Which Document Does an NRI Heir Need in Hyderabad? The Short Answer
In Hyderabad the working paper is the Family Member Certificate, issued by the Tahsildar of the mandal through MeeSeva. Many banks, insurers and utilities accept it; fund houses, depositories and some branches still ask for a court succession certificate or probate. Probate was never compulsory by statute here, since Section 213 of the Indian Succession Act (removed in December 2025) only touched Wills tied to Bombay, Calcutta and Madras, yet institutions often insist. An NRI can do all of it through a power of attorney and affidavits signed before a notary abroad.
- Certificate: Family Member Certificate from the Tahsildar of the mandal, applied for through MeeSeva
- Land: Succession mutation on the Bhu Bharati record of rights, decided by the Tahsildar
- Court: Hyderabad district civil courts, Ranga Reddy court at L.B. Nagar or Medchal-Malkajgiri court at Kushaiguda, by address
- Your part: One signing session before a notary abroad, then updates on WhatsApp
Which Paper Opens Which Door for a Hyderabad Estate?
Hyderabad estates are rarely a single asset. A flat in a gated community, a deposit at a bank in Abids, a plot in an HMDA layout and a farm survey number may each be handled by a different desk. Match your parent's assets to the rows below, then ask the institution what it wants before anything is signed.
| Your situation | Document you likely need | Issued by | Typical time |
|---|---|---|---|
| Parent died without a Will, and a bank, insurer, employer or utility must be told who the heirs are | Family Member Certificate The mandal's revenue staff inquire locally before the Tahsildar signs. NRI legal heir certificate guide | Tahsildar of the mandal covering the deceased's last address | Several weeks; the field inquiry sets the real pace |
| Bank deposits, fixed deposits, lockers, mutual fund units or shares, and no Will | Succession certificate A petition under Part X of the Indian Succession Act, decided after public notice. NRI succession certificate | Civil court of the district of the last residence or of the asset | Several months, because notice and objections are built in |
| Flat in a gated community or apartment association, no Will | Association record change The association updates its owner register and maintenance ledger on the heirship paper, and the corporation's property tax name follows. NRI property transfer | Managing committee of the association, then the civic corporation | Depends on the committee and on whether every heir consents |
| House or plot in a cooperative house-building society colony, no Will | Society share transfer The committee moves the share and membership to the nominee or heirs, and asks for the other heirs' consent. | Managing committee of the society; the cooperative department if a dispute arises | Turns on how fast consents and papers arrive |
| Farm land or village land held on a pattadar passbook, no Will | Succession mutation on Bhu Bharati Heirs apply to the Tahsildar, who verifies and passes an order; the Pahani and passbooks are updated. How NRI mutation works | Tahsildar of the mandal where the survey number lies | A few weeks when heirs agree; far longer if disputed |
| A Will left by a Hindu, Sikh, Jain or Buddhist parent | Probate Proves the Will before a court. Not compulsory by statute in Hyderabad, but many institutions still ask. Succession certificate and letter of administration | Civil court of the district concerned | Months, since notice and proof of the Will are part of the process |
Rows often combine. One Hyderabad family may need a Family Member Certificate for the bank, an association record change for the flat, a court certificate for the demat account and a Bhu Bharati mutation for a field. We sequence them so that one signing session serves every filing.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentFrom Banjara Hills to Kompally: Which Authority Sits Behind Your Parent's Address
People in Hyderabad name a neighbourhood and stop there. Government records go further. Behind one address sit three separate answers: the civic corporation that taxes the building, the district and mandal that issue the heirship paper, and the court that would hear a petition. The three do not move together, so a bank statement and a tax receipt can appear to point at different places.
The civic layer changed in February 2026. The old GHMC area was reorganised on 11 February 2026 into three corporations. The residual GHMC keeps the Khairatabad, Secunderabad, Charminar, Golconda, Rajendranagar and Shamshabad zones. The Cyberabad Municipal Corporation takes the Serilingampally, Kukatpally and Quthbullapur zones, and the Malkajgiri Municipal Corporation takes the Malkajgiri, Uppal and L.B. Nagar zones. Certificates and receipts issued earlier still carry the GHMC name and the departments are still settling into the new arrangement, so we ask the office which body holds your record today.
