How Does an Overseas Heir Take Over a Pune Property After a Death?

Short answer

Title does not shift by itself. The heirs prove who they are, and then each record that still carries the deceased's name is changed: the society or association, the PMC, PCMC or Cantonment tax roll, the Property Card or 7/12, and, for a sale or a hand-over among heirs, a registered deed. From abroad this runs through a power of attorney signed before a notary, authenticated, and stamped in Maharashtra within three months of first receipt. Pune never fell under the old Section 213 probate rule, so probate is not compulsory by statute, although some institutions still ask for it.

  • Abroad: one signing session for the power of attorney, affidavits and consents, authenticated and couriered
  • Stamping: Maharashtra Stamp Act section 18, within three months of first receipt in Maharashtra
  • Pune records: society or association, PMC, PCMC or Cantonment tax roll, Property Card or 7/12
  • Money: sale proceeds to an NRO account, TDS under Section 393(2), then repatriation with Forms 145 and 146

Which Transfer Route Fits Your Pune Property and Your Situation?

A single estate can need several routes at once. Find the row that matches the asset you are dealing with, then read the sections below for the paper each office expects. Where a row says confirm, the answer depends on the specific office or society.

SituationRoutePune office or authorityWhat sets the pace
Flat in a co-operative housing society, for example in Kothrud, Aundh or Deccan, and the heirs live abroadSociety transmission
The committee admits the heirs as members and reissues the share certificate; the tax roll follows.
Managing committee, then the ward office of PMC or PCMCThe date of the next committee meeting and whether every heir's consent arrives in one set
Flat in an apartment complex such as in Baner, Kharadi or Wakad, with its own registered deedHeirs' proof, then deed if shares are fixed
Title already rests in a registered deed, so the heirs show their entitlement and record it with the association and the tax office.
Association, tax office, and the Sub-Registrar if the heirs formalise their sharesWhether the heirs agree on who keeps the flat
Heirs want to sell the inherited flat or plot to a buyerSale deed by all heirs
Every heir signs or is represented by an attorney; the buyer deducts TDS under Section 393(2) unless a lower certificate is in hand.
Sub-Registrar for the area, buyer's bank, a chartered accountantThe lower deduction certificate and the society's no-objection letter
One heir abroad wants to step aside in favour of a sibling who lives in PuneRegistered release deed
Signed abroad or through a recognised attorney, stamped under Maharashtra law, and registered.
Sub-Registrar of the area where the property liesAuthentication abroad and the stamping window
Farm land or a village plot in Mulshi, Haveli, Bhor or MavalMutation entry on the 7/12
The Talathi records the heirs after notice, and a revenue officer certifies the entry.
Talathi, Circle Officer, Tehsildar if someone objectsThe objection period and the completeness of the old extract
Leasehold or special-tenure holding, for example a former Pradhikaran plot, an MIDC unit, an MHADA flat or land in a CantonmentAuthority-specific transfer
The granting authority keeps its own register and often its own consent step, so confirm its checklist first.
PMRDA, MIDC, MHADA Pune Board or the Cantonment Board concernedHow quickly the authority responds and whether lease terms restrict the transfer

Rows often combine. A typical overseas family has a flat in the municipal area, a bank balance and a share in a village plot, and each needs its own sequence. We plan them together so one properly stamped power of attorney serves every office, instead of asking you to sign again.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

Who Keeps Which Record on a Pune Property: The Authority Map

An heir overseas often pictures one transfer. In Pune the same inheritance is spread across several record-keepers, and each expects its own application. Sorting the property into the right bucket before anything is signed saves a second round of signatures from you.

Municipal bodies

Addresses in Kothrud, Baner, Aundh, Viman Nagar, Hadapsar and the central peths come under the Pune Municipal Corporation, whose property-tax department holds the assessment that carries the owner's name. Pimpri, Chinchwad, Akurdi, Nigdi and Wakad sit with the Pimpri Chinchwad Municipal Corporation, which runs a separate roll. Both corporations usually work through ward or zonal offices, so the application tends to go to the office for the ward rather than to a central counter. A corporation changes a name only when shown a basis for it: the society's resolution or a registered deed, together with proof of heirship.

