NRI Property Transfer After Death in Kolkata: What's Different
Kolkata is the one city in this series where the history of the law matters almost as much as the present rules. Until the end of 2025, a Will covering Kolkata property was often expected to go through court probate. That requirement has now gone, but old habits, old family houses, tenants, leasehold plots and a municipal system of its own still shape how an NRI heir gets property transferred. PropResolve helps overseas heirs read these layers correctly before they sign anything.
The Probate Habit Kolkata Is Still Unlearning
Under Section 213 of the Indian Succession Act, 1925, a Will made by a Hindu, Buddhist, Sikh or Jain within the original jurisdiction of the Calcutta High Court, or covering immovable property there, could not be enforced in court unless it had been probated. For generations of Kolkata families, the practical message was that a Will needed a grant of probate from the High Court before the executor or the beneficiaries could safely rely on it.
The Repealing and Amending Act, 2025, which received the President’s assent on 20 December 2025, removed Section 213. Probate is therefore no longer compulsory by statute, in Kolkata or anywhere else in India. Three cautions follow.
- The change is not retrospective in the way many assume. The ordinary rule is that repeal does not disturb rights, liabilities or proceedings that arose or began earlier, so applications already filed and grants already made remain as they were. For an older estate, ask a lawyer which side of the line it sits on.
- Offices and families are slow to change habits. A bank, a municipal office, a lessor or a buyer’s lawyer in Kolkata may still ask whether the Will has been probated. Ask the specific office what it will accept instead of assuming that every counter has updated its checklist.
- Voluntary probate still has value. A grant of probate from a competent court is generally treated as conclusive proof of the Will’s validity, and it makes a later challenge more difficult. For a Kolkata family with a long-standing Will, a cousin who might object, or heirs scattered across countries, it can still be a sensible choice, even though nobody is forced to take it.
Our guide to NRI probate of a Will in India explains how an overseas heir can run a probate petition through a local lawyer. Where there is no Will, or no executor can act, the route is different, as explained in our guide to when a letter of administration is required.
Kolkata Municipal Corporation: Changing the Assessee’s Name
In Kolkata, the municipal record that matters most for a house or flat is the assessment record held by the Kolkata Municipal Corporation (KMC). Changing the name on that record after a death is called mutation. Published guidance and forms show that an application is made on the prescribed mutation form, commonly referred to by its form number, together with a No Outstanding Certificate from the assessment and collection department, which confirms that municipal dues have been cleared.
For a mutation on succession, the documents usually include:
- The death certificate of the late owner.
- Evidence of heirship: a declaratory affidavit naming all legal heirs where there is no Will, a legal heir certificate if the office asks for one, or, where the property passes by Will, the Will itself.
- The registered title deed and the earlier documents in the chain.
- The latest municipal tax receipt and the No Outstanding Certificate.
- Identity proof, a recent photograph and signatures of the new assessees.
Older articles often say that a probated Will is a requirement for testamentary mutation. That statement reflects the old Section 213 position, and it should be rechecked against current KMC practice. Do not assume the form, documents or counters are as they were a year ago.
KMC covers only part of the greater Kolkata area. Properties in Howrah, Bidhannagar and other municipalities fall under their own bodies with their own forms. The first question for an heir abroad is therefore which municipal body assesses the property, and the answer is on the latest tax bill.
Salt Lake and Other Leasehold Plots
A large part of Kolkata’s planned housing, including parts of Salt Lake in Bidhannagar, stands on land held on lease from the state government. When the lessee dies, the heirs apply for mutation of the lease to the competent officer of the Urban Development and Municipal Affairs Department. For Bidhannagar, the published format is addressed to the Land Manager.
The department’s published application for mutation on the death of the lessee lists enclosures of the following kind: the original death certificate, a declaratory affidavit on legal heirship affirmed before a magistrate, a relationship certificate from a government officer of the prescribed rank or from the Sub-Divisional Officer, and affidavits relating to land ceiling legislation. Mutation is granted subject to all the terms of the original lease deed.
