Which Document Does an NRI Heir Need in Surat? The Short Answer

Short answer

Surat families usually start with the Varsai (heirship) certificate from the Mamlatdar's office, backed by a pedhinamu, which serves pensions, utilities and revenue records. Some banks, depositories and registrars ask for a court succession certificate or probate instead. Probate was never compulsory by statute for a Will made and proved in Surat, because Section 213 of the Indian Succession Act, removed in December 2025, reached only Wills tied to the presidency towns of Bombay, Calcutta and Madras. Institutions may still insist on it. An NRI can run the whole process through a power of attorney and documents signed abroad.

  • Local bodies: Surat Municipal Corporation, SUDA villages, GIDC estates and gram panchayats, depending on the address.
  • Revenue side: Mamlatdar under the Collector, Talati-cum-Mantri, Digital Gujarat and AnyROR records.
  • Courts: Civil court at Surat for succession certificate or probate; Gujarat High Court at Ahmedabad above it.
  • Signing abroad: Notary first, then apostille or Embassy attestation, then the originals travel to Surat.

Matching Surat Assets to the Proof They Will Accept

Surat estates tend to mix a flat, a trading business and a little family land, and no single paper opens all three. Read down the left column, find what your parent left, and use the middle column as a starting hypothesis that the institution then confirms in writing before anything is signed overseas.

These pairings are usual practice, not a rule of law. A Surat branch, a registrar or a cooperative society can ask for something different on the same asset, so we ask each of them to state its requirement in writing before the family signs or pays for anything.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

Which Surat Office Covers Which Address: A Working Map

On a courier label Surat is one address. For succession paperwork it is a stack of layers, and the office that registers the death is often not the office that records the heirs or taxes the building. A short map helps before any form is filled.

Inside Surat Municipal Corporation limits. Adajan, Pal, Vesu, Piplod, Athwa, City Light, Ghod Dod Road, Varachha, Katargam, Limbayat, Udhna, Pandesara, Rander and the old city around Chowk and Gopipura all sit in the corporation area. The death certificate, the property tax account and the name entry for a house or flat come from SMC, and the zone office that handles your address depends on where the deceased lived. Confirm the zone before anyone travels to a counter.

The ring of villages around the city. The Surat Urban Development Authority, SUDA, prepares development plans and town planning schemes for the corporation and a belt of villages around it. SUDA is a planning body, not a registrar of deaths or heirs. In places such as Kamrej, Olpad, Palsana and Sachin, a death is usually recorded through the gram panchayat or the local nagarpalika, and the land sits in the village revenue system.

Industrial estates. Plots in GIDC estates are held on GIDC's own allotment terms, so a unit in an estate may need a separate heir intimation to the estate office on top of the revenue paper. Ask for the allotment letter early.

Revenue offices. More than one Mamlatdar office serves the city and the surrounding talukas, and the right one follows the residence of the deceased or the location of the land. We settle this with the Collectorate before filing, not after a rejection.

Utilities. Electricity in Surat is supplied by Dakshin Gujarat Vij Company in most of the district and by Torrent Power in a part of the city, so the latest bill tells you which utility holds the connection. Piped gas, water and telephone accounts each have their own name-change form.

None of these offices passes files to another. The heirs, or their representative, carry the proof from desk to desk, which is why one authorised person in Surat saves so much time.

A Surat Flat: Society Membership, Association Records and the Town Planning Plot

For most families the flat is the main prize, and it is governed by the building's own structure before any government record. Surat has three common set-ups, and each wants a slightly different file.

Cooperative housing society. Many flats in older and mid-age blocks are held through a society registered under the Gujarat Co-operative Societies Act, 1961. The member holds shares and an allotment, and on death the society's managing committee records the heirs as members. Societies typically want the death certificate, the heirship paper, written consent or relinquishment from the other heirs and the original share certificate. A nomination in the society records is a convenient start, but the nominee holds for all legal heirs, so the society still wants the heirs' papers.

Apartment owners' association. Many newer blocks are run by an association of flat owners under the Gujarat Ownership Flats Act, 1973, with the builder's deed of declaration setting out each flat. Here the title sits in the registered sale deed, and the association's role is to update its maintenance and voting register. The name entry in the SMC tax record and the society or association ledger should be done together so that the three documents agree.

Tenements, row houses and old-city homes. Houses in Nanpura, Mahidharpura, Gopipura and similar areas often sit on city survey numbers with a property card, and some on land under an older tenure. Here the property card entry is the main record, and the tax name follows it.

