In Brief: The Power of Attorney a Kolkata Estate Usually Needs

Short answer

A POA for overseas legal heirs in Kolkata works best as a special power of attorney that names the Kolkata asset, lists each act the representative may perform and ends when the task ends. Sign before a notary abroad, then obtain an apostille where your country belongs to the Hague Convention, or consular attestation where it does not. Stamping follows in West Bengal, and registration where a deed will rely on the paper. The authority ends on your death, and you can withdraw it in writing at any time.

  • Scope: special for a named flat or account; general only with close oversight
  • Signing: notary abroad, then apostille or Indian consular attestation
  • In Kolkata: stamping, and registration when a deed will rely on it
  • Ends: on your death, on written revocation, or when the task is done

Which Kind of Authority Fits Which Kolkata Task?

A power of attorney is only as useful as its match to the job. The table pairs six common Kolkata tasks with the kind of authority they call for, the office that will read the document and a realistic time frame. Read the nearest row, then ask us to test it against your own file.

Your Kolkata taskAuthority to grantOffice that reads itTypical time
Mutation of a flat in a KMC ward after a parent's deathSpecial POA
Names the flat, the heirship papers and the mutation application. The representative signs forms and attends at the ward or borough office.
KMC assessment department through the ward or borough office; the owners' association then updates its own registerWeeks once every heir has signed, longer if one withholds consent
A succession certificate or probate petition in a Kolkata courtSpecial POA
Lets a trusted person instruct counsel, sign routine papers and collect certified copies. The petitioner's own verification is usually sworn separately before a notary.
The competent civil court or the Calcutta High Court, depending on the petitionSeveral months, because public notice is part of the process
Claiming a savings account, fixed deposit or locker at a Kolkata bank branchClaim authority
Limited to the claim: submitting the bank's forms and, where the bank accepts it, receiving the money into your NRO account. Banks often keep their own format, so ask first.
The branch and its legal or settlement desk, sometimes a regional officeSet by the bank's queue and by how quickly you sign and courier
Signing a release deed or family settlement over an inherited flat or plotDeed authority
Names the deed, the co-heirs who benefit and the share released. Registrars are careful here, so many families sign the deed itself before an Indian consul.
The registration office with jurisdiction over the property: a Registrar of Assurances or an ADSR or district registrar officeQuick to present once stamped; the registry's appointment calendar sets the pace
Selling the inherited property at a later stageSale authority
Written only after title is settled. Names the property, how the buyer is chosen and what the representative may not do, such as keeping the sale money.
The registration office, the buyer's bank and the tax department for withholding stepsMonths, because title, tax and buyer checks run one after another
Looking after rent, dues, utilities and several assets over a long periodGeneral POA
Wider and longer. Use it only with a person you trust fully, a written duty to report and a fixed end date.
CESC, the owners' association, KMC, tenants and banksOngoing; review it at least once a year

These are working patterns, not rules. KMC, banks and registries each keep their own habits, and those habits change. We write to the office before you sign and attach its reply to your file, so your representative carries proof of what was accepted.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

Which Kolkata Office Will Actually Read Your Power of Attorney?

Overseas heirs often picture one counter where a power of attorney is accepted. In Kolkata there are several, and each reads the document for its own purpose. A paper that satisfies a bank may fall short at a registry, so it helps to see the map before the first draft is written.

KMC and the ward or borough offices

For a flat or house inside the corporation area, the assessment record is changed by the Kolkata Municipal Corporation. A mutation application typically travels with proof of heirship, the latest tax receipt and the heirs' consent papers, and a representative shows authority through a copy of the power of attorney. Officers commonly look for a signature that has been notarised and legalised, so a plain photocopy of a page signed at home rarely works. Ask the ward office what it wants, and whether an original must be shown.

Bidhannagar and New Town

Salt Lake sits under Bidhannagar Municipal Corporation, and many plots there are held on lease from the state, so the lessee's name is dealt with by the Urban Development and Municipal Affairs Department as well. New Town is administered by the New Town Kolkata Development Authority. A representative working in either place should carry a power that names the lease or plot, because the words property in Kolkata are too vague for these offices.

