A Kolkata Release Deed: What It Settles and What It Cannot

Short answer

Through a release deed, one heir permanently gives up an inherited undivided share of a Kolkata property to a person who already co-owns it. Registration is essential, at whichever Registrar of Assurances, DSR or ADSR office covers the premises. The deed creates no title that the heir lacked, and KMC records move only after a separate mutation. Probate is not compulsory by statute here: the old Section 213 rule for Kolkata Wills ended with its removal in December 2025, though some institutions still ask.

  • Deed: a registered deed of release, or relinquishment, signed by every co-heir who gives up a share
  • Office: the West Bengal registration office for the property, found through the portal's office locator and booked by e-appointment
  • Follow-on: KMC assessment mutation, or the Bidhannagar, NKDA or BL&LRO record, then the association and CESC
  • Court: no petition when all co-heirs agree; a partition suit comes into play only if someone declines to sign

Release, Settlement or Something Else: What Suits Your Kolkata Premises?

A release is not always the answer. Certain families need no deed whatever, while others are quietly planning a gift or a sale. Locate the row nearest to your own house or flat, and read the note beneath the table before raising the subject at home.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

What a Kolkata Release Deed Does, and What It Leaves Untouched

Where a Hindu owner dies without a Will, the 1956 succession statute usually puts the widow, sons, daughters and mother in the first class of heirs, with equal claims. So every one of them owns an undivided slice of the entire property, even if just one person lives there. Through a release deed, a co-heir lets go of a stated slice for the benefit of another co-heir, and the document is registered. West Bengal offices use release and relinquishment for the same idea, and what counts is the effect of the paper, not the title typed across the top.

Since the step is so hard to reverse, we devote more time to the weeks before signing than to the counter itself. The heir list, the exact share and the property description are agreed in writing, and each person who gives up a share is asked to say, in their own words, what they understand they are giving up.

  • Ends the signing heir's claim to the described share in the described premises, permanently, once it is registered.
  • Leaves the receiving heir with a bigger holding than before, which is why KMC and owners' associations accept it as a sound basis for updating what they hold.
  • Turns a spoken family understanding into a registered paper that a lender, a purchaser or a later court can read.
  • Can be confined to a single property, so one sibling may step aside from the Kolkata flat yet keep an interest in the family house elsewhere.
  • May be drawn with or without a payment between the parties, though money changes how the office reads it, as explained in the stamp section below.
  • It cannot manufacture ownership that the signing heir never possessed. If the deceased owner's own title was flawed, the flaw travels with the deed.
  • It is no route for giving a share to a person who is not yet a co-owner. That is a gift or a sale, and the stamp and tax outcomes differ.
  • It binds only those who sign. A grandchild whose parent died earlier keeps a share unless that grandchild releases too.
  • It does not alter the KMC assessment register, the CESC connection or the association's records on its own. Each needs a separate application.
  • It does not remove a tenant, cancel a loan secured on the premises or clear municipal dues.
  • Once registered it is hard to undo. A change of heart is not a ground, whereas proof of coercion, impersonation or a forged signature may be.

The Kolkata Office and Record Map for a Release Deed

Four kinds of body touch a release deed in this city: the registration department that registers it, the local body that keeps the tax record, the authority behind the land or lease, and the building's own association. Which of them apply depends on the address, and a Kolkata postal address can sit under any of several.

Registration

The Directorate of Registration and Stamp Revenue, West Bengal, runs the registration offices. In and around the city the work is shared between the Registrar of Assurances, Kolkata, with its Additional Registrar of Assurances offices numbered one to four, and the District Sub-Registrar and Additional District Sub-Registrar (ADSR) offices that serve the surrounding areas. The portal's Locate Registration Office tool tells you which counter takes your property. The choice follows where the property stands, not where the family lives, so confirm it before booking.

Inside the KMC limits

Ballygunge, Behala, Tollygunge, Park Street, Bagbazar, Shyambazar and Jorasanko all fall under Kolkata Municipal Corporation. Its assessment department keeps the assessee register, and a premises is known by its municipal premises number, ward, borough and police station.

Salt Lake

Bidhannagar Municipal Corporation keeps the tax record. Many plots are leasehold from the state, so the Urban Development and Municipal Affairs Department may have a say in a change of lessee.

