Which Document Does an NRI Heir Need in Kanpur? The Short Answer

Short answer

Kanpur rarely runs on one paper. The Tehsildar's heirship certificate usually settles pensions, utility connections and the Nagar Nigam house record, while banks, fund houses and depositories often ask for a succession certificate from the District Judge, Kanpur Nagar, or probate where a Will exists. Section 213 of the Indian Succession Act was removed in December 2025 and never applied to Kanpur, so probate was never compulsory here by statute, yet institutions still commonly insist on it. An NRI can run the whole process through a power of attorney and documents signed before a notary abroad.

  • Heirship: Tehsildar of the Kanpur Nagar tehsil that covers the address, applied for through e-District UP or at the tehsil.
  • Court papers: succession certificate or probate before the District Judge, Kanpur Nagar; appeals go to the Allahabad High Court at Prayagraj.
  • House record: dakhil kharij at Kanpur Nagar Nigam, or at the Cantonment Board for a house inside cantonment limits.
  • Farm land: khatauni entry through the Revenue Inspector and Tehsildar under the U.P. Revenue Code, 2006.

Heirship Certificate, Succession Certificate or Probate: What Does Your Kanpur Asset Ask For?

Kanpur estates tend to be a mixture: a family house with a long paper trail, a few bank deposits, perhaps a share in an old trading firm and a field in a village. Find the row that matches the item worrying you, then check what the institution will accept before anything is signed overseas.

The allotment, lease or registry stays in the dead owner's name until the authority records the heirs, usually on heirship proof, affidavits and clearance of dues. NRI property transfer

Agricultural land in a Kanpur Nagar village, or in Unnao, Kanpur Dehat or FatehpurKhatauni succession entry
Succession is reported to the Revenue Inspector and recorded after inquiry and a proclamation if anyone disputes it. Agricultural land follows the Revenue Code's own list of heirs.

Several rows usually apply at once. One Kanpur family may need the Tehsildar's certificate for a pension, a mutation for the house, a court certificate for the funds and a khatauni entry for a field. We line them up so a single signing abroad supports every filing.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

Reading a Kanpur Address: Nagar Nigam, Cantonment, KDA Colony or Village?

Kanpur looks like one city on an envelope, yet its records are split between several bodies. The body that registers the death, the body that taxes the building and the revenue office that signs the heirship certificate are often three different desks. Sorting the address first saves a returned file later.

Inside Nagar Nigam limits. Most of the central and older residential belt, including Civil Lines, Swaroop Nagar, Kakadeo, Govind Nagar, Kidwai Nagar, Arya Nagar, Shyam Nagar, Harsh Nagar and the trading districts of Colonelganj, Generalganj, Collectorganj and Naya Ganj, is municipal territory. Kanpur Nagar Nigam keeps the death register for deaths in its area, assesses house tax and runs the online dakhil kharij application, so an heir's first two documents usually come from the corporation.

Inside the cantonment. Kanpur also has a Cantonment Board, and houses within cantonment limits, such as those near the Parade ground, sit on the Board's records rather than the corporation's. Some of these properties are held on an old grant or lease with the Defence Estates Officer, which means the heirs need the grant or lease papers as well as any sale deed. A corporation tax receipt will not help there.

KDA and the city edge. The Kanpur Development Authority was set up in 1974 under the Uttar Pradesh Urban Planning and Development Act, 1973, and its planning area has grown beyond the older city. On the outer belt toward Panki, Barra, Kalyanpur and Jajmau, a plot can lie in the Authority's area, in municipal limits, or in a revenue village, so the bill or deed heading is the guide, not the colony name.

Villages. Farm and village land in Kanpur Nagar's tehsils is a revenue matter handled by the Lekhpal and Revenue Inspector, not by any municipal office. Land in Kanpur Dehat belongs to a separate district altogether.

Where the death was registered. A death is registered where it happens. Kanpur's large hospitals draw patients from Unnao, Kanpur Dehat, Fatehpur and nearby districts, so a parent who lived in a village and died in a Kanpur hospital leaves a Kanpur record, while the land stays in the home district. Overseas heirs sometimes find that alarming. It is normal, provided the name, father's name and age match across every paper.

Before any signing abroad we write down, for each asset, which body keeps its record and which office decides, so the power of attorney names every office it will need to reach.