Cantonments

Camp, Khadki and Dehu Road have their own Boards and their own tax registers. A name change there is a separate application, and some Board services, including tax-register mutation, can be started on the eChhawani portal. Holdings on old-grant or defence-managed land may also need papers from the Defence Estates office. Because the civilian parts of some cantonments have been discussed for merger into the corporations, check the position on the day instead of relying on an older bill.

The fringe

Hinjewadi, Maan, Marunji and several villages around the city fall inside the planning area of the Pune Metropolitan Region Development Authority (PMRDA), which approves layouts and building permissions, while the tax record may sit with a gram panchayat or the nearest corporation. A family that says the property is in Pune may therefore be pointing at three different authorities. The tax bill, not the postal address, tells you which one.

Revenue and survey records

Urban plots under city survey have a Property Card at the City Survey Office, and village land has a 7/12 extract kept by the Talathi and updated through a mutation entry, called a Ferfar. Many flats stand on land whose Property Card or 7/12 is in the society's or builder's name, which means an heir's own name may never need to appear there. Overseas families often ask why no revenue entry is needed for a flat, and this is why.

Registration records

Deeds are registered with the Sub-Registrar who covers the area where the property lies. Pune district has a series of numbered Haveli and Pune City sub-registrar offices, and the state registration department's portal shows which one covers a particular village or peth. The same portal lets you search Index II extracts, the register of earlier deeds, which is the quickest way to see how the deceased acquired the property and whether any mortgage or earlier transfer sits on the record.

The society or association

In a co-operative housing society the managing committee is the first gate. It passes a resolution admitting the heirs, or a nominee, who is generally treated as holding for all heirs rather than as the sole owner, and it issues a fresh share certificate. Expect it to ask for the death certificate, the old share certificate, the heirs' consents or a sworn list of heirs, and sometimes an indemnity bond. Ask for its checklist in writing, because requirements differ from one society to the next. In an apartment complex where each flat has its own registered deed and an association looks after common areas, there is no share certificate to move: the association updates its register on proof of entitlement, and any later split of ownership among the heirs is done by registered deed.

Under-construction homes

If the parent held only an allotment letter or an agreement for sale in a project registered with MahaRERA, the developer's consent to substitute the heirs is the first requirement, and the developer's own transfer procedure applies. Keep every receipt and demand letter, since these are the only proof of what was paid.

The Power of Attorney That Pune Offices Will Actually Accept

For an heir abroad, the power of attorney is the document that lets a person in Pune walk into the society office, the ward office and the Sub-Registrar on your behalf. Most delays trace back to how it was drafted, signed or stamped. Our wider guide on powers of attorney for NRIs covers the basics; the points below are the Maharashtra and Pune ones.

Scope

Use a special power that names the property by its flat number, society, survey or CTS number, and lists the acts allowed: applying to the society, changing the tax roll, filing a mutation entry, signing and presenting a release deed or sale deed, receiving sale proceeds into your NRO account, and appearing before offices. A sale authority should be written in expressly. Broad general wording tends to draw questions from a buyer's lawyer or a sub-registrar. Keep the document revocable and avoid language that suggests the attorney paid for the authority, because Maharashtra stamp treatment can change for a power that is irrevocable or given for consideration. Confirm the applicable Article on the state stamp portal before drafting.

Signing and authentication abroad

You sign before a notary or an equivalent officer where you live. If your country belongs to the Hague Apostille Convention, such as the United States, the United Kingdom, Singapore or Australia, the notarised paper is apostilled by the competent authority there. Canada acceded in 2024, so check how its authentication currently works. If the document is signed in the UAE, it is not an apostille matter: it goes to the Indian Embassy in Abu Dhabi or the Indian Consulate in Dubai for attestation, and the same attestation route applies in Germany, which objected to India joining the Convention. Ask the notary to sign two or three identical originals, since the society, the corporation and the Sub-Registrar may each want to see one.

Recognition for registration

Under the Registration Act, 1908, a power executed outside India before a notary and authenticated in that way is among those recognised for presenting a document for registration, which is why many sub-registrars accept a foreign-signed power without a separate registration in India. Practice differs by office and by the type of deed, so we confirm the current approach with the relevant office before the final set is signed.