New Town

The New Town Kolkata Development Authority administers the area. Read the deed to see whether the plot or flat sits on lease, and ask the authority what it wants after a release.

Howrah and the neighbouring municipalities

Howrah Municipal Corporation, Dum Dum, Baranagar and others keep their own assessment records. KMC has no role there.

Panchayat and rural land

The Block Land and Land Reforms Officer (BL&LRO) records the heirs and the new holder through mutation, which is the dakhil-kharij entry on the Banglarbhumi land record.

The building

A flat sits under an owners' association in most newer blocks, or under a cooperative housing society in some, and the supply connection is usually with CESC.

The schedule of property in the deed must describe the premises as the record does. For a KMC house or flat that means the municipal premises number, the road, the ward, the borough, the police station and the post office, plus the assessee number when known. For land beyond municipal limits it means the mouza, the J.L. number, the R.S. and L.R. dag numbers and the khatian number. Older papers often say Calcutta where today's record says Kolkata, and one road may have carried two names. Recite the earlier name where the title chain uses it, so the sub-registrar sees a single property and not two.

Stamp Treatment in West Bengal, and How the Portal Steps Run

There is no single figure a family can look up once for a release. Stamp duty follows from three things: how the deed is characterised, the market value of the property or the share as assessed for the locality, and whether money passes between the parties. A plain release by one co-heir in favour of co-heirs who already hold shares in the same property is read differently from a transfer to an outsider, and a deed with a sum attached may be read as a sale of a share. The governing law is the Indian Stamp Act of 1899 as applied in this state, with West Bengal's own changes to its schedule. We send the family to the state portal for the current treatment and do not state a rate here, because rates and concessions are revised.

The online steps, as the portal presents them at the time of writing, usually run like this:

E-requisition

On wbregistration.gov.in you enter the local body, the property particulars and the deed category that matches your paper. The entries drive the assessment, so a wrong category produces a wrong figure.

Assessment slip

The system returns a slip with a query number showing the duty and the registration levy payable. A calculation tool on the same portal lets you test the position before you commit.

Payment

Duty and levy are paid through GRIPS, the state's government receipt payment system, by net banking, card or UPI, and the receipt travels with the deed. Ask the office whether any part of the payment may still be made at the counter.

Appointment

You book an e-appointment at the office chosen through the locator, and the office tells you how it wants the deed printed.

Appearance

Each person who signs the release appears before the registering officer with identity proof, photographs and fingerprints are taken, and witnesses vouch for the signatories. Section 23 of the Registration Act, 1908 requires presentation within four months from execution, so signing is timed to the appointment and not the other way round.

West Bengal's e-deed templates were first built for sale deeds, and the Calcutta High Court has held that registering through the e-route is optional. For a release we therefore usually assume a conventionally drafted deed, with the requisition and payment steps done online and the signing done in person, unless the portal lists a release template when you apply. We check this each time, as the portal changes.

Old Joint Houses, Tenanted Premises and Other Special Cases

Old joint houses in the older neighbourhoods

A house in Bagbazar or Shyambazar that nobody has divided since a grandfather's time may be owned by cousins spread over several branches, with some co-sharers long dead. Bengal follows the Dayabhaga school of Hindu law, under which sons gain no right by birth and shares usually become fixed at the owner's death. A release then works branch by branch: the heirs of each deceased co-sharer must be named, and each branch either releases or settles internally before the next layer signs. If the deceased was a woman, Section 15 of the Hindu Succession Act, 1956 can send property she inherited from her father or her husband back to that side of the family, which changes who the co-heirs are. Ask an advocate to read the chain before anyone drafts.

Dedicated property

Some old houses include a thakur dalan or a portion set apart for a family deity. Such property is usually held for the deity, with a shebait managing it, and is not an ordinary share passing to the heirs at large. A release should state clearly that it does not purport to give up any dedicated portion.

Tenanted premises

Many older Kolkata properties carry tenants who pay modest rent to a landlord who has since died. The West Bengal Premises Tenancy Act, 1997 governs most such tenancies, and a release among the landlord's heirs neither ends nor alters the tenancy. Recite the tenancy in the deed, tell the tenant in writing who now holds the landlord's right, and keep rent receipts in the right name. Bustee land follows its own thika tenancy law, and the thika tenant's rights sit apart from the landowner's heirs, so take advice before treating such land as an ordinary co-heir asset.

