Which Document Does an NRI Heir Need in Pune? The Short Answer

Short answer

Pune has no single certificate that opens every door. A Tehsildar's Vaaras (heirship) certificate usually serves pensions, utility transfers and revenue entries, while banks, fund houses and depositories often want a civil-court succession certificate, or probate where a Will exists. Section 213 of the Indian Succession Act, which had required probate only for Wills tied to the old presidency towns such as Mumbai, was removed in December 2025, so probate is not compulsory by statute for a Pune estate, yet many institutions still ask for it. Overseas heirs can run all of this through a power of attorney and affidavits signed before a notary abroad.

  • Heirship certificate: Tehsildar office for Pune City, Haveli or Mulshi; suits pensions, utilities and revenue records
  • Succession certificate: granted by the Pune civil court; commonly demanded for deposits, units and shares
  • Probate: proves a Will before the Pune court; still widely requested although no longer compulsory
  • Flat or field: society transmission and PMC or PCMC tax change for a flat, Ferfar on the 7/12 for farm land

Which Document Fits Your Pune Asset: Heirship Certificate, Succession Certificate or Probate?

Pune assets rarely share one paperwork track. A flat in Kothrud, an account at a Camp branch and a field in Mulshi can each ask for a different proof. Match what your parent left against the rows below, then confirm the institution's requirement before anything is signed abroad.

Rows often combine. One Pune family may need a heirship certificate for the pension, a society resolution for the flat, a court certificate for the mutual funds and a Ferfar for a field. We sequence them so a single set of signed papers serves every filing.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

Which Pune Office Covers Which Address: A Working Map

On a postal label Pune is one city. For succession paperwork it behaves more like four jurisdictions sharing a map. The body that records the death, the body that taxes the building and the revenue office that issues the heirship certificate are frequently three different desks. Here is how the common addresses sort out.

  • Inside PMC limits. Kothrud, Baner, Koregaon Park, Shivajinagar, Kasba Peth and the Hadapsar belt that holds Magarpatta fall under the Pune Municipal Corporation. PMC's health department registers deaths that occur in its area, and its property-tax department holds the assessment record for houses and flats. Where City Survey applies, the Property Card sits with the City Survey Office.
  • Inside PCMC limits. Pimpri, Chinchwad, Akurdi, Nigdi, Bhosari and Wakad belong to the Pimpri Chinchwad Municipal Corporation, which keeps a separate death register and tax roll. A family with a Chinchwad flat who file at PMC will simply be sent back.
  • Cantonment areas. Camp comes under the Pune Cantonment Board, Khadki under the Khadki Cantonment Board (formerly spelt Kirkee) and Dehu Road under its own Board, although merging or excising the civilian areas into PMC has been proposed, so the current position needs a check. Each registers deaths and maintains property-tax registers within its limits, and cantonment property owners, Khadki included, can apply for mutation of the tax register online through the eChhawani portal.
  • Edge villages. Hinjewadi, Maan and Marunji lie in Mulshi taluka, and their municipal status has been the subject of merger proposals, so the right authority needs a current check rather than an assumption. Farm land across Haveli, Mulshi, Bhor or Maval is a village revenue matter, not a municipal one.

A death certificate follows the place of death. Deaths are registered where they occur, not where the family lives. A man who lived in Baner but passed away in a Pimpri hospital leaves a PCMC death certificate, while his flat stays in PMC's tax records. Overseas heirs are sometimes alarmed to see two corporations on their papers. That is normal. Each later office only needs to be satisfied that the deceased is the same person, so the identity details have to match.

The Tehsildar is chosen by land, not by corporation. The revenue office depends on the deceased's address or the property, and whether that is Pune City, Haveli or Mulshi taluka can differ between two addresses with the same PIN code. We confirm the office before filing, because an application lodged in the wrong taluka is usually returned rather than forwarded.

