Which Document Does an NRI Heir Need in Bengaluru? The Short Answer

Short answer

No single paper in Bengaluru satisfies every institution. A court succession certificate from the City Civil Court is what banks, fund houses and registrars usually want for deposits, units and shares, while the Tahsildar's Family Member (Vamshavruksha) certificate serves pensions, BESCOM and Khata records. Probate was never compulsory by statute for a Bengaluru Will, because Section 213 of the Indian Succession Act, removed in December 2025, only covered Wills tied to Bombay, Calcutta and Madras, yet some institutions still insist on it. An NRI can run every step through a power of attorney and documents signed before a notary abroad.

  • Court route: City Civil Court, Bengaluru, for most addresses inside the city
  • Revenue route: Family Member certificate from the Tahsildar through Nadakacheri
  • Property: Khata change with the city corporation, apartment association records or RTC mutation for farm land
  • Your part: sign once before a notary abroad while we handle every desk in Bengaluru

Succession Certificate, Family Member Certificate or Probate: What Fits Your Bengaluru Asset?

A Bengaluru estate usually mixes assets: a savings account in Malleswaram, mutual funds held through a registrar, an apartment in Whitefield and a few acres near Anekal. Each has a gatekeeper with its own preference. Read the rows below, then let the institution's written requirement settle the choice before anything is signed overseas.

Rows often combine. One Bengaluru family may need a Family Member certificate for the pension, a court certificate for the mutual funds and a Khata change for the apartment. We sequence them so that one set of signed papers serves every filing.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

Which Bengaluru Office Covers Which Address: A Working Map

Bengaluru is one postal city but several administrations. The civic body that records a death, the authority that planned the layout, the revenue office that issues a Family Member certificate and the court that hears a petition are often different desks, and they do not always follow the address on an envelope.

The city corporations. The Bruhat Bengaluru Mahanagara Palike (BBMP) was replaced from September 2025 by the Greater Bengaluru Authority, an apex body under the Greater Bengaluru Governance Act, 2024, with five city corporations beneath it: Bengaluru Central, North, South, East and West. Older papers still say BBMP, and tax and Khata records continue on the existing portals, so heirs should expect both names to appear in one file. Which corporation and ward holds a given property is best read off the latest tax receipt, not guessed from the neighbourhood.

Neighbourhood to authority, roughly. Jayanagar, Basavanagudi and Banashankari sit in the older south. Malleswaram, Rajajinagar and Yeshwanthpur belong to the north and west. Indiranagar, Koramangala, HSR Layout and Whitefield spread across the east and south-east, and Hebbal, Yelahanka and Hennur mark the northern edge. Ward boundaries were redrawn with the new corporations, so the exact corporation is confirmed from the property record.

Taluks and revenue offices. For revenue purposes Bengaluru Urban district is organised into taluks, traditionally Bengaluru North, South and East and Anekal, with further taluks such as Yelahanka and Krishnarajapura carved out over time. The Tahsildar who issues a Family Member certificate is the one for the taluk covering the deceased's address. A fringe address near Electronic City, Sarjapur Road or Hoskote can sit in a different taluk, or even a different district, from what the postal line suggests, and an application lodged with the wrong office is usually returned.

Planning and development bodies. The Bangalore Development Authority (BDA) formed many of the city's layouts and still holds records for sites it allotted. The Bengaluru Metropolitan Region Development Authority (BMRDA) plans the wider region around the city, and some peripheral layouts sit under local planning authorities or town municipal councils. A BDA site, a plot in a private approved layout and a house in a gram panchayat village therefore follow different rules when the owner's name changes.

Utilities. BESCOM supplies electricity across Bengaluru and several surrounding districts, and the Bangalore Water Supply and Sewerage Board (BWSSB) handles water and sewerage connections in the city. Each can move an account into an heir's name, normally on the Family Member certificate together with the Khata or sale deed, and each keeps its own application.

A death certificate follows the place of death. A man who lived in Indiranagar but died in a hospital in another ward leaves a certificate issued where the death occurred, while his home stays in a different corporation's tax records. That is normal. Later offices only need to be satisfied that the identity matches.

Choosing the court. Where the deceased lived inside the city, the petition normally goes to the City Civil Court. For fringe addresses, including parts of Anekal and places beyond the city limits, the competent civil court can differ, so we confirm it from the death certificate and residence proof before drafting anything.

