Which Document Does an NRI Heir Need in Ahmedabad? The Short Answer

Short answer

Ahmedabad has no one paper that opens every door. A Varsai (heirship) certificate from the Mamlatdar's office usually serves pensions, utilities, societies and revenue entries, while some banks, fund houses and depositories ask for a court succession certificate or probate. Probate is not compulsory by statute: Section 213 of the Indian Succession Act was removed in December 2025, and it never applied here, since Ahmedabad was not a presidency town. Institutions still often insist on it. An NRI can run the whole process through a power of attorney and documents signed abroad.

  • Offices mapped: Mamlatdar, AMC, society, Sub-Registrar and civil court, matched to each asset
  • No flight needed: Sign before a notary where you live while an Ahmedabad advocate attends

What Did Your Parent Leave in Ahmedabad? Pick the Row That Fits

Ahmedabad estates rarely arrive in one piece. A society flat, a savings account at a Ghatlodiya branch and a field in Sanand taluka each answer to a different desk. Find the row closest to your situation, and we will confirm with the institution before any paper is signed overseas.

These rows overlap in real life. One Ahmedabad family may need a Varsai certificate for the pension, a committee resolution for the flat, a court order for the fund units and a nondh for a field. We order the filings so a single signed set covers all of them.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

Which Ahmedabad Body Holds Which Record: From the Walled City to the Ring Road

An Ahmedabad address printed on a letter hides several administrations. The office that registers a death, the body that taxes the building, the desk that holds the land entry and the revenue officer who signs a Varsai certificate are often four different places. Knowing which is which before anything is signed abroad saves a returned file.

Inside the municipal limits. The Amdavad Municipal Corporation, usually shortened to AMC, works through seven zones: Central, East, West, North, South, North West and South West, each divided into wards. The walled city, with Khadia, Dariapur, Shahpur and Jamalpur, falls in the Central zone. Navrangpura, Paldi, Vasna, Naranpura and Ranip sit in the West zone, Maninagar and Isanpur in the South, Naroda and Bapunagar in the North, Nikol, Odhav and Vastral in the East, Thaltej, Bodakdev and Gota in the North West, and Sarkhej and Vejalpur in the South West. The zone matters because the property-tax assessment is kept by that zone's office.

Outside the corporation but still Ahmedabad. Beyond AMC lies the wider planning area overseen by the Ahmedabad Urban Development Authority (AUDA), where villages and smaller local bodies maintain their own records, and further out are the rural talukas of Daskroi, Sanand, Bavla, Dholka and Viramgam. City limits have been redrawn more than once in recent years, so a locality that once belonged to a panchayat may now sit inside AMC. Read the heading on the latest tax bill instead of trusting the postal line.

The east and west talukas. For the urban area, the revenue administration is divided into Ahmedabad City East and Ahmedabad City West, broadly on either side of the Sabarmati. A flat in Vejalpur and a house in Maninagar can therefore sit under different Mamlatdar jurisdictions even though both carry the same city name. We confirm the office with the Collectorate before drafting, because an application lodged at the wrong desk is usually sent back and not forwarded.

The Gandhinagar line. Gandhinagar is a separate district with its own Collector and its own municipal corporation. A family that holds a flat in Satellite and a plot at Sargasan or Kudasan is in practice dealing with two Collectorates, two sets of land records and, for a court petition, possibly two courts.

Where the death was registered. A death certificate follows the place of death, not the family home. A parent who lived in Navrangpura but died in a hospital across the district line leaves a certificate from that other body, while the flat stays on AMC's books. That is normal. Each later office only needs to be satisfied that the person is the same, so the identity details must match across every paper.

Plot references. Much of the city was laid out through Town Planning Schemes, so property papers often cite a scheme number, an Original Plot and a Final Plot number. Copy those references exactly. The survey record, the sale deed and the tax bill all have to describe one and the same plot, and a transposed digit can hold up a file for weeks.

