Which Document Does an NRI Heir Need in Lucknow? The Short Answer
In Lucknow the Tehsildar issues the Vaarisan (legal heir) certificate, usually applied for on the e-District UP portal and tested by a local inquiry. That paper often settles pensions, utilities and the Nagar Nigam house record, though banks and fund houses may still ask for a court succession certificate or probate. By statute probate was never compulsory here: Section 213 of the Indian Succession Act, deleted in December 2025, touched only Wills tied to Bombay, Calcutta and Madras, but institutions still commonly insist on it. An NRI can run it all through a power of attorney and documents signed abroad.
- Tehsil first: The Tehsildar of the covering tehsil issues the Vaarisan certificate, not the Nagar Nigam.
- Two record systems: Town houses sit with the Nagar Nigam, LDA or Parishad; village plots sit in the Khatauni.
- Court route: Succession certificates and probate begin before the District Judge, Lucknow.
- From abroad: Sign before a notary, complete attestation for your country, courier the originals.
Which Paper Opens Which Lucknow Door?
Lucknow estates rarely need a single paper. An old-city house, a savings account and a plot near Malihabad each answer to a different desk. Find your situation below, and have the institution confirm what it accepts before any signature is placed overseas.
| Your situation | Document you likely need | Issued by | Typical time |
|---|---|---|---|
| Parent died with no Will, and you need a pension, a utility transfer, the Nagar Nigam record or a plain statement of who the heirs are | Vaarisan certificate The Tehsildar records the heirs after a local inquiry. Guide to the NRI legal heir certificate | Tehsildar of the tehsil covering the deceased's address: Sadar, Sarojini Nagar, Bakshi Ka Talab, Malihabad or Mohanlalganj | Depends mostly on when the local inquiry closes |
| Bank savings, fixed deposits, a locker, fund units or shares, and no Will | Succession certificate A civil petition under Part X of the Indian Succession Act, granted after public notice. Our NRI succession certificate service | Court of the District Judge, Lucknow | Months, because the notice period and any objections must run |
| A plot or flat allotted by the Lucknow Development Authority or the Awas Vikas Parishad | Authority transfer The authority's property section moves its allotment record to the heirs once dues, heir papers and consents are in order. NRI property transfer | LDA or UP Awas Evam Vikas Parishad, whichever allotted the property | Turns on dues, notices and how soon every heir consents |
| A house in a city ward where the tax bill still carries the deceased's name | House mutation The Nagar Nigam changes the name on its house tax record after the heirs are accepted. It is a tax entry, not proof of title. | Lucknow Nagar Nigam, House Mutation service and zonal office | Short once the file is complete |
| Farmland or a village house at Mohanlalganj, Malihabad, Bakshi Ka Talab or Chinhat | Khatauni mutation A succession report, a proclamation and a Tehsildar's order under Sections 33 and 35 of the UP Revenue Code, 2006. How NRI mutation works | Lekhpal and Revenue Inspector first, then the Tehsildar | Quick when heirs agree; far longer if someone objects |
| A Hindu, Sikh, Jain or Buddhist parent left a Will | Probate Establishes the Will before the court. Institutions often still ask for it even though no law now requires it. | Court of the District Judge, Lucknow | Months, as the Will must be proved and notice given |
Many families land in several rows at once: a Vaarisan certificate for the pension, an LDA transfer for the flat, a court decree for the fund units, a Khatauni entry for the orchard. We order the work so each signature you give abroad is reused.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentLucknow by Address: Which Desk Handles Which Paper
On an envelope, Lucknow is a single city. For inheritance paperwork it behaves like several systems stacked together. The registrar of the death, the body that lists the building for house tax, the authority that allotted the plot and the tehsil that issues the Vaarisan certificate are frequently four separate offices. The pointers below show how common addresses tend to sort themselves. Verify each one with the office concerned before you file.
Inside the Nagar Nigam. Most urban addresses, from Hazratganj and Aminabad to Aliganj, Indira Nagar and Gomti Nagar, lie within Lucknow Municipal Corporation limits. The corporation registers deaths happening within its boundary and maintains the house tax record, and its portal has a House Mutation service for changing the owner's name once the heirs are accepted. Certifying heirs is not its job.
LDA schemes. The Lucknow Development Authority planned and allotted many residential colonies, among them parts of Gomti Nagar, Indira Nagar, Aliganj and Mahanagar. For an allotted plot or flat the authority keeps its own allotment and transfer record, separate from the Nagar Nigam's tax roll. The allotment letter or the registered deed usually shows which scheme a given lane belongs to.
