NRI power of attorney in Bangalore: the short answer

Short answer

An NRI power of attorney in Bangalore is signed in your country of residence before a notary (then apostilled, in Hague countries) or before an Indian embassy or consulate, then couriered to Bengaluru. Karnataka does not need you to register it again if it was authenticated abroad, but it must be stamped within three months of first arriving in Karnataka. Sale power given to anyone outside your parents, spouse, children or siblings attracts 5% government stamp duty on market value. Your attorney also needs a recent life certificate when using it.

  • Signing: Notary plus apostille in Hague countries; Indian embassy or consulate attestation in the UAE, Qatar and Kuwait.
  • Stamping: Within three months of the original first reaching Karnataka (Section 18, Karnataka Stamp Act, 1957).
  • Registration: Not needed again in Karnataka for a POA executed and authenticated outside India, as per the Registration Act scheme.
  • Life proof: Draft Karnataka rules expect a life certificate from abroad dated within 15 days when the POA is used.

Pick the NRI POA that matches your Bengaluru task

Choose by task and by who will hold the power in Bengaluru. Both change the stamp duty, and the task decides how narrow the document should be.

Which POA should an NRI sign for Bengaluru property?

NRIs usually sign one of three documents. The choice decides how much control you keep while you are thousands of kilometres away.

Sign a narrow SPA when

  • You are selling or buying one identified property.
  • You want a cut-off date and a minimum sale value written in.
  • A bank is lending and wants a POA for one loan.
  • Heirs abroad need one sibling to finish the khata transfer.

A GPA makes sense when

  • You will be abroad for years and the property is rented.
  • Taxes, repairs and association work keep coming up.
  • You trust the holder fully and can monitor them.
  • The GPA still excludes sale, or limits it to one property.

We generally advise NRIs against signing an irrevocable POA unless money has genuinely changed hands and the holder's interest needs protecting. Once you sign one, you cannot cancel it on your own.

For a deeper look at drafting choices, read our guides on the NRI power of attorney to sell property and the NRI power of attorney to buy property.

Tip

Write in a clause that sale money goes only to your NRO or NRE account. It closes the most common route for misuse and it makes repatriation paperwork simpler later.

Country-by-country: how to sign your POA abroad

Indian law accepts a POA signed outside India when it is executed before and authenticated by a notary public, a court, judge or magistrate, an Indian consul or vice-consul, or a representative of the Central Government. India has been part of the Hague Apostille Convention since 2005, so a notarised POA from a member country is completed with an apostille instead of embassy legalisation.

Where you liveUsual routeWho completes itWatch out for
USANotary, then apostilleSecretary of State of the state where it was notarisedSome states want county clerk certification first; the Indian consulate route is the alternative
United KingdomNotary public, then apostilleFCDO Legalisation OfficeUse a notary public, not just a solicitor's witness signature
CanadaNotary or lawyer, then apostilleGlobal Affairs Canada or the competent provincial authorityCanada joined the Convention on 11 January 2024; older guides still describe embassy legalisation
AustraliaNotary public, then apostilleDepartment of Foreign Affairs and Trade (DFAT)A Justice of the Peace signature alone is not enough for property use
SingaporeNotary public, then apostilleSingapore Academy of LawSingapore joined in September 2021
Saudi Arabia, Bahrain, OmanApostille now possible, or Indian missionLocal apostille authority or the Indian embassySaudi Arabia joined in December 2022; check which route your buyer's bank prefers
UAEIndian mission attestationEmbassy of India, Abu Dhabi or Consulate General of India, DubaiUAE is not an Apostille Convention member, so a UAE apostille route does not exist
Qatar, KuwaitIndian mission attestationEmbassy of India in Doha or Kuwait CityNeither country is an Apostille member

Carry your passport, the unsigned POA printed single-sided, passport photographs and a copy of the title deed to the appointment. Sign only in front of the notary or consular officer, on every page if the draft asks for it, and make sure the seal and date are legible.

Signing before an Indian embassy or consulate works in every country. It takes an appointment and is often handled through the mission's outsourced service centre, so check the mission's own website for the current process. NRIs in the Gulf will find more detail in our page on a power of attorney from UAE for property in India.

