For owners, joint holders, elderly parents and families in Bengaluru who need someone they trust to sign, register, rent, manage or deal with a property for them. The Propresolve legal team drafts the power of attorney, checks the Karnataka stamp duty clause, books the Kaveri slot and sees it through the sub-registrar.

  • Right clause, right duty: we check whether your POA falls under the fixed duty heads of Article 41 or the 5% market value head before you buy the e-stamp.
  • Bengaluru specific drafting: e-khata, GBA corporation, BDA, BESCOM, BWSSB, apartment association and bank powers written in, so the attorney is not sent back.
  • Registered, not just notarised: Kaveri 2.0 data entry, slot booking, witnesses and the sub-registrar visit handled for you, with a certified copy kept on file.

Power of attorney in Bangalore: the short answer

Short answer

A power of attorney in Bangalore is a written authority, stamped under the Karnataka Stamp Act, 1957, that lets your attorney holder act for you. Use a Special Power of Attorney (SPA) for one sale, purchase or registration and a General Power of Attorney (GPA) for ongoing management. A POA that lets the holder sell or transfer property must now be registered at the jurisdictional sub-registrar through Kaveri 2.0. Giving sale power to someone outside your parents, spouse, children or siblings attracts government stamp duty of 5% of market value. Book a 20-minute assessment to get the type, clause and office right.

  • Law: Powers of Attorney Act, 1882, Registration Act, 1908 (as amended for Karnataka) and Article 41 of the Karnataka Stamp Act, 1957.
  • Registration: Compulsory in Karnataka when the POA lets the holder transfer immovable property. Strongly advisable for every other property POA.
  • Stamp duty: Small fixed duty for most POAs. 5% of market value when sale power goes to a non-family member.
  • Portal: Kaveri 2.0 (kaveri.karnataka.gov.in) for data entry, online payment and sub-registrar slot booking.

Which power of attorney fits your Bangalore situation?

Start from what the attorney actually has to do. The answer decides the POA type, the Article 41 clause and whether the sub-registrar visit is compulsory.

GPA vs SPA in Bangalore: what each one can and cannot do

Most people in Bengaluru ask for a GPA because that is the word they hear at the registration office. In practice, a narrow Special Power of Attorney is safer and is accepted more readily by banks, buyers and sub-registrars.

Special Power of Attorney (SPA)

  • One defined job: sell this flat, buy that plot, register this deed, file this case.
  • Names the property by survey or khata number, e-khata ID and boundaries.
  • Ends once the job is done, so there is little room for misuse.
  • Suited to a single sale or purchase, a home loan signing or a one-time registration.

General Power of Attorney (GPA)

  • Ongoing powers: rent, repairs, tax, utilities, society dealings, bank work.
  • Useful for parents, long stays abroad or owners with several properties.
  • Wider risk: the holder can do everything the document allows, for years.
  • Should still list each power clearly instead of relying on words like "all acts".

Irrevocable and durable POAs

An irrevocable POA is one coupled with an interest, for example where the holder has paid money and the power protects that payment. Under Section 202 of the Indian Contract Act, such an agency cannot be ended to the prejudice of that interest. If a buyer or builder asks you to sign one, take advice first, because it is hard to undo.

India has no separate statute for a durable POA. Section 201 of the Contract Act ends an agency when the principal dies or becomes of unsound mind. So a POA from an ageing parent does not replace a will, nominations or joint holding. Plan those alongside it, for example through will drafting and registration.

Tip

If the only task is selling one property, ask for an SPA with a validity period and a floor sale value written in. It protects you and it reassures the buyer's bank.

Stamp duty on power of attorney in Karnataka, in plain words

Every POA used in Bengaluru must carry stamp duty under Article 41 of the Schedule to the Karnataka Stamp Act, 1957. The duty depends on what the POA lets the holder do and who the holder is, not on how long the document is.

Article 41 headWhat it coversGovernment stamp duty rule
41(a)Sole purpose of presenting documents for registration or admitting execution in one transactionSmall fixed duty
41(b)One or more persons for a single transactionSmall fixed duty
41(c) and (d)Up to five persons, or five to ten persons, for several transactions or generallyFixed duty, higher for the larger group
41(e)Given for consideration, or coupled with interest, with power to sell immovable propertySame duty as a conveyance on the higher of consideration or market value
41(ea)Given to a developer for construction, development or saleDuty linked to market value or project value, with adjustment rules
41(eb)Sale power over Karnataka property given to anyone other than the father, mother, spouse, sons, daughters, brothers or sisters5% of the market value of the property
41(f)Any other caseSmall fixed duty

The fixed amounts were revised upward when the Karnataka Stamp (Amendment) Act, 2023 came into force in February 2024. The 5% head for non-family sale POAs did not change.

