Does Stepping Aside From an Inherited Share in Pune Need a Registered Deed?
Yes, where the share is in a flat, house, plot or field. A promise to step aside, a family letter or a notarised paper does not remove a co-heir's share in immovable property. The release has to be a registered deed, signed at the Sub-Registrar office that covers the property, and Maharashtra stamp law decides how it is treated. Records then need mutation. No probate is involved in this route: Section 213 of the Indian Succession Act never applied to Pune and was removed in December 2025.
- Who signs: every co-heir giving up a share, with the heir who receives it joining the registration
- Stamp: depends on the relationship, the nature of the property and whether anything is paid; check the state portal
- Registered at: the Sub-Registrar office that covers the property, usually one of the numbered Haveli offices for the city
- Afterwards: society share, PMC or PCMC tax name, property card or Ferfar on the 7/12
Which Release Route Fits Your Pune Family? Six Common Situations
Release deeds look simple until the property, the family tree or a payment changes the picture. Find the row closest to yours to see the usual handling, the desk that takes it and the pace families tend to report. Offices differ, so read the last column as a rough guide.
| Situation | How the release is handled | Office or authority | Typical time |
|---|---|---|---|
| Two or three heirs, one flat in a Kothrud or Aundh society, nothing is being paid | Straight release The siblings release in favour of the heir who stays. The lighter family treatment under Maharashtra stamp law may apply if its conditions are met, so check the state portal before drafting. | Sub-Registrar office covering the flat, then the society and PMC | A few weeks once heirship papers are complete |
| Money is being paid to the heir who steps aside | Treated as a transfer A release for payment can be treated closer to a conveyance, and the payment has tax and record consequences. Settle this with a chartered accountant before the deed is drafted. | Sub-Registrar office; chartered accountant for tax | A few weeks, longer if the valuation is debated |
| Old wada in Kasba, Shaniwar or Budhwar Peth, many heirs over several generations | Map the heirs first Build the family tree, identify every living share-holder, then decide between one release by all and a set of smaller releases. A missing heir leaves the deed incomplete. | Sub-Registrar office; City Survey Office for the property card | Several weeks to a few months |
| Farm land in Mulshi, Haveli or Bhor held on a 7/12 extract | Hakka sod, then Ferfar A registered release deed, often called a Hakka sod patra, followed by a mutation entry. Fragmentation and tenancy rules can limit how a small holding is divided. | Taluka Sub-Registrar office, then Talathi and Circle Officer | Registration is quick; the Ferfar waits out its notice period |
| One heir is a minor, or one heir lives overseas | Extra formality A guardian cannot release a minor's share in immovable property without the court's permission. An heir abroad signs before a notary, and the deed follows the stamp and presentation windows for papers signed abroad. | Civil court at Pune for a minor's share; Sub-Registrar office | Several months where court permission is needed |
| A home loan runs on the flat, or one heir will not sign | Pause and resolve The lender and the society must consent before a share moves. An unwilling heir cannot be forced to release, and the alternative is a partition suit. | Lender, society, then the civil court at Pune if needed | Depends on the lender, or on the court's calendar |
Most Pune families fall into more than one row. A wada may also carry a loan, and an heir may live abroad. We sort the rows into one sequence so the same signed papers serve the sub-registrar, the society and the Talathi.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentWhen a Release Is the Right Tool, and When Another Deed Fits Better
A release deed is a document in which one co-owner gives up a claim in a specific property in favour of someone who already holds an interest in it. The word that matters is already. Brothers and sisters who inherited a flat together each hold an undivided share, so one of them can release that share to the others. A cousin who owns no part of the flat cannot receive property by release, and a deed that tries to do so may be treated by the registration and stamp offices as a transfer of another kind.
Release or gift
A gift passes property the donor owns to a person who had no earlier claim. A release is an exit from a shared holding. Families often say gift when they mean release, and the paperwork that follows is different, so the label on the deed should match the facts.
Release or partition
A partition deed divides the property among all co-owners, so everyone walks away with a defined portion. A release suits the case where one or more heirs step aside and the remaining heirs keep the whole. When three siblings each want a separate floor of a house, partition is the better instrument.
Release or family settlement
A settlement records an arrangement that ends or prevents disputes across several assets, with give and take on all sides. Where the arrangement touches immovable property, registration is still advisable, and the document may need its own stamp analysis.