Karnataka rules for a POA signed outside India

Three Karnataka rules decide whether your foreign-signed POA works at a Bengaluru counter.

1. Stamp it within three months of arrival

Section 18 of the Karnataka Stamp Act, 1957 allows an instrument executed only out of India to be stamped within three months after it is first received in Karnataka. After that window, the stamp authority cannot simply certify it, and an unstamped POA can be impounded and charged a penalty that the Act allows to reach ten times the duty. Keep the courier airway bill or other proof of the date it arrived.

2. The same Article 41 duty applies

Signing abroad does not reduce the duty. If you give sale power over Karnataka property to anyone other than your father, mother, spouse, sons, daughters, brothers or sisters, the duty is 5% of the market value. A POA to a cousin, friend, brother-in-law or property manager for selling a Whitefield flat lands in that category.

3. Registration and proof of life

Karnataka now requires registration for a POA with transfer power where the principal lives in India. Draft rules published on 2 February 2026 confirm that when the principal lives outside India, a POA executed before and authenticated by a notary, judge, magistrate or Indian consul does not need separate registration in Karnataka. The same draft asks the attorney to show that the principal is alive, through a life certificate from abroad produced within 15 days of issue, and to annex the original POA.

Tip

Get the life certificate only after the sale deed slot is fixed. A certificate signed a month early is likely to be refused under the 15-day window.

Where the stamping happens

Foreign-signed POAs are stamped through the Department of Stamps and Registration in Bengaluru, where the stamp authority examines the original, your passport copy and the proof of arrival before the duty is paid. We prepare that bundle, check the duty head and keep a scan of the stamped original before it goes back to the holder.

A POA signed in another Indian state, for example while you were visiting Mumbai, is treated differently: Section 19 of the Karnataka Stamp Act charges the difference between Karnataka duty and any duty already paid in that state.

Worked examples from Bengaluru NRI files

Example

An engineer in Dubai sold her two-bedroom flat in Whitefield. She signed an SPA for sale in favour of her brother at the Consulate General of India in Dubai, because a UAE notary plus apostille is not an option. Her brother is within the Karnataka family list, so fixed duty applied. The original reached Bengaluru by courier and was stamped in the second week, and a fresh life certificate from the consulate was timed to the sale deed slot at the east belt office.

Example

A couple in San Jose bought an apartment on Sarjapur Road with a home loan from an Indian bank. They signed the bank's own POA format and our purchase SPA before a California notary, then took both to the California Secretary of State for apostilles. Their friend in Bengaluru held a purchase-only power, so the 5% head did not apply.

Example

Three siblings, two in London and one in Bengaluru, inherited their father's house in Jayanagar. The London siblings signed SPAs before a UK notary with FCDO apostilles, giving their sister power to apply for the vamshavruksha certificate, the khata transfer and, later, the sale. Because the holder was their sister, the family concession applied to the sale power.

Example

A Toronto family needed to let a cousin manage rent on a Hebbal flat. Before 2024 they would have needed embassy legalisation. Now a Canadian notary plus an apostille is enough, and because the POA had no sale power, fixed duty applied even though a cousin is outside the family list.

Bengaluru areas where NRI POAs do the most work

NRI ownership in Bengaluru clusters around tech corridors and older family neighbourhoods. The POA wording should reflect what each area throws at the attorney.

AreaCommon NRI taskPowers worth adding
Whitefield, Bellandur, MarathahalliResale of apartments bought during IT postingsAssociation dues clearance, car park and share certificate transfer, east city corporation e-khata
Sarjapur Road, Electronic CityNew purchases and builder handoversSigning agreement for sale, sale deed, possession and builder NOC; panchayat or GBA records
HSR Layout, Koramangala, IndiranagarLong-term rentals and premium resaleLease signing, deposit refund, BDA layout records, BESCOM and BWSSB changes
Jayanagar, JP Nagar, Malleshwaram, BasavanagudiParents' houses passing to heirs abroadFamily tree certificate, khata transfer, mutation, partition or release, sale
Hebbal, YelahankaApartments and plots bought as investmentsPlot boundary and survey work, developer POA review, rental management
Bannerghatta RoadVillas and gated plotsLayout approval checks, association membership, sale or lease
DevanahalliPlots near the airport bought for future usePanchayat e-swathu, conversion papers, encumbrance tracking, fence and survey

Plot owners abroad should also consider a property due diligence check before a sale, as title gaps in outer layouts often surface only when the buyer's lawyer looks.

