Power of attorney in Chennai: the short answer
A power of attorney in Chennai is a deed in which you (the principal) authorise another person (the attorney holder) to act for you. If it relates to immovable property in Tamil Nadu and is signed in India, registration with a Sub-Registrar is compulsory under the state's 2012 amendment to section 17 of the Registration Act. You can register it where the property lies or where you ordinarily live. Government stamp duty depends on the power given: a flat amount for most POAs, and a value-based duty when a non-family member gets power to sell.
- Registration: Compulsory in Tamil Nadu for POAs on immovable property signed in India.
- Where: Sub-Registrar where the property lies or where the principal ordinarily lives.
- Stamp duty: Flat for most POAs; 1% of market value for a non-family power to sell.
- At the SRO: Photos and fingerprints of principal, agent and both witnesses on the deed.
Which power of attorney do you need in Chennai?
Start from the job you want done. The table shows the usual document, whether Tamil Nadu expects it registered, and the trap people fall into most often.
| Your situation | Document that usually fits | Registration in Tamil Nadu | Watch out for |
|---|---|---|---|
| Selling a flat in Anna Nagar while you are in hospital or travelling | Special POA to sell Name the flat, survey number and document number | Compulsory, and stamp duty depends on whether the attorney is family | A life certificate for the principal is usually asked for when the sale deed is registered |
| Buying a plot on OMR or in Tambaram while you stay in another city | Special POA to purchase Include power to sign the sale deed and pay duty | Compulsory if it covers immovable property | Builders and banks may want their own wording added; check before signing |
| Letting and maintaining a house in Adyar or Besant Nagar | General POA for management Rent, repairs, tax, EB and Metrowater | Compulsory when it deals with the property itself | Leave out power to sell unless you really mean it |
| Elderly parents in Mylapore who cannot visit offices | General POA to a son or daughter Bank, pension, tax and property upkeep | Compulsory for the property powers; the Sub-Registrar can attend at home on request | The POA ends if the parent dies; heirs then need a legal heir certificate |
| Three co-owners of an inherited Kilpauk house | One POA from each co-owner to a single attorney Or one joint deed signed by all | Compulsory | Each co-owner must sign before the SRO or authenticate it properly |
| Developer agreement for a Velachery plot | POA for consideration linked to the development deed Usually irrevocable in practice | Compulsory | Government stamp duty is charged like a conveyance on market value |
| Bank locker, FD or share work only | Special POA for banking No property powers | Not compulsory; notarised may be enough | Banks often insist on their own format, so ask the branch first |
The Registration (Tamil Nadu Amendment) Act, 2012 made property POAs signed in India compulsorily registrable. A POA signed outside India follows a different route, explained on our NRI page.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentGPA, SPA, POA for consideration: choosing the right deed
Most Chennai families ask for a "GPA" because that is the word they have heard. In practice, a narrow deed is often safer. Sub-Registrars, banks and buyers trust a POA that names the exact property and the exact acts.
General power of attorney (GPA)
- Broad powers over a subject, for example "all my properties in Chennai district".
- Good for long absences, ageing parents and ongoing management.
- Higher risk: a broad GPA with power to sell can be misused.
- Called athikaara aavanam (அதிகார ஆவணம்) in everyday Tamil.
Special power of attorney (SPA)
- One property, one transaction, or a short list of acts.
- Suits a single sale, purchase, loan or registration.
- Ends naturally once the job is done.
- Easier for a buyer's lawyer and a bank to accept.
Irrevocable POA and "power coupled with interest"
Under section 202 of the Indian Contract Act, 1872, where the attorney holder has an interest in the property itself, the authority cannot be ended to the prejudice of that interest. This is common in joint development deals, where the landowner gives the builder a POA to sell the builder's share of flats.
Writing the word "irrevocable" on an ordinary family POA does not make it irrevocable. The interest has to be real, and the deed then usually attracts conveyance-level government stamp duty in Tamil Nadu.
What about a "durable" POA?
Indian law does not have the durable POA known in the US. Section 201 of the Contract Act ends an agency on the death of the principal or when the principal becomes of unsound mind. For a parent with early dementia, plan the POA while capacity is clear, and think about a registered will alongside it.