Howrah and the outer districts

A Howrah house falls under Howrah's own corporation and collectorate. Land outside municipal limits is recorded through the BL&LRO and the Banglarbhumi system, where a mutation application is made online and then checked by the local office. A representative may need to show the authority beside the heirship papers, and practice differs from block to block.

Registration offices

Deeds are registered under the state Directorate of Registration and Stamp Revenue. In and around Kolkata the work is shared among Registrar of Assurances offices and the ADSR and district registrar offices of the surrounding areas, and the office that covers your property depends on where it stands. A power of attorney matters most here when your representative will sign or present a deed for you, and registrars look closely at who authenticated the document.

Banks and fund registrars

A branch usually routes an heir's claim through its legal or settlement desk. Many will deal with a representative who brings a properly legalised document, though each keeps its own format and may ask for a specimen signature or an indemnity. Registrars of mutual funds and depositories behave in much the same way.

CESC and owners' associations

The electricity supplier and the association seldom need a registered document. A clear authority letter attached to the heirship papers normally serves, although associations commonly ask that pending dues be settled first.

Special or General: Setting the Scope for an Inherited Kolkata Estate

A special power of attorney authorises named acts. A general one authorises a wide and open range. Under the Powers of Attorney Act, 1882 and the law of agency in the Indian Contract Act, 1872, a representative may do only what the document allows, and doubtful wording tends to be read narrowly. For an heir living abroad, that narrow reading is protection, not a defect.

For most Kolkata estates a special power works best. It can name the flat, the plot or the account, list the heirship papers to be collected, and confine the representative to filing, appearing, signing forms and receiving documents. A ward officer or branch manager finds it easier to accept because the purpose is plain, and you find it easier to supervise because each act matches a clause.

A general power suits a narrower set of cases: an estate with rented rooms, several deposits and utility accounts that need attention for years, looked after by someone you trust completely. Even then, consider two documents, a special one for the immediate filings and a limited general one for upkeep, in place of one paper that can do everything.

A release deed or family settlement needs particular care. A power that merely says sign any deed invites queries from a registry, and the Supreme Court ruled in 2011 that dealings by general power of attorney, agreement to sell and will do not, in substance, transfer title on their own. Where a deed gives up your share, many families have the heir sign the deed itself abroad before an Indian consul and keep the power of attorney for the paperwork around it. Our blog on what to include in a power of attorney for overseas heirs lists further clauses.

  • The property description: municipal premises number, ward and borough, the deed or lease reference, and mouza, plot and khatian details for land outside the corporation area.
  • Your name exactly as on your passport, with a recital of spelling variants such as Chatterjee and Chattopadhyay, so a mismatch cannot be raised later.
  • A list of permitted acts: apply for heirship papers, swear local affidavits, file mutation, instruct advocates, sign bank forms, collect certified copies and appear before registrars.
  • Express limits: no sale, mortgage, lease or gift unless a separate clause names that transaction.
  • Money: whether the representative may receive any payment, and where it must be deposited. Many families insist that money goes only into your NRO account.
  • Delegation: whether the representative may appoint an advocate or a substitute, and whom.
  • Duration: an end date or an end event, such as completion of mutation.
  • Ratification and indemnity wording, and a duty to send you copies of everything filed.

Notary, Apostille, Stamping and Registration: From Your Desk Abroad to a Kolkata Counter

Sign before the right person

The Registration Act, 1908 recognises, for registration purposes, a power of attorney signed outside India when it is authenticated by a notary public, a court, judge or magistrate, an Indian consul or vice-consul, or a representative of the Central Government. The evidence law presumption for such documents (Section 85 of the Indian Evidence Act, 1872, now reflected in the Bharatiya Sakshya Adhiniyam, 2023) also helps if the paper is ever tested in court. Some advocates prefer execution before an Indian consular officer because it removes doubt. A local notary remains common and is usually accepted, but ask the office that will rely on the paper.