The revenue layer did not move with it. Districts and mandals follow older boundaries, and a commission to redraw districts and mandals has been announced by the state, so the position is confirmed at the time of filing. The guide below is a starting point only. The tax receipt or survey number decides the matter.
- Old city and the south, such as Charminar, Chandrayangutta and Yakutpura: Hyderabad district, within the residual GHMC.
- Banjara Hills, Jubilee Hills, Ameerpet, Begumpet and Secunderabad: Hyderabad district, mostly within the residual GHMC. Cantonment pockets around Secunderabad belong to the Cantonment Board instead.
- Madhapur, Gachibowli, Kondapur and Miyapur: typically Serilingampally mandal of Rangareddy district, under the Cyberabad corporation.
- Kukatpally, KPHB, Nizampet and Bachupally: Medchal-Malkajgiri district, under the Cyberabad corporation.
- Uppal, Nacharam, Malkajgiri and Alwal: Medchal-Malkajgiri district, under the Malkajgiri corporation.
- L.B. Nagar, Dilsukhnagar and Hayathnagar: Rangareddy district, with the L.B. Nagar zone in the Malkajgiri corporation.
- Narsingi, Kokapet, Attapur and Shamshabad: Rangareddy district, with the corporation depending on the exact locality.
Outer towns and villages near the ring road may sit under a municipality, a gram panchayat or HMDA planning control, each with its own tax record. A postal address that says Hyderabad is no guarantee of a Hyderabad district mandal. Two houses with the same PIN code can fall under different districts, different corporations and different courts.
Flats, Gated Communities and Cooperative Colonies: Who Must Accept the Heirs
Housing in Hyderabad comes in several structures and each has its own gatekeeper. New towers in Gachibowli, Kokapet and Kompally are run by owners' associations. Older blocks in Himayatnagar, Banjara Hills and Secunderabad may be small associations or a single builder's society. Many villa colonies, among them older cooperative house-building society layouts such as those in Jubilee Hills, answer to a cooperative society and its committee. Independent houses on HMDA layouts have no association at all. The first job is to find out which structure your parent's property belongs to.
Apartments and gated communities. The Telangana Apartments (Promotion of Construction and Ownership) Act, 1987 treats an apartment as heritable and transferable property, so the flat passes to the heirs when the owner dies. The association's role is administrative. It updates its owner register, the maintenance ledger and the access records. It typically asks for the death certificate, the heirship proof, a copy of the sale deed, a no-objection letter or affidavit from the other heirs and a statement that dues are clear. Unpaid maintenance can stall the request, so arrears are settled first.
Cooperative house-building societies. Under the Telangana Co-operative Societies Act, 1964 a society may transfer a deceased member's share to the nominee or, where nobody was nominated, to the person the committee finds to be the heir or legal representative. A nominee holds for all the heirs and is not the sole owner, so the nominee's name alone rarely ends the matter. Expect the committee to want a written application, the share certificate, the death certificate and the other heirs' consent.
Flats still under construction. If the flat was booked with a builder, the builder will need written notice of the death and the heirship paper before it endorses the agreement in the heirs' names. A home loan adds a lender that must also be informed.
After the building accepts the heirs. Next comes the property tax assessment at the corporation covering the address, then the utilities. The Telangana Southern Power Distribution Company, TGSPDCL, serves Hyderabad, Rangareddy and Medchal-Malkajgiri among other districts and changes the consumer name on the strength of the heirship paper and a few forms. The Hyderabad Metropolitan Water Supply and Sewerage Board handles water connections, and the piped gas distributor keeps its own consumer record. Each wants broadly the same papers, so one set of notarised copies saves repeated trips.
If the building is likely to redevelop, or you plan to sell, we word the power of attorney so that it names those tasks specifically.
Pattadar Passbooks, Bhu Bharati and Open Plots: Inherited Land Around Hyderabad
Land is where Hyderabad estates become tangled. Around the city, families hold farm survey numbers, plots in approved layouts, plots bought on plain agreements and sometimes government-assigned land. Each category follows a separate path.