Minor co-heirs

A natural guardian may not transfer a minor's immovable property without the civil court's prior permission, a rule found in Section 8 of the Hindu Minority and Guardianship Act, 1956. Giving up a child's share therefore needs that sanction first, and a deed signed without it can be challenged.

Where a Will exists

The shares then follow the Will, and the legatees, not the intestate heirs, decide who releases what. Kolkata sat among the presidency towns where Section 213 of the Indian Succession Act once made probate a precondition for rights under Hindu Wills; the section was repealed in December 2025. Legatees releasing among themselves need no probate by statute, although a bank or association may still ask for one.

Other personal laws and secured property

Muslim heirs take shares set by their own personal law, while Christian and Parsi families follow the Indian Succession Act of 1925. The registration steps are the same. If the property is mortgaged, the lender's consent is needed before the shares move, whatever the family has agreed.

A Realistic Timeline, Including the KMC Mutation That Follows

Timing depends far more on the heirship papers and the family than on the registration office. These soft ranges describe a typical uncontested file, and every one of them can stretch.

Heir list and papers

A few weeks when the death certificate and ownership papers are at hand, several months for an old house with a deep chain of ownership.

Drafting and agreement

A couple of weeks, longer if shares are still being negotiated or a minor's share needs court permission first.

Requisition and payment

Usually one sitting once the draft is settled, because the figure comes from the portal.

Appointment

A wait of a few weeks is common, depending on the office, and signing is timed to land inside the four-month presentation limit.

The registration visit

One sitting for all signatories when everyone is ready, with the registered deed returned after the office completes its processing.

KMC mutation

Anywhere from several weeks to a few months, depending on dues, inspection and how complete the file is.

Association, CESC and other records

A few weeks apiece, and the two can proceed in parallel.

The mutation step after registration

The registered deed is not the end for a KMC property. The receiving heir lodges an application with the KMC assessment department, at the borough office or online, in the prescribed mutation form, which has long been called Form A-42, though names and the online routes have been revised. The file usually carries the registered deed, the death certificate, proof of the earlier owner's name on the assessment record, identity proof, and a no-outstanding-dues certificate from the assessment and collection section. KMC staff may inspect the premises. Once cleared, the new name is entered in the assessment register and a valuation letter is issued. Confirm the current form and list with the borough office, because they change.

Mutation records who pays the tax; it does not create title, which comes from the registered deed. In Salt Lake, New Town, Howrah or a panchayat area the same step is taken at the local body or the BL&LRO, and the checklist is not the same.

Where Kolkata Release Deeds Go Wrong

An incomplete heir list

The child of a brother who died earlier, or a surviving mother, is forgotten. That person still holds a share, and the deed leaves the property under a cloud.

A loose property description

The premises number, ward or mouza does not match the tax record or the title deed, or an old road name is dropped. The office returns the deed or, worse, registers it against the wrong description.

Using a release to pass a share to an outsider

A release serves only a person who already holds a share. For anyone else the right paper is a gift or a conveyance, taxed and stamped on its own terms.

Writing a token sum without thinking

A payment recited in the deed can change how the office reads it. Decide the characterisation before the draft, not after the assessment.

Choosing the wrong category on the portal

The assessment depends on the entries, and a slip generated for another category cannot be reused cheaply or safely.

Missing the four-month limit

Signing months before an appointment can run the clock out under the Registration Act. Sign when the slot is confirmed.

Name mismatch across papers

Banerjee on a PAN card and Bandyopadhyay on the old deed, or a married name on an Aadhaar. Reconcile every variant in the deed itself.

Forgetting the tenant, the lender or the dues

A release leaves each of these exactly where it was, and the receiving heir inherits them.

Pressure on a widow or a daughter

A release must be voluntary. A deed obtained by pressure invites later litigation, and a calm written record of each person's choice protects everybody.

Skipping mutation

Months later the tax bill still arrives in the dead owner's name, and a buyer or a bank asks why.

Eight Moves That Take a Family From Enquiry to a Registered Deed

Every move closes with an output the family can see, so nobody wonders what is decided and what remains.

1

List the heirs and fix each share

Every heir the law counts is written down: a surviving mother, daughters, and the children of anyone who died first. Each share is then stated as a fraction the family agrees on. The drafting waits until all accept the list as complete.

