Which Document Does an NRI Heir Need in Kolkata? The Short Answer
Kolkata has no single office whose Warish certificate every institution honours. Inside the KMC area, families usually rely on an affidavit before a Judicial Magistrate and a ward councillor's certificate. Banks, registrars and depositories often prefer a civil-court succession certificate or, when a Will exists, probate. Probate is no longer compulsory by statute (Section 213 of the Indian Succession Act was removed in December 2025), yet institutions still commonly insist on it. An NRI can run all of this through a power of attorney and papers signed abroad.
- Pension and provident fund claims: a heirship document in the form the paying office accepts, often an affidavit with a ward councillor's endorsement
- Bank balances, FDs and demat holdings: a succession certificate from a civil court, whenever the branch or registrar will not settle for less
- A Will left in Kolkata: probate or letters of administration from the Calcutta High Court or the competent civil court, where the institution asks for one
- The flat or plot itself: KMC assessment mutation, or Bidhannagar and New Town records, backed by every heir's consent
Which Document Fits Your Kolkata Asset: Warish, Succession Certificate or Probate?
Kolkata families often collect the paper that is easiest to obtain, not the one the bank or the KMC office will actually accept. The table below matches six common situations to a document, the body that issues it and a realistic time frame. Read the row closest to yours, and we will check it against the institution in writing.
| Your situation | Document you likely need | Issued by | Typical time |
|---|---|---|---|
| No Will; family pension, EPF or gratuity from a Kolkata employer | Warish (legal heir) certificate Many paying offices take an heirship affidavit with a ward councillor's endorsement; a few prescribe their own format. | Affidavit before a Judicial Magistrate (First Class) in Kolkata and an endorsement from the KMC ward office; outside KMC, the BL&LRO or Gram Panchayat | Often a few weeks, set largely by the ward office |
| No Will; savings account, FD or locker at a Kolkata branch that wants more than an affidavit | Succession certificate Granted under Part X of the Indian Succession Act, 1925. Our guide to the NRI succession certificate explains the petition. | A civil court with jurisdiction over the deceased's last residence in Kolkata | Several months, because public notice invites objections |
| No Will; a flat in a KMC ward such as Ballygunge or Behala | KMC assessment mutation Heirs ask for the assessee's name to be changed, usually with proof of heirship and the other heirs' written consent. See NRI property mutation. | KMC Assessment Department through the ward or borough office; the apartment owners' association then updates its own records | Weeks when every heir signs, longer if one objects |
| A leasehold plot or house in Salt Lake | Lease mutation in favour of the heirs The state's Urban Development and Municipal Affairs Department publishes a procedure for changing the lessee after a death, and it typically asks for an heirship affidavit and a relationship certificate. | Urban Development and Municipal Affairs Department, with Bidhannagar Municipal Corporation for the assessment record | Depends on the file; confirm with the department |
| A Will left by a Hindu, Buddhist, Sikh or Jain parent | Probate Letters of administration apply when no executor is named or the Will cannot be worked. Read succession certificate versus letters of administration. Probate is not compulsory by statute, but most institutions still ask for it. | Calcutta High Court (Original Side) or the competent civil court in Kolkata; we confirm which one applies | Several months, since notice is part of the process |
| A nominee is named on the flat, share or policy, and the other heirs disagree | Heirs' consent or a court order In most cases a nominee collects the asset on behalf of all heirs; it does not decide ownership. See NRI property transfer. | The association, bank or insurer acts first; a court settles any dispute among the heirs | Quick if every heir agrees; months if not |
The first question we settle is which municipal or district body governs the address. A Ballygunge flat, a Salt Lake lease, a New Town apartment and a house across the river in Howrah each point to a different office, and we confirm the choice with the institution before a single page is signed abroad.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentSalt Lake, New Town, Howrah or KMC: Which Office Handles Your Address?
Kolkata is not one jurisdiction. A postal address ending in Kolkata can sit under a municipal corporation, a development authority, a different district or a village panchayat, and each has its own registrar, assessment office and heirship practice. Getting this right early saves a courier trip of originals to the wrong counter.
