Which Document Does an NRI Heir Need in Bhopal? The Short Answer

Short answer

In Bhopal the usual first paper is a legal heir certificate from the Tehsildar, applied for through MP e-District, while banks and depositories often ask for a succession certificate from the district court. Probate was never compulsory by statute for a Bhopal Will, because Section 213 of the Indian Succession Act, removed in December 2025, only ever reached Wills tied to the old presidency towns, yet some institutions still ask for it. An heir abroad can run the whole sequence through a power of attorney and affidavits signed before a notary.

  • Revenue side: Huzur, Berasia and Kolar tehsils, with MP Bhulekh and namantaran for land entries.
  • Urban side: Bhopal Municipal Corporation tax records, plus the Housing Board, Development Authority or society that allotted the property.
  • Court side: district court at Bhopal; the M.P. High Court sits at Jabalpur, with benches at Indore and Gwalior, and none at Bhopal.
  • From abroad: power of attorney and affidavits signed before a notary, then apostille or embassy attestation.

Match Your Bhopal Estate to the Right Paper

A Bhopal estate rarely fits a single row. A government officer's house in a Board colony, a flat in a society and a few bighas near Berasia can each ask for a different paper. Find the situations that match your family below, then confirm the requirement with the office or institution before anything is signed abroad.

Your situationDocument you likely needIssued byTypical time
A flat in a Bhopal cooperative society or apartment complex, parent died without a WillSociety transfer, then tax name
The managing committee or owners' association records the heirs, and the Bhopal Municipal Corporation then changes the assessment. A recent building may also carry a builder's deed and RERA papers worth reading. NRI property transfer service
Society committee or owners' association, then the Corporation's ward or zone officeTurns on how soon every heir's consent and the society's resolution arrive
A plot or house in a Housing Board or Development Authority colony, no WillLegal heir certificate, then Board or Authority namantaran
The Tehsildar names the heirs, and the allotting body then enters them on its own file, often with indemnity papers and a release from any heir who steps aside. NRI legal heir certificate guide
Tehsildar for Huzur, Berasia or Kolar, then the Estate Officer or property section of the allotting bodySet mostly by field verification and by the allotting body's notice step
Farm land or a village plot in a Bhopal district villageNamantaran on the land record
The heirs report the succession, a notice is published, objections are invited and the Tehsildar orders the entry, which MP Bhulekh then displays. How NRI mutation works

A Will exists and the family wants the property moved on itProbate or letter of administration where a court order is wanted
A revenue office can act on a Will for namantaran, but a doubt about the Will goes to a civil court, and some banks and buyers still ask for probate although no statute demands it. Succession certificate or letter of administration

A sale is planned within a year or twoMutation first, then a registered sale deed and a lower TDS certificate
Buyers look for the heirs' names on the revenue and Corporation records and for every heir's signature. The NRI share needs a lower deduction application before the deed is signed. FEMA rules for selling inherited property
Sub-Registrar through Sampada 2.0 for the deed; the income tax portal TRACES for the certificatePlan the tax certificate and the mutation steps before any closing date is promised

Several rows usually apply at once. We order them so one signed set of papers serves each filing, and we ask every office or institution for its present requirement, in writing where possible, because counter practice differs between desks and shifts over time.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

Capital City Estates: When the Parent Served the Government

Bhopal is the seat of the state government, so a large number of local families have a parent who worked in a department, a board, a university or a public-sector body. That shapes a death estate in ways a purely private-sector city does not. Next to the house or flat there is usually a service file, a pension order and a set of provident fund and insurance papers, and each runs on its own rulebook.

A quarter is not an inheritance. Many serving and retired officers live in government quarters in older residential blocks near the Secretariat, in colonies such as Char Imli, Shivaji Nagar and Tulsi Nagar, where a good deal of the housing was built for government staff. A quarter is allotted to the employee. It does not pass to the heirs, and the family is normally expected to hand it back under the department's allotment rules. Ask for the allotment letter on the first day, so the quarter and the family's own house are never mixed in one file.