Moving a Pune Flat to the Heirs: Society, Association and Municipal Records

A flat is often the most valuable item an overseas family inherits in Pune, and it passes through three separate hands: the building's own body, the corporation's tax record and, occasionally, a court. Many older buildings in Kothrud, Deccan, Aundh and Camp are co-operative housing societies. Newer complexes, including some in Baner, Kharadi and Hinjewadi, may instead be run as an apartment owners' association, with the flat held through a registered deed rather than society shares. The paperwork changes with the structure, so we check which one applies first.

In a co-operative housing society. Section 30 of the Maharashtra Co-operative Societies Act, 1960 directs the society to transfer a deceased member's share and interest to the nominee, or, where nobody was nominated, to the person the committee finds to be the heir or legal representative. Courts have described a nominee as acting for all the heirs, not as the exclusive owner. In practice a Pune society asks for a written application, the death certificate, the share certificate, a no-objection letter from the other heirs (or an affidavit listing them) and often an indemnity bond. If heirs disagree, or a housing loan is still running, the committee may insist on a court document. After its resolution, the share certificate is reissued in the new names.

In an apartment association. Ownership rests in the registered deed, so the heirs prove title through their heirship papers, and any transfer between heirs is documented by a deed registered at the Sub-Registrar's office. The association's bye-laws and deed of declaration set out the remaining steps, and it then updates its records and billing.

Municipal and survey records. Once the building has accepted the heirs, the property-tax name is changed at PMC, PCMC or the Cantonment Board concerned. Where the land falls under City Survey, the Property Card is updated through a separate mutation application. Electricity, water and gas connections are handled individually, usually on the same set of papers.

Redevelopment is the Pune-specific trap. Several older societies in the central peths and the Kothrud and Erandwane belt are at some stage of redevelopment. A deceased member's unresolved heirship can stall the society's agreement with the developer, because every heir's signature is needed on the consent. If you live overseas, ask that your power of attorney says expressly that the representative may sign redevelopment documents. A broad general clause may not satisfy the society's or the developer's lawyers.

Inherited Farm Land Around Pune: The 7/12, the Ferfar and the Talathi

Plenty of Pune families still hold a field in Mulshi, Haveli, Bhor or Maval that was never renamed after a grandparent died. That land lives in the village revenue system, not the municipal one, and the starting document is the 7/12 (Satbara) extract: the 7 side records ownership and rights, and the 12 side records cultivation.

How a succession Ferfar runs. The heirs report the death to the village Talathi with the death certificate and proof of who the heirs are. The Talathi opens a mutation entry in the register, a notice reaches the people concerned, and the entry waits through the objection period laid down in the 1971 record-of-rights rules. A revenue officer, usually the Circle Officer, then certifies it. If someone objects, the dispute is heard at a higher level, typically by the Tehsildar. Once certified, you obtain the updated 7/12, which is also available in digital form from the state land-records portal.

What a Ferfar does not do. A mutation entry updates the revenue record. It does not decide ownership, so a family quarrel still ends in a civil court. Even so, banks, buyers and the revenue office all rely on a clean 7/12, which makes the entry worth completing early.

Read the old extract first. Older 7/12 sheets often show a previous generation still as owner, a different spelling of the deceased's name, tenancy entries, or a bank's crop-loan lien in the other-rights column. Each one has to be explained or cleared. Small shared plots can also be recorded in sub-divided shares, and the state's fragmentation law can restrict how a tiny holding is split among heirs, so do not assume the field can simply be divided.

When one heir keeps the field. A sister in Pune may wish to keep the land while her brother in Dubai steps aside. That is usually done by a registered relinquishment deed (a Hakka sod patra) at the Sub-Registrar, followed by a Ferfar. If the brother signs abroad, the deed travels like any overseas document: notarised, apostilled, stamped within three months of first being received in Maharashtra, and presented for registration within four months of arrival in India under Section 26 of the Registration Act, 1908, subject to the registering officer's acceptance.