Moving an Ahmedabad Flat to the Heirs: Society, Apartment Association, AMC Tax and Torrent Power

For most families abroad, the flat is the largest item in an Ahmedabad estate, and it moves through several hands before it is fully in the heirs' names. Two structures are common. Older blocks in Navrangpura, Naranpura, Maninagar and Paldi are often co-operative housing societies registered under Gujarat's co-operative law. Newer towers along the western belt may instead be run by an association of flat owners, where each owner holds a flat through a registered deed. The paperwork differs, so we first learn which structure applies.

If the block is a co-operative society. The society's bye-laws and the state's co-operative law provide for the share and interest of a deceased member to pass to the nominee or, failing a nominee, to the heirs the committee recognises. A nominee is generally treated as holding for all the legal heirs, not as the only owner. A typical Ahmedabad committee wants a letter of request, the death certificate, the original share certificate, written consent or a sworn list from the remaining heirs, and frequently a bond of indemnity. A running housing loan or a dispute among heirs can lead the committee to ask for a court document. Once the committee passes its resolution, a fresh share certificate is issued to the heirs.

If it is an owners' association. Title rests on the registered deed, so the heirs establish their position with the heirship papers, and any transfer among themselves is documented by a deed lodged with the Sub-Registrar. The association then updates its register and its maintenance billing. Its bye-laws and declaration set out any extra steps, and we read them first.

The AMC property-tax record. After the society or association has recognised the heirs, the assessment name at AMC can be amended. The corporation usually wants the heirship document, the society's confirmation and the newest tax receipt, and arrears stay attached to the property, so any balance should be settled first. A sole heir can often change the name on the strength of the Varsai certificate alone, while several heirs usually need their consent set out in writing. Requirements shift, so we check the current checklist with the zone office.

Torrent Power and other utilities. Electricity in most of the city is supplied by Torrent Power, and the meter changes hands on an application supported by the death certificate, evidence of heirship and the society's letter. In outlying areas the supplier may be the state distribution company instead. Water and drainage connections sit with the corporation, and piped gas with the city gas distributor concerned. Dues left by the deceased normally stay with the premises, so ask each supplier for a clear statement before the name changes.

The redevelopment trap. Several older societies in the central and eastern parts of the city have begun redevelopment talks. A deceased member whose heirship was never recorded can hold up the society's deal with a developer, because each member must consent. From abroad, make sure your power of attorney names redevelopment consents specifically. A vague general clause may not satisfy a developer's advisers.

Pol Houses, Chawls and Notified Areas: Ahmedabad's Older Property

Ahmedabad's walled city, a World Heritage site, is made of pols: clusters of houses around a shared lane and a gate. A pol house is often owned by many cousins who each inherited a fraction from a grandfather or great-grandfather. Overseas heirs who think they are sharing a house with a sibling sometimes find that ten other people also hold a piece.

Recording the chain. If an earlier owner died without the land record being updated, that death has to be dealt with before yours. The Mamlatdar may be asked to record several generations, each with its own family tree. Start from the last name on the city survey property card and work forward, not backward from the family story. We usually ask relatives in Khadia, Kalupur or Dariapur to photograph every old receipt and card they can find.

City survey records. In areas under city survey, ownership is shown on a property card kept by the City Survey office. Heirs' names enter that card through a separate application based on the heirship papers, and it should be done before a sale or a split among heirs. Confirm with the office which entry applies to your plot.

Notified disturbed areas. Under Gujarat's disturbed areas law, a sale of immovable property inside a notified area needs the prior permission of the Collector. Inheritance itself is not a sale, but heirs who later sell, or who plan a transfer among themselves that looks like a sale, may be asked about it. Check early whether the address falls in a notified locality, because the permission step adds its own papers, including declarations from the seller and the buyer.

Tenancies and shared lanes. Older chawls and mill-area properties may have long-standing tenants or protected occupants whose rights pass to their own heirs. Shared walls, common lanes and heritage rules for the old city can also limit what a buyer will pay for or accept. A buyer's lawyer will usually ask to see the whole chain of title, so a clean record is worth building early.