Awas Vikas Parishad colonies. The Uttar Pradesh Awas Evam Vikas Parishad developed other colonies, typically including Rajajipuram, Jankipuram and the Vrindavan Yojana area, and its own property office handles transfers there. A family with a Rajajipuram house who writes to the LDA will simply be pointed elsewhere.
The cantonment. The Lucknow Cantonment Board administers the military station area around Sadar Bazaar. A house or shop there can sit on land held on defence or old grant terms, with the Board's own tax register and its own mutation process, so the name at the top of the tax bill counts for more than the postal address.
The old city. Chowk, Husainabad, Daliganj, Nakhas and Yahiyaganj hold houses that predate any housing scheme. They are often ancestral holdings divided informally among branches of a family, sometimes with long-standing tenants, and the paperwork is a blend of old registered deeds, Nagar Nigam house records and handwritten family arrangements.
Villages at the edges. Mohanlalganj, Malihabad, Bakshi Ka Talab and the Chinhat and Gosainganj belts are rural revenue land. There the Khatauni, kept through the tehsil's land record staff, is the main document, and the village is a revenue unit rather than a municipal ward. Some villages have been drawn into the corporation's limits in recent years, so a current check beats an assumption.
The tehsil follows the land. The district has five tehsils: Sadar, Sarojini Nagar, Bakshi Ka Talab, Malihabad and Mohanlalganj. Which one covers an address is a revenue-boundary question, not a postcode question, and two houses a few streets apart can belong to different tehsils. An application lodged with the wrong tehsil tends to come back instead of travelling onward, so the office is confirmed first.
Where the death happened decides the certificate. Someone who lived in a village near Malihabad and died in a Lucknow hospital will have a Nagar Nigam death record, while the farm stays in the village land records. Two different bodies on one set of papers is ordinary. Each later office just wants to be sure it is the same person, so identity details must agree throughout. For a death in a rural area, registration generally sits with the local registrar, and a late entry typically needs a magistrate's order, which adds time.
A Lucknow House, Plot or Flat After a Death: Who Updates Which Record
For most overseas families the Lucknow house or flat is the asset that matters most, and it moves through up to four hands in turn: the authority, association or society that holds the allotment or membership, the Nagar Nigam's tax record, the utilities and, if someone insists, a court. Start by finding out how the property was acquired.
An LDA or Parishad allotment. Heirs of a deceased allottee generally apply to the authority's property or estate section with the death certificate, heirship proof, the allotment papers, proof that dues are cleared, and consents or affidavits from the other heirs. Authorities differ in what they accept. One office may act on an indemnity bond, another may insist on a succession certificate from a court, and a newspaper notice may come first. Ask for the current checklist before you sign anything abroad.
The allotment that never reached a sale deed. Some Lucknow files involve an allottee who paid instalments and held an allotment letter but died before the registered deed was executed. The heirs must then ask the authority to complete the transaction in their names, which makes the heir documents central and any unpaid balance a live issue. Keep the allotment letter, receipts and demand notices in one folder from the start.
An apartment in a private project. Flats in newer projects usually pass under a registered deed, and the Uttar Pradesh Apartment (Promotion of Construction, Ownership and Maintenance) Act, 2010 provides for an association of apartment owners. Heirs prove title through heirship papers and request that the association amend its register and maintenance billing. Projects registered with UP RERA also carry a public record that helps confirm who built and who maintains the complex.
Cooperative group housing. Lucknow also has apartment blocks built by cooperative group housing societies under the Uttar Pradesh Cooperative Societies Act, 1965. There the membership and share are what the society moves to the heirs, typically on an application backed by the death certificate, the share certificate and letters of consent from the remaining heirs. As elsewhere, a nominee is generally treated as holding for all the legal heirs, not as the sole owner.
The Nagar Nigam entry comes after. When the authority, association or society has recorded the heirs, the Nagar Nigam's House Mutation service can carry the new name into the house tax record. Treat it as a records step. It does not decide title, so do not rely on it to settle a quarrel between heirs.
Utilities follow the same papers. Electricity in Lucknow is supplied through LESA, which sits under the Madhyanchal Vidyut Vitran Nigam and UPPCL, and a connection can usually be moved to an heir on application with heirship proof and clearance of any arrears. Water and piped gas connections are handled by their own providers and tend to ask for the same set. Do these early, because arrears left in a dead person's name are easily forgotten and later block a sale.