Farm land and village land. The record of rights is kept on the Bhu Bharati portal, which replaced Bhu Bharati (which replaced Dharani in 2025) in 2025. Heirs apply to the Tahsildar with the death certificate, proof of who the heirs are and the pattadar passbook. The officer verifies the family and passes an order, and updated Pahani entries and passbooks follow in each heir's name. Appeals are reported to run up the revenue ladder to the Revenue Divisional Officer and the Collector. Each parcel carries a Bhudhaar number and a survey map, so we ask for these early.
Open plots and HMDA layouts. Open plots in approved layouts, or plots regularised under the state's layout scheme, are recorded through the registered sale deed and the municipal assessment rather than the passbook. Heirs update the assessment at the corporation once the heirship paper is in hand. A plot for which the parent holds only a layout plan and no registered deed needs its chain of title traced first.
Sada bainama plots. Many Hyderabad plots were bought on plain, unregistered agreements, locally called sada bainama. The parent may have been the buyer in everything except the record. Heirs inherit what the parent actually owned, so the first step is a title search, then a registered confirmation from the seller's side. Such a plot should not be listed for sale until the paper trail is clean.
Assigned and special lands. Land granted by the government to poor families is usually restricted from sale, and the restriction passes to the heirs. Inam, wakf and old jagir holdings in the older parts of the region may carry histories of their own. We check the land's classification in the record of rights before the heirs plan a sale.
Lakes and buffer zones. Since the state created the Hyderabad Disaster Response and Asset Monitoring and Protection Agency (HYDRAA) in 2024, action against encroachments on lakes and drains has made it important to check whether a plot falls inside a full tank level or buffer area. That check belongs in due diligence before sale, not after.
NRI and OCI heirs. You may inherit agricultural land but cannot purchase it, and a later sale generally has to be to a resident Indian citizen. A registered deed signed abroad, such as a release by a brother overseas, may be presented for registration within four months of reaching India under Section 26 of the Registration Act, 1908, at the registering officer's discretion. We confirm Telangana's stamping rules for papers signed abroad before the originals are used. See NRI property mutation and our note on FEMA rules for selling inherited property.
Telugu and Urdu Names on Paper: Initials, House Names and Spellings That Stall a File
Names cause more delay in Hyderabad files than any point of law. Records were created over decades by different offices, and each office spelt the name in its own way.
Telugu naming patterns. Many Telugu families place a family or house name first, then the given name, and shorten the first part to an initial. A father's name or a native village can also appear as an initial. One paper may carry the family name in full, another a single letter, and a third may drop it. A clerk reading those lines sees several possible persons. Passports issued abroad add another twist, because some countries insist on one surname field and push the given name or the house name into the wrong box.
Spelling variants. Venkateswara and Venkateshwara, Lakshmi and Laxmi, Srinivas and Srinivasa, Reddy and Reddi, Narayana and Narayan all circulate in Hyderabad records. Urdu names pass through English in several ways: Mohammed becomes Mohd or Md, Syed becomes Sayyed, Hussain becomes Hussein. None of these is wrong by itself. The trouble starts when two documents that the Tahsildar must read side by side disagree.
Women's names. A daughter's surname may change on marriage, or she may keep one name on one record and use her husband's given name on another. Her link to the deceased is shown through a birth or school record in her earlier name together with the marriage certificate. Because daughters are equal heirs under Hindu law, leaving one off the list invites a later challenge.
Dates and relations. Approximate birth years on older Aadhaar cards, and S/o, D/o and W/o lines that differ between records, confuse a file in the same way.
What fixes it. Compare the death certificate, Aadhaar, passports, OCI card, property record and bank file side by side before anything goes to a notary. Where a mismatch remains, we draft an affidavit declaring that the different spellings belong to one individual and attach supporting records. In a few cases the record itself must be corrected first. A mismatch caught on a scan is an easy repair. One caught after the originals have been notarised and couriered means signing again.
The Court Route From Hyderabad: Which Court Hears a Petition, and Why Probate Was Never Compulsory Here
The Telangana High Court sits in Hyderabad, but a petition for a succession certificate, probate or letters of administration does not ordinarily begin there. These petitions are filed in the civil court of the district where the deceased lived, or, where no residence can be shown, where the property lies. The High Court is the forum for appeals and writs, not for the first petition.