Pension and dues have their own proof. The treasury or pension office will want a record of the family members, often the Tehsildar's legal heir certificate or a family declaration entered in the service book. A nomination in the service record decides who the department pays for certain dues, but a nominee generally holds for all the heirs, so the heirs still have to settle how the money is shared among themselves.

One certificate, many claims. The same heirship document usually serves the pension office, the provident fund section, the insurer and the municipal record. Ask the issuing office for several certified copies at the outset, and ask each department what it will accept before you sign anything abroad. A departmental clerk may want an original signature on a form that a representative cannot sign for you, so we find that out early.

Where the family home stands. Officers' own houses in Bhopal are often in Board colonies or cooperative societies, so the next section applies. A widow or widower who draws family pension is normally first on the heirs' list, and children living abroad are heirs alongside, a fact that surprises some families who assume that the pension recipient inherits everything.

If the parent was in service in another state before settling in Bhopal, an old service file or a second pension office may exist. Mention it in the assessment call so it is not discovered later.

Board Colonies, Authority Plots and Societies: Whose File Is It?

Much of Bhopal grew through planned colonies rather than village-by-village sale. The Housing Board, which is now styled the Madhya Pradesh Housing and Infrastructure Development Board, built and allotted houses and plots in colonies that include sectors of Arera Colony. The Bhopal Development Authority, set up in 1976, plans and develops schemes of its own. Cooperative housing societies, many of them formed by employee groups, took up other blocks. Each of these bodies keeps a file on the allottee or member, and that file is separate from the Corporation's tax record and from any revenue entry.

Allotted houses and plots. The documents that matter are the allotment letter, the possession letter, the lease deed or sale deed, and the body's receipts. When the allottee dies, the allotting body normally wants an application from the heirs, proof of heirship, an indemnity or undertaking, and a release from any heir who will not take a share. Some bodies publish a notice before they act. Practice differs between the Board and the Authority, and between old and recent allotments, so the Estate Officer or the property section should be asked what it requires now.

Leasehold terms. Some older allotments were made on lease, with an option to convert the tenure into full ownership on payment of what the body requires. If the parent never completed that step, the heirs inherit the leasehold position, and a buyer will want it regularised. We read the deed for this before suggesting a sale.

Cooperative societies. A member's share and interest passes on death under the state's cooperative law and the society's own bye-laws. The committee generally records a nominee, or the heirs if there is none, and a nominee is normally treated as holding for every legal heir. A society may admit a nominee provisionally and still ask for consents or a settlement among the heirs, particularly where a loan runs or heirs disagree.

Apartment complexes. In a private building the registered deed is the title, and the owners' association handles maintenance dues and no-objection letters. A recent project may also have registered with MP RERA, whose office is in Bhopal. The association does not decide heirship, but it will want the heirs' names before it changes its billing.

A caution on outskirts plots. Some plots on the city's edge were sold on a general power of attorney or a stamp-paper agreement rather than a registered deed. Heirs of such a plot should not treat the paper as a completed transfer. An advocate should assess the chain first, because namantaran cannot fix a defect in title.

Whichever body holds the first file, we normally finish it before approaching the Corporation, because the Corporation's officer will look for the Board or society acknowledgement.

Old Bhopal, Nazul Plots and Leasehold Land: Read the Tenure First

The walled and older parts of the city, around Chowk, Itwara and Jahangirabad, carry a land history that newer colonies do not. Many plots trace back to the princely-state period, and some are held on lease from the state rather than on outright ownership. Before a family assumes that a house in these neighbourhoods follows the ordinary mutation route, the tenure has to be read.

Nazul land. Nazul land is state-owned land that has been let on lease, and Madhya Pradesh deals with it under its own nazul rules. A succession entry on nazul land is generally handled by the Nazul Officer, not by the Tehsildar under the Land Revenue Code, and the lease term, renewal status and any sub-letting all matter. A lease that expired during the parent's lifetime, or one that was never renewed, can complicate both the transfer and a later sale. We ask the Nazul section what it holds before the family signs anything.