The ancestral old-city house. Where a house in Chowk or Daliganj never had a formal partition, the heirs of every branch may have to be listed, and an affidavit or family settlement may need to precede any sale. If tenants have occupied part of the building for decades, their rights usually continue after the owner's death, so we ask for rent receipts early and keep the tenancy question apart from the heirship paper. For the wider picture, see our overview of inheriting property in India.
Farm and Village Land Near Lucknow: Khatauni, Lekhpal and the Revenue Code
Many Lucknow families still own an orchard, a field or a village house recorded in a long-dead grandparent's name. Around Malihabad that often means mango land, while Mohanlalganj and Bakshi Ka Talab lean towards ordinary cropland. The revenue system, not the Nagar Nigam, governs all of it.
The records. The key papers are the Khatauni, which lists the holders and their shares, and the Khasra or Gata extract, which identifies the plot. Uttar Pradesh publishes these digitally through its Bhulekh service, and the Lucknow district website links to a Bhulekh portal for extracts. Read the current extract before anything else, because older entries often still show a previous generation as the holder.
How succession is recorded. Under Sections 33 and 35 of the Uttar Pradesh Revenue Code, 2006, a person who obtains land by succession reports it to the Revenue Inspector of the circle, and the Tehsildar issues a proclamation and makes an inquiry before the record is amended. If nobody disputes the case, the Khatauni is changed. If somebody does, the Tehsildar decides, and an appeal lies to the Sub-Divisional Officer. In practice the Lekhpal, the village-level record keeper, is usually the first official you meet.
Which heirs the Code recognises. The Code lays down its own order of succession for a bhumidhar's holding, and the relevant sections were rewritten by an amendment in 2016. The result can differ from what a family expects, so we compare the current text with the personal-law heirs before the application is drafted, and we tell you if a gap appears.
The limits of a mutation. A mutation corrects the revenue record and nothing more. Title disputes between relatives are still settled by a court. Yet banks, buyers and the tehsil lean on a clean Khatauni, so the entry is worth finishing early.
If one heir stays on the land. A brother in Lucknow may wish to keep farming while a sister overseas gives up her share. The tool is normally a registered release deed at the Sub-Registrar's office, followed by the mutation. A deed executed abroad is notarised, attested or apostilled as her country requires, and then lodged for registration: Section 26 of the Registration Act, 1908 allows presentation within four months of arrival in India, if the registering officer agrees.
Selling afterwards. Under FEMA an NRI or OCI cardholder can receive farmland by succession but cannot buy it, and a later sale can generally only be to a resident Indian citizen. Local land laws may restrict buyers further. Wait until the Khatauni carries the heirs' names before marketing the land. Our blog on exchange-control rules for inherited property sales covers the remittance side, and our NRI property mutation page covers the record side.
Going to Court in Lucknow: The District Judge, the High Court Bench and What Delays Petitions
If an institution will not budge without a court order, the application goes to the District Judge's court in Lucknow, which hears succession certificate petitions under Part X of the Indian Succession Act, 1925, along with probate and letters of administration. The Allahabad High Court also sits at Lucknow through a permanent Bench, and many families presume it is the first stop. Usually it is not: the Bench handles writs and appeals from the districts allotted to it, whereas a succession certificate petition starts below, in the district court.
The journey of a petition. Your advocate lodges the petition together with the heirs' affidavits, the death certificate and a schedule of assets. The judge orders a notice, so any objector can step forward, and may require a bond before a certificate is issued. When no one objects, the court proceeds to the petitioner's evidence and then its order. A probate petition adds the original Will and witness testimony. Our explainer on succession certificate versus letter of administration shows which applies.
Your part from abroad. You sign affidavits, consents and the power of attorney in your own country, with attestation or apostille as needed, while the Lucknow advocate does the filing and attendance. An overseas executor named in a Will can be asked for extra material, since a judge may want that person's own statement. If that looks likely, you hear about it early, and a video link is arranged where the court allows one.
Common stumbling blocks. Four small things account for most delays.
- Broken chains. An old entry may still name a grandfather, or a joint account may involve a spouse who has since died. Each gap needs an affidavit or a correction.
- Absent heirs. A forgotten daughter, a mother or the child of a son who died earlier is an invitation to object. Name every person entitled, cooperative or not.
- Short asset lists. A certificate applies to the debts and securities it names, so an account found later may require an extension of the certificate.
- Confused addresses. A postal line saying Lucknow may hide a village plot or a cantonment house, and the file then goes to the wrong body.
