NRI Property Transfer After Death in Pune: What's Different

In Pune, the biggest difference for an NRI heir is a Maharashtra stamping rule: a power of attorney signed abroad generally has to be stamped within three months of first being received in the state. The rest of the journey follows the national pattern, but the record that must be updated depends on where the property sits. PropResolve maps those local steps before anything is filed.

What Changes in Pune and What Does Not

Succession law does not change from city to city. A Hindu who dies without a Will is governed by the Hindu Succession Act, 1956, a Will is read under the Indian Succession Act, 1925, and an NRI or OCI heir can inherit under FEMA. Income-tax rules on a later sale are national as well. If you want the national picture first, our guide to NRI property inheritance in India covers it.

What changes in Pune is the paperwork around the property. These are the local differences that matter most:

  • Stamping of an overseas power of attorney: Maharashtra applies a three-month window that runs from first receipt in the state.
  • Several record systems: a flat in the city, a house in Pimpri Chinchwad, a plot in a cantonment and a field on the outskirts are updated by different offices.
  • Housing society step: most Pune flats sit inside a co-operative housing society that keeps its own membership record.
  • Market-value stamp duty: duty on family transfers is anchored to Maharashtra’s Ready Reckoner rates, not to what the family says the property is worth.
  • Language: revenue records and mutation notices are often in Marathi, so the family needs someone local who reads them and responds on time.

The Three-Month Stamping Rule for a Power of Attorney Signed Abroad

Most NRI heirs run the Pune process through a trusted person in India, which means a power of attorney signed abroad. Under Section 18 of the Maharashtra Stamp Act, an instrument signed only outside India may be stamped within three months after it is first received in Maharashtra. The clock starts on arrival in the state, not on the date of signing.

That detail catches families out. A document signed in the first week of a month can sit in a courier depot, then at a relative’s home, and nobody notes the arrival date. By the time a bank, society or registrar asks for it, the window may be close to closing or already shut.

How to handle it in practice:

  1. Decide who will receive the original in Maharashtra before it is dispatched, and write down the date it arrives.
  2. Ask local counsel to assess the duty payable on that specific power of attorney, since the duty depends on what the document authorises.
  3. Have the attorney holder take the original to the stamp authority (the Collector of Stamps handles this) well inside the three months.
  4. Keep the stamped original and a few certified copies, because different offices will each want to see it.

Stamping is a different step from registration. Section 26 of the Registration Act, 1908 separately allows a document executed outside India to be presented for registration within four months of reaching India, at the registering officer’s discretion. The two periods are not the same, so treat each on its own calendar.

Late stamping is generally possible but usually attracts a penalty on top of the duty. Some documents signed abroad on Indian stamp paper of the right value can be treated differently. Do not rely on that without asking the stamp office. This three-month rule is a Maharashtra rule and should not be assumed in other states.

Which Record Gets Updated Depends on Where the Property Sits

The word “Pune” covers several administrative worlds. Before filing anything, confirm which authority holds the live record for your property. The table below gives the usual pattern. Offices differ in practice, so confirm with the office concerned.

Property typeRecord that usually mattersWho typically updates it
Flat or house inside Pune Municipal Corporation limitsMunicipal property tax assessment, plus society record for a flatPune Municipal Corporation and the society

Plot within a surveyed city areaProperty cardCity Survey Office
House in a village or peripheral areaGram panchayat property registerGram panchayat
Agricultural land7/12 extract and the mutation (ferfar) entryTalathi and the revenue office

For land governed by the Maharashtra Land Revenue Code, mutation works through the talathi. Where a registered document is the basis of the change, the registering authority reports it. Where the change comes by inheritance, the heirs are expected to report it to the talathi, and the code sets a short period for that report. Confirm the current period with the local office.

The talathi then enters the change in the register of mutations and puts up a notice for interested persons. Two cautions follow. First, a notice delivered in Marathi to an address in Pune can easily be missed by a family abroad, so the attorney holder should check for it. Second, a mutation entry is a revenue record. Courts have repeatedly said it does not by itself decide ownership, which is why a clean heir document and, where needed, a release deed still matter. Our guide on NRI property transfer explains how these pieces fit together.

