For Mumbai owners, joint owners and families who need someone they trust to sell, buy, rent, mortgage or manage a flat. We scope the power, check the property file and take the deed through stamping and registration with independent advocates.
- Right type, right clauses: GPA, SPA or a sale POA written for one flat, one bank or one case, so the sub-registrar, the society and the buyer’s bank all accept it.
- Article 48 stamp duty checked before you sign: family or non-family attorney, with or without consideration, sale power or management only. These four facts decide the duty.
- Joint Sub-Registrar visit planned: PDE entry, e-Step-in token, identifiers and originals ready, so the attorney and you finish in one sitting.

Short answer: how a power of attorney works in Mumbai
To make a power of attorney in Mumbai, draft it for the exact task, pay government stamp duty under Article 48 of the Maharashtra Stamp Act before or at signing, and register it at a Joint Sub-Registrar office when it deals with property. Most POAs carry Rs 500 stamp duty. A POA that lets a non-relative sell your flat, or one given for consideration, carries the same duty as a sale deed on market value. Irrevocable POAs to transfer property must be registered in Maharashtra, and buyers, banks and housing societies expect a registered POA for any sale.
- Stamp duty: Rs 500 for most POAs; sale deed level duty if a non-relative gets sale power or consideration is paid
- Registration: Compulsory for irrevocable POAs to transfer property in Maharashtra; advisable for every sale POA
- Where: Joint Sub-Registrar offices in Mumbai City and Mumbai Suburban; Thane and Navi Mumbai have their own
- Reviewed by: Propresolve legal team, with independent advocates enrolled with the Bar Council
Which power of attorney does your Mumbai task need?
Start from the job, not the template. The task and the person you appoint decide the type, the stamp duty clause and whether registration is a must.
| Your situation | POA to use | Government stamp duty (Article 48) | Register it? |
|---|---|---|---|
| Sell your Dadar or Borivali flat through your son, daughter, spouse, sibling or parent, nothing paid to you for the power | Special POA to sell Relative listed in Article 48(f)(ii)(a) | Rs 500 | Yes. Registered POA expected by the buyer, the bank and the society |
| Sell through a cousin, friend, colleague or property manager | Special POA to sell Non-relative, no consideration | Same duty as a conveyance under Article 25, on market value | Yes. Treat it like a sale document |
| The attorney or a buyer has paid you money for the power | POA for consideration Clause (f)(i) | Same duty as a conveyance on market value; credited later against the sale deed (Explanation III) | Compulsory if irrevocable |
| Rent out a Powai or Malad flat, sign leave and licence, pay BMC tax, attend society meetings | General POA for management No sale power | Rs 500 for one attorney | Advisable. Many societies and tenants ask for a registered copy |
| You have already signed a sale deed and only need someone to admit execution at the SRO | SPA for registration Clause (a) | Rs 500 | Present it with the document; registering the POA itself is safer |
| Home loan, loan closure or bank paperwork on a mortgaged flat | SPA in the lender's format Clause (c) or (d) | Rs 500 | Lender decides. Most Mumbai lenders want it registered |
| Society redevelopment, where a POA goes to the developer | Developer POA Clause (g) | Conveyance level duty, or Rs 100 if duty is already paid on the development agreement | Yes |
Stamp duty figures are government stamp duty under Schedule I, Article 48 of the Maharashtra Stamp Act, 1958 (text as modified up to June 2022). We confirm the current position for your document before you buy stamps.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentGPA, SPA, irrevocable or durable: picking the right POA for a Mumbai flat
Most Mumbai POA problems start with the wrong type. A general power of attorney (GPA) feels safe because it covers everything. In practice, buyers, lenders and housing societies read a broad GPA with suspicion and ask why one person needs all your powers.