Old Mohalla Houses and Joint Families: When the Paper Trail Stops Two Generations Back

Many Kanpur families still live in, or rent out, a house that a grandfather bought in a mohalla such as Gwaltoli, Colonelganj, Chamanganj or Birhana Road. The deed may be in an older style of drafting, the corporation tax bill may carry the grandfather's name, and nobody ever applied to change it. By the time a grandchild abroad asks for a certificate, two or three successions are waiting to be recorded.

Each missing link needs explaining. Heirs of the grandfather, then heirs of the father, each have to be shown in turn. That means a death record for every person in the chain. Where an older death was never registered, a delayed registration route exists, and after a long gap it usually needs an order from a magistrate, so it is worth starting early. Family register extracts, school leaving records, ration cards and old voter lists help to prove who belonged to the family.

Daughters in joint property. Under the Hindu Succession Act as amended in 2005, a daughter is a coparcener in a Hindu joint family by birth, with the same share as a son. A house that the family always called the brothers' property may therefore have married sisters, in Kanpur or abroad, as co-owners. Overlooking them is the commonest reason a later buyer's lawyer rejects the title.

Family settlement and the Nagar Nigam. The corporation's mutation list for a death case asks for the death certificate of the recorded owner and, for heirs who will not appear on the new record, a no-objection letter or registered family settlement along with their identity proof. If you are an overseas heir who wishes to step aside, that signed consent or release is your contribution. A release deed has to be registered in Kanpur, and a deed signed abroad can be presented for registration within four months of reaching India under Section 26 of the Registration Act, 1908, at the registering officer's discretion.

Tenants and shop-cum-houses. Older markets in Naya Ganj, Collectorganj and Generalganj carry shop-cum-residence buildings with long-standing tenants. The state's urban rent law deals separately with what happens to a tenancy or a landlord's rights on death, so a family with such premises should have the tenancy position checked rather than assume it follows the heirship certificate.

Where a parent held the house jointly with a brother who is also deceased, expect the file to cover both estates, and plan the signing abroad so that one set of affidavits serves both.

Nazul Plots, KDA Allotments and Awas Vikas Colonies: Check Who Really Owns the Land

In Kanpur, the thing a family calls its house is sometimes a building standing on land that belongs to someone else. Before anything is mutated, find out what kind of title the dead person actually had.

Nazul land. Parts of older Kanpur, including areas near Civil Lines, include Nazul land, which is government land that was leased to private persons long ago. A lease may have lapsed, its rent may be unpaid, and a conversion to outright ownership may never have been completed. News reports from Kanpur describe administrative action against Nazul plots sold without the permission the lease required. Rules on Nazul property in Uttar Pradesh have also been changing, so the current position must be checked with the district administration rather than assumed from an old document.

For an heir, the questions are plain. Is the plot on lease or fully owned? Is the lease valid and the rent paid? Does a transfer to heirs need the government's recorded consent? A heirship certificate answers none of these. It only names the family.

KDA schemes. The Kanpur Development Authority has allotted plots and flats for decades. If the allottee died before the registry or lease deed was completed, or while instalments were still due, the Authority's file will show it, and it will normally want proof of heirs, affidavits and clearance of any dues before it records the new names. The exact list of papers changes, so we ask the KDA office for its current list.

Awas Vikas Parishad colonies. Housing board colonies in Kanpur follow a similar pattern: allotment, instalments, registry, and then a transfer of the record to heirs through the Parishad's own office. Older allotments are the usual trouble spots, because the original papers may sit only in the Parishad's file.

Apartments and group housing. Newer complexes are run by an owners' association, and the flat is held through a registered deed. Heirs prove title by heirship papers and a registered document where the flat is divided among them. The association then updates its maintenance records.

Our first step on any such file is to collect the latest registered deed, lease deed or allotment letter and read it before drafting anything for you to sign.

Leather, Textile and Trading Families: Business Assets Do Not Pass With the House

Kanpur's household economy has long rested on leather and footwear units in and around Jajmau, textile and hosiery trading, and wholesale shops in Naya Ganj. When the founder dies, an overseas son or daughter often inherits a business interest along with a house, and the two follow different rules.

What sits in the proprietor's own name. A sole proprietor's current account, GST registration, trade licence, pollution board consent, machinery loans and vehicle papers are all registered in one name. Each department or lender sets its own requirement when that person dies. A heirship certificate shows who the heirs are, but it does not by itself move a business registration, and some bodies want a fresh application in the heir's name.

