Power of Attorney in Delhi: The Right GPA or SPA, Registered Without a Second Visit

For Delhi families, joint owners and elderly parents who need someone they trust to sign, register, rent, mortgage or manage property for them. We draft the power to fit the task, stamp it correctly and take you through the Sub-Registrar counter.

  • Drafted for the 2026 Delhi checks: wording that tells the Sub-Registrar plainly whether your GPA is a simple agency or something the Collector of Stamps must look at.
  • One visit at the SRO: NGDRS data entry, PAN verification, witnesses and e-stamp lined up before you leave home.
  • Built for what comes next: clauses that MCD, DDA, banks and housing societies actually ask for, so the power works after it is registered.

Power of Attorney in Delhi: The Short Answer

Short answer

A power of attorney in Delhi is a written authority, usually printed on an e-stamp paper from SHCIL, that lets your attorney holder act for you. For property, register it at the Sub-Registrar office for the area where you live, after booking a slot on NGDRS. You, the holder and two witnesses attend with ID and PAN. Since 8 July 2026, a GPA in favour of anyone other than your parents, spouse, children, brother or sister is sent to the Collector of Stamps before it can be registered. A power of attorney never makes the holder the owner; only a registered sale deed transfers title.

  • Registration: Optional in law for most powers, but advisable for any property work in Delhi.
  • Where: Sub-Registrar office for the principal's area, booked on NGDRS Delhi.
  • Stamp: e-Stamp under Article 48; sale-type GPAs can attract sale deed level duty.
  • 2026 rule: Non-relative GPAs go to the Collector of Stamps first, order within 30 days.

Which Delhi Power of Attorney Fits Your Task?

Start from the job, not from a template. The table below matches the common Delhi tasks with the type of power that the receiving office is most likely to accept.

Your task in DelhiPower that usually fitsMust includeWatch out for
Selling a flat or builder floor in South DelhiSpecial POA (SPA)

Full property description, power to sign and present the sale deed, receive money only into your bank accountAvoid irrevocable wording and possession clauses, which invite Collector of Stamps scrutiny
Buying a home while you are busy or unwellSPA for purchasePower to sign the agreement, pay from your account, sign and present the sale deed, apply for mutationBuyer's PAN must verify on NGDRS before the slot
Renting out and managing a let propertyGPA for management
no sale power
Rent agreements, police verification, repairs, MCD property tax, electricity and water billsKeep sale and mortgage powers out if you do not need them
Home loan, top-up loan or loan closureSPA in the bank's formatSigning loan papers, creating or releasing the mortgage, collecting title deedsMost banks reject generic drafts; ask for their wording first
Society transfer, NOC or share certificateSPA for society workPower to appear before the society and the Registrar of Co-operative Societies, sign forms and affidavitsSociety bye-laws may need the member's own signature on some forms
DDA leasehold to freehold conversionSPA for DDA workFiling the conversion application, signing affidavits and undertakings, receiving the conveyance deedOld GPA chains must be registered for DDA to look at them
MCD mutation or property tax correctionSPA or management GPAPower to apply on the MCD portal, sign indemnity and affidavit, attend hearingsMutation follows title; the POA cannot replace a sale deed or heirship proof
Court case, tenant dispute or police complaintSPA for litigationPower to engage advocates, sign pleadings, depose where the law allowsCourts may still need you in person for evidence on facts only you know

Not sure which row is yours? Many Delhi families need two short powers rather than one wide GPA. That keeps each power clean at the counter and easy to cancel later.

Not sure which row is yours? Most families are not. One call with an advocate settles it.

What Changed for GPAs in Delhi in July 2026

On 8 July 2026 the Delhi government, on the directions of Chief Minister Rekha Gupta, told every Sub-Registrar to scrutinise general powers of attorney that deal with immovable property. The aim is to stop GPAs being used as a low-duty substitute for a sale deed.

This is why searches for "power of attorney in Delhi" jumped that month, and why so many people now ask whether GPA is closed in Delhi. It is not closed. Genuine powers are still registered every day. What changed is the route for some of them.

