Mutation or Sale First? The Short Answer for NRI Heirs in Pune
Title usually passes to the heirs on the death, so a sale is not barred while the records lag. In practice Pune buyers, lenders and societies want the heirs' names on the PMC or PCMC tax record, the Property Card or the 7/12 first. Sequence it: records, then a registered sale deed, with the buyer's tax deduction on a non-resident seller planned in advance. Proceeds land in an NRO account and move abroad within the annual limit. Probate is not compulsory by statute, though a buyer's bank may still ask for court papers.
- Mutation: records who pays the tax, it does not create title
- Sale deed: registered at the Sub-Registrar office that covers the property
- Tax: TDS under Section 393(2) is planned before the agreement is signed
- Money abroad: NRO account first, then remittance within the USD 1 million annual limit
Which Record Moves First, Depending on Your Pune Property
Which record has to move first depends on what the property is and who maintains its register. Use the rows below to find your starting point, then confirm the authority with an advocate before anything is signed abroad, since the wrong office will usually return the file.
| Your property in Pune | What changes on record first | Office or authority | Typical time |
|---|---|---|---|
| Flat in a co-operative housing society in Kothrud, Deccan or Aundh | Society, then PMC tax Membership and the share certificate move to the heirs, then the PMC tax name follows. A sale is planned once both are done. | Managing committee of the society, then PMC | Depends on how quickly every heir's consent reaches the committee |
| Flat or shop in Pimpri, Chinchwad, Wakad or Pimple Saudagar | PCMC tax roll The corporation's own register is changed on the heirship papers and the building's records, then the sale deed can follow. | Society or association, then PCMC | A few weeks once the heirship papers are accepted |
| House or bungalow on city-survey land in the peths or the older suburbs | Property Card The heirs are entered on the Property Card, the PMC tax name is changed, and only then is the sale deed presented. | City Survey Office, then PMC | Several weeks, longer if the card carries an old entry |
| House in Camp, Khadki or Dehu Road inside a cantonment | Board register The Board's own assessment register decides who the buyer deals with, and some plots sit on defence land with separate occupancy papers. | Pune, Khadki or Dehu Road Cantonment Board | Varies by Board, so the current checklist is confirmed first |
| Farm land in Haveli, Mulshi, Bhor or Maval | Ferfar on the 7/12 A succession mutation entry certifies the heirs. A sale then goes only to an eligible resident Indian buyer. | Talathi, Circle Officer, Tehsildar if someone objects | Several weeks when nobody objects, since the notice period is built in |
| Village house or plot in the PMRDA belt, such as Hinjewadi side or Wagholi side | Village register The Gram Panchayat assessment register and the 7/12 or Property Card may both need an update before a lender will proceed. | Gram Panchayat, Talathi, PMRDA for layout permissions | Varies by village, so we ask the office first |
Many Pune estates sit across several rows at once, for example a society flat, a field and a city house. We sequence the filings so each office receives what it needs from a single signed set.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentWhich Pune Body Holds Which Record: A Working Map for Sellers
Selling an inherited property in Pune starts with a basic question: who keeps the record of the owner's name? The answer changes from street to street. Before any application is signed abroad, we place the property in one of the zones below, because the mutation route, the buyer's checks and even the stamp on your power of attorney follow from it.
Pune Municipal Corporation limits
Kothrud, Baner, Aundh, Kharadi, Hadapsar, Shivajinagar and the old peths sit inside PMC. Its property-tax department keeps the assessment register that a buyer's bank will read, and the name on the bill is changed by an application supported by the heirship papers. Villages merged into PMC in recent years can still carry their old village names on documents, so look at the ward on the bill and not the postal line.
Pimpri Chinchwad Municipal Corporation limits
Pimpri, Chinchwad, Akurdi, Nigdi, Wakad and Pimple Saudagar answer to PCMC, which runs its own tax roll and its own name-change procedure. A flat with a Pune postal address but taxed by PCMC will be turned away if the application is lodged at PMC.
Cantonments
Pune Camp, Khadki and Dehu Road each have a Cantonment Board with an assessment register of its own, and some holdings stand on defence land with occupancy papers that are separate again. The Boards have an online route for register changes, but the steps for a sale differ from municipal areas, so we ask the Board for its current checklist before planning anything.
Gram Panchayat and the PMRDA fringe
Beyond the corporations, village houses and plots are recorded by the Gram Panchayat in its assessment register, often called Namuna 8, alongside the 7/12 or the Property Card. The Pune Metropolitan Region Development Authority governs layouts and building permissions across much of this belt, which matters more to a buyer's lawyer than to the mutation itself. Hinjewadi, Maan and Marunji sit in Mulshi taluka, and their municipal status has been discussed for merger, so the present authority needs a fresh check.