What the records may and may not show. Old Bhopal files can include handwritten leases, older survey numbers and tax records that were never matched to a deed. A name on the tax bill is only an assessment. A registered deed or a lease is what shows rights, and a missing link in the chain is repaired by affidavit, rectification or, where there is a real gap, a civil court declaration.

Personal law matters here. Many families in these neighbourhoods follow Muslim personal law, under which shares among the widow, sons, daughters and parents are fixed by law and are different from the equal Class I shares under the Hindu Succession Act. A heir should not assume that a share follows the pattern in another family. A gift deed made in the parent's lifetime, sometimes called a hibanama, may also affect the estate, and its validity depends on how it was made and delivered.

Waqf property. A property that was dedicated as waqf is not an ordinary heritable asset. If a family house is described as waqf in an old record, the status has to be checked with the proper board before any heir treats it as an inheritance.

These cases are slower and more document-heavy than a flat in a society. They are also the cases where an early read of the title saves the most effort, which is why we do it before drafting a single affidavit.

Villages Around Bhopal: Khasra, B-1 and Namantaran in Berasia, Kolar and Huzur

Bhopal district has three revenue tehsils, Huzur, Berasia and Kolar. Plots at the edge of the city, farm land and village houses all sit on the revenue record kept by the Patwari of the village circle, and the Tehsildar who decides your file depends on where the village lies.

Where to start. The record of rights is shown on MP Bhulekh as the khasra, which lists plots, and the B-1, which lists the holder and the extent. Before any application is made, an extract is pulled to see whose name stands there, how many heirs have already been added, and whether any loan or entry is noted against the land. Older papers may name a grandparent, so the file may need more than one succession.

How namantaran runs. Under the Madhya Pradesh Land Revenue Code, 1959, a person who acquires a right in land is expected to report it, and the Tehsildar publishes a notice and invites objections before ordering the change. The mutation rules framed in 2018 also recognise a Will as a basis for an entry. Heirs normally apply on the revenue court monitoring portal or at the tehsil. If nobody objects, the entry follows after the notice stage. If someone does, the Tehsildar hears the matter, but a real dispute about the genuineness of a Will is left to a civil court.

Tehsil boundaries have shifted. Kolar was made a separate tehsil in recent years, so older papers may name Huzur for a village that now belongs to Kolar. We check which Tehsildar holds the file today, since an application lodged at the wrong office is normally returned.

Plots carved out of farm land. A colony plot at the edge of the city may still sit on the revenue record as farm land. Check whether the land use was converted and whether the colony was approved, because a plot without those papers can be hard to register or sell even when namantaran is complete.

When one heir keeps the land. A sibling in Bhopal may wish to hold the field while a brother abroad steps aside. That is usually done through a registered release deed followed by namantaran, and a state law on minimum holdings can limit how a small field is divided.

NRI rules. FEMA allows an NRI or OCI cardholder to inherit agricultural land but not to buy it, and a later sale is generally only to a resident Indian citizen, so plan a sale only after the khasra and B-1 show the heirs. For the exchange-control side, see our guide to FEMA rules for selling inherited property.

Courts, Registration and the Aadhaar Question

The court at Bhopal. Petitions for a succession certificate, probate or letters of administration are ordinarily filed in the district court at Bhopal, in the court that has jurisdiction over the deceased's residence or assets. The Madhya Pradesh High Court has its principal seat at Jabalpur, with benches at Indore and Gwalior. Bhopal has no bench, so a Bhopal family only reaches Jabalpur at a late stage, for an appeal or a writ, and not for the ordinary succession petition. Which district court or designated judge takes a particular petition is confirmed before drafting.

