What Does Mutation After a Death Actually Do in Pune?
Mutation after a death in Pune updates the record that shows who answers for the property: the PMC, PCMC or Cantonment Board tax assessment, the Ferfar entry on the 7/12 for land, the City Survey property card and the housing society's share register. It records the heirs but does not create or prove title. Pune never fell under Section 213 of the Indian Succession Act, so probate was never compulsory here, although an institution may still ask for it when there is a Will.
- Municipal record: the tax name at PMC, PCMC or the Cantonment Board changes on the heirs' application, supported by proof of who the heirs are
- Land record: a succession Ferfar on the 7/12, opened by the Talathi, noticed to interested persons and certified by the Circle Officer
- Flat: the society moves the share certificate first, and the corporation tax name usually follows that resolution
- Not title: a mutation entry names the person paying tax; disputes about ownership are settled by a civil court
Which Record Needs Updating? Match Your Pune Property
Pune properties rarely sit in one system. Find the row that looks like what your family inherited, then note the office behind it. Many families will recognise two or three rows, and the entries can usually run side by side once the heirs' papers are ready.
| Where the property sits | What gets updated | Office or authority | Typical time |
|---|---|---|---|
| Flat in a co-operative housing society in Kothrud, Deccan, Aundh or the older peths | Share transfer, then tax name The managing committee passes a resolution in the heirs' names, then the PMC tax register follows. | Society managing committee, then the PMC property tax department | A few weeks once every heir has signed; months if a heir objects |
| Flat or house in Pimpri, Chinchwad, Akurdi, Nigdi or Wakad | PCMC tax register The name in the assessment roll is changed on the heirs' application, after the society has acted where there is one. | Pimpri Chinchwad Municipal Corporation tax department | A few weeks for complete papers; longer if documents are queried |
| Farm or village land in Haveli, Mulshi, Maval or Bhor | Succession Ferfar on the 7/12 A mutation entry adds the heirs to the 7/12 after notice and the objection period. | Village Talathi, Circle Officer, Tehsildar if someone objects | Short when heirs agree and the extract is clean; much longer if contested |
| Bungalow, plot or building under City Survey | Property card entry The City Survey record is changed by a separate application, alongside the municipal tax name. | City Survey Office of the Land Records department, plus PMC or PCMC | Several weeks, depending on the office and how clean the chain is |
| House or shop in Camp, Khadki or Dehu Road | Cantonment tax register The Board keeps its own register, and defence-managed land may carry separate occupancy papers. | Pune, Khadki or Dehu Road Cantonment Board, as the address requires | Varies by Board; confirm the current process first |
| House in a village governed by a gram panchayat or a small municipal council | House tax assessment entry The panchayat assessment register (Namuna 8) is corrected to the heirs' names. | Gram panchayat office or the council's tax section | A few weeks to a couple of months, depending on the local office |
Rows often combine. A family may need a society resolution for the flat, a Ferfar for a field and a cantonment entry for a shop. We sequence them so that one set of signed papers serves every filing, and we confirm each office before anything is lodged.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentWhich Pune Body Holds Which Record: A Working Map
On a postal label Pune reads as one city. For records it behaves like several jurisdictions that share a map, and the register you must change depends on who holds your building or field. Start from the property, not from the family's mailing address.
Pune Municipal Corporation (PMC)
Kothrud, Aundh, Baner, Shivajinagar, Deccan, the peths around Kasba and Sadashiv, Koregaon Park, Viman Nagar, Kharadi, Hadapsar and Katraj lie inside PMC limits. Its property tax department keeps the assessment register for houses, flats, shops and open plots, and that register is where the deceased owner's name sits. Several fringe villages have been brought into the corporation in recent years, so for a property near the older boundary, check the present position instead of trusting an old address.
Pimpri Chinchwad Municipal Corporation (PCMC)
Pimpri, Chinchwad, Akurdi, Nigdi, Bhosari, Thergaon, Pimple Saudagar and Wakad belong to PCMC, which runs its own tax roll and its own application route. A file lodged at PMC for a Chinchwad flat is simply returned, and the time lost is real.
Cantonment Boards
The Camp area is governed by the Pune Cantonment Board, Khadki by the Khadki Cantonment Board and Dehu Road by its own Board. Each assesses tax inside its limits and holds a separate register, and in many cases mutation requests can be made through the eChhawani portal. Some holdings stand on defence-managed land with old grant or occupancy papers, which a municipal property would never have. Proposals to carve civilian pockets out of cantonments have come up from time to time, so confirm the current position before filing.
