Does a Will Still Mean Probate in Kolkata? The Short Answer

Short answer

Probate is not compulsory by statute now. Section 213 of the Indian Succession Act, the provision that long tied many Hindu, Buddhist, Sikh and Jain Wills in Calcutta to a court grant, was removed in December 2025. Some banks, registrars and lease offices may still ask for probate, so the executor should ask each office what it will accept before filing anything. Property transfer with a will in Kolkata therefore runs on two tracks: proving the Will where an office wants proof, and recording the new owners in the municipal or land register.

  • Old rule: Section 213 tied certain Calcutta Wills to probate; the Repealing and Amending Act, 2025 removed it.
  • Court, if needed: The Calcutta High Court's original side, or whichever civil court has jurisdiction over the address.
  • Records: KMC assessment mutation inside the city; other bodies for Salt Lake, New Town, Howrah and panchayat land.
  • Pause points: A caveat in court, or a written objection from a relative, can slow a grant or a mutation.

Which Route Fits Your Will: Direct Mutation, a Probate Petition or Both?

The table pairs six common Kolkata situations with the route usually taken. Read the row nearest to yours. Offices differ and practice moves, so treat each row as a starting position that an advocate then checks against the office concerned.

Your situationWhat you doOffice or authorityTypical time
Executor named, every beneficiary agrees, flat sits inside a KMC ward, and no institution has asked for a court grantDirect mutation
Apply for assessment mutation with the Will, the death certificate and the title papers. Keep a probate petition ready in case a query comes back.
Assessment Department of KMC, routed via the borough or ward officeA few weeks to a couple of months, depending on hearings and queries
A bank, registrar or lease office says it will act on the Will only after a court grantProbate petition
File a petition for probate with the original Will, the death certificate and the witness details. Notice goes out and anyone with a claim may appear.
Calcutta High Court original side, or the civil court with jurisdictionSeveral months, since notice and listing are part of the process
The Will names no executor, or the named executor has died or will not actAdministration with the Will annexed
A beneficiary petitions for letters of administration with the Will annexed, so that someone has court authority to deal with the estate.
Same courts as for probate; the advocate confirms which one appliesSeveral months, longer if anyone objects
A plot in Salt Lake held on lease from the state passes under the WillLease mutation
The department has published separate formats for a probated Will and for a Will without probate. Ask which one it expects now.
Urban Development and Municipal Affairs Department, then Bidhannagar Municipal Corporation for assessmentVaries with the file; ask the department for its own estimate
Family land in a village or panchayat area outside the municipal limitsLand record mutation
Apply for mutation of the khatian so the record of rights shows the beneficiaries. Offices may ask how the Will is proved.
BL&LRO and Gram Panchayat, with the Banglarbhumi recordA few weeks to several months, depending on the office
A relative has filed a caveat or says the Will is forgedContested route
Probate then runs as a contested matter and evidence is led. Mutation usually waits for the outcome or for a settlement.
The High Court or the civil court that has the caseMany months, with no fixed pace

Time ranges are soft and describe uncontested files. A missing original Will, mismatched names or an unpaid property tax balance can move any row into the slower column, which is why the first call is about documents, not forms.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

How Section 213 Shaped Wills in Kolkata, and What the December 2025 Repeal Changed

Kolkata families grew up on a rule that families in Delhi, Pune or Bengaluru never met: a Will is not safe until a court has probated it. The rule came from Section 213 of the Indian Succession Act, 1925. It said that no right as executor or legatee could be established in a court of justice unless a competent court had granted probate, or letters of administration with the Will annexed.

For Wills of Hindus, Buddhists, Sikhs and Jains, the section was tied to the classes of Wills described in Section 57 of the same Act. In plain terms, that meant Wills connected with the old presidency towns, and Calcutta was one of them, alongside Bombay and Madras. Commentary differs on how far beyond the old town limits the reach went, for instance for land in the wider Bengal territory. For new matters that debate has stopped mattering, but it explains why older Kolkata advice sounds so firm.