Legalise it for India

India is a member of the Hague Apostille Convention. Where your country is also a member, the notarised paper receives an apostille from that country's designated authority. The USA, the UK, Singapore and Australia are members, and Canada acceded in 2024, so confirm the current position there. Where the Convention does not apply, the document goes to an Indian mission for attestation. The UAE is not a member, so papers signed there are attested by the Indian Embassy in Abu Dhabi or the Consulate General in Dubai. Germany objected to India's accession, so German documents also follow the attestation route. Some countries ask for a local ministry step first, so check the mission's current instructions.

Stamp it once it arrives

Stamp duty on a power of attorney in West Bengal comes from the state's stamp schedule, which treats documents differently according to what they do: a power limited to registering a single document, one for a single transaction, one for acting generally, and one given to sell immovable property. The Indian Stamp Act as published on the state registration portal says an instrument executed only outside India may be stamped within three months after it is first received in India. Treat three months from first receipt as the working outer limit, and have the Kolkata advocate confirm it with the stamp office before the courier is booked. Duty can be paid through the state's electronic payment system, GRIPS, or by other methods the office accepts, and the amount depends on the schedule and the wording of your document, so rely on the portal and an advocate rather than a number from the internet.

Register where it is needed

In general, the power of attorney itself is not registered as a matter of course. Whether it must be depends on what it authorises and on what the office relying on it expects. Where a registry wants it, for example because your representative will present a deed, Section 26 of the Registration Act lets a document executed outside India be presented within four months of reaching India, at the registrar's discretion. The four months run from arrival, not from the date you signed. We date the courier receipt, put it on the file and ask the registration office what it needs for your particular deed before anything is lodged.

Choosing an Attorney, and What Brings the Authority to an End

Who to appoint

Your representative will hold your signature in Kolkata, sometimes for months, so choose someone with time, honesty and a methodical habit. A sibling in the city is the obvious pick but not always the wise one, because a sibling is also an heir with an interest in the same estate. Where relations are warm and interests align, a sibling can work well. Where shares are in doubt, a neutral person such as a cousin, a family friend or an advocate avoids any suspicion that your authority was used for another heir's benefit.

Whoever you choose, check a few things. The person should be an adult of sound mind who lives in or near Kolkata, holds identity and address proofs that match the document, is comfortable with bank forms and government counters, and agrees to report to you in writing. If you want an alternate, say clearly when the alternate steps in.

What the attorney owes you

Under agency law the representative must act within the authority given, keep accounts and hand over whatever is received. In practice, ask for a short note after each step and keep a folder of copies. That habit protects you more than any clause can.

Death ends it

A power of attorney is an agency. Under Section 201 of the Indian Contract Act, 1872 an agency ends when the principal dies or becomes of unsound mind, when the principal revokes it, or when the agent dies or renounces the work. After your death, banks and registrars should not act on it. The same is true of a power your late parent gave to a child: once the parent has died, it no longer supports any dealing with the parent's accounts or property. Section 202 recognises an agency coupled with an interest in the subject matter, which survives, but that exception is narrow and not one to rely on in an ordinary inheritance.

Revoking it

Revoke in writing and make sure the attorney receives the notice, because revocation takes effect against the attorney once it is communicated. Then tell every office and bank that holds a copy, collect the originals, and note the dates. If the original was registered, ask the registry how it wants the revocation recorded, since practice varies. A newspaper notice is common but does not replace direct notice to each institution. If you are appointing a replacement, put the revocation and the new appointment in one carefully dated document.

A Realistic Timeline for a Kolkata Power of Attorney, in Soft Ranges

Much of the timing sits with offices outside anyone's control, so the ranges below are guides and not promises.

Scoping and drafting

usually within about a week once we hold the asset list, the representative's details and your instructions.

Review and revisions

depends on how quickly you read and answer; two rounds are typical.

Signing and legalising abroad

a notary visit is quick. An apostille may take a few weeks when processed by post, and consular attestation can take longer where appointments are needed.