Partnerships and companies. A partnership deed may say what happens to a dead partner's share, and that clause usually governs before succession law does. Shares in a private company pass through the board's transmission process on proof of heirship. A Hindu undivided family business has a karta whose death changes who manages it and may need a family settlement.

Tannery sites. Many Jajmau units face environmental restrictions that have affected the industry for years. An heir who inherits a unit should expect to check the land title, the pollution board consent, any bank loan secured on the premises and the unit's current operating status before deciding to run, lease or sell it.

Employees' dues. If the parent worked in a mill, a defence production unit or a public-sector firm in or around Kanpur, the provident fund, gratuity and family pension are claimed through the employer's welfare office or the relevant provident fund office. These bodies generally ask for proof of heirs, and some insist on a succession certificate when the amount is large.

Debts follow the estate. Loans taken for the business are a burden on what was inherited rather than a personal liability beyond it, but lenders will still ask for formal documents before closing or restructuring an account.

If you do not want to run the business, the cleanest routes are usually a registered release in favour of a sibling, a sale or a lease, and each needs the title and permissions confirmed first. We map those choices after the first assessment call.

Farm Land Around Kanpur: Khatauni, Lekhpal and the Revenue Code's Own List of Heirs

Many Kanpur families still hold a field in a Bilhaur, Ghatampur or Narwal village, or in a neighbouring district such as Unnao, Fatehpur or Kanpur Dehat. This land lives in the revenue system, not the municipal one.

The record to look at. Farm land is recorded in the khatauni and the related field maps, maintained at village level by the Lekhpal under a Revenue Inspector circle. The U.P. Revenue Code, 2006 is the governing law for these holdings. Check the latest extract first: older entries often show a previous generation, a different spelling of the family name or an outstanding crop loan.

A separate list of heirs. Succession to agricultural holdings follows the Code's own order of heirs, which is not identical to the order in the Hindu Succession Act, 1956. The Code has been amended several times, including on the position of daughters, and earlier versions treated married and unmarried daughters differently. So the list of heirs for a field should be checked against the current text of the Code and the date of death, not copied from the heirship certificate for the house.

How the entry is made. A person who obtains land by succession reports it to the Revenue Inspector, who records the entry where there is no dispute. If anyone objects, the Tehsildar holds an inquiry after a proclamation, in the manner of sections 33 to 35 of the Code. Revenue staff commonly want a family tree (vanshavali) signed by the heirs, the death certificate and an identity proof for each heir, and they may verify the facts locally.

Land in another district. A field in Unnao or Kanpur Dehat is handled by that district's Tehsildar, not by Kanpur Nagar. That matters again if a dispute reaches the High Court: Kanpur Nagar matters go to the Allahabad High Court at Prayagraj, while Unnao falls within the jurisdiction of its Lucknow bench.

Rights of NRI and OCI heirs. FEMA lets NRI and OCI holders inherit agricultural land even though they cannot buy it. Selling is a separate step that generally requires a resident Indian citizen as buyer, and Uttar Pradesh revenue law also limits who may acquire farm land and how much, so plan the sale only after the khatauni shows the heirs. Our guide to NRI property inheritance in India sets out the wider position.

The Kanpur Court Route, and the Spelling Slips That Stall Files

Where the petition goes. A succession certificate or probate for a Kanpur estate is filed before the District Judge, Kanpur Nagar, who may assign it to another judicial officer. The petition sets out the heirs, the assets and the death details. The court orders public notice, hears any objection and may ask for a bond or security before a certificate for debts and securities is issued. A probate petition adds the original Will and evidence from its attesting witnesses. Appeals from these orders go to the Allahabad High Court at Prayagraj, since no bench of the High Court sits in Kanpur.

What the overseas heir does. Your affidavit, any consent from relatives and the power of attorney are signed abroad. The Kanpur advocate files and attends. If a Will names you as executor, the court may want your own statement, and we tell you at the start if that looks likely. See also how an NRI power of attorney is drawn.

Spelling is where Kanpur files stall. Hindi names are written in Devanagari and then transliterated, so one person can appear differently on every paper. Typical clusters are Srivastava, Shrivastava and Srivastav; Agarwal, Agrawal and Aggarwal; Bajpai, Bajpayee and Vajpayee; Dixit and Dikshit; Awasthi and Avasthi; Mishra and Misra; Pandey and Pande. A death certificate may carry one version and the bank record another.