Gram panchayats and municipal councils
Villages across Haveli, Mulshi, Maval and Bhor that lie outside any corporation keep a house tax assessment register at the gram panchayat, commonly called Namuna 8, with a demand register beside it. Towns such as Talegaon Dabhade and Alandi are run by municipal councils with registers of their own. Fast-growing belts such as Hinjewadi have seen their administrative status discussed repeatedly, so the right body should be checked, not assumed.
The revenue side
Three more records sit outside the municipal system:
- The 7/12 (Satbara) and 8A extracts for agricultural land, maintained by the village Talathi under the Tehsildar, with digital copies on the state land records portal.
- The property card for land surveyed under City Survey, kept by the City Survey Office of the Land Records department.
- The registered deed and its Index II entry, at the Sub-Registrar office that covers the property, searchable through the state registration department's portal.
A death certificate follows the place of death
Deaths are registered where they occur, not where the family lives. Someone who lived in Baner and passed away in a Pimpri hospital leaves a PCMC death certificate, while the flat remains in PMC records. That is normal. Every later office only needs to be sure it is the same person, so the identity details must match across all papers.
A Tax Register Entry Is Not a Title Deed
The most common misunderstanding in Pune families is that a name on the corporation bill or the 7/12 settles who owns the property. It does not. Mutation records who pays the tax and who the office treats as the person in occupation or possession. Ownership between heirs follows the law of succession, a Will, or a registered deed, not the register.
Courts have said this repeatedly: revenue entries are kept for fiscal purposes, and a disputed claim to ownership is for a civil court. For heirs, that cuts two ways.
Why bother at all, then? Because almost every later step asks to see the entry. A buyer's advocate wants the chain of names. A bank wants the tax name to match the borrower. The society will not move a share certificate on a verbal understanding. A developer redeveloping an old building wants every heir identified and signed up.
If the heirs decide that one of them should hold the property alone, mutation by succession is not the tool. The other heirs sign a registered release deed (in Marathi usage, a Hakka sod patra), stamped according to Maharashtra stamp law and registered at the Sub-Registrar office. Only then do the records move to a single name. Stamp treatment for releases within a family has been revised over the years, so read the current position on the state registration portal instead of relying on what a neighbour paid.
Our guide on drafting a release deed for inherited property explains what such a deed needs to say.
- Good news. A delay in mutation does not mean the family has lost anything. Heirs hold their share from the moment of death, even when the paperwork trails behind by years.
- Careful news. A mutation entry, however clean, cannot be used to push another heir out. If one sibling is shown as sole holder because the others stayed silent, the entry can be challenged, and a buyer's lawyer will notice the gap.
A Flat in a Society or Association: Share Transfer First, Tax Name Second
Many Pune flats are held through a co-operative housing society, especially in older buildings around Kothrud, Deccan, Erandwane and the central peths. Newer complexes in Baner, Kharadi or Wakad may instead be run as an apartment owners' association, where the flat is held under a registered deed rather than through shares. The first job is to work out which structure applies, because the route differs.
In a co-operative society
The Maharashtra Co-operative Societies Act, 1960 provides, in Section 30, that on a member's death the society moves the share and interest to the nominee, or, where no one was nominated, to the person the committee finds to be the heir or legal representative. Courts have described a nominee as holding on behalf of all heirs, not as the exclusive owner. In practice a Pune society asks for a written application, a certified death certificate, the original share certificate, consent letters or an affidavit from the other heirs, and sometimes an indemnity bond. The committee then passes a resolution, and a fresh share certificate is issued in the new names. Practice varies from society to society, so ask the secretary what the bye-laws and past resolutions require.
In an apartment association
Because ownership rests on a registered deed, the heirs prove their position through the heirship papers, and any redistribution among them needs a deed registered at the Sub-Registrar office. The association then updates its records, and its own bye-laws and deed of declaration describe the remaining steps.
Then the tax name
After the society or association has accepted the heirs, the property tax name is changed at PMC or PCMC. Registered transfers increasingly flow from the registration department to the corporations electronically, but a succession by operation of law does not produce a registered deed, so heirs usually still have to apply. Ask the ward office what it needs.
When a society refuses
If heirs cannot agree, or the committee suspects a hidden claim, it may insist on a court document. Disputes with a society are typically heard by the co-operative court under the Act, not by the revenue office. Our blog on resolving disputes among legal heirs sets out how families usually get unstuck.