2

Pin down the property and who keeps its record

From the deed, the tax receipt or the lease, we work out whether the premises sits under KMC, Bidhannagar, New Town, Howrah or a panchayat, and who holds its record. The answer decides the registration office and the later mutation.

3

Choose the right instrument

The question is whether the plan is truly a release, or a family settlement, a gift or a sale. A payment, an outsider or unequal shares each tilt it toward another deed. Settling this early avoids a stamp surprise later.

4

Draft and circulate

The draft recites the heirs, the shares, the property schedule as the records describe it, any tenant and any exclusion. Every signatory reads the same version, and we note questions and answers in a short covering sheet.

5

Run the portal requisition

With the draft settled, we enter the property and deed details on the registration portal, read the assessment slip with the family, and pay through the state's payment gateway. If the figure surprises anyone, we stop and recheck the category.

6

Book the slot and plan the signing

We choose the registration office through the locator, book an e-appointment, and time the signing inside the four-month limit. Witnesses, photographs and identity originals are arranged so one visit is enough.

7

Attend registration

Signatories appear before the registering officer, photographs and fingerprints are taken, and witnesses identify the parties. We stay for the endorsement and note the deed number, year and book, because later applications will ask for them.

8

Mutation and follow-up

With the registered deed we apply to KMC or the local body, then to the association and CESC. We track each file, answer queries and tell the family when the records finally carry the new holder's name.

What to Collect Ahead of the Registration Slot

Every registration office and local body asks for its own attestations and certified copies, and some want papers sworn before a notary or magistrate. Before the family spends time collecting anything, we get each office's present checklist.

From each heir who signs

  • Aadhaar and PAN for each signatory and for the heir taking over the share
  • Recent passport-size photographs of every signatory and of the receiving co-owner
  • Proof of relationship: birth certificates, a marriage certificate or school records naming the parents
  • Two adult witnesses carrying identity proof, able to attend on the booked date
  • A one-page signed note saying who gives up which share, and for whom
  • Written lender consent, where the property is mortgaged

From Kolkata offices and registers

  • The owner's death certificate from the KMC birth and death office, or from the registrar where the death occurred, with spare certified copies
  • The owner's title papers: sale deed, deed of conveyance, lease deed or partition deed, with the registration particulars
  • Latest KMC assessment bill and receipt, or the equivalent from Bidhannagar, New Town or the municipality concerned
  • An heirship paper acceptable to the office, often an affidavit before a Judicial Magistrate with a ward councillor's certificate
  • For a flat: the association's or society's no-dues letter and its record of membership
  • For land beyond municipal limits: the Banglarbhumi record of rights extract with mouza, dag and khatian details
  • Rent receipts or tenancy papers, where the property is let

Why Kolkata Heirs Ask Us to Prepare Their Release

  • We draft for the reader at the counter. The recitals answer the questions that the registering officer, KMC and the association usually raise, so the deed does not come back for a missing line.
  • One person keeps every heir on the same page. One case manager keeps cousins in Behala, Salt Lake and elsewhere reading the same draft and working to the same calendar.
  • A frank view on whether a release fits. If a settlement, a gift or a partition would serve better, we say so before any stamp duty is paid.

Frequently Asked Questions

Is a release deed the same as a gift deed in Kolkata?

+
No. A release comes from a co-heir who already holds a share, and it enlarges what another co-owner holds. A gift moves property from a sole owner, or a share to an outsider, and it draws its own stamp and tax treatment. Should the plan be to give a share to a spouse, a child or a nephew who is not a co-heir, the paper is a gift or conveyance, whatever label sits on the first page.

Does a release deed have to be registered, and where?

+
Yes. Section 17 of the Registration Act, 1908 makes a deed that extinguishes a right in immovable property compulsorily registrable, and neither KMC nor a buyer will accept an unregistered release. It is registered at the West Bengal registration office that covers the property, which may be a Registrar of Assurances office or a District or Additional District Sub-Registrar office. The portal's office locator tells you which one, and we confirm before booking.

Which office takes the deed: the Registrar of Assurances or an ADSR?