Why this matters abroad. A sibling in London and a cousin in Nairobi may each hold a share without having spoken for years. The more heirs there are, the more important it is to collect consents in one coordinated round, so that nobody has to sign twice. Our representative can gather the Ahmedabad signatures while you complete yours overseas.

Inherited Farm Land Around Ahmedabad: Varsai Nondh, Village Form 6 and anyROR

A good number of Ahmedabad families own a field in Daskroi, Sanand, Bavla, Dholka or Viramgam taluka that never moved into the next generation's name. Such land belongs to the village revenue system and not to the municipal one, and its story is told by three records: the 7/12 extract (Village Forms 7 and 12), which shows who holds the land and how it is used, Village Form 8A, which groups a person's holdings in one account, and Village Form 6, the register of entries.

How a Varsai nondh runs. The heirs inform the village Talati of the death, handing over the death certificate and papers showing who the heirs are, and the Talati makes a numbered entry in Village Form 6. Notice goes to those who may be affected, a period for objections follows, and a revenue officer then certifies the entry. If someone objects, the matter moves to a higher officer and can end up before the Mamlatdar. After certification the updated 7/12 appears in the state's land-records portal, anyROR, and applications can often be started through the i-ORA online system. Taluka offices differ in practice, so we check the present steps.

Study the existing extract. An old 7/12 sheet may still show a previous generation, a different spelling of a name, a tenant, or a bank loan recorded in the other-rights column. Every such item needs an explanation or a clearance. Land that is shown as a joint holding may also be split between heirs in shares that look odd at first sight.

Inheriting is allowed, buying is not. Under FEMA, an NRI or OCI cardholder may inherit agricultural land but cannot buy it, and any later sale is generally limited to a resident Indian citizen. Gujarat's own tenancy and agricultural land law restricts the pool of buyers even more, and some categories of land need the Collector's permission to be sold. Land near Sanand or Bavla that has already been converted to non-agricultural use follows a different path. Do not plan a sale until the 7/12 or the property card shows every heir.

If one heir takes over the field. A sister in Ahmedabad may wish to hold the field while her brother in Houston steps aside. In Gujarat this is normally achieved with a registered relinquishment document, called a hakk kami deed locally, followed by an entry in the record. If the relinquisher signs overseas, the deed is notarised, then apostilled or attested, and Section 26 of the Registration Act, 1908 lets the registering officer accept it for registration within four months after it reaches India, at that officer's discretion. Gujarat stamp law has its own rule for papers first received in the state, which we check and complete.

The limits of an entry. The nondh corrects the revenue record but cannot decide who truly owns the field, so a real family quarrel is settled by a civil court. Lenders, purchasers and revenue staff still trust a tidy 7/12, so finishing the entry early pays off.

The Court Route in Ahmedabad: City Civil Court, District Court and the High Court at Sola

When a bank, fund house or depositary wants a court order, the petition is presented to the civil court whose area covers the deceased's home at death or, if there was none, the place where the assets are found. Within the city that is typically the City Civil Court at Bhadra. For addresses outside the corporation, the Ahmedabad (Rural) District Court at Mirzapur and the taluka courts at Sanand, Dholka, Dhandhuka and Viramgam come into play. The right forum turns on the address and on what is being sought, so we confirm it with the registry before any drafting begins.

The High Court is not a stage in the process. The Gujarat High Court sits at Sola in Ahmedabad, and it is a single seat with no regional benches. It is not where an initial succession certificate or probate petition is heard. It becomes relevant if an order is appealed, or if a writ is filed against a revenue authority, for example over a refused nondh.

The life of a petition. Your advocate lodges the petition together with the heirs' sworn statements, the death certificate and a schedule of assets. The court orders public notice so that any objector can step forward, and it may require security before granting authority over debts and securities. With no objection, the order comes once the petitioner's evidence has been taken. Probate adds the original Will and testimony from the witnesses who attested it, and then goes through the same notice stage. For the differences between these court documents, see succession certificate versus letter of administration.