Who must be on the deed
The shares come from the family's personal law. For a Hindu who died without a will, the first class of heirs usually includes the widow, sons, daughters, the mother, and the children of a son or daughter who died earlier. Since the 2005 amendment, daughters stand equal to sons in ancestral joint family property. Muslim, Christian and Parsi families follow their own rules. If a will exists, the share comes from the will instead, and the will should be read before anyone signs.
The signature you cannot do without
A release only binds the person who signs it. If four heirs exist and three sign, the fourth still owns a share, and the receiving heir does not own the whole property. That one gap is the commonest reason a Pune deed is useless to a later buyer or lender.
A minor or an incapacitated heir
A natural guardian cannot transfer a minor's immovable property without the court's permission under the Hindu Minority and Guardianship Act. In practice, a release that includes a minor usually means a petition to the civil court first. Do not let a deed include the minor on the strength of a parent's signature alone.
Drafting and Stamping a Release Deed Pune Desks Will Accept
A good deed is short on rhetoric and long on exact facts. A clerk at the sub-registrar office reads it against the title papers, so every name, survey number and family relationship has to line up.
Recitals that trace the title
The deed opens by explaining how the property reached the family: the original purchase or allotment, the date and place of the owner's death, and the heirs who succeeded. A reference to the registered purchase deed, with its document number and the sub-registrar office, helps a later reader follow the chain.
Names and relationships
List each heir with full name, age, relationship to the deceased, address and identity details. Marathi names often travel as given name, father's name and surname, and Aadhaar, PAN and the 7/12 may spell them differently. Put the preferred spelling in the deed and add an also-known-as line where records differ.
The property schedule
A Pune schedule describes the property the way its own records do. City land uses the CTS number and the Property Card. Village land uses the survey or Gat number with the hissa. Land in a town planning scheme may carry a final plot number. A flat adds the society's name, the flat number, the floor, the built-up area as per the share certificate or agreement, and the boundaries in four directions.
The operative clause
It states that the releasing heir gives up all right, title and interest in a named share, for the stated consideration or for none, and that the releasee holds it from that date. It should say plainly whether the share is released to one heir or to all remaining heirs, because that choice shapes the stamp analysis and the later mutation.
Supporting clauses
A declaration that the releasing heir acts voluntarily, has read and understood the deed, and has taken advice if desired. A covenant not to sue over the released share. A statement about possession. A promise to sign further papers needed for mutation. Where there is a home loan, a note that the lender's consent has been obtained.
How Maharashtra stamp treatment works, without numbers
The release entry in the Maharashtra Stamp Act schedule is not a single flat treatment for every case. For a release of ancestral property among close family where nothing is paid in any form, the state has provided a markedly lighter treatment, with conditions about the relationship and the nature of the property. If money or anything of value passes, or the receiving person falls outside the listed relatives, the instrument can be treated more like a conveyance, with duty measured on the market value of the share. That value is guided by the ready reckoner rates and the valuation tools on the registration department's portal.
Duty is normally paid through the state's online channels, such as GRAS or the e-SBTR route, or by franking, and the receipt is attached to the deed. Rates and conditions have been revised in recent years, so we send every family to the department's portal and the sub-registrar office for the figure on the day, and we do not print one here.
Tax in one paragraph
India has no inheritance tax, and receiving an inherited share is not taxed on receipt. A payment to the heir who steps aside can raise questions of capital gains for that heir. A later sale by the receiving heir is generally taxed on the earlier owner's purchase value and holding period. A chartered accountant should look at any release that involves money.
Reading Your Papers: Which Pune Office Matches Which Number on the Page
The quickest way to find the right desk is to read the property papers, not the postal address. Each kind of reference number points to a different record keeper.
A CTS number or City Survey number, with a Property Card
This is urban surveyed land, common in the peths, Deccan, Shivajinagar and many parts of Kothrud. The City Survey Office keeps the card, and its name change is a separate application after registration.
A survey number with a hissa number, and a 7/12 extract
This is village or agricultural land, in Haveli, Mulshi, Bhor, Maval and the fringe villages around the city. The Talathi keeps the record, the Circle Officer certifies mutation, and the Tehsildar hears objections.
A Gat number
This usually appears where the land was consolidated or sits in a rural revenue village. It is treated like a survey number for the 7/12.
