Power of attorney in Kolkata: the short answer
A power of attorney in Kolkata is a deed in which you (the principal) authorise another person (the attorney holder) to act for you on named matters. For property, use a special POA for one task, such as selling one flat, or a general POA for ongoing management. Draft it, generate the assessment on wbregistration.gov.in, pay the government stamp duty under Article 48 of the Indian Stamp Act as it applies in West Bengal, then sign before two witnesses at the sub-registrar, ADSR, District Registrar or Registrar of Assurances office. A registered POA is what buyers, banks and KMC usually expect.
- Registration: Optional in law for many POAs, but registration is what Kolkata buyers, banks and civic bodies expect for property work.
- Stamp duty: Set by Article 48 (West Bengal). Small fixed duty for authority-only POAs; conveyance-level duty if the power to sell is given for consideration.
- Where: Sub-registrar or ADSR with jurisdiction, the District Registrar, or the Registrar of Assurances, Kolkata, for property anywhere in the state.
- Who appears: The principal signs before the registering officer with two witnesses; photos and fingerprints are taken at the counter.
Which power of attorney fits your Kolkata matter?
Start with the job the attorney must finish. The job decides the type of POA, the stamp duty article, and how much risk you carry.
| Your situation | POA to use | How it is usually executed | What to watch |
|---|---|---|---|
| You are selling one flat in Salt Lake or New Town but cannot attend the sale deed | Special POA (sale) names the flat, buyer route and sale steps | Registered at the office with jurisdiction or the Registrar of Assurances | Add lease-transfer permission and NKDA or Bidhannagar steps if the plot is leasehold |
| Your parent owns a house in Ballygunge or Behala and needs help with tax, repairs and tenants | General POA (management) no power to sell | Registered, or signed at home through a registering officer visit if your parent is unwell | Leave the sale power out unless the family has agreed in writing |
| You are buying a flat in Rajarhat or Garia and will be away on the registration date | Special POA (purchase) to sign, pay and receive possession | Registered before the purchase date | The bank may want its own wording if a home loan is involved |
| Joint owners in Alipore or Tollygunge want one brother to handle the sale for all | Special POA from each co-owner | Each co-owner signs; one deed or separate deeds | Every co-owner must have clear title first; an heir dispute stops the sale |
| You need someone to apply for KMC mutation or collect records for you | Special POA (records and mutation) | Registered or notarised, as the department asks | Mutation after a death also needs heir papers, not only a POA |
| A developer will build on your plot in Howrah or Dum Dum | Developer POA under Article 48(g) with the development agreement | Registered with the development agreement | Slab duty based on market value; read every power before signing |
| You hold the POA and the owner has since died | None: the POA has ended | Not usable | Move to heir documents: legal heir, succession or probate route |
Rows near the bottom carry more legal risk and usually need heir or title work first. The Propresolve legal team confirms the row that fits you during the assessment.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentGPA, SPA, irrevocable or durable: choosing the right POA in Kolkata
Most problems with a power of attorney in Kolkata start at the first choice. People ask for a general POA because it sounds complete. A buyer's advocate then asks why a POA meant for one flat lets the attorney sell every property you own.
Special POA (SPA)
- One task or one property, such as the sale of Flat 3B in a Kasba building.
- Easier for buyers and banks to accept.
- Ends when the task is done.
- Lower risk if the relationship with the attorney changes.
General POA (GPA)
- Many acts over time: tax, rent, repairs, court dates, bank visits.
- Useful for an elderly owner or a family that travels often.
- Higher risk because the powers are wide.
- Should not carry a power to sell unless that is truly intended.
What "irrevocable" really means
Writing "irrevocable" on the cover does not make a POA irrevocable. Under Section 202 of the Indian Contract Act, 1872, a POA survives only when the attorney has an interest in the property itself, for example a bank that has lent against it.
The Supreme Court said this again in M.S. Ananthamurthy v. J. Manjula (2025): a POA without such an interest ended on the owner's death, and a sale deed signed by the attorney after that death was held invalid.
There is no "durable" POA in Indian law
Websites copied from the US talk about durable POAs that keep working after the owner loses mental capacity. Indian law does not work that way. Section 201 of the Contract Act ends an agency when the principal dies or becomes of unsound mind.
