Short answer: how an NRI power of attorney for Mumbai works
An NRI power of attorney for Mumbai property is drafted in India, signed abroad and then stamped in Maharashtra. In the UAE, Qatar or Kuwait you sign before the Indian Embassy or Consulate. In apostille countries such as the USA, UK, Canada, Australia and Singapore you sign before a local notary and get an apostille. The original is couriered to Mumbai, where your attorney pays Article 48 stamp duty within three months of its first receipt in Maharashtra, usually through adjudication by the Collector of Stamps. Your attorney then uses it at the Joint Sub-Registrar office.
- Sign at: Indian Embassy or Consulate in the UAE, Qatar, Kuwait; notary plus apostille in Hague countries
- Stamp in Mumbai: Within 3 months of the POA first reaching Maharashtra (Stamp Act s.18)
- Duty: Same Article 48 rules as a POA signed in Mumbai; no credit for foreign stamps
- Reviewed by: Propresolve legal team, independent advocates enrolled with the Bar Council
Your country, your signing route for a Mumbai POA
Where you sign decides how the POA is authenticated. India and most Western countries are in the Hague Apostille Convention; the UAE, Qatar and Kuwait are not.
| Where you live | Signing route | What reaches Mumbai | Watch out for |
|---|---|---|---|
| UAE (Dubai, Abu Dhabi, Sharjah, Northern Emirates) | Indian mission attestation Embassy Abu Dhabi or Consulate General Dubai, via the outsourced attestation centre | Original POA signed before the Consular Officer, with your photo on the front page | Personal presence with original passport and residence visa page; UAE is not an apostille country |
| Qatar, Kuwait | Indian Embassy attestation Sign before the Consular Officer at the Indian Embassy | Consular attested original | Neither country is in the Apostille Convention, so a local notary alone is not enough |
| Saudi Arabia, Oman, Bahrain | Apostille or Indian mission All three are now apostille countries; many residents still use the Indian mission | Apostilled or consular attested original | Arabic-only notarial pages need a certified English translation |
| USA | Notary plus apostille Notary public, then apostille from the Secretary of State of the state where notarised | Notarised POA with the apostille certificate attached | A county clerk step comes first in some states; the apostille must match the notary's state |
| United Kingdom | Notary plus apostille UK notary public, then the FCDO apostille | Notarised POA with the FCDO apostille | Solicitor certification alone is not a notarial act; use a notary public |
| Canada | Notary plus apostille Apostille available since 11 January 2024 through the federal or provincial competent authority | Notarised and apostilled POA | Older guidance tells you to visit the Indian mission; that is no longer the only route |
| Australia, Singapore, New Zealand, Europe | Notary plus apostille Local notary public, then the national competent authority's apostille | Notarised and apostilled POA | Check the apostille is on the POA itself, not on a separate copy |
Apostille membership dates are from the Hague Conference status table: India (2005), USA (1981), UK (1965), Canada (2024), Australia (1995), Singapore (2021), Saudi Arabia (2022), Oman (2012), Bahrain (2013). The UAE, Qatar and Kuwait are not listed.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentWhich POA should an NRI give for a Mumbai property?
From abroad, you cannot correct a vague POA quickly. Every fix means a new signing, a new attestation and a fresh courier. So the scope must be right the first time you sign.
A special POA suits you for
- Selling one Mumbai flat, with a floor value and your NRO account named
- Buying a new flat from a builder in Thane or Navi Mumbai
- A home loan, where the lender's own format is used
- One court matter or one society redevelopment
A general POA is reasonable for
- Long-term rental management of several units
- Ongoing BMC, society and utility work
- Relatives who live in Mumbai and handle everything
- Still list sale powers one by one, or leave them out
Most NRIs appoint a parent, sibling or adult child. If the POA includes power to sell and goes to a listed close relative without consideration, Article 48 duty in Maharashtra is Rs 500. If it goes to a friend, cousin or property manager, duty equals the conveyance duty on the flat's market value. That single fact often decides whom you appoint.