How a petition runs. An advocate files the petition with the heirs' affidavits, the death certificate and a list of the assets. The court directs that a notice be displayed and published so that anyone with an objection can come forward, and it may ask for a bond or security before issuing a certificate for debts and securities. With a Will, the original and evidence of the attesting witnesses are added. Our note on succession certificates and letters of administration compares the court documents.

Registration through Sampada 2.0. Madhya Pradesh moved registration to Sampada 2.0 in October 2024. It sells e-stamps, takes document details and books slots at the Sub-Registrar's office, and it ties identity checks to Aadhaar-linked mobile numbers. Some documents can be registered without a visit, but only where the record already sits with the custodian department and every party has completed Aadhaar verification. That is the point at which many overseas heirs get stuck, because an NRI often has no Aadhaar-linked mobile number.

What that means for you. A release deed, family settlement or sale deed signed by an heir abroad has to be presented for registration, and Section 26 of the Registration Act, 1908 lets a registering officer accept a document executed outside India within four months of its reaching India. How a party without Aadhaar is verified depends on the document and the Sub-Registrar, so we confirm the arrangement before a signing date is fixed.

Value for registration. A deed between heirs is assessed against the Collector's guideline value for the property, and the stamp duty depends on the type of document and the relationship of the parties.

Names and Records: Spelling, Samagra IDs and the Hindi and English Gap

Most Bhopal revenue and municipal records were written in Hindi, while passports and many bank records use Roman letters. Every conversion is a chance for a mismatch, and every mismatch is a reason for an office to return a file.

Spelling drift. Common surnames appear in several Roman forms, such as Shrivastava and Srivastava, Dubey and Dube, or Choubey and Chaubey. A Khan or Begum in an older record may appear with a prefix or a father's name that a passport leaves out. We list every spelling that appears in the title, tax and identity papers and prepare a one-and-the-same-person affidavit where needed, but aligning the names early is cleaner than explaining them later.

Father's name and husband's name. Hindi revenue entries often record the holder together with a father's or husband's name. A married daughter may therefore appear under a different relation name from the one on her birth record, so her link to the deceased is shown with a birth or school record and the marriage certificate. An unmarried daughter may be shown with a prefix in a revenue extract that her passport does not use.

Samagra ID. Madhya Pradesh issues each family and each member a Samagra ID, and some offices ask for it when they verify a family. An heir abroad usually has none, but relatives in Bhopal can often supply the deceased's family ID and their own. We ask the office whether it is required rather than assuming it is.

The death certificate. The certificate comes from the registrar of the Bhopal Municipal Corporation, and its name, date and parent details should match the property papers. A correction at the registrar before filing is much easier than one after every office has copied the error.

Gaps in the chain. A house bought from the Board by a father may still stand in a grandfather's name, a flat's share certificate may carry only one spouse, and a khasra may name a person who died two generations ago. Each gap is a link that has to be explained by affidavit, repaired by an entry, or in rare cases settled by a court.

When the Parent Who Died Is the Mother

Many Bhopal files involve a house in the mother’s name, with the father already gone. If a Hindu woman dies without a will, Section 15 of the Hindu Succession Act, 1956 gives her sons, daughters and husband the first claim, and they take equally. Special rules for property she inherited from her parents or her husband’s side apply only when she leaves no children.

A daughter abroad is therefore a full heir, not a witness. The heirship document must list her, and the revenue and municipal records must carry her name or a documented release. We read the title history before drafting anything, because a house the mother bought can follow a different line from one she inherited.

What Heirs Update After a Death in Bhopal

  • Revenue entry: a namantaran order from the Tehsildar, filed on RCMS, which MP Bhulekh then reflects as an updated khasra and B-1 extract.
  • Municipal tax name: the Bhopal Municipal Corporation assessment passes to the heirs, so the tax bill and no-dues letters reach the right person.
  • Housing Board file: a house in a Housing Board colony, which can include the Housing Board sectors of Arera Colony, may carry a Board record with its own mutation and lease steps.
  • Electricity account: the connection with the Madhya Pradesh Madhya Kshetra Vidyut Vitaran Company, the Bhopal discom, stays in the mother’s name until changed.
  • Bank, provident fund and insurance: each institution wants its own proof of heirship, and some ask for a succession certificate instead of a legal heir certificate.
  • Hold-or-sell readiness: any buyer will check mutation, tax receipts and every heir’s signature, and an NRI seller must plan for TDS and repatriation.