Three district court systems. For an address in Hyderabad district, the civil courts of Hyderabad district apply. For Ranga Reddy district addresses, the district court at L.B. Nagar applies. For addresses in Medchal-Malkajgiri district, such as Uppal, Malkajgiri and Kompally, the district court at Kushaiguda is the one that normally applies. Which court takes the file can also turn on the nature of the claim, so we confirm it before drafting.
Why Section 213 never reached Hyderabad. Section 213 of the Indian Succession Act made probate a condition for proving certain Wills, and only Wills tied to the presidency towns of Bombay, Calcutta and Madras. Hyderabad was the capital of a princely state outside those towns, so a Will dealing with Hyderabad property was never bound by it. A Will that also dealt with immovable property in Mumbai, Kolkata or Chennai was a different case. Parliament removed the section in December 2025. What heirs meet in Hyderabad today is institutional practice: a bank, a registrar or a buyer's lawyer asks for probate because a court order settles any doubt about the Will.
How a petition moves. The advocate files with the heirs' affidavits, the death certificate and a list of assets. The court directs public notice so that anyone with an objection can come forward, and it may call for security before granting a certificate for debts and securities. If nobody objects, the order follows after the petitioner's evidence. A probate petition adds the original Will and evidence from the attesting witnesses. Letters of administration are used where there is no Will or no executor willing to act, and the choice between these documents is explained in our comparison of succession certificates and letters of administration.
Your role from abroad. You sign affidavits, consents and the power of attorney before a notary, attested as your country requires. The Hyderabad advocate files and attends. Where a judge wants to hear an executor or a witness in person, we raise it early and ask whether the court allows video attendance, which varies by court.
Hindu, Muslim and Christian Families: How Personal Law Shapes the Heir List in Hyderabad
The Tahsildar's certificate lists the heirs the family law recognises, and Hyderabad has an unusually mixed population. Getting the personal law right at the start prevents a certificate that names the wrong people.
Hindu, Buddhist, Sikh and Jain families. The Hindu Succession Act, 1956, as amended in 2005, governs a death without a Will. A son, a daughter, a widow and a mother are all first-class heirs, and the Supreme Court's 2020 ruling in Vineeta Sharma confirmed that daughters share equally in coparcenary property. A pre-deceased child's own children can step into that child's place.
Muslim families. Muslim personal law fixes shares for the spouse, children and parents, and a Will is generally limited to about one third of the estate unless the heirs agree to more. The household structure, the sect and any earlier marriages affect the shares, so the heir list is prepared with care and with the family's input. Property held as wakf follows different rules altogether.
Christian and Parsi families. Intestate succession is governed by the Indian Succession Act, 1925, which sets shares for the spouse and children on different rules from Hindu law.
Special situations. A second marriage, an adopted child, half-siblings, a marriage outside the faith or a conversion each change the list. Tell us at the first call, even if the subject is delicate. The inquiry will find it anyway, and a certificate that omits an heir can be challenged later.
NRI and OCI status. Living abroad or holding a foreign passport does not alter who inherits. The personal law of the deceased decides, and our guide to NRI property inheritance in India explains how that works for overseas heirs.
Why a Hyderabad Address Needs a Mandal Check Before Anything Is Filed
The certificate goes to the Tahsildar of the mandal that covers the address, so the first job is to identify that mandal. Hyderabad district alone has 16 mandals, and a locality name on a bank statement does not say which one applies. A flat in Banjara Hills sits in Hyderabad district. A house in Kukatpally or Serilingampally falls in a different mandal and, after the 2026 reorganisation, under the Cyberabad Municipal Corporation rather than GHMC.
A file lodged with the wrong mandal can be sent back, which costs weeks. We confirm the mandal and corporation from the property tax receipt and death certificate before drafting. Your NRI or OCI status does not change who inherits; our guide to NRI inheritance laws in India explains why.

What You Need the Hyderabad Certificate For
- Bank accounts and lockers: branches usually ask for an heirship document first. Some accept the Family Member Certificate, others want a court order, so we ask the branch.
- Pension, PF and insurance: official Telangana district pages list insurance, pension and retirement benefits among its uses.
- Property tax name change: the corporation covering the flat typically asks for the death certificate and an heirship document before changing the assessed owner.
- Land records: heirs of agricultural land deal with the Tahsildar under Telangana’s Bhu Bharati land record system, which replaced Dharani.
- Apartment associations: they usually want the same proof before recording heirs as owners.
