Which Document Does an NRI Heir Need in Visakhapatnam? The Short Answer
Visakhapatnam has no one paper that unlocks every asset. Heirs commonly begin with the Family Membership Certificate from the Tahsildar, then carry it to GVMC, to the Meebhoomi land record and, where shares move, to the sub-registrar. No statute makes probate mandatory: Section 213 of the Indian Succession Act, repealed in December 2025, only ever covered Wills linked to Bombay, Calcutta and Madras, never this city. Some banks and buyers still ask for probate anyway. An NRI can handle all of it through a power of attorney and papers signed before a notary overseas.
- Heirship proof: the Family Membership Certificate from the Tahsildar, applied for through MeeSeva
- Flat or house: association records first, then the GVMC property tax name
- Land: the Meebhoomi 1-B and Adangal, amended by the Tahsildar of the mandal
- Court papers: a succession certificate or probate only where an institution insists
Which Route Fits Your Visakhapatnam Property: Flat, House, Land, Will or Sale?
Few families here own a single type of asset. One estate may hold an apartment, a house on a layout plot, a village field and a deposit account, and each calls for its own proof. Locate the row nearest to what your parent left, then ask the office concerned to confirm before any paper is signed overseas.
| Your situation | Document you likely need | Issued by | Typical time |
|---|---|---|---|
| Apartment in a complex, parent left no Will | Heirship paper first, then the association and GVMC The association amends owner and member names and dues. GVMC then re-enters the property tax holder. A registered deed enters only when heirs redistribute their shares. NRI property transfer guide | Tahsildar for the certificate; the apartment association; the GVMC zonal office | The Tahsildar's verification, then a few weeks with the association and GVMC |
| House or plot in a layout within GVMC limits, no Will | Heirship paper, then assessment change, then a deed if one heir takes over The title deed and an Encumbrance Certificate get read before anything is filed. If a single heir will hold the property, the co-heirs sign a registered release or settlement. How NRI mutation works | Tahsildar, GVMC, and the sub-registrar office where a deed is involved | A few weeks per office; a deed waits for the slowest signatory |
| Farm or village land, for instance in Anandapuram or Padmanabham, or in Anakapalli district nearby | Succession entry on the Meebhoomi 1-B and Adangal Heirs file through MeeSeva, and the Tahsildar enquires and amends the entry. NRI and OCI heirs may hold inherited farmland but may not buy it, so a later buyer must be a resident Indian citizen. | Tahsildar of the mandal in which the land sits | Several weeks; more if survey extents disagree |
| The parent left a Will | The Will itself; probate only where an institution demands it No statute requires probate, and Section 213 never applied in Visakhapatnam. If a petition is filed, the court proves the Will. Succession certificate versus letters of administration | District court at Visakhapatnam for probate; Tahsildar for land entries | Several months when a petition goes to court |
| Bank balances, shares or fund units sit beside the property | Succession certificate, or the institution's own heirship procedure Each bank or depository sets its own rule. Some release smaller sums on the Family Membership Certificate and an indemnity, while bigger holdings often need a court order. NRI succession certificate | Civil court at Visakhapatnam under Part X, or the institution | Several months when the court route applies |
| A sale is intended shortly afterwards | Clean records first, then a lower-deduction TDS certificate The buyer's lawyer will usually want the heirship paper, the revised GVMC or Meebhoomi entry and a current Encumbrance Certificate. FEMA rules for selling inherited property | Sub-registrar for the sale deed; TRACES for the TDS certificate | Governed by how soon the earlier records are put right |
Estates tend to mix rows. A single Visakhapatnam family could need a heirship paper for a pension, an association letter for the apartment, a Meebhoomi entry for a field and a court order for share certificates. We order the filings so a single signing round covers all of them.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentWhich Visakhapatnam Office Answers to Which Address
On a letterhead Visakhapatnam is one city. Behind an inherited property sit several bodies whose borders do not line up. The first job is to pin down which body governs the address on the title deed, because an application lodged at the wrong desk is usually returned and not passed along.