Who Records What in Bhopal

Bhopal district has three revenue tehsils, Huzur, Berasia and Kolar, so the Tehsildar who acts on your file depends on where the house stands. The municipal record is separate: the Bhopal Municipal Corporation covers 85 wards and keeps its own property-tax assessment.

Heirship applications go through MP e-District, which signs in with Aadhaar and an OTP, or through a Lok Seva Kendra. An heir abroad normally uses an authorised representative with an apostilled Power of Attorney, and we check the office’s current practice first.

From First Call to Updated Records: Eight Steps for Bhopal Heirs

Each step below is sequenced so one signed set of papers serves every Bhopal office that needs it.

1

Assessment call

We talk through what the parent left, where each asset sits and who the heirs are. By the end of the call you know which Bhopal offices are involved, which papers you will sign abroad and what a realistic order of work looks like.

2

Collect the family file

Relatives in Bhopal send the death certificate, title papers, tax receipts and any old khasra extract or allotment letter. We read them for gaps, such as a previous owner still on record or a name spelt two ways, and list what each office will ask for.

3

Sign abroad

We send the power of attorney, affidavits and indemnity papers in a form Bhopal offices accept. You sign before a notary, complete the apostille or embassy attestation that suits your country, and courier the signed set to our representative.

4

Originals reach Bhopal

On arrival the representative checks signatures, annexures and page order against each office's list. Where a deed is involved, the set is timed against the four-month window in Section 26 of the Registration Act, 1908.

5

Filing and notice

Applications go to MP e-District, the tehsil, the Corporation and any Board or society desk as each asset demands. Notices are displayed or published, and we track the objection period so a quiet file is never mistaken for a finished one.

6

Inquiry and hearing

A Patwari or Naib Tehsildar may verify the family, and a Tehsildar or court may call the parties. Our representative attends, files short replies to any objection, and tells you at once if a matter must go to a civil court.

7

Certificate or order issued, then put to use

We collect the certificate or namantaran order, check every name and survey number, and use it for the Corporation tax record, the Board or society file, the bank or the buyer. Any error is corrected at once, before the next office copies it.

8

Money home

If you sell, we plan the lower deduction certificate, the NRO account and the repatriation papers, with Forms 145 and 146 that replaced 15CA and 15CB, so that proceeds can move abroad within the FEMA limit once the sale is registered.

Papers for a Bhopal Transfer: What You Sign and What Bhopal Supplies

Lists differ between the Tehsildar, the Corporation, a Board or Authority and a society, so treat this as a working checklist, not a promise that every desk wants the same set. We confirm each list before you sign anything overseas.

From you (abroad)

  • Passport copy, and OCI card copy where held, for each heir living abroad
  • Power of attorney naming the Bhopal representative and each power needed, signed before a notary and legalised by apostille or embassy attestation
  • Affidavit of heirship or self-declaration, and indemnity bond, signed before the same notary
  • Consent or release letter from any heir who will not take a share
  • Proof of overseas address, such as a utility bill or bank statement
  • PAN card if held, since bank, sale and tax steps ask for it
  • Passport-size photographs and a signature specimen that match the signature on the power of attorney

From family or records in India

  • Death certificate from the Bhopal Municipal Corporation registrar, with several certified copies
  • Title papers: registered deed, Housing Board or Authority allotment, possession and lease papers, or the society share certificate
  • Latest Corporation property-tax receipt and an electricity bill from the Madhya Pradesh Madhya Kshetra Vidyut Vitaran Company
  • Khasra and B-1 extracts from MP Bhulekh where land is on the revenue record