Khata A, Khata B and e-Khata When the Heirs Take Over

The Khata is the municipal record that names the person liable for property tax on a building or site in Bengaluru. It is not title: ownership still rests on the sale deed, a registered Will or succession. Yet banks, buyers, BESCOM and BWSSB all ask for a current Khata, so an inherited property is not fully usable until the heirs' names appear on it.

A-Khata and B-Khata. An A-Khata is generally given to property in an approved layout or building that carries the required sanctions. A B-Khata has been used for property outside that approved framework, such as revenue sites and some unauthorised layouts. The Greater Bengaluru Governance Act, 2024 formalised the distinction, and the rules on regularisation keep evolving. Inheritance does not turn a B-Khata into an A-Khata. Heirs may be able to record their names, but lending against, or selling, a B-Khata property can be harder, so check what the current rules allow before planning a sale.

e-Khata. Khata records now exist as digital extracts, and the Khata number, the property identification number (PID) and the tax history can be checked through the corporation's online systems such as e-Aasthi. The name on the e-Khata must match the deceased's identity papers exactly. Spelling gaps are best spotted before an application, not after a query letter.

What a transfer usually asks for. Offices typically look for the death certificate, proof of heirship (often a Family Member certificate, sometimes a registered Will or a registered release or partition deed), the latest tax receipts, the title documents, identity proof of each applicant and affidavits or no-objection statements from other heirs. Practice differs between offices and forms change, so we confirm the current checklist first.

When there are several heirs. The Khata can be recorded in all names jointly. Alternatively the heirs agree that one of them keeps the property, and the rest sign a registered release deed at the Sub-Registrar through the Kaveri registration system. An NRI heir who signs abroad can have such a deed presented for registration within four months of the document reaching India under Section 26 of the Registration Act, 1908, at the registering officer's discretion.

Arrears come with the property. Outstanding property tax is usually cleared before a transfer is accepted, and some offices ask for current receipts. An heir inherits the arrears even if the parent never mentioned them, so an early look at the tax history avoids surprises. Our NRI property mutation page explains how the record change sits beside the title.

Apartments, Layout Sites and Joint-Development Plots: The Housing Structures Heirs Meet

Bengaluru families rarely inherit a single kind of property. The structure decides who must be satisfied and in what order, so we identify it before drafting.

Apartments. Most newer apartments are held under the Karnataka Apartment Ownership Act, 1972, through a registered deed and a declaration, with an owners' association running the building. Title reaches the heirs through succession and the proof they offer, and the association then updates its register and maintenance billing. Associations commonly ask for the death certificate, heirship proof, a copy of the deed and an undertaking about dues, and a few want a no-objection letter from other heirs. An association cannot decide who inherits, but its records follow the documents placed before it.

Cooperative layouts. Several established areas grew out of house-building cooperative societies that allotted sites and flats to members. For such property the Karnataka Co-operative Societies Act, 1959 and the society's bye-laws govern what happens to a deceased member's interest. A nominee may be recorded as the new member, but a nominee holds for all the heirs, so siblings and a spouse can still assert their shares. Read the society's own register before assuming either outcome.

BDA sites. Where the BDA allotted a site, its records show the allottee and the sale deed. Heirs usually place heirship proof before the BDA to have the allottee's name updated, and some allotments carry conditions that survive the owner. Confirm the procedure with the office handling that layout.

Joint development agreements. Many older Bengaluru plots were handed to builders under a joint development agreement: the owner supplies the land, the builder constructs, and the owner receives a share of flats or a payment. If the owner dies mid-project, the agreement binds the heirs, and the builder needs each heir's signature on later documents. If you live overseas, ask that the power of attorney expressly lets the representative sign papers connected with the agreement. A broad general clause may not satisfy the builder's lawyers.

Property bought on a general power of attorney. It was once common in Bengaluru to buy a site on a general power of attorney, an agreement to sell and a Will, instead of a registered sale deed. The Supreme Court's Suraj Lamps decision held that such arrangements do not themselves transfer ownership. If your parent bought that way, the first task is to see whether title ever reached them, since heirs inherit only what the deceased owned. An advocate's title review comes before any filing.

