How can an NRI give power of attorney for Hyderabad property?

Short answer

Sign the power of attorney in your country before a notary and get it apostilled, or sign it at the Indian Embassy or Consulate if you live in a non-apostille country such as the UAE. Courier the original to your attorney in Hyderabad. Within three months of its first arrival in India, it must be stamped with the District Registrar under the Indian Stamp Act as applied in Telangana. The attorney then uses it at the sub-registrar office to sign and present sale, rental or other deeds for you. The POA itself never transfers ownership.

  • Signing: Notary plus apostille, or Indian mission attestation in the UAE and other non-member countries.
  • Deadline: Stamp duty paid within 3 months of the original first reaching India.
  • Duty: 1% of market value to a non-family attorney with sale powers; flat duty for family.
  • Attorney: An India-resident relative or trusted person; banks usually insist on residence.

How to sign your Hyderabad POA in the country you live in

The route depends on whether your country is a member of the Hague Apostille Convention. Check the list below, then follow the matching steps.

Which power of attorney should an NRI sign for Hyderabad property?

Most NRI problems in Hyderabad start with a POA that is too broad, too vague or written for another state. Choose by the transaction you need done.

What you need done in HyderabadPOA to signKey powers to spell out
Sell a resale flat in Kondapur or GachibowliSpecial POA for that flat, or GPA limited to that saleAgree terms, receive the sale amount into your NRO account, sign and present the sale deed, hand over keys and society papers
Buy an under-construction flat in Kokapet or TellapurSPA for the purchaseSign the agreement for sale with the builder, check TG RERA registration, sign the sale deed, take possession
Let out and maintain a Madhapur apartmentGPA for management, without saleSign rental agreements, collect rent, pay property tax and association dues, deal with repairs
Take a home loan for a Hyderabad flatBank's own POA formatSign loan papers, create the mortgage, deal with the builder and bank as one chain
Sell or transfer a parent's house in SecunderabadPOA by each overseas heirApply for heirship papers, sign release or sale deeds, apply for mutation
Give ancestral land on the city edge for developmentDevelopment agreement cum GPABuilder's share only, landowner flats listed, stage-wise safeguards

A narrow SPA is better when

  • You are selling or buying one identified property
  • The buyer or their bank wants a clean, single-purpose deed
  • Your attorney is not a close family member
  • You may return to India within a year

A wider GPA makes sense when

  • You hold several Hyderabad properties needing year-round care
  • Tenants, tax, association and repairs need a single point of contact
  • The attorney is a parent, spouse or sibling you trust fully
  • You add clear limits, such as no gift and no mortgage

Our India-wide guide to the NRI power of attorney compares these types in more depth. For residents and families in India, see power of attorney in Hyderabad.

Country by country: apostille, consulate and notary routes

Apostille countries: USA, UK, Canada, Australia, Singapore and others

You sign before a local notary, who adds a notarial certificate. The competent authority then attaches an apostille that India accepts without embassy legalisation. Telangana's registration FAQ also accepts POAs attested by a notary public abroad.

  • USA: each state's Secretary of State issues the apostille for notaries commissioned in that state.
  • UK: the FCDO Legalisation Office issues it.
  • Canada: Global Affairs Canada, or the competent authority in provinces such as Ontario, Alberta, British Columbia, Quebec and Saskatchewan.
  • Australia: DFAT. New Zealand: the Department of Internal Affairs. Singapore: the Singapore Academy of Law.

UAE: the most common non-apostille case

The UAE is not a member of the Apostille Convention. NRIs in Dubai, Sharjah and Abu Dhabi sign the POA before the consular officer at the Consulate General of India, Dubai or the Embassy of India, Abu Dhabi, usually through the mission's appointed application centre. Carry your passport, visa page, Emirates ID and the attorney's ID copies. Our POA from UAE for property in India page and the guide for NRIs in Dubai cover booking in detail.

Qatar, Kuwait and other non-members

Sign at the Indian Embassy in Doha or Kuwait City in the same way. A local notarisation followed by foreign ministry legalisation is slower and Hyderabad SROs see it less often.

Signing at an Indian mission even in an apostille country

You can always sign before an Indian consul, for example at the Consulate in New York, San Francisco or Toronto. It avoids the apostille step, but appointments can take weeks, so compare timelines first.

Tip

Sign every page, add your photograph where the draft shows a photo box and sign across it, and leave no blank lines. Hyderabad SROs reject pages that look inserted later.

Stamping in Telangana: the three-month rule and the duty you pay

A POA signed abroad is usually on plain paper, so no Indian duty has been paid. Under Section 18 of the Indian Stamp Act, 1899, an instrument executed outside India may be stamped within three months after it is first received in India. The Telangana department's FAQ confirms this window and says the District Registrar receives the duty and endorses the document.

Worked timeline: an NRI in Dallas signs and apostilles a POA on 3 February. The courier delivers it to her brother in Kukatpally on 12 February. Duty must be paid by 11 May. Her brother books the stamping first, and only then the buyer's sale deed slot at the Kukatpally SRO.