Special POA (SPA) suits you when
- There is one flat, one sale or one purchase
- You want a floor for the sale value and a named bank account for the money
- The task ends on a known event, such as registration of the sale deed
- You want a short, clean document the Joint Sub-Registrar reads in minutes
General POA (GPA) suits you when
- You own several units, shops or parking spaces that need ongoing care
- The attorney must deal with BMC, the society, tenants and courts over years
- You trust the attorney fully and can monitor what they sign
- You still want sale powers listed one by one, never implied
Irrevocable POA. A POA cannot be cancelled at will when the attorney has an interest in the property itself, for example a buyer who has paid in advance. That rule comes from section 202 of the Indian Contract Act, 1872. In Maharashtra, an irrevocable POA relating to transfer of immovable property must be registered, because the Registration (Maharashtra Amendment) Act added it to section 17(1) of the Registration Act, 1908.
Durable POA. Indian law has no "durable" POA in the US sense. Under section 201 of the Contract Act, the authority ends when the principal dies or becomes of unsound mind. For an elderly parent, sign the POA while capacity is clear and pair it with a registered Will in Mumbai, so the plan does not collapse later.
Write the flat details exactly as they appear on the share certificate and the Index II: wing, floor, flat number, building name, CTS or survey number and village. A mismatch with the society records is the most common reason a sale gets held up.
The Supreme Court in Suraj Lamp and Industries v. State of Haryana (2011) held that a GPA does not transfer ownership. The attorney can sign a registered sale deed on your behalf, but the GPA by itself is never a sale. Old "GPA sales" of Mumbai flats still surface in title searches and need cleaning up before any resale.

Maharashtra stamp duty and registration rules for a POA, in plain words
Maharashtra charges POA stamp duty under Article 48 of Schedule I to the Maharashtra Stamp Act, 1958. The duty depends on what the POA lets the attorney do and who the attorney is. The figures below are government stamp duty, not professional charges.
| Article 48 clause | What the POA does | Government stamp duty |
|---|---|---|
| (a) | Only to present documents for registration or admit execution, for one transaction | Rs 500 |
| (b) | Suits or proceedings under the Presidency Small Cause Courts Act | Rs 500 |
| (c), (d), (e) | One or more persons acting in one transaction, several transactions or generally | Rs 500 |
| (f)(i) | Given for consideration and authorising sale of immovable property | Same as a conveyance under Article 25, on market value |
| (f)(ii)(a) | Sale or transfer power, no consideration, given to father, mother, brother, sister, wife, husband, son, daughter, grandson, granddaughter, or the spouse's father, mother, brother or sister | Rs 500 |
| (f)(ii)(b) | Sale or transfer power, no consideration, given to anyone else | Same as a conveyance on market value |
| (g) | Given to a promoter or developer for construction, development or sale | Same as a conveyance on market value; Rs 100 if duty was paid on the development agreement between the same parties |
| (h) | Any other case | Rs 500 for each person authorised |
"Market value" means the value under the Annual Statement of Rates (the ready reckoner) or the stated value, whichever is higher. For a flat inside Mumbai's municipal limits, Article 25(b) sets conveyance duty at 5 per cent of market value. Mumbai sale deeds usually also attract a further 1 per cent metro cess, so ask the sub-registrar whether it is collected on a clause (f) POA.
Explanation III to Article 48 gives credit. If you paid conveyance level duty on a clause (f) POA, and the attorney later signs the sale deed in favour of the same person, the duty on that sale deed is reduced by the duty already paid on the POA.
When stamp duty must be paid
Section 17 of the Maharashtra Stamp Act requires a document signed in Maharashtra to be stamped before or at execution, or on the next working day. Buy the stamp first through GRAS e-payment, e-SBTR or franking. Signing on plain paper and stamping weeks later is the classic error.
Registration and government registration fee
- Compulsory: irrevocable POAs relating to transfer of immovable property, under section 17(1)(h) of the Registration Act as amended for Maharashtra.
- Strongly advisable: any POA with power to sell, mortgage, gift or lease a Mumbai flat. Buyers' lenders and societies rarely accept an unregistered sale POA.
- Usually enough without registration: notarised POAs for bank account operation, tax filings, utility work or collecting documents. The receiving office still decides.