What the heir abroad contributes. Your sworn statements, consents and power of attorney are executed overseas and then apostilled or attested, while the Ahmedabad advocate does the filing and attending. An executor living abroad who is named in a Will may be asked for a personal statement, which we flag as soon as it looks probable. Where a court permits video attendance, we plan it around your calendar.

Where Ahmedabad petitions stall. Most delay comes from small slips. An incomplete list of assets means a second round of notices. A petition filed in the wrong court has to be moved. A mismatch between the name on the bank record and the name on the death certificate triggers a query. Heirs who are unreachable hold up the consent set. We try to catch each of these before the file leaves our desk.

Contested matters. Where an heir objects, the petition can turn into a contested proceeding, and the court then decides on evidence. That route is slower and may require a personal appearance. We tell you at the outset if the facts make that likely, and we try to restore consent by explaining what each person is legally entitled to before a petition becomes necessary.

Names and Surnames on Gujarati Papers, and Families Under Other Personal Laws

Gujarati names usually follow a three-part pattern: a given name, the father's name and the family surname. A man called Kirit might appear as Kiritbhai Maganbhai Shah on an Indian record and as Kirit Shah on a passport abroad. Suffixes such as bhai, ben, kumar and lal are added or dropped from one document to the next. Offices notice every such difference, and so do banks.

Married women. After marriage, a woman commonly takes her husband's given name as her middle name and his surname as her own. A daughter's link to her father therefore has to be shown through a birth or school record in her maiden name, together with the marriage certificate. If you are that daughter, collect both before anything is signed.

Spelling drift. Moving from Gujarati to English creates variants such as Bhatt and Bhat, Mehta and Mehata, or Gandhi and Ghandi. Aadhaar, the 7/12, the share certificate and the passport may each use a different one. The remedy is a short declaration that the different spellings belong to a single person. It is cleaner still to line the names up before filing, which is why we ask you to send scans early.

Children born abroad. A child born in the US, UK or Africa may carry the father's given name as a middle name, or none at all. The birth certificate that names both parents is the key document. Keep the passport and any name-change record with it.

Personal law. The Varsai certificate names heirs according to the law that governs the family. Hindus, Jains, Sikhs and Buddhists are covered by the Hindu Succession Act, 1956. Ahmedabad is also home to large Muslim, Parsi and Christian communities. Muslim heirs inherit under their personal law, which fixes different shares, and Parsi and Christian families are generally governed by the Indian Succession Act, 1925. The shares differ, so we state the family's religion and applicable law at the outset, and the affidavits are drafted to match.

Why it matters. A certificate that names the wrong share or the wrong spelling can be refused at the very desk that was meant to accept it, which means another round of courier and another round of signatures abroad. A little care with names at the start avoids that.

Why Heirs Abroad Struggle With the Ahmedabad Varsai Process

Heirs abroad struggle because the Mamlatdar’s inquiry is built around people who can appear in person. Heirs sign affidavits, independent witnesses give a panchnama, and the office may call the applicant in to confirm the family details.

Ahmedabad families are often spread across the US, UK, East Africa and the Gulf, so the usual picture is one heir in India and the rest overseas, with a flat or bank accounts waiting. The fix is a properly prepared set of papers signed abroad and a representative who attends the inquiry, acting under an NRI Power of Attorney. A faster counter does not solve it.

What an Ahmedabad Family Needs the Varsai Certificate For

  • Bank accounts and lockers: Banks in Ahmedabad usually ask for a heirship document before releasing balances or opening a locker. Each bank sets its own rule, so we ask the branch what it will accept before we file.
  • Flat or house records: The certificate supports the record update that follows, the revenue entry or property mutation and then the name change in AMC property tax records. It does not replace either step.
  • Housing society transfer: Co-operative housing societies typically ask for the death certificate, a heirship document and no-objection letters from the other heirs before changing the membership. The property transfer after death page explains the sequence.
  • Pension, PF and gratuity: Family pension, EPFO and gratuity claims normally need proof of who the heirs are.
  • Insurance, demat and mutual funds: Where there is no nominee, insurers and depositories ask for a heirship document, and some insist on a succession certificate instead. The institution decides.
  • Sale or partition: A buyer’s lawyer in Ahmedabad will ask who all the heirs are. One certificate answers that, and heirs abroad can sell later, subject to TDS and repatriation rules.