- Demat and mutual funds: registrars set their own rule, and some insist on a court Succession Certificate.
- Sale readiness: a buyer’s lawyer will ask for the chain of heirs before paying.
Who Issues the Certificate in Hyderabad, and Where It Is Filed
The Tahsildar of the mandal issues it, and the application goes through MeeSeva, the Telangana government’s e-service portal, or through the Mandal Revenue Office. The portal files the service under the Revenue Department as the Family Member Certificate. Official Telangana district pages call the same document the legal heir certificate and say it is issued within 30 days of application, after verification by the Tahsildar’s office.

| Item | What applies in Hyderabad |
|---|---|
| Certificate name | Family Member Certificate on MeeSeva; called the legal heir certificate in everyday use |
| Issuing authority | Tahsildar of the mandal (also called the Mandal Revenue Officer), after field verification |
| Where it is filed | A MeeSeva centre or the MeeSeva portal; the Mandal Revenue Office for forms and queries |
| Official timeline | 30 days from the date of application, as stated on a Telangana district government page |
| Death certificate | Registered by the municipal registrar and collected through MeeSeva. Hospitals enter their own deaths; for a death at home, relatives bring the burial ground receipt and Form 2 |
| Property tax records | The corporation covering the address: GHMC, Cyberabad Municipal Corporation or Malkajgiri Municipal Corporation |
| Court Succession Certificate | City Civil Court for Hyderabad district; for Ranga Reddy or Medchal-Malkajgiri addresses, that district’s court (Ranga Reddy sits at L.B. Nagar). We confirm it from the address |

Settling a Hyderabad Estate From Abroad in Eight Steps
You sign once overseas, and our representative and a Hyderabad advocate handle whatever needs a person in the room.
Assessment call
You send the death certificate, a recent property tax receipt or passbook and a list of assets. We read the mandal and corporation from them, check for a Will, and ask each bank or office in writing which heirship paper it accepts, so the plan fits Hyderabad before anything is signed.
Document collection
Relatives in Hyderabad collect the death certificate through MeeSeva or the corporation, the Aadhaar and ration card copies and the property papers. You gather passport, OCI and overseas address proof. We build one heir list with names spelt as on the death certificate and flag every Telugu or Urdu spelling variant.
Signing abroad
You sign the power of attorney and heirs' affidavit before a notary where you live. The US, UK, Singapore and Australia use an apostille. UAE papers go to the Indian Embassy in Abu Dhabi or the Consulate in Dubai, and for Germany attestation is the route. We review scans first.
Originals to Hyderabad
The originals travel by courier to our representative. We confirm with the Telangana office concerned whether any document needs stamping or registration, and prepare the application for the Tahsildar along with any affidavit that heirs living in the city must sign.
Filing and notice
Our representative files at a MeeSeva centre or on the portal under your authority and keeps the acknowledgment. For a court route, a Hyderabad advocate files the petition in the district court covering the address, and public notice goes out so any objection can be raised.
Inquiry or hearing
For the Family Member Certificate, revenue staff inquire into the family while our representative answers queries and attends. In a court matter the advocate appears under your power of attorney. If a judge wants you in person, we raise it early and ask about video attendance.
Certificate issued, then put to use
The scan reaches you first and the original follows by courier. We then work in the order each office accepts: bank and insurer claims, the association or corporation record, the TGSPDCL name change, the Bhu Bharati mutation for land and the demat folios.
Money home
Sale or maturity proceeds land in your NRO account first. Remittance abroad is allowed up to USD 1 million per financial year with Forms 15CA and 15CB, renumbered 145 and 146 from 1 April 2026, once any buyer's TDS under Section 393(2) of the Income-tax Act 2025 is settled.

Book an assessmentWhat to Gather in Hyderabad and What to Sign Abroad
Names must read the same on every paper, down to the initials. Telugu and Urdu names travel through several spellings, so compare the death certificate, Aadhaar, passports and property record side by side before a notary sees anything. A mismatch caught on scans is a quick repair.
