The Short Answer: What a Delhi Power of Attorney Can and Cannot Do for You

Short answer

A power of attorney lets someone you trust in Delhi sign, file and collect papers in your name, but it passes no title and it ends when you die or revoke it. For inherited property a narrow special power, one per purpose, is usually safer than a general one. Sign before a notary abroad, add an apostille or Indian mission attestation as your country requires, and expect Delhi offices to read the wording closely. Registration matters mainly when the attorney will present a registered deed for you.

  • Best fit: A special power for each purpose, naming the property and the act
  • Signed: Before a notary or Indian consular officer, then apostilled or attested by country
  • Delhi readers: DDA, L&DO, group housing societies, MCD, NDMC, SDM, sub-registrars, banks, courts
  • Ends when: You die, you revoke it, the attorney dies, or the task is completed

Which Power Does Your Delhi Task Need? Match the Task to the Instrument

A single overseas heir often needs several things done in Delhi at once. Find the row closest to your task. Each row names the kind of power we draft, the office that will read it, and the check that usually follows.

Task in DelhiPower we draftDelhi office that reads itCheck or registration step
Joint mutation of a DDA flat with the other surviving heirsSpecial power, filing only
Lets one named person lodge the file, answer queries and collect letters. Statements that are personal to you, such as an affidavit of heirs, are normally signed by you abroad.
DDA housing branch under the Deputy Director concernedAsk in writing whether the branch lets an attorney lodge and collect, because some counters prefer the applicant in person.
Relinquishing your share to a co-heir by a registered deedSpecial power with a presentation clause
Authorises the attorney to present your signed deed, admit execution and collect it after registration. The deed itself is a separate document that you sign abroad.
Sub-registrar office in Delhi, booked through the Revenue Department systemAuthentication under Section 33 of the Registration Act, and the four-month window under Section 26 for papers signed abroad.
Transfer of a group housing flat to the heirsNarrow power for society forms
Covers the intimation, the transfer application, the indemnity and the new nomination, each described by flat number and society name.
Managing committee of the cooperative society, then the Registrar of Cooperative Societies if it stallsMany societies ask the member to sign their own prescribed form, so we obtain the society's written position first.
Surviving Member Certificate, MCD or NDMC tax record, utilitiesFiling power, no sale wording
Lets the attorney upload on e-District Delhi where permitted, attend verification, and apply for name changes on tax, power, water and gas accounts.
SDM and Tehsildar, MCD or NDMC, BSES or Tata Power Delhi, Delhi Jal BoardA resident heir is often the named applicant, so the power sits behind that application as support.
Succession certificate, probate or letters of administrationPower plus vakalatnama
The power lets one person run the case file and receive papers. The advocate acts under a vakalatnama that you sign in the same sitting.
Delhi district court complex or the Delhi High Court, by jurisdictionAffidavits are sworn before a notary abroad and authenticated like the power itself.
A later sale of the inherited Delhi propertySeparate sale power, one property
Drafted only when you have decided to sell, with the property described exactly and the attorney barred from buying it.
Sub-registrar, Collector of Stamps where a referral applies, the buyer's bankTax at source on a non-resident seller and remittance are planned with your accountant before the power is signed.

Counter practice in Delhi changes, and a branch can ask for one more paper after a file is lodged. Treat the last two columns as a guide and confirm the current requirement with the office concerned. We obtain that confirmation in writing before you sign.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

Special, General or One Power per Purpose: How We Decide for a Delhi Estate

A general power hands over a wide range of acts. A special power names one act on one property. For an overseas heir dealing with an inheritance, the special power is almost always the better tool, and the cleanest version is one separate instrument for each purpose.

The reasoning is practical. A Delhi estate usually has more than one property and more than one gatekeeper. A DDA flat in Dwarka is read by a housing branch. A house in an old colony may sit with MCD. A bank balance may need a court paper. If a single sweeping document covers all of them, every office reads every clause, and any one clause that an officer dislikes can hold up the whole set. With separate powers, a query from one office touches only that instrument.

We usually group the work like this:

A filing power

Lodging applications, attending verification, collecting certified copies and letters. It carries no wording about sale, gift or relinquishment.

A deed power

Presenting a relinquishment deed, a settlement or a sale deed that you have signed, and collecting it after registration. It is drafted only when a deed is actually planned.

