Which Document Does an NRI Heir Need in Patna? The Short Answer

Short answer

Most Patna estates run on two tracks: the Anchal for land records and the Patna Municipal Corporation for the holding. Probate was never compulsory by statute here, because Section 213 of the Indian Succession Act applied only to Wills tied to the Bombay, Calcutta and Madras presidency towns, and it was removed in December 2025. Banks and depositories may still insist on probate or a court certificate, so ask each one first. An NRI can run every step through a power of attorney and papers signed before a notary abroad, without flying in.

  • Land side: the Anchal Adhikari decides dakhil-kharij, and the jamabandi and Register-II then show the heirs' names
  • Building side: a Patna Municipal Corporation circle updates the holding, and the apartment association updates its own register
  • Heirship paper: a warishan (legal heir) certificate, usually sought through the RTPS portal or the Anchal; the institution decides what it accepts
  • Court route: the District Judge at Patna for a succession certificate or probate, and the Patna High Court for appeals

Flat, Plot or Village Land: Which Route and Which Paper Fits Your Patna Estate?

Patna families usually inherit a mix: a flat in the city, a house on an old holding, and a share of land in a village that was never recorded after earlier deaths. Find your situation below, then confirm with each office before anything is signed overseas.

Your situationDocument you likely needIssued byTypical time
Parent owned a flat in a Patna apartment complex and left no WillAssociation record, then municipal mutation
Heirship proof comes first, then the owners' association register and the holding. See NRI property transfer.
Owners' association or builder, then the Patna Municipal Corporation circle for the wardTurns on how quickly every heir's consent arrives
House or plot on a municipal holding in Kankarbagh, Boring Road or Patna City, no WillHolding mutation with heirship proof
The corporation changes the tax record. If the heirs agree that one of them keeps the house, a registered deed settles it among them.
Patna Municipal Corporation circle office; Sub-Registrar for any family settlement or release deedA few weeks once papers are complete, longer if an objection is lodged
Ancestral farm or homestead land in a village of Patna district, no WillDakhil-kharij at the Anchal
Heirship paper, jamabandi extract, rent receipt and consent of co-heirs. See NRI property mutation.
Anchal Adhikari of the anchal where the land lies, after the Karmachari and Circle Inspector reportA few weeks to several months, depending on the field inquiry and any objection
The owner left a registered WillProbate for the Will
Bihar's mutation law, as published, does not act on a Will for land until a competent court has decided its probate, so confirm the current text before filing.
District Judge's court at Patna; the Anchal and the corporation then act on the court's orderSeveral months, since notice and proof of the Will are part of the process
Bank deposits, shares or mutual funds sit alongside the propertySuccession certificate, if the institution insists
A warishan certificate is enough for some modest balances. See NRI succession certificate.
Civil court under the District Judge, PatnaSeveral months, because public notice is built in
A sale is planned soonClean record first, then the sale paperwork
Buyers and lenders look for mutation orders, tax receipts and consent of every heir. See FEMA rules for selling inherited property.
Anchal and corporation for the record; Sub-Registrar for the sale deed; the tax portal for any lower deduction certificateThe record work sets the pace, so start it before a buyer is found

Rows often overlap. One Patna family may need a warishan certificate for a pension, dakhil-kharij for the village plot, a holding mutation for the flat and a court certificate for the demat account. We plan the order so one set of signed papers serves each filing.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

Who Holds Which Record in Patna: An Address-by-Address Working Map

A Patna postal address hides several different authorities. The body that registered the death, the body that taxes the building and the revenue office that knows the land are often three separate desks, and a file lodged at the wrong one is usually returned instead of passed on. This map shows how common addresses sort out.

Inside the corporation limits. The Patna Municipal Corporation covers 75 wards, grouped into six administrative circles that are reported as Patliputra, New Capital, Azimabad, Bankipore, Kankarbagh and Patna City. Localities such as Kankarbagh, Boring Road, Patliputra Colony, Bailey Road, Rajendra Nagar, Gardanibagh, Khajekalan and Bankipore lie within its area. The ward printed on the latest holding tax receipt, not the neighbourhood name, tells you which circle office handles the mutation, so ask the family to photograph that receipt first.