The Maharashtra stamping clock

Under section 18 of the Maharashtra Stamp Act, a paper executed outside the state can be stamped within three months after it is first received in Maharashtra. The clock starts on arrival, not on the date of signing, so the courier receipt is evidence worth keeping. The duty depends on the Article that fits the power and on the authority it grants; the state's online payment system and its stamp portal show how it is worked out. Do not leave the original in a drawer: stamp it as soon as it lands and note the date in the file.

A deed signed abroad is a separate matter

If you sign the release deed or sale deed itself overseas, section 26 of the Registration Act allows a document executed outside India to be presented within four months of reaching India, at the registering officer's discretion. In practice, many families avoid the issue by signing a power abroad and letting the attorney execute the deed in Pune.

When the power ends

It stops on the death of the person who signed it and can be withdrawn by a written revocation. If a co-heir who gave you authority dies, a new arrangement is needed. We note this in the plan so that no filing is signed under a lapsed authority.

Registered Deeds in Pune: Between Heirs, to a Buyer, and for Special Tenures

Succession itself does not need a registered deed. A deed becomes necessary when heirs formally divide the property, when one heir gives up a share, or when the property is sold. At that point the Registration Act and the Maharashtra Stamp Act apply to the family exactly as to any owner.

How the deed is built

The draft starts from the chain of title: how the deceased acquired the property, the death, the heirship or Will, and the heirs' present names. Stamp duty is worked out on the instrument type and, for a sale, generally on the higher of the agreed consideration and the government's Ready Reckoner value; the state portal is the place to confirm the current method, because this page does not state rates. After the stamp is paid, the document is lodged on the registration department's online system and an appointment is fixed at the Sub-Registrar for the area. The signatories and witnesses usually give photographs and fingerprints at the office. An attorney appearing for an heir abroad does so under the recognised power.

Selling inherited property

A buyer's lawyer will trace the title back through Index II and ask why each heir's signature is, or is not, on the deed. Most buyers also want the society or tax office to have recorded the heirs before the sale, because a transfer on top of an unrecorded succession invites later queries. The sensible order is therefore heirship proof, then society or tax-roll entry, then sale, with the buyer's TDS and your lower deduction certificate settled before the final payment. Our guide to the property transfer process without a will explains the family-side sequence, and the one on transfer when the owner left a will covers that case.

Giving up a share

A brother in Dubai who wants his sister in Pune to keep the flat usually signs a release deed. It must be registered, and the stamp treatment depends on Maharashtra law and on the relationship between the parties, so check the portal instead of assuming. A separate guide explains how an NRI registers a release deed from abroad.

Special tenures that change the checklist

Several Pune holdings are not ordinary outright-ownership property. Plots allotted by the former Pimpri Chinchwad New Town Development Authority, whose functions were folded into PMRDA, usually come with lease conditions and a transfer permission. Industrial plots in MIDC areas are held on lease from MIDC, which keeps its own approval step. Flats allotted by the MHADA Pune Board follow that Board's procedure for heirs. Plots in layouts regularised under the state's Gunthewari law need their regularisation papers in order. A house on defence-managed or old-grant land in a Cantonment may involve the Defence Estates office. For every one of these, the granting authority's own checklist comes first, and a registered deed alone may not be enough.

Farm land

For land on a 7/12, the Ferfar entry records the heirs after notice, and a later sale must respect the rules on who may buy agricultural land in Maharashtra. An NRI or OCI heir can inherit such land, but a later transfer is generally limited to a resident Indian citizen, and the state's tenancy and land laws can narrow the buyer pool further.

FEMA, Repatriation and TDS Under Section 393(2) in Brief

Receiving property by inheritance is the easy part. The tax and exchange-control questions begin when the property is sold and the money has to leave India. This is a short orientation, and your chartered accountant should confirm the details for your year.

Inheriting

A person resident outside India, including an NRI or OCI holder, may hold immovable property in India that came by inheritance, and no RBI approval is needed for that. This includes agricultural land, which an NRI or OCI cannot buy but can inherit. India has no inheritance tax, so receiving the property does not create a tax bill. If it is sold later, capital gains are calculated using the previous owner's acquisition value and holding period.