Selling later. FEMA allows NRIs and OCI holders to inherit agricultural land, but they can generally transfer it only to a person resident in India who is an Indian citizen, and Maharashtra's tenancy and agricultural-land laws can narrow the field of buyers further. Plan a sale only after the 7/12 shows the heirs' names. Our guide to FEMA rules for selling inherited property covers the exchange-control side.

The Pune Court Route, and the Paperwork Slips That Stall It

A succession certificate or probate for a Pune estate is ordinarily sought from the civil court at Pune, not in Mumbai. The Bombay High Court has its principal seat in Mumbai, with benches at Nagpur, Chhatrapati Sambhajinagar and Panaji and a circuit bench at Kolhapur, and none of these sits in Pune. The Kolhapur circuit covers Kolhapur, Sangli, Satara, Solapur, Ratnagiri and Sindhudurg, but not Pune district. Which Pune court takes the petition turns on where the deceased lived or held property and on the nature of the matter, so we confirm it before drafting.

How a petition travels. The advocate files a petition with the heirs' affidavits, the death certificate and a list of assets. The court directs that a notice be displayed and published, so anyone who objects can come forward, and it may ask for a bond or security before issuing a certificate for debts and securities. If no one objects, the order follows after the petitioner's evidence is heard. A probate petition adds the original Will and evidence from its attesting witnesses, and then runs through the same notice and objection stages. For the difference between the court documents, see our note on succession certificates and letters of administration.

What an overseas heir contributes. Affidavits, no-objection consents and the power of attorney are signed abroad and apostilled, and the Pune advocate files and attends. An overseas executor named in a Will can be asked for more, since the court may want the executor's own statement. We tell you early if that looks likely.

Where Pune files stall. A handful of small mismatches cause most of the delay.

  • Different spellings. Marathi names often run as first name, father's name, surname. A passport may drop the middle name that Aadhaar and the 7/12 carry, and a transliteration can turn Kulkarni into Kulakarni. A one-and-the-same-person affidavit is the usual fix, but aligning the names early is cleaner.
  • Married daughters. A daughter's surname changes at marriage, so her link to the deceased is proved with a birth or school record in her maiden name together with the marriage certificate.
  • Mixed addresses. The word Pune appears on PMC, PCMC and some cantonment addresses, so a file can be lodged with the wrong body. Check the ward or the heading on the tax bill, not the postal line.
  • Gaps in the chain. An old 7/12 may still show a grandfather, or a share certificate may stand in a spouse's name. Each gap is a link someone must explain in an affidavit or repair through a Ferfar.

Why does the right office depend on where the property sits in Pune?

A Pune address can fall under PMC, PCMC or a Cantonment Board, and the death certificate, property-tax record and mutation entry come from the body that governs it. Kothrud is under PMC, Pimpri under PCMC, and Pune Camp or Khadki under a Cantonment Board. Farm land is recorded under a taluka such as Haveli or Mulshi.

Overseas heirs often start at the wrong office because the family home and the inherited land are in different places. A wrong filing can be returned or questioned, which costs weeks, so we confirm the issuing body before anything is signed abroad.

The records differ too. Urban property sits on the City Survey Property Card and municipal property-tax records. Agricultural land sits on the 7/12 (Satbara) extract, updated by a mutation entry (Ferfar).

What do you need an NRI legal heir certificate in Pune for?

  • Property records: a Ferfar mutation entry on the 7/12 extract for land, and the property card, society share transfer and PMC or PCMC property-tax name change for a flat or house.
  • Bank and insurance claims: many banks and insurers accept it for the deceased's accounts and policies. Some insist on a Succession Certificate instead.
  • Pension and employer dues: family pension, provident fund and gratuity claims usually ask for proof of who the heirs are.
  • Utility connections: electricity, water and gas connections can be moved into an heir's name with it.
  • Sale or transfer: buyers, banks and registrars ask for it before an inherited flat or plot is sold or transferred.
  • Proof of who inherits: it names the heirs under the Hindu Succession Act, 1956, or under the personal law that applies to the family.