The town planning plot. Surat's growth ran through town planning schemes, so a plot is frequently identified by a scheme number and a Final Plot number rather than by a village survey number. A sale deed, property card or tax bill that shows the wrong scheme or final plot is a real cause of delay, and we compare all three before filing.

If the flat was bought under construction, also ask for the allotment letter and the builder's no-dues paper. A deceased buyer's heirs step into the allotment, but the builder will want the same heirship proof as the society.

Textile, Diamond and Trading Estates: What the Certificate Does Not Settle

Few cities mix property and business as tightly as Surat. A Varsai certificate names the heirs. It does not decide whether those heirs inherit a place in a firm, and that is where families lose the most time.

Partnerships. Under the Indian Partnership Act, 1932, a firm is dissolved by a partner's death unless the deed says otherwise, and many Surat trading and processing firms have a clause allowing the heirs to join or the survivors to continue. Read the deed first. The heirs may be entitled to the deceased partner's share in the accounts instead of a seat in the firm.

Proprietorships. A sole proprietorship has no separate legal identity, so the stock, machines and bank balances pass to the heirs as personal estate. GST registration, trade licences and current accounts then need to be closed or re-registered in the right names, and the bank will ask for the Varsai certificate and often an indemnity from all heirs.

Hindu undivided family businesses. Many Marwari, Jain and Gujarati business families trade as an HUF with a karta. A death inside an HUF is not always a succession, because the coparcenary property may pass by survivorship and, since the 2005 amendment, daughters share as coparceners. A wrong assumption here changes who signs.

Company and LLP interests. Shares in a private company move by transmission under its articles, and an LLP interest by the agreement. Both usually ask for heirship proof and the board or partners' consent.

Market units and trade premises. Shops and offices in textile markets, diamond offices in Varachha or the Surat Diamond Bourse, and godowns are often controlled through an association or the original allotment. Transfer on death usually needs the association's own approval.

Treat stock, loose goods and receivables separately: they are not covered by any certificate, and an inventory with a valuer's note protects every heir in later talks.

Village Land Around Surat: Vaarsai Entries, Form 6, the 7/12 and Land Tenure

Many Surat families still hold a field in Bardoli, Mandvi, Kamrej or Olpad that never moved out of a grandparent's name. That land sits in the village revenue system, and a different set of papers governs it.

Gujarat keeps land rights in village forms. Village form 6, the hakk patrak, is the register of entries that records every change of right. Form 7/12 shows the owner and the crop, and form 8-A groups a holder's land under one account. When an owner dies, the heirs report the succession to the Talati-cum-Mantri, who raises a vaarsai entry in form 6. Interested persons receive a notice and a window to object, and the revenue officer then certifies the entry. Once certified, it shows on the AnyROR portal and in the 7/12.

Three Surat-specific points deserve attention.

  • Many names on one survey number. After a few generations a single survey number can carry a dozen co-owners. The entry only works when each branch of the family is named correctly, so the pedhinamu has to be exact.
  • Tenure. South Gujarat land is often marked as old tenure or restricted new tenure. Inheritance is recorded in either case, but a later sale of restricted-tenure land can need the Collector's permission. Check the tenure column on the 7/12 before planning a sale.
  • Who may hold and sell farmland. The Bombay Tenancy and Agricultural Lands Act, as applied in Gujarat, restricts transfers of farmland to non-agriculturists, and the Supreme Court has treated a Will leaving farmland to a non-agriculturist as caught by that restriction. Intestate succession follows the personal law. Have an advocate read the Will and the land record before relying on either.

Under FEMA an NRI or OCI can inherit agricultural land but cannot buy it, and a later sale generally goes to a resident Indian citizen. An NRI heir's name on the 7/12 is therefore not a problem in itself, but any sale plan must be tested against both the Gujarat rule and FEMA.

The Court Side: The Surat Civil Court, Probate and the Gujarat High Court

When an institution wants a court order, the petition normally goes to the civil court at Surat that has jurisdiction, usually the court of the Principal District Judge. That court deals with a succession certificate for debts and securities under Part X of the Indian Succession Act, 1925, and with probate or letters of administration where there is a Will or the estate needs a court-appointed administrator. Which exact court takes the petition depends on the value and the location of the assets, so we confirm that locally.

The Gujarat High Court sits at Ahmedabad, not in Surat. It is the appeal and writ forum, and a Surat family rarely sees it unless a decision is challenged or a revenue officer's order is contested. Nobody needs to go to Ahmedabad to begin a succession matter.