A final plot number under a town planning scheme
Parts of Pune were laid out under such schemes, and the plot may sit on a Property Card or a 7/12 depending on how it was later surveyed. Ask the City Survey Office which applies.
A society name with a flat number and share certificate
This is a co-operative housing society flat. The society is the first stop after registration, then the municipal tax desk.
A deed of declaration and a registered flat deed
This points to an apartment ownership structure, where title lives in the deed and the association updates its books.
A cantonment address in Camp, Khadki or Dehu Road
The Cantonment Board keeps the tax register, and some holdings sit on defence-managed land with their own occupancy papers. The deed is still registered with the sub-registrar, but mutation follows the Board's process.
Where the deed is registered
Pune's registration offices are organised by area and are numbered, and the Haveli offices run in sequence from Haveli 1 onward. Each covers a defined set of wards and villages, and other talukas usually have their own offices. The department's website has an office locator and an online booking system, so confirm which one covers your property before booking. The department is headquartered in Pune, but your deed is registered at the local office, not at headquarters.
Who taxes the building
The Pune Municipal Corporation covers Kothrud, Aundh, Baner, Shivajinagar, Hadapsar and the central peths. The Pimpri Chinchwad Municipal Corporation covers Pimpri, Chinchwad, Akurdi, Nigdi and Bhosari. Peripheral and merged areas may belong to a gram panchayat or to a regional authority, so look at the heading on the latest tax bill. The wrong tax body returns the file.
Special cases
Gunthewari plots on the outskirts, flats from slum rehabilitation schemes and land with a tenancy or restricted-tenure history can carry limits on dealing or later sale. These rarely block a release among heirs, but they can complicate what the receiving heir does next, so ask the relevant authority early.
After Registration: Society, Municipal Tax, Property Card and 7/12
Registration moves the share on paper. The records that other people rely on change only when someone applies. Treat the registered deed as the key that opens four doors.
The housing society
The receiving heir applies to the society with the registered deed, the death certificate, the share certificate and proof of the earlier heirs' succession. If the membership still stands in the deceased's name, the society first records the heirs under the Maharashtra Co-operative Societies Act and its bye-laws, and the nomination, if any, is dealt with at that stage. The committee then passes a resolution, and the share certificate is reissued or endorsed. Some societies ask for a no-objection letter from the other heirs or an indemnity bond. Ask the secretary for the written list.
The municipal tax record
Once the society has accepted the heir, the Pune Municipal Corporation, the Pimpri Chinchwad Municipal Corporation or the Cantonment Board changes the owner's name on the tax assessment. Expect to attach the registered deed, a recent tax receipt, identity proof and the society's letter. Several of these bodies take applications online, though a field visit may follow.
The Property Card
For land on City Survey, the heir applies at the City Survey Office with the registered deed to have the card updated. Registration alone does not change the card. Check the card online after the entry is made, and save the downloaded copy with your records.
The 7/12 and the Ferfar
For village land, a registered release leads to a mutation entry. In some cases the registration data reaches the revenue system on its own, but the heir should check, and apply to the Talathi if no entry has appeared. The Talathi records the entry in the register, notice goes to those who may object, and the Circle Officer certifies it if there is no objection. The Maharashtra Land Revenue Code requires the person who acquires a right to report it. Once certified, the updated 7/12 can be downloaded from the state land-records portal. A Ferfar records who pays the land revenue. It does not create title that the deed did not already give.
Utilities and everyday records
Electricity connections with MSEDCL, piped gas with the Pune gas distributor, water and the society's maintenance billing can be moved to the heir's name, usually on the same set of papers. Banks and lenders also need the new ownership record before any later mortgage or sale.
Redevelopment
If the society or wada owner is negotiating with a developer, tell the developer's lawyers about the release as soon as it is registered. Every share-holder's consent matters in a redevelopment agreement, and an unrecorded release can leave the wrong person signing.
A Realistic Pace for a Pune Release Deed
No desk gives a date, and no two Pune families move at the same speed. These soft ranges describe what people commonly report.
Establishing the heirs
A short stretch where the death certificate is on hand and the family tree is simple. Longer where a heirship certificate is needed from the Tehsildar, or where an heir is hard to trace.
Drafting and review
Usually a week or two, because every heir should read the draft in a language they follow and ask questions.
Stamp and valuation
Quick when the family treatment clearly applies, slower when money passes or a valuation is debated.
