NRI power of attorney in Chennai: the short answer
Sign the POA in your country of residence, before a notary or at an Indian embassy or consulate. In Apostille Convention countries such as the USA, UK, Canada, Australia and Singapore, the notarised deed then gets an apostille. In the UAE, Qatar and Kuwait, the Indian mission attests it instead. Courier the original to Chennai and pay Tamil Nadu stamp duty within three months of its arrival, as section 18 of the Indian Stamp Act requires. Registration is not compulsory for a POA executed abroad, but the Sub-Registrar will check stamping, authentication and a recent life certificate before a sale.
- Sign: Before a notary or an Indian mission where you live.
- Authenticate: Apostille in Convention countries; Indian mission in UAE, Qatar, Kuwait.
- Stamp in Tamil Nadu: Within three months of the original reaching India.
- Duty to sell: Flat rate for a family attorney; 1% of market value otherwise.
How to sign your POA, by country
The country you sign in decides the authentication. Get this wrong and the original has to travel back. Check your row before you book a notary.
| Where you live | Authentication route | Then in Chennai | Common slip |
|---|---|---|---|
| USA | Notary, then apostille Apostille from the Secretary of State of the state where it was notarised | Courier the original; stamp within three months | Remote online notarisation is not always accepted; ask us before you use it |
| United Kingdom | Notary public, then apostille Apostille from the FCDO Legalisation Office | Courier the original; stamp within three months | A solicitor's certified copy is not a notarised original |
| Canada | Notary, then apostille Canada joined the Convention on 11 January 2024; apostille from Global Affairs Canada or your province | Courier the original; stamp within three months | Older advice still says consulate only; both routes now work |
| Australia and Singapore | Notary, then apostille DFAT in Australia; Singapore Academy of Law in Singapore | Courier the original; stamp within three months | Signing before a Justice of the Peace instead of a notary |
| United Arab Emirates | Indian mission attestation Indian Embassy, Abu Dhabi or Consulate General, Dubai, through its service centre | Courier the original; stamp within three months | The UAE is not in the Apostille Convention, so an apostille is not available there |
| Qatar and Kuwait | Indian mission attestation Indian Embassy in Doha or Kuwait City | Courier the original; stamp within three months | Local Arabic notarisation alone will not do |
| Saudi Arabia, Oman, Bahrain | Apostille or Indian mission All three are Convention parties; Saudi Arabia since 7 December 2022 | Courier the original; stamp within three months | Arabic text without an English version for the Sub-Registrar |
Apostille status is taken from the Hague Conference status table, last updated 30 June 2026. Section 33(1)(c) of the Registration Act accepts a POA authenticated abroad by a notary or an Indian consul.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentWhat your Chennai attorney can do, and the POA each job needs
One broad POA for "everything in India" worries buyers and banks. Most NRIs do better with one focused POA per job. Pick your goal below.
| Your goal | POA that fits | Must include |
|---|---|---|
| Sell a flat or plot in Chennai | Special POA to sell | Power to sign, present and admit the sale deed, receive the price into your NRO account, and handle TDS papers |
| Buy a new flat on OMR or in Porur | Special POA to purchase | Power to sign the builder agreement and sale deed, pay duty and take possession |
| Take a home loan for a Chennai purchase | Banking and loan POA | Power to sign loan papers and create the mortgage; most banks want their own format |
| Let out and look after a house | General POA for management | Leases, rent, Corporation tax, EB and Metrowater, repairs and the association |
| Update patta or tax after an inheritance | Special POA for mutation | Power to apply before the Tahsildar and the Corporation and to sign affidavits |
| Act for you in a family settlement | Special POA for one deed | The exact deed, the property and your share |
Read more on each: POA to sell property in India, POA to buy property, home loan POA and POA for property mutation.
Clauses that make an overseas POA work in Chennai
- Your passport number, OCI number if any, and your address abroad, so the office can match your ID.
- The attorney's Indian address and Aadhaar number.