If a parent's memory is starting to fail, sign the POA while capacity is clear and keep a doctor's note from the same week. If capacity is already lost, a POA is the wrong tool and a court-appointed guardian route is needed.
| Type | Suits | Avoid when |
|---|---|---|
| Special POA | One sale, one purchase, one mutation, one loan | You need help with many different things over years |
| General POA | Running a house or rented flats for an elderly owner | You only need one deed signed |
| POA coupled with interest | Lenders, developers with a stake in the project | The attorney is simply a relative helping out |
| Developer POA (Article 48(g)) | Joint development of a plot in Howrah, Behala or Dum Dum | No signed development agreement exists yet |
Not sure which one you need? The power of attorney registration guide for India explains the national rules, and this page covers what changes in West Bengal.
West Bengal stamp duty and registration rules, in plain words
Stamp duty on a POA in Kolkata is a government charge under Article 48 of Schedule IA of the Indian Stamp Act, 1899, as amended for West Bengal. It is not one flat number. The duty depends on what the POA lets the attorney do and whether anything is paid for that authority.
| What the POA does | Government stamp duty rule (West Bengal) |
|---|---|
| Lets the attorney present documents, admit execution, or handle one or more routine acts | A small fixed duty. The assessment slip shows the exact figure for your draft. |
| Is given for consideration and authorises the attorney to sell immovable property | Charged like a conveyance, on the market value of the property |
| Is given to a promoter or developer for construction, sale or transfer of property (Article 48(g)) | A fixed duty in six slabs linked to market value, from properties up to thirty lakh rupees to those above three crore |
| Developer POA between the same parties where duty is already paid on the development agreement under Article 5(f) | A token duty only, as per the Explanation to Article 48(g) |
Some states, Maharashtra for example, charge market-value duty on a POA to sell unless it goes to close family. Do not carry that rule into Kolkata on trust. Generate the e-assessment on wbregistration.gov.in for your exact draft and let the slip decide.
Registration: optional on paper, expected in practice
The Registration Act, 1908 does not force every POA to be registered. Kolkata reality is different. Sub-registrars, buyers' lawyers, KMC, Bidhannagar and NKDA desks and banks all trust a registered POA far more than a notarised one.
- Where: documents about property in West Bengal are registered at the sub-registrar office with jurisdiction, the District Registrar's office, or the office of the Registrar of Assurances, Kolkata. The Registrar of Assurances may register a document for property anywhere in the state.
- When: present the document within four months of signing. Late presentation up to a further four months is possible only with a fine, under Sections 23 and 25 of the Registration Act.
- How you pay: government duty and registration charges are paid through GRIPS, the state e-payment system, or by non-judicial stamp paper where allowed. Above set thresholds, GRIPS e-payment is compulsory.
- Online steps: e-requisition, market value and duty calculator, e-appointment and deed search are all on wbregistration.gov.in.
If the sub-registrar disputes the market value used for duty, the case goes to the Deputy Inspector General of Registration under Section 47A of the Stamp Act. Agreeing value at the assessment stage saves weeks.
A refused registration is not the end. An appeal lies to the District Registrar within thirty days under Sections 72 and 73 of the Registration Act.
Where your POA gets registered and used: Kolkata areas and the bodies they deal with
A Kolkata POA usually has two jobs: getting registered, and then being accepted by the body that keeps the property record. The second body is different in Salt Lake, New Town, Howrah and the old KMC wards. Plan for both before drafting.