Sites in gram panchayat layouts. Beyond the corporation limits, houses and sites have been recorded in panchayat registers, and Karnataka has moved these records onto the e-Swathu system with extracts such as Forms 9 and 11A. Heirs apply to the panchayat to enter their names, and the panchayat will ask for heirship proof like any other body.

Inherited Land and Village Property on the Bengaluru Fringe

Many families that moved into the city generations ago still hold an acre or a village house around Anekal, Devanahalli, Bidadi or Hoskote that was never renamed after a grandparent died. That property lives in the village revenue system, not the municipal one.

The RTC and the mutation. The ownership record for agricultural land is the RTC, the Record of Rights, Tenancy and Crops, available through the Bhoomi system and often called the pahani. After a death, the heirs apply for a mutation that updates it under the Karnataka Land Revenue Act, 1964. The village accountant, now commonly titled Village Administrative Officer, records the application, notice goes to interested persons, and the Revenue Inspector or the Tahsildar's office decides. If someone objects, the dispute is heard at the Tahsildar's level. A mutation updates the revenue record and gets a mutation register number. It does not decide ownership, so a family quarrel still ends up in a civil court.

Read the old RTC first. Older extracts often show a previous generation as owner, a Kannada spelling that differs from the English one on an Aadhaar card, tenancy entries or a crop loan noted in the other-rights column. Each item has to be explained or cleared before a new entry can follow.

Granted land and conditions. Some Karnataka land was originally granted by the government and carries conditions on transfer. The Karnataka Scheduled Castes and Scheduled Tribes (Prohibition of Transfer of Certain Lands) Act, 1978 is one example of a law that can restrict later dealings. If the RTC suggests a grant, an advocate should check the conditions before any plan to sell or divide.

Conversion and layouts. Land near Bengaluru is often converted for non-agricultural use by an order of the Deputy Commissioner, after which a layout may be formed and Khatas issued by the local planning body. If conversion happened in the deceased's name, the heirs inherit the converted land, and the paperwork follows it. If it did not, the land is still agricultural in the records, whatever the neighbours have built.

Small holdings. The Karnataka Prevention of Fragmentation and Consolidation of Holdings Act, 1966 can limit how a small holding may be divided among heirs, so never assume a field can simply be split into equal parts.

When one heir keeps the field. A sister in Bengaluru may want to keep the land while a brother in Singapore steps aside. This is usually done by a registered release deed at the Sub-Registrar, followed by a mutation. If the brother signs abroad, the deed travels as any overseas document does: notarised, apostilled or attested, and presented for registration within the Section 26 window. Whether and when stamp duty applies to a deed signed abroad is confirmed with the local office.

Selling later. FEMA lets NRIs and OCI holders inherit agricultural land but they cannot purchase it, and a later sale generally goes only to a resident Indian citizen. Plan any sale after the RTC shows the heirs' names. Our guide to FEMA rules for selling inherited property covers the exchange-control side.

The Bengaluru Court Route, and the Name Slips That Stall It

The Karnataka High Court sits principally in Bengaluru, with permanent benches at Dharwad and Kalaburagi serving the northern districts. A succession certificate or probate petition for a Bengaluru resident starts in the civil court, not at the High Court, which hears appeals and writs. In the City Civil Court, cases are heard in numbered court halls known by the abbreviation CCH followed by a number, and a petition is allotted to one of them. Which hall takes the matter is the registry's choice, and an advocate on the ground tracks it.

What an overseas heir contributes. Your affidavit, any no-objection consents and the power of attorney are signed abroad and made acceptable in India, and the Bengaluru advocate files and attends. If the Will names an executor who lives overseas, the court may want a statement from that person too, and we say so early.

Where Bengaluru files stall. A handful of small mismatches cause most of the delay.

Initials and father's names. Kannada names often carry a father's name, a village name or both as initials, and some people have no surname at all. A bank may hold K. S. Ramesh, a passport may spell out Krishnamurthy Srinivas Ramesh and an RTC may use another order. A one-and-the-same-person affidavit is the usual fix, but aligning the records early is cleaner.

Spelling variants. Venkatesh, Venkatesha and Venkatesa can all be the same man. Narayanaswamy and Narayana Swamy look like two names to a clerk. Community names such as Gowda, Shetty, Reddy or Rao may sit as a surname in one document and as a middle name in another.

Bangalore and Bengaluru. The city was officially renamed Bengaluru in 2014. Older IDs, deeds and bank records use the earlier spelling and newer ones the new one. The place name rarely stops a file, but affidavits should refer to both so that nobody is left guessing.