- Government registration fee: the IGR Maharashtra fee table charges a POA with sale power on the ad valorem scale (Rs 10 per Rs 1,000 of value, capped at Rs 30,000). A POA to close relatives without consideration attracts Rs 100. Other POAs attract a fixed Rs 100. Document handling charges are extra, per page.
- Time limit: section 23 of the Registration Act allows four months from execution to present a document for registration.
Where your POA gets registered in Mumbai: area by area
Mumbai's registration offices still carry old sub-district names, so the names do not always match the address. Andheri 3 sits in Khar, Borivali 1 sits in Goregaon, and the Kurla offices sit in Chembur and Nahur. The table follows the IGR Maharashtra office list for the Mumbai Division.
| Area | Joint Sub-Registrar offices nearby | Bodies your attorney deals with |
|---|---|---|
| Colaba, Cuffe Parade, Fort, Marine Lines | Mumbai City 1, Old Custom House, Fort | Old co-operative societies, cessed building records, A ward and neighbouring BMC ward offices |
| Worli, Lower Parel, Prabhadevi, Dadar | Mumbai City 2 to 5, MTNL building, Worli | Tower societies, builder possession and OC files, mill land redevelopment records |
| Bandra, Khar, Santacruz, Juhu | Andheri 3 and 4 (Khar West), Andheri 2 (BKC) | Bungalow and old society titles, redevelopment agreements, H West and K West ward offices |
| Andheri, Jogeshwari, Versova | Andheri 1 (Andheri West), Andheri 5 and 6 (Jogeshwari) | MHADA layouts, leave and licence heavy rental stock |
| Goregaon, Malad | Borivali 1, 4 and 6 (Goregaon) | Large layouts, MHADA colonies, rental management |
| Kandivali, Borivali | Borivali 7 (Charkop), Borivali 2, 3, 8 and 9 (Borivali East), Borivali 5 (Borivali West) | Charkop and Gorai layouts, older societies with share certificate gaps |
| Chembur, Ghatkopar, Kurla, Powai | Kurla 1 and 3 (Chembur) | Redevelopment, SRA pockets, Powai township societies |
| Mulund, Bhandup, Vikhroli | Kurla 2 and 4 (Nahur West) | New towers, builder resale, T and S ward property tax |
Within BMC limits, a 2024 state notification, as reported, merged the Mumbai offices into Mumbai City and Mumbai Suburban groups so that property documents can be registered at any Joint Sub-Registrar office in the city. A Model Sub-Registrar Office opened at Bandra Kurla Complex in September 2026 and also handles powers of attorney. Book through e-Step-in and confirm the office on the day.
Thane and Navi Mumbai are outside BMC limits. Thane flats go to the Thane district sub-registrar offices. Vashi and much of Navi Mumbai fall under Thane district, and a Model Sub-Registrar Office opened at Mahape in September 2026. Kharghar sits in Panvel taluka of Raigad district, so check which office serves your sector before you book.

Society, MHADA, CIDCO, SRA and BMC: what each one will ask your attorney
A registered POA is only half the job. Every Mumbai flat sits inside another system, and each system reads the POA its own way.
Co-operative housing societies
- The society secretary will want a self-attested copy of the registered POA and the attorney's ID before accepting letters or transfer forms.
- For a sale, the society's NOC and the transfer of shares come later, but most buyers' banks want to see that the society has no objection.
- Check the share certificate is in your name. If a deceased co-owner is still on it, fix that first through property transfer after death in Mumbai.
MHADA and CIDCO properties
- MHADA layouts across Andheri, Goregaon and Borivali often need MHADA's own transfer permission before the society can transfer shares. Your POA should expressly cover applications to MHADA.
- CIDCO flats and plots in Vashi, Nerul and Kharghar are mostly leasehold. Transfers need CIDCO's permission, so add power to apply to CIDCO's estate section and sign the forms it prescribes.
SRA and redevelopment buildings
- Slum rehabilitation tenements usually carry a lock-in on sale. Check the allotment letter conditions before drafting a sale POA.