| Area | Body for tax and record changes | Registration office to check first | Local point to plan for |
|---|---|---|---|
| Salt Lake (Bidhannagar) | Bidhannagar Municipal Corporation for tax; UD&MA Department, Land Manager Bidhannagar, for leasehold transfer permission | ADSR Bidhannagar, or the Registrar of Assurances | Most plots are leasehold; transfer needs government permission before the sale deed |
| New Town | NKDA for Record of Title (mutation) on nkdamar.org; WBHIDCO as allotting body | ADSR Rajarhat | Check the allotment and lease terms; some plot schemes carried a lock-in before resale |
| Rajarhat (outside New Town) | Bidhannagar Municipal Corporation; land records on Banglarbhumi | ADSR Rajarhat | Match the dag and khatian numbers in the POA to the RoR |
| Ballygunge, Gariahat, Southern Avenue | Kolkata Municipal Corporation | Offices at Alipore serving south Kolkata, or the Registrar of Assurances | Old family houses often have several heirs; each one signs or releases |
| Alipore | Kolkata Municipal Corporation | District Registrar and sub-registrar offices at Alipore | High-value bungalows: the buyer's lawyer will read every power in your POA |
| Park Street, Camac Street | Kolkata Municipal Corporation | Registrar of Assurances, Kolkata | Commercial units and tenanted floors need clear rent and eviction powers |
| Behala | Kolkata Municipal Corporation | ADSR Behala | Many independent houses; check the building plan sanction before a sale |
| Tollygunge, Jadavpur | Kolkata Municipal Corporation | Offices at Alipore, or the Registrar of Assurances | Older co-operative and refugee-colony plots can have unusual title papers |
| EM Bypass (Kasba, Anandapur) | Kolkata Municipal Corporation | Confirm with the Jurisdiction of the R.O tool | Newer complexes: the developer's conveyance and the association NOC are checked |
| Garia | KMC in some wards, Rajpur Sonarpur Municipality in others | Confirm with the Jurisdiction of the R.O tool | Confirm which civic body holds the record before writing the POA |
| Lake Town, Dum Dum | South Dum Dum and neighbouring municipalities | The registration office at Cossipore, Dum Dum, or ADSR Sealdah for some areas | Housing societies often ask for their own NOC and a copy of the POA |
| Howrah | Howrah Municipal Corporation; land records on Banglarbhumi | District Registrar and sub-registrar offices in Howrah district | Ancestral land with mutation still in a grandparent's name is common |
Office jurisdiction can change and some areas sit on a boundary. The "Jurisdiction of the R.O" option under E-Services on wbregistration.gov.in gives the current answer for your exact address.
Salt Lake, New Town and old Kolkata: worked examples
These examples come from the kinds of matters we see across the city. Names and details are changed.
Example 1: a Salt Lake house and a daughter in Pune
A retired couple in Salt Lake Sector II want their daughter to sell the house. The plot is leasehold. A plain sale POA is not enough, because the transfer needs permission from the Land Manager, Bidhannagar, under the UD&MA Department.
The special POA therefore lists four powers: apply for and receive the transfer permission, sign the sale deed, admit execution before the registering officer, and receive the sale money into the couple's account.
Example 2: a New Town flat on a HIDCO allotment
A software engineer in Action Area I is moving to Hyderabad and wants his brother to rent out and later sell the flat. The POA names NKDA for the Record of Title, the housing society for NOCs, and the bank that holds his home loan.
If a home loan is running, ask the lender first. Many banks will not release the title papers to an attorney unless their own clause appears in the POA.
Example 3: a Ballygunge family flat with five heirs
After a father's death, five siblings want one sister to handle the sale. A POA cannot cure a gap in title. First the family proves heirship with a legal heir certificate in Kolkata or, where a will exists, the probate route. Then each sibling signs a POA in the sister's favour, or the others sign a release deed in Kolkata so she becomes the sole seller.
Example 4: a Howrah plot still in a grandfather's name
Three cousins hold an ancestral plot in Howrah. The RoR on Banglarbhumi still shows the grandfather. The POA is drafted only after mutation steps are mapped, because a buyer will not register a sale where the record of rights does not match the sellers.
For record changes after a death, see property mutation after death in Kolkata.
POA for elderly parents and joint owners in Kolkata
Kolkata has one of the oldest home-owning populations among Indian metros. Many POAs we draft are for parents in their seventies or eighties who want a son or daughter to deal with KMC, banks and tenants.
- Signing at home: the registration directorate allows registration at a private residence for a person who cannot attend the office because of bodily infirmity, on application and payment of the government charge. The registering officer may visit, or issue a commission under Section 38 of the Registration Act.
- Capacity: the officer must be satisfied that your parent understands the deed. Keep the language simple and read it aloud in Bengali if that is the language your parent is most at ease in.
- Scope: a management GPA for a parent should not quietly include a power to sell or gift. Siblings who are not told often challenge such POAs later.
- Bank accounts: banks follow their own mandate rules. Many will accept a registered POA only on their own format or after a branch visit.
Joint owners
Where a flat is in two names, both owners must give powers for a sale. A husband cannot sell a flat held jointly with his wife on the strength of his own POA alone.
Good practice for families
- Tell every co-owner and adult heir what the POA allows.
- Keep one registered original and certified copies.
- Ask the attorney to keep receipts and a simple account.
Warning signs
- The parent is asked to sign quickly without reading.
- The POA adds powers nobody discussed.
- The attorney is also the buyer.
If a parent would also like to plan who inherits, a POA is not a substitute for a will. See will drafting and registration.