Married daughters. A woman may take her husband's first name as a surname after marriage. Her link to the deceased is shown with a birth or school record in her maiden name together with the marriage certificate.

Kannada documents. Older sale deeds, RTC extracts and Khata papers are often in Kannada. Courts and some institutions ask for an English translation, and we confirm how the court wants it certified before filing. Registered translators help, but a small slip can cause questions, so a bilingual advocate reads each document against the original.

Joint and survivor accounts. A joint account may pass to the surviving holder under the bank's own terms, which can remove it from the petition altogether. We read the mandate before listing any account in the asset schedule.

Working With Bengaluru's Banks and Registrars From Another Time Zone

Many Bengaluru families have members who studied or worked abroad, and their parents often built up a mix of accounts, fund folios, employer dues and shares over decades. The result is a long list of institutions, each with its own helpdesk, and an overseas heir calling during Indian office hours finds few windows.

Branch, regional office and nodal officer. A branch usually cannot decide on a large or disputed claim. The papers may travel to a regional office or a deceased-claims cell, which sets the document requirement. Asking for that requirement in writing at the start helps, and we send the letter on your behalf.

Registrars and depository participants. Fund registrars and the depository participants of shares each keep their own claim forms. They may want a succession certificate, an indemnity or an affidavit, depending on the nomination and the value. Their forms usually need your signature, so we plan the signing abroad so that every form is covered once.

Employer dues and provident fund. A parent who worked in a Bengaluru company or the public sector may have provident fund, gratuity or pension dues. These claims normally go through the employer or the relevant provident fund office, and the proof of heirship asked for varies, so we check the rules for each claim.

Time zones. Calls are scheduled around your day in the United States, United Kingdom, Gulf, Singapore or Australia, and WhatsApp updates let you follow progress without waiting for an office to open. When the court wants to hear an heir, video attendance can sometimes be arranged where the court permits it.

Our NRI property inheritance guide and the wider NRI property transfer page explain what comes after the certificate.

Two Karnataka Routes, Two Different Documents

Karnataka gives families two ways to prove who the heirs are, and they are not interchangeable. The Family Member Certificate is a revenue document, issued by the Tahsildar through the Nadakacheri system after field verification. The Succession Certificate is a court order, granted after public notice. Banks and registrars decide which one they want, so we ask the institution in writing before any filing. Starting with the wrong route can cost NRI heirs months, and resident relatives can use our legal heir certificate in Bangalore service for the revenue side.

When a Court Certificate Is Needed

  • Fixed deposits and savings accounts: banks often ask for it when there is no nominee, the nominee is not the only heir, or the balance is large. The bank’s own policy decides.
  • Shares in demat or paper form: the registrar or depository participant may seek a court order when there is no nomination or the holding is large.
  • Mutual-fund units: the fund’s registrar may accept a simpler heirship document or ask for the certificate, depending on nomination and value.
  • Insurance and provident fund dues: where the institution insists on it.
  • Disputed or doubtful heirship: when a co-heir objects or a revenue certificate is refused, the court hears every side.
  • Not for a house or land: the certificate covers debts and securities, not title to immovable property in Bengaluru.

Which Court Handles It in Bengaluru

For an NRI succession certificate in Bengaluru where the deceased lived within city limits, the petition goes to the City Civil Court, Bengaluru. Under the Bangalore City Civil Court Act, 1979, it is the principal civil court of original jurisdiction in the city, so it does the work a District Judge does elsewhere. Section 371 of the Indian Succession Act, 1925 ties the court to the place where the deceased ordinarily lived at death, so a Jayanagar, Indiranagar or Malleswaram address points here. If the deceased lived outside city limits, the competent court may be the district court of that area, and we confirm it from the address on the death certificate before drafting.

The court’s official site, bengaluru.dcourts.gov.in, carries cause lists and case status. Our note on the City Civil Court process and our succession certificate guide give the resident-family view.

Settling a Bengaluru Estate From Abroad in Eight Steps

You sign once overseas, and Bengaluru advocates and our representative handle everything that needs a person at the desk.

1

Assessment call

We list what your parent left, where each asset sits, whether there was a Will and whether a nominee exists. Then we say which Bengaluru desk each item needs: the City Civil Court, a city corporation, a Tahsildar or the bank itself, and in what order.