Housing Society Transfer for a Pune Flat

A large share of Pune’s housing stock is flats in co-operative societies. For these, the municipal record is only one half of the work. The society holds the deceased owner’s share certificate and membership, and the society has to record the new member or members.

Societies commonly ask for the following, though each managing committee has its own habits:

  • the death certificate of the member
  • the share certificate and the latest maintenance receipts
  • the nomination form, if the member filed one
  • proof of who the heirs are, such as a legal heir certificate
  • consent or no-objection letters from the other heirs, or a registered release deed if one heir is taking the flat
  • an undertaking or indemnity that the heirs will settle any later claim

A nominee is not automatically the owner. A nominee holds on behalf of all legal heirs, so a society that records only a nominee is recording a custodian, not settling ownership. If the heirs agree that one sibling will keep the flat, that agreement should be put into a registered release deed instead of being left to goodwill. Our guide to drafting a release deed for inherited property shows what such a deed contains.

Societies sometimes insist on documents the law does not strictly require. When that happens, a calm written request asking the society to point to the bye-law or rule it relies on usually moves the conversation forward faster than an argument.

Heir Proof in Pune: Certificate, Court Order or Neither

A legal heir certificate issued by the revenue authority is evidence of who the heirs are. It is not a court order and it usually does not by itself transfer title. A succession certificate from the District Court under Part X of the Indian Succession Act, 1925 is mainly useful for debts and securities, such as bank balances, shares and insurance. Letters of administration come into play for an intestate estate or where no executor exists, and probate is for Wills.

The process and even the naming of these documents differ by state and office. For the Pune angle specifically, see our page on the NRI legal heir certificate in Pune, which explains how applications are usually handled from abroad.

A point that matters for Pune families with a Will: Section 213 of the Indian Succession Act, which once made probate compulsory for certain Hindu Wills tied to the presidency towns of Bombay, Calcutta and Madras, never applied to Pune. It has now been removed by the Repealing and Amending Act, 2025. Probate is therefore not compulsory by statute anywhere in India. In practice, a bank, registrar or court may still ask for it, so ask each institution what it will accept and why.

For money held in banks, a succession certificate may be requested even when the property side needs none. Our overview of the NRI succession certificate helps you judge which documents you need and which only look necessary.

Land Around Pune: Extra Care for Agricultural and Peripheral Plots

Pune’s growth means many families own a slice of farmland or a rural-style plot on the edge of the city, often inherited decades ago and mutated only partly. Three issues come up repeatedly.

  • Old entries: the 7/12 extract may still show a grandparent or an earlier generation, so several heirs must be added in sequence before the current heirs can act.
  • FEMA position: an NRI or OCI can inherit agricultural land but cannot purchase it. A later sale is generally only to a resident Indian citizen.
  • State land laws: Maharashtra has its own tenancy and agricultural land legislation that limits who can acquire farmland by purchase. Inheritance is treated differently from purchase, but the family should have local counsel read the 7/12 and any tenancy remarks before planning a sale.

Treat farmland as a separate workstream from the flat or house in an estate. The documents, the timelines and the pool of eligible buyers are all different, and mixing them delays the straightforward parts.

How Stamp Duty Is Worked Out for Family Transfers in Maharashtra

If the heirs sign a release deed or a family arrangement, stamp duty applies. We do not state rates here because they change and depend on the instrument. What helps is knowing how the figure is reached.

  • Duty is generally determined by the market value of the property, with reference to the Ready Reckoner (the state’s annual statement of rates), or by the stated consideration where that is higher.
  • Maharashtra gives concessional treatment to certain transfers between close family members. Whether your deed qualifies depends on its wording and on who the parties are.
  • A registration levy is collected separately from stamp duty.
  • Payment and the franking record are made online through the state’s stamps and registration systems.

Before finalising a deed, check the current position on the official portal of the Inspector General of Registration and Controller of Stamps, Maharashtra, and ask the sub-registrar’s office how it will value the property. Surprises at the counter are usually valuation surprises.

Example: A Pune Flat, Three Siblings and a Courier Parcel

Consider an anonymous family. The father owned a flat in a co-operative society in western Pune and died without a Will. His wife had died earlier. The three children are one daughter in Singapore, one son in California and one son in Pune. All three agree the Pune son will keep the flat.