+
It depends on the property. Kolkata has the Registrar of Assurances with Additional Registrar offices, while surrounding areas are served by District and Additional District Sub-Registrar offices. The Registrar of Assurances can register documents for property across the state, but families should not assume that every counter will take every deed in practice. Use the locator on the state portal, and ask the office on the phone if the screen shows more than one choice.

How is stamp duty on a release deed decided in West Bengal?

+
It turns on how the deed is characterised, the market value assessed for the locality and whether money changes hands. A plain release among co-heirs is treated differently from a transfer to an outsider, and a recited payment may lead the office to read the deed as a sale of a share. We do not state a rate here. Enter the details on the state portal, read the assessment slip, and have an advocate confirm the entry that applies.

Do all the heirs have to sign?

+
The signatories are those who surrender a share, yet all heirs must be named and accounted for in the recitals. Someone who is not a party, and has not released, still owns a share. We therefore finish the family tree first, then settle who signs, for whose benefit and over which property, leaving no loose end behind. A deed that names only some heirs invites a dispute years later, usually just when a sale is planned.

Can a married daughter release her share in the family house?

+
She may, if she wishes, and she may just as well decline. The Hindu Succession Act, 1956 ranks a daughter alongside a son among first-class heirs, and marriage does not reduce what she holds. A release must be voluntary. We ask her to confirm her decision in writing, ideally after she has read the draft in her own time, because pressure from relatives is the commonest reason a release is challenged later.

What if one co-heir refuses to sign?

+
A share cannot be extracted from an unwilling heir. The family can try mediation, including through the legal services authority, and a release may follow once terms are agreed. If talks fail, the remaining road is a partition suit in the competent civil court, which divides the property or allots shares. That is slower and more public, so we normally attempt a quiet settlement first and keep each step on paper.

Can a registered release deed be cancelled?

+
Rarely. A change of mind is not a ground. A court may set a deed aside where there was fraud, coercion, impersonation, a forged signature or a minor's share released without court permission. Even then the burden of proof lies on the person challenging it, and the process takes time. This is why we slow down before signing and record, for each releasing heir, that the decision was understood and made without pressure.

Will KMC change the name automatically after registration?

+
No. KMC does not learn of a registered deed on its own. The receiving heir applies to the assessment department in the prescribed mutation form, with the registered deed, the death certificate, identity proof and a no-outstanding-dues certificate. KMC staff may inspect the premises before the name is entered and a valuation letter issued. Forms and the online routes have been revised over the years, so confirm the current list with the borough office.

Do we need probate or any court certificate before signing a release?

+
Not as a matter of statute. With no Will, heirs release on the strength of their relationship, which the deed recites. With a Will, the shares follow it. Kolkata once fell under the old Section 213 rule, which tied rights under certain Hindu Wills to probate, and that rule went in December 2025. A bank or association may nonetheless ask for a court paper, so find out what each institution will accept.

Does a release deed affect a tenant in an old house?

+
No. The tenancy continues on its existing terms, and the tenant owes rent to whoever now holds the landlord's right. The West Bengal Premises Tenancy Act, 1997 governs most tenancies, and bustee land follows thika tenancy law. We recite the tenancy in the deed, help the family give the tenant written notice of the change, and warn against accepting rent in the name of someone who has stepped aside.

Our plot in Salt Lake or New Town is on lease. Is a release still possible?

+
Usually yes, among co-heirs of the lessee, but the lessor has its own process. In Salt Lake the state's Urban Development and Municipal Affairs Department deals with a change of lessee, and Bidhannagar Municipal Corporation keeps the assessment record. In New Town the development authority administers its plots. Read the lease terms first, since some leases restrict transfers, and confirm with the lessor what it wants beyond the registered deed.

Are there tax consequences when co-heirs release shares?

+
The answer depends on whether money passes and how the transaction is characterised. A release among co-heirs with no payment is generally treated differently from selling a share for a sum, and a later sale of the property carries the earlier owner's acquisition value and holding period forward. India has no inheritance tax. As the position turns on facts, a chartered accountant should review before the draft is final; we do not give tax opinions.

Can a sibling who lives abroad take part?

+
Yes. A sibling who is an NRI or lives overseas can sign abroad before a notary and complete the legalisation India requires, or empower someone in Kolkata through a power of attorney that the office will accept. Section 26 of the Registration Act also lets a document signed outside India be presented within four months of reaching India, at the registrar's discretion. Plan the order of signing and posting with us early.