Our India-wide NRI power of attorney guide covers formats for other states. For the selling side, read how NRIs sell property through a POA, and for purchases, how NRIs buy property through a POA.
OCI and PIO cardholders can give a POA for Mumbai residential or commercial property in the same way. Agricultural land, plantations and farmhouses are outside what FEMA allows them to acquire, so a POA to buy such land will not help.
Country by country: signing your Mumbai POA abroad
UAE: Dubai, Abu Dhabi and the Northern Emirates
The UAE is not a party to the Apostille Convention. So a POA for Mumbai property is signed before a Consular Officer of the Embassy of India in Abu Dhabi or the Consulate General of India in Dubai. Attestation is run through an outsourced centre; in Dubai it moved to Al Nasr Central, Oud Metha in October 2024.
- Carry the original POA and a duplicate, unsigned. You sign in front of the officer.
- Bring your original passport, copies of its first pages and the page with your valid UAE residence visa.
- Paste a recent passport-size photograph at the top of the front page. If your attorney is in the UAE too, their photograph may be needed.
- The Embassy says such attestation is usually done the same day. Book a slot first.
We have a dedicated page on the POA from the UAE for property in India, and a broader guide for NRIs in Dubai with property in India.
Qatar and Kuwait
Both sit outside the Apostille Convention. Use the Indian Embassy in Doha or Kuwait City and sign before the Consular Officer. A local notary stamp alone will not satisfy a Mumbai sub-registrar.
Saudi Arabia, Oman and Bahrain
These joined the Convention (Oman in 2012, Bahrain in 2013, Saudi Arabia in 2022), so an apostilled notarial POA is legally possible. Many residents still sign at the Indian mission because the POA stays in English and Mumbai offices recognise the consular seal at a glance.
USA
Sign before a notary public in your state. Then get an apostille from that state's Secretary of State. "Power of attorney from USA to India" is one of the most searched NRI queries, and the usual slip is getting the apostille from a different state than the notary's commission.
United Kingdom
Sign before a notary public, then get the apostille from the FCDO Legalisation Office. A solicitor's certified copy is not a substitute.
Canada
Canada's apostille regime started on 11 January 2024. A notarised POA can now be apostilled by the federal or provincial competent authority instead of being legalised.
Australia, Singapore, New Zealand and Europe
All are apostille countries. Sign before a notary public, then get the apostille from the national competent authority. Keep the apostille physically attached to the POA.
Section 33 of the Registration Act recognises a POA signed by a person living outside India when it is authenticated by a notary public, a court, a magistrate or an Indian Consul. The apostille proves the foreign notary's seal. Neither step pays Indian stamp duty; that still happens in Mumbai.
The three-month clock: stamping your POA once it lands in Mumbai
This is where NRI POAs most often fail. Section 18 of the Maharashtra Stamp Act lets a document signed outside the State be stamped within three months after it is first received in Maharashtra. The clock runs from receipt, not from the date you signed.
- Keep proof of arrival. Save the courier airway bill, the tracking page and the envelope. The Collector may ask when the original reached Mumbai.
- Apply for adjudication to the Collector of Stamps under section 31. Brought within three months of first receipt, the Collector assesses the duty and certifies it under section 32.
- Pay the assessed duty within 60 days of the demand notice. Late payment attracts a penalty of 2 per cent of the deficit for each month, capped at four times the deficit.
- Collect the endorsed POA. The endorsement makes the POA receivable in evidence and registrable as if it had been duly stamped.
Brought in time
- Collector can certify the duty
- POA usable at the SRO, bank and society
- No penalty if paid within 60 days of demand
Brought after three months
- Section 32 bars the Collector from endorsing it
- It is treated as insufficiently stamped
- Penalty proceedings follow, and buyers lose patience
Do not send the original until your attorney is ready to start the stamping. Many NRIs courier the POA early "to be safe", and then the sale is delayed past the three-month window.
