Power of attorney in Gurgaon: the short answer
A power of attorney in Gurgaon is a written authority, governed by the Powers of Attorney Act 1882, that lets a person you trust act for you. For Gurugram property, draft it for one clear purpose, pay the government stamp duty under Article 48 of Haryana's Schedule 1-A as an e-stamp, and execute it before the registering officer of your tehsil on the paperless Web-HALRIS system. Registration is optional in law for most powers, but tehsils, HSVP, developers and banks usually expect a registered or authenticated POA. A POA never transfers ownership. Only a registered sale deed does.
- Law: Powers of Attorney Act 1882, Registration Act 1908 (ss. 17, 18, 32, 33) and the Indian Stamp Act 1899 as amended for Haryana.
- Stamp duty: A fixed government duty for most POAs. Sale deed level duty if the POA is for consideration and lets the holder sell.
- Where: The tehsil or sub-tehsil where the principal lives for the POA, and where the property lies for the sale deed.
- Registration: Optional in law for a POA, but expected in practice for any Gurugram property step.
Which power of attorney fits your Gurgaon task
Start with the job the power must do. The job decides the type of POA, the wording and the office that will read it next.
| What you need done in Gurugram | POA that usually fits | Must clearly include | Watch out for |
|---|---|---|---|
| Selling a resale flat or house in DLF Phase 1 to 5 or Sushant Lok | Special POA (SPA) for one named sale | Unit, tower or plot number, conveyance deed details, power to sign and present the sale deed, sale money paid only into your bank account | Clauses saying the holder has paid you, which can make it a POA for consideration |
| Possession and conveyance deed of a new flat in New Gurgaon or on Dwarka Expressway | SPA for possession and conveyance | Allotment letter and buyer agreement details, power to sign the conveyance deed, clear dues, take keys and apply for the property ID | Developer printed formats that are wider or narrower than the tehsil needs |
| Renting and managing a house in Palam Vihar or South City | General POA (GPA) management only | Leasing, rent collection, repairs, RWA, MCG property tax and police tenant verification | Adding a power to sell when you only need management |
| Parents in Sector 56 or 57 who cannot travel to the tehsil | GPA or SPA in favour of a son or daughter | Property work, society and HSVP letters, power to present documents for registration | Capacity doubts later; keep a recent medical note and ask for a home visit |
| A co-owner who lives in another city | SPA by the absent co-owner | Their share, power to join the sale, gift or mortgage deed with the other owners | Each owner signs for their own share; one owner cannot sign for all |
| Agricultural land or a plot in Sohna, Manesar or an urban village | SPA with land record details | Khewat, khatoni and khasra numbers from the jamabandi, mutation and sale powers | Section 7A town planning NOC for small vacant plots |
| Landowner handing development rights to a builder | Development POA tied to the collaboration agreement | Licence details, project scope, timelines and what the landowner receives | Charged like a conveyance on market value under Article 5(d) as amended for Haryana |
| RERA complaint, consumer case or civil suit about a Gurugram flat | SPA for litigation | Case details, power to sign pleadings and affidavits, appoint and instruct advocates | Forums may ask for the original or a certified copy; keep both ready |
These rows are starting points, not templates. The Propresolve legal team reads your title papers and the reader's requirements before fixing the wording.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentGPA, SPA or irrevocable POA: a plain decision guide
Most Gurgaon owners walk in asking for a "GPA" because that is the word used around the tehsil. In many property cases a special power of attorney is the safer pick. The difference is scope, not strength.
A Special POA (SPA) suits you when
- You need one sale, one purchase or one conveyance deed done
- You want the power to end once that job is complete
- A bank, developer or buyer has asked for a narrow, clean document
- You worry about the power being used for something you never meant
A General POA (GPA) suits you when
- You need long-term management of a rented house or flat
- Many small tasks are spread across MCG, HSVP, the RWA and banks
- The holder is your spouse, son or daughter and you trust them fully
- You will be away from Gurugram for a long stretch
Irrevocable POA
Under Section 202 of the Indian Contract Act 1872, an agency in which the agent has an interest in the property cannot be ended at the principal's will. Some Gurgaon developers and lenders ask for an irrevocable power. Read that clause carefully, because you give up the freedom to cancel on your own.
Is there a "durable" POA in India?