The family list is narrower than most people think

The concession in 41(eb) covers only father, mother, wife or husband, sons, daughters, brothers and sisters. A POA with sale power given to a son-in-law, daughter-in-law, nephew, grandchild, cousin, friend or broker falls under the 5% head. We see this mistake often in families where a grandson in Bengaluru is handling the sale for grandparents.

The duty is adjustable, not lost

Where duty is paid under 41(e) or 41(eb), the Act lets that duty be adjusted against the duty on the later sale deed or agreement between the same parties for the same property. Keep the e-stamp certificate and the registered POA safe, because the adjustment is claimed with them.

People searching for GPA registration charges in Bangalore usually want this split. The two government items are stamp duty under Article 41 and the registration charge collected by the sub-registrar. Both are shown on Kaveri before you pay.

Is registration compulsory? Karnataka rules, Kaveri 2.0 and the sub-registrar

Karnataka changed its rules in 2025. The Registration (Karnataka Amendment) Act, 2025 adds clause (f) to Section 17(1) of the Registration Act, 1908, which makes registration compulsory for a power of attorney that authorises transfer of immovable property, with or without consideration. A POA limited to rent, maintenance, tax or litigation sits outside that clause, though registering it is still sensible.

Draft amendments to the Karnataka Registration Rules, published in the Gazette on 2 February 2026, spell out the working: a POA with transfer power from a principal living anywhere in India is registered before a sub-registrar, and any document later presented using that POA must carry proof that the principal is alive. Ask us, or the office, how these rules are being applied in the month you register.

Why the original POA matters

Under Section 32 and 33 of the Registration Act, an attorney can present a sale deed only on a POA that has been executed and authenticated in the manner the Act sets out. Karnataka has made production of the original POA mandatory, so keep the original safe and do not leave it with a broker.

How Kaveri 2.0 fits in

  1. Create a login on kaveri.karnataka.gov.in and start pre-registration data entry for a power of attorney.
  2. Enter the principal, attorney holder, witnesses and property schedule exactly as in the draft.
  3. Check the stamp duty and registration charge the portal calculates, then pay online.
  4. Book a time slot at the sub-registrar office that has jurisdiction over the property.
  5. Attend with originals: the principal, the attorney holder if required, and two witnesses with ID. Photos and thumb impressions are captured at the counter.
Tip

The jurisdictional office is fixed by survey number, not by the locality name in your address. Check the office named on your latest encumbrance certificate or on Kaveri before you book.

The Supreme Court held in Suraj Lamp and Industries v State of Haryana (2011) that a GPA, sale agreement and will together do not transfer ownership. In Bengaluru, title moves only through a registered sale deed, and a POA is the authority to sign it, nothing more. For the India wide rules, see our power of attorney registration guide.

Where your POA gets registered and used across Bengaluru

Bengaluru Urban district has about 42 sub-registrar offices, plus offices in Bengaluru Rural for the airport belt. The table groups the high-demand localities we handle with the office belt and the civic body the attorney will deal with afterwards. Use it as a starting point, then confirm the exact office by survey number.

The civic side changed in 2025

The state notified five city corporations under the Greater Bengaluru Authority on 2 September 2025: Central, East, West, North and South. BBMP is being phased out, so your POA should refer to the competent city corporation or authority instead of naming only BBMP. That small wording change saves a return trip when the attorney applies for an e-khata or a name change.

Bengaluru property tips your POA should cover

A POA fails in Bengaluru less often at the sub-registrar and more often at the next counter: the khata office, the apartment association or the bank. Write these powers in from the start.

  • e-khata and A or B khata: power to apply for, correct or transfer the e-khata, and to deal with B khata regularisation where it applies. See our khata transfer service in Bangalore.
  • BDA sites: for BDA allotted sites still under a lease cum sale agreement, the attorney often has to obtain the absolute sale deed or a no objection before any sale. Name BDA in the powers.
  • Apartment associations: gated communities in Whitefield, Sarjapur Road and Hebbal ask for association NOCs, dues clearance and share transfer forms before handover.
  • Utilities: BESCOM and BWSSB name changes and deposit refunds need a clear clause, or the attorney cannot sign the forms.
  • Bank and loan: loan closure, collection of original documents and release of the mortgage from the lender.
  • Tax: paying property tax, getting receipts and filing objections on assessment.
Example

A retired couple in Basavanagudi wanted their daughter to sell a BDA site in Banashankari. The draft first named only "the property" and "BBMP". We added the BDA site number, the absolute sale deed step, the e-khata ID and the South City Corporation, then registered it at the jurisdictional office. The buyer's bank cleared it in one round.