Around the edge. Danapur Nizamat, Khagaul and Phulwari Sharif are run by their own nagar parishads, and the state has widened their limits, so a house that sat outside a body last year may now fall under a different one than the family expects. Danapur Cantonment has its own Cantonment Board, which manages property inside its boundary under its own rules. Smaller towns such as Barh and Maner have local bodies of their own. For any property near these lines we ask the local office which body currently holds the assessment before anything is filed.

Village land. Land outside any urban body is a revenue matter. The anchal covering the revenue village, or mauza, keeps the jamabandi, and the Circle Officer heads that office. Patna district spreads across several subdivisions, including Patna Sadar, Patna City, Danapur, Barh, Masaurhi and Paliganj, and one family often holds land in more than one anchal. Each anchal is a separate file with its own queue.

Where deeds are registered. A family settlement, release deed or sale deed is registered at the sub-registry office for the area where the property lies. The district sub-registry at Patna Sadar and the sub-registries at Patna City, Danapur and Barh, among others, each serve a defined area, so we confirm the competent office deed by deed.

The death certificate follows the place of death. A man who lived in Kankarbagh but died in a hospital in another town leaves a certificate from that registration unit, while his flat stays in the corporation's records. Overseas heirs are sometimes alarmed to see two local names on the papers. That is normal, provided the deceased's own name, father's name and age read the same everywhere.

Electricity. Patna is served by SBPDCL, the south Bihar distribution company, and a connection moves to an heir through the local electricity office on proof of heirship and cleared dues. The company and division on the latest bill confirm the right office, because north Bihar is served by a different company.

Apartments, Old Holdings and Allotted Houses: Moving a Patna Flat or House to the Heirs

Most Patna flats built in recent decades are held as apartments under the Bihar Apartment Ownership Act, 2006, which treats the flat and its share of the common areas as heritable and transferable property. There is usually no cooperative share certificate to move, unlike in some other cities. Title sits in the registered deed, so the heirs prove succession and then update the records built around it.

The association and the builder. A complex normally has an owners' association, or a builder who still keeps the register. The heirs write with the death certificate, heirship proof, a copy of the deed and the latest maintenance receipt. Associations typically want dues cleared and sometimes a consent letter from the other heirs. Some complexes never formed a working association, in which case the builder's allotment letter and the registered deed carry the weight.

The holding at the corporation. The flat's holding stays in the dead owner's name until the municipal circle orders a mutation. The corporation offers an online application for mutation and self-assessment, and the order can be downloaded afterwards. Expect the circle to ask for the registered deed, tax receipts and proof of who the heirs are, and to hear any objection. The exact list is confirmed on the portal at filing.

Nominee is not owner. A bank, an insurer or an association may hold a nominee's name. A nominee holds for all legal heirs, not as sole owner, so a brother named as nominee cannot sideline his sisters. Associations that understand this ask for a consent letter or a family settlement deed.

Older houses on a holding. Many houses in Kankarbagh, Rajendra Nagar and Patna City stand on land bought decades ago under an early deed, and the holding may still carry the first buyer's name. A missing link in that chain has to be repaired by affidavit, or by tracing the earlier heirs, before a mutation is accepted. We read the whole chain before drafting anything.

Allotted and leased housing. If a government housing agency allotted the house on lease or hire-purchase, that agency keeps its own file and usually wants its own heirship papers and clearance. The corporation's mutation does not replace the agency's record, so we ask its estate office at the start.

One heir keeps the flat. When siblings agree that one takes the flat and the rest step aside, a registered family settlement or release deed at the sub-registry does it cleanly. If an heir signs abroad, the deed travels like other overseas papers: notarised, apostilled or attested, couriered, and presented for registration within the four-month window in Section 26 of the Registration Act, 1908, at the registering officer's discretion. We confirm the stamping position for Bihar with the registry before the deed is signed instead of assuming it.

Ancestral Village Land: Joint Families, Old Khesra Entries and the Special Survey

For many Patna families the hardest asset is not the flat. It is a plot in a village that stayed in a grandfather's name through two deaths, with cousins cultivating it or letting it out. Bihar follows the Mitakshara school for Hindu joint families, and daughters have been equal coparceners since the 2005 amendment, so the first job is a family tree showing who held what and when each person died. Ancestral shares can pass differently from self-acquired property, which is why we map the facts before choosing a route.