  • Keep the courier receipt and tracking printout. It is your proof of the first-receipt date in India.
  • If you are unsure of the duty, the District Registrar can give an opinion on the correct duty under Section 31 (adjudication).
  • Miss the window and the POA can be impounded, with a penalty of up to ten times the deficit duty under the Telangana rules.
  • Where the POA is to be registered, it must be presented within four months of first reaching India, with a further four months only with the District Registrar's permission and a penalty.
Note

The department's FAQ says a GPA executed abroad and attested by an embassy, consulate or notary need not be registered again in Telangana, provided duty is paid in time. The SRO will still examine the stamped original when your attorney presents a sale deed, so courier the original, not a scan.

How much duty is payable

Duty is the government's charge under Article 42 of Schedule I-A, as applied in Telangana. It depends on who your attorney is and what the POA allows. The executant, meaning you, is liable to pay it unless agreed otherwise.

Your attorney isPOA allows sale, development or transferPOA for other acts only
Parent, spouse, child, brother or sisterFlat government stamp duty of Rs 1,000Nominal duty
Cousin, in-law, friend or agent1% of the government market value of the propertyNominal duty

The family list also covers grandparents and grandchildren in the department's fee table. If you are an NRI in London giving sale powers to a cousin for a Jubilee Hills house, the 1% on market value is a real sum, so consider a sibling or a narrow SPA.

Avoid an agreement of sale cum GPA unless you truly intend to sell on those terms. It attracts 6.5% duty and, for an NRI seller, it hands control of the sale to the buyer long before your tax and repatriation papers are ready.

Government charge figures come from the Telangana Registration and Stamps Department FAQ and G.O.Ms.No.59 of July 2021. Rates can change, so we recheck them on the department's calculator before your attorney pays.

Hyderabad localities where NRIs most often need a POA

Tip

Ask your attorney to pull a fresh encumbrance certificate from IGRS Telangana before you sign anything. It shows whether an old GPA or mortgage is still on record against the property.

Selling through an attorney: tax, NRO account and repatriation

The POA has to match the money trail. If the powers and the bank details do not line up, the sale may close but the funds get stuck.

  • Receiving the money: the POA should direct the sale amount into your NRO account and name the bank, so the attorney never handles cash.
  • Tax at source: a buyer paying an NRI seller must deduct tax at source on the gains. A lower deduction certificate from the Income Tax Department can reduce it; apply before the sale. See TDS for NRI property deals.
  • Repatriation: RBI allows NRIs to remit up to USD 1 million per financial year from NRO balances, including sale proceeds, after tax. Details in repatriation of sale proceeds.
  • PAN and identity: your PAN, passport and OCI card details in the POA must match those you give the buyer and the bank.

Example: an NRI in Toronto sells a Kondapur flat through his mother. The SPA lets her sign the sale deed at the SRO, but payment goes only to his NRO account in Hyderabad. He gets a lower deduction certificate before the sale and remits the balance after filing his return.

Our blog on using a POA to sell property lists the clauses buyers' lawyers in Hyderabad usually check.

Buying, home loans and banks: POAs that lenders and builders accept

Under foreign exchange rules, NRIs and OCI holders can buy residential and commercial property in India, but not agricultural land, plantation property or farmhouses. A POA cannot get around that. Read what NRIs can buy in India before signing a purchase POA for land near the airport or Shankarpally.

Buying from a Hyderabad builder

  • Confirm the project's TG RERA registration before signing
  • Give powers to sign the agreement for sale and the sale deed
  • Pay only from your NRE, FCNR or NRO account or by inward remittance
  • Allow the attorney to take possession and apply for mutation

Taking a home loan

  • Most banks want their own POA wording
  • Many require the attorney to be resident in India
  • Some banks need the POA authenticated by the Indian mission, not only apostilled
  • Stamp duty still has to be paid in India within three months

SBI's NRI POA instructions, for example, ask for an India-resident attorney, authentication by an Indian embassy or consulate for POAs signed abroad, and stamping in India within three months. Check your lender's format first. Our NRI home loan POA guide and POA to buy property explain how to combine them.

Inherited Hyderabad property when the heirs live abroad

Many NRI POAs in Hyderabad are about a parent's home that now belongs to several children in different countries. Each overseas heir signs a POA so one person in India can collect certificates, sign deeds and deal with GHMC.

A POA for heirs needs different wording from a sale POA. See POA for overseas legal heirs in Hyderabad and what to include in a heirs' POA. What changes for Hyderabad specifically is covered in NRI property transfer after death in Hyderabad.

Watch

If the parent's old GPA is still in someone's hands, it died with the parent. Do not let anyone sell on it; buyers' lawyers in Hyderabad check the death certificate date against the sale deed.

No power to receive money or to admit executionAttorney can sign but not complete the saleList each act, including admitting execution under Section 33

An SRO may also ask the attorney for an affidavit that the principal is alive and the POA has not been revoked. Keep a recent signed letter or video call record handy for that day.