What a POA can and cannot do for Kolkata property
A POA lets someone act in your name. It does not move ownership by itself. In Suraj Lamp and Industries v. State of Haryana (2011) the Supreme Court held that a GPA, an agreement to sell and a will together do not transfer title. Only a registered conveyance does.
| A registered POA in Kolkata can usually | It cannot |
|---|---|
| Sign and present a sale, purchase, gift or lease deed for registration on your behalf | Make the attorney the owner |
| Apply for mutation with KMC, Bidhannagar, NKDA or Howrah | Replace heir documents after the owner's death |
| Pay property tax, sign rent agreements, deal with the housing society | Be used after the principal dies or loses mental capacity |
| Appear in court or tribunal matters, through an advocate where needed | Let the attorney give evidence on facts only the owner knows personally |
| Obtain certified copies of deeds and records | Make or change your will |
Checking a POA before you buy in Kolkata
Buying from an attorney? The registration directorate's Circular No. 2 of 2020 lets a prospective buyer obtain a certified copy of a POA relating to immovable property, even before the sale deed is signed.
- Check the POA is registered and the powers cover sale of this property.
- Confirm the owner is alive, ideally by a video call or a fresh letter.
- Search the deed on wbregistration.gov.in by property details for any revocation.
- Ask for the owner's bank details so money goes to the owner, not the attorney.
If the owner has died, read property transfer after death in Kolkata before you pay anything.
Why POAs get rejected in Kolkata: common mistakes
Most rejections are drafting or record problems, not legal puzzles. Fixing them after signing means a fresh deed and fresh duty.
| Mistake | What happens | How to avoid it |
|---|---|---|
| Property schedule does not match the deed or KMC record | Buyer's lawyer or the registering officer refuses to proceed | Copy holding number, premises number, dag and khatian exactly from the title papers |
| Power to "sell" but no power to "admit execution" and "present for registration" | Attorney signs, but cannot complete registration | List each act the Registration Act needs, in plain words |
| General POA used for a one-off sale | Buyer worries about wide powers; bank asks for more papers | Use a special POA for one property |
| One co-owner signs, the other does not | Sale cannot be registered for the full flat | Every co-owner gives powers, or releases the share first |
| POA used after the owner's death | Deed is void; buyer can lose the money | Switch to heir documents and mutation |
| Salt Lake or New Town permission not covered | Sale deed waits months for a fresh POA | Add power to apply for lease transfer permission and NOCs |
| Witness details incomplete | Delay at the counter | Bring two witnesses with original photo ID |
| Presented more than four months after signing | Fine, or refusal if the outer limit has passed | Book the e-appointment when you finalise the draft |
Model deeds can be downloaded from the registration website, but a model is a starting point. A POA for a Salt Lake leasehold plot and one for a KMC flat need different powers.
Revoking or cancelling a power of attorney in West Bengal
You can cancel most POAs at any time while you are alive. The exception is a POA coupled with interest, such as one given to a lender, which survives until that interest ends.
- Draft a deed of revocation naming the original POA, its registration office, book and deed number and date.
- Register the revocation if the original POA was registered, so a search on wbregistration.gov.in shows it.
- Tell the attorney in writing, by registered post and email, and ask for the original POA back.
- Tell everyone who relied on it: the bank, KMC or Bidhannagar office, NKDA, the housing society, tenants and any broker.
- Consider a public notice in a Kolkata daily if the attorney held wide powers or the relationship has broken down.
Acts the attorney did before learning of the revocation can still bind you, as far as people who dealt in good faith are concerned. Speed matters more than form.
POA ends on its own when
- The principal dies
- The principal becomes of unsound mind
- The single task in a special POA is complete
- A fixed end date passes
You still need to act when
- The attorney holds the original
- A buyer is negotiating with the attorney
- A bank has the POA on file
- Rent is being paid to the attorney

Frequently Asked Questions
How do I make a power of attorney in Kolkata?
+Decide the exact task, then draft a special or general POA naming you, the attorney and the property as described in the title deed. Generate the assessment on wbregistration.gov.in, pay the government stamp duty and registration charges, and book an appointment. You then sign before the registering officer with two witnesses, and photos and fingerprints are taken. The registered POA is returned after scanning.
Is registration of a power of attorney compulsory in West Bengal?
+The Registration Act does not make every POA compulsorily registrable. For property in Kolkata, though, registration is what buyers, banks, KMC and the registration offices expect, and an unregistered POA is often refused when the attorney tries to present a sale or purchase deed. If a POA is for property, register it.
