, OCI and PAN details. Nothing is filed until names agree across all of them.
Sign abroad
We prepare the power of attorney, heirs' affidavit and any release or consent, and you sign before a notary. The USA, UK, Singapore and Australia use an apostille. Papers from the UAE or Germany go the attestation way, in the UAE through the Indian Embassy in Abu Dhabi or the Consulate in Dubai.
Originals reach Indore
Originals travel by courier to our Indore team. Before the set is sent we confirm the Madhya Pradesh stamping rule for a power signed abroad. A deed signed abroad can be presented for registration within four months of reaching India under Section 26, at the registering officer's discretion.
File and give notice
Our representative files the heirship application through MP e-District or a Lok Seva Kendra, then the namantaran case on the Revenue Case Management System. The Patwari or Nagar Sarvekshak reports, notice goes to interested persons, and any objection is answered on the record.
Inquiry or hearing
Revenue staff may visit the property, and the Tehsildar hears the case. We attend for you. Where a court petition is needed it goes before the District Judge at Indore. Your own presence is seldom required, and we warn you early if a judge or officer asks for it.
Order issued, then put to use
The certified order goes first to the zone office of the Indore Municipal Corporation, then to the association, society or IDA, the electricity company and any bank. Each acceptance supports the next, so the order of visits is planned in advance.
Money home
Sale proceeds or a matured deposit land in an NRO account. Remittance of up to USD 1 million per financial year needs Forms 15CA and 15CB (renumbered Forms 145 and 146 from 1 April 2026), prepared with your chartered accountant once tax on any gain is settled.

Book an assessmentWhat an Indore Heir Needs to Have Ready
Requirements shift between tehsils, zone offices and societies, and a clerk may add an item midway. We confirm each office's list before filing and keep spare certified copies, because most counters retain one.

Illustrative Example: Vivek’s Flat and Plot in Vijay Nagar, Indore
Illustrative example (fictional). Vivek, a financial analyst in Chicago, USA, loses his father in Vijay Nagar, Indore. The father owned a flat and a residential plot and left no will. The heirs are Vivek, his mother and his sister, all Class I heirs under Section 8 of the Hindu Succession Act, 1956. This is how NRI property transfer after death in Indore could run for a family like his.
A day-by-day view
- Day 1: Vivek calls us. The family collects the death certificate from the Indore Municipal Corporation, and we pull the khasra and B-1 extract for the plot from MP Bhulekh. The plot record and the flat’s tax assessment both still show the father.
- Days 3 to 5: Vivek signs the Power of Attorney and affidavits before a notary in Chicago and has them apostilled.
- Day 12: The apostilled set reaches our Indore team by courier.
- Days 14 to 40: The heirship application goes through MP e-District. His mother and sister sign locally, our representative attends the field inquiry, and the Tehsildar’s office issues the heirship document.
- Days 45 to 100: We file fauti namantaran for the plot on RCMS as an all-heirs case; the notice runs without objection and the certified order arrives. The zone office updates the flat in the municipal record, and the IDA and the apartment association update theirs, because the flat came through an IDA scheme.
- Day 110: The family decides to hold the flat jointly and sell the plot. The buyer deducts TDS under Section 195 (Section 393(2) of the Income-tax Act, 2025 from 1 April 2026) on the full sale consideration of Vivek’s share unless he holds a lower deduction certificate (Form 13 (now Form 128), TRACES). His proceeds can be repatriated up to USD 1 million per financial year through Forms 15CA and 15CB (Forms 145 and 146 from 1 April 2026).
The timings are illustrative. Real timelines depend on the offices involved and on whether any heir objects.

Why Indore Families Overseas Hand This to Us
- One map for every record. Tehsil, zone office, IDA file and Sub-Registrar are checked together, so a certificate is never lodged where it cannot be used.
- Local filers, one thread. A representative who works the Indore tehsils and zone offices reports to you on WhatsApp in your time zone, in plain language.
- Spellings settled once. Hindi and English forms of each name are reconciled by affidavit before filing, which spares you later returns from banks and revenue staff.