Women's names. A woman may be recorded as Devi or Kumari, with a husband's name in one document and a father's name in the next. Relationship fields often say daughter of in one place and wife of in another. Proving a married daughter's link to a parent usually needs a birth or school record in her earlier name together with the marriage certificate.

Dates and places. Many older Aadhaar cards show only a year of birth, and some papers show the city as Cawnpore. The ward, mohalla and house number may be written differently in the deed, the tax bill and the death record.

The standard remedy is an affidavit that the different names belong to one person, but aligning the records early is cleaner. We compare every document against the passport before you sign, so the affidavit only has to explain what cannot be corrected.

Which Kanpur Office Handles What, and Why Does the District Matter?

In Kanpur the Tehsildar of one of four Kanpur Nagar tehsils issues the certificate; Kanpur Nagar Nigam handles the death record and the house tax record. The district website lists Kanpur Sadar, Bilhaur, Ghatampur and Narwal, with 1,110 revenue villages between them. A city address such as Swaroop Nagar normally falls under Kanpur Sadar, and we confirm that from the property papers.

Kanpur Dehat, headquartered at Akbarpur, is a different district. A house or field there goes to a different Tehsildar and a different civil court, so read the village or ward in the title deed, not just the word Kanpur on a bank statement.

Heirs are fixed by the Hindu Succession Act, 1956 or the deceased’s personal law, whichever country you live in.

Where Will You Need a Kanpur Legal Heir Certificate?

You need it wherever an institution wants proof of the surviving heirs. On Kanpur files it serves these purposes.

  • Bank and FD claims: closing accounts, fixed deposits and lockers at Kanpur branches. A bank may ask for a Succession Certificate for larger sums.
  • House tax record: Kanpur Nagar Nigam's online property tax mutation changes the name on its record. See NRI property mutation.
  • Pension and provident fund: family pension, EPF and gratuity claims.
  • Shares and mutual funds: transmission through the depository or registrar, which may want a court order instead.
  • Sale of inherited property: read the FEMA rules for NRIs selling inherited property before you list it.

How Does the e-District Application Work for a Kanpur Legal Heir Certificate?

The application is filed on the e-District UP portal and then verified by the tehsil. The portal, edistrict.up.gov.in, is linked from both the Kanpur Nagar district site and the Nagar Nigam site. A typical flow is registration with a mobile number, a form with every heir’s details, document upload and an application number for tracking. Screens change, so we confirm the current steps before filing.

Revenue staff such as the Lekhpal or Revenue Inspector usually check the facts locally. Typically a few weeks after verification.

The table lists the Kanpur offices in the order a file meets them.

Settling a Kanpur Estate From Abroad: Eight Steps From First Call to Money Home

You sign once overseas, and a Kanpur advocate with our representative handles every step that needs someone present.

1

Assessment call

On a short call we map what your parent left: a house, accounts, a plot from KDA, a shop or a field. We note where each asset is recorded, ask about any Will, and tell you which Kanpur desk or court handles each item. Different assets usually get different tracks.

2

Document collection

We send two checklists. One covers papers within your reach abroad. The other goes to relatives in Kanpur, who can obtain the death certificate, house deed, Nagar Nigam tax receipt and parivar register extract. Both sides work at once, so nobody waits for the other.

3

Signing abroad

Our draft heir affidavit, consents and power of attorney reach you before you meet the notary. An apostille applies for the US, UK, Singapore and Australia. From the UAE the set is attested at the Indian Embassy in Abu Dhabi or the Consulate in Dubai, and German-signed papers use attestation too.

4

Originals to Kanpur

Scanned copies come first, so a Kanpur advocate can test each name, date and signature against Aadhaar, the deed and the bank records. Corrections happen before anything is filed. Once the scans pass, you courier the originals and we record when they land.

5

Filing and notice

A heirship application goes onto e-District UP, or is lodged at the tehsil, and we keep the application number. For a succession certificate or probate, the petition is presented to the District Judge, Kanpur Nagar, and the court's public notice gives anyone with an objection a chance to speak.

6

Inquiry or hearing

Revenue staff usually visit or call the family to verify the details, and our representative attends with a relative. In court, an uncontested petition proceeds with your advocate appearing under the power of attorney. If the judge wants you personally, we arrange a time that suits your zone, by video if permitted.