What is the stamp duty for power of attorney in West Bengal?
+It is a government charge under Article 48 of Schedule IA of the Stamp Act as amended in West Bengal. Authority-only POAs carry a small fixed duty. A POA to sell given for consideration is charged like a conveyance on market value, and developer POAs pay slab duty under Article 48(g). The assessment slip on wbregistration.gov.in shows the exact duty for your draft.
Can a sale deed be executed by power of attorney in Kolkata?
+Yes. A registered POA that clearly authorises the attorney to sign the sale deed, admit execution and present it for registration lets the attorney complete the sale. The sale deed itself must still be registered, because the Supreme Court in Suraj Lamp (2011) held that a POA does not transfer ownership. The owner must be alive on the date of execution.
How can I check a power of attorney online in West Bengal?
+Use the search options on wbregistration.gov.in: search registration records by party name or by property details, and the legacy record search for older deeds. This shows whether a POA or a revocation has been registered. For a full copy, apply for a certified copy; a prospective buyer can also apply under Circular No. 2 of 2020.
Which office registers a power of attorney in Kolkata?
+A POA about property can be registered at the sub-registrar or ADSR office with jurisdiction over the property, the District Registrar's office, or the Registrar of Assurances, Kolkata, which may register documents for property anywhere in West Bengal. Use the Jurisdiction of the R.O tool on wbregistration.gov.in to find the right office for your address.
Can a POA holder sell property in Kolkata after the owner dies?
+No. A POA ends when the principal dies, unless it is coupled with an interest under Section 202 of the Contract Act. In 2025 the Supreme Court held a sale deed signed by an attorney after the owner's death to be invalid. The heirs must establish their rights and sell themselves. See our pages on legal heir certificates and property transfer after death in Kolkata.
Is a notarised power of attorney valid for property in Kolkata?
+A notarised POA is a valid document between you and the attorney, and some offices accept it for simple tasks such as collecting papers. For selling, buying or mortgaging property, Kolkata registering officers, buyers and banks usually expect a registered POA. A POA signed abroad and authenticated by a notary there is a separate case covered on our NRI page.
Can my elderly parent sign a power of attorney at home in Kolkata?
+Yes, where the parent cannot attend the office because of bodily infirmity. The registration directorate allows registration at a private residence on application and payment of the government charge, and the registering officer may visit or issue a commission under Section 38 of the Registration Act. The officer still checks that your parent understands the deed.
What does the government collect for a power of attorney in Kolkata?
+Two government charges apply: stamp duty under Article 48 as it applies in West Bengal, and registration charges if you register. There may also be a standard user charge for scanning. All are shown on the assessment slip generated on wbregistration.gov.in and paid through GRIPS or stamp paper. Advocate work is separate and is discussed during the assessment.
How long does POA registration take in Kolkata?
+Once the draft is final and duty is paid, the signing itself takes one visit. The registered POA is usually returned after scanning, often the same day or within a few working days depending on the office. Most delay comes before that: title checks, co-owner signatures, or Salt Lake and New Town permissions.
Can a POA holder apply for KMC mutation for me?
+Yes, if the POA expressly authorises the attorney to apply for mutation, sign forms and receive the mutation certificate. KMC also asks for the title deed, a no-outstanding certificate for tax and its own forms. If mutation follows a death, heir documents are needed in addition to the POA, as explained in our Kolkata mutation guide.
How do I cancel a power of attorney in West Bengal?
+Sign a deed of revocation naming the original POA and register it if the original was registered. Send written notice to the attorney and ask for the original back. Inform the bank, KMC or Bidhannagar office, NKDA, the housing society and any buyer. For wide POAs or a broken relationship, a public notice in a Kolkata newspaper adds protection.
Can one POA cover a flat in Salt Lake and a plot in Howrah?
+Yes, one deed can schedule more than one property, and the Registrar of Assurances can register documents for property anywhere in West Bengal. In practice, separate special POAs are cleaner when the properties will be sold to different buyers, because each buyer's lawyer then sees only the powers that concern that property.
Is Kolkata or Calcutta written in the POA?
+Use the name as it appears on the title deed and current records, and add the present name where helpful, for example "Calcutta, now Kolkata". Older deeds, Calcutta High Court orders and ancestral papers often say Calcutta. Consistency with the title chain matters more than the spelling.