A few practical points shape how a Surat petition runs.

  • Public notice. The court invites objections through a notice, which is the main reason the court route takes months and not weeks.
  • Language. Subordinate court work in Gujarat is commonly done in Gujarati, so a local advocate is useful, and English papers signed abroad may need a translation.
  • Heirs overseas. An overseas heir normally files a notarised affidavit and consent. Personal attendance becomes an issue only if someone contests, and even then we ask the court what it will accept.
  • Security. A court may ask for a bond or surety on a larger succession certificate. We raise this early so that the overseas heir is not surprised.

Before filing, we also check whether the asset really needs the court. A Surat bank or registrar that will release funds on a Varsai certificate with an indemnity saves the family a few months, and we get that answer in writing first.

Names, Scripts and Communities: What Slows Surat Files

Surat records are written in Gujarati and English, and the two do not always agree. A short list of slips explains most of the queries we see.

  • The Gujarati naming pattern. A name usually runs as first name, father's name, surname. After marriage a woman typically takes her husband's first name as her middle name, so one person can appear under two sets of names in school, bank and tax records.
  • Transliteration. Shah and Sha, Mehta and Metha, Patel and Patil, Desai and Dessai: the same person gets spelt differently across a 7/12 extract, a passport and an SMC certificate. A one-and-the-same-person affidavit usually fixes it.
  • Honorific endings. Names ending in bhai or ben are sometimes entered with the ending and sometimes without it, which creates mismatches between old and new documents.
  • Kutchi and Marwari surnames. Some families use a community name in one record and a clan name in another. Collect an old document that shows both.

The deceased's personal law decides who the heirs are and in what shares.

  • Hindus, including Jains, Sikhs and Buddhists, follow the Hindu Succession Act, 1956.
  • Muslims, including the large Bohra and Sunni communities of Surat, follow their personal law, which gives different shares and often a different list of heirs.
  • Parsis and Christians are governed by the Indian Succession Act, 1925.

Tell us the community early. The pedhinamu, the affidavits and the entry in the revenue records are drafted on the basis of it, and a wrong assumption means redoing the whole pack after it has been signed abroad.

Surat Adds a City Layer: SMC First, Then the Mamlatdar

Surat’s extra step is local. The death is registered with Surat Municipal Corporation through its zone offices and civic centres, and only then does the Varsai file go to the revenue side under the Collector. Those are two offices with separate processes, and the heir has to carry documents from one to the other.

Most Surat families have someone in the city and others abroad, so the practical job is to put one authorised person in Surat with complete papers. We act as that person under an NRI Power of Attorney signed before a notary where you live.

What Surat Heirs Typically Need the Certificate For

  • Shares and demat accounts: Registrars and depository participants transmit shares to heirs, and many ask for a heirship document. For larger holdings some prefer a succession certificate, so we collect each one’s written requirement first.
  • A flat in Surat: The certificate supports the name transfer application in SMC property records and the society’s own transfer. It sits alongside the NRI property transfer steps and does not replace them.
  • Bank accounts, deposits and lockers: Banks differ on what they accept. A branch that takes the Varsai certificate for one account may ask for more on another.
  • Apartment association or builder records: Associations typically want the heirship document and no-objection letters from co-heirs before they record a new owner.
  • Pension, PF and insurance: Family pension, provident fund and insurance claims without a nominee usually need proof of the heirs.
  • Selling or dividing the estate: Buyers in Surat and their lawyers ask for the full list of heirs, and co-heirs use the same list to agree shares.

How the Varsai Certificate Works in Surat

In Surat the Varsai certificate is issued by the revenue administration under the Collector and District Magistrate, whose office is at Jilla Seva Sadan, Athwalines, with a Jan Seva Kendra for citizen services (see the Surat Collectorate page). Applications go through the Digital Gujarat portal or the Mamlatdar’s counter. That is how an NRI legal heir certificate in Surat starts.

Surat City taluka is subdivided into city areas, which public references list as Udhna, Katargam, Puna and Majura. Which Mamlatdar office covers Adajan or any other address is something we confirm at the Collectorate before filing, so the file goes to the right office the first time.

Surat Municipal Corporation publishes its death registration rules: registration within 21 days of the death is the simple route, a delayed registration is possible afterwards, and beyond 30 days it needs an affidavit before the Executive Magistrate, as set out on the SMC birth and death registration page. If the family has missed the window, we fix that before the Varsai file is lodged.