7

Certificate in hand, then used

The certificate then opens other doors, in an order the offices will accept: Nagar Nigam or cantonment mutation, the KESCO connection, bank and fund claims, and any KDA, Parishad or khatauni entry. We keep a tracker so nothing is left half done.

8

Money home

Proceeds from a sale or maturity arrive in your NRO account. You can move up to USD 1 million per financial year abroad on Forms 15CA and 15CB (Forms 145 and 146 from 1 April 2026). Any TDS deducted by a buyer is settled before the remittance.

Kanpur Document Checklist: What You Hold and What Family Can Fetch

Gather everything into one set of scans and check that each name reads the same. Kanpur files stumble over transliterated surnames, absent middle names and women's names recorded two ways. Report any mismatch to us at once so the right affidavit is drafted.

From you (abroad)

  • Valid passport and proof of residence abroad, such as a residence permit, visa or OCI card
  • Indian PAN card, since banks, tax filings and any later sale ask for it
  • Heir affidavit and power of attorney executed before a notary, then apostilled or attested for your country
  • Written consent or release from any co-heir who also lives outside India
  • A recent bank statement or utility bill showing your overseas address in the passport name
  • Sample signatures matching those on every signed paper

From family or records in India

  • Death certificate from Kanpur Nagar Nigam or the Cantonment Board, depending on where the death occurred
  • Parivar register extract, ration card or school records that show the family tree
  • Registered deed, latest Nagar Nigam house tax receipt and any mutation record for the house

Illustrative Example: A Frankfurt Researcher Settles Her Mother's Estate in Swaroop Nagar

This is an illustrative example. The family, dates and timings are fictional; the offices, documents and steps are real.

The situation

Neha is a researcher in Frankfurt, Germany. Her mother, Kamla, died at the family home in Swaroop Nagar, Kanpur, leaving a house and a fixed deposit at a local bank branch. Her father had died earlier. The heirs are Neha and her brother Vivek in Kanpur, both Class I heirs under Section 8 of the Hindu Succession Act, 1956.

Step by step

  • Day 1: Neha writes to us. We ask for the title deed, house tax receipt, FD receipt and heirs’ details, and check the revenue address: Kanpur Nagar, not Kanpur Dehat.
  • Days 2 to 4: we write to the bank and the Nagar Nigam. The bank wants a Tehsildar’s certificate for the FD. Our representative collects the death certificate from Kanpur Nagar Nigam.
  • Days 5 to 16: we check with the Indian mission for her address how papers signed in Germany are authenticated, since Germany has objected to India’s accession to the Apostille Convention. Neha signs before a German notary, completes the attestation steps and couriers the originals after we check the scans.
  • Days 17 to 20: Vivek signs a local affidavit. Our representative files on e-District UP, with Kanpur Sadar as the covering tehsil in this example, and records the application number.
  • Weeks 4 to 6: revenue staff verify the facts at the house and the Tehsildar issues the certificate.
  • Weeks 7 to 8: the bank pays out the FD as the heirs agreed. The same papers go into the Nagar Nigam’s online mutation form for the house record.

No court petition was needed here. Had the bank insisted on a Succession Certificate, we would have drafted one for the District Judge, Kanpur Nagar, and the matter would have run for months.

What Neha did and did not do

She signed once before a notary, sent one courier parcel and joined a few video calls. She never travelled to Kanpur, but she could not skip the notary, the attestation or the originals, and neither can you.

If Neha later sells the house

As an NRI or OCI heir she can hold the house. A sale brings TDS under Section 195 (Section 393(2) of the Income-tax Act, 2025 from 1 April 2026) on the full sale consideration, which a Lower or Nil Deduction Certificate (Form 13 (now Form 128)) can reduce, and repatriating the proceeds is capped at USD 1 million per financial year, with Forms 15CA and 15CB (Forms 145 and 146 from 1 April 2026). Our succession certificate in Uttar Pradesh note covers the court route.

Legal Heir Certificate or Succession Certificate: What Changes in Kanpur?

In Kanpur the Tehsildar's certificate names the heirs, while a Succession Certificate is an order of the District Judge, Kanpur Nagar. The court order lets the heirs collect debts and securities such as an FD or mutual fund units. Some institutions want it instead of the tehsil paper, and they decide.