Example

Two brothers jointly owned a flat in Bellandur. One lives in Pune. He signed an SPA for sale in favour of his brother, which falls within the family list, so the fixed duty applied instead of 5%. The Pune signing was notarised and the POA was registered in Bengaluru before the sale deed slot.

POAs for elderly parents, joint owners and heirs

Family situations bring most of the POA work we see in Bengaluru. Each needs a slightly different structure.

Elderly parents

A management GPA from a parent to one child keeps rent, tax and repairs moving. Keep the powers specific, add a reporting duty to the family, and avoid giving sale power unless a sale is actually planned. Because a POA ends on death, pair it with a registered will so the next step is clear.

If a parent is bedridden or too frail to travel to the office, the Registration Act has a route for that. Section 31 lets the registering officer attend at a private residence on special cause shown, and Section 38 exempts persons who cannot attend because of bodily infirmity from appearing in person. Expect an application, a medical note and some waiting time, so raise it at the assessment stage rather than on slot day.

Joint owners

Each co-owner must sign their own authority. A POA signed by one co-owner cannot bind the other. Where the co-owners are siblings, the family concession applies to sale powers between them.

Heirs after a death

A POA signed by the deceased stops at death and cannot be used. Heirs first prove their rights, then the heirs who cannot attend give fresh POAs to one family member. In Karnataka that usually means a vamshavruksha (family tree) certificate or a legal heir certificate, and for bank money or securities a succession certificate.

Once the heirs are on record, the POA holder can file the mutation after death and handle the transfer of the property. If some heirs want to step out in favour of one sibling, a release deed is cleaner than a POA, because it actually moves their share.

Tip

Our blog on the family tree certificate vs legal heir certificate in Bangalore explains which one the khata office and the bank will ask for.

Why POAs get rejected in Bengaluru: common mistakes

These are the issues that send attorneys back from the counter, in roughly the order we see them.

MistakeWhat happensHow we prevent it
Sale power given to a nephew or son-in-law on fixed dutyDocument impounded as under-stamped; duty and penalty demandedFamily list check before buying the e-stamp
Property described only by flat number or localitySub-registrar or buyer's bank refuses; mismatch with e-khataSurvey number, khata or e-khata ID, boundaries and extent taken from the title deed

Vague words like "all acts and deeds" with no listBanks and associations refuse specific actsEach power listed: sign, present, receive, apply, collect
Old POA from before a co-owner's deathInvalid for the deceased's shareHeirship documents first, fresh POAs from heirs

How to cancel or revoke a power of attorney in Bangalore

You can revoke an ordinary POA at any time while you are alive and of sound mind. An irrevocable POA coupled with an interest is the exception and needs the holder's consent or a court order.

  1. Draft a deed of revocation that names the original POA, its registration number and date, and the office where it was registered.
  2. Stamp the revocation deed and register it at the sub-registrar office, ideally the same office that registered the POA.
  3. Send the revocation to the attorney holder by registered post with acknowledgement, and keep the proof.
  4. Inform everyone who relied on the POA: the bank, tenants, the apartment association, the city corporation office and any buyer in talks.
  5. For a widely used GPA, publish a public notice in an English and a Kannada daily.

A POA also ends without any deed when its single job is done, when the principal or holder dies, or when either becomes of unsound mind. Ask the holder to return the original in every case.

Tip

Before you sign a new POA for the same property, revoke the old one first. Two live POAs over one flat is how disputes start.

Buying a Bengaluru property from a POA holder? Check these first

Many sales in Whitefield, Electronic City and the airport belt are signed by attorneys. If you are the buyer, run these checks before paying any advance.

  • See the original registered POA, then match its number and date with the issuing office or a certified copy.
  • Confirm the POA covers sale of this exact property and has not expired or been revoked.
  • Ask for a current life certificate of the owner, because the sub-registrar will ask too.
  • Match the e-khata, encumbrance certificate and title deed with the POA schedule.
  • Check the stamp duty head used on the POA. An under-stamped POA can stall your sale deed.
  • Pay the sale amount to the owner's bank account, not the attorney's, unless the POA expressly allows it.
  • Search the sub-registrar records for any revocation deed filed after the POA date, and ask the owner directly, by video call if needed, to confirm the sale.

The Propresolve legal team drafts the POA in plain English with each power listed, plus limits, validity and reporting duties you choose.

4

Your review

You and the attorney holder read the draft. We change wording until both of you are comfortable signing it.