Selling or buying through your attorney: money, tax and bank points

The POA is only the authority. The sale or purchase still has to fit foreign exchange and tax rules.

  • Who can buy from you: NRIs and OCIs can sell residential and commercial property to residents, NRIs or OCIs. Agricultural land, plantation property and farmhouses follow tighter rules, so check before agreeing a buyer.
  • Tax withheld by the buyer: a buyer paying an NRI seller must deduct tax at source on the sale. A lower deduction certificate from the income tax department can reduce this if your actual gain is small. See our guide on TDS when an NRI sells or buys property.
  • Getting money out: RBI rules allow repatriation from an NRO account up to USD 1 million per financial year, with the right forms. Read NRI repatriation of sale proceeds.
  • Home loans: many lenders insist on their own POA format for an NRI borrower. Our blog on the NRI home loan power of attorney covers what banks look for.
  • Paying for a purchase: money for a Bengaluru purchase must come through normal banking channels or from your NRE, NRO or FCNR account. Cash or third-party payments create problems later when you sell and want to repatriate.
  • Buying from abroad: if you are new to Indian property, start with what NRIs can buy in India.
Tip

Keep your PAN active and linked, and make sure the name on your PAN matches your passport. Mismatches hold up both the TDS filing and the sub-registrar data entry.

Heirs living abroad: POAs after a death in the family

When a parent in Bengaluru dies, the POAs they signed end. The heirs, often spread across two or three countries, first establish heirship, and then the heirs abroad sign fresh POAs to one person in the city.

  1. Get the family tree certificate or legal heir certificate in Bengaluru. Heirs abroad can sign their consent documents through the same notary and apostille route. See NRI legal heir certificate in Bangalore.
  2. For bank deposits and shares, apply for a succession certificate in Bengaluru.
  3. Each overseas heir signs an SPA for khata transfer, mutation and, if agreed, sale. Our article on what an overseas heir POA should include lists the clauses.
  4. If an heir wants to give up their share instead, a release deed signed from abroad moves the share permanently.

Our full service for this situation is POA for overseas legal heirs in Bangalore, and the wider process is set out in property transfer after death for NRIs in Bangalore and mutation and sale of inherited property by NRIs. Where there is a will and a court route is needed, compare a POA with a letter of administration in this explainer.

Revoking an NRI power of attorney from abroad

You can end an ordinary POA from wherever you live. The revocation must be at least as formal as the POA it cancels.

  • Sign a deed of revocation before a notary with an apostille, or at the Indian mission, quoting the POA's date and any registration or stamping reference.
  • Courier it to Bengaluru and get it stamped within the same three-month window.
  • File or register it with the sub-registrar office that holds the original record, so a search shows the cancellation.
  • Tell the holder in writing by email and registered post, and inform your bank, tenant, association and any buyer in talks.
  • If the POA was widely used, place a public notice in Bengaluru newspapers.

Signing a new POA without revoking the old one leaves two people with power over the same flat. Revoke first, then sign the replacement.

Frequently Asked Questions

Can an NRI give power of attorney for property in Bangalore?

+

Yes. NRIs, OCI and PIO holders can appoint anyone they trust in Bengaluru. You sign in your country before a notary (with an apostille in Hague countries) or at an Indian embassy or consulate, courier the original, and get it stamped in Karnataka within three months of arrival. The holder can then act at the sub-registrar, khata office or bank.

What is the format of a power of attorney for an NRI?

+

A good NRI POA for Bengaluru names you with passport details, names the holder with Aadhaar details, describes the property by survey number and e-khata ID, lists each power, and sets limits such as an end date or minimum sale value. It has space for photographs, signatures and the notary or consular seal. A bank may add its own format for loans.

Can an NRI sell property in Bangalore through a power of attorney?