A court power

Running a petition file and receiving notices, alongside the vakalatnama for the advocate.

A utility and bank power

Name changes on accounts and the paperwork a bank asks for on a deceased customer's balance, drafted to the bank's own checklist where it supplies one.

Each instrument describes the property exactly as its title paper does: the allotment number, pocket and sector for a DDA flat, the flat and society name for group housing, or the municipal address and property identification number for a house. Where the spelling on an old paper differs from today's, we record both forms.

A general power has a place in only a few situations, such as a long period of unavoidable absence when many small tasks will arise across several accounts. Even then we prefer to list the tasks, and we tell the family plainly that a general power is harder to monitor from another time zone.

What a power cannot do is as important as what it can. It does not transfer ownership. The Supreme Court's 2011 decision in Suraj Lamp and Industries held that a general power of attorney sale does not by itself pass title to immovable property, which matters in Delhi where many colony homes were bought on an agreement to sell and a power. Treat your own power as a tool for acting, never as evidence of who owns what.

Delhi Offices and How Each One Reads an Attorney's Authority

The same signed power meets a different reader at each Delhi counter. Knowing what each reader looks for lets us draft once and avoid a second round of signing from abroad. The list below is general; each office confirms its own checklist.

DDA

Flats allotted decades ago often still stand in the allottee's name. The housing branch reads the power for the property description and the acts named. Its mutation handbook is built around heirs applying and swearing their own statements, so we ask the Deputy Director concerned what an attorney may lodge, sign or collect.

Land and Development Office

Older leaseholds on central government land follow a separate procedure. The office looks at who the lessee's heirs are and at any registered relinquishment. A power that supports a registered deed must satisfy the sub-registrar first, so the two offices are planned together.

Cooperative group housing societies

Registered under the Delhi Co-operative Societies Act, 2003, a society decides who becomes the member. Committees differ on whether an attorney can sign the transfer form or whether the member must sign it personally. We ask the secretary in writing and draft to the answer.

MCD and NDMC

The property tax record follows the heirship paper and the title paper. An attorney is routinely accepted for the application and for collecting the updated record, provided the power names the property.

SDM, Tehsildar and e-District Delhi

The Surviving Member Certificate is applied for through the Revenue Department's online service. The district page lists a resident applicant, so an overseas heir commonly appears as a surviving member while a resident heir or an authorised representative files.

Sub-registrars

The registering officer decides whether the authentication on a power made abroad is sufficient and whether the attorney may present your deed. This is the reader with the strictest eye for the wording.

Utilities

BSES Rajdhani, BSES Yamuna, Tata Power Delhi Distribution, NDMC in its own zone, Delhi Jal Board and Indraprastha Gas usually take a short name-change application and a copy of the power.

Banks and courts

A bank follows its own policy on deceased customers and may insist on its own authority form. A court expects a vakalatnama for the advocate and affidavits that are sworn, not delegated.

Delhi's geography also moves. The Revenue Department has reorganised its districts and sub-divisions, and reports in 2026 describe sub-registrars being appointed across all thirty-nine sub-divisions. An address that sat under one office on an old paper may sit under another today, so we confirm the current office before the power names it. In the other direction, Delhi has adopted a policy that lets a document be registered at any sub-registrar office, so the choice of office is often about convenience and appointment availability, not the property's location. Confirm the policy still operates in that form when your date approaches.

From Draft to Delhi Counter: Signing Abroad, Authentication and Registration

Drafting for a signing abroad

You see the draft before you travel to a notary. We send a signing sheet for your country that says how the signature must appear, which name to use, which pages to initial, and which authority comes next. Use the name on your passport. Leave nothing blank for later. If your name on the passport differs from the name on the Indian property papers, we prepare a short statement that links the two, and the power uses both forms with the words alias or also known as.

Notary, Indian mission, or both

Section 33 of the Registration Act, 1908 recognises a power made by a principal who lives outside India when it is authenticated by a notary public, a court, a judge or magistrate, an Indian consul or vice-consul, or a representative of the Central Government. Section 85 of the Indian Evidence Act adds a presumption that such a document was properly executed. Some Delhi offices lean toward authentication by an Indian mission, so where your country offers a signing at the embassy or consulate we weigh that against a local notary.