Redevelopment is the Pune-specific trap
Many older societies in the central areas are somewhere in the redevelopment process. A deceased member's unresolved heirship can hold up the society's agreement with the developer, because every heir's signature may be needed. If one heir lives overseas, make sure the power of attorney expressly allows signing redevelopment documents; a broad general clause may not satisfy the society's or the developer's lawyers.
Land Records in Pune: The Ferfar, the 7/12 and the Property Card
Families who still hold a field in Haveli, Mulshi, Maval or Bhor, or a plot with an old City Survey number, deal with a different kind of record altogether. The mechanics are set by the Maharashtra Land Revenue Code, 1966 and the record of rights rules framed under it.
How a succession Ferfar runs
The Code expects a person who acquires a right by succession to report it to the Talathi within a stated period, which is three months. In practice many families report much later, and the Talathi will still take the report. The Talathi opens a mutation entry in the register of mutations, posts a copy of the entry at the village chavdi, and sends written intimation to persons who appear to be interested. The entry then waits through the objection period, which is usually a fortnight. A revenue officer, typically the Circle Officer, certifies it if nobody objects. A digital 7/12 reflecting the new names is then available from the state land records portal.
If someone objects
A disputed entry is taken to a hearing, usually before the Tehsildar. Appeals can lead upward through the Sub-Divisional Officer, the Collector and the Divisional Commissioner at Pune, but none of them decides who owns the land. That is for a civil court.
Read the old extract first
Many 7/12 sheets still show a grandparent as owner, a different spelling of the deceased's name, tenancy remarks, or a crop loan recorded in the other-rights column. Each item needs an explanation or a clearance. Small shared plots can also be held in recorded shares, and Maharashtra's fragmentation law can limit how a very small holding is divided among heirs, so do not assume a field can be split as the family pleases.
The property card
Where land has been surveyed under City Survey, the property card is the ownership register, and it is changed by its own application at the City Survey Office. Some properties therefore need three updates: the property card, the tax register and the society or association records. Doing only one leaves the others pointing at the deceased.
When one heir keeps the land
A sibling in Pune may wish to retain a field while another steps aside. A registered release deed, followed by a Ferfar, is the usual route. A heir who signs abroad follows the same path as other overseas papers, and our guide on registering a release deed from abroad covers the steps.
A Realistic Timeline for Pune Mutation, in Soft Ranges
Honest timelines in Pune depend more on the family than on the offices. When every heir is reachable and agrees, entries can move at a steady pace. When a signature is missing, the whole file waits. Here is how the stages usually unfold, with ranges kept deliberately soft.
Gathering papers: a few weeks
The death certificate is usually quick, the 7/12 or property card extract is available online, and the tax receipts are easy. Slower items are an old registered deed, a share certificate that was misplaced, and proof of who the heirs are.
Agreeing the heirs and shares: from an afternoon to many months
It depends on whether everyone sees the same list. Disagreement here is the biggest single cause of delay.
Filing and notice: a few weeks
The Ferfar entry runs through its statutory objection period, a fortnight in the usual case, then waits for certification by the revenue officer.
Society resolution: a few weeks to a couple of months
Committees meet on their own calendar, and some wait for a general body meeting.
Corporation or Board tax name: a few weeks to a couple of months
Faster when the society's resolution and the heirship papers are in order, slower when the ward office raises queries.
A dispute: several months, sometimes years
A revenue hearing, a co-operative court matter or a civil suit follows its own pace.
Things that shorten the path: names spelled the same on every document, a clear list of heirs, written consent from heirs who are not applying, and a clean 7/12 or card without pending remarks. Things that lengthen it: an incomplete chain, a missing heir, loans recorded against the property, or a society that is already in dispute with the owner.
Our general guide, the timeline for property mutation after death in India, compares how the stages run across states, and Pune follows the Maharashtra pattern described above.
Common Mutation Mistakes in Pune, and How to Avoid Them
Most delays in Pune come from a short list of avoidable slips. A short check before filing saves weeks.
Applying to the wrong body
The postal line says Pune for PMC, PCMC and cantonment addresses alike. Check the heading on the tax bill, not the address line.
Leaving an heir off the list
Daughters have equal shares under Hindu succession law, and the children of a predeceased heir step into that heir's place. A list that omits someone invites a later objection, and a buyer's lawyer will notice.