- For redevelopment in Bandra, Chembur, Ghatkopar or Vile Parle, the attorney may need to sign the permanent alternate accommodation agreement and receive rent for temporary housing. List both powers.
BMC property tax and mutation
Changing the name on the BMC property tax bill is a separate step after a sale or inheritance. A POA lets your attorney apply, but the ward office will still ask for the registered deed. Our guide to property mutation timelines in Mumbai explains the sequence, and mutation after death in Mumbai covers the inheritance version.
Ask the society for its latest "no dues" letter before you sign the POA. If maintenance arrears exist, the buyer's bank will ask anyway, and your attorney should have power to clear them from the sale money.
Four Mumbai examples: what the POA said and why
Example 1: elderly parents in Dadar. A retired couple in a Dadar West society wanted their daughter to sell their flat and buy a smaller one in Thane. We drafted one SPA to sell the Dadar flat with a floor value and a named joint account, and a second SPA for the Thane purchase. Both carried Rs 500 government stamp duty because the daughter is a listed relative. The registering officer can attend a home where bodily infirmity prevents a visit, under section 38 of the Registration Act, and the family applied for that.
Example 2: three siblings in Borivali. A Borivali East flat was inherited by three siblings. Two lived in Pune and Bengaluru. Each gave the third sibling an SPA to sign the sale deed and the society transfer forms. Before that, the siblings signed a release deed in Mumbai for a fourth heir who wanted no share. Where heirs are many, our page on transfers with multiple legal heirs in Mumbai sets out the order of steps.
Example 3: a Powai owner moving to Pune. The owner wanted a friend to manage rent, renew the leave and licence and pay BMC tax. A sale power was not needed, so the GPA left it out. Stamp duty stayed at Rs 500 for one attorney, and the society accepted a registered copy for correspondence.
Example 4: Chembur redevelopment. A member who travels for work gave his brother power to sign the permanent alternate accommodation agreement, collect temporary rent cheques and take possession of the new flat. The POA named the developer, the building and the flat number so no one could stretch it to a sale.
In each case the POA named the property, the counterparty and the end point. That is what makes a Mumbai SRO, a bank and a society accept it without extra letters.
Why POAs get rejected in Mumbai: common mistakes and fixes
| Mistake | What happens | Fix |
|---|---|---|
| Signed on plain paper, stamped later | Document is insufficiently stamped; it cannot be registered or acted on until duty and penalty are paid | Pay duty through GRAS or franking before signing |
| Rs 500 stamp used for a sale POA to a cousin or friend | SRO or buyer's lawyer flags deficit; conveyance level duty becomes payable | Check the relationship against Article 48(f)(ii)(a) before buying stamps |
| Flat described by address only | Society and bank cannot match it with the share certificate and Index II | Add wing, flat number, CTS or survey number, village and society registration number |
| Joint owners, only one signs | Attorney can deal with one share only; buyer walks away | Every co-owner signs, or gives a separate POA |
| Sale power implied by "all acts" | Banks and buyers refuse; the sale stalls | List each power: sign agreement, receive money, sign sale deed, admit execution |
| Principal has died, POA still used | Authority ended at death; anything signed later is open to challenge | Move to succession: legal heir or succession certificate, or probate |
| No identifiers or wrong ID at the SRO | Registration refused on the day | Two identifiers with photo ID, originals of all parties' IDs |
| Old POA, no confirmation that it is alive | SRO asks for the declaration that the POA is in force and the principal is alive | Carry the original, a true copy and the declaration in the prescribed form |
The IGR Maharashtra checklist lists the original POA, a true copy and that declaration whenever an attorney executes a document. Buyers' lawyers in Mumbai often add a recent letter or video call with the principal before the sale deed.
Revoking or cancelling a POA in Mumbai
You can cancel a revocable POA at any time while you are of sound mind. The cancellation must reach everyone who might rely on the old POA, or it is close to useless.
- Sign a deed of cancellation (revocation). It is usually stamped as a cancellation under Article 15 of Schedule I, which carries Rs 500 government stamp duty. Confirm the clause with the sub-registrar.