Reading the record. The jamabandi register lists each raiyat with a khata number, and each plot has a khesra number. Area is usually written in decimals, and older papers still speak of katha and dhur. Register-II is the village-wise ledger, and the land rent receipt shows who is paying. Ask the family for the latest extract and the last receipt, then compare the names with the family tree.

How dakhil-kharij runs. The heir applies, now usually through the Bihar Bhumi portal. The Anchal Adhikari orders an inquiry, the Karmachari visits and reports, and the Circle Inspector checks that report. A notice invites objections, a hearing follows where someone objects, and an order is passed. A correction slip, the shuddhi-patra, is then issued and the entries change. An appeal from the order lies to the Deputy Collector, Land Reforms.

Rules that can block a case. As published, the Bihar Land Mutation Act, 2011 does not allow mutation while a civil suit is pending over the same land, and it asks for physical possession by the person claiming. A claim based on partition needs the consent of all sharers unless a court or a registered document says otherwise. These conditions are why a calm family agreement before filing matters more in Bihar than speed.

Several generations unrecorded. When a great-grandfather is still the recorded raiyat, each later death adds heirs. We list the heirs of every deceased holder in order, and the Anchal may ask for a warishan or declaration for each branch. It is slower than a single-step case, and a representative in Patna should be available for the field visit.

The special survey. Bihar's special land survey asks landholders, or the descendants of a deceased raiyat, to file a self-declaration with a family tree at the survey camp. Officials have simplified the family tree step, and the closing date has moved more than once, so confirm current status with the anchal. The family tree filed there, the one in the heirship paper and the one in the mutation petition should agree line for line, because mismatches create their own objections later.

Departmental drives. In 2026 the revenue department reportedly directed staff to begin heir mutations on their own, using death registers and village records. Nobody can promise that a particular village will be reached soon, so an heir abroad should not wait for it, but a letter or call from the Anchal should be answered quickly by someone on the ground.

NRI heirs and farm land. FEMA allows an NRI or OCI holder to inherit agricultural land but not to buy it, and a later sale generally goes only to a resident Indian citizen. When a sibling in Patna prefers to keep the village plot, a registered release deed followed by dakhil-kharij is the usual way to record that.

The Court Side in Patna: Succession Certificate, Probate and Appeals

Patna was never one of the presidency towns, so no statute ever made probate compulsory for a Patna Will, and Section 213 of the Indian Succession Act has now been removed in any case. In day-to-day practice, though, a bank, a depository or a buyer's lawyer may still ask for a court order, and for village land under a Will the mutation rule discussed above points the same way.

Which court. A succession certificate or probate petition is ordinarily filed before the District Judge at Patna, or the court the District Judge's jurisdiction places it with, depending on where the deceased ordinarily lived or held property. Patna also has civil courts at its subdivision headquarters, so the correct forum is confirmed before drafting. The Patna High Court sits at Patna as the High Court for Bihar and hears appeals.

How a petition moves. The advocate files a petition with heirs' affidavits, the death certificate and a list of the debts and securities claimed. The court directs public notice so that anyone with an objection can come forward, and may ask for security before it grants the certificate. Without an objection the order follows after evidence. A probate petition adds the original Will and testimony from its attesting witnesses.

What it does and does not cover. A succession certificate lets the holder collect debts and securities such as deposits, units and shares. It is not a title document for a flat or a plot, which pass by succession and are recorded through mutation. Our note on succession certificates and letters of administration explains the other court documents.

What an overseas heir contributes. Affidavits, consents and the power of attorney are signed abroad and attested, and the Patna advocate files and attends. An executor named in a Will who lives overseas may be asked for a statement of their own, and we say so early. Attendance in person is usually needed only if someone contests or the judge asks to hear a party, and video attendance is a matter for the court.

Names, Spellings and Family Trees That Slow Patna Files

Revenue records in Bihar are written in Hindi, while banks, passports and the corporation's tax roll often use English. Moving between scripts is where most Patna files pick up their first objection.

Common name patterns. Kumar, Prasad, Singh, Sinha, Jha, Mishra, Yadav, Sah, Ram and Lal appear as first names, middle names or surnames, and the same person can use different positions on different papers. Sinha and Singh are different surnames, not spelling variants. Choudhary, Chaudhary and Chowdhury, or Rajeev and Rajiv, can all appear for one person. Muslim families may see Md., Mohd. and Mohammad on separate documents.