Clauses every Chennai property POA should carry
- Full names, ages, addresses and Aadhaar details of principal and attorney holder.
- Property schedule with survey number, sub-division, village, taluk, extent and boundaries, copied from the parent deed.
- Each power listed separately: sign, present, admit, receive the price, apply for patta, deal with the Corporation, EB and Metrowater.
- Whether the holder may appoint a substitute. Leave this out unless needed.
- A duty to account for money received, and a bar on selling below a stated floor if you wish.
- An end date or a condition on which the POA lapses.
- A clause on ratification: you confirm lawful acts done within these powers.
- Space for the photographs and fingerprints section 34-B requires.
If you only need someone to present and admit a sale deed you have already signed, ask for a POA limited to presentation for registration. Tamil Nadu charges a smaller flat duty for that narrow purpose than for a power to sell.
Tamil Nadu registration rules in plain words
The central Registration Act, 1908 leaves most POAs optional to register. Tamil Nadu changed that for property. The Registration (Tamil Nadu Amendment) Act, 2012 (Act 29 of 2012) made four changes that matter to anyone in Chennai.
| Provision | What it says | What it means for you |
|---|---|---|
| Section 17(1)(h) | Instruments of power of attorney relating to immovable property, other than those executed outside India, must be registered. | A notarised-only property POA signed in Chennai will not be accepted to register a sale. |
| Section 28 proviso | Such a POA may also be presented where the principal ordinarily resides. | A T Nagar resident can register at the T Nagar office even if the plot is in Tambaram. |
| Section 34-B | Passport-size photographs and fingerprints of the principal, the agent and the identifying witnesses must be on the deed, and the agent must sign it. | The attorney holder has to come to the office too. Many people miss this. |
| Section 64-A | When a POA, or its revocation, is registered outside the sub-district where the property lies, a copy is sent to that sub-district. | The office handling your property later can see the POA and any cancellation. |
Other rules that still apply
- Section 32 and 33, Registration Act: an agent can present a document for registration only under a POA executed and authenticated as section 33 requires. For a principal living in India, that usually means a POA registered or authenticated by the Registrar or Sub-Registrar.
- Powers of Attorney Act, 1882: acts done by the attorney holder within the powers bind you as if you did them yourself.
- Life certificate: when a registered POA is later used to sell property, Chennai Sub-Registrars commonly ask for a recent certificate that the principal is alive. Practitioners report a 30-day window; confirm with the office.
All registration work runs on the state portal, TNREGINET (tnreginet.gov.in). You can enter document details, book a token, check the guideline value and pull an encumbrance certificate there. Our general guide to power of attorney registration in India explains how other states differ.
Government stamp duty on a POA in Tamil Nadu (Article 48, revised 2024)
Tamil Nadu revised Article 48 of Schedule I to the Indian Stamp Act through the Indian Stamp (Tamil Nadu Amendment) Act, 2023, published as Act 13 of 2024 in the Gazette of 3 May 2024. The amounts below are government stamp duty, paid to the state. They are not PropResolve charges.
| Type of POA | How the government stamp duty is worked out |
|---|---|
| Only to present and admit documents for one transaction | Flat amount fixed in the Schedule |
| To act in a single transaction | Flat amount fixed in the Schedule |
| General POA for several acts, up to five or up to ten attorney holders | Flat amount fixed in the Schedule |
| Given for consideration with power to sell | Same duty as a conveyance, on the market value of the property |
| No consideration, power to sell given to a family member | Flat amount fixed in the Schedule |
| No consideration, power to sell given to someone outside the family | One rupee for every hundred rupees of market value, that is 1% |
| Any other case | Flat amount for each person authorised |
Who counts as "family"
Article 48 borrows the family definition used for settlement deeds in Article 58. Reported decisions read it as father, mother, spouse, son, daughter, grandchild, brother and sister. A recent Full Bench decision of the Madras High Court held that grandparents are not covered, so a POA to a grandparent with power to sell may attract the 1% rate.
A widow in KK Nagar wants her flat sold. A POA to her daughter attracts the flat family duty. The same power given to a family friend or a broker attracts duty at 1% of the flat's market value. Choosing the attorney holder is therefore a money decision as well as a trust decision.