Who Issues the Certificate in Ahmedabad and How It Is Filed

In Ahmedabad the Varsai certificate comes from the revenue administration under the Collector and District Magistrate, through the Mamlatdar office at the Jan Seva Kendra near Ashram Road. The application is made on the Digital Gujarat portal or offline at that office. For an NRI legal heir certificate in Ahmedabad, we file it for you.

Ahmedabad City taluka was split in 2012 along the Sabarmati river into Ahmedabad City (East) and Ahmedabad City (West). Satellite lies west of the river, so we confirm with the Mamlatdar office which taluka covers the deceased’s address before filing.

One local detail matters. The Collectorate’s published Varsai certificate service page describes the certificate for direct heirs of a deceased pensioner and lists a pension-office letter and PPO copy among the documents. For the heirs of someone who owned a flat or held bank accounts, the Mamlatdar’s office decides what it will accept, and we confirm that first instead of assuming.

From First Call to Certificate: Eight Stages for an Ahmedabad Estate

You sign once abroad, and an Ahmedabad advocate with our representative handles everything that needs a person at the counter.

1

Assessment call

We ask what was left, in which part of Ahmedabad, and whether a Will exists. Then we say which Mamlatdar zone, society, AMC office or court each asset needs. A Satellite flat, a Daskroi field and a Gandhinagar plot usually mean separate tracks, so we map them before any drafting.

2

Document collection

You receive two lists: papers you hold abroad, and papers relatives can fetch in Ahmedabad, such as the AMC death certificate, the tax receipt and the society share certificate. Both sides work together so nobody waits, and we flag any name that differs between records.

3

Signing abroad

Drafts reach you first, then you sign before a notary where you live. Where your country belongs to the Hague Apostille Convention (the US, UK, Singapore and Australia are examples), an apostille is added. The UAE and Germany are not on that route and use attestation by the Indian Embassy or Consulate.

4

Originals to Ahmedabad

Scans go first, so an Ahmedabad advocate can compare each name and signature with Aadhaar, the death certificate and the land entry. The originals follow by courier. We also check what stamping Gujarat law needs on a power of attorney first received in the state, and complete it before use.

5

Filing and notice

For a Varsai certificate we apply on Digital Gujarat or at the Mamlatdar office, and revenue staff inquire locally. For a succession certificate or probate we petition the competent court, where notice invites objections. For land, the Talati opens the nondh and notice goes out.

6

Inquiry or hearing

Our representative attends the inquiry, brings witnesses for the panchnama and answers the office's queries. In a court matter the Ahmedabad advocate appears under your power of attorney and affidavits. If an officer or judge wants to hear from you, we plan it early, using video where it is permitted.

7

Certificate issued, then put to use

Once the certificate arrives, we work through the order each institution will accept: society transfer, AMC name change, the entry in Village Form 6 or the property card, the Torrent Power meter, bank claims, demat and fund folios, and a release deed at the Sub-Registrar if one is needed.

8

Money home

Sale or maturity proceeds first reach an NRO account. Remittance abroad is permitted up to USD 1 million in a financial year, supported by Forms 15CA and 15CB (Forms 145 and 146 from 1 April 2026). Any TDS withheld by a buyer is settled first, and the heirship papers travel with the sale records.

Ahmedabad Document Checklist: What You Hold and What Family Can Fetch

Maintain a single scan folder where each name is spelled identically. Gujarati and English spellings, a dropped suffix or an initial are the most common causes of queries. If two papers differ, tell us early so the right declaration is drafted once, and not after a courier has already crossed the ocean.