Which office issues the legal heir certificate in Pune?

The Tehsildar office (Revenue Department) covering the deceased’s residence or property location issues the certificate. Pune City, Haveli and Mulshi are separate talukas, so the office depends on the address. For an NRI legal heir certificate in Pune, the application is filed online on the Maharashtra Aaple Sarkar portal, or offline at the Tehsildar office or a Setu Suvidha Kendra. The official Heirship Certificate application form is published on Mahaonline.

Settling a Pune Estate From Abroad: The Eight Steps

You sign once overseas. A Pune advocate and our representative handle everything that needs someone in the room.

1

Free assessment call

We ask what your parent left, where each asset sits and whether a Will exists, then say which Pune office or court each item needs. A flat in Baner, a PCMC house and Mulshi land usually mean three separate tracks, so we map them before drafting anything.

2

Document collection

You receive one list for what you can find overseas and another for relatives in Pune. Family can pull the death certificate, 7/12 extract, property card and society share certificate while you gather passport, PAN and overseas address proof, so neither side waits for the other.

3

Sign abroad

We prepare the heirship affidavit, consents and a power of attorney naming our Pune representative. You sign before a notary where you live. Members of the Hague Apostille Convention, such as the US, the UK, Singapore and Australia, apostille the set; other countries, the UAE included, use Indian consulate attestation.

4

Courier originals to Pune

Email scans first so a Pune advocate can check every name and signature against Aadhaar and the 7/12, then send the originals by courier. A document signed abroad is stamped under the Maharashtra Stamp Act within three months of first being received in Maharashtra, and we track that date for you.

5

Filing and notice

For a Vaaras certificate we file on Aaple Sarkar or at the tehsil office or a Setu Suvidha Kendra, and the Talathi inquires locally. For a succession certificate or probate we file a petition in the Pune court, where public notice lets anyone with an objection come forward.

6

Hearing

In an uncontested matter your Pune advocate appears for you under the power of attorney and your affidavits. If a judge asks to hear from you, we raise it well ahead and plan around your calendar and time zone, including video attendance where the court permits it.

7

Certificate issued, then put to use

When the document arrives we work through the society's share transfer, the PMC or PCMC property-tax name change, the Ferfar entry on the 7/12, bank claims and demat or fund folios, in whatever order each institution will accept.

8

Money home

Sale or maturity proceeds land first in your NRO account. Remitting abroad is allowed up to USD 1 million per financial year, supported by Form 15CA and a Chartered Accountant's Form 15CB (Forms 145 and 146 from 1 April 2026), and any buyer's TDS is settled before the money moves.

Pune Document Checklist: What You Hold and What Family Can Fetch

Keep one folder of scans in which every name matches. Marathi and English spellings, initials and a missing middle name are the commonest triggers for queries. If two documents spell a name differently, tell us early so that the right one-and-the-same-person affidavit is drafted.

From you (abroad)

  • Passport, plus the visa, residence card or OCI card that shows where you live
  • Indian PAN card, needed for bank claims, tax filings and any later sale
  • Power of attorney and heirship affidavit, signed before a notary and apostilled or consulate-attested
  • Signed no-objection consents from any sibling or relative who also lives overseas
  • Overseas address proof, such as a utility bill or bank statement, in the same name as your passport
  • Specimen signatures that match the ones on the affidavits

From family or records in India

  • Death certificate from the registrar where the death occurred: PMC, PCMC or the relevant Cantonment Board
  • Aadhaar, PAN and address proof of the deceased, with spellings checked against the 7/12 and bank records
  • The Will with its witnesses' details, or a short statement that none exists
  • 7/12 extract and any Ferfar entry for farm land; Property Card and PMC or PCMC tax receipt for a house or flat
  • Society share certificate, latest maintenance bill and nomination record for a flat
  • Bank passbooks, FD receipts, demat statements, insurance policies and mutual fund folio details
  • Birth, school-leaving or marriage certificates that prove each heir's relationship

Example: an heir in Birmingham settles a father's Kothrud flat and Mulshi land

This is an illustrative example with fictional people. Timings are realistic, but real cases vary by office and courier speed.