Land records
Where City Survey applies, the Property Card sits with the City Survey Office, and many plots also carry a CTS number or a Final Plot number from a town planning scheme. In rural areas the 7/12 extract is kept by the village Talathi, the Circle Officer certifies mutation entries, and the Tehsildar of Pune City, Haveli, Mulshi, Bhor, Maval or another taluka hears objections. The Mahabhumi portal shows digital 7/12 extracts and the status of mutation entries.
Registration
A sale deed is registered at the Sub-Registrar office whose area covers the property, under the Inspector General of Registration. The office follows the location of the land or building and not the seller's address. IGR Maharashtra's online search lists earlier registered documents, which buyers use to test the chain of ownership.
These bodies do not update each other. A name changed at PMC does not change the 7/12, and a registered sale does not alter the society's own register. Each record is updated, or at least checked, on its own track, which is why a clean plan at the start saves months at the end.
Mutation by Property Type: Flat, Bungalow, Plot and Farm Land
Mutation means entering the heirs' names in the record that raises the tax or shows possession. It does not make anyone an owner, because title already passed on the death, by succession or under a Will. What mutation gives a buyer, a lender and a registrar is one clean document to rely on. How it runs depends on what you inherited.
A flat in a co-operative society
The committee moves membership and the share certificate to the heirs, normally on an application with the death certificate, the share certificate, proof of heirship and consents or an affidavit from every other heir. The Maharashtra Co-operative Societies Act and the society's bye-laws guide the step. A nomination helps the society act quickly but does not make the nominee the sole owner, so a sibling's signature still counts. After the society records the heirs, the corporation updates its tax record.
A flat in an apartment-owners' building
Many newer Pune complexes hold title through a registered deed rather than society shares. Heirs rely on their heirship papers for the tax and utility records, while a transfer between heirs, such as one sibling buying out another, is documented by a registered deed. The association's own register and billing then follow.
A bungalow or house on city-survey land
The heirs apply to update the Property Card, attaching the death certificate, the heirship proof and the existing card, and the PMC or PCMC tax name follows. Read the card before applying. An entry for a previous generation, a mortgage noted in the other-rights column or a name spelled differently from the passport are the usual snags, and each needs an affidavit or a correction.
Agricultural land
The heirs report the death to the Talathi, who opens a mutation entry in the register, displays notice and informs the people named in the record. If nobody objects in the notice period, the Circle Officer certifies the entry and the 7/12 shows the heirs. The Maharashtra Land Revenue Code expects a report of acquired rights within three months, and late reports are commonly still taken up, though the office may ask for an explanation. If someone objects, the Tehsildar hears the dispute. A revenue officer does not decide title, which only a civil court does.
Before a sale, read the tenure on the 7/12 too. Land shown as occupancy class II or as new tenure can need the Collector's permission to transfer, and an old crop-loan entry in the other-rights column must be cleared first. The state's fragmentation law also affects how a small holding can be divided, so splitting a field among siblings is not always permitted.
Where the family holds almost no paper
Some inherited houses in older Pune neighbourhoods exist only as a share certificate, a handwritten receipt or a tax bill in a grandparent's name. We rebuild the chain from earlier registered deeds, the tax history and a heirship document, and we say plainly if a court declaration is the safer road.
Heirs who disagree
If siblings differ over who keeps the property, settle that before mutation. A registered release deed from those who step aside is the usual instrument, and each heir's consent is recorded in writing so the buyer's lawyer can see the full picture.
Sale Stage: Society, Registrar and What a Pune Buyer Will Check
Once the records show the heirs, the sale is an ordinary Pune transaction with a few extra layers for a non-resident seller. Most deals move in this order: an agreement, due diligence by the buyer's advocate and bank, the lower-deduction certificate for tax, then the registered deed.
Agreement and stamp duty
In Maharashtra, stamp duty is generally assessed on the higher of the agreed consideration and the government valuation for that location, published by the Registration and Stamps Department. Check the current valuation and the duty on the department's portal and do not rely on an agent's memory of last year. Who bears the duty is a matter for the contract, and the treatment of an earlier agreement can affect the final deed, so a Pune advocate should settle the sequence before anything is signed. The Income-tax law also compares the stamp-duty value with the agreed amount, with a tolerance band, so the seller's capital gain can be worked on the higher figure.
What the buyer's side will check
A careful buyer, and certainly the buyer's lender, will ask for the following.