Settling a Surat Estate From Abroad: Eight Steps

You sign once overseas, and our Surat representative handles each counter that needs a person in the room.

1

Assessment call

We ask what your parent left, which Surat body or village each asset sits under and whether a Will exists. By the end of the call you know which items need the Mamlatdar, which need a court and which may need nothing more than an indemnity.

2

Document collection

Family in Surat gathers the SMC or panchayat death certificate, the pedhinamu inputs, share certificates, the society record and the property card. You send passport, OCI and identity pages. We compare every spelling in Gujarati and English.

3

Signing abroad

We send the power of attorney, affidavits and consents as drafts, then as final versions. You sign before a notary where you live, with a witness if the form needs one, and we mark exactly which pages need initials or a stamp.

4

Originals to Surat

Papers get an apostille in the UK, US, Singapore or Australia, or an Embassy or Consulate attestation in places such as the UAE and Germany. The originals then travel to Surat by courier, and we check them page by page on arrival.

5

Filing and notice

Our representative files through Digital Gujarat or at the Mamlatdar's counter, lodges the hard copies and, for village land, raises the vaarsai entry with the Talati. We track every notice and answer each query as it arrives.

6

Hearing and verification

Where a revenue officer or the civil court wants a statement, an authorised person attends with the witnesses. Overseas heirs usually appear through their affidavits and the power of attorney, not in person, unless an objection changes that.

7

Certificate, mutation and use

Once the certificate or entry is issued, we send scans and courier the original. Then we take each asset in turn: the society, the SMC record, the utility, the registrar and the bank, each with its own covering letter.

8

Money and property home

Sale proceeds or bank balances move through the heir's NRO account under FEMA, with the tax forms in place. We plan this early, because the buyer's deduction, the bank's checks and the heirs' shares all need to match.

A Surat Document Checklist: What You Hold and What Family Can Fetch

Keep one folder of scans in which every name matches. Gujarati and English spellings, a missing middle name or a married name are the usual triggers for queries. If two papers differ, tell us at once so that the right affidavit is drafted before signing.

From you (abroad)

  • Passport, with visa, residence card or OCI card, and a recent address proof
  • Notarised power of attorney naming our Surat representative
  • Notarised affidavit of heirship and a consent or relinquishment where the family agrees
  • Any old Indian document showing your father's name and your married name, if it differs
  • A foreign tax or residence paper if the bank asks for FATCA or tax residence details
  • Apostille certificate, or Embassy or Consulate attestation, on each signed paper

From family or records in India

  • Death certificate from SMC or the gram panchayat, with the registration number
  • Pedhinamu details from the Talati-cum-Mantri, with every heir and relationship listed
  • Latest SMC tax bill, property card or 7/12 extract, and the sale deed or allotment letter
  • Share certificate and the society's or association's last maintenance receipt
  • Electricity, gas and water bills, with the consumer numbers
  • Partnership deed, GST and bank details if the deceased ran a business
  • Two witnesses who knew the family, with their identity proof

Illustrative Example: An NRI Legal Heir Certificate in Surat for an Adajan Flat and Shares

Illustrative example (a fictional case, not a real client). Jigna is an accountant in London, UK. Her father died in his flat in Adajan, Surat, leaving that flat, a savings account and shares held in a demat account. Her mother died earlier. Jigna and her brother, who lives in Surat, are the surviving children and therefore Class I heirs.

Day by day

  • Day 0 to 2: The brother registers the death at a Surat Municipal Corporation zone office, well inside the 21-day registration window, and later downloads the certificate through the Virtual Civic Center.
  • Day 5: Jigna contacts us. We map the estate and write to her depository participant to ask what it needs to transmit the shares. The reply, in this illustration, is that smaller holdings can move on a heirship document with an indemnity, while the largest holding may need a succession certificate.
  • Day 8: We send the draft Power of Attorney, Jigna’s affidavit, her brother’s affidavit and the pedhinamu statement.
  • Day 14: Jigna signs before a notary in London and sends the papers for an apostille. Her brother signs in Surat.
  • Day 24: The apostilled originals reach Surat by courier.
  • Day 27: Our representative first confirms at the Collectorate which Mamlatdar area covers the Adajan address, then files on Digital Gujarat and lodges the hard copies.
  • Day 33 to 60: Two neighbours give witness statements. The office issues one hearing notice, which the brother attends as co-applicant with our representative. Jigna does not need to travel because her signed papers and Power of Attorney are on file.
  • Day 74: The certificate is issued, 47 days after filing, inside the 30 to 60 days that state guides report. We scan it to Jigna and courier the original.
  • From Day 75: The small holdings move on the Varsai certificate. For the large holding, Jigna instructs us to prepare a court petition, a separate matter that takes months. The flat stays in the family, and we file the SMC name transfer application.