Registered at the counter as before

  • GPA in favour of your father or mother
  • GPA in favour of your husband or wife
  • GPA in favour of your son or daughter
  • GPA in favour of your brother or sister
  • Special powers for a single task, drafted as pure agency

Referred to the Collector of Stamps first

  • GPA in favour of anyone outside that family list, such as a nephew, friend, broker or builder
  • The Collector must pass a written, reasoned order, ordinarily within 30 days
  • The period can stretch to three months in exceptional cases
  • No registration until the order is passed and any extra duty is paid

The Sub-Registrar now reads the recitals line by line. Five things trigger a closer look:

  • Money paid to you for giving the power.
  • Possession handed to the attorney holder.
  • The word "irrevocable", or a power that cannot be withdrawn.
  • A permanent power to sell, gift, exchange, mortgage or otherwise part with the property.
  • Any line that suggests ownership rights pass to the holder.

If the Collector decides the document is really a sale in disguise, it is charged the same stamp duty as a conveyance deed. Offices also keep a separate register of these referrals and report them monthly, so there is no informal way around it.

Tip

If your attorney holder is not on the family list, keep the power narrow: one named property, one named task, money only into your own bank account, and a clear right for you to revoke. A clean agency document is far less likely to be held back for weeks.

The rule builds on an older position. After the Supreme Court decided Suraj Lamp and Industries v. State of Haryana on 11 October 2011, the Delhi Revenue Department published FAQs saying there is no ban on registering a GPA in a bona fide case, but that a GPA, agreement to sell or will cannot transfer title. The July 2026 order simply puts a stamp duty check behind that statement.

GPA, SPA, Irrevocable or Durable: Picking the Right Power

Most problems at Delhi counters start with the wrong type of power. Here is how the four labels people search for actually work under Indian law.

TypeWhat it doesWhen it suits a Delhi ownerMain risk
General Power of Attorney (GPA)Wide authority over many acts or all your affairsManaging a let house in Punjabi Bagh while you live in another city; running several propertiesToo much power in one hand; the 2026 Collector referral if the holder is not close family
Special Power of Attorney (SPA)One act or one transaction, such as a single saleSelling a DDA flat in Vasant Kunj, a loan closure, a DDA conversion fileEnds once the task is done; a fresh task needs a fresh SPA
Irrevocable POAA power given with an interest, often to a buyer or builder who has paidDevelopment agreements and some builder collaborationsAlmost always referred to the Collector; may be charged like a sale
"Durable" POAA foreign idea: a power that survives your mental incapacityRarely the right fit in DelhiSection 201 of the Indian Contract Act ends an agency when the principal dies or becomes of unsound mind

The donor or executant is you, the principal. The donee is your attorney holder, sometimes called the agent. In Hindi and Urdu deeds you will still see the old word mukhtarnama, which simply means a power of attorney.

Choose an SPA when

  • There is one property and one job
  • The holder is outside close family
  • A bank or DDA will read every clause
  • You want the power to end on its own

Choose a GPA when

  • The holder is your spouse, child, parent or sibling
  • You need routine management for years
  • Several properties or bank matters are involved
  • You keep sale and mortgage powers out unless truly needed

Example: a retired couple in Model Town want their daughter to handle tenants, MCD property tax and repairs on a second floor they let out. A management GPA to the daughter fits, and it stays outside the Collector referral because she is family. If they later decide to sell, a separate SPA for that one sale is cleaner than stretching the GPA.

Stamp Duty and Registration Rules in Delhi, in Plain Words

Delhi follows the Indian Stamp Act, 1899 as it applies to the capital, and the Registration Act, 1908. Here is what that means at the counter, without legal jargon.

1. The e-stamp

Delhi uses e-stamp certificates issued through Stock Holding Corporation of India (SHCIL). The Revenue Department says e-stamp papers up to Rs 500 can be bought from authorised collection centres, and anything above that is paid through listed banks or online modes such as net banking and NEFT.

2. How much government stamp duty applies

  • Ordinary GPA or SPA, no money involved: a small fixed duty under Article 48 of the stamp schedule. The exact sub-clause depends on whether the power is for one act, several acts or general management.
  • GPA given for consideration with a power to sell: Article 48 treats it like a conveyance on the amount paid. In Delhi the Revenue Department lists conveyance duty at 6% for men and 4% for women, on the higher of the deal value or the circle rate.
  • GPA where possession is handed over: the Act can treat it as a conveyance, with the duty later adjusted against the final sale deed.

3. Government registration fee

The Delhi Revenue Department publishes a fixed government registration fee for each power of attorney or special power of attorney, plus a small pasting charge. It is paid to the government at the time of registration, not to any adviser.