When an office goes quiet. Uttar Pradesh operates a public grievance portal, Jansunwai (IGRS), on which delays at tehsil or municipal offices can be raised, and the District Magistrate's office supervises the tehsils. We turn to these channels courteously after ordinary follow-up has failed, never first.
Hindi Names, Spelling Drift and Personal Law in Lucknow Files
Most delays in a Lucknow file come from names, not law. Records in Uttar Pradesh pass between Devanagari, Urdu-influenced spellings and English, and the same person can look like three people on three papers.
Common drift. Srivastava appears as Shrivastava or Srivastav, Mishra as Misra, Tiwari as Tewari, Agarwal as Agrawal, Saxena as Saksena, Mohammad as Mohd or Muhammad, Siddiqui as Siddiqi, Qureshi as Quraishi. A bank may keep the form used when the account opened decades ago, the Nagar Nigam another, and the passport a third.
Relationship words. Indian records usually describe people as son of, daughter of or wife of another person, and that other name has to match too. One woman can appear under her father's name on a school certificate and her husband's on a ration card. A short table listing every name variant on every paper, prepared early, heads off most queries.
The usual fix. Offices typically accept an affidavit declaring that the variant spellings belong to a single individual, backed by identity papers, and some also want a newspaper notice. Aligning names before filing is tidier, so we advise which spelling to adopt and make the passport, affidavit and application agree.
Personal law decides the heirs. The deceased's own personal law fixes who inherits. Hindus, Sikhs, Jains and Buddhists are governed by the Hindu Succession Act, 1956, whose Class I list covers the widow, sons, daughters and the mother. Muslims are governed by Islamic rules through the Muslim Personal Law (Shariat) Application Act, 1937, under which shares vary between the Shia and Sunni schools and with the surviving relatives. Christians and Parsis fall under the Indian Succession Act, 1925. Since Lucknow families come from every community, we ask early and let the heir affidavit state the law relied on.
Waqf and trust property. Some Lucknow properties, especially in the old city, are held as waqf or in a trust. They do not pass to heirs like private property, and a heirship certificate will not change that. We read the title documents before promising a route.
When the Deceased, or Some Heirs, Live Overseas
Some Lucknow files have a foreign thread running through them, and that changes the order of work.
The deceased died abroad. A death in the Gulf, the UK or the US leaves a foreign death certificate. That paper needs to be apostilled or attested according to its country of issue, and many families also ask the Indian mission to record the death. The names on it must match the Aadhaar, bank and land records in Lucknow. If the person owned a house in Lucknow, the Tehsildar's jurisdiction usually follows the property or the last Indian address, and we confirm which with the office.
Heirs in different countries. A brother in Dubai, a sister in Houston and a mother in Aliganj each sign in their own country, and each country has its own route. One signs before a UAE notary and the papers go for Indian mission attestation. Another signs before a US notary and obtains an apostille. We prepare one consistent set, brief each notary and track which originals have reached Lucknow, so the file is not held back by a single missing signature.
Check before you sign. A signed document loses its use if a detail turns out to be wrong. Sign only after the draft has been compared with the passports, the death certificate and the land or tax records. A signature that has to be redone because a name or a house number was off is the most avoidable delay in these files.
One account of progress. Brothers and sisters abroad often hear different versions from relatives in Lucknow. We send the same written update to every heir at each stage, which tends to lower suspicion and the risk of a late objection.
Why Does the Lucknow Route Start at the Tehsil, Not the Nagar Nigam?
A private heirship certificate in Lucknow comes from the revenue side of government, not the municipal side. The Tehsildar issues it; Lucknow Nagar Nigam registers the death and keeps the house tax record but does not certify heirs. The district has five tehsils: Sadar, Sarojini Nagar, Bakshi Ka Talab, Malihabad and Mohanlalganj, as the district website lists.
The tehsil, not the postal address, decides where you file. A house in Gomti Nagar, a bank branch in Hazratganj and a plot on the city’s edge can belong to one estate yet fall under different offices. We confirm in writing what each institution wants before you sign anything abroad.
NRI or OCI status does not change who inherits. Class I heirs under Section 8 of the Hindu Succession Act, 1956 include the spouse, sons, daughters and mother.

What Will You Use a Lucknow Legal Heir Certificate For?
You use it to prove to an office exactly who the surviving heirs are. These uses come up most on Lucknow files.
- Bank accounts and lockers: savings, fixed deposits and locker contents at Lucknow branches. Some banks ask for a Succession Certificate once balances are large.