- Inside the KMC limits. Kolkata Municipal Corporation runs 144 wards today (a 2026 amendment raises this to 209 once new boundaries are notified), which cover Ballygunge, Behala, Tollygunge, Park Street and most of the older city. The death certificate comes from the KMC birth and death registration office, the assessment name change happens at KMC, and the routine heirship paper is usually the Magistrate's affidavit with a ward councillor's certificate.
- Salt Lake (Bidhannagar). Governed by Bidhannagar Municipal Corporation, not KMC. Many plots here are leasehold from the state, so the lessee's name changes through the Urban Development and Municipal Affairs Department as well as the municipal assessment.
- New Town. Administered by the New Town Kolkata Development Authority (NKDA). Read your deed to see whether the land is held on lease, and ask the authority for its own mutation format.
- Howrah side. Howrah is a separate district with its own municipal corporation and collectorate. The Kolkata Collectorate has no role there, so a Howrah family must work with local offices.
- Panchayat and outer areas. Villages beyond municipal limits go to the BL&LRO and Gram Panchayat, where the Tathya Sathi and Banglarbhumi portals come into play.
One more trap: a death is registered where it happened, which is not always where the family lived. A father who lived in Behala but passed away in a hospital in another municipality may have a death certificate from that other registrar. Both offices are legitimate for their own purposes, so our checklist records the place of death and the place of residence separately.
Flats, Owners' Associations and Cooperative Societies in Kolkata
Overseas heirs often picture a housing society with share certificates when they think of a flat. In Kolkata the picture is more mixed, and that changes what you ask for after a death.
Most apartments in newer buildings are owned individually through a registered deed of conveyance, and the West Bengal Apartment Ownership Act, 1972 treats an apartment as heritable and transferable property. The owners' association looks after the common areas and the dues. It does not decide who the heirs are. Some complexes, and many older buildings, are cooperative housing societies instead, where the member's share and the allotment have to pass to the heirs under the society's own rules.
For an overseas heir the order of work usually runs like this:
- Prove who the heirs are, with the Warish-type paper, a succession certificate or probate, depending on what each office accepts.
- Record the division among the heirs, often through a family settlement or a release deed. A release deed signed abroad needs the same notarisation and apostille as the power of attorney. See NRI property transfer after death.
- Apply for mutation in the KMC assessment register, or the equivalent record in Salt Lake or New Town, so that the property tax bill carries the heirs' names. Our page on NRI property mutation explains the sequence.
- Ask the association or society to update its records, and settle any pending maintenance dues so a no-objection letter can be issued.
- Move the electricity connection, which in Kolkata and much of Howrah is supplied by CESC, and other utilities into the heirs' names.
A nominee in a cooperative society may be admitted provisionally, but in most cases the nominee holds the share for all the heirs and does not become the sole owner. Offices differ on how much proof they want, which is why we ask each one in writing first.
The Court Route in Plain English: Succession Certificate, Probate and Letters of Administration
When a bank, registrar or association insists on a court order, three petitions are possible. Each answers a different question.
- Succession certificate. Used when there is no Will and the heirs need to collect debts and securities, such as deposits, shares and units. The court gives the holder authority to collect them. It does not transfer land or a flat.
- Probate. Used when a Will exists. The court confirms that the Will is genuine and that the executor named in it may act.
- Letters of administration. Used when there is no Will, or when the Will names no executor who can act. It authorises a person to administer the estate, including immovable property.
In Kolkata, the right forum for these petitions can be the Calcutta High Court on its original side or the City Civil Court, and the rules on which court takes which case have changed over the years. The deceased's address, the nature of the petition and the value of the estate all matter, so our advocate confirms the forum before drafting anything. Residents of areas outside the city usually go to the district court that covers their address.
The steps look much the same in each court. A petition is drafted and the petitioner signs a verification, which an NRI can normally swear before a notary abroad, followed by an apostille or consular attestation. Notice is published so that anybody with a claim can object. If nobody does, the court usually proceeds on the papers and a brief hearing. For a succession certificate, the court may ask the holder for security or an undertaking before it issues the certificate, and your advocate will explain what applies.