Why Overseas Families Choose PropResolve for Kanpur Estates

  • Kanpur-based representation: an advocate and representative who attend the tehsils, Nagar Nigam and the district court in person, so applications are lodged where they will be accepted.
  • One plan for every asset: a mohalla house, a KDA plot, a business account and a village field seldom need the same paper, so each gets its own track instead of repeated applications.
  • A single round of signing: the affidavits, consents and power of attorney are written to serve the tehsil, corporation, authority and court together, so you are not asked to sign a second time.

Frequently Asked Questions

Do I need to fly to Kanpur to obtain a heirship certificate after my father's death?

+
In most uncontested cases you do not. The tehsil needs a signed heir affidavit and a power of attorney from you, both executed before a notary in your country. Our Kanpur representative lodges the application, stands with your brother or sister when the Lekhpal calls at the house, and brings back the certificate. Your presence would matter only if a relative disputes the claim or an official asks to question you directly. We say so at the beginning if the family situation points that way.

Will my mother's Kanpur bank branch honour a Tehsildar's certificate?

+
It depends on the branch and on the amount. Many branches release a modest savings balance on the revenue certificate with an indemnity from the heirs. When the sum is large, or there is a locker, an FD in joint names or investment units, the bank's legal department tends to ask for a court-issued succession certificate. Put the question to the branch manager in writing and keep the reply. That one letter decides whether to spend months on a court petition, and we obtain it during the first assessment.

Does a Will in Kanpur still have to go through probate?

+
No statute demands it. Section 213 of the Indian Succession Act, the provision that made probate a precondition for enforcing certain Wills, was removed by the Repealing and Amending Act, 2025, which received assent on 20 December 2025. It had only ever reached Wills linked to the old presidency towns, so Kanpur was never within it. In practice, many banks, depositories and transfer agents continue to ask for a probated Will because it settles authenticity in one step. We ask the institution first and shape the petition accordingly.

I am the nominee on my mother's flat in Kanpur. Does that make me its owner?

+
A nomination says who may receive or handle an asset. It does not decide who owns it, and courts have generally treated a nominee as holding for every legal heir. So a brother, a sister or a widowed father can still assert a share. Housing associations, KDA clerks and bank managers in Kanpur know this, which is why they often want written consent from the other heirs or an indemnity bond before acting on the nomination alone. Where the family agrees this goes quickly. Where one heir objects, expect the heirship or court route.

What is the right way to get papers signed in the US, UK, UAE or Germany for Kanpur use?

+
Begin with a notary public in the country where you live. What follows depends on the country. Members of the Apostille Convention, such as the US, UK, Singapore and Australia, have a competent authority add an apostille. The UAE sits outside the Convention, so UAE papers are attested through the Indian Embassy in Abu Dhabi or the Consulate in Dubai. Germany objected to India's accession, which means apostille does not operate between the two countries and an attestation route applies. We circulate the draft before you visit the notary.

Which acts can my Kanpur attorney perform on my behalf?

The list is whatever the document spells out. A properly drafted instrument for an heirship matter authorises one named person to sign applications, verify and swear affidavits, attend the tehsil, Nagar Nigam, KDA, Sub-Registrar and the District Judge's court, receive certificates and pursue claims with banks and KESCO. A sale, gift or release deed should be listed separately rather than assumed. A document that needs registration and was signed abroad can be presented within four months of reaching India under Section 26 of the Registration Act, 1908, though the registering officer decides whether to accept it. Details are in our NRI power of attorney guide.

As an OCI holder, may I take my father's land in a Bilhaur or Ghatampur village?

+
Yes. FEMA permits NRIs and OCI holders to receive agricultural land by inheritance, even though they cannot buy it. The entry is made in the khatauni, and the heirs are worked out under the U.P. Revenue Code, 2006, whose order of heirs can differ from the Hindu Succession Act. A later sale is possible generally only to a resident Indian citizen, and Uttar Pradesh law restricts who may hold farm land and how much. So settle the record first, then plan any sale with a lawyer and a chartered accountant.

What route does inheritance money take to my foreign bank account?