From you (abroad)
- Passport and OCI card copies for every heir abroad, with names spelt as on the death certificate or explained in an affidavit
- Power of attorney naming our Hyderabad representative, signed before a notary and then apostilled or attested as your country requires
- Heirs' affidavit listing every legal heir with relationship, age and address
- Consent or no-objection letters from any heir who plans to step aside
- Overseas address proof, such as a recent utility bill or bank statement
- PAN card copy, needed later for a sale, TDS and the NRO remittance
- Marriage certificate and any name-change record where a daughter's or spouse's surname differs between papers
From family or records in India
- Death certificate registered by the GHMC, Cyberabad or Malkajgiri corporation or the cantonment board, collected through MeeSeva: the original plus several copies
- Aadhaar, ration card or voter card of the deceased and of the heirs living in India
- Application for the Family Member Certificate, signed by the authorised representative, with the heirs' details
- Property tax receipt with the assessment number, and the registered sale deed or other title papers
- For land: pattadar passbook, Pahani and survey number details from the Bhu Bharati record
- For a flat: share or membership record, a dues statement and the association's or society's letter on what it needs
- Bank passbooks, fixed deposit receipts and demat statements listing every asset
- The Will, if any, with the names of its witnesses

Example: A Houston Physician Settles His Father’s Estate in Hyderabad
Illustrative example. Praveen, his family and the dates are made up; the offices and the order of steps are real.
The situation
Praveen is a physician in Houston, USA. His father, Krishna Murthy, died at a private hospital in Banjara Hills, Hyderabad, leaving no Will. He left a flat, a savings account and a fixed deposit at a nearby branch. The heirs are Praveen, his sister Anitha in Hyderabad and their mother Savitri, all Class I heirs under Section 8 of the Hindu Succession Act, 1956.
Step by step
- Day 1: Praveen messages us late evening, Houston time. We ask for the death certificate, tax receipt, bank details and any Will. The hospital entered the death on the municipal system, so Anitha collects the certificate at a MeeSeva centre.
- Days 2 to 4: we confirm the address is in Hyderabad district, read the mandal off the property tax record, and ask the bank branch and the GHMC circle office in writing which heirship paper each wants.
- Days 5 to 12: Praveen signs the Power of Attorney and the heirs’ affidavit before a Texas notary and gets the apostille from the Texas Secretary of State, as the US is a Hague Apostille Convention country.
- Days 13 to 16: the originals reach us, Anitha and Savitri sign the India-side affidavit, and our representative lodges the application at MeeSeva and keeps the acknowledgment.
- Days 17 to 45: the Tahsildar’s office verifies the family through its revenue staff, and our representative attends the inquiry. The certificate is typically issued within the official 30-day window, though it can run longer.
- Week 7: the Family Member Certificate arrives. In this example the branch accepts it for the savings account but asks for a court Succession Certificate for the fixed deposit.
- Weeks 8 to 10: the same certificate supports the property tax name change at the GHMC circle office. For the fixed deposit we start a Succession Certificate petition through a Hyderabad advocate, which takes months because of the public notice.
What Praveen did and did not do
He signed once before a notary, sent one courier parcel and joined two WhatsApp calls. He never flew to Hyderabad, but he could not skip the notary, the apostille or the originals.
If Praveen later sells the flat
As an NRI or OCI heir he may hold and sell the inherited flat. The buyer deducts TDS under Section 195 (Section 393(2) of the Income-tax Act, 2025 from 1 April 2026) on the full sale consideration unless he first obtains a Lower or Nil Deduction Certificate (Form 13 (now Form 128), filed on TRACES). Repatriation is capped at USD 1 million per financial year, with Forms 15CA and 15CB (Forms 145 and 146 from 1 April 2026). Read our guide to TDS on sale of inherited property by an NRI before listing.
After the certificate, the usual next steps are property transfer after death for NRIs in Hyderabad, an NRI release deed in Hyderabad when one heir gives up a share, and a Power of Attorney for overseas legal heirs in Hyderabad. Learn who we are on the About PropResolve page.

Why Overseas Families Trust Us With Telangana Estates
- One plan across three jurisdictions. A Hyderabad estate often straddles Hyderabad, Rangareddy and Medchal-Malkajgiri, and we run the mandal, corporation and court tracks from a single plan.
- Names checked before notarisation. We compare every Telugu and Urdu spelling on scans, so the originals you sign abroad are not wasted.
- The institution's answer in writing first. We ask each bank, association and office which paper it accepts, then prepare only what is needed.