Registration charges were also revised from 10 July 2023, and press reports say a non-family POA now carries a registration fee linked to guideline value. Check the current figure on TNREGINET when the deed is ready, because the state revises these through notifications.
Where your POA gets registered in Chennai: area by area
Sub-Registrar jurisdiction in Chennai follows revenue villages, not postal names. One street can fall under a different office from the next. We check the survey village before you book a token. The table shows the offices usually involved for the areas we see most.
| Area | Sub-Registrar office usually involved | Local point to plan for |
|---|---|---|
| Anna Nagar | Annanagar SRO | Many TNHB-origin plots; the POA should cover dealing with the Housing Board if the sale deed from the Board is pending. |
| Adyar and Besant Nagar | Adayar SRO | Older family homes and TNHB layouts; heirs often need a POA plus a legal heir certificate. |
| T Nagar | Thiyagaraya Nagar SRO | Mixed residential and commercial buildings; include power to deal with tenants and lease deeds. |
| Mylapore | Mylapore SRO | Old title chains; ask for a long encumbrance certificate before the attorney signs anything. |
| Nungambakkam and Kilpauk | Chennai Central registration district offices | High-value flats; banks often vet the POA wording before a loan closure or sale. |
| KK Nagar and Ashok Nagar | Ashok Nagar or Kodambakkam side offices, by village | Housing Board allotments are common; confirm the conveyance from TNHB is registered. |
| Velachery | Velacheri SRO | Many apartment resales; the POA should cover the undivided share of land as well as the flat. |
| OMR: Perungudi, Thoraipakkam, Sholinganallur | Neelankarai or the nearby south Chennai offices, by village | New apartment handovers; include power to sign with the builder and the association. |
| ECR: Neelankarai, Injambakkam and beyond | Neelankarai SRO; further south, Chengalpattu district offices | Plots near the coast may carry coastal zone conditions; check before buying through an attorney. |
| Guindy and Alandur | Alandur SRO | Close to the airport belt; check for land acquisition notes in the EC. |
| Porur | West Chennai offices, decided by revenue village | Part of the area sits outside Corporation limits, which changes who handles tax. |
| Tambaram and Pallavaram | Chengalpattu registration district offices | Property tax now sits with Tambaram City Municipal Corporation, not the Greater Chennai Corporation. |
| Ambattur | Ambattur SRO | Mix of industrial and residential land; confirm land use before the attorney signs a sale. |
Remember the section 28 proviso: you are not tied to the property's office. A principal in Anna Nagar can register a POA for an OMR flat at Annanagar SRO, and section 64-A ensures the OMR office receives a copy.
Using the registered POA: patta, tax, EB, Metrowater and banks
Registration is only the first step. The attorney holder then has to use the POA at several offices, and each one reads it closely. Draft the powers with these offices in mind.
- Patta and chitta: name transfer runs through the Tahsildar under the Revenue Department. Patta follows title, so for a death in the family read our guide on patta transfer after death in Tamil Nadu.
- Property tax: the Greater Chennai Corporation handles most city areas. Tambaram, Pallavaram and Avadi have their own corporations. The POA should expressly allow the holder to apply for assessment name change.
- Electricity and water: name change of the EB service connection and the Metrowater connection usually needs the owner's signature or a POA that says so.
- Banks: loan closure, release of title deeds and locker access often need the bank's own format. Ask the branch before you finalise the deed.
- Apartment associations and TNHB: NOCs, share certificates and allotment files need explicit mention.
- Mutation of records: our property mutation team can run the record updates using the same POA.
A retired couple in Besant Nagar moved to their son's home in Coimbatore and let their house. Their daughter in Chennai holds a registered POA limited to letting, rent collection, tax and repairs. She renewed the lease, changed the Metrowater bill to the tenant's name for the period and paid the Corporation tax, all without a sale power that could worry the parents.
Ask for three certified copies of the registered POA from TNREGINET at the start. Banks and offices keep copies, and the original should stay with you.
GPA sales and Suraj Lamp: what Chennai buyers must check
In Suraj Lamp and Industries v State of Haryana (2011), the Supreme Court held that a "GPA sale", meaning an agreement plus a GPA plus a will in place of a sale deed, does not transfer title. Only a registered conveyance does. Tamil Nadu's 2012 amendment was partly aimed at the same practice.