What the repeal did

The Repealing and Amending Act, 2025 received assent on 20 December 2025 and omitted Section 213. A beneficiary no longer needs a probate order simply to be heard in court on a Will. Probate itself has not gone away. The Calcutta High Court still grants it, and the old testamentary jurisdiction of the High Court on its original side continues.

What the repeal did not do

It did not instruct banks, registrars or lease offices to change their forms overnight. The section spoke to courts, not to municipal counters, yet in practice assessment offices, registrars and depositories borrowed it as a safety net. Some now accept a Will with supporting papers. Others keep asking for a court grant until their own circulars change. The executor should ask in writing and keep the reply.

Cases already in court

If a probate petition was filed before the change, speak to the advocate on record about what the repeal means for that file. Do not assume it can be withdrawn without consequence, and do not assume it must be pursued either.

Other communities

Section 213 never applied to Wills of Muslims, and other personal laws have their own rules. A Muslim testator is generally limited in what a Will can give away without the other heirs' consent, so the Will has to be read against that limit. This page mostly assumes a Hindu testator unless it says otherwise.

Which Kolkata Office Handles Your Will-Based Transfer? The Authority and Record Map

A Kolkata postal address does not tell you who keeps the property record. Behind the same postcode there may be KMC, a separate municipality, a state-run lease authority or a gram panchayat, and each has its own register and its own way of reading a Will. The commonest early delay is an executor queuing at the wrong counter, so the map below comes before any form.

  • Inside the KMC limits (for example Ballygunge, Bhowanipore, Alipore, Tollygunge, Jadavpur, Behala, Park Circus, Shyambazar and Garden Reach). Kolkata Municipal Corporation keeps the assessment register, the register that decides who receives the property tax bill. Applications usually travel through the borough or ward office to the Assessment Department. A death that took place inside the city is registered with KMC's own birth and death registration unit.
  • Salt Lake (Bidhannagar Municipal Corporation). A large share of plots were allotted on lease by the state. Two records therefore need attention after a death: the lease register held by the Urban Development and Municipal Affairs Department, and the property-tax assessment kept by the municipal corporation.
  • New Town. The New Town Kolkata Development Authority runs this planned township. Check the deed first: a leased plot and an outright purchase are handled differently, and the authority can tell you which application form it expects from a Will beneficiary.
  • Neighbouring municipalities such as Dum Dum, Baranagar and Barasat. Each municipality runs its own assessment, so a KMC format does not apply. The executor applies to the municipality that bills the property.
  • Howrah. Across the river, Howrah is a different district. Its civic body, revenue office and court all sit apart from the Kolkata set, so a Howrah family should plan its filings locally.
  • Panchayat and rural areas. Here the Block Land and Land Reforms Officer, usually written BL&LRO, works with the Gram Panchayat on mutation of the khatian, and the state's Banglarbhumi portal displays the record of rights.

The registration side

A Will may be registered, but registration is optional. A registered Will is normally easier to prove. The Registrar of Assurances, Kolkata, may register documents for property anywhere in West Bengal, and district-level registrars cover their own areas. A Will kept in a sealed cover with a registrar can be produced after death on the registrar's own procedure, so ask that office how it works.

Courts

For Kolkata addresses, probate petitions go either to the Calcutta High Court's original side or to a civil court with jurisdiction, depending on the facts of the estate. Outside the city, the district judge for that area is the usual forum.

Housing bodies

Flats allotted by the West Bengal Housing Board, HIDCO or a cooperative society, and plots from the Calcutta Improvement Trust or the Kolkata Metropolitan Development Authority, may impose their own conditions on a transfer. The deed or allotment letter tells you which body must also be told.

A small trap catches many families. The certificate comes from the registrar for the place of death, and a hospital stay can put that in a different municipality from the family home. An uncle who lived in Tollygunge but passed away in a nursing home elsewhere may hold a certificate from that other body. Offices accept it, provided the Will and the title papers show where he actually lived.