Selling

Residential and commercial property can generally be sold to a resident or to another NRI or OCI holder. Agricultural land generally goes only to a resident Indian citizen. Sale money is credited to your NRO account first.

TDS

From 1 April 2026 the Income-tax Act, 2025 governs, and tax deducted by a buyer on a payment to a non-resident is dealt with in Section 393(2), which replaces the old Section 195. The deduction generally applies to the whole sale consideration, not only the gain, unless the Assessing Officer has issued a lower or nil deduction certificate on Form 128, which replaces Form 13. The buyer needs a TAN to deduct and deposit the tax, so mention this early to the buyer's side. Apply for the certificate before the sale closes, since the buyer deducts at the time of each payment. Read our guide to TDS on sale of inherited property by an NRI for the detail.

Sending money abroad

Remittance from the NRO account is allowed up to USD 1 million per financial year, and the bank usually asks for the sale deed, evidence of inheritance, proof that tax was paid, Form 145 (the old Form 15CA) and a chartered accountant's certificate on Form 146 (the old Form 15CB). Larger sums or unusual cases need separate permission, so give your accountant the full picture early. The page on FEMA rules for NRIs selling inherited property goes further.

Your own country

Many countries tax or require reporting of foreign property, gains and bank accounts. Take advice there as well, because the Indian side is only half of the picture.

How the Work Usually Unfolds, in Realistic Ranges

Nobody can honestly promise a fixed date, because several offices and a courier move at their own pace. The ranges below show the usual order and where the waiting happens.

The first few weeks: planning and papers

Mapping each asset to its office, collecting the death certificate and old title papers, checking name spellings, and drafting the set for signing. This stage is quick when family in Pune can fetch documents while you gather yours.

A few more weeks: signing and authentication abroad

The notary visit is simple, but apostille or consulate attestation is where queues build, and the UAE and German routes through an Indian mission usually take longer than a Hague apostille.

Soon after arrival: stamping

The original is stamped in Maharashtra inside the three-month window, so this step is short but must not be forgotten.

Several weeks: society and tax-office entries

A society can only act when its managing committee meets, so the calendar of the committee often matters more than the paperwork. A corporation or Cantonment Board then updates its roll, and timing varies from office to office.

Weeks to months: heirship papers where needed

A revenue authority's heirship certificate usually takes weeks, while a civil court's succession certificate or a Will route takes months because of notice. Not every property needs this stage, and we only start it when an institution requires it.

A few weeks: registration

After stamp payment, the online lodging and the Sub-Registrar's appointment slots decide the pace.

Weeks again: sale and money

The lower deduction certificate adds a wait, and remittance follows once the funds are in the NRO account and the tax records are in order.

Taken together, a clean society flat with agreeing heirs can take a few months, and a matter with a farm land entry, a court route or a lease consent can take well over that. We give you a likely sequence at the first assessment and update it as each office responds.

Mistakes That Hold Up Pune Transfers for Heirs Abroad

These are the problems we see repeated. Each one is avoidable if the plan is checked before the original papers are signed.

Missing the stamping window

A power of attorney signed abroad sits unstamped after the courier delivers it, and the three-month limit under section 18 passes. Record the arrival date and stamp promptly.

Using a general power for a property job

Offices and buyers want the property and the exact acts named. A general paper invites a second signing round.

Signing before the office map is known

If the family assumes a PMC address and the flat is under PCMC, or if the land is in Mulshi instead of Haveli, the wording and the offices differ. Confirm first.

Name mismatch

A passport may omit a middle name that the Aadhaar, the share certificate and the tax roll carry. Align the names or prepare an affidavit that one and the same person is meant.

Treating a nomination as ownership

A nominee is generally seen as holding for all heirs. Siblings and a surviving spouse keep their legal rights.

Selling before the society or tax office records the heirs

This invites buyer queries and can stall the closing.

Skipping the lower deduction certificate

Without it, the buyer generally deducts tax on the whole consideration, which locks up cash that you may later reclaim only by filing a return.