From you (abroad)

  • Passport and your OCI card or residence permit
  • PAN card, which banks, tax filings and a later sale all require
  • Power of attorney, signed before a notary and apostilled or attested by the Indian Embassy or Consulate
  • Your own affidavit naming every heir you know of, and a no-objection consent if you are stepping aside
  • Proof of your overseas address, in the name shown on your passport
  • Specimen signatures and passport-size photographs as the Mamlatdar's office requires
  • A short declaration covering any spelling variation between your passport and Indian records

From family or records in India

  • AMC death certificate, or the certificate from the body where the death occurred, in several certified copies
  • Pedhinamu from the Talati or revenue office, with Aadhaar and ration card of the heirs living in Ahmedabad
  • Latest AMC property tax receipt, and the society share certificate or maintenance bill
  • Property card or 7/12 extract downloaded from anyROR, with any earlier entries
  • Registered sale deed or allotment letter, and for a plot the TP Scheme and Final Plot details
  • Bank passbooks, FD receipts, locker details, demat, insurance and mutual fund statements
  • Birth, school-leaving and marriage certificates linking each heir to the deceased, including a daughter's maiden-name record

Illustrative Example: An NRI Legal Heir Certificate in Ahmedabad for a Satellite Flat

Illustrative example (a fictional case, not a real client). Hardik is a pharmacist in New Jersey, USA. His father died at home in a flat in Satellite, Ahmedabad, leaving the flat and two bank accounts, with no will. Hardik’s mother and his sister, who lives in Ahmedabad, survive him. Under Section 8 of the Hindu Succession Act, 1956, the mother, Hardik and his sister are all Class I heirs.

Day by day

  • Day 1: The death is reported to the Ahmedabad Municipal Corporation; registration has a 21-day window.
  • Day 7: The AMC death certificate is available and Hardik messages us on WhatsApp. We review the case: a flat in a co-operative housing society, no will, two banks. We ask both branches in writing what they accept. One takes a Varsai certificate with its own indemnity form. The other says it may want a succession certificate above a certain balance, so we note that for later.
  • Day 9: We send drafts of the Power of Attorney, Hardik’s affidavit, the affidavits for his mother and sister, and the pedhinamu statement.
  • Day 12: Hardik signs before a notary in New Jersey and sends the papers for apostille through the state’s apostille office. His mother and sister sign before a notary in Ahmedabad the same week.
  • Day 19: The apostilled originals go out by courier and reach our Ahmedabad office on Day 23.
  • Day 25: Our representative files on Digital Gujarat and lodges the set at the Mamlatdar office, after confirming that the Ahmedabad City (West) taluka covers the Satellite address.
  • Day 31 to 50: The inquiry. Two neighbours from the society give panchnama statements with our representative present. The office queries the spelling of the mother’s name, and a short corrective affidavit settles it.
  • Day 84: The certificate is issued, 59 days after filing and close to the 60 days the Collectorate lists. We scan it to Hardik and courier the original.
  • After Day 84: The bank claims proceed, and we plan the society transfer and the AMC property tax name change. Hardik decides to hold the flat for now and let his mother stay there.

What the example shows

The certificate took about three months from the death, and the early delay was papers crossing the Atlantic, not the Mamlatdar’s office. Real timings vary. If Hardik sells later, TDS under Section 195 (Section 393(2) of the Income-tax Act, 2025 from 1 April 2026) applies to the full sale consideration unless he obtains a Lower/Nil Deduction Certificate (Form 13 (now Form 128), TRACES), and repatriation of sale proceeds is capped at USD 1 million per financial year (Forms 15CA/15CB). Our posts on selling inherited property as an NRI and TDS on sale of inherited property cover the rules.

Why Overseas Gujarati Families Hand Their Ahmedabad Estates to PropResolve

  • Local filing, remote control: Advocates who attend the Mamlatdar offices, AMC zones, Sub-Registrar and civil courts mean each paper goes to the desk that will accept it.
  • One plan for every asset: A flat, a bank balance and a field rarely need the same document, so we sequence them and avoid repeating applications.
  • Signing handled once: Affidavits, consents and the power of attorney are drafted to cover the society, the revenue office and the court together, so you are not asked to sign again.