Married daughters and widows. A woman may be Kumari before marriage and Devi afterwards. Jamabandi entries for widows often name the late husband rather than the father. To link a daughter to her parent we use a school record in her maiden name together with the marriage certificate.

Father's name and age. The Anchal, the corporation and the bank all check the father's name. A passport that shows a different spelling from the jamabandi needs a one-and-the-same-person affidavit, and it is cleaner to align names early than to patch them late.

Plot and holding numbers. A khesra number copied wrongly, or a holding number from an old tax bill, sends the file to the wrong record. We compare every number with the latest extract.

Family trees. Write the tree once, in Hindi and English, and keep it the same across the survey declaration, heirship paper, consent letters and mutation petition. Include predeceased children and their heirs, since an omitted branch is the commonest ground for objection.

Personal law. Hindu, Sikh, Jain and Buddhist families follow the Hindu Succession Act. Muslim families follow their personal law, under which a Will operates only within limits. Christian and Parsi families fall under the Indian Succession Act. The family tree and the share table differ accordingly, so we confirm the governing law before drafting.

Planning a Sale From Abroad Once the Patna Record Is Clean

A buyer or lender in Patna will normally ask for the mutation order, the latest tax or rent receipts, the registered deeds and the consent of every heir. A sale on an unmutated record is possible in law but meets resistance, which is why we fix the record first.

Authority to sell. A power of attorney drafted for succession work does not allow a sale unless it says so expressly. If a sale may follow, we widen the document at the start so that you are not asked to sign again, and we explain the extra risk of giving that power.

Tax and money. A buyer deducts tax at source on a payment to a non-resident under Section 195 of the Income-tax Act, 1961, now Section 393(2) of the Income-tax Act, 2025 from 1 April 2026, and a lower or nil deduction certificate (Form 13, now Form 128) can be sought before the sale closes. Proceeds land in an NRO account and can be remitted up to USD 1 million per financial year with Forms 15CA and 15CB (now Forms 145 and 146). See NRI property inheritance in India for the wider picture.

Village land buyers. Agricultural land held by an NRI heir can generally be sold only to a resident Indian citizen, so the pool of buyers is smaller, and our advice is to settle the family arrangement before approaching anyone.

Two Records, Two Offices, One Heir Abroad

Most delays in Patna come from treating a death as one paperwork event. It is two. The Anchal keeps the land record (jamabandi, khatian and Register-II) and decides dakhil-kharij under the Bihar Land Mutation Act, 2011. The Patna Municipal Corporation, through its six circles, keeps the property tax (holding) record for houses and flats.

An heir abroad rarely can attend either office, and each wants its own papers. We run both files in parallel so the heir signs once abroad, not twice.

What Must Change After a Death in Patna

  • Land record (Anchal): dakhil-kharij moves the jamabandi entry from the deceased to the heirs. The petition is due within 90 days.
  • Property tax record (Patna Municipal Corporation): the holding stays in the dead owner's name until mutation is ordered.
  • Heirship paper: a legal heir certificate, or the document the Anchal or the institution accepts, naming every heir.
  • Utilities and society records: electricity with SBPDCL, and the apartment owners' association or builder's register, wherever the old name is printed.
  • Bank, loan and insurance: some institutions ask for a succession certificate from the District Judge, and the institution decides.
  • Sale readiness: buyers and banks look for the mutation orders, tax receipts and a clean heir chain. FEMA, TDS and repatriation rules also apply to a seller abroad.

Who Records What in Patna

In Patna the Anchal and the municipal corporation never share a file. One decides who holds the land in the revenue register; the other decides who pays the holding tax. The table sets out each body, what it records and what it asks heirs for; each confirms its exact document list at filing. The land side runs on the Bihar Bhumi portal and the building side on the Patna Municipal Corporation site.

If the owner left a will, check one more rule. The Bihar Land Mutation Act, 2011, as published, does not allow mutation on a will until a competent court has decided its probate.Probate is no longer compulsory by statute, but institutions still commonly ask for it.

Settling a Patna Estate From Abroad: Eight Steps From First Call to Money Home

You sign once overseas, and a Patna advocate and our representative handle everything that needs someone in the room.

1

Assessment call

We ask what the deceased left, where each asset sits and whether a Will exists. Then we say which Anchal, corporation circle, sub-registry or court each item needs. A flat, a holding and village land usually mean separate tracks, so we map them first.