Apostille or attestation, by country

The route turns on whether your country belongs to the Hague Apostille Convention in its relationship with India.

  • The USA, UK, Singapore and Australia are members. A notarised power is apostilled by the designated authority there, such as the office of the Secretary of State in the US state where the notary is commissioned, or the Foreign, Commonwealth and Development Office in the UK.
  • The UAE is not a member. A power signed there goes to the Indian Embassy in Abu Dhabi or the Consulate General in Dubai for attestation.
  • Germany objected to India's accession, so the apostille route is not used between the two countries and the Indian mission attests instead.
  • Canada acceded in 2024. An apostille is generally the route, but we confirm the current position with the Indian mission before you sign.

A notary's stamp alone is not enough where an apostille or attestation is required, and an apostille where attestation is needed forces a second signing round. That is the single most common reason overseas heirs sign twice, and the reason we send the country sheet before anything is signed.

Stamping

Whether a power needs stamping, and on what basis, depends on the instrument and the stamp law that applies to it. We do not repeat a rule from another state. We confirm the Delhi position with the stamp authority for your specific instrument before you sign, and we record what we were told.

Registration in Delhi

A power of attorney is not compulsorily registrable, and it is not a title deed. Registration questions arise in a narrower way. Section 32 of the Registration Act lets a recognised agent present a document for registration, and Section 33 defines which powers are recognised. So the sub-registrar looks for a properly authenticated power when your attorney comes to present your relinquishment or sale deed. Section 26 allows a document executed outside India to be presented within four months of reaching India, at the registering officer's discretion, so we log the day the parcel first arrives.

The 2026 attention on powers of attorney

In July 2026 the Delhi Chief Minister's office announced stricter handling of general powers of attorney that are used in practice as property transfers. As reported, a document titled as a power, but carrying recitals about consideration, possession, irrevocable authority or permanent alienation, in favour of someone other than a parent, spouse, child or sibling, is to be referred to the Collector of Stamps before registration. The reports do not mention powers made abroad or powers limited to inheritance filings, and the details may change. We draft inheritance powers without ownership or consideration recitals and name the purpose on the face of the document, which keeps them clearly outside that category. Confirm the current instruction with the sub-registrar before presenting.

Appointments at Delhi's sub-registrar offices are booked through the Revenue Department's online appointment system, and document details for powers, deeds and wills can be uploaded in advance through the national generic document registration system. Your attorney attends on the booked day with originals and identity proof.

When the Power Ends, How to Revoke It, and Whom to Name as Attorney

Death ends it

Under Section 201 of the Indian Contract Act, 1872, an agency ends when the principal dies or becomes of unsound mind, and also when the agent dies. For an overseas heir that has a very concrete meaning: if you pass away before a filing is complete, your attorney can no longer sign for you, and your own heirs must step in. If a deed was executed and registered while you were alive, it stands. Anything attempted afterwards in your name does not. A rare exception for authority coupled with an interest exists in law, but it should not be assumed, and inheritance filings do not usually fit it.

Revocation

You can revoke a power by a written revocation, and Section 203 of the Contract Act allows this at any time before the attorney has exercised the authority to bind you. In practice revocation is only as effective as the notice that follows. We prepare a short notice to the attorney and a copy for each office that holds the power: the DDA branch, the society, the sub-registrar, the bank and the advocate. Where the original power was registered or recorded with an office, we ask what that office requires to note the cancellation. Collect the original from the attorney where possible.

Choosing the attorney

The attorney does not need to be a lawyer, but the choice shapes how smoothly offices respond. Points that we raise with families:

  • A resident close relative, such as a sibling, parent, spouse or adult child, usually meets the least resistance, and is the kind of person the 2026 Delhi instruction on general powers treats more gently.
  • Someone who lives in Delhi and can attend counters on short notice is more useful than a trusted friend who travels often.
  • Avoid naming a person who also stands to gain from the transaction. An attorney should not also be the buyer, and a co-heir who benefits from your relinquishment is better kept separate from the person who signs your papers.
  • Name an alternate attorney in the instrument, so a single illness or move does not force a new round of signing abroad.
  • Have the attorney sign an acceptance and keep copies of their identity papers, which Delhi offices ask for.