Frequently Asked Questions

Do I have to travel to Ahmedabad to settle my late father's estate?

In most uncontested cases you can stay where you are. Your signature on a power of attorney and an affidavit, witnessed by a notary in your own country, lets an Ahmedabad lawyer take your place at the counter and at any inquiry. The scenario that could bring you back is a dispute: if a relative objects, or an official wishes to question you in person, a visit may be suggested. We name that possibility during the first call. Family members living locally usually only confirm a few details.

A bank's willingness to rely on the Varsai certificate depends on its own internal policy, the size of the balance and sometimes the branch. Small savings balances often move on it. Big fixed deposits, lockers and securities tend to trigger a request for something stronger, namely a court-issued document. Write to the branch and ask what its legal department will take for your particular account, then choose the route. That single letter can save a whole round of paperwork, and we send it for you at the outset.

Is probate still needed for a Will in Ahmedabad?

+
No law forces probate today, and for Ahmedabad none ever did. The old Section 213 of the Indian Succession Act, which blocked enforcement of a Will without probate, only covered Wills linked to Bombay, Calcutta and Madras. The Repealing and Amending Act, 2025 deleted the section, with assent on 20 December 2025. Practice has not caught up everywhere: lenders, registrars and depositories continue to ask for a probated Will since it settles any doubt about authenticity. Ask first, then decide.

My mother named me nominee for her society flat. Am I the owner?

+
Being named nominee gives you a right to be admitted by the society, which is not quite the same as keeping the flat. Courts have described a nominee as holding on behalf of every legal heir. A widow, brothers and sisters therefore retain their legal shares even after the society changes its register. Ahmedabad committees often protect themselves by seeking consent letters from all heirs, a bond of indemnity, or a court order. Where a family member disagrees, the nomination alone seldom ends the argument.

How do I sign from the US, UK or UAE so that Ahmedabad offices accept my papers?

+
Visit a notary public, sign in front of them, and then complete the second step that suits your country. In the US, UK, Singapore and Australia, the second step is an apostille from the competent authority. The UAE sits outside the Convention, and Germany is not an apostille route for India, so those papers need attestation at the Indian Embassy or Consulate. We email drafts first and review passport details with you, so that the notary sees finished wording and no re-signing is needed.

What can my representative do under the power of attorney?

+
Think of the power of attorney as a list of permissions given to one named person in Ahmedabad. Typical items include lodging applications, giving sworn statements on your behalf, attending the Mamlatdar, Talati, civil court, AMC office and Sub-Registrar, collecting certificates, and following up with banks and societies. Selling property is normally excluded unless the document says so in plain words. Documents executed abroad also meet Gujarat stamp and registration requirements, which we verify. For wider background, read our NRI power of attorney guide.

Can an NRI or OCI cardholder inherit farm land in Daskroi or Sanand?

+
Yes, inheriting is allowed even though buying is not. Under FEMA, an NRI or OCI cardholder can take farm land as an heir. The record is corrected through a nondh in Village Form 6, after which the 7/12 shows the heirs' names. Selling needs more thought, since the buyer must generally be a resident Indian citizen, and Gujarat's tenancy and agricultural land law can restrict the buyers or call for permission. Fix the record first, then take advice on a sale.

How do I move the money abroad once an Ahmedabad asset is sold or matures?

+
Proceeds land in your NRO account. Moving money overseas is generally allowed within a ceiling of USD 1 million in each financial year, supported by Form 15CA and a chartered accountant's certificate in Form 15CB. These carry new numbers, Forms 145 and 146, from 1 April 2026. Banks ask for supporting papers, so keep the heirship certificate, deed and tax records in one folder. Bigger sums or special cases can need Reserve Bank approval, which is why your accountant should see the full facts at an early stage.

Will India tax me for inheriting my parent's Ahmedabad flat?