Rohan, 41, lives in Birmingham, UK, and holds an OCI card. His father Suresh, a Hindu, died without a will in Kothrud, Pune, leaving a flat in Kothrud, agricultural land in Mulshi taluka on a 7/12 extract, and a mutual fund folio. The heirs are Rohan, his sister Meera in Pune and their mother, all Class I heirs under Section 8 of the Hindu Succession Act, 1956. Under FEMA an OCI holder can inherit and hold agricultural land, so Rohan keeps his share of the Mulshi land even though he could not buy it.

Week 1: confirm the offices

Rohan sends the death certificate on WhatsApp. PMC issued it, so the flat and its property-tax record sit under PMC. The land is recorded in Mulshi taluka, so the Ferfar mutation runs through the revenue office there. We confirm with the issuing office which Tehsildar office takes the application and whether one certificate serves both properties. The fund house says it wants a Succession Certificate, so we plan that court route as a separate track.

Weeks 1 to 2: drafting and signing in Birmingham

We draft the application, an affidavit naming the three heirs and a Power of Attorney for our representative. Rohan signs before a notary public in Birmingham and gets an apostille, as the UK is a Hague Apostille Convention country. He couriers the originals to Pune. This usually takes one to two weeks, and nobody else can sign for him.

Weeks 3 to 4: filing in Pune

Meera signs her consent in Pune. Our representative files the application with the affidavit on stamp paper, either online on Aaple Sarkar or offline, and attaches Rohan’s apostilled Power of Attorney.

Weeks 4 to 8: inquiry and issue

A Talathi or revenue officer inquires into the family details. Our representative handles the field inquiry, and Meera is available for verification. The Tehsildar office typically issues the certificate a few weeks after the inquiry, and Rohan has the certified copy around week 8 after courier.

Weeks 8 to 10: using the certificate

  • Flat: the certificate supports the society share transfer and the PMC property-tax name change. A later sale goes through our NRI property transfer service.
  • Mulshi land: it supports the Ferfar entry that adds the three heirs to the 7/12 extract. See how NRI agricultural land inheritance works.
  • Mutual fund folio: a lawyer files for a Succession Certificate in the civil court. Public notice makes this a matter of months.

If Rohan sells later

The buyer deducts TDS under Section 195 (Section 393(2) of the Income-tax Act, 2025 from 1 April 2026) on the full sale consideration unless Rohan first obtains a Lower or Nil Deduction Certificate (Form 13, now Form 128, TRACES). Repatriating proceeds is capped at USD 1 million per financial year with Forms 15CA and 15CB, under FEMA rules from the Reserve Bank of India. A deed signed abroad can be presented for registration within four months of reaching India (Section 26, Registration Act, 1908), at the registering officer’s discretion. Our blog on selling inherited property from abroad covers the tax side.

In this illustration, the route from first message to a certified copy took about eight weeks, and nobody flew to India. Your own NRI legal heir certificate in Pune may move faster or slower, depending on the office, the number of heirs and how complete your papers are.

What is the difference between a legal heir certificate and a succession certificate?

A Legal Heir Certificate is an administrative document from the Tehsildar that names the heirs. A Succession Certificate is a civil court order that lets you collect the deceased's debts and securities. If you need the court version, see our page on the NRI succession certificate.

Why Overseas Families Choose Propresolve for Pune Estates

  • Pune-based representation: Advocates who file at the Pune tehsils, the PMC and PCMC offices and the Pune court, so papers go in at the desk that will accept them.
  • One plan for every asset: A flat, a bank balance and a field rarely need the same document, so we sequence them instead of repeating applications.
  • Signing handled once: Affidavits, consents and the power of attorney are drafted to cover the corporation, the tehsil, the society and the court together, so you are not asked to sign again.