For an NRI heir, two consequences follow. The affidavits must be signed by the right persons, in the right form, and where an heir is abroad they must be authenticated. And because the lease terms continue to bind the heirs, the lease deed should be read before the family decides whether to keep the plot, build on it or sell it. Please confirm the present format and enclosures with the department, because published forms are revised from time to time.
Warish: The Bengal Heirship Certificate and Who Issues It
In West Bengal the heirship certificate is commonly called a warish or warisan certificate. In rural areas, it is issued by local revenue and panchayat authorities. In Kolkata, the position is less uniform. The Collector of Kolkata is empowered to issue legal heir certificates within the Kolkata Municipal Corporation area, but, according to the Collectorate’s published information, only for cases directed by government or government agencies. Private families often rely on other forms of heirship proof: a declaratory affidavit sworn before a magistrate, a certificate from the municipal councillor or another authority, or, where financial assets are involved, a succession certificate from a district judge.
The consequence is that an heir abroad should not simply ask for a warish certificate. The better question is: which form of heirship proof does the office receiving it accept? A bank, a KMC unit, the Land Manager and a sub-registrar may each have different preferences. Settle that before commissioning any certificate, and it can save a good deal of time.
Where a succession certificate is required, the petition is filed before the district judge with jurisdiction, generally determined by where the deceased lived at the time of death. Our guide to the succession certificate in West Bengal goes through the court process, and our NRI legal heir certificate in Kolkata page explains how an overseas family can start the heirship process from abroad.
Registration in Kolkata: Registrar of Assurances and ARA Offices
Registration in Kolkata has a structure that is unfamiliar to families from other cities. Besides the district sub-registrar offices, Kolkata has the Registrar of Assurances and several Additional Registrar of Assurances (ARA) offices. Published descriptions of the registration department say that the Registrar of Assurances in Kolkata may register documents relating to property anywhere in West Bengal. If that is correct for a given document, it can matter to an NRI heir whose family property is outside Kolkata but who will be signing documents in the city.
Whichever office is used, the usual points apply:
- A document that creates or transfers rights in immovable property, such as a release deed or a registered family settlement, must be registered.
- Section 26 of the Registration Act, 1908 lets a deed signed outside India be presented for registration once it has reached the country, within four months, though the registering officer has a discretion.
- Stamp duty and registration are worked out from the type of document and the value of the property. Both are payable separately. The West Bengal registration department’s portal has a calculation tool that should be used for the current position, instead of any figure from an article.
Where the NRI heir signs from abroad, the deed or the power of attorney needs the authentication described below. Our guide to NRI property documentation gives the full list of papers that an overseas heir is usually asked for.
Old Houses, Many Branches and the Dayabhaga Background
Some of Kolkata’s most valuable inheritances are old family houses in the north and south of the city, held by several branches of one family, often with shared staircases, courtyards and passages. These properties need more than a simple heir list.
West Bengal historically followed the Dayabhaga school of Hindu law, in which a son does not acquire an interest in family property by birth in the way the Mitakshara school describes, and shares are fixed when the owner dies. Since 1956, intestate succession among Hindus has been governed by the Hindu Succession Act, so a house left without a Will is divided among first-class heirs in equal shares, and daughters inherit alongside sons. But how the older generations held the property still matters. A house may have passed through a partition or a Will two generations ago, or one branch may have bought out another without proper registration.
For an NRI heir, the practical step is to prepare a chart before anyone signs: who owned the house at each earlier stage, what each branch received, and what documents prove it. A lawyer reading the family history can then calculate each person’s real share. Without that chart, a release deed signed in good faith may release the wrong thing.
Tenanted Houses and the Five-Year Question
A great many older Kolkata properties have tenants, sometimes families who have lived there for decades. An heir who inherits such a house steps into the landlord’s position. The death of the landlord does not end the tenancy.