Illustrative Example: Ritu’s Mother’s House in Arera Colony, Bhopal

Illustrative example (fictional). Ritu, a lecturer in Auckland, New Zealand, loses her mother in Arera Colony, Bhopal. The house stood in her mother’s name, her father died years earlier, and there is no will. The heirs are Ritu and her brother, who lives in Bhopal. New Zealand is a Hague Apostille country, so Ritu’s documents need an apostille rather than Embassy attestation. This is how NRI property transfer after death in Bhopal could run for her.

Week by week

  • Day 1: Ritu calls us in the Bhopal morning, which is evening in Auckland. The title papers show the house was allotted by the MP Housing Board, so a Board record sits beside the Municipal Corporation and revenue records.
  • Days 3 to 6: Ritu signs the Power of Attorney and affidavits before a New Zealand notary and has them apostilled. The set is couriered to Bhopal.
  • Days 12 to 35: Her brother signs in Bhopal. Our representative files the heirship application through MP e-District at a Lok Seva Kendra and attends the field inquiry, and the Tehsildar’s office issues the heirship document.
  • Days 40 to 80: We file namantaran on RCMS where the land sits on the revenue record. At the same time we apply to the Corporation for the tax-name change and to the Housing Board for mutation, which may involve a public notice and a lease deed.
  • Day 90: The records are updated. Ritu and her brother choose to hold the house for now; NRIs and OCI holders may inherit and hold immovable property in India under FEMA.
  • Later: if they sell, TDS under Section 195 (Section 393(2) of the Income-tax Act, 2025 from 1 April 2026) applies to the full sale consideration of her share unless she holds a lower deduction certificate (Form 13 (now Form 128), TRACES), and repatriation of her proceeds is capped at USD 1 million per financial year under FEMA, with Forms 15CA and 15CB (Forms 145 and 146 from 1 April 2026).

The timings are illustrative; offices and objections decide the real schedule.

Why Bhopal Families Use PropResolve From Abroad

  • One file across many desks. The tehsil, the Corporation, the Housing Board, the Sub-Registrar and the district court run on separate rules, and we sequence them so work for one does not undo work for another.
  • Candour about what is uncertain. Where practice at a Bhopal counter varies, we say so and ask the office first, rather than promising an outcome that depends on one clerk's reading.
  • Built for distance and time zones. Updates arrive on WhatsApp and calls fit your evening or morning, while a representative in Bhopal attends the counters and hearings so you do not need to travel.

Frequently Asked Questions

Can I move my late parent's Bhopal property into my name without travelling to India?

+
Usually yes, for an uncontested matter. You sign a power of attorney, an affidavit and any consent letters before a notary abroad, complete the apostille or embassy attestation for your country, and courier the set to Bhopal. Our representative then files with MP e-District, the Tehsildar, the Bhopal Municipal Corporation and any Housing Board or society desk, and attends inquiries for you. A personal visit becomes necessary only if an office or court insists on seeing a party, or a registered deed needs an identity step that cannot be arranged otherwise. We ask the relevant office before you sign, so you know in advance.

Will a Bhopal bank accept the Tehsildar's legal heir certificate?

+
Sometimes, but not always. Many branches release small balances on a legal heir certificate with an indemnity bond, while others, especially for larger deposits, lockers, shares and mutual fund units, ask for a succession certificate from the district court. Each bank follows its own internal policy, so the answer depends on the bank and the amount involved. We write to the branch or its claims desk first and obtain the requirement in writing, which saves you from signing papers abroad that are later rejected. Our legal heir certificate page explains where the certificate helps.

Is probate compulsory for a Will in Bhopal?