Revoking a power of attorney from abroad

You can cancel a POA from overseas in the same way you signed it. Execute a deed of revocation before a notary with apostille, or at the Indian mission, and courier it to Hyderabad.

  1. Refer to the original POA by date, place and, if registered, its SRO document number.
  2. Stamp and, where the original was registered, register the revocation at the same SRO through someone you now trust.
  3. Send notice to the old attorney by email and registered post.
  4. Tell your bank, tenants, the association and any buyer or broker in talks.

A POA tied to a paid buyer's interest cannot be revoked by you alone. For family disputes involving a spouse, see POAs during an NRI divorce.

Frequently Asked Questions

How does power of attorney work for an NRI with property in Hyderabad?

+

You sign a POA abroad naming a trusted person in India, authenticate it by apostille or at the Indian mission, and send the original to Hyderabad. It is stamped within three months of arrival. Your attorney then signs and presents deeds for you at the SRO, but you remain the owner throughout.

Can an NRI make a power of attorney online for Hyderabad property?

+

Not fully. Drafting and review can happen online, but you must sign the original before a notary or Indian consular officer, and the original must physically reach India for stamping. Hyderabad SROs work from the stamped original, so a scan or an e-signed copy will not do for a property deed.

Is apostille enough for a POA from the USA to Hyderabad?

+

Yes, for most uses. The USA is an apostille member, so a POA signed before a US notary and apostilled by the Secretary of State is accepted under Section 33 of the Registration Act. It still has to be stamped in Telangana within three months. Some banks prefer Indian consulate attestation, so check with your lender.

How do I make a POA in Dubai for property in Hyderabad?

+

The UAE is not an apostille country, so sign the POA before the consular officer at the Consulate General of India in Dubai or the Embassy in Abu Dhabi, through their appointed centre. Carry your passport, Emirates ID and the attorney's ID copy. Courier the attested original to Hyderabad for stamping.

What is the time limit to stamp an NRI POA in Telangana?

+

Three months from the date the original first reaches India, under Section 18 of the Indian Stamp Act as applied in Telangana. Duty is paid to the District Registrar, who endorses the POA. After that, the POA can be impounded and a penalty of up to ten times the deficit can be levied.

Does an NRI POA need to be registered in Hyderabad?

+

The Telangana department's FAQ says a GPA executed abroad and properly attested need not be registered again, if duty is paid in time. In practice, the SRO examines the stamped original whenever the attorney presents a sale or other deed, and some buyers ask for it to be lodged. We advise on each case.

How much stamp duty is payable on an NRI POA in Telangana?

+

If the POA allows sale or development and the attorney is a parent, spouse, child or sibling, there is a flat government duty. For anyone else, it is 1% of the property's government market value. A POA for management only carries nominal duty. These are government charges, not professional charges.

Who can be the attorney for an NRI in Hyderabad?

+

Any adult of sound mind whom you trust, usually a parent, sibling or close friend living in India. Banks typically insist the attorney is resident in India. Choosing a family member keeps the government stamp duty low if the POA includes sale powers.

Can my attorney sell my Hyderabad flat while I am in the UK?

+

Yes, if the POA expressly allows sale, receiving the sale amount into your NRO account, signing the sale deed and admitting execution. The buyer will deduct tax at source and your attorney registers the sale deed at the SRO. Get a lower deduction certificate early if your gain is small.

Can an OCI holder give power of attorney for Hyderabad property?

+

Yes. OCI and PIO cardholders follow the same signing and stamping route as NRIs. Use your foreign passport details exactly as on the OCI card, and make sure the name matches the Hyderabad title deed, or add an affidavit explaining the difference.

Can an NRI buy agricultural land near Hyderabad through a POA?

+

No. Foreign exchange rules do not allow NRIs or OCI holders to acquire agricultural land, plantation property or farmhouses, and a POA cannot change that. NRIs can hold agricultural land they inherit. A POA to manage or sell inherited land is possible through the Bhu Bharati route.

What happens if my POA reaches Hyderabad after the courier is delayed?

+

The three months run from first receipt in India, not from the signing date, so a delay abroad does not eat into the window. Keep the courier tracking that shows the arrival date. If the original is lost, sign a fresh POA rather than relying on a copy.

How long is an NRI power of attorney valid?

+

Until the task is done, you revoke it, or either of you dies, unless the POA states an end date. Adding an expiry, such as two years, is wise for sale POAs. Our guide on NRI POA validity covers time limits and renewals.

How can I cancel a POA I gave before leaving India?

+

Sign a deed of revocation abroad with apostille or at the Indian mission, courier it home, have it stamped and registered at the SRO where the original was registered, and notify the old attorney and your bank in writing. A POA given to a buyer who has paid cannot be cancelled by you alone.

Can two NRI co-owners sign one POA from different countries?

+

Yes, but each must sign before a notary or mission in their own country and get it authenticated there. It is often simpler for each to sign a separate POA in favour of the same attorney. Both originals must reach Hyderabad and be stamped within their own three-month windows.