The municipal layer. The Greater Visakhapatnam Municipal Corporation works through eight zones: Bheemunipatnam, Madhurawada, Asilmetta, Suryabagh, Gnanapuram, Gajuwaka, Anakapalli and Vepagunta. Its territory therefore runs past the old city into parts of Anakapalli district. A flat on the beach road and a house in Anakapalle town can share one corporation yet fall under different Tahsildars. GVMC also registers deaths within its limits and keeps the property tax roll.
Ward numbers are in motion. The state published a gazette notification on 14 September 2026 that redraws the corporation from 98 wards into 120. Ward numbers printed on older tax receipts and demand notices may no longer match the new map. Ask the zonal office for the current ward and zone before an application is typed.
The revenue layer. Land records follow the mandal, not the corporation. The reorganised Visakhapatnam district has a compact list of mandals, among them Visakhapatnam Rural, Seethammadhara, Maharanipeta, Mulagada, Gopalapatnam, Gajuwaka, Pedagantyada, Pendurthi, Bheemunipatnam, Anandapuram and Padmanabham. Villages that moved to the new Anakapalli district in April 2022, or to Alluri Sitarama Raju district, now answer to those districts, while deeds and passbooks written earlier may still carry the older, undivided district name. The Tahsildar of the mandal tied to the property or to the deceased's address is the officer who issues the Family Membership Certificate, so any mismatch between old papers and the new map is best settled at the start.
The planning layer. The Visakhapatnam Metropolitan Region Development Authority plans the wider region across Visakhapatnam, Vizianagaram and Anakapalli districts. Heirs rarely deal with it for a transfer, but it matters when a plot lies in a layout whose approval is uncertain, because a buyer's lawyer will ask who approved the layout. We check that early so a later sale does not stall.
The death certificate follows the place of death. GVMC takes death registration applications through its portal, and sanitary inspectors at the ward secretariats help families who are unsure how to apply. If the person died in a hospital outside GVMC limits, the certificate comes from the body for that place. Two local bodies on one set of papers is normal, provided the identity details match.
Land that is not ordinary private title. Plots inside the port, the steel plant, naval or other public-sector holdings, and temple endowment land follow their own rules. If a deed or the Encumbrance Certificate points to any of these, we read the entry closely before promising a route.
Moving an Apartment or House Into the Heirs' Names in Visakhapatnam
An apartment is often the single asset an overseas family cares about most. Complexes in Madhurawada, Seethammadhara, Dwaraka Nagar, MVP Colony and Gajuwaka are mostly run by apartment owners associations, and the Andhra Pradesh Apartments (Promotion of Construction and Ownership) Act, 1987 is the state law behind that structure. Associations usually register as societies, and their bye-laws differ from one building to the next.
Title stays in the deed. A flat is typically owned through a registered sale deed that gives an undivided share of the land along with the built unit. The association manages the building and does not own the flat. So the heirs establish their position through heirship papers, and the association amends its books afterwards. From the secretary we obtain the bye-laws, a dues clearance letter and the current maintenance bill, and learn whether the association expects an application form, an indemnity bond or letters of consent from co-heirs.
Where a loan is running. Many flats carry a housing loan that the parent took. The lender holds the original deed and expects to hear from the heirs early. Any insurance attached to the loan may clear the balance, so we ask about it before a repayment plan is made.
Houses and plots. A house or a plot in an approved layout has no association in between. The heirs go from the heirship paper to the GVMC assessment, or to the municipality or gram panchayat record where the property lies outside GVMC, with a registered deed only when shares are being rearranged. The Encumbrance Certificate should be read for old mortgages, agreements to sell and deeds that never reached the tax record.