+
No. Probate was never compulsory by statute for a Bhopal Will, because Section 213 of the Indian Succession Act, which the Repealing and Amending Act 2025 removed in December 2025, only ever reached Wills tied to the old presidency towns of Bombay, Calcutta and Madras. Even so, a bank, an insurer, a Housing Board desk or a buyer's lawyer may still ask for it, particularly where the Will is unregistered or a relative objects. A revenue office can mutate on a Will, but it will not decide a genuine dispute about the Will. We find out what each institution wants before suggesting a court petition.

I am the nominee for a flat in a Bhopal society. Does that make me the owner?

+
Not by itself. A nominee in a society, bank or insurance record is generally treated as holding on behalf of all the legal heirs, so the nomination lets the institution deal with one person but does not remove the other heirs' shares. In practice a Bhopal society may admit the nominee provisionally and ask for consents or a settlement among the heirs, and some insist on a court document where heirs disagree or a housing loan is outstanding. Read the society's bye-laws and ask for its present practice, then record any agreed arrangement in a registered release deed. See also our NRI property transfer service.

How do I sign documents abroad so Bhopal offices accept them?

+
Sign before a notary or the authority recognised in your country, then add the legalisation that fits it. The USA, the UK, Singapore and Australia are Apostille Convention members, so an apostille is the route. The UAE is not a member, so papers go to the Indian Embassy in Abu Dhabi or the Consulate in Dubai for attestation. Germany objected to India's accession, so attestation, not apostille, is the route there as well. We send the draft wording first so the notary does not alter it, and we check that names and signatures match your passport.

What can a power of attorney cover for a Bhopal matter, and what can it not?

+
A well-drafted power of attorney lets your representative sign applications and affidavits, attend the Tehsildar, the Corporation, a Board desk and the court, collect certificates and, if you choose, sign a registered deed for you. It cannot cover what you did not name, and offices read general clauses narrowly, so we list each power: heirship, namantaran, society or Board transfer, court work, registration, bank claims and sale. A document signed abroad and used for registration falls under Section 26 of the Registration Act, 1908, which allows presentation within four months of reaching India at the officer's discretion. We also check the Madhya Pradesh stamp position. See NRI power of attorney.

Can an NRI inherit farm land near Bhopal?

+
Yes. FEMA allows an NRI or OCI cardholder to inherit agricultural land, and the Tehsildar's namantaran then records the heirs in the khasra and B-1 that MP Bhulekh displays. What an NRI cannot do is buy agricultural land, and a later sale generally has to be to a resident Indian citizen, which narrows the field of buyers. If the heirs prefer that one sibling holds the land, a registered release deed is the usual tool. Older papers may show a village under a different tehsil, because Kolar became a separate tehsil in recent years, so we check which Tehsildar now holds the file.

How do I bring sale proceeds from an inherited Bhopal property to my country?

+
Sale proceeds are credited to an NRO account. From there an NRI can generally repatriate up to USD 1 million per financial year, supported by Forms 15CA and 15CB, which were renumbered Forms 145 and 146 from 1 April 2026, and by documents showing that the property was inherited and the tax was dealt with. Tax is deducted at source on the sale first, so a lower deduction certificate is sought before the deed. The rules sit under FEMA and the Income-tax Act, and the bank's authorised dealer branch asks for its own set. Our blog on FEMA rules for selling inherited property covers the detail.

Is there inheritance tax on a Bhopal property I inherit?

+
India has no inheritance or estate tax, so receiving a house, flat or field from a parent does not create a tax bill for the heir at that point. Tax questions arise later. If you sell, capital gains are worked out with the original acquisition value and holding period carried over from the earlier owner, and a non-resident seller faces TDS. Rent earned in the meantime is taxable income. Stamp duty may apply to a registered release deed or partition among heirs, depending on the document and the Collector's guideline value. We flag these items in the plan, and a chartered accountant should confirm the tax position in your country of residence.

A sibling in Bhopal will not cooperate. What happens to the file?