Treating the nominee as sole owner
A nomination lets the society hold a flat for the heirs; it does not decide who owns what among them.
Name mismatches
Marathi names can run first name, father's name, surname, and a passport may drop the middle name that the 7/12 or Aadhaar carries. A transliteration can also change a surname. An affidavit saying that two names belong to one person is the usual fix, but aligning them early is cleaner.
Ignoring the notice
Notices go to persons shown in the record, often at old addresses. A missed hearing can mean an order passed in your absence.
Skipping the old 7/12 entries
A grandfather still shown as owner, a loan, or a tenancy remark must be explained before the current entry can be certified.
Expecting mutation to divide the property
A succession entry shows heirs as co-holders. Giving the property to one heir needs a registered release deed, and giving a defined share needs a partition document.
Waiting for a sale
Heirs often discover the gap only when a buyer's advocate asks for the chain of names. Fixing it then takes the same effort, plus time pressure.
If one of the heirs refuses to sign, read what happens when one legal heir refuses to sign the release deed before taking a position within the family.

From the First Application to a Clean Record: Eight Steps for a Pune Property
The order matters, because each Pune office tends to ask to see what the previous one has already accepted.
Identify every record that carries the name
We list the flat, house, plot or field, and the register behind each: PMC, PCMC or cantonment tax roll, 7/12, property card, society register. Many files reveal a second or third record that nobody had noticed, and each needs its own application.
Gather the death certificate and proof of heirs
Certified death certificates come from the body where the death occurred. Proof of heirs is a legal heir or heirship certificate where one is needed, or a signed affidavit listing all heirs, depending on what each office accepts.
Settle the heirs' list and the way ahead
All heirs agree in writing who they are and whether anyone will hold alone. If one heir will keep the property, a registered release deed is drafted before the records are touched. Otherwise the entry shows all heirs as co-holders.
Report the death on the land record
For land, the heirs report the succession to the village Talathi, who opens a mutation entry. We prepare the report, the death certificate, the heirs' list and the current extract so that the entry is not returned for missing papers.
Watch the notice and objection period
The entry is posted at the village chavdi and notified to interested persons, with a statutory objection period. We track dates, check that addresses on record are right, and prepare to appear if someone raises a point.
Move the society or association records
For a flat, the managing committee needs the application, death certificate, share certificate and consents from the other heirs. We follow the committee resolution, the entry in the share register and the reissue of the share certificate in the heirs' names.
Change the municipal or cantonment tax name
With the society resolution and heirship papers, the application goes to the PMC or PCMC tax department, the Cantonment Board or the gram panchayat. We check the receipt shows the new names and that no old arrears block the entry.
Update the property card, utilities and lenders
Where City Survey applies, the property card is changed separately. Electricity, water and gas connections follow, and any lender is shown the new record. We hand over one file with every certified copy in the right order.

Book an assessmentPapers a Pune Mutation File Usually Needs
Offices differ on small points, such as how recent an extract must be or whether a notarised affidavit is needed in addition to a certificate. We ask the specific office before filing, then prepare one consistent set, so the same papers can be used again for the next record in line.
From the family
- Certified death certificate of the owner, from the PMC, PCMC, Cantonment Board or council where the death was recorded
- Aadhaar, PAN and address proof for each heir who is applying
- Proof of who the heirs are: a heirship or legal heir certificate, or a notarised affidavit listing every heir with relationships
- Registered Will, with probate or other court order where an institution insists on one
- Written consent or no-objection letters from heirs who are not applying
- A registered release deed, if one heir is to hold the property alone
From Pune offices and records
- Current 7/12 and 8A extracts for land, or the property card for City Survey property
- Latest property tax receipt and assessment extract from PMC, PCMC, the Cantonment Board or the gram panchayat
- Registered title deed with its Index II entry from the Sub-Registrar office, or the conveyance in a society flat
- Society share certificate, membership record, nomination form and no-dues letter
- Encumbrance details from the Sub-Registrar records, to show whether a loan is recorded
- Recent electricity or water bill in the owner's name, to help the offices tie the property to the record
Why Pune Families Hand Mutation to PropResolve
- Records, not just forms. We map the property to the right Pune body first, so the filing goes to the register that actually holds the name.
- Heirs who live apart. Siblings in Pune, Pimpri or abroad sign once, and one coordinated file serves each office in turn.
- Honest about what mutation cannot do. We say plainly when a release deed, a partition or a court order is the real answer, so no one relies on a tax record for ownership.