4. Is registration compulsory?

For most powers, no. Registration under the Registration Act is optional unless the document itself creates or transfers an interest in property. In practice, Delhi buyers, banks, DDA and MCD expect a registered power for anything to do with property, so treat it as essential.

5. Which office

Section 33 of the Registration Act says a power used to present documents for registration must be executed before, and authenticated by, the Registrar or Sub-Registrar of the district or sub-district where the principal lives. Your sale deed later goes to the office where the property sits. These may be two different offices.

Tip

NGDRS Delhi has made PAN verification compulsory since 9 September 2024. A spelling mismatch between your PAN and Aadhaar can block the token, so fix it before you book a slot.

Government rates change by notification. We confirm the current rate on the day you buy the e-stamp, and we never ask you to pay duty through anyone other than the official channels.

Where Your Delhi Power of Attorney Gets Registered and Used

Delhi was reorganised into 13 revenue districts from the start of 2026. In September 2026 the government posted Sub-Registrars across all 39 sub-divisions, adding 17 new offices to the earlier 22. Office names on old blogs are often out of date, so always pick your office from NGDRS before you travel.

The table shows the localities we handle most, the body that usually reads your power after registration, and the district to check first. Where a Sub-Registrar office is named, it comes from the Revenue Department's December 2025 jurisdiction order.

Area tips we use every week

  • Dwarka and Mayur Vihar societies: the managing committee will want the member's power to name the society, the flat number and the act, such as share transfer or NOC. A generic "manage my property" line is usually refused.
  • Rohini, Janakpuri, Vasant Kunj and Saket DDA homes: if the flat is still leasehold, the power should cover the DDA conversion file as well as the sale. DDA generally looks only at registered GPAs and agreements in an older chain.
  • GK, Hauz Khas and Punjabi Bagh floors: builder collaborations often come with an irrevocable power to the builder. Expect the Collector of Stamps referral and plan the timeline around it.
  • Lajpat Nagar and Defence Colony: check first whether the title still runs back to a Land and Development Office lease. The power then needs to cover L&DO work, not just MCD.

How to Convert a Power of Attorney Property to a Registry in Delhi

Thousands of Delhi homes were bought on a GPA, agreement to sell and will set before 2011. People now ask how to convert that power of attorney into a registry, meaning a registered sale deed in their own name. There is no single form, but there are four routes.

  1. Fresh sale deed from the owner: if the original owner is alive and willing, the cleanest route is a registered sale deed. Stamp duty already paid on an earlier power or agreement that handed over possession may be adjusted under the Stamp Act.
  2. Sale deed signed by the GPA holder while the owner is alive: a valid, unrevoked power with sale authority lets the holder sign the conveyance for the owner. Once the owner dies, the power ends and this door closes.
  3. DDA conversion: for DDA flats, DDA's conversion scheme has allowed conveyance in favour of purchasers and GPA holders in older chains, subject to registered documents, possession proof and a surcharge set by DDA.
  4. Unauthorised colonies: the PM-UDAY scheme under the 2019 central law recognises GPA, agreement and possession papers for residents of eligible unauthorised colonies.

The Revenue Department's own FAQ states that GPAs, agreements to sell and wills registered before 11 October 2011 are not affected by Suraj Lamp, but any further transfer must be through a registered sale deed.

Tip

If the original owner has died, you will need the legal heirs to join the sale deed. That often means a surviving member certificate, a succession certificate or a property transfer with a will route first.

Banks follow the same logic. A loan against a power of attorney property in Delhi is hard to get, because lenders want a registered sale deed or conveyance in the borrower's name before they create a mortgage.

Checking a Delhi Power of Attorney Before You Rely on It

If someone shows you a power of attorney to sell you a flat, rent you a shop or settle a dispute, check it before you pay anything. A forged or cancelled power is one of the oldest frauds in Delhi property.

  • Is it registered? The Revenue Department offers an online search of registered documents. Match the registration number, date and Sub-Registrar office on the copy.
  • Is the principal alive? A power dies with the person who gave it. Delhi registration guidance asks the Sub-Registrar to satisfy himself that the principal is alive when a deed is signed under a power.
  • Has it been revoked? Ask for a fresh written confirmation from the principal, and search for any cancellation deed at the same office.
  • Does it cover this act? A management GPA does not let anyone sell. A power for one flat in Pitampura does not cover a shop in Karol Bagh.
  • Who receives the money? Insist that sale money goes to the principal's own bank account, not the holder's.