+

Yes. The holder signs and presents the sale deed using the original stamped POA and a recent life certificate from abroad. The buyer deducts tax at source on the sale, and proceeds should go to your NRO or NRE account. If the holder is not your parent, spouse, child or sibling, the POA attracts 5% duty on market value.

Does an NRI power of attorney need registration in Karnataka?

+

A POA executed and authenticated outside India by a notary, judge, magistrate or Indian consul does not need separate registration in Karnataka, as reflected in the draft rules of February 2026. It must still be stamped in Karnataka within three months of arrival, and the original must be produced wherever it is used.

What is the time limit to stamp a POA received from abroad?

+

Three months from the date it is first received in Karnataka, under Section 18 of the Karnataka Stamp Act, 1957. Missing the window means the document can be impounded and charged a penalty that can reach ten times the duty. Keep the courier receipt, because it is the easiest proof of the arrival date.

Can a UAE power of attorney be apostilled for India?

+

No. The UAE is not a member of the Apostille Convention. A POA signed in the UAE for Bengaluru property should be executed or attested at the Embassy of India in Abu Dhabi or the Consulate General of India in Dubai. The same applies in Qatar and Kuwait, through the Indian embassies there.

Can I sign the POA at the Indian consulate instead of a notary?

+

Yes, and it works in every country. A consular officer can attest your signature on the POA, which satisfies the Indian authentication requirement without an apostille. Missions usually need an appointment and often route the work through an outsourced service centre, so check your mission's current process before you go.

Why does the sub-registrar ask for a life certificate for an NRI POA?

+

Karnataka is tightening checks on POA sales after misuse cases. The draft rules ask the attorney to prove the principal is alive, and for principals abroad they accept a certificate from a notary, judge, magistrate or Indian consul produced within 15 days of issue. Get it close to the registration date.

Can an NRI give power of attorney to a friend?

+

Yes, but it changes the duty if the POA includes sale power. Only parents, spouse, children and siblings get the fixed duty for sale powers. A friend, cousin or in-law holding sale power means duty at 5% of market value. For management or purchase-only powers, a friend can hold the POA on fixed duty.

Can a power of attorney be used for a bank account in India?

+

Yes, for operating an NRO account or handling a home loan, if the POA covers it and the bank accepts it. Most banks prefer their own POA format and may restrict powers such as closing accounts. NRE account operations by a resident holder are usually limited to local payments, so ask your bank first.

Can an OCI card holder give a power of attorney for Bangalore property?

+

Yes. OCI holders execute the POA in the same way as NRIs, through a notary with an apostille or an Indian mission. The holder can manage, rent or sell residential and commercial property for them. Agricultural land and farmhouses carry ownership limits for OCIs, which the POA cannot get around.

Is there a fully online NRI power of attorney for Bangalore?

+

No. You can review the draft and plan everything online, but the POA must be physically signed before a notary or Indian consular officer, and the original must reach Karnataka for stamping. E-signatures and scanned copies are not accepted for property work at sub-registrar offices today.

Which countries need an apostille on a POA for Bengaluru property?

+

Any country that is a member of the Hague Apostille Convention, including the USA, UK, Canada, Australia, Singapore, New Zealand, Germany, Saudi Arabia, Bahrain and Oman. In those countries a local notary signs first and the competent authority adds the apostille. Non-members such as the UAE, Qatar and Kuwait use Indian mission attestation instead.

What if I sign the POA while visiting Bengaluru?

+

Then it is a POA executed in India, and the overseas route does not apply. Sign it at the jurisdictional sub-registrar office during your visit, with stamp duty paid before or at signing. If it includes power to sell or transfer, Karnataka now expects registration, so book the Kaveri slot before you fly in.

How long is an NRI power of attorney valid?

+

As long as the document says, or until the task is completed, you revoke it, or you or the holder die. Banks and buyers are more comfortable with a POA that has a clear end date, and some lenders ask for a POA signed recently. We usually suggest a validity period linked to the planned deal.

How can an NRI cancel a power of attorney given in Bangalore?

+

Sign a revocation deed abroad with the same notary and apostille or consular route, courier it, stamp it in Karnataka and file it with the sub-registrar that recorded the POA. Notify the holder in writing and tell every bank, tenant or buyer who relied on it. A newspaper notice helps if the POA was widely shown.