+
India does not tax a person for receiving an inheritance, since there is no estate or inheritance tax. The tax question starts only on a later sale, when capital gains are calculated using the original owner's purchase value and the period for which the property was held. Rental income, if you let the flat out, is taxed as it comes in. Also check what your home country requires, because some countries tax or require reporting of foreign inherited assets.

One of my siblings in Ahmedabad refuses to sign. Can the matter go on?

+
A refusal slows things but does not always stop them. The society is unlikely to transfer the flat without that sibling's consent, and revenue staff may note the objection and send the parties to court. Where a court petition is filed, every heir receives notice, and a judge weighs evidence if there is a challenge. Often a lawyer who explains the share each person is legally entitled to can restore agreement before litigation begins. We try that conversation first.

How long will the Ahmedabad process take from my first call to the final transfer?

+
Nobody can honestly promise one number. The pace is set by the route: the Varsai inquiry takes as long as verification takes, a land nondh waits through its notice window, and a court case depends on notice, any objections and the judge's calendar. Your own courier and apostille time are added on top, and after the certificate come the society and bank steps. In the first call we outline the likely order for your assets and report back at each stage.

Can I apply for the Varsai certificate online?

+
Partly. The Digital Gujarat portal lists the revenue service: you register, enter applicant, family and deceased details, attach documents and submit. The same file can be taken to a Mamlatdar office or Jan Seva Kendra. Submitting online does not skip the field inquiry, since staff still verify the family. A stamp-paper affidavit and local checks keep the process anchored in Gujarat, so overseas heirs typically act through a representative. Because forms are revised from time to time, we confirm the latest version first.

How is a Mamlatdar's Varsai certificate different from a court's succession certificate?

+
Think of the Varsai certificate as a revenue department record: after an inquiry, the Mamlatdar's office lists the family members. No judge is involved. A succession certificate, by contrast, is a civil court order made under the Indian Succession Act following a petition, public notice and hearing, and it lets the holder collect debts and securities such as deposits, units and shares. Which document an institution asks for is its own decision, and a few ask for both. Our NRI succession certificate page covers the court track.

My parent's flat is in Ahmedabad but there is also a plot in Gandhinagar. Does that change the paperwork?

+
It does. Gandhinagar is its own district, with a separate Collector, municipal corporation and set of land records, so a plot there is handled through that district's revenue and civic offices. The society and bank steps for the Ahmedabad flat proceed in the usual way. The court can differ, depending on where the deceased lived or where the asset lies. We draft one coordinated set of papers for both districts so that you are not asked to sign a second time.

Who deducts tax when an NRI sells an inherited Ahmedabad flat?

+
A buyer paying an NRI seller must withhold tax. The rule sat in Section 195 of the Income-tax Act, 1961 and moves to Section 393(2) of the Income-tax Act, 2025 from 1 April 2026. It typically applies to the entire consideration, not only the profit, which is why sellers seek a certificate for lower or nil deduction (Form 128 on TRACES, earlier Form 13) before closing. The remittance ceiling then applies to what reaches you. Read our guide to FEMA rules for selling inherited property for the exchange control side.

My family is Muslim, Parsi or Christian. Is the process different?

+
The filing steps look alike, but the entitlements do not. Hindus, Jains, Sikhs and Buddhists follow the Hindu Succession Act, 1956. A Muslim family inherits under Muslim personal law, which splits an estate in a different pattern. Parsi and Christian families generally come under the Indian Succession Act, 1925. Affidavits and the family tree must state the correct law and each person's share, so we raise religion and applicable law in the first conversation and draft accordingly.

What if my father's house is in a notified area of Ahmedabad?

+
Inheriting the house is not a sale, so the Varsai certificate and the record entry follow the ordinary path. The extra hurdle appears when the heirs later sell: under Gujarat's disturbed areas law, a transfer of property inside a notified area needs the Collector's prior permission. Find out early whether the address is notified. Schedule any sale for after the heirs' names appear in the record, and expect the permission step to bring declarations and papers of its own.