+
An uncooperative heir does not erase your share, but he or she can slow every office that wants consents. The Tehsildar publishes a notice and hears objections, and a genuine dispute over title or a Will is sent to a civil court. We usually begin with a calm written approach and a record of what each heir is offered, since a settlement signed by all and registered is often faster than litigation. If that fails, a partition suit or a succession petition at the Bhopal district court may follow. We tell you early which way the file is heading, so you decide with the facts in hand.

How long does the process take in Bhopal?

+
There is no honest single answer. An uncontested matter with clean papers and cooperative heirs often needs a few weeks for the heirship document and a few more for the namantaran and the Corporation record, while an objection, a missing link in the title or a court petition can stretch the work to several months or longer. The biggest delays are usually paperwork, such as a name spelt two ways or a signature that reaches Bhopal late, rather than the offices themselves. After reading the file we give you a realistic sequence and update you at each stage.

Can I apply for the legal heir certificate online in Madhya Pradesh?

+
Partly. Madhya Pradesh runs revenue certificates through the MP e-District portal and through Lok Seva Kendras, and the application carries the deceased's details, the list of heirs, the death certificate and an affidavit. The Patwari or Naib Tehsildar may still verify the family on the ground before the Tehsildar signs. The online login normally relies on an Aadhaar-linked mobile number, which many overseas heirs lack, so the usual route is for a representative in Bhopal to file under your authority. Confirm the current portal steps with the office, since screens and rules change.

What is the difference between a legal heir certificate and a succession certificate in Bhopal?

+
The legal heir certificate is an administrative document from the Tehsildar's office that names the surviving heirs, and it serves the family pension, utilities, revenue entries and many small bank claims. A succession certificate is an order of the district court under the Indian Succession Act, 1925, which authorises the heirs to collect debts and securities such as deposits, shares and units. Neither proves title to land or a flat, and an institution may refuse to treat one as a substitute for the other. Our guide to succession certificates and letters of administration compares the court documents.

My parent left a Housing Board house and a village field. Are these two separate processes?

+
Yes, and they run side by side. The house sits with the Board or Authority and the Bhopal Municipal Corporation, while the field is a revenue matter for the Tehsildar and the Patwari, and no urban body will update a khasra. The same legal heir certificate usually serves both, and one power of attorney can cover both if it names each type of asset. We keep a separate checklist for each desk, because an application sent to the wrong one is normally returned, and the notice periods run independently of each other.

How is TDS handled when an NRI heir sells an inherited Bhopal property?

+
A buyer paying a non-resident seller must deduct tax at source under Section 195 of the Income-tax Act, 1961, which became Section 393(2) of the Income-tax Act 2025 from 1 April 2026, and the deduction is applied to the sale consideration for the NRI's share, not only to the gain. A lower or nil deduction certificate can be sought on Form 13, now Form 128, through TRACES before the deed is signed. The buyer needs the certificate in hand and a valid TAN. We plan this before the sale date is fixed, since the application can take several weeks.

Does my religion change how a Bhopal property passes?

+
Yes. Hindus, Sikhs, Jains and Buddhists who die without a Will are governed by the Hindu Succession Act, 1956, under which sons, daughters, the widow and the mother of the deceased share equally as Class I heirs. Muslim families follow personal law as applied by the Muslim Personal Law (Shariat) Application Act, 1937, with shares fixed differently. Christians and Parsis are generally governed by the Indian Succession Act, 1925. A valid Will can change the picture for property that a person could lawfully dispose of by Will. Bhopal has large communities of each, and we read the family's law first because it decides who must sign.

My father worked for the state government. What else should the family handle?

+
Alongside the property matter there is usually a family pension order, provident fund, gratuity and an insurance claim, each dealt with by the department's accounts section or the treasury. Offices often accept the Tehsildar's legal heir certificate, but each decides its own proof. A government quarter is allotted to the employee, so it is not inherited, and the family normally hands it back under the department's rules, which is why it should be kept apart from the family's own house. We ask the pension office early what it will accept and obtain enough certified copies of the heirship document for every claim.