Utilities follow. APEPDCL, the power distribution company headquartered in Visakhapatnam, moves a service connection to a legal heir against the death certificate, heirship paper and the latest bill. Water and gas accounts follow a similar pattern, though each office sets its own list, so we confirm each one.
Co-operative and housing board colonies. A few older colonies were built by co-operative societies or by statutory housing bodies. Their membership records follow their own bye-laws and not an association's. Where a deed shows the unit is held through such a body, the secretary's written position on transmission to heirs comes first.
Family arrangements. If one heir is to take over the property, the rest typically surrender their shares through a registered release deed or family settlement at the sub-registrar office of the Registration and Stamps Department. Stamp duty varies with the type of document and the family relationship, so we confirm it with the sub-registrar before the draft is finalised. An heir overseas may sign through an attorney or sign before a notary abroad. Under Section 26 of the Registration Act, 1908 a document executed outside India can still be presented for registration within four months of reaching India, at the registering officer's discretion, so couriers should not wait.
Inherited Land Around Visakhapatnam: Meebhoomi, the 1-B and the Prohibited List
Land in the district runs on a different rulebook from a city flat. The record that matters is kept by the revenue department and shown online on Meebhoomi: the 1-B extract lists the pattadar, and the Adangal shows who cultivates what. For heirs, the goal is to see each of their names against the survey number on the 1-B and to hold a passbook that matches.
What the mandal needs. Succession is a manual service, unlike a purchase, which updates the land record from the registration database. Heirs apply through MeeSeva with the death certificate, the Family Membership Certificate and the survey details: village, survey number and extent. Revenue staff may hold a village enquiry, and the order is then reflected on the record. Offices differ on format, so we ask the mandal office what it wants before filing.
Passbooks. The state has been issuing QR-enabled pattadar passbooks since August 2025 and publishes an e-passbook on Meebhoomi, with distribution still under way, as reported. A passbook is only as good as the record behind it, so after succession we check that every heir's share reads correctly before relying on it.
Check the prohibited list first. Under Section 22A of the Registration Act as amended in Andhra Pradesh, the Registration and Stamps Department keeps a list of prohibited properties covering assigned land, endowment land, ceiling surplus land and land in which the government has an interest. A survey number on that list cannot be registered, so a release deed or a sale would be refused at the sub-registrar office. The list was reported to have been trimmed in early 2026, so older advice may be out of date. We search each survey number before promising a route.
Assigned land. Land granted by the government to a landless family typically comes with conditions on transfer. Heirs can usually inherit, but a sale may need permission or may be barred, so the terms of the original grant should be read before any buyer is approached.
The agency tracts. The hill country around Paderu and Araku now sits largely in Alluri Sitarama Raju district. In Scheduled Areas the Andhra Pradesh Scheduled Areas Land Transfer Regulation, 1959, as amended in 1970, restricts transfers of land in favour of non-tribals, so a family with property there needs specific advice before any release or sale.
NRI and OCI heirs. FEMA lets an NRI or OCI heir inherit agricultural land, though buying it is not permitted, and a later sale generally has to be to a resident Indian citizen. Plan for that narrow pool of buyers and settle the record first. Our note on FEMA rules for selling inherited property covers the exchange-control side.
Extents that do not agree. The old patta, the passbook and the Adangal sometimes show different extents or survey numbers, especially in a village that has been resurveyed. Each difference needs an explanation, or a correction through the mandal, before a deed can be registered.
Telugu Names, House Names and the Mismatches That Delay Files
Telugu naming habits cause more queries than most families expect. A name often begins with a house name (inti peru), followed by the given name and the father's name. The English version on a passport, a PAN card, an Aadhaar and a title deed may arrange the same words differently, with initials in one paper, the full house name in another and a fused single word in a third.
Common variants. Satyanarayana and Satya Narayana, Venkata and Venkat, Lakshmi and Laxmi, Rao and Rau, a house name that shrinks to one initial. Some older passports can show a single name with no surname entry. None of this is wrong, but every office compares documents character by character, and a small difference becomes a written query.