Forgetting the NRO route

Money that lands in the wrong account or without the right forms can hold up remittance.

Assuming farm land can go to any buyer

Agricultural land generally goes only to a resident Indian citizen, and state land laws narrow the field further.

Listing the wrong countries for apostille

The UAE and Germany use the Indian mission attestation route, not an apostille.

If one of these has already happened, tell us at the first call. Most are fixable, but the earlier the better.

Related Guides and Services

These pages cover neighbouring questions that often come up for an overseas heir with Pune property.

From Signing Abroad to a Recorded Pune Title: Eight Steps

You sign once overseas, and the work in Pune follows in a set order so that no office is approached before the one it depends on.

1

Map the property

We list each asset, its authority and its record: society or association, PMC, PCMC or Cantonment roll, Property Card or 7/12, and any lease or MIDC or MHADA link. That tells us which offices to approach and in what order.

2

Settle the heirship proof

We confirm what each institution will accept as proof of who the heirs are: a revenue authority's heirship certificate, a court certificate or a Will route. Probate is not compulsory by statute, so we only start a court step when an institution requires it.

3

Draft one set to sign

You receive a special power of attorney, a heirship affidavit and any consent or release, drafted around Pune offices and the Sub-Registrar's expectations. A draft goes to you first so the notary abroad sees the exact wording.

4

Authenticate and send

You sign before a notary, then the paper is apostilled or attested by the Indian mission, depending on the country. We track the courier, record the date of first receipt in Maharashtra, and scan each page on arrival for the file.

5

Stamp inside the window

The original is stamped in Maharashtra within three months of first receipt under section 18 of the Maharashtra Stamp Act. The duty depends on the Article and the powers given, and we pay it through the state's online system.

6

Society and tax-roll entries

The Pune advocate approaches the society or association, then the ward office of PMC, PCMC or the Cantonment Board, and files the Ferfar entry for any land. Each office is asked what it wants in writing, so nothing is rejected on a technicality.

7

Registered deed, if needed

If the heirs formalise shares, an heir steps aside, or the property is sold, the deed is stamped and registered at the Sub-Registrar of the area. An attorney appears for an heir abroad under the recognised power.

8

Close the money side

If the property is sold, we coordinate the lower deduction certificate, the buyer's TDS under Section 393(2), the NRO credit and remittance with Forms 145 and 146, so the proceeds can leave India in an orderly way.

Papers for a Pune Transfer: What You Sign and What Offices Hold

Keep one folder of scans in which every name reads the same way. A passport that omits a middle name, or a share certificate in a spouse's name, is the usual trigger for queries. Send us the set early so mismatches are fixed before any notary signs.

Why Overseas Heirs Hand Their Pune Transfers to Propresolve

  • A power of attorney built for Maharashtra. It is drafted with the Maharashtra stamping window and the sub-registrar's expectations in mind, so the deadline is tracked and not left to chance.
  • One plan across every office. The society, the corporation, the revenue office and the Sub-Registrar are sequenced together, so each filing reuses the same signed papers.
  • Money and tax kept in view. Section 393(2) deduction, the lower certificate and remittance paperwork are planned before a sale, not after the buyer has already deducted.

Frequently Asked Questions

Do I have to come to Pune to transfer a property I inherited?

+
Usually not, when the heirs agree. You sign a special power of attorney and affidavits before a notary abroad, and a Pune advocate handles the society, the tax office and the Sub-Registrar in person. Attendance may become necessary if a relative disputes the claim, if an office insists on seeing you, or if you decide to sign a registered deed yourself. We flag that at the first assessment so that you can plan ahead and not discover it midway.

What does the three-month stamping rule mean for a power of attorney signed abroad?

+
Under section 18 of the Maharashtra Stamp Act, a paper executed outside the state can be stamped within three months after it is first received in Maharashtra. The period starts when the original arrives, not when you sign. Keep the courier proof, stamp the paper as soon as it lands, and note the date in the file. The duty depends on the Article and the powers given, so check the state stamp portal.

Does my power of attorney also have to be registered in India?