- Register it if the original POA was registered, ideally at an office that can link it to the original registration number.
- Send written notice to the attorney by registered post and email. Keep proof.
- Inform the society, BMC ward office, banks and any developer with a copy of the registered cancellation.
- Publish a public notice in an English and a Marathi newspaper when a sale POA was in circulation.
A POA ends on its own when
- The principal dies
- The principal becomes of unsound mind
- The task is done, for an SPA
- The end date in the deed passes
It cannot be revoked at will when
- The attorney has an interest in the property
- It was given for consideration and stated as irrevocable
- Revoking would cause loss to the attorney's interest
- Ask a lawyer before you try
When the principal has died, the POA cannot help. The family needs a legal heir certificate in Mumbai or a succession certificate in Mumbai, and where there is a Will, transfer with a Will or a letter of administration. Our explainer on probate rules in Mumbai clears up a frequent confusion.
Before you sign: ten clauses a Mumbai property POA should have
- Full property schedule matching the share certificate, agreement and Index II
- Each power listed: advertise, negotiate, sign agreement for sale, receive money, sign sale deed, admit execution, hand over possession
- Floor value for any sale, and a ban on selling to the attorney or their relatives without written consent
- Bank account in the principal's name for every payment
- Society powers: transfer forms, NOC applications, share certificate endorsement
- Authority powers: BMC, MHADA, CIDCO or SRA applications, as the flat needs
- Tax and utilities: property tax, electricity and water account changes
- Substitution: whether the attorney may appoint someone else (usually no)
- End point: a date or event, such as registration of the sale deed
- Ratification clause that stays within the listed powers only
Selling with a POA has its own tax and money steps. Our article on the POA to sell property covers sale proceeds and paperwork, and how long a POA stays valid answers the validity question.

How we take your power of attorney from draft to registered copy
Eight steps, most of them done before you reach the sub-registrar.
Book a 20-minute assessment
Tell us the flat, the task and who the attorney is. We say which POA type and Article 48 clause fit, and what the society or bank will expect.
Check the property file
We read the share certificate, agreement, Index II and latest tax bill. Gaps such as a deceased co-owner or a missing society transfer get flagged now, not at the SRO.
Draft and agree the clauses
You get a plain-English draft with each power listed, the floor value, the bank account and the end point. You and the attorney approve it.
Pay government stamp duty
Duty is paid through GRAS, e-SBTR or franking before signing, based on the relationship and the powers given.
Enter data and book the slot
We complete the Public Data Entry on the IGR portal and book an e-Step-in token at a suitable Joint Sub-Registrar office.
Line up identifiers and originals
Two identifiers with photo ID, originals of everyone's ID, photographs and the property papers go in one folder.
Execute and register
You and the attorney appear, sign, give photographs and thumb impressions, and the officer registers the POA. Where bodily infirmity prevents a visit, we help apply for registration at home.
Hand over and follow through
You receive the scanned registered copy. We send copies to the society and bank, and the same team can handle the sale, mutation or succession step that follows.

Frequently Asked Questions
What is the stamp duty on a power of attorney in Maharashtra?
+Under Article 48 of the Maharashtra Stamp Act, most POAs carry Rs 500 government stamp duty. A POA to sell given without consideration to a parent, spouse, child, sibling, grandchild or the spouse's parent or sibling also carries Rs 500. A sale POA to anyone else, or one given for consideration, carries the same duty as a conveyance on market value. Developer POAs follow clause (g).
Is registration of a power of attorney compulsory in Maharashtra?
+Registration is compulsory for an irrevocable POA relating to transfer of immovable property, under section 17(1)(h) of the Registration Act as amended for Maharashtra. For revocable POAs it is optional in law, but any POA with power to sell, mortgage or gift a Mumbai flat should be registered, because buyers, banks and societies rarely accept an unregistered one.
Is a notarised power of attorney valid in Maharashtra?
+Yes, for many tasks. A notarised POA, properly stamped, works for bank operations, tax work, utility changes and collecting documents. It is weak for property sales: the buyer's bank and the society usually want a registered POA, and an irrevocable POA to transfer property must be registered. Notarisation never replaces stamp duty.