Married daughters. Many daughters take a husband's name or house name after marriage, and a passport issued abroad usually reflects it. The link to the deceased parent is then shown with a birth or school record in the maiden name, together with the marriage certificate. The heir list must carry each daughter under both names where they differ.
The usual cure. An affidavit that records two spellings as one and the same person solves most gaps. It is cleaner still to align the spellings in the new papers, meaning the power of attorney and the heirs' affidavit, with the title deed and the death certificate. We keep a short table that lists each spelling and where it appears, and share it before anything is signed.
Daughters' shares. Andhra Pradesh moved early on daughters' rights in joint family property: the Hindu Succession (Andhra Pradesh Amendment) Act, 1986 operated from 5 September 1985, years before the central amendment of 2005. For a daughter abroad, the practical point is that her name belongs on the heir list on the same footing as her brothers, subject, in older cases, to the limits the state Act itself sets for earlier marriages and earlier partitions. An advocate confirms how this applies to the family.
When the Parent Worked at the Port, the Steel Plant or the Naval Base
Visakhapatnam has an unusual number of families tied to large employers: the steel plant township, the port, the Eastern Naval Command and the refinery and shipyard belts. When a parent from such a household dies, two files open at once, and mixing them up is the commonest error.
Employer benefits are not a property transfer. Family pension, provident fund, gratuity, insurance and any special payment follow the employer's own claim procedure. In Andhra Pradesh the Family Membership Certificate for a government employee's benefits is listed as its own service type, apart from the one used for social security schemes, and an employer may want it in a particular format. Ask the personnel office which form it accepts before applying, so that an issued certificate is not rejected over its wording.
Quarters. A house in a township or a service flat allotted by an employer is an allotment and not an asset the heirs inherit. How long a family may stay, and how dues and deposits are settled, come from the employer. Keep this apart from the family's own flat or plot elsewhere in the city.
The property the family owns. Many employees also bought a flat or a plot in Visakhapatnam. That is the property this page covers, and it follows the GVMC, mandal and sub-registrar route described above.
Children abroad. The next generation overseas is often both an heir to the family flat and a claimant under the employer's scheme. One set of affidavits can usually serve both, as long as the two applications are described correctly. We ask the employer for its checklist first and plan the two files together.
The Court Route in Visakhapatnam, and When It Is Worth Taking
Most families in Visakhapatnam finish without ever entering a courtroom. When a bank, depository or buyer does demand a court paper, the petition is lodged before the district court with jurisdiction over where the deceased lived or held assets, normally the District Court at Visakhapatnam, and we check that before drafting. A district judge's order under Part X of the Indian Succession Act can be appealed to the High Court of Andhra Pradesh.
Three papers, three jobs. A succession certificate lets heirs collect debts and securities, such as deposits, shares and fund units. Probate confirms a Will whose executor is named. Letters of administration step in when no executor exists. The blog on succession certificate and letter of administration sets out the contrast.
The path of a petition. An advocate lodges it with affidavits from the heirs, the death certificate and a schedule of assets. Public notice then invites objections, the court may ask for a security bond where debts and securities are involved, and evidence is recorded before the order. In a probate matter the original Will and its attesting witnesses join the evidence. Plan for several months.
Your role abroad. You sign the affidavits and the power of attorney where you live. The Visakhapatnam advocate does the filing and the attending. Should a judge ask to hear an heir personally, we tell you early and enquire whether the court allows a video appearance.
Resist filing by habit. A petition publicises the family's affairs through notice and invites objection. When the heirs agree and no institution has demanded a court paper, it adds delay without adding title. We obtain each institution's requirement in writing, and only then decide. Our NRI succession certificate service runs the court route from start to finish.