With probate, the original Will normally has to be produced in court, and the witnesses who attested it may be called. This is the one document that cannot be photographed and discarded. If the Will is in a safe deposit box or with a relative in Kolkata, tell us where it is on the first call. Kolkata was among the cities where the old Section 213 rule applied to Hindu Wills. That section has gone, so probate is now a choice driven by what the bank or registrar will accept, not a statutory duty.
Names, Spellings and Bengali Family Law: Where Overseas Heirs Trip Up
Bengali names are rich in spellings, and an overseas passport is often the only document that sets one in English. A mismatch is the most common reason a Kolkata office returns an NRI file.
- Surname variants. Chatterjee and Chattopadhyay, Banerjee and Bandyopadhyay, Mukherjee and Mukhopadhyay, Ganguly and Gangopadhyay, Bose and Basu are the same families written in different ways. A deed from the 1970s may use one form, a bank passbook another, and your US passport a third.
- Formal and household names. Many Bengalis carry a bhalo naam on records and a daak naam at home. A relative signing an affidavit as ‘Tuku’ instead of the formal name will cause a query.
- Warish, Waris, Warisan. The same document appears under all three spellings, in English and in Bengali. Ask the office which spelling its form uses and keep it consistent.
- Married names. A daughter may appear under her father's surname on a school certificate and her husband's on a passport.
- Bengali-language papers. Older deeds, property tax receipts and affidavits may be in Bengali, and an office may ask for a certified translation.
Our fix is simple: one reconciliation statement, sworn along with the heirship affidavit, which lists every variant and states that they all refer to the same person. We also check every name against the death certificate before the originals are couriered.
Dayabhaga and the Hindu Succession Act. Bengal is the home of the Dayabhaga school of Hindu law, under which sons do not acquire a right by birth in the father's property. For a Hindu who died without a Will after 1956, the Hindu Succession Act, 1956 decides the heirs and their shares in West Bengal as elsewhere, so the school rarely changes the outcome for a parent's own property. It can matter for older ancestral holdings and for how a family explains its history, so ask an advocate to look at any property that was never divided. Our national guide to the NRI legal heir certificate covers the heirs in each class.
Why Is the Warish Process in Kolkata Different From Other Cities?
Kolkata has no one certificate that every bank and office accepts. The Collector of Kolkata (Stamp & Revenue) is empowered to issue a legal heir certificate within the Kolkata Municipal Corporation (KMC) area only, and only for cases directed by the government or government agencies, as the official Collectorate page states.
For a private matter such as a bank account or a flat in Ballygunge, many families follow a different paper trail in practice: an affidavit sworn before a Judicial Magistrate (First Class), often with a certificate or endorsement from the local KMC ward councillor. This is practice, not a legal rule, and acceptance varies. We confirm with the specific bank or KMC department first.
For an NRI a wrong guess costs months and a courier round trip, so our first task on every file is to ask the institution in writing what it wants. Your NRI or OCI status does not change who inherits; our guide to NRI inheritance laws in India explains why.

What Do You Need an NRI Legal Heir Certificate in Kolkata For?
You need it whenever an office asks you to prove who the surviving heirs are.
- Property records: changing the owner's name in KMC assessment or land records. See NRI property mutation.
- Bank accounts and lockers: balances, fixed deposits and locker contents.
- Insurance, PF and pension: insurance payouts, EPF, gratuity and family pension claims.
- Shares and mutual funds: transmission through the depository or registrar, which may ask for a Succession Certificate instead.
- Sale of inherited property: buyers and registrars want proof of heirship. See how an NRI inherited property sale works, including tax.
- Proof of who inherits: names the heirs under the Hindu Succession Act, 1956 or the applicable personal law.
Which Authority Issues the Warish Certificate in Kolkata?
It depends on where the deceased lived and what the certificate is for. Inside KMC limits the Collector of Kolkata (Stamp & Revenue) is the empowered authority, but only for government-directed cases. Outside KMC limits, the Block Land & Land Reforms Officer (BL&LRO) and Gram Panchayat handle it. For private matters in the city, families usually use an affidavit and a ward councillor’s certificate.
The Collectorate accepts applications offline: two sets of the filled form with all documents, at the General Section, Room no. 101, 1st Floor (North Wing). It publishes a contact number for office hours on its website.