2

Document collection

You get one list for what you can find abroad and another for relatives in Patna. Family can pull the death certificate, jamabandi extract, rent receipt, holding tax receipt and deed, while you gather passport, PAN and overseas address proof.

3

Signing abroad

We prepare the power of attorney, heirs' affidavit and consents. You sign before a notary. The US, UK, Singapore and Australia are Hague Apostille members and use an apostille. The UAE is not, so papers go to the Indian Embassy in Abu Dhabi or the Consulate in Dubai. Germany needs attestation.

4

Originals to Patna

Scans go first so a Patna advocate can match names and signatures against Aadhaar and the jamabandi. Originals follow by courier. We track the date the set reaches India, because stamping and registration windows run from arrival, and we confirm the Bihar position.

5

Filing and notice

For land we apply for dakhil-kharij on the Bihar Bhumi portal. For the holding we apply to the corporation, and for heirship proof we use the RTPS portal or the Anchal. A court petition, if needed, goes to the District Judge and public notice follows.

6

Inquiry and hearing

The Karmachari visits the land and the Circle Inspector reviews the report, while the corporation checks its own file. If someone objects, a hearing is fixed. Your advocate appears under the power of attorney, and we flag early if a judge may want to hear from you.

7

Order issued, then put to use

Once the Anchal order and shuddhi-patra arrive, the jamabandi changes, and the corporation's order changes the holding. We then update the association register, the electricity connection, bank claims and demat folios in whatever order each institution accepts.

8

Money home

Rent or sale proceeds are credited to an NRO account first. Remittance abroad is allowed up to USD 1 million per financial year with Forms 15CA and 15CB (Forms 145 and 146 from 1 April 2026), and any buyer's tax deduction is settled before the money moves. A Chartered Accountant prepares Form 15CB.

Patna Document Checklist: What You Hold and What Family Can Fetch

Keep one folder of scans in which every name matches. Hindi and English spellings, initials and a missing middle name trigger most queries at the Anchal and the corporation. If two papers differ, tell us at the start so the right affidavit is drafted once.

From you (abroad)

  • Passport, with the visa, residence card or OCI card that shows where you live
  • Indian PAN card, needed for bank claims, tax filings and any later sale
  • Power of attorney and heirs' affidavit signed before a notary, then apostilled or attested by the Indian Embassy or Consulate as your country requires
  • Signed consent from any sibling or relative who also lives abroad
  • Overseas address proof, in the same spelling as the passport
  • Specimen signature page that matches the signatures on the affidavits

From family or records in India

  • Death certificate from the registration unit of the place of death
  • Aadhaar and PAN of the deceased and of the heirs in Patna, with names checked against the jamabandi
  • Registered deed, latest jamabandi extract and land rent receipt for village land
  • Holding tax receipts from the corporation, and for a flat the allotment letter, deed and maintenance receipt
  • A family tree signed by the heirs, in Hindi and English
  • The Will with witness details, or a short statement that none exists
  • Passbooks, demat statements and policies, plus school or marriage records that prove each relationship

NRI Property Transfer After Death in Patna: An Illustrative Example

Illustrative example. Names, places and dates are fictional. Abhishek is an engineer in Dubai. His father died in Kankarbagh, Patna, leaving a flat where his mother lives and ancestral agricultural land in a village in Patna district. His mother, his sister and he are Class I heirs under Section 8 of the Hindu Succession Act, 1956. He hands the matter to us.

Day 1 to 3: map the estate

On a video call we list the flat’s registered deed, the holding record in Kankarbagh Circle of the Patna Municipal Corporation, the khata and jamabandi of the village land, and the bank accounts. An NRI can inherit agricultural land under FEMA but cannot buy it (see NRI agricultural land inheritance).

Day 4 to 12: sign abroad

Abhishek signs a Power of Attorney and an heir affidavit before a notary in Dubai. They are apostilled or consular-attested depending on the country; we confirm the route for UAE-issued papers at the start instead of assuming it. The set is couriered to Patna and our representative collects certified copies of the death certificate. See NRI Power of Attorney for property mutation and our NRI Power of Attorney service.