2

Document collection

You receive two lists, one for papers near you and one for relatives in Bengaluru. Family can collect the death certificate, tax receipts, Khata extract and passbooks while you gather passport, PAN and address proof, so neither side waits for the other.

3

Signing abroad

We prepare your affidavit, the supporting papers and a power of attorney naming our Bengaluru representative. You sign before a notary. The US, UK, Singapore and Australia use an apostille; the UAE and Germany use attestation by the Indian mission. A draft goes to the notary beforehand.

4

Originals to Bengaluru

Scans travel first so an advocate can compare every name with Aadhaar, bank records and the Khata. Then the originals follow by courier. We confirm with the local office what stamping a power of attorney signed abroad needs, rather than assume it.

5

Filing and notice

The advocate files the petition at the City Civil Court with the asset schedule, answers any registry objection and follows the notice stage. For a Family Member certificate the application goes through Nadakacheri, and local verification by the village accountant and Revenue Inspector follows.

6

Hearing

In an uncontested matter the Bengaluru advocate appears under the power of attorney and your affidavits. If the judge wishes to hear from you, we raise it early and plan around your time zone, including video attendance where the court allows it.

7

Certificate issued, then put to use

When certified copies arrive, we present them to each bank, fund registrar and depository, and use the heirship proof for the Khata, BESCOM and association records, in whichever order each institution will accept.

8

Money home

Proceeds land first in an NRO account. Remitting abroad is allowed up to USD 1 million per financial year, supported by Form 15CA and a Chartered Accountant's Form 15CB (Forms 145 and 146 from 1 April 2026), and any TDS on a sale is settled before the money moves.

Bengaluru Document Checklist: What You Hold and What Family Can Fetch

Keep one folder of scans in which every name matches. Kannada and English spellings, initials and a missing middle name are the commonest triggers for queries. If two documents spell a name differently, tell us early so that the right affidavit is drafted once.

From you (abroad)

  • Passport, plus the visa, residence card or OCI card that shows where you live
  • Indian PAN card, needed for claims, tax filings and any later sale
  • Power of attorney and affidavit signed before a notary, then apostilled or attested by the Indian mission
  • Signed no-objection consents from any sibling or relative who also lives overseas
  • Overseas address proof, such as a utility bill or bank statement, in the same name as your passport
  • Specimen signatures that match the ones on the affidavits

  • Aadhaar, PAN and address proof of the deceased, with names checked against bank records and the Khata
  • The Will with witness details, or a short statement that none exists
  • Khata certificate and extract, latest tax receipt and sale deed for a house, site or apartment
  • RTC extract and any mutation entry for farm land, or the association's records for an apartment

Illustrative Example: Anjali in Seattle, Her Father in Jayanagar

Illustrative example (fictional): Anjali is a data scientist in Seattle, USA. Her father died in Jayanagar, Bengaluru, leaving three fixed deposits, two mutual-fund folios and a demat account with shares. Her mother and elder brother live in Bengaluru. There is no will. The bank says a Family Member Certificate is not enough for its deposits and asks for a court-issued Succession Certificate. Here is how an NRI succession certificate in Bengaluru could run for her.

Week 1: Find out what each institution wants

Anjali writes to us on day 1. By day 4 we have asked the bank branch, the mutual-fund registrar and the share registrar for their written requirements, and prepared a schedule of every account, folio and holding. The heirs are Anjali, her brother and her mother, all Class I heirs under the Hindu Succession Act, 1956.

Weeks 2 and 3: Papers signed in Seattle and Bengaluru

We draft the petition, a Power of Attorney and Anjali’s affidavit. She signs before a notary in Seattle, has the documents apostilled, and couriers them to us. Her mother and brother sign consent affidavits in Bengaluru in the same weeks.

Week 4: Filing at the City Civil Court

Our advocate files the petition at the City Civil Court, Bengaluru, stating the date of death, Jayanagar as the residence, all three heirs and each asset.

Weeks 5 to 9: Notice and objection window

The court admits the petition, fixes a hearing date, posts notice at the court-house and has it published as the judge directs. In this illustration nobody objects.

Months 3 to 4: Hearing and bond

Our advocate appears and the judge decides the matter in a summary manner. Under Section 375 the judge directs a bond with a surety, which our advocate arranges in Bengaluru.