+
Sale proceeds or matured deposits are first credited to an NRO account in your name. From there you may remit up to USD 1 million in a financial year, provided the bank receives Form 15CA and the chartered accountant's certificate in Form 15CB, renumbered as Forms 145 and 146 from 1 April 2026. Banks usually ask to see the heirship papers, the sale deed and proof that TDS was deposited. Sums above the limit, or unusual circumstances, need Reserve Bank permission, so involve your accountant before the sale rather than after it.

Does inheriting a Kanpur house create a tax liability in India?

+
India does not levy an estate or inheritance tax, so receiving the house on a parent's death creates no tax for you in itself. Tax comes later if you sell: capital gains are worked out using the original acquisition value and the holding period of the person who died. Rent you collect is taxed as income. Separately, the country where you live may require you to report the asset or may tax inheritances, so speak to an adviser there. Our blog on FEMA rules for selling inherited property covers the exchange-control side.

My sister in Kanpur will not sign. What happens to the application?

+
Without her consent the quick route usually closes. The Nagar Nigam or KDA clerk may refuse to move the record, and a Tehsildar who receives an objection often directs the parties to the civil court. In a petition for a succession certificate each heir is served notice and may contest, and the judge decides on evidence. Many standoffs ease when a lawyer lays out in writing what each person is legally entitled to, and we attempt that conversation before any filing.

How many weeks or months should I plan for a Kanpur matter overall?

+
Plan in stages rather than a single figure. Local verification sets the pace of a heirship certificate. A khatauni entry waits for the proclamation. A court petition runs longest because of notice and the court calendar. Your own notary visit, attestation and courier add time at the start, and the bank, KDA or Nagar Nigam steps follow once the certificate is in hand. After the assessment call you receive a likely order of steps for your own assets, and we report back at each stage.

Is the heirship application on e-District UP fully online?

+
Only the filing is. The applicant registers on the portal, uploads scans and the affidavit and tracks a reference number, but a Lekhpal or Revenue Inspector still confirms the facts and the Tehsildar still decides. Stamp paper and local verification are tied to Uttar Pradesh, so heirs overseas almost always apply through a representative in Kanpur. Because the form fields and document list are revised from time to time, we check the current version on the day we file.

Why do some Kanpur institutions ask for a court certificate when I already hold the Tehsildar's?

+
The two papers answer different questions. The Tehsildar's certificate is an administrative record of who the family members are. The succession certificate is the District Judge's order under Part X of the Indian Succession Act, which empowers named heirs to receive debts and securities. A bank or fund house that must be sure it is discharged from liability may want the court order, and some accept both. We ask each institution what it needs. See our NRI succession certificate page.

My father's bungalow is in the cantonment and his fields are in Kanpur Dehat. Do I need separate processes?

+
Largely yes. The house is recorded by the Cantonment Board, and a cantonment property can sit on old grant or lease terms, so the grant papers matter. Kanpur Dehat is another district with its own Tehsildar, revenue officers and civil court. Bank claims can use one court or Tehsildar document if the institution accepts it. We list each body, its proof and its likely order before you sign anything, so that the power of attorney covers all of them.

When an NRI sells the inherited Kanpur house, who withholds tax?

+
The buyer does. Under Section 195 of the Income-tax Act, 1961, a person paying a non-resident must deduct TDS, and from 1 April 2026 the same rule sits in Section 393(2) of the Income-tax Act, 2025. The deduction is normally computed on the full sale consideration, not only the profit. A seller who expects a smaller liability can apply on TRACES for a lower or nil deduction certificate in Form 128 (earlier Form 13) before completion. Remitting the proceeds then falls within the USD 1 million annual limit.

Does the family's faith decide how the Kanpur heirs are listed?

+
Yes. For property without a Will, Hindus, Sikhs, Jains and Buddhists are governed by the Hindu Succession Act, 1956. Muslim heirs take under their personal law, with a fixed fraction for each relative. Christian families are governed by the Indian Succession Act, 1925. Kanpur has large Muslim and Christian communities, so the list of heirs is checked before an affidavit is drafted. A valid Will changes the picture, within what the law allows.

Our plot near Civil Lines is Nazul land on an old lease. Can the heirs still be recorded?

+
Often they can, but the lease is the first thing to examine. Nazul land is government property let on lease, so heirs should establish whether the term is still running, whether rent is up to date and whether the authority must consent to a change of name. Because Uttar Pradesh has been revising its Nazul rules, the district administration confirms the current position. A heirship certificate proves relationship. It cannot revive a lapsed lease or establish ownership.