- A title search covering earlier owners, backed by an Index II search on IGR Maharashtra for registered transactions
- The 7/12 or Property Card, with the mutation entries that show how the property reached you
- The heirship or Will papers, and proof that every legal heir has either signed or released a share
- The society's no-objection letter, share certificate and statement of dues; for a plot, the layout and the non-agricultural order
- Tax receipts from PMC, PCMC, the Cantonment Board or the Gram Panchayat, plus sanctioned plans and the occupancy certificate for a building, and RERA registration for newer projects
- Proof that any home loan or society lien on the flat has been closed
Every heir signs, or steps aside by deed
A buyer's lawyer will not accept a sale by one heir of a property that passed to several. Heirs abroad sign through the power of attorney. Heirs in Pune sign at the registrar's office, or release their shares by a registered deed earlier.
Registration
The deed is presented at the Sub-Registrar office that covers the property. The parties or their authorised representatives attend with identity proof, photographs, PAN and two witnesses, and the registrar checks the documents, the valuation and the duty paid. If you sign through an attorney, expect the registrar to read the authority closely, so the document must list the sale acts expressly. IGR Maharashtra offers online document preparation and appointments, and its procedure is revised from time to time.
After registration
The buyer applies to the society and the corporation for the name change, or to the Talathi for the 7/12 entry on a field. As the seller you give your consents promptly and make sure dues are cleared up to the handover date, while the tax formalities run in parallel.
Selling farm land near Pune
NRIs and OCI cardholders may inherit agricultural land but cannot buy it, so a later sale generally goes to a resident Indian citizen. Maharashtra's tenancy law, the Bombay Tenancy and Agricultural Lands Act, can restrict buyers who are not agriculturists. A plot carved out of farm land without a non-agricultural order carries a regularisation risk, and land near a Ring Road alignment, a development-plan reservation or a green zone attracts both interest and objections. We ask what the development plan shows before the listing is discussed.
Signing From Abroad, Settling the Tax and Bringing the Money Home
For a non-resident seller, three things run beside the sale itself: the power of attorney that lets Pune act for you, the tax on the gain, and the banking route out of India. Handle them in that order and the sale itself stays simple.
The power of attorney
Draft the mutation powers and the sale powers separately. The sale powers should let the attorney sign and present the deed, admit execution before the registrar, collect the proceeds only into your NRO account, and apply for tax certificates. Stamp treatment of a sale power depends on its terms, for example whether it is irrevocable or given for a consideration, so a Pune advocate should confirm it. Section 33 of the Registration Act lists how a power of attorney made outside India is authenticated, and the registrar will examine the document.
Apostille or attestation
The United States, the United Kingdom, Singapore and Australia are members of the Hague Apostille Convention, so the notarised set is apostilled there. Canada acceded in 2024, and the current route should be confirmed with the Indian mission. The UAE is not a member, so papers signed in Dubai or Abu Dhabi go to the Indian Consulate in Dubai or the Embassy in Abu Dhabi for attestation. Germany objected to India's accession, so German papers also follow the attestation route.
The two clocks
Under section 18 of the Maharashtra Stamp Act, an instrument signed outside India is stamped within three months of first being received in Maharashtra. Under Section 26 of the Registration Act, 1908, a document executed outside India can be presented for registration within four months of reaching India, at the registrar's discretion. Keep the courier receipt, because both clocks start from arrival.
Tax deducted by the buyer
The buyer must deduct tax on a payment to a non-resident seller. Since 1 April 2026 that rule is Section 393(2) of the Income-tax Act, 2025, and earlier it was Section 195. The deduction is generally worked on the full sale consideration, not just the gain. Your CA can apply on the income-tax portal for a lower or nil deduction certificate on Form 128 (earlier Form 13), with the previous owner's acquisition details and the inheritance papers, and that application belongs before the agreement is signed.
Capital gains basics
India has no inheritance tax, and receiving the property is not taxed. A later sale is. The previous owner's acquisition value and holding period are carried to you, so a property held for more than 24 months in total is generally long-term. Rules on indexation changed in 2024, and reinvestment exemptions may apply in some cases, so the CA runs the numbers. You then file an Indian return, claim credit for tax deducted and receive any refund. Check also whether your country of residence taxes the gain and gives treaty credit.
NRO account and repatriation
The proceeds are credited to your NRO account. From there, up to USD 1 million per financial year can generally be remitted abroad, counting every remittance in that year. The bank asks for the remittance certificate on Forms 145 and 146 (earlier 15CA and 15CB), the sale deed, the inheritance proof and evidence of tax paid. A larger sum may need the Reserve Bank's permission, and many families spread remittances across financial years.