Why a Flat in Visakhapatnam Sits in Three Separate Records
A death updates none of the three records by itself: GVMC for property tax, the Tahsildar for revenue land on Meebhoomi, and the sub-registrar for registered deeds. Each office keeps its own record and wants its own papers.
As reported, that covers newly registered transactions. An inheritance with no registered deed is not one, so we confirm with GVMC how an heir’s case is handled.
Title passes to the heirs by succession or by Will. Mutation only updates the record, and our guide to NRI inheritance laws in India explains who inherits.

What Has to Change After a Death in Visakhapatnam
- GVMC property tax assessment: the assessed owner’s name for the flat or house. GVMC typically asks for the death certificate, an heirship document and the latest tax receipt; confirm at the zonal office or ward secretariat.
- Revenue land record: for land, the Tahsildar amends the record of rights, which shows on Meebhoomi as the 1-B and Adangal.
- Apartment association records: owner and member names, and dues, usually need the heirship paper.
- Bank, loan and locker: a home loan on the flat is a live account, so the lender must hear from the heirs early.
- Encumbrance check: before any sale or release, we pull the Encumbrance Certificate from the Registration and Stamps Department to see registered deeds against the property.
- Sale readiness: a buyer’s lawyer will look at the heirship paper, the updated assessment and the Encumbrance Certificate.
Who Records What in Visakhapatnam
Four bodies matter: GVMC, the Tahsildar, the sub-registrar and, for flats, the apartment association. Each keeps its own record and asks heirs for different papers.

| Body | What it records | What it asks heirs for |
|---|---|---|
| GVMC (Greater Visakhapatnam Municipal Corporation) | Property tax assessment and the assessed owner’s name | Typically the death certificate, an heirship document and the latest tax receipt; confirm at the zonal office or ward secretariat |
| Tahsildar (Mandal Revenue Officer) | Revenue land record of rights, visible on Meebhoomi as 1-B and Adangal | Written intimation of succession within 90 days under Section 4 of the 1971 land rights Act, with the death certificate and heirship paper |
| Sub-registrar office | Registered deeds and Encumbrance Certificates | A registered release, settlement or gift deed if heirs rearrange shares; a Power of Attorney where an heir is abroad |
| Ward secretariat | Local help desk; as reported, sanitary inspectors there guide death registrations | Help with the death certificate application |
| Apartment association | Owner and member names, and dues | The heirship paper and, typically, consent from co-heirs |

Settling a Visakhapatnam Property From Abroad: The Eight Steps
You sign once overseas, and a representative in Visakhapatnam handles every desk that needs someone present.
Assessment call
We start by listing what was left, where each item sits and whether a Will exists. An apartment in MVP Colony, a plot at Madhurawada and a field near Anandapuram point to three separate tracks, so each gets its GVMC zone, mandal and sub-registrar office named before drafting begins.
Document collection
Family in the city fetches the GVMC death certificate and the title papers, while you gather your passport, PAN and overseas address proof. We obtain the Encumbrance Certificate from the Registration and Stamps Department and look up every survey number on Meebhoomi.
Signing abroad
In front of a notary you sign the power of attorney, the heirs' affidavit and any consent. US, UK, Singapore and Australian documents take an apostille. Papers from the UAE go to the Indian Embassy in Abu Dhabi or the Consulate in Dubai, and German papers are attested too.
Originals to Visakhapatnam
Once the scans match the title deed and the death certificate, the originals travel by courier to our representative. A deed headed for registration should reach India quickly, because Section 26 of the Registration Act gives four months from arrival, subject to the registering officer's discretion.
Filing and notice
The Family Membership Certificate application goes in through MeeSeva, followed by the GVMC assessment request and, for land, the intimation of succession to the Tahsildar. If a bank or buyer insists on a court paper, the petition for the district court is drafted in parallel.
Enquiry or hearing
Revenue staff may visit or call to confirm who the family members are. Our representative attends, and a relative nearby backs up the verification. Any court hearing proceeds through the advocate under your power of attorney, with a video link requested only when the judge wants to hear from you.