KMC Mutation on a Will: What the Assessment Department Usually Looks At

Mutation records who is answerable for the property tax. It does not create title, and it does not replace the Will. A KMC assessment entry that carries the beneficiary's name is useful proof of possession and a requirement for many later steps, such as a sale, a home loan or a utility transfer.

The application

KMC documents describe the prescribed mutation form as Form A-42, which is filed with the supporting documents at the assessment office through the borough. Confirm the current form and whether your ward accepts the application online, because KMC has been moving property-tax services to its portal in stages.

What the office usually asks for with a Will

The death certificate, the Will, the title deed or deed of conveyance, the latest assessment bill with receipts, and identity and address proof for the applicant. Many officers also want evidence that tax dues are cleared, often through a no-outstanding-dues certificate. Where the Will could be questioned, a signed no-objection or a written consent from the other heirs makes the file easier to approve. Where probate has been obtained, attach the grant.

Hearing and inspection

Mutation files commonly involve a notice, a hearing for the applicant, and sometimes an inspection of the premises. Those steps exist to allow an objector to speak. Attend with the originals and an executor or beneficiary who can answer questions about the Will.

Several beneficiaries

If the Will leaves the property to more than one person, the assessment can show them as joint owners. Splitting the premises into separate assessments is a different application, and it usually follows a partition or a family arrangement that the Will itself does not carry out.

Flats and associations

Most newer flats in Kolkata are owned through a registered deed of conveyance under the West Bengal Apartment Ownership Act, 1972, with an owners' association looking after the common areas. The association does not decide who inherits, but it keeps its own register and may ask for dues to be cleared. Older buildings and some complexes are cooperative societies, where the member's share and allotment pass under the society's rules and the registrar's procedure. Share certificates, nomination forms and the society's bylaws matter more there than the municipal bill.

Electricity and other utilities

CESC supplies most of Kolkata. Moving the consumer name on the electricity connection is its own request with its own papers, normally made after mutation rather than before it.

Probate at the Calcutta High Court: When a Grant Helps, and How Caveats Work

Since December 2025 the question is no longer whether probate is required. The question is whether a grant will make the transfer smoother, safer or acceptable to a particular institution. A grant is a court order that the Will is genuine and that the executor may act under it. It is binding on everyone, which is why a probated Will is hard to challenge afterwards.

When a grant helps

A bank, a registrar, a lease authority or a buyer may insist on it. A relative may have hinted at a challenge. The Will may be old, unregistered, handwritten or poorly witnessed. The estate may include several properties and assets, and the executor wants one document that every office will respect. In these cases the petition is often worth the time.

When a grant may not be needed

Where every beneficiary agrees, the Will is clear and registered, and the municipal office accepts it, direct mutation often goes through without a petition. The executor should still keep the original Will safe, because a court may ask for it later.

The petition

The executor files a petition for probate, with the original Will, the death certificate and details of the estate, in the court that has jurisdiction. For a Kolkata estate, that is usually the original side of the Calcutta High Court or a civil court with jurisdiction, depending on the address and the estate. The petitioner and, where needed, the attesting witnesses are available to prove the Will. Notice of the petition is published so that anyone with a claim may come forward, and the court may call for the testator's family to be informed.

Letters of administration with the Will annexed

This is the route when no executor was named, or the named executor cannot act. A beneficiary applies, and the court authorises that person to administer the estate in line with the Will.

What a caveat is

A caveat is a notice lodged in the probate court by a person who expects to object to a grant. Under Section 284 of the Indian Succession Act, once a caveat is on the record, the court gives the caveator notice of the petition before proceeding. The caveator may then file an objection, and the matter generally turns into a contested case in which evidence is heard. A caveat does not by itself decide the Will, and it speaks to the court, not to KMC.

Objections outside court

A relative who wants to stop a mutation usually writes to the municipal office and may ask a civil court for an order. The executor should expect the office to hear both sides, and should keep all correspondence in writing and dated.

Administrator General

In some Kolkata estates, particularly where no suitable person can act, the Administrator General of West Bengal can be asked to administer. Whether that suits a family is a matter for the advocate.