The reverse question, what happens when the tenant dies, is covered by the West Bengal Premises Tenancy Act, 1997. Under the definition of tenant in Section 2(g), as commonly read, certain close relatives of a deceased tenant, including the spouse, son, daughter and parent, continue as tenants for a limited period of five years from the date of death. For residential premises, the five-year limit does not apply to a surviving spouse who meets the conditions of the Act. Because older tenancies and different kinds of premises can be governed differently, a lawyer should confirm which rule applies.
Three practical suggestions for an overseas heir:
- Ask the family representative for the rent register, receipts and any tenancy agreements before the property is mutated.
- Notify the tenant in writing, with copies of the heirship documents, so that rent continues to reach the right account.
- Do not attempt self-help eviction. A tenancy dispute belongs before the competent tenancy authority or court, and it can be resolved only on the strength of proper paperwork.
Authenticating Papers: Into Kolkata and Back Out
Papers cross the border in both directions in a Kolkata inheritance, and each direction has its own authentication. Start with documents the heir signs abroad for use in Kolkata. The right step depends on the country where the heir lives:
| Heir lives in | How the signed paper is made acceptable in India |
|---|---|
| United States, United Kingdom, Singapore or Australia | Notarise the document locally, then obtain an apostille, because these countries belong to the Hague Apostille Convention |
| United Arab Emirates | The UAE has not joined the Convention, so no apostille is available. The paper goes to the Embassy of India in Abu Dhabi or the Consulate General of India in Dubai for attestation |
| Germany | Germany objected to India’s accession, so the two countries rely on attestation rather than apostille |
| Canada | Canada acceded in 2024. Ask the receiving authority which route it expects before relying on an apostille |
Now the reverse direction. A Kolkata death certificate or heirship document is often wanted overseas, for example by a British or Gulf bank that needs proof of the death before it will speak to the family. For use in a Convention country, an Indian public document generally has to be authenticated first by the state authority concerned, which for West Bengal papers has been the Home Department, and then apostilled through the Ministry of External Affairs. That ministry has devolved the work to branch secretariats, and Kolkata has one. The sequence has changed over the years, so confirm it before posting originals, and keep scanned copies of everything.
Example: A Registered Will, a South Kolkata Flat and Two Countries
Picture a retired professor who passes away in Kolkata, leaving a registered Will that gives his south Kolkata flat to his two children in equal shares. His wife died some years before. His daughter works in Dubai and his son lives in London. A cousin in the city remarks that the Will was signed when the professor was already unwell.
The family’s first question is whether probate is needed. A Kolkata lawyer explains that, after the repeal of Section 213, probate is not compulsory by law. Because the cousin has hinted at a challenge, however, the family may want a grant of probate for protection, and the lawyer prepares to file a petition. The family chooses to proceed with probate and the KMC mutation in parallel.
Authentication comes next, and it differs for the two siblings. The daughter’s power of attorney is signed in Dubai and goes to the Indian Consulate General there for attestation. The son’s is signed before a London notary and receives an apostille. Both name the same Kolkata lawyer, who can file the probate petition, make the KMC application and deal with any registered documents.
The mutation application is made with the death certificate, the Will, the title papers, a No Outstanding Certificate and the affidavits. The probate petition is heard separately and runs on its own timeline. Over the following months, the municipal record is updated and the probate matter moves forward. The cousin’s concern is dealt with through the court process rather than family argument.
This is only an illustration. A real estate may involve different documents, and each office and court sets its own pace.
After Mutation: If the Family Decides to Sell
Selling is a separate decision, and nothing about mutation forces it. If the heirs do sell, the taxable gain is measured against what the late owner paid and from the date the late owner acquired the property, not from the date of the death. When the seller is an NRI, the buyer has to withhold tax under Section 393(2) of the Income-tax Act 2025 (earlier Section 195), which applies from 1 April 2026. A seller who expects the real gain to be small can apply for a certificate on Form 128 (earlier Form 13) so that withholding follows the gain rather than the whole sale amount.