The Singapore daughter and the California son sign separate special powers of attorney in favour of their brother in Pune. Singapore and the United States are Hague Apostille Convention members, so each document is notarised and then apostilled. The two parcels arrive in Pune a few weeks apart.

Here is where the family nearly stumbles. The first parcel is received by a neighbour and passed to the brother weeks later. Nobody writes down when it first reached Maharashtra. When the housing society asks for stamped authority, several months have gone by, and the family cannot say with confidence whether the three-month window has closed.

Their local counsel treats it as a documentation problem. The dates of courier delivery are reconstructed from the courier’s tracking record and the neighbour’s confirmation, the documents are presented to the stamp authority, and any shortfall is dealt with as the authority directs. The family then moves on to the release deed, the society transfer and the municipal record.

The lesson is simple and takes almost no effort: record the arrival date, calendar the three months, and stamp before the society or the registrar asks. Even with an agreeable family, a small administrative gap can add months.

Checklist Before You Instruct Anyone in Pune

  • Death certificate of the owner, with several certified copies
  • Title documents: sale deed or allotment letter, share certificate for a flat, 7/12 extract or property card for land
  • Latest property tax receipt and society maintenance receipt
  • Will, if one exists, and details of the executor
  • List of all legal heirs with relationships, ages and current addresses
  • Passport, OCI card and address proof of each overseas heir, self-attested as the office requires
  • Power of attorney signed abroad, with apostille or Indian embassy or consulate attestation as the country requires
  • A written note of the date the power of attorney first reached Maharashtra
  • PAN of each heir, which banks and registrars usually need
  • Contact details of the society secretary, the talathi or ward office, and a trusted local representative

For overseas documents, remember the country matters. The United States, United Kingdom, Singapore and Australia are Apostille Convention members. The UAE is not, so papers signed there go to the Indian Embassy in Abu Dhabi or the Consulate General in Dubai for attestation. Germany objected to India’s accession, so attestation applies between the two countries. PropResolve works with top law firms across India, which helps when the property, the heirs and the offices sit in different places.

Frequently Asked Questions

How long do I have to stamp a power of attorney signed abroad in Maharashtra?

Under Section 18 of the Maharashtra Stamp Act, an instrument signed only outside India may be stamped within three months of first being received in Maharashtra. The period runs from arrival in the state, not from signing. Record the delivery date and ask counsel to assess the duty before the period ends.

Can an NRI inherit property in Pune without visiting India?

Usually yes. Inheritance itself needs no visit to India, and a properly authenticated power of attorney lets a trusted person act in Pune. Some offices may ask for a personal appearance or video verification, so confirm with each office. Documents signed abroad need apostille or embassy attestation, depending on the country.

Do I need probate to transfer inherited property in Pune?

Not by statute. Section 213 of the Indian Succession Act never applied to Pune and has now been removed, so probate is not compulsory anywhere. A bank, society or registrar may still ask for it in practice. Ask each one to state what it will accept, and why, before you start.

What is a 7/12 extract and why does it matter for inherited land near Pune?

The 7/12 extract is the revenue record of agricultural land showing the holder, crops and encumbrances. After an inheritance, the heirs’ names must be entered through a mutation entry. The entry supports revenue and tax purposes but does not by itself settle ownership, so keep heir documents and agreements safe.

Does the housing society have to transfer the flat to the heirs?

A society normally records the new member after the death of a member, subject to its bye-laws and the documents it reasonably asks for. A nominee holds for all heirs, not as sole owner. If one heir keeps the flat, a registered release deed from the others is the clean way to record that.

Is there tax on inherited property in Pune?

India has no inheritance tax, so receiving property is not taxed. Tax arises on a later sale, as capital gains, where the previous owner’s purchase value and holding period carry over to the heir. Non-resident sellers also face tax deduction at source on the sale, so plan the sale with a chartered accountant.

Conclusion

For an NRI heir, Pune is manageable once three local points are handled: stamp the power of attorney within three months of its first receipt in Maharashtra, identify which office holds the live record for your property, and settle the housing society step in writing. None of these needs a visit if the representative is well chosen and the documents are in order.