If you are buying a Chennai property from an attorney holder, check these points before paying anything.
- The POA is registered, and the registration details match TNREGINET records.
- It names this property by survey number, extent and document number.
- It expressly allows the holder to sell and to receive the sale price.
- The principal is alive, shown by a recent life certificate.
- No cancellation is registered. Look at the encumbrance certificate for the property and ask for a search in the office where the POA was registered.
- Payment goes to the owner's own account wherever possible.
Our guides to using a POA to sell property and to buy property go deeper into the clauses.
Why Chennai Sub-Registrars return POAs: common mistakes
| Mistake | What happens | How to avoid it |
|---|---|---|
| Agent does not attend or sign | Section 34-B is not met and the deed cannot be registered | Bring the attorney holder with ID and a passport photo |
| Property described only by door number | The office may refuse, and buyers will query it later | Give survey number, village, extent and parent document details |
| Family duty paid for a non-family attorney | Deficit duty demanded before release | Check the relationship against the Article 58 family list |
| Wrong office booked | Wasted token and a second visit | Use the principal's residence office or confirm the property's village |
| Witnesses without original ID | Identification fails | Two adult witnesses with Aadhaar or another original ID |
| Vague words like "all acts" | Banks and buyers reject it later | List each act the holder may do |
| Old POA used for a sale | Office asks for a fresh life certificate and may question it | Get the certificate close to the sale date |

Revoking or cancelling a POA in Chennai
A POA you registered should be cancelled the same way: by a registered deed of cancellation. A letter to the attorney holder alone does not stop a buyer from relying on the registered deed.
- Draft a cancellation deed that cites the POA's document number, year and office.
- Pay the government stamp duty on cancellation and register it at a Sub-Registrar. Section 64-A sends a copy to the office where the property lies.
- Send the attorney holder a copy by registered post with acknowledgement and ask for the original POA back.
- Inform your bank, society, the Corporation and anyone the holder was dealing with.
- Where misuse is feared, publish a notice in one English and one Tamil daily.
A POA ends on its own when
- The principal dies
- The principal becomes of unsound mind
- The fixed period in the deed ends
- The single job in an SPA is done
A POA you cannot simply cancel
- One coupled with the holder's interest, as in a development deal
- Ending it may need the holder's consent or a court order
- Take advice before sending any notice
Parents, joint owners and heirs: when a POA is the wrong tool
A POA only works while the principal is alive. Families sometimes try to use a parent's POA after the parent has died. That is not valid, and Sub-Registrars in Chennai check for it.
- If the owner has died: heirs need a legal heir certificate in Chennai, issued by the Tahsildar. Our Tamil Nadu legal heir certificate page covers other districts, and this note explains why applications get rejected.
- For bank deposits and shares: a succession certificate in Chennai may be needed. The difference between the two certificates is explained here.
- To consolidate shares: one heir can take the others' shares by a release deed; see our release deed format and process.
- To plan ahead: pair the POA with a registered will. Where a will exists after death, read about probate of a will.
- The full route after a death: start with a Chennai Corporation death certificate, then see property transfer after death.
Under sections 31 and 33 of the Registration Act, the Sub-Registrar can attend at a residence when a principal cannot come to the office because of age or illness. The request is made in advance, and a visit charge set by the government applies. We plan these visits for parents in Mylapore, Adyar and Anna Nagar often.

Frequently Asked Questions
Is registration of power of attorney compulsory in Tamil Nadu?
+Yes, for property. Since the Registration (Tamil Nadu Amendment) Act, 2012, section 17(1)(h) makes a POA relating to immovable property compulsorily registrable if it is signed in India. A POA only for bank work, shares or a court case need not be registered, though a bank may still ask for notarisation. A property POA signed abroad follows a separate route.
Where can I register a power of attorney in Chennai?
+At the Sub-Registrar office within whose jurisdiction the property lies, or under the Tamil Nadu proviso to section 28, the office where the principal ordinarily resides. So a Velachery resident can register a POA for a Porur plot at Velacheri SRO. The office then sends a copy to the property's office under section 64-A.
How much is the stamp duty for a power of attorney in Tamil Nadu?