Registration
Often completed at a single appointment once the papers are in order. Slots depend on the office and the season.
Society transfer
A few weeks, since committees meet on their own calendar.
Municipal tax name
A few weeks after the society letter, longer where a field inspection is part of the process.
Property Card or Ferfar
Several weeks, because notice and an objection period are built in.
Court permission for a minor
Several months.
For an agreeing family with one flat and complete papers, the whole journey from first call to updated records often runs a few weeks to a couple of months. Each extra layer, such as a loan, a minor, a wada with many heirs or an unwilling relative, adds time.
Mistakes That Make a Pune Release Deed Unreliable
Leaving out an heir
A married daughter, a half-sibling, a child of an earlier-deceased brother, or a widow can each hold a share. The deed works only for those who sign.
Calling it a release when it is a gift or a sale
If one cousin with no share receives the property, or money changes hands, the deed may need to be something else, with a different stamp treatment.
Relying on a notarised paper
A notary confirms a signature, not the transfer of a share. Immovable property needs a registered deed.
Vague property description
A schedule that says the flat on the second floor without the society, flat number or CTS number is a recipe for questions at the counter.
Name mismatch
A deed that says one spelling while the Aadhaar, 7/12 and tax receipt say another will be queried. Add an also-known-as line.
Signing under pressure
A registered release is hard to undo. Consent obtained by fraud, coercion or undue influence can be challenged, but a change of heart is not a ground. Take time to read the draft with someone you trust, and ask for explanations before the registration appointment.
Forgetting the lender
A running home loan stays on the flat. The lender's no-objection should be in hand before registration.
Stopping at registration
A deed that is never followed by society, tax and record mutation leaves the old names everywhere, which causes trouble at the next sale or loan.
Missing the presentation window
The Registration Act sets a four-month window from execution for presenting a document, and a deed signed abroad has its own windows. Book the appointment promptly after signing.
Assuming a release ends an unrelated claim
It covers the share and the property named in the deed. Other assets, such as bank accounts and shares in companies, need their own papers.

From Family Agreement to Updated Records: Eight Steps for a Pune Release
Each step prepares the ground for the next, so no office meets a paper that another office has not yet seen.
Confirm the heirs and the shares
List every person entitled to a share under the personal law or the will, including married daughters and the children of any heir who died earlier. Collect the death certificate and, where an office insists, a heirship certificate. Do not draft before this list is firm.
Agree the shape of the release
Decide who releases, who receives, whether the release is to one heir or all remaining heirs, and whether anything is paid. These choices drive the stamp treatment and the tax questions, so settle them before anyone sees a draft.
Collect the title chain
Gather the registered purchase deed or allotment letter, the Index II extract, the society share certificate or flat deed, the latest tax receipt, and the Property Card or 7/12. Check the spelling of names and the property description against each paper.
Draft and read the deed together
We prepare the draft with the recitals, schedule and release clause, and each heir reads it in a language they follow. Questions are answered before the stamp is bought, because a draft is easy to correct and a registered deed is not.
Settle stamp treatment and any lender consent
Check the current treatment on the registration department's portal, pay through the state's online channel or by franking, and attach the receipt. Obtain the lender's written consent where a loan runs on the flat, and the society's letter if it asks.
Book the appointment and prepare the parties
Choose the Sub-Registrar office that covers the property, upload the draft if the portal allows, and book a slot. Every releasing heir, the receiving heir and two witnesses should bring original identity papers and be ready for photographs and thumb impressions.
Execute and register
At the appointment, the officer checks identities and the deed, the parties sign, and the registration is recorded. Collect the registered original or the receipt of acceptance, and download the Index II entry once it appears online so the details can be checked.
Mutate every record
Apply to the society, the municipal tax desk, the City Survey Office or the Talathi, as the property requires, and then move the utility connections. Keep a certified copy of the deed with each application and track each file until the new name appears.

Why Pune Families Ask Us to Handle a Release Deed
- One deed, checked against the records. We read the draft against the Index II, the card, the 7/12 and the share certificate, so the desk has few questions to ask.
- Honest advice on the alternatives. We say when a gift, a partition or a family settlement fits better than a release, and we explain why in plain language.
- Follow-through after registration. We track the society, municipal and revenue files and report in plain terms, so the new name actually reaches every record.