Certificate issued, then put to use
With the certificate in hand we correct the association, GVMC, APEPDCL and Meebhoomi records one by one, and register a release or settlement deed where shares change hands. You receive scans straight away and the originals follow by courier, in whatever order each office will accept.
Money home
Sale proceeds arrive in an NRO account first. Remittance abroad can run up to USD 1 million each financial year, backed by Form 15CA and the accountant's Form 15CB (Forms 145 and 146 from 1 April 2026), after the buyer's TDS has been dealt with. Your accountant and we keep the paperwork aligned.

Example: A Sydney Pharmacist Settles Her Father’s Flat in Visakhapatnam
Illustrative example. Lakshmi, her family and the dates are made up; the offices and the order of steps are real.
The situation
Lakshmi is a pharmacist in Sydney, Australia. Her father, Venkata Rao, died in MVP Colony, Visakhapatnam, leaving no Will. He left a flat assessed with GVMC and a home loan that was almost repaid. The heirs are Lakshmi, her brother Srinivas in Visakhapatnam and their mother Padmavathi, all Class I heirs under Section 8 of the Hindu Succession Act, 1956. The family agrees that Srinivas and Padmavathi keep the flat.
Step by step
- Day 1: Lakshmi messages us on a Sydney morning. We ask for the title deed, the tax receipt, the loan details and the death certificate, which Srinivas obtains from the GVMC registrar.
- Days 2 to 5: we pull the Encumbrance Certificate, confirm the mandal for the address, and ask the lender and the GVMC zonal office in writing what each needs.
- Days 6 to 14: Lakshmi signs the Power of Attorney and heirs’ affidavit before a notary in Sydney and gets the apostille, since Australia is a Hague Apostille Convention country. She couriers the originals.
- Days 15 to 18: Srinivas and Padmavathi sign the India-side papers, and our representative applies for the Family Membership Certificate through MeeSeva.
- Weeks 4 to 6: the Tahsildar issues the certificate after verification. In this example the lender accepts it and closes the loan.
- Weeks 7 and 8: we file the GVMC assessment change with the death certificate, the certificate and the tax receipt, so the flat is assessed in the heirs’ names.
- Weeks 8 to 10: Lakshmi gives up her share by a release deed. We draft it, her Power of Attorney holder signs for her and the sub-registrar registers it.
What Lakshmi did and did not do
She signed once before a notary, sent one courier parcel and joined a few video calls. She never flew to Visakhapatnam, but she could not skip the notary, the apostille or the originals.
If Lakshmi had chosen to sell
As an NRI or OCI heir she may hold or sell inherited residential property. The buyer deducts TDS under Section 195 (Section 393(2) of the Income-tax Act, 2025 from 1 April 2026) on the full sale consideration unless a Lower or Nil Deduction Certificate (Form 13 (now Form 128), on TRACES) is obtained. Repatriation of proceeds is capped at USD 1 million per financial year, with Forms 15CA and 15CB (Forms 145 and 146 from 1 April 2026). Read our guide to TDS on sale of inherited property by an NRI and the FEMA rules for selling inherited property first.

Mutation vs Registered Deed vs Family Membership Certificate
| Feature | Family Membership Certificate | Mutation (GVMC or Tahsildar) | Registered deed |
|---|---|---|---|
| What it does | Names the heirs of the deceased | Updates the record to show who pays the tax or holds the land | Gives up or moves a share by a registered document |
| Handled by | Tahsildar, applied through MeeSeva | GVMC for the assessment; Tahsildar for land | Sub-registrar office registers it |
| Needed when | A bank, GVMC or the Tahsildar wants heirship proof | Before a sale or loan, or to pay tax in the heir’s name | Heirs rearrange shares, for example one keeps the flat |
| What it does not do | It does not transfer property | It does not give title | It does not update GVMC records on its own |