Courier to Kolkata

a short journey, though customs and holidays can add delay. The arrival date matters, because the stamping and registration windows are counted from it.

Stamping

best done soon after arrival, not left until the outer limit.

First use at a counter

a few weeks for a ward office or bank claim once every heir has signed.

Court routes

several months, because notice and listing are part of a succession certificate or probate petition.

Registration of a deed

set by the registry's appointment calendar and by how quickly stamps are in order.

The document itself is rarely the slowest part of an inheritance. Delay usually comes from a late apostille, a name mismatch found at the counter, or an heir who has not yet signed. Fixing those early is where careful preparation pays off.

Common Mistakes That Send a Kolkata File Back

One broad power for everything

A vague grant makes officers hesitate and puts you at risk. Name the asset and the acts.

A loose property description

Property at Kolkata is not an address. Give the premises number, ward, deed reference or plot details.

Name mismatches

A passport that says Banerjee and a deed that says Bandyopadhyay will stall a file unless the document records both forms.

Stopping after the notary

A notarised paper is not yet usable in India. The apostille or Indian mission attestation step is what the Kolkata office looks for.

Using an apostille where none exists

The UAE and Germany follow the attestation route, so do not plan around an apostille there.

Losing track of the clocks

The stamping window and the four-month registration window run from first receipt in India. Record the courier date on the day it arrives.

Relying on a dead person's authority

A power given by your late parent ended with the parent's death. Do not let anyone keep operating accounts on it.

Granting sale power when only mutation was needed

Give the least authority that finishes the job.

Naming an interested co-heir with no safeguards

If you do, add reporting duties and limits on money.

Sending photocopies where an original is wanted

Ask each office whether it needs to see the original.

Writing to the branch manager only

Claims usually run through the legal or settlement desk, so ask who handles heirs' requests.

Eight Steps From Your Notary Abroad to Your Representative in Kolkata

You sign once, and the steps that need a person in Kolkata are carried out by your representative with our advocates in support.

1

Map the assets and the offices

We list every Kolkata asset and decide which office governs it: a KMC ward, Bidhannagar, New Town, Howrah or a BL&LRO block. For each asset we note what the counter reads and whether an original or a copy of your authority is shown.

2

Choose the scope and the attorney

On a call in your time zone we agree which acts the representative may perform, for which asset and until when. We also talk through who should hold the authority, including the case for an independent person where siblings have different interests.

3

Draft and review across time zones

Our advocate prepares the document with the premises number, deed reference and your passport spelling, then sends a plain-language summary beside the draft. You mark questions and we revise, so nothing is printed for signing until you can say what each clause allows.

4

Test the draft with the offices

Before you sign, we write to the bank's settlement desk, the KMC ward or borough office and any registry involved, asking what authority they accept. Their replies go into the file, so a Kolkata counter cannot surprise your representative with a new demand later.

5

Sign and legalise abroad

You sign before a notary, or before an Indian consular officer where that route is open, then obtain an apostille in a Hague country such as the USA, UK, Singapore or Australia. In the UAE, Germany and other non-apostille routes, Indian mission attestation applies. Sign exactly as on your passport.

6

Courier, log the arrival and stamp

Scans travel first, then the originals by tracked courier. On arrival in Kolkata we log the date, because West Bengal stamp law and the Registration Act both count their windows from first receipt in India. Our representative then has the document stamped as the schedule requires.

7

Lodge it where it is needed

The representative presents the authority with each filing: the ward office for mutation, the bank's settlement desk for claims, the court registry for petitions and a registration office where a deed relies on it. Where registration of the power itself is expected, we apply within the statutory window.

8

Report, review and close

After each step you receive copies and a short note. When the task ends, we recommend revoking the authority in writing and collecting the originals, so a document signed for one estate does not linger in Kolkata files for years. New tasks get a fresh, narrower document.

Papers to Gather Before the Authority Is Drafted

Photocopies are enough to begin, and originals travel only after every name has been compared with your passport. A ward office, bank or registry may ask for more, so treat both lists as an opening set and adjust once each office replies in writing.