- House record: the Nagar Nigam's House Mutation service changes the owner's name in the house tax record. See NRI property mutation.
- Pension, PF and insurance: family pension, EPF, gratuity and insurance payouts.
- Demat and mutual funds: transmission through the depository or registrar, which may ask for a Succession Certificate instead.
- Allotments and societies: a development authority or housing society keeps its own member record and may ask for its own papers.
- Sale: buyers and registrars want proof of heirship. See how an NRI inherited property sale works.
Who Issues the Legal Heir Certificate in Lucknow, and Where Do You File?
The Tehsildar of the tehsil where the deceased lived issues it. You file at the tehsil office or on the e-District UP portal, edistrict.up.gov.in, which Uttar Pradesh district websites list for this service.
Revenue staff such as the Lekhpal or Revenue Inspector typically verify the facts locally. Typically a few weeks for a straightforward file.
The table shows how the Lucknow offices fit together.

| Task | Office in Lucknow | How it is filed | What to expect |
|---|---|---|---|
| Death certificate | Lucknow Nagar Nigam | Our representative applies for you | First paper in every file |
| Legal heir certificate | Tehsildar of the covering tehsil | Tehsil office or e-District UP | Local inquiry, then issue |
| House record update | Lucknow Nagar Nigam, House Mutation | Nagar Nigam service, with death certificate and heirship papers | Tax record only; not title |
| Agricultural land | Tehsil, U.P. Revenue Code, 2006 | Succession report, then Tehsildar's proclamation and inquiry | Only if farmland is in the estate |
| Succession Certificate | Court of the District Judge, Lucknow | Civil court petition with public notice | Months; only if an institution insists |

Settling a Lucknow Estate From Abroad: Eight Steps
You sign once overseas, and a Lucknow advocate with our representative handles everything that needs a person in the room.
Assessment call
Tell us what was left, in which colony or village, and whether the deceased signed a Will. We reply with the Lucknow desk each item belongs to: tehsil, Nagar Nigam, LDA or Parishad office, Khatauni or district court. A Hazratganj account and a Mohanlalganj plot seldom follow one route.
Gathering papers
Two checklists go out. One covers papers within your reach overseas, the other covers papers relatives can collect in Lucknow, such as the death certificate, house tax receipt and Khatauni extract. Working in parallel keeps either side from idling.
Signing abroad
We draft the heir affidavit, consents and power of attorney, and you execute them in front of a notary in your country. The US, UK, Singapore and Australia sit inside the Apostille Convention. The UAE and Germany do not use that route, so attestation by the Indian mission applies. Your route is checked first.
Originals reach Lucknow
Scans travel first so our Lucknow representative can match each name against Aadhaar, the Khatauni and bank records. The originals follow by courier. Before you sign, we also confirm stamping and registration expectations for your papers with the local Sub-Registrar.
Filing and notice
The Vaarisan application goes in through the UP e-District portal or at the tehsil counter, and revenue staff then check the family on the ground. Where a court order is needed, a petition is lodged before the District Judge and a public notice invites any objection.
Hearing
Uncontested matters usually proceed with the advocate speaking for you under the power of attorney. Should the judge ask to see you in person, we say so well ahead and arrange a video link if the court allows one, timed for your region.
Certificate in hand
With the paper issued, we take it to the bank, the Nagar Nigam house mutation desk, the LDA or Parishad record, the Khatauni entry and the LESA electricity account, in the order each office is willing to accept.
Money home
Sale or maturity proceeds first reach your NRO account. Remittance abroad is allowed up to USD 1 million per financial year with Forms 15CA and 15CB, renumbered 145 and 146 from 1 April 2026, after any TDS owed by the buyer is dealt with.

Book an assessmentPapers for a Lucknow File: Your Side and the Family's Side
Gather everything into one folder of scans where each name is spelt the same way. Hindi-to-English spellings, initials and absent middle names trigger most queries. When two documents disagree, tell us early; the matching affidavit is better drafted before filing than demanded at a counter.