Stamp duty on an NRI POA for Mumbai property
A POA signed abroad pays the same government stamp duty as one signed in Mumbai. Section 19 of the Stamp Act charges the Maharashtra rate, less only duty already paid under a law in force in India. Foreign stamps or notarial charges abroad give no credit.
| What your POA does | Attorney | Government stamp duty |
|---|---|---|
| Sell your Mumbai flat, no consideration | Parent, spouse, child, sibling, grandchild, or spouse's parent or sibling | Rs 500 (Article 48(f)(ii)(a)) |
| Sell your Mumbai flat, no consideration | Anyone else | Conveyance duty on market value (Article 48(f)(ii)(b)) |
| Sell, with consideration paid for the power | Anyone | Conveyance duty on market value (Article 48(f)(i)) |
| Buy a flat, take a home loan, manage rent, register documents | Anyone | Rs 500 per person authorised in most cases |
For flats inside Mumbai's municipal limits, conveyance duty under Article 25(b) is 5 per cent of market value. Thane and Navi Mumbai municipal areas follow the same clause. Market value is read from the ready reckoner or the value stated, whichever is higher.
Registration, where needed, adds the government registration fee from the IGR Maharashtra table: ad valorem for sale POAs (capped at Rs 30,000) and Rs 100 for close-relative sale POAs without consideration and for most other POAs.
Using your POA in Mumbai: SRO, bank, society and BMC
Once stamped, your attorney carries the POA to each office that needs it. Each one checks something different.
| Office | What they check | What your attorney carries |
|---|---|---|
| Joint Sub-Registrar | Stamp endorsement, authentication, that the POA is in force and you are alive | Original POA, true copy, the declaration in the prescribed form, attorney's ID, two identifiers |
| Buyer's bank or your lender | Sale powers, NRO account clause, recent confirmation from you | Registered or adjudicated POA, your passport copy, a recent signed letter |
| Housing society | Attorney's identity, power to sign transfer forms | Copy of POA, share certificate, no dues letter request |
| BMC ward office | Power to apply for name change and pay tax | POA copy, registered sale or transfer deed |
| Builder (new purchase) | Power to sign agreement for sale, take possession, register | POA, your KYC, home loan sanction |
Many Mumbai buyers and SROs ask for a recent "life certificate" style confirmation that you are alive and the POA stands: a signed letter with a passport copy, or a short video call. Plan for it a week before the registration date.
Home loan lenders usually insist on their own POA format. Our note on the NRI home loan power of attorney explains why. For mutation work after a purchase or inheritance, see the POA for property mutation.
If you are in Mumbai on a visit, a local POA is simpler: see our power of attorney in Mumbai page for the resident route.
Mumbai areas where NRI POAs come up most, and what they need
| Area | Typical NRI job | What to add to the POA |
|---|---|---|
| Powai | Renting or reselling township flats owned by Gulf and US based families | Leave and licence powers, police verification of tenants, society parking letters |
| Bandra and Khar | Redevelopment of old societies, sale of parents' flats | Power to sign the PAAA and collect temporary rent; floor value for a sale |
| Juhu and Andheri West | Bungalow or society flat sales, often inherited | Title documents list, power to sign indemnities the buyer's lawyer asks for |
| Worli and Lower Parel | New tower purchases from builders, possession and OC follow-up | Power to sign the agreement for sale, pay instalments, take possession |
| Goregaon and Malad | Long-term rental of investment flats | Rent collection into your NRO account, maintenance and repairs |
| Borivali and Kandivali | Sale of family flats after parents pass away | Society transfer forms, heirs' releases, BMC name change |
| Chembur and Ghatkopar | Society redevelopment with family members abroad | Developer agreement signing, new flat allotment, rent cheques |
| Dadar and Colaba | Old cessed buildings, tenancy and ownership flats | Landlord or tenancy papers, cessed building repair board letters |
| Thane (Ghodbunder Road, Majiwada) | Under-construction purchases | Builder payments, home loan, registration at Thane offices |
| Navi Mumbai (Vashi, Kharghar) | CIDCO leasehold flats and plots | Power to apply to CIDCO for transfer permission and sign its forms |
Inherited flats are a large share of NRI work in Mumbai. When a parent has died, the POA only works once heirs have title in hand. See property transfer after death for NRIs in Mumbai, mutation and sale of inherited property by NRIs and what is different about Mumbai.