Day 13 to 30: heirship document

We apply for the legal heir certificate, or the document the Anchal accepts. His mother stays available at home for the revenue staff’s visit, which also helps the later possession check, since the Bihar Land Mutation Act, 2011 lists physical possession as a condition. His sister sends a notarised no-objection.

Day 31 to 45: petitions filed

The dakhil-kharij petition for the land goes on the Bihar Bhumi portal inside the 90 days, and the municipal mutation application for the flat follows the same week. The Karmachari visits the land and reports to the Circle Inspector, and a notice period for objections runs.

Month 3 to 4: orders

The Anchal Adhikari passes the order, a correction slip is issued and the jamabandi changes to the three heirs. The corporation orders the holding into their names.

Month 5: hold or sell

The family keeps the flat and decides to sell the land later. Abhishek learns that TDS under Section 195 (Section 393(2) of the Income-tax Act, 2025 from 1 April 2026) applies on the full sale consideration unless a Lower or Nil Deduction Certificate (Form 13 (now Form 128)) is obtained, and that repatriation is capped at USD 1 million per financial year with Forms 15CA and 15CB (Forms 145 and 146 from 1 April 2026), rules set under FEMA by the Reserve Bank of India. See TDS on inherited property and selling inherited property from abroad.

Frequently Asked Questions

Do I have to travel to Patna to move my late father's property into our names?

+
Usually not, when the heirs agree. You sign a power of attorney, an affidavit and a consent before a notary where you live, and a Patna advocate files at the Anchal and the corporation, answers the field inquiry and attends any hearing. Travel becomes a question only if a relative contests, or if a judge or officer specifically asks to see you, and we flag that risk at the first call. Family in Patna mainly need to be reachable when the revenue staff visit the land.

Will a Patna bank accept a warishan certificate for my father's accounts?

+
Sometimes, mostly for modest savings balances, but practice differs by bank and even by branch. Larger deposits, lockers, shares and mutual fund units more often bring a request for a court succession certificate or probate. Ask the branch manager in writing which document the bank's legal team accepts for your balance before you spend months on one route. We make that enquiry as part of the assessment call, and we plan the sequence around the answer.

Is probate still needed for a Will in Patna?

+
Not by statute, and for Patna it never was. Section 213 of the Indian Succession Act covered only Wills tied to the Bombay, Calcutta and Madras presidency towns, and the Repealing and Amending Act, 2025 removed it from December 2025. Even so, some banks and depositories still ask for probate because it is firm proof of a Will, and Bihar's land mutation law, as published, does not act on a Will for land until a court has decided its probate. We check each institution and the current text before choosing the route.

My mother named me nominee for her Patna flat. Does that make me the owner?

+
No. A nominee holds for all the legal heirs, not as sole owner, so your siblings and the surviving spouse keep their shares under succession law. In a Patna apartment complex the association may still record your name for dues and notices, but a sale or a clean title needs the other heirs' consent or a registered family settlement deed. If a sibling objects, the nomination alone rarely settles the question, and a calm talk led by a lawyer usually helps more than the paper.

How do I sign from the US, UK, UAE or Germany so Patna offices accept my papers?

+
Sign before a notary. The US, UK, Singapore and Australia are members of the Hague Apostille Convention, so an apostille is added there. The UAE is not a member, so the signed set goes to the Indian Embassy in Abu Dhabi or the Consulate in Dubai for attestation. Germany objected to India's accession, so apostille is not the route between the two countries and attestation is used. We send the draft first and brief the notary so nothing is signed twice.

What can my Patna representative do under the power of attorney?

+
A well-drafted power names one person in Patna and lists the permitted acts: signing and filing the dakhil-kharij petition and the corporation's mutation application, swearing affidavits for you, appearing before the Anchal Adhikari, the corporation, the sub-registry and the court, and collecting orders and certificates. It does not normally allow a sale unless it says so expressly. Papers signed abroad also have registration windows, and we confirm the Bihar stamping position with the registry. See our NRI power of attorney guide.

Can I, as an NRI or OCI holder, inherit family farm land in a Patna district village?

+
Yes. FEMA allows NRIs and OCI holders to receive agricultural land by inheritance, although they cannot purchase it. The inheritance is recorded through dakhil-kharij at the Anchal, which updates the jamabandi and Register-II. A later sale generally goes only to a resident Indian citizen. Because village land often stays in an ancestor's name for generations, we first trace each earlier death and its heirs, then file for all of them in order.