From you (abroad)
- Passport, and the residence permit or OCI card showing your country of residence
- Indian PAN, which bank claims and a later sale both require
- Heir affidavit and power of attorney executed before a notary, then apostilled or sent for Indian mission attestation, as your country requires
- Written no-objection letters from siblings or relatives living abroad
- Proof of overseas address matching the passport name and spelling
- Sample signatures consistent with those on the affidavits
- A foreign death certificate with attestation or apostille, where the death occurred abroad
From family or records in India
- Death certificate from the Nagar Nigam, the Cantonment Board or the rural registrar, whichever covers the place of death
- Aadhaar, PAN and address documents for the deceased and the heirs in India, cross-checked against bank and land entries
- Family register extract, ration card, school leaving certificates, birth and marriage records linking each heir
- Current house tax receipt showing the house ID or assessment number
- LDA or Parishad allotment letter, deed and dues clearance, or the society's share or membership certificate
- Khatauni and Khasra extract from Bhulekh for village land, plus any earlier mutation order
- Passbooks, deposit receipts, demat and fund statements, policies and a recent LESA electricity bill
- The Will with its witnesses' details, or a note saying there is none

Illustrative Example: A Dubai Banker Settles His Father's Estate in Gomti Nagar
This is an illustrative example. The family, dates and timings are fictional; the offices, documents and steps are real.
The situation
Aman is a banker in Dubai, UAE. His father, Rakesh, died at the family house in Gomti Nagar, Lucknow, without a Will, leaving the house, a savings account and fixed deposit at a Hazratganj branch, and mutual fund units. The heirs are Aman, his sister Pooja in Lucknow and their mother Sunita, all Class I heirs under Section 8 of the Hindu Succession Act, 1956.
Step by step
- Day 1: Aman messages us on WhatsApp. We ask for the house address, tax receipt, bank details, the heirs’ names and what each institution has asked for.
- Days 2 to 5: we write to the bank, the fund registrar and the Nagar Nigam. The branch wants a Tehsildar’s certificate; the registrar wants a Succession Certificate. Our representative applies for the death certificate.
- Days 6 to 14: we confirm with the Indian mission in the UAE how his documents must be authenticated. Aman signs the Power of Attorney and heir affidavit before a notary in Dubai, completes the attestation step and couriers the originals once we have checked the scans.
- Days 15 to 18: Pooja signs a local affidavit. Our representative confirms the covering tehsil, Sadar in this example, and files on e-District UP.
- Weeks 4 to 6: revenue staff inspect the address; our representative attends and the Tehsildar issues the certificate.
- Weeks 7 to 8: the bank releases the savings and deposit, and the papers support a House Mutation request at the Nagar Nigam.
- Month 3 onward: for the fund units we draft a Succession Certificate petition for the District Judge, Lucknow. Public notice runs; this takes months.
What Aman did and did not do
He signed once in Dubai, sent one courier parcel and joined a few video calls. He never flew to Lucknow, but he could not skip the notary, the attestation or the originals, and neither can you.
If Aman later sells the house
FEMA lets an NRI or OCI heir inherit and hold immovable property, farmland included, though buying farmland is barred. On a sale the buyer must deduct TDS under Section 195 (Section 393(2) of the Income-tax Act, 2025 from 1 April 2026) on the full sale consideration unless a Lower or Nil Deduction Certificate (Form 13 (now Form 128), on TRACES) is issued. Proceeds can be sent abroad up to USD 1 million per financial year, with Forms 15CA and 15CB (Forms 145 and 146 from 1 April 2026). See our guide to TDS on sale of inherited property by an NRI.

Which Does a Lucknow Institution Want: Legal Heir Certificate or Succession Certificate?
A legal heir certificate names the heirs; a Succession Certificate is a court order letting heirs collect the deceased's debts and securities. Some institutions insist on the court order, instead of or alongside the Tehsildar's certificate, and they decide. Petitions start in the District Judge's court in Lucknow, not the Allahabad High Court's Lucknow Bench.
| Feature | Legal heir certificate | Succession Certificate |
|---|---|---|
| Nature | Administrative record of heirs | Court order, Part X, Indian Succession Act, 1925 |
| Issued by | Tehsildar of the covering tehsil | Court of the District Judge, Lucknow |
| Used for | House record, pension, many bank and insurance claims | Bank deposits, shares, mutual funds |
| Time | Typically weeks | Months |
| Who decides which you need | The institution asking | The institution asking |

What a Lucknow Family Gets From Working With Us
- People at the counters: Our Lucknow representative and advocates deal with the tehsil, Nagar Nigam, LDA and Parishad offices and the District Judge's court, so each application lands where it will actually be processed.
- One map for all assets: Before drafting, we work out which paper each Lucknow asset needs. A single death should not produce a string of repeated applications.
- A single round of signing: Affidavits, consents and the power of attorney are written to cover the tehsil, the authorities and the court together, so your notary appointment happens once.