Month 5: Grant and claims

The court grants the certificate listing the three deposits, the two folios and the shares. We obtain certified copies. The bank, the fund registrar and the share registrar each ask for their own claim forms, which Anjali signs in Seattle. Proceeds go to an NRO account. Remitting abroad later is capped at USD 1 million per financial year, with Forms 15CA and 15CB (Forms 145 and 146 from 1 April 2026); see our note on FEMA rules for NRIs.

These timings are illustrative. The real pace depends on the cause list, any objection and each institution, and each institution decides what it accepts.

  • One plan for every asset: A bank balance, an apartment and a field rarely need the same document, so we sequence them instead of repeating applications.

Frequently Asked Questions

Do I have to fly to Bengaluru to get a succession certificate for my late parent's accounts?

+
Usually not, provided the heirs are in agreement. You sign the affidavit and a power of attorney before a notary where you live, and a Bengaluru advocate files the petition, deals with the registry and attends the hearing for you. The court may occasionally ask an heir to appear, most often when someone objects or the judge wants a relationship point explained, and video attendance can sometimes solve that. We flag the likelihood at the start. Relatives in the city only sign their own consents and confirm a few details.

Will a Bengaluru bank release my father's balance on a Tahsildar's Family Member certificate?

Sometimes, mainly for modest balances in a savings account with a clear nominee, but each bank and occasionally each branch follows its own policy. Larger deposits, lockers, shares and fund units more often trigger a demand for a court succession certificate. Because the wrong route can waste months, we ask the branch for its requirement in writing before filing anything. If the bank accepts the revenue certificate, the matter can finish much sooner than a court petition.

Is probate still necessary for a Will made in Bengaluru?

+
Not by statute, and in Bengaluru it never was. Section 213 of the Indian Succession Act, which barred enforcement of rights under certain Wills until probate, applied only to Wills tied to the old presidency towns of Bombay, Calcutta and Madras. The Repealing and Amending Act, 2025 removed it with assent on 20 December 2025. Even so, a bank, depository or buyer may ask for probate because it is conclusive proof of the Will. We check what each institution insists on and plan around that, rather than assuming either way.

My mother named me nominee for her apartment in Bengaluru. Am I the owner?

+
Not on that basis alone. A nominee may be recorded to receive the property or membership on the owner's death, but a nominee holds for all the legal heirs and does not displace them. Siblings and a surviving spouse can still claim their shares under succession law. An owners' association or a cooperative society may update its register in your name, yet it may also ask for no-objection letters from other heirs or an indemnity. If a sibling objects, the nomination rarely settles anything.

How do I sign from the US, UK, UAE or Germany so Bengaluru offices accept my papers?

+
Sign before a notary public, then complete the step that depends on your country. The United States, United Kingdom, Singapore and Australia belong to the Hague Apostille Convention, so an apostille is added. The UAE is not a member, and Germany objected to India's accession, so papers from those countries go to the Indian Embassy or Consulate for attestation. We send a draft and brief the notary beforehand so that nothing is signed twice, and we check that your passport name matches the affidavits.

What can my Bengaluru representative do under the power of attorney?

+
A well-drafted instrument names one person in Bengaluru and lists the permitted acts: signing and filing the petition papers, swearing affidavits for you, appearing before the City Civil Court, the Tahsildar and the Sub-Registrar, collecting certified copies and following claims at banks, registrars and the association. It does not allow a sale or the signing of a joint development agreement unless it says so expressly. Stamping on arrival and registration timelines vary, so we confirm them locally. Our NRI power of attorney guide has the wider picture.

Can I, as an NRI or OCI holder, inherit my father's farm land near Anekal or Devanahalli?

+
Yes. FEMA allows NRIs and OCI holders to receive agricultural land by inheritance even though they cannot buy it. The new names reach the RTC through a mutation application to the revenue office. Selling is a separate matter: such land can generally pass only to a resident Indian citizen, and Karnataka's land laws, along with any conditions attached to granted land, can narrow the buyers further. Finish the title and the mutation first, then plan any sale with an advocate and a Chartered Accountant.

How do I move the money abroad once a Bengaluru asset matures or is sold?