Frequently Asked Questions

Do I have to travel to Pune to get my late father's heirship certificate?

+
Usually not, when every heir agrees. You sign an affidavit and a power of attorney before a notary where you live, and a Pune advocate files, answers the Talathi's inquiry and attends hearings in your name. Attendance becomes a possibility only if a relative contests the claim or a judge specifically wants to question you, and we flag that risk at the outset. Many overseas heirs finish a Pune matter without boarding a flight, while family in the city simply confirm details when the revenue officer visits.

Will a Pune bank accept a Tehsildar's heirship certificate for my father's accounts?

+
Sometimes, particularly for modest balances in a savings account, but practice differs from bank to bank and even branch to branch. Larger deposits, locker contents, shares and mutual fund units more often trigger a demand for a court succession certificate or probate. Ask the branch, in writing if possible, which document its legal team accepts for your balance before you invest months in one route. We make that enquiry as part of the first assessment.

Is probate still required for a Will in Pune?

+
Not as a matter of statute, and for most Pune estates it never was. Section 213 of the Indian Succession Act, which stopped an executor or legatee from enforcing rights under a covered Will in court until probate was granted, reached only Wills tied to the old presidency towns such as Mumbai and Kolkata, and it was removed by the Repealing and Amending Act, 2025, with assent on 20 December 2025. Even so, Pune banks, depositories and registrars frequently still ask for probate before releasing assets, because it is conclusive proof of the Will. We check each institution's stance first and plan the route around it.

My mother nominated me for her society flat in Kothrud. Does that make me the owner?

+
Not by itself. Section 30 of the Maharashtra Co-operative Societies Act lets the society move the membership to the nominee, yet courts have treated a nominee as a representative of all legal heirs rather than the sole owner. Siblings and a surviving spouse can still claim their shares under succession law. Pune societies therefore often ask for a no-objection letter from every heir, an indemnity bond or a court document. If a sibling objects, the nomination alone rarely settles the question.

How do I sign from the US, UK or UAE so that Pune offices accept my papers?

+
Sign in front of a notary public, then obtain an apostille. The United States, the United Kingdom, Singapore and Australia all belong to the Hague Apostille Convention, which India recognises. The UAE does not. If your country is outside the Convention, the document goes to the Indian embassy or consulate for attestation instead. Wherever you sign, we send a draft in advance, check your passport details and brief the notary on the wording, so that nothing has to be signed twice.

What exactly can my Pune representative do under the power of attorney?

+
A well-drafted power of attorney names one person in Pune and lists the permitted acts: signing and filing applications, swearing affidavits for you, appearing before the Tehsildar, the Talathi, the civil court, PMC or PCMC offices and the Sub-Registrar, collecting certificates and following claims at banks and the society. It does not normally allow a sale unless you say so expressly. A document signed abroad is stamped within three months of first being received in Maharashtra, and a deed signed abroad is presented within the four-month window in Section 26 of the Registration Act. Read more in our NRI power of attorney guide.

Can I, as an NRI or OCI holder, inherit my father's farm land in Mulshi or Haveli?

+
Yes. FEMA lets NRIs and OCI holders receive agricultural land by inheritance, even though they are not allowed to buy it. The inheritance is recorded through a Ferfar entry on the 7/12 extract. Selling is a different matter: such land can generally be transferred only to a resident Indian citizen, and Maharashtra's tenancy and agricultural-land laws can limit who may purchase farm land and with what permissions. Settle title and records first, then plan any sale with a lawyer and a CA.

How do I move the money abroad once a Pune asset is sold or matures?