Where the family prefers a professional representative, we can propose one of the advocates we work with, and the instrument sets out the limits of authority. We never place one person in a position to sign for you, receive money and benefit from the deed at once.

Finally, keep the original safe. A copy may satisfy a utility, but a sub-registrar, a DDA branch or a court usually asks to see the original authenticated document, and a lost original means starting the authentication again.

A Realistic Order and Timeline for a Power Made Abroad

The power is usually the quickest piece of an inheritance file, yet it sits at the front of everything else, so a delay here delays every Delhi office. The timings below are soft ranges, because your country and the Delhi counters set the pace more than we do.

Scoping and drafting

A few working sessions once we have your passport papers, the attorney's details and the property descriptions. Drafting is quicker when the Delhi title papers are already in hand.

Your signing and the authentication step

A notary can often see you soon after you book. The apostille is usually a matter of days or a few weeks, depending on the authority in your country. Attestation at an Indian mission can take longer when an appointment is needed.

Courier to Delhi

Normally a few days to about a week, with tracking. The arrival date is entered in the file the day the parcel lands.

First use at the counters

Filing at DDA, a society, MCD or the SDM can start within days of arrival. The offices then move at their own speed, often several weeks, and longer for a society or a leasehold with a complicated history.

A registered deed

Booking and attending the sub-registrar can be arranged within the Section 26 window if the parcel is tracked from its first day in India.

Court routes

Several months for a succession certificate, probate or letters of administration, because notice and hearing dates decide the speed.

Two habits shorten the whole path. First, decide the list of purposes before the signing so that you sign each instrument only once. Second, ask each Delhi office for its written checklist before the draft is final, so the wording answers its questions in advance. Once the parcel arrives, we give you a dated schedule for your own set of properties.

Slip-ups That Make Overseas Heirs Sign a Delhi Power Twice

The same few errors account for most repeat signings. Each one is avoidable if it is caught before the pen touches the paper.

One power for everything

A broad instrument invites a query at every office. Splitting it by purpose keeps a query local.

A vague property description

A power that says "my flat in Delhi" is unlikely to satisfy DDA or a sub-registrar. It should carry the allotment, pocket, sector or municipal details taken from the title paper.

The wrong authentication

A notary stamp without the apostille or mission attestation your country requires is incomplete. Check the country route first.

Sale wording in a filing power

If the family later disputes the plan, a power that quietly allowed a sale becomes a source of mistrust. Add that authority only when a sale is intended.

Ownership recitals

Language about receiving consideration or giving up possession belongs in a deed, not in a power, and it can draw the scrutiny that Delhi now gives to powers used as transfers.

Name drift

Hindi, Punjabi and Urdu names are spelled in many ways, and an old DDA letter may not match your passport. A short identity statement avoids a query.

Assuming the power outlives you

It does not. A death before completion needs a fresh approach through your own heirs.

Losing the arrival date

Section 26 runs from the arrival of a document executed abroad, so a missing courier record puts a registration at risk.

Treating an old colony power as title

Many unauthorised-colony homes still rest on an agreement to sell and a power. The heirs should identify the chain and plan a registered route before any new document is signed.

If one of these has already happened, a new instrument is usually quick to prepare. It is the second round of authentication abroad that takes the time, which is why we check before the first.

Eight Steps From Your First Call to a Power Delhi Offices Accept

Each step prepares the next, so the sequence matters as much as the paper.

1

Map the purposes

We ask which Delhi properties and accounts exist, who the other heirs are, and what each office will need done. From that list we decide how many separate powers are needed and which acts each one should name.

2

Gather the checklists

We request the written requirements from the DDA branch, society, MCD or NDMC office, bank and any court. Where an office will not accept an attorney for a step, we learn that before drafting, not after signing.

3

Settle the attorney

We discuss who in Delhi should act, whether an alternate should be named, and what identity papers and acceptance the attorney must provide. A close resident relative is usually the first option we examine, and we check that the person is willing and reachable.

4

Draft each instrument

We write one narrow power per purpose, describing every property as its own title paper does. Ownership recitals and sale wording are left out unless you have decided on a sale, and each draft is sent to you for review in plain language.