From you (abroad)

  • Passport with photo and address pages, and the OCI card if you hold one
  • Proof of your overseas address
  • Indian PAN, or the details we need to help you obtain one
  • A note of every spelling variant of your name found on Indian records
  • The name, relationship and contact details of the person you wish to appoint, with your written instructions
  • Details of your NRO account, or a note that one is needed for the money
  • Your preferred notary or consular appointment, so we can brief them in advance

From Kolkata offices and records

  • The conveyance, lease or sale deed for the flat or plot, showing the municipal premises number
  • The latest KMC assessment bill and receipt, or the Bidhannagar, New Town or BL&LRO record for the property
  • The owner's death certificate, from the KMC registration office or the registrar for the place of death
  • Whatever heirship paper already exists, such as a magistrate's affidavit or a court certificate
  • Identity, address proofs and photographs of the person named as representative
  • Bank passbooks, deposit receipts and locker details with the branch name
  • Owners' association receipts, the CESC bill, and for rural land the khatian and plot extract from Banglarbhumi

Why Overseas Heirs Ask Us to Draft Their Kolkata Authority

  • Scope written for the counter. Each clause is drafted with the KMC ward office, the bank desk or the registry in mind, so a Kolkata officer sees a named premises and named acts, not a vague grant.
  • Windows tracked from arrival. We log the day your document first reaches India, then watch the stamping and registration limits for you, instead of leaving two clocks to a courier tracking page.
  • Authority that stays narrow. You see each clause in plain language, you decide the limits, and you receive written reports, so a representative acts for you without holding more power than the task needs.

Frequently Asked Questions

Should my Kolkata power of attorney be special or general?

+
For most inherited estates, special. A special power names the flat, plot or account and lists the acts the representative may perform, such as applying for mutation, swearing local affidavits, instructing an advocate or filing a bank claim. KMC officers, branch managers and registrars generally find that easier to accept, and you can check each act against a clause. A general power can suit long, hands-on management of rented rooms and utilities, but it carries more risk when you are far away. Many families sign one special document now and decide later whether upkeep needs anything wider.

I live in the USA, the UK, Singapore or Australia. How do I make the power of attorney usable in Kolkata?

+
Sign before a notary and complete every line of the notarial certificate. Because these four countries belong to the Hague Apostille Convention, the designated authority in your country then attaches an apostille to the notarised paper, and Kolkata offices can rely on it without a visit to an Indian mission. Canada acceded in 2024, so check how its apostille route works before you rely on it. Send us scans before the originals travel, so a spelling or signature problem is corrected while a fresh copy is still easy to produce.

My papers will be signed in the UAE. Is an apostille possible?

+
No. The UAE is not a member of the Hague Apostille Convention, so the notarised power of attorney is attested for India instead, through the Indian Embassy in Abu Dhabi or the Consulate General in Dubai. The same route applies to Germany, which objected to India's accession to the Convention. Some countries also ask for a step at a local ministry before the Indian mission attests, so read the mission's current instructions. An attested paper is read in Kolkata in the same way as an apostilled one.

Must a power of attorney signed abroad be registered in West Bengal?

+
Not as a blanket rule. Registration depends on what the document authorises and on what the office relying on it expects. Where a registry wants it, for example because your representative will present a deed for registration, Section 26 of the Registration Act, 1908 allows a document executed outside India to be presented within four months of reaching India, at the registrar's discretion. The four months run from arrival in India, not from the date you signed. We record the courier's delivery date and ask the registration office what it requires for your particular deed before anything is lodged.

How long after the power of attorney reaches Kolkata can it be stamped?

+
The Indian Stamp Act text published on the state registration portal says an instrument executed only outside India may be stamped within three months after it is first received in India, and the Collector's power to endorse a late instrument is bound by the same period. We treat three months from first receipt as the working limit, note the arrival date, and have the Kolkata advocate confirm it with the stamp office before relying on it. The duty depends on what the document authorises, so use the state portal and not a generic number.

Will KMC accept my representative for mutation of a flat in a ward?