What the example shows

One certificate rarely settles everything. The Varsai certificate cleared the flat records and the small holdings, while the court route stayed open for the one institution that asked for it. Real cases vary. If Jigna decides to sell the flat later, TDS under Section 195 (Section 393(2) of the Income-tax Act, 2025 from 1 April 2026) applies to the full sale consideration unless a Lower/Nil Deduction Certificate (Form 13 (now Form 128), TRACES) is obtained, and repatriating the proceeds is capped at USD 1 million per financial year under the Reserve Bank of India FEMA framework (Forms 15CA/15CB). Our post on FEMA rules for NRIs selling inherited property explains this.

  • Surat desk knowledge: Advocates and representatives who deal with SMC zone offices, the Mamlatdar counters, village Talatis and the civil court, so each paper reaches the desk that will accept it.

Frequently Asked Questions

Can I get my father's legal heir certificate from Surat without travelling?

+
In most uncontested matters, yes. You sign a power of attorney and an affidavit before a notary where you live, and our representative in Surat files, attends the Mamlatdar's verification and collects the certificate. Digital Gujarat registration often runs on an Indian mobile number and local identity, which is another reason a family member or representative in Surat usually does the filing. Personal attendance arises mainly when a relative objects or an office insists on seeing an heir. We ask the office early what it will accept, so that you are not surprised later.

Will a Surat bank accept the Varsai certificate for my mother's account?

+
Often, but not always. Public sector and private banks in Surat usually accept a Varsai certificate with an indemnity for smaller balances, while some branches, and many urban cooperative banks, prefer a court succession certificate for larger sums or for fixed deposits. The branch manager and the bank's legal desk decide, and their answer can differ even inside one bank. We ask for the requirement in writing before filing, because that letter shapes whether the revenue route or the court route is the better start.

Is probate still needed for a Will in Surat?

+
Not by statute. Section 213 of the Indian Succession Act, which made probate compulsory for some Wills, applied only to Wills tied to the presidency towns of Bombay, Calcutta and Madras, so it never governed a Will made and proved in Surat, and the Repealing and Amending Act 2025 removed it in December 2025. In practice, a society, bank or registrar may still ask for a court-proved Will because it is the cleanest proof. If a Will was signed in Mumbai, tell us, as the history of that Will differs.

My mother nominated me for her flat in a Surat society. Is that enough?

+
Usually not on its own. A nominee in a society or bank record is recognised to receive the asset, but holds it for all legal heirs and does not become the sole owner. Most Surat societies therefore still ask for the death certificate, an heirship paper and consent or relinquishment from the other heirs before they record a new member. The nomination can speed the first step, but if siblings exist, plan on getting their written agreement as well.

How do I sign the papers abroad so that Surat offices accept them?

+
You sign before a notary or an authority where you live, and then the paper is legalised. In the US, UK, Singapore and Australia that is an apostille. The UAE is not a party to the Apostille Convention, so papers from the UAE go to the Indian Embassy in Abu Dhabi or the Consulate in Dubai for attestation. Germany objected to India's accession, so attestation is the route there too. Because the exact stamping and format rules differ, we confirm them before you sign.

What can a power of attorney do for me in Surat, and what can it not?

+
It lets our representative file the application, sign routine forms, collect notices and certificates, and deal with the Mamlatdar, SMC, the society and banks on your behalf. It does not make a decision you have not made, and it cannot replace a personal affidavit where an office specifically wants the heir's own statement. A document executed outside India can be presented for registration within four months of reaching India, at the registering officer's discretion, under Section 26 of the Registration Act. We draft the scope narrowly so that each power is clear.

My father owned farmland near Kamrej. Can I, as an NRI, inherit it?

+
Under FEMA an NRI or OCI can inherit agricultural land, though cannot buy it. In Gujarat the revenue entry for the land is raised through a vaarsai entry in village form 6 and certified by the revenue officer. The tenure shown on the 7/12 matters later: restricted-tenure land can need the Collector's permission to sell, and Gujarat farmland rules limit who may buy. A later sale generally goes to a resident Indian citizen. Have the Will, if any, checked before relying on it for farmland.

How do I bring the money home after the estate is settled?