Not as a separate category. A POA ends when the principal dies (Section 201 of the Contract Act) and is open to challenge if the principal loses mental capacity. For ageing parents, pair the POA with a registered will through our will drafting and registration service, so that the family is covered after death too.
| Point | SPA | GPA | Irrevocable POA |
|---|---|---|---|
| Scope | One named task | Many acts, often ongoing | Tied to the holder's own interest |
| Ends when | Task done, revoked, or death | Revoked, or death | Only as the deed or law allows |
| Typical Gurugram use | Resale, conveyance deed, possession | Rented property, elderly parents | Builder or lender arrangements |
| Misuse risk | Low | Higher | Hard to reverse |
Ask the reader first. If HSVP, a developer or a bank will rely on the POA, find out the wording they expect before you sign. A signed POA cannot be edited; it needs a fresh deed.
Haryana stamp duty and registration rules for a POA, in plain words
Haryana does not have its own Stamp Act. It applies the Indian Stamp Act 1899 with state amendments, and Schedule 1-A of that Act lists the duty for each type of document. A power of attorney falls under Article 48.
- Most POAs carry a fixed government stamp duty. The amount depends on the category, such as a POA only to present one document for registration, a POA for a single transaction, or a general POA for several acts. It does not rise with the property's value.
- A POA for consideration with a power to sell is taxed like a sale. Where the POA is given for consideration and authorises the holder to sell immovable property, the duty is the same as a conveyance on the amount of consideration. This is the rule that catches disguised "GPA sales".
- Development rights are taxed like a conveyance. Since the 2013 Haryana amendment, Article 5(d) applies conveyance level duty on market value when authority is given to a promoter or developer to build on, develop or sell land.
- Cancelling a POA is a separate document. A cancellation deed falls under Article 17 and carries its own fixed duty.
The duty is paid as an e-stamp through Haryana's e-GRAS system. The state revised many Article 48 entries in 2013 and again in 2018, so check the current schedule and the stamp duty calculator on jamabandi.nic.in before you buy the e-stamp.
Is registration of a POA compulsory?
No, not by itself. Section 17 of the Registration Act 1908 does not list a power of attorney among documents that must be registered, and Section 18 lets you register it by choice. The catch is Sections 32 and 33. If your attorney will present a sale deed or conveyance deed at a Gurugram tehsil, the POA must have been executed before, and authenticated by, the registering officer of the area where you live.
So in day-to-day Gurugram practice, any POA that touches property is executed at the tehsil. Banks, HSVP and developers then rely on that authenticated copy.
What Web-HALRIS changed
From 1 November 2025, Haryana moved all property deed registration to a paperless online system called Web-HALRIS. The deed is generated on the official portal, government dues are paid online, a slot is booked, and the parties appear before the registering officer for photographs and biometrics. Deeds typed outside the portal by a deed writer no longer carry weight on their own.
For you this means the POA wording, names and ID numbers must match the portal entry exactly. A spelling difference that a clerk might once have let pass can now stop the deed at the approval stage.
Stamp duty and registration dues belong to the government. Pay them only through e-GRAS and the official portal, never in cash to an agent at the tehsil gate.
For the national picture, including how other states treat a POA, see our power of attorney registration guide for India.
Which Gurugram tehsil handles your POA: area by area
Gurugram district has five tehsils (Gurgaon, Sohna, Pataudi, Farrukhnagar and Manesar) and four sub-tehsils (Wazirabad, Badshahpur, Kadipur and Harsaru). In Haryana the tehsildar or naib tehsildar acts as the registering officer. The office that handles a property depends on its revenue estate, not its PIN code or the name the developer uses in brochures.
The table follows the district's published collector rate lists for 2026-27, which group colonies and sectors by tehsil. Treat it as a guide and confirm the revenue estate from your conveyance deed or the jamabandi.
| Locality | Usually listed under | Who your attorney will also deal with |
|---|---|---|
| DLF Phase 1 to 5, Golf Course Road | Wazirabad sub-tehsil (some DLF Phase 2 and Golf Course Road commercial entries sit in the Gurgaon tehsil list) | DLF or RWA maintenance office, MCG property tax and NDC |
| Sushant Lok I to III, South City I and II | Wazirabad sub-tehsil | Colony developer records, RWA, MCG |
| Nirvana Country, Sector 57 | Wazirabad sub-tehsil | Society or maintenance agency, MCG |
| Sohna Road (Malibu Towne, Uppal Southend, Vatika City) and Golf Course Extension Road sectors 62 to 72 | Badshahpur sub-tehsil | Developer transfer desk, DTCP licence and occupation certificate status |
| Palam Vihar and New Palam Vihar | Gurgaon tehsil | Colony developer, RWA, MCG |
| Dwarka Expressway sectors 104 to 115 | Gurgaon tehsil list | Developer, occupation certificate, property ID |
| New Gurgaon sectors 83, 84 and 90 | Manesar tehsil | Developer, the municipal body for that sector |
| Sectors 88, 89 and 95 | Harsaru sub-tehsil | Developer, the municipal body for that sector |
| Kadipur, Shivaji Park, Shakti Park | Kadipur sub-tehsil | MCG, patwari for unplotted land |
| MG Road, Sikanderpur, Chakkarpur | Wazirabad sub-tehsil list | MCG, building society or RWA |
| Manesar town and IMT Manesar | Manesar tehsil | Municipal Corporation Manesar, HSIIDC for industrial plots |
| Sohna town and nearby villages | Sohna tehsil | Patwari and revenue records, local municipal body |
Two offices, not one
Under Section 33, the POA itself is executed at the office for the area where you, the principal, live. The sale deed your attorney signs later is registered at the office for the area where the property lies. If you live in Sushant Lok and own a flat in Sector 84, the POA goes to Wazirabad and the sale deed to Manesar.