A Realistic Timeline, Stage by Stage
No two Pune sales run to the same clock, so read these as soft ranges and not as promises.
Papers and signing abroad
usually a couple of weeks to prepare, sign, notarise and apostille or attest, with courier time on top.
Mutation of a flat
a few weeks to a couple of months, driven by how fast every heir's consent reaches the committee, then a further few weeks for the corporation's record.
Mutation of farm land
several weeks when nobody objects, because the notice period is built in, and several months if the Tehsildar must hear an objection.
Lower or nil deduction certificate
often several weeks, so we apply as soon as a buyer and a likely consideration are known.
Buyer's diligence and agreement
a few weeks, longer if the buyer's bank raises queries.
Registration
fixed by appointment, and the delay is usually in the lead-up rather than at the counter.
Remittance abroad
a few weeks after the proceeds arrive, once the CA's certificate and the bank's checks are done.
A tidy flat inheritance, with agreeing heirs and a cooperative society, often takes several months from the first call to money abroad. Farm land and family disputes take longer.
Common Mistakes That Stall a Pune Sale by an NRI Heir
Most delays come from a short list of avoidable slips.
Signing the sale agreement before the tax certificate is applied for
The buyer is then left to deduct on the whole consideration, and the refund comes only after an Indian return is filed.
Treating a nominee as the sole owner
A nominee holds for all legal heirs, so a sibling who was never asked can stop a sale late in the process.
Name mismatches
Marathi and English spellings, a missing middle name or a married surname differ across the passport, Aadhaar, the 7/12 and the share certificate, and each needs an explanation.
A power of attorney that covers mutation only
The registrar will not accept a deed signed under a document that never mentions sale.
Late stamping
A set signed abroad that sits in a drawer past the three-month window needs fresh handling.
Proceeds paid into the attorney's account
Money should go only to your NRO account, since the remittance papers depend on it.
Filing at the wrong body
A Wakad address belongs to PCMC, a Camp address to the Cantonment Board, and a village plot to the Gram Panchayat.
Ignoring a running loan or society lien
A buyer's lender will not proceed until the loan is closed and the lien removed.
Marketing farm land to the wrong buyers
Offering inherited farm land to an overseas buyer or to someone who does not qualify under Maharashtra's tenancy law wastes the negotiation.

From Inherited Record to Proceeds Abroad: The Eight Steps
Each step below is sequenced so that the record, the tax certificate and the sale deed arrive in time for each other.
Place every asset in its record office
We list each property, its PMC, PCMC, cantonment or village record and the Sub-Registrar office that will register a sale. A Wakad flat, a Camp bungalow and a Maval field need three different tracks, so this map comes before any signature abroad.
Gather heirship proof and align names
We settle which document carries the heirs, whether a Tehsildar's certificate, a Will or a court order, and line up spellings across passport, Aadhaar, PAN, the 7/12 and the share certificate. A one-and-the-same-person affidavit is prepared only where a mismatch remains.
Draft the power of attorney with separate powers
Powers for mutation and powers for sale are listed apart: sign and present the deed, admit execution before the registrar, receive proceeds only into your NRO account and apply for tax certificates. You sign once before a notary, then apostille or consulate attestation follows.
Courier originals and log the arrival date
Scans are checked by a Pune advocate first. The originals then travel by courier, and the date they first reach Maharashtra is recorded, because stamping under the Maharashtra Stamp Act and the later registration window both run from that arrival.
Mutate the record in the heirs' names
The society, the corporation, the City Survey Office or the Talathi receives the application suited to the property type. We track notices and objections, then collect the updated tax record, Property Card or certified 7/12 and file them for the buyer's lawyer.
Apply for the lower or nil deduction certificate
Once a buyer and a likely consideration exist, your CA applies for the Form 128 certificate on the income-tax portal, with the previous owner's acquisition details and the inheritance papers. The agreement is signed with that application under way, so the buyer's deduction can follow the certificate.
Settle terms and register the sale deed
The buyer's advocate completes the title search, and the agreement and duty position are confirmed. The deed is then presented at the Sub-Registrar office, by you or by your attorney, within the stamping and registration windows that apply to documents signed abroad.
Close the tax file and remit abroad
We confirm the buyer deposited the deduction at the certified rate, collect the certificate and route the proceeds into the NRO account. Your CA then issues the remittance certificate on the Forms 145 and 146 route so the bank can send funds abroad within the annual limit.

- Records and sale on one plan: The mutation steps, the tax certificate and the sale deed are scheduled together, so a buyer is never kept waiting for a record that nobody has started.