Old Family Houses, Dayabhaga and Mistakes That Stall Kolkata Wills

A Will in a Bengali family often meets assumptions that do not appear on any form. Reading the Will against the property history is part of the work before any office is approached.

Dayabhaga and ancestral property

Bengal follows the Dayabhaga school of Hindu law, under which sons do not take a share by birth in the father's property. A father who holds property in his own right can therefore generally leave it by Will, even where the property came down from his own father. Families from other Hindu traditions may be in a different position, and the Hindu Succession Act, 1956 deals with a coparcenary share in its own way. Ask an advocate to look at any property that was never divided.

Debuttar and thakur bari

Property dedicated to a family deity is debuttar. It belongs to the deity, and the person who manages it is the shebait. A Will cannot give debuttar property away as if it were personal property. The shebaiti right follows its own line, set by the deed of dedication or by custom. If the family home includes a shrine room or a thakur dalan, check this before the Will is relied on.

The undivided bari

Old houses in North and Central Kolkata are often held by several branches, each with a fractional share. A Will can give the testator's share, but the Will cannot split the building. Mutation then shows shared ownership, and a partition deed comes later.

Tenants and thika land

Tenancies under the West Bengal Premises Tenancy Act, 1997, and thika tenancies in some bustee areas, are governed by their own laws. A Will can pass the landlord's rights, but it does not end a tenancy.

  • Assuming probate is needed, or is not needed, without asking the office that will act on the Will.
  • Handing over the original Will to an office instead of a certified copy, and then being unable to produce it in court.
  • Treating the Will as the finish line and never applying for mutation, so the property tax bill still carries the dead owner's name.
  • Leaving out a codicil or a later Will, which can change who the executor is.
  • Applying to KMC for a plot that sits in Salt Lake, New Town or Howrah.
  • Letting a part of the tax dues stay unpaid, which stops many mutation files.
  • Collecting a verbal assurance from a relative in place of a signed consent.
  • Forgetting a loan or lien on the property, which the lender may have to clear first.
  • Not reconciling name spellings between the Will, the death certificate and the tax bill, for example Chatterjee and Chattopadhyay.

A Realistic Timeline for a Will-Based Transfer in Kolkata

No honest timeline is exact, because the pace is set by offices and by the family. The ranges below are soft and describe uncontested files. They show which steps can run side by side.

Death certificate and certified copies

The death must be registered within 21 days of the death. After that, certified copies usually come in a few weeks.

Locating and checking the Will

A few weeks, mostly spent finding the original, the witnesses and any codicil, and reading the Will against the title papers.

Written answers from offices on probate

A few weeks. Start early, because the answer decides whether a petition is filed.

Probate petition, if filed

Several months at minimum, since notice is published and the matter is listed. A caveat or an objection can add many months.

KMC or municipal mutation

A few weeks to a couple of months where documents are complete. Missing dues or an unsigned consent can add weeks.

Lease mutation in Salt Lake or New Town

Depends on the file and on the department. Plan for several months and ask the office for its own estimate.

Association, society, CESC and bank records

A few weeks each, and they can run at the same time once mutation is in hand.

The parts that run in parallel save the most time. While probate is pending, the executor can still gather tax receipts, clear dues, collect consents and prepare the mutation file, so the application is ready the day the grant arrives.

Eight Steps From a Kolkata Will to a Clean Property Record

The order below keeps the court question and the municipal question moving together instead of one after the other.

1

Read the Will against the property

We check who the executor is, what each beneficiary receives, whether a codicil exists, and whether the Will treats the property as the testator's own. We also check the title, so a bequest of something the testator did not own is caught early.

2

Register the death and collect certified copies

A death should be registered within 21 days. Copies come from the KMC office or from the registrar for the place of death. We record both the place of death and the place of residence, since they may differ.

3

Secure the original Will and the witness details

The original must be traced, stored safely and never handed over casually. We list each attesting witness, any registration details, and the person who now holds the paper, because a court or office may ask for each of them.