HSVP sectors, licensed colonies and urban villages
- HSVP (earlier HUDA) plots: after the sale, the buyer applies to HSVP to record the transfer. HSVP usually asks for the POA, so keep the authenticated copy and the e-stamp receipt together.
- DTCP licensed colonies and group housing: the developer issues a transfer or no dues letter and the RWA a maintenance clearance. The POA should name the power to apply for both.
- Urban villages and lal dora pockets: records may sit only in the jamabandi. Your POA should list the khewat, khatoni and khasra numbers, and the attorney should be able to follow up on mutation after the sale.
Worked examples from across Gurugram
Real cases show the choices better than definitions. These are typical patterns the Propresolve legal team sees, with names left out.
Example 1: retired couple in DLF Phase 4 selling through their son
The parents live in their DLF Phase 4 flat and want their son in Noida to handle the sale. They sign an SPA at Wazirabad, where they live, naming only that flat. Before the sale deed, the son clears MCG property tax and gets the No Dues Certificate, without which the tehsil will not register the sale.
Example 2: first-time buyer of a Sector 84 flat who works in Bengaluru
The developer has issued the offer of possession. The buyer gives an SPA to her father in Gurgaon to pay the final dues, take keys, sign the conveyance deed at the Manesar tehsil and apply for the property ID. The SPA mentions the allotment number so the developer's transfer desk can match it.
Example 3: three siblings co-owning a Palam Vihar house
One sister lives in Delhi. Under Section 33 she can execute her POA before the sub-registrar for her own area in Delhi, and her brother then signs for her share in Gurgaon. Haryana stamp duty may need to be made good when a document stamped in another state is used here, so we check that before the sale date. Our power of attorney page for Delhi covers her side of the work.
Example 4: farmland near Sohna
A landowner wants his nephew to complete mutation and sell two acres. The SPA lists the khewat and khasra numbers exactly as shown on the jamabandi. Since the land is not a small vacant plot in a notified urban area, the Section 7A NOC question is checked rather than assumed.
Example 5: investor flat on Golf Course Extension Road
The owner lives in Pune and only needs the flat let out and maintained. A GPA limited to leasing, rent, repairs and society work does the job. It gives no power to sell or mortgage, which protects the owner if the relationship with the holder changes.
If the owner lives abroad, the route is different: the POA is signed before an Indian mission or a foreign notary and stamped after it reaches India. Our NRI power of attorney in Gurgaon page explains that path step by step.
Suraj Lamp: the Haryana judgment every POA holder should know
In Suraj Lamp and Industries v. State of Haryana (2011), the Supreme Court held that a "sale" made through a GPA, an agreement to sell and a will does not transfer ownership of land. Title passes only through a registered deed of conveyance. The case was against the State of Haryana, and its effect is felt strongly across Gurugram's older colonies and urban villages.
What a POA can still do
- Let your attorney sign and present a registered sale deed for you
- Let your attorney take possession and sign a conveyance deed
- Let a family member manage, rent and maintain property
- Let someone appear in court or before RERA for you
What a POA cannot do
- Make the attorney the owner
- Replace a registered sale deed
- Survive the death of the person who gave it
- Carry powers the deed does not spell out
The court also said that genuine POA transactions, such as a POA given to a relative to execute a sale deed, are not affected. The judgment targets the use of a POA as a substitute for a sale.
Buying from someone who holds a GPA
- Ask for the original POA and check it on the portal or through a certified copy from the tehsil
- Confirm the owner is alive and has not cancelled the power; ask for a recent life certificate or affidavit
- Check that the power actually includes selling and receiving the sale money
- If you are buying from a chain of old GPA "sales", plan for a registered deed that cures the chain
Our guides on using a POA to sell property and a POA to buy property cover the clauses in more detail.