- A property schedule that mirrors the parent deed and patta, including survey and sub-division numbers.
- Power to receive the sale price only into a named NRO or NRE account in your name.
- Power to apply for and sign tax forms, including the lower deduction certificate where you seek one.
- Power to obtain certified copies, encumbrance certificates and guideline value statements from TNREGINET.
- A clear end date, so an unused POA does not sit around for years.
As an OCI card holder you can own and sell residential and commercial property in Chennai, but FEMA rules bar you from acquiring agricultural land, plantations or farmhouses. That matters for some ECR and outskirt plots. Check land classification before your attorney signs.
Signing abroad: apostille countries versus Indian mission countries
Apostille route (USA, UK, Canada, Australia, Singapore, Saudi Arabia, Oman, Bahrain)
- Print the final draft on plain paper, single sided.
- Sign every page before a local notary, with two witnesses if the draft asks for them.
- Paste your passport photo and put your thumb impression where marked.
- Send the notarised deed to the competent authority for an apostille.
- India is a Convention party since 2005, so no further embassy step is needed.
Indian mission route (UAE, Qatar, Kuwait, and an option everywhere)
- Book an appointment with the Indian embassy or consulate, often through its outsourced centre.
- Carry the unsigned POA, your passport, visa or residence card and photos.
- Sign in front of the consular officer, who attests the signature.
- Collect the attested original; it is ready for India as it is.
- Each mission sets its own appointment rules and timings, so check its website first.
Section 33(1)(c) of the Registration Act lets a Sub-Registrar accept a POA from a principal living outside India if it was executed before and authenticated by a notary public, a court, judge or magistrate, an Indian consul or vice-consul, or a representative of the Central Government.
The MEA's e-Sanad service is for Indian documents that are going abroad. It does not apply to a POA you sign overseas and send to Chennai.

Stamping in Tamil Nadu: the three-month rule and what you pay the state
A POA signed outside India can be signed on plain paper. Section 18 of the Indian Stamp Act, 1899 then allows it to be stamped within three months after it is first received in India. Miss that window and the document can only be admitted after duty and a penalty are paid, so plan the courier date with care.
The duty is Tamil Nadu's, set by Article 48 of Schedule I as amended by Act 13 of 2024 (Gazette of 3 May 2024). It is government stamp duty, not a PropResolve charge.
| What your POA does | Government stamp duty in Tamil Nadu |
|---|---|
| Power to sell, given without payment to a family member | A flat amount fixed in the Schedule |
| Power to sell, given without payment to anyone else | 1% of the market value of the property |
| Power to sell given for consideration | Conveyance duty on market value |
| Purchase, management, banking or single transaction | A flat amount fixed in the Schedule |
For this purpose "family" follows the Article 58 explanation: father, mother, spouse, son, daughter, grandchild, brother and sister, as read by the Madras High Court. Cousins, in-laws, friends and property managers fall outside it.
An engineer in Dubai wants to sell a two-bedroom flat in Velachery. If she appoints her brother in Chennai, the POA attracts the flat family duty. If she appoints a friend because her brother is abroad too, Tamil Nadu charges 1% of the flat's market value on the POA. On a high-value flat, that can change who she chooses.
How the stamping is done
- Your attorney collects the original and keeps the courier receipt as proof of the arrival date.
- The deed is presented to the registration office for adjudication of duty, and the duty is paid through the state's online payment route.
- The office endorses the duty paid on the original, which is then usable for the sale or purchase.
Why the family list matters more for NRIs
Many NRIs have no parent or sibling left in Chennai and turn to a cousin, a nephew or a trusted manager. Each of those choices moves a sale POA into the 1% band. Before you sign, ask whether a sibling elsewhere in India, or a spouse visiting Chennai, could act instead. Choosing the attorney first and drafting second saves a second round of signing abroad.
Chennai offices vary in how they handle this step. We confirm the current practice with the office before your attorney goes.
Does a POA signed abroad need registration in Tamil Nadu?