+Government stamp duty under Article 48, as revised in May 2024, is a flat amount for most POAs, including a power to sell given to a family member. A power to sell given to a non-family member without consideration attracts 1% of market value. A POA given for consideration with power to sell is charged like a conveyance. Check TNREGINET for the current figures.
What is a life certificate for power of attorney in Tamil Nadu?
+It is a recent certificate confirming the principal is alive, produced when a POA holder registers a sale or similar document for the principal. Chennai Sub-Registrars commonly ask for one issued by a registered medical practitioner or a gazetted officer, and practitioners report it is treated as current for about 30 days. Ask the office for its present practice.
What is the validity period of a power of attorney in Tamil Nadu?
+The law sets no fixed expiry. A POA lasts until the period written in it ends, the task is done, it is cancelled, or the principal dies or becomes of unsound mind. In practice, offices question very old POAs and ask for a fresh life certificate, so many families add a sensible end date.
Is special power of attorney needed to be registered in Chennai?
+If the SPA deals with immovable property and is signed in India, yes, Tamil Nadu treats it as compulsorily registrable like a GPA. An SPA that only covers a bank account, a car, shares or a court matter does not need registration, though the receiving office may set its own format.
Can a power of attorney holder sell property in Chennai?
+Yes, if the registered POA expressly gives power to sell that property and the principal is alive. The holder signs and presents the sale deed as the principal's agent. The sale deed itself transfers title, not the POA, as the Supreme Court explained in Suraj Lamp. Expect a life certificate request at registration.
How many days does it take to get a power of attorney registered in Chennai?
+Once the draft is agreed and documents are ready, registration usually happens on the token date and the registered deed is often released the same day or within a few working days. Drafting and title checks take a few more days. A home visit by the Sub-Registrar needs extra time to schedule.
How do I cancel a power of attorney in Tamil Nadu?
+Register a cancellation deed at a Sub-Registrar, citing the POA's document number and office, and pay the government stamp duty for cancellation. Send a copy to the attorney holder and ask for the original back. Inform banks and offices the holder dealt with. If you fear misuse, publish a newspaper notice too.
Can I make a power of attorney online in Tamil Nadu?
+You can enter the document details, check guideline value and book a token on TNREGINET online, but the POA cannot be completed fully online. The principal, the attorney holder and two witnesses still attend the Sub-Registrar office, or the officer attends at home, for photos, fingerprints and signatures.
Who can be witnesses for a POA in Chennai?
+Two adults who know the principal and carry original photo ID, usually Aadhaar. They should not be minors, and it is safer if they are not the attorney holder. Their photos and fingerprints are also affixed under section 34-B, so they must attend registration in person.
Does a POA to my brother count as a family POA for stamp duty?
+Reported decisions read the Article 58 family list, which Article 48 now borrows, as covering father, mother, spouse, son, daughter, grandchild, brother and sister. A brother therefore usually qualifies for the flat family rate. A recent Madras High Court Full Bench decision held that grandparents are not covered.
Can a POA be used after the principal dies?
+No. Under section 201 of the Indian Contract Act, the agency ends on the principal's death, except where the power is coupled with the holder's own interest. Heirs then need a legal heir certificate, and sometimes a succession certificate or probate, before dealing with the property.
Can power of attorney be used for a bank account in Chennai?
+Yes, a POA can cover deposits, withdrawals, loan closure and locker access, but most banks want their own format or will vet yours first. A banking-only POA does not need registration in Tamil Nadu. If it also covers property, register it and give the bank a certified copy.
What is power of attorney called in Tamil?
+In everyday Tamil and at many registration counters it is called athikaara aavanam (அதிகார ஆவணம்), and many people simply say "power" when speaking Tamil. A general power is a broad authority and a special power is limited to named acts. Whatever the label, the Sub-Registrar reads the powers written inside the deed, so the wording matters more than the title.
My son lives in the US. Can he give me a POA for his Chennai flat?
+Yes, but a POA signed abroad follows a different path. It is notarised and apostilled in the US, or attested at an Indian consulate, then sent to Chennai and stamped under Tamil Nadu law within three months of arrival. Our NRI power of attorney in Chennai page explains each step and the documents involved.