+
The credit goes into your NRO account first. From there, up to USD 1 million per financial year can generally be remitted abroad, using Form 15CA and a Chartered Accountant's Form 15CB. Keep the heirship papers, the sale deed and the TDS records together, since the bank will ask for them. Larger sums or unusual situations may need the Reserve Bank's permission, so give your CA the full picture early.

Will India tax me simply for inheriting my parent's Pune flat?

+
No. India has no estate or inheritance tax, and property received on a death is not taxed in your hands on receipt. Tax appears later if you sell, as capital gains, where the deceased's purchase date and original acquisition value are generally taken into account. Rent from the flat is taxable as it arises. Your country of residence may have its own reporting or inheritance rules for overseas assets, so take local advice there as well.

One of my siblings in Pune refuses to sign. Can the matter still go ahead?

+
It can, but not on the quick path. Without consent the society will rarely move the flat, and the Tehsildar may record the objection and point the parties to court. In a court petition for a succession certificate or probate every heir receives notice and may object, and the judge decides on evidence. A calm conversation in which a lawyer explains each person's legal share often restores consent before any petition is needed, and we try that route first.

How long will the Pune process take from my first call to the final transfer?

+
No honest single answer exists, because the route sets the pace. A Vaaras certificate depends on how quickly the Talathi's inquiry is completed. A Ferfar entry waits out a public notice period. Court petitions take longest because of notice, objections and the judge's diary. Courier time and the apostille at your end add to all of these, and the society and bank steps follow once the document is in hand. At the assessment we give you the likely sequence for your assets and update you at each stage.

Can I apply for a legal heir certificate online in Maharashtra?

+
Yes, in principle. The Revenue Department lists the heirship certificate on the Aaple Sarkar portal, where the form, scanned papers and affidavit are uploaded, and the same application can be lodged at the tehsil office or a Setu Suvidha Kendra. Uploading does not remove the inquiry: the Talathi still verifies the family and the Tehsildar still signs. Because the login, stamp-paper affidavit and local verification all sit in Maharashtra, an overseas heir normally acts through a representative in Pune. Forms change, so we confirm the current version before filing.

How is a Tehsildar's heirship certificate different from a court's succession certificate?

+
The heirship certificate is a revenue record that names the family members. The Tehsildar issues it after an inquiry, and it is not a court order. A succession certificate is granted by the civil court under the Indian Succession Act after a petition, notice and a hearing, and it authorises you to collect debts and securities such as deposits, units and shares. Banks, fund houses and depositories decide which one they want, and some want both. For the court side, see our NRI succession certificate page.

My father's flat is in Pimpri, not Pune proper. Does that change the paperwork?

+
In a few places, yes. Pimpri and Chinchwad fall under the Pimpri Chinchwad Municipal Corporation, so the death certificate (if the death occurred there), the property-tax name change and any building records come from PCMC rather than PMC. The society, the bank and the court route work the same way, though the Tehsildar office and the court with jurisdiction depend on the address and are confirmed separately. Postal addresses read Pune for both areas, which is why files often reach the wrong desk.

Who deducts tax when an NRI sells an inherited Pune flat?

+
The buyer must deduct TDS under Section 195 of the Income-tax Act, 1961 on a payment to a non-resident, and this generally applies to the whole sale consideration rather than just the gain. The Income-tax Act, 2025 now carries the rule in Section 393(2) with effect from 1 April 2026. To avoid over-deduction, apply for a lower or nil deduction certificate on the TRACES portal (Form 128, earlier Form 13) before the sale closes. Repatriating the proceeds then follows the annual USD 1 million limit.

Why does the office depend on where the property sits in Pune?

+
Because several bodies keep different records inside the same Pune address book. PMC, PCMC and each Cantonment Board register deaths, levy property tax and update their own rolls in their areas. Talukas such as Pune City, Haveli and Mulshi hold revenue records and issue heirship certificates, and village land sits on 7/12 entries kept by the Talathi. Choosing the wrong one means the file comes back, so we confirm the right combination first, for example a Baner flat, a PCMC shop and Mulshi land.