Salt Lake (Bidhannagar Municipal Corporation) and New Town sit outside KMC limits, so the Collector of Kolkata route would not apply. Confirm jurisdiction before filing.

| Route | Where it applies | How it is filed | Typical use |
|---|---|---|---|
| Collector of Kolkata (Stamp & Revenue) | Within KMC limits only; government-directed cases | Offline, two sets of the form at General Section, Room 101 | Government-directed matters |
| Affidavit before a Judicial Magistrate (First Class) plus ward councillor certificate | KMC area; private bank and municipal work. Practice, not a legal rule | Affidavit sworn in Kolkata; certificate requested at the ward office | Routine claims; confirm with the institution |
| BL&LRO and Gram Panchayat | Outside KMC limits | Online via Tathya Sathi (Application for Issuance of Legal Heir Certificate - GP) or the Banglarbhumi Warish application | Land records, panchayat areas |
| Salt Lake and New Town | Outside KMC limits; Collector route does not apply | Confirm the competent office first | Property in these areas |
| Civil court Succession Certificate | Any area, when an institution insists | Court petition with public notice | Deposits, shares, mutual funds |

Eight Steps From Your Home Country to a Kolkata Certificate
You sign once overseas. Our advocate and representative in Kolkata handle every step that needs a person on the ground.
Assessment call in your time zone
We set the call for an hour that suits Seattle, London or Dubai. You tell us where the parent lived (a KMC ward, Salt Lake, New Town, Howrah or a panchayat), who the heirs are, whether a Will exists, and which assets need which paper.
Document collection
You receive a two-column list. What sits with you overseas goes in one column; what relatives in Kolkata can fetch from KMC, the bank or the association goes in the other. Both sides work at the same time, so nothing waits on the other.
Signing abroad
We draft the power of attorney, the heirship affidavit and any consents. You sign before a notary, then obtain an apostille in a Hague country such as the USA, UK, Singapore or Australia, or Indian consulate attestation elsewhere, which includes the UAE. Sign in the name on your passport.
Originals travel to Kolkata
Scans come first, so a Chatterjee or Chattopadhyay mismatch is fixed while it is easy. Originals then go by courier to our representative in Kolkata. The power of attorney must also be stamped as required in West Bengal, within the time the stamp law allows after it first reaches India; we check the current rule and handle it.
Filing and notice
The advocate files on the route that fits: the Magistrate's affidavit and ward councillor's endorsement inside KMC, the BL&LRO or Gram Panchayat outside it, or a petition in the competent court, where public notice invites objections, for a succession certificate or probate.
Hearing
Your advocate in Kolkata attends on your behalf. In an uncontested matter you seldom need to appear. If the judge or an office wants you personally, we raise it early and discuss the options so that you can plan leave and travel without pressure.
Certificate issued, then put to use
With the paper in hand, we go back to the bank for transmission, to KMC or Bidhannagar for mutation, to the association and CESC for their records, and to registrars and depositories for shares and fund units, one asset at a time.
Money home
Proceeds reach your NRO account first. Remittance abroad is allowed up to USD 1 million in a financial year, with Form 15CA and 15CB (renumbered Forms 145 and 146 from 1 April 2026) prepared through a chartered accountant. Our FEMA guide to selling inherited property explains the limits.

Book an assessmentWhat to Gather: A Document List for Kolkata Heirs
No list is final. A bank branch, a Magistrate's office or an association may ask for something extra, so treat this as the opening set. Photocopies are enough at the start, and originals travel only after we compare every name with your passport.