The Delhi High Court has repeatedly held that a GPA holder is only an agent. Courts have ordered holders to hand over sale proceeds to the principal or the principal's legal heirs, and have refused to treat a GPA as proof of ownership.

Green flags

  • Registered copy with SRO stamp and photo page
  • Specific property and specific acts
  • Recent date and a living principal you can speak to

Red flags

  • Notarised only, for a property sale
  • "Irrevocable" with cash already paid
  • Chain of several GPAs with no sale deed anywhere

Buying through an attorney? Our checklist in the guide on using a power of attorney to buy property applies to residents too.

Elderly Parents and Joint Owners: Making a Power That Works

Many of our Delhi files are for parents in their seventies who can no longer stand in a queue at an SRO. The law has room for them.

  • Home visit: the Registration Act lets a principal who cannot attend because of bodily infirmity avoid a personal appearance; the Registrar can attend at the residence or send a commission. Ask early, because slots are limited.
  • Capacity matters: the power must be signed while your parent clearly understands it. If memory is already failing, a power may be challenged later, and Section 201 of the Contract Act ends an agency on unsound mind.
  • Joint owners: if a flat is in the names of husband and wife, both must sign, either one joint power or two separate ones. One co-owner cannot give away the other's share.
  • Plan for the future: a power stops on death. Pair it with a registered will so the family is not stuck later.

Example: a widow in Janakpuri owns a DDA flat jointly with her late husband. Before anyone can act for her, the husband's share must pass by heirship, and the flat may still need DDA conversion. We usually sequence it as heirship papers, then her power to her son, then conversion and mutation. Doing it in the wrong order means signing twice.

Tip

Banks and pension offices often refuse a general power for account operations and insist on their own mandate form. Ask the branch before you draft.

Why Delhi Powers of Attorney Get Held Back or Rejected

These are the mistakes we see most often at Delhi counters and at the offices that use the power afterwards.

MistakeWhat happensHow to avoid it

Revoking or Cancelling a Power of Attorney in Delhi

You can withdraw a revocable power at any time while you are alive and of sound mind. To make the withdrawal stick, do it on paper and in public.

  1. Sign a revocation or cancellation deed on e-stamp paper, naming the original power, its registration number, date and office.
  2. Register the cancellation, ideally at the same Sub-Registrar office that registered the power.
  3. Send a copy to the attorney holder by registered post or courier with proof of delivery.
  4. Inform everyone who may rely on the old power: your bank, the society, DDA, the MCD zone, tenants and any broker.
  5. Consider a short public notice in a Delhi newspaper if the old power was widely used.

A power also ends on its own when the task is complete, when you or the holder die, or when either party becomes of unsound mind. A power given with an interest, such as one to a builder who has paid, cannot be ended in a way that harms that interest; Section 202 of the Contract Act protects it.

Tip

Keep the original registered cancellation with your title papers. Buyers' lawyers in Delhi now ask for it whenever a past power appears in the chain.

How We Get Your Delhi Power of Attorney Registered

A typical resident file moves through these steps, usually in one or two weeks unless the Collector of Stamps is involved.

1

20-minute assessment

We ask what the power must achieve, who the holder is and which office will read it next. That decides GPA or SPA and whether the 2026 referral applies.

2

Title and record check

We look at your sale deed, conveyance or allotment papers and MCD or DDA records so the property description is exact.

3

Drafting for the counter

The Propresolve legal team drafts the power in plain English, with Hindi where the office or family prefers it, and sends it to you to read.

4

e-Stamp purchase

The correct Article 48 e-stamp is bought in your name through SHCIL or a listed bank, and the draft is printed on it.

5

NGDRS data entry and slot

Party details, PAN verification and the deed summary go into NGDRS Delhi, and a slot is booked at the right Sub-Registrar office.

6

Collector of Stamps, if needed

If the holder is outside the family list, we prepare the file for the Collector's order and track it until it is passed.

7

Signing at the SRO

You, the holder and two witnesses attend for photographs and biometrics. For elderly principals we ask for a home visit where the law allows.

8

Collection and handover

You receive the registered power, and we tell you exactly which bank, society or office should see a copy first.

Frequently Asked Questions

Is GPA closed in Delhi?

+

No. Delhi still registers general powers of attorney. Since 8 July 2026, a GPA dealing with property in favour of anyone other than your parents, spouse, children, brother or sister is first sent to the Collector of Stamps, who decides within about 30 days whether it is a simple agency or a disguised sale that must carry sale deed level stamp duty. GPAs to close family are registered at the counter as before.