Why Gurgaon POAs get rejected: common mistakes
Most refusals at Gurugram tehsils come from avoidable drafting or paperwork gaps. Here are the ones we see most often.
| Mistake | What happens | How to avoid it |
|---|---|---|
| Property described only by postal address | The registering officer or HSVP cannot match it to the records | Use unit, tower, plot, sector and revenue estate, plus khasra numbers for land |
| Name spelt differently on Aadhaar, PAN and the title deed | Web-HALRIS entry stalls or the deed is held at approval | Align the names first or add a one-and-the-same affidavit; see legal name change |
| "Consideration received" wording next to a power to sell | Treated as a POA for consideration, with sale deed level stamp duty | Keep sale money clauses clean: payment only into the owner's account |
| POA executed at an office where the principal does not live | Authentication under Section 33 is questioned when the sale deed is presented | Execute at the tehsil for the principal's own residence |
| Unpaid MCG property tax or other municipal dues | No Dues Certificate not issued, so the sale deed cannot be registered | Clear dues on the ULB property portal before booking the slot |
| Small vacant plot in a notified urban area | Registration refused without the District Town Planner's NOC under Section 7A | Apply for the NOC before the sale date |
| Old POA from an elderly or unwell owner | Buyers, banks and tehsils ask whether the owner is alive and the power still live | Carry a fresh life certificate or affidavit, or execute a new POA |
| Developer's printed POA format used as is | Powers do not cover the step the tehsil or bank needs | Have the format checked against the task before signing |
| Witnesses missing on the appointment day | The slot lapses and has to be rebooked | Bring two adult witnesses with ID; the portal allows a digital change of witness if needed |
If the owner has already died, a POA stops working at once. The family then needs heirship papers, such as a legal heir certificate in Haryana or a succession certificate, before anyone can sell.
POA for elderly parents and joint owners in Gurugram
Many of our Gurgaon matters start with a parent who can no longer stand in a tehsil queue. The law allows for this. Section 33 lets the registering officer attest a POA without the principal attending the office if the person cannot attend without serious inconvenience, and the officer may visit the home or issue a commission.
Before the tehsil visit
- A recent note from the treating doctor on mental and physical condition
- Agreement in the family on who holds the power
- Clear limits: management only, or sale too
- Joint owners decide whether each signs a separate POA or all sign one deed
After registration
- Keep the original safe and give the holder a certified copy
- Tell the RWA, developer and MCG who is now acting
- Banks often need their own mandate form for accounts
- Review the power every year or two
Joint owners
Each co-owner can only give power over their own share. If one owner lives in Gurgaon and another in Chandigarh, both POAs must be in place before a sale deed or mortgage. Where a co-owner wants out of the property entirely, a release deed is often cleaner than a POA; see our guide to release and relinquishment deeds.
Plan for what happens after
A POA ends on the principal's death, so it is not an estate plan. Families who want continuity usually register a will alongside it. If a will is later challenged or needs court proof, our note on probate of a will explains that route, and the property transfer after death page covers transfers without a will.
Revoking or cancelling a POA in Haryana
You can cancel a POA at any time unless it is an irrevocable power coupled with the holder's interest. The steps below keep the cancellation clean.
- Draft a cancellation deed that names the original POA, its date and its registration or authentication details.
- Pay stamp duty for a cancellation instrument under Article 17 through e-GRAS.
- Register it at a Gurugram tehsil, ideally the same office that handled the original, so that the record links the two.
- Tell the attorney in writing by registered post and email, and keep proof of delivery.
- Tell everyone who relied on it: banks, the developer, HSVP, the RWA and any buyer or tenant who has seen it.
- Consider a public notice in a newspaper read in Gurugram if the power was general or widely used.
A POA also ends without any deed when the principal or the attorney dies, when either loses capacity, or when an SPA's single task is done. Our note on how long a POA stays valid sets out each trigger.
If the holder refuses to return the original or keeps using it, the cancellation deed and your written notice are your main evidence. Speak to us early; acts done by the holder after notice are not binding on you.

Frequently Asked Questions
What is the stamp duty on a power of attorney in Haryana?
+Haryana levies stamp duty on a POA under Article 48 of Schedule 1-A of the Indian Stamp Act as amended for the state. Most POAs carry a fixed duty based on their type, not on property value. If the POA is given for consideration and allows the holder to sell immovable property, the duty equals that on a sale deed. Check the current schedule on jamabandi.nic.in before buying the e-stamp.
Is registration of a power of attorney compulsory in Gurgaon?