Three NRI examples from Mumbai
Example 1: NRI in Dubai selling a Powai flat. The owner signed an SPA in favour of her brother at the Consulate General of India in Dubai. The POA named the society, wing and flat, set a floor value and required every payment into her NRO account. The brother couriered nothing until the buyer's loan was sanctioned, then took the original to the Collector of Stamps within days of arrival. Duty was Rs 500 because a brother is a listed relative.
Example 2: NRI in New Jersey buying in Thane. The buyer signed a notarised SPA in New Jersey and got the New Jersey apostille. His father signed the builder's agreement for sale and the bank's documents in Thane. The lender asked for its own format too, so both POAs were signed in one notary visit to save a second courier.
Example 3: three siblings in London, Toronto and Singapore. Their late mother's Borivali flat needed transfer and sale. Their first plan was a notarised and apostilled POA from each of them in favour of a cousin. A cousin is not a listed relative, so the sale power would have attracted conveyance level duty on market value. They changed course: the eldest sister flew in for the registration week, and the other two gave apostilled POAs to her, at Rs 500 duty each because siblings are listed. Before any sale, a legal heir certificate for NRIs in Mumbai and a release deed from abroad settled the shares.
The relationship clause in Article 48 is narrow. Uncles, aunts, cousins and in-laws beyond the spouse's parents and siblings are outside the Rs 500 sale clause.
Why NRI POAs bounce in Mumbai, and how to avoid it
| Problem | Result | Avoid it by |
|---|---|---|
| UAE POA signed before a local notary only | Not authenticated in a form Mumbai accepts | Sign before the Indian Consular Officer |
| US apostille from the wrong state | Apostille does not match the notary | Apostille from the notary's own state |
| Original reached Mumbai, stamped after four months | Collector cannot certify; penalty route | Start adjudication within three months of receipt |
| Copy sent by email or scan | Only the original can be stamped and used | Courier the signed original with tracking |
| Signature differs from passport | SRO or bank queries identity | Sign as in your passport, on every page |
| Sale money to the attorney's account | Buyer's lawyer refuses; repatriation trouble later | Name your NRO account in the POA |
| No photo on the front page | Consulate or SRO returns it | Paste a recent photograph before signing |
| Joint owner abroad left out | Sale stalls for the missing share | Every co-owner abroad signs a POA |
Money, tax and revocation: what NRIs must plan for
Sale money and tax
- The buyer must deduct TDS on payments to an NRI seller, at the rate that applies to non-residents. See our note on TDS when buying from an NRI.
- Sale money should go to your own NRO account, never the attorney's. Our guide to repatriating sale proceeds sets out the bank steps.
- A lower deduction certificate from the tax department can reduce TDS. Apply before the sale agreement is signed.
Cancelling a POA from abroad
You can revoke a revocable POA from abroad with a deed of cancellation signed and authenticated the same way as the original: consulate in the UAE, Qatar or Kuwait, notary plus apostille elsewhere. Stamp it in Maharashtra, register it where the original was registered, and send notice to the attorney, the society, your bank and any buyer. A public notice in Mumbai newspapers protects you further. Divorce and family disputes change things; see POA issues in NRI divorce.
When the principal has died
The POA ends. Heirs abroad then need succession papers. Read POA vs letter of administration for NRIs, probate in Mumbai for NRIs and our POA for overseas legal heirs in Mumbai, with the clauses heirs should include.

Frequently Asked Questions
Can an NRI give a power of attorney for property in Mumbai?
+Yes. An NRI, OCI or PIO holder can appoint anyone in India to sell, buy, rent, mortgage or manage Mumbai property. The POA is signed abroad before an Indian mission or a notary with apostille, then stamped in Maharashtra within three months of reaching the State. Agricultural land is outside what OCI and PIO holders can acquire.
How do I make a power of attorney in the USA for a Mumbai flat?