+
Proceeds first land in an NRO account. From there, remittance up to USD 1 million per financial year is generally allowed, supported by Form 15CA and a Chartered Accountant's Form 15CB, which became Forms 145 and 146 from 1 April 2026. Keep the certificate, the sale deed and the tax records together, since the bank will ask for them. Sums above the limit or unusual situations may need the Reserve Bank's approval, so give your Chartered Accountant the full picture early.

Will India tax me for inheriting my parent's Bengaluru apartment?

+
No. India has no estate or inheritance tax, and property received on a death is not taxed in your hands when you receive it. Tax arises later if you sell, as capital gains, with the deceased's purchase date and original acquisition value generally carried over to you. Rent from the apartment is taxable as it arises. Your country of residence may have its own reporting or inheritance rules for overseas assets, so take advice there as well.

One of my siblings in Bengaluru will not sign. Can the matter still move?

+
It can, but not on the quick path. A bank or an association rarely acts without every heir's consent, and a Tahsildar who receives an objection may point the parties to court. In a succession petition every near relative is named and receives notice, and the judge decides on evidence. A calm conversation in which a lawyer explains each person's legal share often brings consent before anything is filed, so we try that first. Disputes add months, and overseas heirs should plan for that.

How long will a Bengaluru succession certificate take?

+
No honest single answer exists, because the route sets the pace. A Family Member certificate depends on how quickly local verification is completed. A court petition takes longer, since notice, any objection, a possible bond and the judge's diary all play a part, and it is usually measured in months. Courier time and notarisation at your end add to that. We give you the likely sequence at the assessment and update you at each stage rather than promising a date.

Can I apply online in Karnataka?

+
In part. The Family Member (Vamshavruksha) certificate is a Nadakacheri service that can be requested through the state's online revenue services and at the Atalji Janasnehi Kendras, though field verification by the village accountant and Revenue Inspector still takes place. A succession certificate cannot be downloaded: an advocate may e-file the petition, but notice, hearing and grant stay with the court. Because login, verification and affidavits sit in Karnataka, an overseas heir normally acts through a representative. Portals change, so we confirm current steps.

How does the Family Member certificate differ from a court succession certificate?

+
The Family Member certificate is a revenue record, issued by the Tahsildar after local verification, that names the surviving family members. It is not a court order. A succession certificate is granted by the City Civil Court after a petition, public notice and a hearing, and it authorises you to collect the specific debts and securities listed in it. Institutions choose which they accept, and some ask for both. See our legal heir certificate page for the revenue side.

My father's flat is in Whitefield and his site is in Anekal. Does that change the paperwork?

+
Yes, in several places. The flat sits inside the Greater Bengaluru area, so the Khata change and the association's records follow it, while an Anekal site could fall under a local body, a BDA or BMRDA-related layout or a panchayat, each with its own process. The court route for deposits is separate from both. Postal addresses read Bengaluru for all of them, which is why files reach the wrong desk. We map each asset to its body before anything is signed abroad.

Who deducts tax when an NRI sells an inherited Bengaluru apartment?

+
The buyer must deduct TDS under Section 195 of the Income-tax Act, 1961 on a payment to a non-resident, and this generally applies to the whole sale consideration rather than just the gain. The Income-tax Act, 2025 now carries the rule in Section 393(2) from 1 April 2026. To avoid over-deduction, apply on the TRACES portal for a lower or nil deduction certificate (Form 128, earlier Form 13) before the sale closes. Repatriating the proceeds then follows the annual USD 1 million limit.

Does religion change which law applies to my family's inheritance?

+
Yes, personal law decides who the heirs are. For Hindus, Buddhists, Sikhs and Jains who die without a Will, the Hindu Succession Act, 1956 applies, with Class I heirs that include children, a spouse and the mother. Muslims follow their own personal law, while Christians, Parsis and others fall mainly under the Indian Succession Act, 1925. The court procedure under Part X is the same, but the list of heirs named in the petition differs. NRI status itself does not change who inherits.

Does it matter whether papers say Bangalore or Bengaluru, or spell my father's name differently?

+
It can. Bangalore was officially renamed Bengaluru in 2014, so older IDs, deeds and bank records use the earlier spelling while newer ones use the new. The place name rarely stops a file, but names do. Kannada names often appear with initials, a father's name or a village prefix, and one given name can be Venkatesh in one record and Venkatesha in another. A one-and-the-same-person affidavit usually fixes it, but lining up the records early is cleaner.