From you (abroad)
- Passport, with the photo and address pages, and proof of where you live overseas
- A copy of your OCI card, if you hold one
- Indian PAN, or the details we need to help you obtain one
- Power of attorney and heirship affidavit, signed before a notary and then apostilled or attested at a consulate
- Written consent or no-objection from any sibling who also lives overseas, signed and legalised the same way
- Details of your NRO account, or a note that one has to be opened for the proceeds
From family or records in India
- Death certificate from the KMC birth and death registration office, or from the registrar for the place of death, such as Bidhannagar or Howrah
- The deed of conveyance, lease deed or sale deed for the flat or plot, with the latest KMC assessment bill and receipt
- Bank passbooks, FD receipts, locker agreement and demat or mutual fund folio statements
- The original Will, if there is one, and the names and addresses of the attesting witnesses
- Aadhaar, voter card or PAN of the deceased and of heirs in Kolkata who will swear the local affidavit
- Proof of relationship: a marriage certificate, the children's birth certificates or school records naming the parents
- CESC electricity bill and association maintenance receipts that show the deceased as the owner

Example: A Seattle Heir Settles Her Father's Estate in Kolkata
This is an illustrative example. The family, dates and timings are fictional; the offices, documents and steps are real. It shows how an NRI legal heir certificate in Kolkata file typically moves when the heir never leaves her home country.
The situation
Priya Sen lives in Seattle, USA. Her father, Arun Sen, died at his flat in Ballygunge, Kolkata, leaving no Will. He left a savings account and fixed deposit at a Park Street bank branch, mutual fund units and the flat. The heirs are Priya, her brother Rahul in Kolkata and their mother Mala, all Class I heirs under Section 8 of the Hindu Succession Act, 1956.
Step by step
- Day 1: Priya messages us on WhatsApp in the evening, Seattle time. We ask where the flat sits (a KMC ward), whether there is a Will, who the heirs are and what the bank has asked for.
- Days 2 to 6: we write to the bank, the fund registrar and KMC. The branch will consider an affidavit before a Judicial Magistrate (First Class) with a ward councillor’s certificate. The registrar wants a Succession Certificate. The Collectorate is not the route, since it issues certificates only for government-directed cases.
- Days 7 to 14: Priya signs the Power of Attorney and affidavits before a notary in Seattle, gets the apostille (the US is in the Hague Apostille Convention) and couriers the originals. Scans reach us first, so a misspelt middle name is fixed before the originals travel.
- Days 15 to 21: Rahul swears the Kolkata affidavit before the Magistrate with our representative present. The representative then requests the councillor’s certificate, which can take days to a couple of weeks.
- Weeks 4 to 6: the representative submits the papers and the bank releases the account and deposit as the heirs agreed. The same papers support a KMC assessment name change for the flat.
- Month 2 onward: for the fund units, we draft a Succession Certificate petition with a Kolkata advocate. Priya signs the verification before a notary, the advocate appears and public notice runs. This takes months.
What Priya did and did not do
She signed papers twice before a notary, sent one courier parcel and joined a few WhatsApp calls. She never flew to Kolkata, but she could not skip the notary, the apostille or the originals, and neither can you.
If Priya later sells the flat
An NRI or OCI heir may inherit any immovable property in India, including agricultural land, though she could not buy agricultural land. On a sale, the buyer deducts TDS under Section 195 (Section 393(2) of the Income-tax Act, 2025 from 1 April 2026) on the full sale consideration unless a Lower or Nil Deduction Certificate (Form 13, now Form 128, on TRACES) is obtained. Proceeds can be repatriated up to USD 1 million per financial year, with Forms 15CA and 15CB under Reserve Bank of India FEMA rules. Our guide to NRI and OCI inheritance of property in India covers the limits.

What Is the Difference Between a Legal Heir Certificate and a Succession Certificate?
A legal heir certificate names the heirs; a Succession Certificate is a court order letting heirs collect the deceased's debts and securities. Some institutions insist on the Succession Certificate instead of, or alongside, the Warish. The institution decides, so we ask first.
| Feature | Legal Heir (Warish) Certificate | Succession Certificate |
|---|---|---|
| Nature | Administrative document naming heirs | Court order |
| Issued by | Collector (KMC, government-directed cases); BL&LRO or Gram Panchayat outside KMC | Civil court |
| Law | Heirs decided under Hindu Succession Act, 1956 (Section 8) or personal law | Part X, Indian Succession Act, 1925 |
| Used for | Property records, mutation, many bank, insurance and pension claims | Bank deposits, shares, mutual funds |
| Timeline | Typically weeks | Months |
| Who decides which you need | The institution asking | The institution asking |