+Print the POA drafted for Mumbai, sign it before a notary public in your state and get an apostille from that state's Secretary of State. Courier the original to your attorney in Mumbai. Within three months of arrival, they pay Article 48 stamp duty through the Collector of Stamps and then use it at the sub-registrar.
How do I make a POA in Dubai for property in Mumbai?
+Book an attestation slot with the Consulate General of India in Dubai, or the Embassy in Abu Dhabi. Carry the unsigned POA, your passport, passport and visa page copies and a photograph pasted on the front page. Sign before the Consular Officer. The UAE is not an apostille country, so a UAE notary alone will not do.
Does a POA signed in the UK need an apostille for Mumbai?
+Yes, in practice. Sign before a UK notary public and get the apostille from the FCDO Legalisation Office. India and the UK are both in the Apostille Convention, so no further embassy step is needed. The original then comes to Mumbai for stamping within three months of receipt.
Within how many days must a foreign POA be stamped in Maharashtra?
+Section 18 of the Maharashtra Stamp Act allows three months from the date the POA is first received in Maharashtra. If it is brought to the Collector of Stamps for adjudication within that period, the duty can be certified. After three months, section 32 stops the Collector from endorsing it, and penalty follows.
What is the stamp duty on an NRI power of attorney in Maharashtra?
+The same as for a POA signed in Mumbai. Most POAs carry Rs 500. A POA to sell given without consideration to a listed close relative also carries Rs 500. A POA to sell given to anyone else, or for consideration, carries conveyance duty on market value, which is 5 per cent inside municipal corporation limits.
Is a POA notarised abroad without apostille valid in Mumbai?
+Usually not enough. In Hague countries, the apostille confirms the foreign notary's seal, and Mumbai offices expect it. In the UAE, Qatar and Kuwait, which are outside the Convention, the POA should be signed before the Indian Consular Officer. A bare foreign notary stamp invites a refusal at the sub-registrar or the buyer's bank.
What is a life certificate for an NRI power of attorney?
+It is proof that the principal is alive when the attorney uses the POA. The IGR Maharashtra checklist requires a declaration that the POA is in force whenever an attorney signs a document. Buyers and banks often add a recent signed letter with a passport copy, a consulate life certificate or a video call before registration.
Can my attorney receive the sale money for my Mumbai flat?
+Your attorney can receive it only if the POA allows it, and it is wiser to insist that every payment goes to your own NRO account. Buyers' lawyers prefer that too. It keeps TDS credit, repatriation and your bank records clean, and stops the attorney from mixing your money with theirs.
Can I revoke my power of attorney while living abroad?
+Yes. Sign a deed of cancellation abroad using the same route as the original, consulate or notary with apostille. Courier it to Mumbai, stamp it within three months, register it where the original was registered and notify the attorney, society, bank and any buyer. A public notice in local newspapers adds protection.
Can an NRI use a POA for a home loan in Mumbai?
+Yes. Lenders let an attorney in India sign loan papers, the agreement for sale and the mortgage. Most banks insist on their own POA format and may ask for it to be registered. Sign the lender's format and your general purchase POA in the same consulate or notary visit to avoid two couriers.
How long is an NRI power of attorney valid for Mumbai property?
+No fixed expiry applies in law. It lasts until the end date or task in the deed, until you revoke it, or until your death or unsound mind. Mumbai buyers and lenders get wary of POAs signed long ago, so plan a fresh confirmation from you before each major use.
Can my POA be used in Thane or Navi Mumbai too?
+Yes, if those properties are listed. The same adjudicated POA can be used at Thane district offices, the Navi Mumbai offices including the Mahape Model Sub-Registrar Office, and CIDCO for transfer permission. List each flat or plot with its full description so no office questions the scope.
Is there a sample NRI power of attorney format for Mumbai?
+Samples online are a starting point only. A Mumbai POA needs the society details, CTS or survey number, Index II reference, named NRO account, a floor value and powers to deal with the society, BMC and, where relevant, MHADA or CIDCO. We draft it for your flat after a 20-minute assessment.