4

Ask each office what it will accept

KMC, the bank, the registrar, any lease authority and the association each get a short written query on whether probate is needed. Their replies are kept on file. That evidence settles the probate question far better than guesswork.

5

Decide on a probate petition

If an office insists, or a relative is likely to object, the advocate prepares the petition for the right court. If nobody asks, the executor may skip it and rely on the Will with supporting papers. The decision is recorded with reasons.

6

Check for caveats and objections

The advocate looks for a caveat on the record and asks the family whether anyone has voiced a challenge. Where trouble is likely, the file is built for a hearing from the start, not repaired later.

7

File the mutation at the correct body

The application goes to KMC, Bidhannagar, NKDA, another municipality or the land office, according to the address. Dues are cleared first, consents are attached and the executor or a beneficiary attends any hearing.

8

Update the associations, utilities and family file

With mutation done, the owners' association or society, CESC and any lender are told. The family ends up with one file: Will, grant if any, mutation order, receipts and certified copies, ready for a sale or loan.

Documents for a Will-Based Transfer in Kolkata

No list is final. A ward office, a registrar or a lease department may ask for one more paper. Treat this as the opening set, and share photographs first so a name mismatch is fixed before any original leaves the family's hands.

From the family

  • The original Will and every codicil, kept safe, with names and addresses of the attesting witnesses
  • Identity and address proof of the executor and of each beneficiary
  • Certified copies of the death certificate
  • Signed consent or no-objection from the other heirs, where they are willing to give it
  • Marriage or birth papers where a beneficiary's link to the testator needs proof
  • A written list of the property, loans, liens and tenants

From Kolkata offices and records

  • Death certificate issued by KMC's registration unit for deaths in the city, or by the registrar of the place where the death occurred
  • Deed of conveyance, sale deed or lease deed for the property, with a certified copy from the registration office if the original is missing
  • Latest KMC assessment bill and receipts, plus a no-outstanding-dues certificate where the office asks
  • Owners' association dues clearance, or the cooperative society share certificate and allotment letter
  • CESC bill and meter details, showing the testator as consumer
  • Khatian or record of rights from Banglarbhumi for land outside municipal limits
  • Probate or letters of administration, if the court route was taken

Why Kolkata Families Ask Propresolve to Handle Will-Based Transfers

  • The probate question gets a recorded answer. Each office is asked in writing what it will accept, so the family never relies on a rumour about Section 213.
  • The address decides the route. KMC, Bidhannagar, New Town, Howrah and panchayat land are sorted out before a form is signed.
  • Disputes are planned for. Caveats, objecting relatives and old family-house shares are considered at the start, not discovered halfway.

Frequently Asked Questions

Is probate compulsory for a Will in Kolkata now?

+
No. Section 213 of the Indian Succession Act, which had made a court grant the gateway for many Hindu, Buddhist, Sikh and Jain Wills connected with Calcutta, was omitted by the Repealing and Amending Act, 2025. A beneficiary can now rely on the Will without a prior probate order. Probate is still available, and a bank, registrar or lease department may still ask for it, so the executor should ask each office in writing what it will accept before deciding.

Why was probate compulsory in Kolkata earlier?

+
Section 213 barred an executor or legatee from establishing rights in court without a grant. For Wills of Hindus, Buddhists, Sikhs and Jains it was tied to the classes of Wills described in Section 57, which connected it with the old presidency towns, including Calcutta. People in Delhi, Pune or Bengaluru were never in that position. Commentary differs on the exact territorial reach, which is one reason current advice depends on what offices accept, not on the old boundary.

Can KMC mutate a flat on a Will without probate?

+
Often it can, but practice varies by officer and by file. The assessment office usually looks at the death certificate, the Will, the title deed and clear tax receipts, and it may want consent from the other heirs where the Will could be questioned. If the office insists on a court grant, ask for that in writing, since the answer then decides whether a petition is needed. Mutation records who pays tax and does not create title.