+
Balances and sale proceeds are credited to an NRO account in your name. From there, an NRI can remit up to USD 1 million per financial year, supported by the tax forms that were Forms 15CA and 15CB and were renumbered as Forms 145 and 146 from 1 April 2026, together with a chartered accountant's certificate. Banks also ask for proof that the funds came from inheritance, so the Varsai certificate and the deceased's tax papers matter. Our post on FEMA rules for NRIs explains the details.

Is there inheritance tax in Gujarat or anywhere in India?

+
No. India has no inheritance or estate tax, and Gujarat adds none. Receiving property by inheritance is not taxed as income in the hands of the heir. Tax arises later: if you sell the flat or land, capital gains tax applies, and the deceased's purchase value and holding period carry over to the heir. Income from the property after you inherit it is taxable as usual. An NRI seller also faces tax deducted at source by the buyer, which we cover below.

One of my siblings in Surat will not cooperate. What can I do?

+
First, find out what the sibling's objection is, because most turn out to be about money, a business or an old promise, not about the heirship paper. The Varsai route can still proceed on the facts, and the revenue officer's notice gives the sibling a chance to say so formally. If the dispute is real, the matter may move to the civil court, and a release deed or settlement can still close it later. We keep every message factual and do not file before the family is told.

How long will a Surat legal heir certificate take?

+
It depends on the office, the completeness of the file and the witnesses. State guides suggest a window of a few weeks to a couple of months for a Varsai certificate, and a court route with public notice takes several months. Heirs abroad should add time for notarisation, apostille or attestation and the courier. The biggest delays come from mismatched names, missing death registration and an unavailable witness, so the early assessment saves more time than any fast courier.

Can I apply online for a Varsai certificate in Gujarat?

Yes, the Revenue Department lists the Varsai certificate among the services on the Digital Gujarat portal, and Jan Seva Kendras at Mamlatdar offices also take applications. You register, fill in the family and deceased details and upload the papers. The system usually expects an Indian mobile number and local identity, so an overseas heir often finds it easier for an authorised person in Surat to file. Hard copies and witness verification still follow, so the online step starts the process but does not end it.

What is the difference between a Varsai certificate and a succession certificate in Surat?

+
The Varsai certificate is a revenue record from the Mamlatdar's office stating who the heirs are, and it is accepted by pensions, utilities, societies and many banks. A succession certificate is a civil court order under the Indian Succession Act that lets the holder collect debts and securities. The court route has public notice and takes longer, and some registrars and banks insist on it for larger holdings. We ask each institution which it wants before starting either.

My father had a flat inside Surat Municipal Corporation limits and land in a village. Is that two matters?

+
In effect, yes. The flat runs through SMC's name entry, the society or association and the property card, while the land runs through the Talati's vaarsai entry and the Mamlatdar's certification. Both can rest on the same Varsai certificate and pedhinamu, so you do not repeat the heirship step, but each asset has its own counter and its own covering papers. We plan one document set that serves both and sequence the filings so that nothing is lodged twice.

I am selling the inherited Surat flat. What happens with TDS?

+
The buyer must deduct tax at source on an NRI seller's sale. From 1 April 2026 this sits under Section 393(2) of the Income-tax Act, 2025, which replaced Section 195 of the 1961 Act, and it is generally computed on the full consideration unless a lower or nil deduction certificate is obtained through TRACES on Form 128, previously Form 13. Capital gains tax is worked out after the sale. In a few Surat localities, transfers may also need the Collector's permission under the Disturbed Areas Act, so we check that at the sale stage.

Does the deceased's religion change how the Surat process works?

+
It changes who the heirs are and in what shares, though the filing counters stay the same. A Hindu, Jain, Sikh or Buddhist estate follows the Hindu Succession Act, 1956. A Muslim estate, including a Bohra or Sunni family in Surat, follows personal law with different shares. A Parsi or Christian estate is governed by the Indian Succession Act, 1925. Tell us the community at the start so the pedhinamu, affidavits and entries are drafted correctly the first time.

My father ran a diamond or textile firm in Surat. What do the heirs get?

+
That depends on the business form, not on the Varsai certificate. A partnership firm is dissolved on a partner's death unless the deed says otherwise, so the deed decides whether heirs join the firm or take the deceased partner's share. A sole proprietorship passes as personal estate, and company shares move by transmission under the articles. Stock, receivables and loans need an inventory and a lender's check. We read the deed before any filing, because it shapes who signs and what each heir should ask for.