Not as a rule. Tamil Nadu's section 17(1)(h), added in 2012, makes property POAs compulsorily registrable "other than those executed outside India". The state's own statement of objects said the exclusion was deliberate.
That does not mean the Sub-Registrar takes it on trust. When your attorney presents a sale or purchase deed, the office usually checks:
- the original POA, stamped in Tamil Nadu within time;
- the apostille or Indian mission attestation;
- a recent life certificate showing you are alive, which Chennai offices commonly expect when an attorney sells;
- copies of your passport and visa or OCI card;
- the attorney's own ID, photos and presence.
If you are selling
- Life certificate dated close to the sale
- Buyer's lawyer will want the POA chain checked
- Price should come to your NRO or NRE account as allowed
If you are buying
- Attorney signs as your agent on the purchase deed
- Pay from your NRE or NRO account for a clean trail
- TDS on a resident seller is the buyer's duty; see our TDS note for NRI buyers
How your attorney presents the deed
Section 32 of the Registration Act lets a document be presented by the executant or by an agent holding a POA authenticated as section 33 requires. So your attorney, not you, sits before the Sub-Registrar, signs as your agent and has their own photo and fingerprints captured. Your foreign POA is the authority the office records against your name.
Some families choose to register the foreign POA anyway when it will be used repeatedly. We tell you whether that helps in your case.
Chennai localities: what NRIs usually ask their attorney to handle
| Area | Typical NRI matter | What the POA should cover |
|---|---|---|
| OMR: Sholinganallur, Perungudi, Thoraipakkam | Apartments bought from builders during IT years, now being sold or let | Builder NOC, association dues, undivided share of land, lease to corporate tenants |
| Velachery | Resale flats and rentals | Sale deed signing, tenant eviction notice, Metrowater and EB name change |
| Anna Nagar | Parents' Housing Board-origin house to be sold or rebuilt | Dealings with TNHB, joint development agreement, patta |
| Adyar and Besant Nagar | Inherited bungalows shared by siblings in different countries | One attorney for all heirs, release deed signing, sale |
| Mylapore and T Nagar | Older commercial and residential buildings with long tenancies | Rent agreements, Rent Authority filings, building tax |
| Nungambakkam and Kilpauk | High-value flats with loans still running | Loan closure, title deed release, sale |
| KK Nagar and Ashok Nagar | Housing Board flats held by retired parents | TNHB conveyance, society transfer, sale or settlement |
| Porur and Guindy | New purchases near the IT and industrial belt | Purchase deed, home loan papers, possession |
| Tambaram and Pallavaram | Plots and independent houses in suburbs | Tax with Tambaram City Municipal Corporation, patta sub-division, sale |
| ECR | Plots and weekend homes | Land classification checks, coastal zone conditions, sale |
| Ambattur | Plots near the industrial estate | Land use check, encumbrance search, sale or lease |
Registration offices are fixed by revenue village. Our power of attorney in Chennai page lists the Sub-Registrar offices usually involved for each of these areas.
Plan your timeline backwards from the registration date
Most delays come from documents expiring in the wrong order. Work back from the day your attorney will sit before the Sub-Registrar.
| Stage | Typical time | What to watch |
|---|---|---|
| Draft agreed with us | 2 to 4 working days | Property schedule copied exactly from the parent deed |
| Notary and apostille, or mission attestation | A few days to three weeks, by country | US state apostilles and UAE mission slots are the usual bottlenecks |
| Courier to Chennai | 3 to 7 days | Keep the tracking record; it proves the arrival date |
| Tamil Nadu stamping | Within three months of arrival | Late stamping means a penalty |
| Life certificate | Close to the sale date | Offices treat it as current for a short window, commonly 30 days |
| Sale or purchase registration | On the token date | Buyer's bank, TDS and payment trail in place |
A couple in New Jersey are selling a Thoraipakkam flat in March. They finalise the draft in January, notarise it the next week and wait about ten days for the state apostille. The original reaches Chennai in early February and is stamped the same month, well inside three months. The husband signs a life certificate at a local notary in late February, so it is fresh for the March registration.