Frequently Asked Questions

What is the stamp duty for a power of attorney in Karnataka?

+

Most POAs carry a small fixed government duty under Article 41 of the Karnataka Stamp Act. The big exception is 41(eb): if sale power over Karnataka property goes to anyone other than your parents, spouse, children or siblings, the duty is 5% of market value. A POA given for consideration is charged like a sale deed. Check the Kaveri calculator for the current figure.

Is GPA registration compulsory in Karnataka?

+

Yes, if the GPA or SPA lets the holder transfer immovable property. The Registration (Karnataka Amendment) Act, 2025 added that requirement to Section 17(1) of the Registration Act. A POA only for rent, tax or litigation is not caught by that clause, but registering it still helps when banks or offices ask questions.

How do I register a power of attorney in Bangalore?

+

Get the POA drafted, create a Kaveri 2.0 login, enter the document details, pay the stamp duty and registration charge online and book a slot at the sub-registrar office that has jurisdiction over the property. On the day, the principal and two witnesses attend with original ID. The office records photos and thumb impressions and returns the registered document.

Which sub-registrar office should I use in Bengaluru?

+

The office is decided by the property's survey number, not just the locality name. Your latest encumbrance certificate or Kaveri shows the jurisdictional office. For example, Whitefield properties often fall in east belt offices like Mahadevapura or Varthur, but the survey number is what counts.

Can we buy property from a power of attorney holder?

+

Yes, if the POA is registered, covers sale of that exact property, is still in force and the owner is alive. The sale deed itself must be registered in your name. A POA never transfers ownership on its own, as the Supreme Court made clear in Suraj Lamp (2011). Check the life certificate and title papers before paying.

Is a notarised power of attorney valid in Bangalore?

+

A notarised POA can work for routine tasks like rent collection or a court filing. For selling or transferring property, Karnataka now requires registration at the sub-registrar where the principal lives in India, so notarisation alone is not enough. Banks also prefer registered POAs for loan closure and title document release.

Is a power of attorney valid in court?

+

Yes. A POA can authorise the holder to sign, file and pursue a case. Courts may still want the principal's own evidence on facts only the principal knows. The POA should be properly stamped, because an under-stamped instrument can be impounded and is not admissible until duty and penalty are paid.

What does the government collect for GPA registration in Bangalore?

+

Two government items apply: stamp duty under Article 41 of the Karnataka Stamp Act and the registration charge collected by the sub-registrar. Kaveri 2.0 shows both before you pay. Our own scope is discussed separately on the assessment call, and it never changes the government amounts.

Can I give power of attorney to my son-in-law or nephew at the family rate?

+

Not for sale powers. The Karnataka concession lists only father, mother, wife or husband, sons, daughters, brothers and sisters. A son-in-law, daughter-in-law, nephew, grandchild or friend holding sale power attracts duty at 5% of market value. For management-only powers, the fixed duty applies whoever the holder is.

How long is a power of attorney valid in Karnataka?

+

A POA stays valid for the period it states, or until its job is done, it is revoked, or the principal or holder dies or loses mental capacity. If no period is written, it runs until one of those events. Writing a clear validity period is safer for both sides.

How do I cancel a GPA in Bangalore?

+

Sign a deed of revocation that cites the original POA, stamp it, and register it, ideally at the office that registered the POA. Then notify the holder by registered post and inform the bank, tenants, association and anyone else who relied on it. A public notice helps where the GPA was widely used.

Can a power of attorney holder sell the property to himself?

+

Only if the POA expressly allows it and the duty and registration rules are met, and even then it invites challenge. Courts look closely at self-dealing by agents. If a family member intends to buy, use a direct sale deed or an SPA that clearly records your consent to that buyer and the sale terms.

Does a power of attorney work after the owner's death?

+

No. A POA ends when the principal dies. Any sale signed after that is open to challenge. The heirs must first establish their rights through a family tree certificate, legal heir certificate, will or succession route, and then sign fresh POAs if someone needs to act for them.

What is the format of a general power of attorney in Karnataka?

+

There is no single government form. A sound Karnataka GPA names the principal and holder with ID details, describes the property by survey number, khata or e-khata ID and boundaries, lists each power separately, states limits and validity, and ends with signatures, two witnesses and the Article 41 stamp. Download templates miss Bengaluru items like BDA, GBA and association powers.

Do I need e-khata to use a POA for selling a Bangalore property?

+

For sale deed registration in the Greater Bengaluru area, sub-registrars check the e-khata linked to the property. The POA should carry the same property ID and description. If the e-khata is missing or wrong, fix it first, or the sale slot will be wasted even if the POA itself is perfect.