+
KMC assessment offices usually deal with a representative who holds a properly legalised authority and the standard supporting papers, such as the heirship document, the death certificate, the latest tax receipt and the heirs' consent. Requirements vary between ward and borough offices and change over time, so we ask the office what it wants to see, whether a copy suffices or an original must be shown, and who may sign the application. We then draft the authority to match, naming the premises number so that nothing is left to query.

Will a Kolkata bank deal with my attorney for a deceased parent's account?

+
Often yes for the claim itself, though each bank keeps its own rules. The branch normally routes an heir's claim through a legal or settlement desk, which may ask for the legalised power of attorney, your identity papers, the heirship document and a signed claim form. Some pay only into your own account, and some ask for an indemnity. Where an NRO account is involved, a resident representative can typically operate it only within limits set by the RBI and the bank, and cannot send the money abroad for anyone but you. Write to the branch before you sign.

My late father gave my brother a power of attorney years ago. Can he keep using it?

+
No. A power of attorney is an agency, and under Section 201 of the Indian Contract Act, 1872 an agency comes to an end when the principal dies. After your father's death a bank, KMC or a registry should not act on the old document, and anything done under it risks being challenged. Your brother needs the heirship papers and, if he is to act for siblings abroad, a fresh power of attorney from each of them, signed and legalised in the usual way.

Can my attorney sell my share of the inherited Kolkata flat?

+
Only if the document expressly says so and names the property and the transaction. A power written for mutation and heirship papers does not stretch to a sale. Even with a sale clause, a registrar may look closely at the authentication, and the Supreme Court has ruled that dealings by general power of attorney do not in themselves transfer title. Tax steps for an NRI seller, including deduction under Section 393(2) of the Income-tax Act, 2025, sit outside the power of attorney. Keep sale authority in a separate, later document, drafted once title and the buyer are settled.

How do I cancel the power of attorney if I lose trust or the task is finished?

+
Revoke it in writing and make sure the attorney receives the notice, because revocation takes effect against the attorney once it is communicated. Then tell every office or bank that holds a copy, ask for the originals back and note the dates. If the original was registered, ask the registry how it wants the revocation recorded, since practice varies. A newspaper notice is common but does not replace direct notice to each institution. If you are appointing a replacement, put the revocation and the new appointment in one carefully dated document.

Can my sister and I, both abroad, sign one power of attorney?

+
It is possible, but separate documents are usually cleaner. Each heir may live in a different country with a different notary and a different apostille or attestation route, and each may want different limits. If one signs late, a joint paper stalls for both. If one later revokes, a joint paper becomes awkward for offices that must decide whose authority still stands. Two matching documents naming the same representative and the same asset let each of you act independently, and a Kolkata office sees the full picture of authority from both heirs.

Should I appoint my brother in Kolkata or an independent person?

+
Where family relations are easy and interests are aligned, a sibling in the city can be the simplest and most trusted choice. Where shares are in doubt or tempers are short, an independent person such as a cousin, a family friend or an advocate avoids the suspicion that your authority was used for a sibling's benefit. Whoever it is, limit the clauses, require copies of everything filed, ask for written reports after each step and keep money out of the representative's hands wherever possible.

Can the representative sign a release deed for me?

+
Only if the power of attorney names that deed, the co-heirs who benefit and the share being released. Registrars are cautious about deeds that give up an interest, and some prefer the executant's own signature. Many families therefore sign the release deed itself abroad before an Indian consul and keep the power of attorney for the surrounding paperwork. Our guide on how an NRI registers a release deed from abroad explains the choices, and the registry's own requirement decides which is practical.

Can I sign the power of attorney at an Indian Consulate instead of before a local notary?

+
Often yes, and some advocates like it because Section 33 of the Registration Act, 1908 and the evidence law both recognise authentication by an Indian consul or vice-consul. The missions publish how appointments, identification and documents work, and those rules change, so check the website of the mission that serves your area. A notary plus apostille or attestation remains the common route and is normally accepted. Ask the Kolkata office that will rely on the paper whether it has a preference.