Sign the life certificate on a later trip to the notary or consulate, not with the POA itself. Then it is fresh when your attorney needs it.

Why NRI POAs get stuck in Chennai
| What went wrong | Result | Fix |
|---|---|---|
| Apostille asked for in Dubai | Weeks lost; none is available there | Use the Indian mission in the UAE |
| Original arrived in India months ago and sat in a drawer | Penalty on top of duty | Stamp within three months of arrival |
| Friend named as attorney to save time | 1% of market value as stamp duty | Name a family member where one is available |
| Scanned copy emailed to Chennai | Not accepted for registration | Courier the signed original |
| Property described by flat number only | Buyer's lawyer and the office query it | Survey number, village, extent and parent document |
| Old life certificate | Sale registration deferred | Fresh certificate shortly before the date |
| POA from the parent who has since died | POA is void after death | Heirs need succession papers; see below |
Our article on NRI power of attorney validity explains how long an overseas POA stays usable.
Cancelling an NRI POA without flying to Chennai
- We draft a deed of revocation naming the POA, its date and, if registered, its document number and office.
- You sign it abroad and authenticate it the same way as the original: apostille or Indian mission attestation.
- The original reaches Chennai and is stamped in Tamil Nadu. If the POA was registered, the cancellation is registered too, and section 64-A carries notice to the office where the property lies.
- We send notice to the attorney holder by email and registered post and ask for the original back.
- Banks, the association and any buyer or tenant in contact with the attorney are told in writing.
If you are visiting Chennai anyway, you can sign and register the cancellation in person at any Sub-Registrar office. We book the token so it fits your trip.

When the owner has died: a POA cannot carry the property forward
Every POA ends with the death of the person who gave it. If a parent in Chennai has passed away, the heirs abroad need succession papers first, and only then a fresh POA from each heir.
- Legal heir certificate: issued by the Tahsildar in Tamil Nadu. See our NRI legal heir certificate in Chennai service.
- Succession certificate: for bank balances and securities, through the NRI succession certificate route.
- POA versus letter of administration: know which you need; read POA or letter of administration.
- Heir POAs: what each overseas heir's POA must say is in our guide to a power of attorney for overseas legal heirs.
- Release deeds: siblings who want to give up their share can sign abroad; see the release deed process.
- Wills and probate: where there is a will, read about probate of a will for NRIs.
- Patta and sale: update records with the patta transfer after death process, then see selling inherited property as an NRI.
Two sisters in London and Toronto inherit their mother's flat in Adyar. Each signs a POA abroad in favour of their cousin in Chennai, one apostilled in the UK and one in Canada. Because a cousin is outside the family list, each POA with power to sell would attract duty at 1% of market value. They change the plan: the London sister gives a POA to the Toronto sister, who flies to Chennai once for the sale. A sister is in the family list, so the flat family duty applies.

Frequently Asked Questions
Can an NRI give power of attorney for property in Chennai?
+Yes. An NRI, OCI or PIO can appoint any trusted adult in India as attorney. The POA is signed abroad before a notary or an Indian mission, authenticated by apostille or mission attestation, and stamped in Tamil Nadu after it arrives. The attorney can then sell, buy, let or manage the property within the powers written in the deed.
Does an NRI power of attorney need to be registered in Tamil Nadu?
+Not compulsorily. Tamil Nadu's 2012 amendment requires registration of property POAs executed in India, and expressly leaves out POAs executed outside India. Your POA must still be authenticated under section 33(1)(c) of the Registration Act and stamped in Tamil Nadu within three months of arrival before it is used.
How do I make a power of attorney from the USA for property in Chennai?
+Get the draft from your Indian lawyer, sign it before a US notary, then obtain an apostille from the Secretary of State of the state where it was notarised. You may instead sign at an Indian consulate. Courier the original to Chennai and have it stamped in Tamil Nadu within three months.