How do I bring the money home once a Patna asset is sold or earns rent?

+
The credit goes into your NRO account first. From there, up to USD 1 million per financial year can be remitted abroad, supported by Form 15CA and a Chartered Accountant's Form 15CB, which are now Forms 145 and 146 from 1 April 2026. Keep the heirship papers, the deed and the tax records together, because the bank will ask for them. Larger sums or unusual cases may need Reserve Bank approval, so give your CA the full picture early.

Will India tax me just for inheriting my parent's Patna property?

+
No. India has no inheritance or estate tax, and property received on a death is not taxed in your hands when you receive it. Tax arises on a later sale, as capital gains, with the deceased's original acquisition value and holding period carried over to you. Rent from the property is taxable as it arises. Your country of residence may have its own reporting or inheritance rules for foreign assets, so take advice there too before you decide to hold or sell.

One sibling in Patna refuses to sign. Can the matter still proceed?

+
It can, but not on the quick path. The Anchal records objections and hears the parties, a partition-based claim needs every sharer's consent, and a pending civil suit stops mutation altogether. A court petition sends notice to every heir, and the judge decides on evidence. Before any of that, a lawyer explaining each person's legal share to the family often restores consent. We try that conversation first, and we tell you honestly if the dispute will need a court.

How long will the whole Patna process take?

+
There is no honest single answer, because the route sets the pace. The Karmachari's inquiry and the notice period drive dakhil-kharij, the corporation's circle office drives the holding, and a court petition takes longest because of notice and objections. Courier time, attestation abroad and the apartment association's own steps add to it. After the assessment call we give you the likely sequence for your assets, and we update you at each stage instead of promising a date.

Can I do any of this online in Bihar?

+
Partly. The Bihar Bhumi portal offers online dakhil-kharij application and status tracking, the RTPS portal is where heirship certificates are generally applied for, and the Patna Municipal Corporation has an online mutation facility. Uploading does not remove the inquiry, because the Karmachari still visits and the officer still signs. Logins often rely on an Indian mobile number and local verification, so an overseas heir normally acts through a representative. Portals and forms change, so we confirm the current version before filing.

How is a warishan certificate different from a court's succession certificate?

+
A warishan (legal heir) certificate is an administrative record that names the surviving family members, issued through the revenue system after verification. A succession certificate is an order of the civil court under the Indian Succession Act, granted after notice, and it lets you collect the deceased's debts and securities. Banks, fund houses and depositories decide which one they want, and some want both. For the court side, see our NRI succession certificate page.

My father owned a flat in Kankarbagh and land in Danapur and a village. Does one set of papers cover all three?

+
Mostly the signed papers can be shared, but the filings cannot. The flat's holding sits with a Patna Municipal Corporation circle, a Danapur property may sit with a nagar parishad or the Cantonment Board, and village land sits with an anchal. Each office keeps its own record and its own queue. We confirm the right body for each address, then use the same power of attorney and affidavits for all of them, so you sign once.

Who deducts tax when an NRI sells an inherited Patna property?

+
The buyer must deduct tax at source on a payment to a non-resident, under Section 195 of the Income-tax Act, 1961, which is now Section 393(2) of the Income-tax Act, 2025 from 1 April 2026. This generally applies to the whole sale consideration, not only to the gain. To avoid over-deduction, apply for a lower or nil deduction certificate on the TRACES portal (Form 13, now Form 128) before the sale closes. Remittance then follows the annual USD 1 million limit.

Does my family's religion change the paperwork in Patna?

+
Yes, in the family tree and the shares. Hindu, Sikh, Jain and Buddhist families follow the Hindu Succession Act, 1956, under which a son, a daughter, the widow and the mother are Class I heirs. Muslim families follow their personal law, in which shares are fixed differently and a Will operates only within limits. Christian and Parsi families fall under the Indian Succession Act. The offices are the same, but the heirs listed and the shares claimed differ, so we confirm the governing law first.

The jamabandi still shows my grandfather, who died long before my father. What now?

+
This is common in Patna district. The record was never updated after one or more deaths, so the Anchal needs to see each link. We list every deceased holder and their heirs, prepare one family tree, and file so that the entries move to the present heirs in order. Where a branch cannot be traced, an affidavit or a declaration may be needed, and the officer decides whether it is enough. A representative should be available for the field visit.