5

Send the signing sheet

You receive a country sheet covering the notary or mission, the name to use, where to initial, and which authentication follows. You review the drafts and raise questions before travelling to any signing appointment, so nothing is changed at the notary desk.

6

Sign and authenticate

You sign before a notary or an Indian consular officer, then obtain the apostille or attestation your country requires. We check the finished set against the sheet before it is posted, looking for missing pages, initials, stamps and mismatched spellings.

7

Log the arrival

The originals reach our Delhi team by tracked courier, and we record the day they first arrive in India. That date anchors the Section 26 window for any registered deed that follows, and the courier receipt is kept in your file.

8

Use, monitor, close

Your attorney lodges files and attends counters, and we watch for queries. When a task ends we note it, and when the purpose is complete we prepare a revocation notice so that no old authority stays in circulation.

Papers a Delhi Power of Attorney Needs: What You Sign and What Delhi Supplies

Delhi offices differ in what they ask for, and we confirm each checklist before the draft is final. Keep an extra set of certified copies of the death certificate, since most offices keep one. Originals of the authenticated power should stay with your attorney or with us, never in loose post.

From you (abroad)

  • Passport pages showing your name, photograph, signature and issue date
  • OCI card if you hold one, your Indian PAN and your overseas address proof
  • A signed list of purposes, property by property, so we can scope each instrument
  • Confirmation of the notary or Indian mission appointment you have booked
  • A short statement linking name spellings, where your passport and Indian papers differ
  • A specimen signature and a recent photograph if the office asks for them

From Delhi offices and records

  • Title papers for each property: DDA allotment letter, conveyance or lease, or registered sale deed
  • Society membership certificate and latest no-dues statement for a group housing flat
  • Death certificate of the deceased, with several certified copies
  • Latest MCD or NDMC property tax receipt, with the identification number where one exists
  • The attorney's identity proof, PAN, photograph and written acceptance of the role
  • Any earlier power or agreement to sell for an older colony house, so the chain can be read

What an Overseas Family Gains From a Delhi Team That Drafts for the Counter

  • Wording tested before you sign. We ask each Delhi office what it will accept before the draft is final, so the power answers real questions and does not guess at them.
  • One signing round for the whole estate. Because the purposes are fixed in advance, you sign each instrument once, with the right authentication already planned for your country.
  • A Delhi hand on every date. We log the day the parcel arrives, book the sub-registrar appointment where a deed follows, and keep your WhatsApp thread current in your time zone.

Frequently Asked Questions

Can one power of attorney cover every heir in the family?

+
No. Each person signs a power of attorney in their own right, because each heir is the principal for their own share. Several heirs can name the same attorney in separate instruments, which makes it easier for Delhi offices to deal with one person. A joint document that tries to bind several signatories invites queries, and it becomes awkward when one heir lives in another country and signs on a different date. We prepare one instrument per heir, with identical property descriptions so the set reads consistently.

Is a special or a general power better for an inherited Delhi flat?

+
A special power is usually better. It names the flat, describes it as the DDA letter or society record does, and lists only the acts you want, such as filing for mutation or presenting a deed you have already signed. Offices accept it more readily because the purpose is explicit, and it limits what a mistake can do. A general power suits only rare situations with many small tasks, and even then we prefer to list the tasks. We also keep sale wording out until a sale is genuinely planned.

Does the power of attorney itself have to be registered in Delhi?

+
Not as a rule. The Revenue Department has described a power of attorney as not compulsorily registrable and not a title deed. What matters is authentication: Section 33 of the Registration Act recognises a power made abroad when a notary, consul or similar officer authenticates it. If your attorney will present a registered deed for you, the sub-registrar checks that authentication. Some families still choose to register a power for convenience, so we confirm the current practice with the office that will rely on it.

Which countries need an apostille and which need Indian mission attestation?

+
The USA, UK, Singapore and Australia are members of the Hague Apostille Convention, so a notarised power is apostilled by the authority there. The UAE is not a member, so papers signed there go to the Indian Embassy in Abu Dhabi or the Consulate General in Dubai for attestation. Germany objected to India joining, so attestation by the Indian mission is the route. Canada acceded in 2024, so an apostille is generally used, but we confirm with the mission before you sign. Our signing sheet sets out the steps for your country.

Can my attorney sell my share of the Delhi property under this power?