The money normally lands in an NRO account. Moving it abroad is possible within an annual ceiling of USD 1 million per financial year, supported by Forms 145 and 146 (earlier 15CA and 15CB). Our guide to NRI property inheritance in India places these steps in the wider framework.
Inheriting is not a taxable event in India. A Kolkata house that stays in the family, is let to tenants or is occupied by a relative raises no tax question merely because it was inherited.
Document Checklist for a Kolkata Filing
- The death certificate, with a note of which civic body issued it.
- The Will with its registration particulars, or a written statement that the owner left no Will.
- Heirship proof in the form the receiving office has confirmed: affidavit, warish or legal heir certificate, or succession certificate.
- Identity papers for each heir: passport or OCI card, proof of address and PAN where held.
- Registered title deeds, earlier deeds in the chain and, for leasehold land, the lease deed.
- Latest KMC or other municipal tax receipt and a No Outstanding Certificate.
- For a flat, the owners’ association or society documents and the allotment papers.
- For a tenanted property, the rent register, receipts and tenancy papers.
- A family chart for old joint houses, showing earlier owners and shares.
- The power of attorney for the Kolkata representative, with the apostille or consular attestation that suits the country of signing.
Frequently Asked Questions
Is probate still required for a Will in Kolkata?
Not by law. Section 213 of the Indian Succession Act, 1925, which once applied to Wills of Hindus, Buddhists, Sikhs and Jains in Kolkata, was removed by the Repealing and Amending Act, 2025. Proceedings begun earlier are generally unaffected, and some banks, municipal offices or buyers may still ask whether the Will has been probated. A family that expects a challenge, or has heirs spread across countries, may still choose to obtain probate voluntarily.
Who issues a warish certificate in Kolkata?
It depends on the area and the purpose. In rural West Bengal, local revenue and panchayat authorities issue warish certificates. In Kolkata, the Collector’s office has said it issues legal heir certificates only for cases directed by government or government agencies, so private families often rely on a magistrate-sworn affidavit, a certificate from another authority or a court-issued succession certificate. The most reliable approach is to ask the office receiving the document which form of heirship proof it will accept.
Can an NRI heir complete KMC mutation without visiting Kolkata?
Usually yes. An NRI heir can sign a power of attorney abroad, have it apostilled or attested for the country concerned, and appoint a Kolkata representative to file the mutation application and follow it up. Some offices may ask for a personal appearance or an additional identity verification in particular cases, so the relevant KMC unit, or the municipal body of Howrah or Bidhannagar, should be asked before any travel is booked.
What happens to a Salt Lake leasehold plot when the lessee dies?
The legal heirs apply for mutation of the lease to the competent officer of the Urban Development and Municipal Affairs Department, which for Bidhannagar is the Land Manager. The department’s published format has asked for the death certificate, an heirship affidavit affirmed before a magistrate, a relationship certificate from a prescribed officer and certain land ceiling affidavits. Mutation is subject to the terms of the original lease, so the lease deed should be read carefully.
What happens to tenants when I inherit a tenanted house in Kolkata?
The tenancy generally continues with the heirs stepping into the landlord’s position. If the tenant dies, the West Bengal Premises Tenancy Act, 1997 allows certain close relatives, such as the spouse, son, daughter and parent, to continue for a limited period, with a different rule for a surviving spouse in residential premises. Older tenancies may be treated differently, and any eviction must follow proper legal process instead of self-help.
Is there any tax when an NRI inherits property in Kolkata?
No. India has no inheritance tax, so becoming the owner of a Kolkata property triggers no tax. Tax is considered only if the heir sells, and the gain is then worked out from the late owner’s purchase value and acquisition date. When the seller is an NRI, the buyer’s withholding follows Section 393(2) of the Income-tax Act 2025 (earlier Section 195), and the seller can ask for a lower certificate on Form 128 if the actual gain is modest.