+The Registration Act does not make it compulsory, but it is advisable for any property work. If your attorney will present a sale deed or conveyance deed at a Gurugram tehsil, the POA must have been executed before and authenticated by the registering officer of your area under Section 33. Banks, HSVP and developers also expect an authenticated POA.
Can I sell property in Gurgaon through a GPA?
+Your attorney can sign and present a registered sale deed on your behalf if the POA gives that power. What you cannot do is treat the GPA itself as the sale. The Supreme Court in Suraj Lamp v. State of Haryana held that GPA, agreement to sell and will transactions do not pass title. The buyer becomes owner only through a registered sale deed.
Where do I register a power of attorney in Gurugram?
+A POA is executed at the tehsil or sub-tehsil for the area where you, the principal, live. Gurugram district has tehsils at Gurgaon, Sohna, Pataudi, Farrukhnagar and Manesar, and sub-tehsils at Wazirabad, Badshahpur, Kadipur and Harsaru. The district's collector rate lists show which colonies fall under which office, and we confirm it before booking.
How long does POA registration take in Gurgaon?
+The execution itself happens in one appointment once the draft, e-stamp and documents are ready. The overall time depends on slot availability and approval on the Web-HALRIS portal, which the state has said it wants to make faster. Drafting and record checks usually take longer than the visit, so start early if a sale date is fixed.
Does the attorney have to be a blood relative in Haryana?
+No law limits who can hold a POA; any adult of sound mind can. The difference is in scrutiny. A POA to a non-relative with a power to sell, especially with payment clauses, is more likely to be treated as a disguised sale and charged sale deed level stamp duty. Choosing a family member for property powers keeps things simpler.
Can a power of attorney be registered online in Haryana?
+Partly. Since 1 November 2025 Haryana uses paperless deed registration on Web-HALRIS. The deed is prepared and paid for online and the slot is booked online, but the principal and witnesses still appear before the registering officer for photographs and biometrics. For a principal who cannot travel, a home visit can be requested.
Is a notarised power of attorney valid for property in Gurgaon?
+A notarised POA executed in India is fine for simple tasks such as dealing with a society or paying bills. It is usually not enough for a Gurugram tehsil when the attorney must sign or present a sale or conveyance deed, because Section 33 requires authentication by the registering officer where the principal lives. For property, execute the POA at the tehsil.
Can an elderly parent give a POA without visiting the tehsil?
+Yes, in genuine cases. Section 33 of the Registration Act lets the registering officer attest a POA without the principal attending if attendance would cause serious inconvenience. The officer may visit the home or issue a commission. Keep a recent medical note ready, because the officer must be satisfied that the parent is signing freely and understands the document.
How long is a power of attorney valid?
+Unless the deed sets an end date, a POA stays valid until it is cancelled, the task in an SPA is complete, or the principal or attorney dies or loses capacity. Buyers and banks in Gurgaon often get nervous about older POAs, so many ask for a recent affidavit or life certificate showing the principal is alive and has not revoked the power.
How do I check a POA before buying a Gurgaon flat from an attorney?
+Ask for the original and a certified copy from the tehsil, then match the property details, the powers given and the registration particulars. Confirm the owner is alive and has not cancelled the power. Check that the POA allows selling and receiving payment, and insist that the sale money goes to the owner's account. Our team can run this check for you.
Can I use a Delhi-registered POA for my Gurugram property?
+Usually yes, because Section 33 lets you execute the POA before the sub-registrar where you live, including in Delhi. When a document stamped in another state is used in Haryana, extra stamp duty may be payable to bring it to Haryana's rate. Check this with the tehsil before the sale deed date so the deed is not held up.
What does the attorney need to sign a sale deed in Gurgaon?
+The authenticated POA, the attorney's Aadhaar and PAN, the owner's title deed, the No Dues Certificate for municipal areas, any developer or HSVP no dues letter, and two witnesses. For small vacant plots in notified urban areas, a Section 7A NOC from the District Town Planner is also needed. Some tehsils ask for proof that the owner is alive.
How do I cancel a registered POA in Gurugram?
+Execute a cancellation deed on the correct e-stamp under Article 17 and register it at a Gurugram tehsil, preferably the office that registered the original. Then send written notice to the attorney and inform banks, the developer, HSVP and the RWA. A public notice in a local newspaper helps if the power was general or widely shown.
Should my POA say Gurgaon or Gurugram?
+The district was renamed Gurugram in 2016, and government records, the portal and new deeds use that name. Use the address exactly as it appears in your title deed and current records, and add the other name in brackets if older papers say Gurgaon. What matters most is that the unit, sector and revenue estate match the records.