How do I register a power of attorney in Delhi?

+

Get the draft ready, buy the correct e-stamp through SHCIL or a listed bank, and print the draft on it. Enter the deed and party details on NGDRS Delhi, verify PAN and book a slot at the Sub-Registrar office for the area where you live. On the day, you, the attorney holder and two witnesses attend with ID for photographs and biometrics.

Is a power of attorney valid in Delhi?

+

Yes. A properly stamped power is valid in Delhi, and a registered one is accepted by Sub-Registrars, DDA, MCD and banks. It lets your holder act for you, but it never makes the holder the owner. After the Supreme Court's 2011 Suraj Lamp ruling, title in Delhi passes only through a registered sale deed or conveyance.

Can a GPA holder sell property in Delhi?

+

Yes, if the power expressly gives sale authority and you are alive when the sale deed is signed. The holder signs the sale deed for you at the Sub-Registrar office and the buyer becomes owner through that deed. Sale money should come to your own bank account. The power cannot be used after your death.

What is the stamp duty on a power of attorney in Delhi?

+

An ordinary GPA or SPA with no money involved carries a small fixed duty under Article 48 of the stamp schedule as applied in Delhi. A GPA given for consideration with a power to sell is charged like a conveyance, which the Revenue Department lists at 6% for men and 4% for women on the higher of deal value or circle rate.

What does the government collect for a power of attorney in Delhi?

+

The government part is the e-stamp duty plus a fixed registration fee and a small pasting charge, both published by the Delhi Revenue Department for every power of attorney. Sale-type GPAs referred to the Collector of Stamps can attract much higher duty. We explain your exact government outgoings during the 20-minute assessment.

How many days does it take to get a power of attorney in Delhi?

+

For a family GPA or an SPA, drafting and NGDRS entry usually take a few working days, and the registered copy is generally released the same day or soon after signing. If the Collector of Stamps is involved, add up to 30 days for the order, or longer in exceptional cases.

How can I check a power of attorney online in Delhi?

+

The Delhi Revenue Department offers an online search of registered documents, and registered deeds can be viewed through an NGDRS login by the parties. Match the registration number, date and office on the copy you have been shown. Also confirm with the principal directly that the power has not been cancelled.

Which Sub-Registrar office should I go to in Delhi?

+

For a power used to present documents, Section 33 of the Registration Act points to the office for the area where you, the principal, live. Delhi now has 39 Sub-Registrar offices across 13 districts, so pick yours on NGDRS. The later sale deed goes to the office where the property is located.

Is notarised power of attorney valid for property in Delhi?

+

A notarised power may be enough for minor tasks such as utility bills or a rent agreement. For selling, buying, mortgaging or presenting a deed at the Sub-Registrar office, a registered power or one authenticated under Section 33 of the Registration Act is the safe choice. Most Delhi buyers and banks will refuse a notarised-only power.

How do I convert a GPA property to a registry in Delhi?

+

The usual route is a fresh registered sale deed from the original owner, or signed by the GPA holder while the owner is alive. DDA flats may qualify for conversion in favour of GPA holders in older chains. If the owner has died, the legal heirs must join, which usually needs heirship papers first.

Can I get a home loan on a power of attorney property in Delhi?

+

It is difficult. Banks want a registered sale deed or conveyance in the borrower's name before they create a mortgage, so a property held only on GPA, agreement and will papers is usually refused. Converting the chain into a registered sale deed, or completing DDA conversion, normally comes first.

Can my mother give power of attorney from home if she cannot visit the SRO?

+

Yes, in many cases. The Registration Act allows a principal who cannot attend because of bodily infirmity to be examined at home by the Registrar or through a commission. Apply early with a medical note. Your mother must still fully understand what she is signing.

Does a power of attorney end when the owner dies?

+

Yes. Under Section 201 of the Indian Contract Act an agency ends on the death of the principal, so any deed signed afterwards is open to challenge. The property then passes by will or inheritance, and the family usually needs a surviving member certificate, legal heir certificate or succession certificate.

What is the difference between GPA and SPA in Delhi?

+

A GPA gives wide authority over many acts or all your affairs. An SPA covers one act or one transaction, such as selling a single flat, and ends when that task is done. In Delhi an SPA for a sale is often cleaner, especially if the holder is not close family and the July 2026 Collector referral would otherwise apply.