How do I send a power of attorney from Dubai to Chennai?
+The UAE is not a party to the Apostille Convention. Book an appointment with the Indian Embassy in Abu Dhabi or the Consulate General in Dubai, usually through its service centre, and sign before the consular officer. Courier the attested original to Chennai, where it is stamped under Tamil Nadu law within three months.
What is the time limit to stamp a POA executed abroad in Tamil Nadu?
+Section 18 of the Indian Stamp Act, which applies in Tamil Nadu, allows a document executed only outside India to be stamped within three months after it is first received in India. After that, duty plus a penalty is needed before it can be used. Keep the courier receipt to prove the arrival date.
What is a life certificate for an NRI power of attorney?
+It is a short certificate that the principal is alive on a stated date. When an attorney registers a sale for an NRI in Chennai, the Sub-Registrar commonly asks for one that is recent, often within about 30 days. You can sign it before a notary or Indian mission abroad, authenticated the same way as your POA.
Can my POA holder sell my Chennai flat without me visiting India?
+Yes, if your POA expressly gives power to sell that flat, is properly authenticated and stamped, and a fresh life certificate is ready. Your attorney signs and presents the sale deed at the Sub-Registrar. The price should reach your NRO or NRE account, and the buyer deducts TDS as the law requires.
Is a POA signed at the Indian consulate better than an apostille?
+Both are valid under section 33 of the Registration Act. In apostille countries, a notary plus apostille is often quicker to book. In the UAE, Qatar and Kuwait, the Indian mission is the practical route. Some Chennai banks prefer consular attestation, so ask your bank if a loan is involved.
What stamp duty applies to an NRI POA to sell property in Tamil Nadu?
+Under Article 48 as revised in May 2024, a power to sell given without consideration to a family member attracts a flat government stamp duty. If the attorney is not in the family list, duty is 1% of the property's market value. A POA given for consideration is charged like a conveyance.
Can an OCI card holder give a POA to sell Chennai property?
+Yes, for residential or commercial property the OCI holder owns. The process is the same as for an NRI. FEMA rules do not let OCI holders acquire agricultural land, plantations or farmhouses, so an OCI cannot use an attorney to buy such land. Inherited agricultural land has its own rules.
How long is an NRI power of attorney valid for Chennai property?
+Indian law sets no fixed expiry. It lasts until its stated end date, until the task is done, until you cancel it, or until your death. Offices may question an old POA and will ask for a fresh life certificate, so many NRIs add a clear end date and renew if needed.
Can my attorney sign a home loan for a Chennai purchase?
+Yes, if the POA covers loan documents and creation of the mortgage. Most banks want their own POA format, sometimes with consular attestation. Ask the lender for its format before you sign, so you do not have to authenticate twice.
How do I cancel an NRI POA from abroad?
+Sign a deed of revocation before a notary or Indian mission, authenticate it like the original, and courier it to Chennai for stamping. Register the cancellation if the POA itself was registered. Send notice to the attorney and to banks, buyers and tenants who dealt with them.
What if the Sub-Registrar does not accept my foreign POA?
+First find out the exact objection in writing. Most refusals are about missing authentication, late stamping, an unclear property description or an old life certificate, and each can be fixed. If an office refuses a properly executed and stamped POA without a legal basis, the remedy lies before the Madras High Court.
Can a POA be used after the NRI owner passes away?
+No. The POA ends on death. The heirs need a legal heir certificate from the Tahsildar, and sometimes a succession certificate or probate. Each heir who lives abroad then signs a fresh POA in favour of someone in Chennai to complete patta updates or a sale.
Can my attorney in Chennai pay the stamp duty on my POA?
+Yes. Once the original arrives, your attorney can present it for stamping and pay the Tamil Nadu government stamp duty through the state's online payment route. Keep the payment receipt with the POA. We usually prepare the duty working and the papers so your attorney only has to attend once.