+
Only if the instrument says so in clear words and describes the exact property. A filing power does not stretch to a sale. We draft a sale power separately, when you have decided to sell, and bar the attorney from buying the property. Keep in mind that a power of attorney sale does not by itself pass title, as the Supreme Court said in 2011, so the sale must still be completed by a registered deed. Tax on a non-resident seller is planned with your accountant first.

What happens to the power if I die before the work is finished?

+
It ends. Under Section 201 of the Indian Contract Act, 1872, an agency ends on the principal's death, so your attorney cannot sign anything further in your name. A deed that was executed and registered while you were alive stands. Work that was still open must be taken forward by your own legal heirs, who may need their own papers. This is one reason to keep each power to a single, finishable purpose and to complete filings in a sensible order, instead of leaving an open authority running for years.

Will DDA and cooperative societies accept my attorney?

+
Often for lodging and collecting papers, but practice varies by branch and by society. DDA's mutation handbook is written around heirs applying and swearing their own statements, so some counters prefer the applicant in person. A society's committee decides how it treats an attorney, and some ask the member to sign its prescribed form personally. We write to the Deputy Director or the secretary, ask what an attorney may do, and draft the power to that answer, so you are not signing blind.

Who should I appoint as my attorney in Delhi?

+
Usually a resident close relative, such as a sibling, parent, spouse or adult child, who can attend counters at short notice. Avoid someone who also benefits from the transaction, and never let the attorney be the buyer. Name an alternate in case the first person falls ill or moves away. Reports of a July 2026 Delhi instruction suggest that general powers in favour of non-relatives are examined more closely before registration, which is another reason to keep the instrument narrow and the choice of person simple.

Can I sign at an Indian embassy or consulate instead of before a notary?

+
Many Indian missions offer notarial or attestation services by appointment, and Section 33 of the Registration Act recognises authentication by an Indian consul or vice-consul. Some Delhi offices are comfortable with a mission-authenticated power, so it can reduce questions. Availability, appointment waits and the services offered differ from one mission to another, and a mission may still require your country's own authentication step. We check the mission's current process and compare it with a local notary for your city before you decide.

How do I cancel a power of attorney I no longer need?

+
Revoke it in writing, and make the notice reach everyone who has seen the power. Under Section 203 of the Contract Act, revocation is possible before the attorney has exercised the authority, but it works in practice only if the attorney and the offices know. We prepare a notice for the attorney and copies for the DDA branch, society, sub-registrar, bank or advocate that holds the document, and we ask whether any office needs its own form. Ask the attorney to return the original power.

Do I need a separate power for a court petition, or only a vakalatnama?

+
You need the vakalatnama in every case, because the advocate acts only under it. A power of attorney can sit alongside it so that one named person runs the file, collects notices and certified copies, and speaks to the advocate on your behalf. Affidavits filed in a petition are your own sworn statements, so you swear them before a notary abroad and they are authenticated like the power. Courts in Delhi have sometimes allowed video attendance, though that is never promised.

Can my attorney sign my affidavit or consent for DDA or the society?

+
Generally not. An affidavit of heirs, a statement of family members or a no-objection consent is a personal declaration, so the person making it normally signs it. An attorney can lodge it, correct formal defects and collect the outcome. Where an office says an attorney may sign a particular form, we ask for that in writing and name the form in the power. Otherwise we prepare those statements for signing at the same appointment as your power, so you travel to the notary once.

I already gave a general power for another purpose. Can I reuse it?

+
It is worth reading, but reuse is often a poor idea. An old power may name different property, use a different spelling of your name, carry no authentication that a Delhi office accepts, or reflect an earlier relationship that has changed. A general power that was granted years ago is also harder to defend if it is questioned. We read the existing document, compare it with the Delhi title papers, and usually recommend a fresh, narrow instrument and a written revocation of the old one.

My property is in an unauthorised colony on an old agreement to sell and a power. Does my new power fix that?

+
No. A new power of attorney only lets someone act for you. It does not repair a weak chain of title. An agreement to sell and a general power do not, on their own, pass ownership, so the heirs should first identify who holds the rights today, read the earlier papers, and consider a registered route in the heirs' names where the scheme for the colony allows. We map those gaps before any new document is signed, and we flag any step that may need a court.