How do I register a power of attorney in Mumbai?
+Pay the Article 48 stamp duty, complete Public Data Entry on the IGR Maharashtra portal, and book an e-Step-in token at a Joint Sub-Registrar office. On the day, the principal and the attorney appear with original IDs, photographs and two identifiers. The officer records photographs and thumb impressions, collects the government registration fee and registers the POA.
What does the government collect for a power of attorney in Mumbai?
+Two government charges apply. Stamp duty under Article 48 is Rs 500 for most POAs and conveyance level duty for sale POAs to non-relatives or for consideration. The IGR registration fee is Rs 100 for most POAs and for family sale POAs without consideration, and 1 per cent of value capped at Rs 30,000 for other sale POAs. Page handling charges are extra.
Can I register a POA at any sub-registrar office in Mumbai?
+For property within BMC limits, a 2024 notification, as reported, lets documents be registered at any Joint Sub-Registrar office in Mumbai City or Mumbai Suburban. Thane, Navi Mumbai and Raigad properties have their own offices. Since rules and tri-letter codes change, we confirm the office when we book your e-Step-in token.
What value of stamp paper is needed for a power of attorney in Maharashtra?
+For most POAs, Rs 500 of government stamp duty, paid through e-SBTR, franking or GRAS e-payment. A sale POA to a non-relative or given for consideration needs duty equal to a conveyance on the flat's market value, which in Mumbai can be large. Check the clause first, since buying the wrong stamp means paying again.
How can I check a power of attorney online in Maharashtra?
+Registered documents can be searched on the IGR Maharashtra e-search service using district, document number or party name, and certified copies can be applied for at the office that registered it. If the POA was only notarised, there is no public record, so ask for the original and call the principal to confirm it is still in force.
Can a POA holder sell a flat in a Mumbai co-operative society?
+Yes, if the POA expressly gives power to sell, sign the sale deed, receive money and sign society transfer forms. The society will check the registered POA and the attorney's ID. The buyer's bank will also want the share certificate, a society NOC and proof that the principal is alive and the POA has not been revoked.
Does a power of attorney end when the principal dies?
+Yes. Under section 201 of the Indian Contract Act, the attorney's authority ends on the principal's death or unsound mind. Anything signed after that is open to challenge. The family must then move to succession, through a legal heir certificate, succession certificate, probate or a registered Will, depending on the asset.
Can I give a power of attorney to a friend in Mumbai?
+Yes. Anyone you trust can be your attorney. For management, banking or registration work, the duty stays at Rs 500. If the POA lets a friend sell or transfer your flat, Article 48 charges the same duty as a conveyance on market value, because only listed close relatives get the Rs 500 sale clause.
How long is a power of attorney valid in Maharashtra?
+A POA stays valid until the end date or task in the deed, until you revoke it, or until your death or unsound mind. There is no fixed expiry in law. In practice, Mumbai buyers and banks get nervous about POAs more than a year or two old and ask for fresh confirmation from the principal.
Can an elderly parent register a POA without visiting the sub-registrar?
+Section 38 of the Registration Act lets the registering officer attend a person's home when bodily infirmity prevents a visit, on application. Maharashtra offices process such visits on request, subject to official charges and availability. We prepare the application and medical note and coordinate the visit date with the office.
Can a Mumbai POA be used for a flat in Thane or Navi Mumbai?
+Yes, if it describes that property. One POA can cover flats in Mumbai, Thane and Navi Mumbai, but each must be listed in full. Registration happens at one office, and the attorney then uses certified or original copies at the Thane, Navi Mumbai or Raigad office where the sale deed is registered.
Can I register a power of attorney online in Maharashtra?
+Not fully. You can pay stamp duty online through GRAS, fill the Public Data Entry form on the IGR portal and book an e-Step-in token. The principal and attorney still appear at the Joint Sub-Registrar office for photographs, thumb impressions and admission of execution, unless a home visit is approved.