Which court grants probate for a Kolkata property?

+
Usually the original side of the Calcutta High Court or a civil court with jurisdiction, depending on where the testator lived, where the property sits and the nature of the estate. For addresses outside the city, the district court covering that area is the normal forum. The advocate confirms the court before drafting, because the wrong forum wastes months. Notice of the petition is published so anyone with a claim may appear and object.

What is a caveat and should we file one?

+
A caveat is a notice lodged in the probate court by a person who expects to object to a grant. Under Section 284 of the Indian Succession Act, the caveator then gets notice of the petition before the court proceeds. An executor has no reason to file one. A beneficiary who fears that a relative will move first may consider it, but it speaks to the court, not to KMC, and it generally leads to a contested hearing.

Is an unregistered Will valid in West Bengal?

+
Yes, if it was properly made. A Will needs the testator's signature and attestation by two witnesses who each saw the signing, and registration is optional. The difficulty is proof, not validity. An unregistered Will is easier to attack on authenticity, so the executor should trace the witnesses early and keep the original safe. Where doubt exists, a probate petition can settle it for all offices.

Does a Will override a nomination on a flat or an account?

+
Not in a simple way. A nominee is generally the person an institution pays or recognises, and in most cases the nominee holds the asset for those entitled under the Will or the succession law. The institution may release the asset to the nominee, and the Will beneficiary then claims from the nominee. Practice differs between banks, societies and insurers, so ask each institution how it treats a Will and a nominee together.

Does a Will transfer a leasehold plot in Salt Lake?

+
The Will can pass the lessee's rights, but the lease is recorded with the state, so the lessee's name changes through the Urban Development and Municipal Affairs Department. The department has published separate formats for a probated Will and for a Will without probate. Since the repeal, ask which format it expects now. Bidhannagar Municipal Corporation then updates the assessment. Confirm each step with the office before filing.

The property is in Howrah or a district town. Where do we apply?

+
Not at KMC. Howrah has its own municipal corporation, collectorate and district court, and other towns have their own municipalities. Probate, if wanted, goes to the court that covers the address. For village land, mutation of the khatian is handled by the BL&LRO and the Gram Panchayat, with the Banglarbhumi portal carrying the record. Identify the billing body from the latest tax bill first.

What if the executor named in the Will has died or refuses to act?

+
Then a beneficiary can ask the court for letters of administration with the Will annexed, which gives that person authority to administer the estate in line with the Will. Where the Will names a substitute executor, that person may act instead. The advocate reads the clause carefully, since the wording decides who has standing. Offices will usually insist on the court's order before accepting a replacement.

Can a Will give away ancestral property in a Bengali family?

+
Frequently yes, because under the Dayabhaga school a father generally holds property in his own right, even if it came from his father. Families from other Hindu traditions may be in a different position, and the Hindu Succession Act, 1956 treats a coparcenary share in its own way. Property that was never divided needs a careful look at the history. An advocate should read the Will against that history before any office is approached.

Does a Will cover debuttar or thakur bari property?

+
No, not as personal property. Property dedicated to a family deity is debuttar and belongs to the deity, and the shebait manages it. The shebaiti right follows the deed of dedication or custom, not the ordinary rules for a Will. If the house has a shrine or a thakur dalan, the family should find the dedication papers early, because an office may ask for them before it acts on a Will.

The Will was made before December 2025 and probate is pending. What now?

+
The Will remains valid, since the repeal removed a procedural bar and not the Will. If a petition is already filed, speak to the advocate on record about what the change means for that file. The petition may still be useful where an office wants a grant or a relative is likely to object. Do not withdraw it on your own, and do not assume it must continue.

Do heirs who live abroad have to travel for a Will-based transfer?

+
Often not. Overseas family can sign consents and powers of attorney before a notary, with legalisation that depends on the country, and a local representative handles KMC and the court. The Will's original must still be produced in India if a court asks. Legalisation rules differ by country, so check before anything is signed. See the NRI property transfer page for the signing steps.