+
Often not. A power executed outside India before a notary and authenticated in that way is among those recognised for presenting a document for registration under the Registration Act, 1908, so many sub-registrars accept it as it is. Practice differs by office and by the deed, and some offices ask to see the apostilled or attested original. We confirm the present approach with the relevant office before the final set is signed, so nothing needs a second signature.

Can my Pune representative sell the flat on my behalf?

+
Only if the power says so expressly. A special power should name the flat or plot and list the sale, the signing and registration of the deed and the receipt of proceeds into your NRO account. Broad wording is often queried. Keep it revocable and read the stamp treatment for the Article that fits, because Maharashtra can treat a power given for consideration differently. We also suggest stating who may sign the TDS and remittance forms.

Is probate compulsory for a Pune property if my parent left a Will?

+
Not by statute. Section 213 of the Indian Succession Act applied only to Wills of Hindus, Buddhists, Sikhs and Jains tied to the old presidency towns, and Pune never fell under it. The Repealing and Amending Act, 2025 has since removed that section. Some banks, depositories or buyers may still ask for probate as their own practice, so we check each institution first and plan the court step only where it is actually required.

Which office changes the owner's name on the tax bill?

+
It depends on where the property sits. The Pune Municipal Corporation records flats and houses in its area, the Pimpri Chinchwad Municipal Corporation does the same for Pimpri, Chinchwad and Wakad, and Cantonment Boards handle Camp, Khadki and Dehu Road. The application is normally made at the ward office or the Board's office with the society's resolution or registered deed and proof of heirship. Always read the tax bill, not the postal line, to find the correct office.

Does a society have to admit me as a member after my parent dies?

+
A co-operative society acts through its managing committee and usually admits the legal heirs, or a nominee who is generally treated as holding for all heirs, once it receives the death certificate, the share certificate and the heirs' consents. Expect questions if heirs disagree or a loan is outstanding. The society's meeting calendar often sets the pace. Ask for its checklist in writing so the heirs' papers match it in one go.

We are three heirs in three countries. Does each of us sign the same set?

+
Usually each heir signs an identical power and affidavit before a notary where that heir lives, and the authentication route depends on the country. One heir in the UAE may use consular attestation while another in the United States uses an apostille. We prepare the same wording for all, track each courier date separately because each paper has its own stamping window, and then file them together.

If I step aside in favour of my sister, does that need a registered deed?

+
Yes. An heir who gives up a share in immovable property normally does so by a release deed, which must be registered, and Maharashtra law decides the stamp treatment. You can sign abroad and have the deed presented by an attorney, or sign the deed overseas and present it within the period allowed by section 26 of the Registration Act at the registering officer's discretion. A signed consent letter alone will not record the change.

What will a buyer deduct if I later sell the inherited flat?

+
A buyer paying a non-resident must deduct tax under Section 393(2) of the Income-tax Act, 2025 from 1 April 2026, which replaces Section 195, and it generally applies to the whole consideration unless a lower or nil certificate on Form 128 is in hand. Apply before the sale closes. The buyer also needs a TAN to deduct and deposit the tax. Your accountant can then match the deduction against your actual gain and your return.

How do I bring the sale money abroad?

+
The proceeds are credited to your NRO account first. You can then remit up to USD 1 million per financial year, and the bank will ask for the sale deed, evidence of inheritance, proof that tax was paid, Form 145 and a chartered accountant's Form 146. Larger or unusual cases may need the Reserve Bank's permission. Keep every paper from the transfer in one folder, because the bank will ask to see how you came to own the property.

As an OCI holder, can I inherit and sell my father's plot in Mulshi?

+
You can inherit it, because an OCI or NRI is allowed to hold agricultural land received by inheritance even though he or she cannot buy it. The Ferfar entry records the heirs on the 7/12. A later sale is generally limited to a resident Indian citizen, and Maharashtra's tenancy and land laws can narrow the buyers further, so settle the record first and plan any sale with a lawyer.

How is this service different from the legal heir certificate page?

+
The legal heir certificate service is about getting the heirship document. This one starts after that, or alongside it, and covers the movement of the asset: the stamped power of attorney, the society and tax-office entries, the registered deed, the sale and the repatriation. Many Pune families need both, so we plan the heirship paper and the transfer together and use the same signed set wherever possible.
