How does a power of attorney work in Hyderabad?

Short answer

A power of attorney in Hyderabad is a signed deed in which you (the principal) let another person (the attorney holder) act for you. For property, it is usually stamped under the Indian Stamp Act as applied in Telangana and registered or attested at the sub-registrar office (SRO) through the IGRS Telangana portal. A GPA to sell or develop property in favour of a non-family member attracts 1% government stamp duty on market value; close family members pay a flat duty. A POA never transfers ownership: the attorney still has to sign and register a sale deed in your name.

  • Registration: Advised for any POA that will sell, develop or mortgage property; SPAs are attested at the SRO.
  • Stamp duty: 1% of market value for a non-family GPA to sell or develop; flat duty for family.
  • Where: SRO for the property area, booked through registration.telangana.gov.in.
  • Ownership: Never passes on a GPA; a registered sale deed is still required.

Start from the job the attorney holder must do, not from a template. The table shows the usual document for common Hyderabad situations and the government stamp duty that applies.

GPA, SPA, AGPA or development agreement cum GPA: pick by the job

Hyderabad property work uses four kinds of authority far more than any other. Each has a different stamp duty, a different risk level and a different shelf life.

General power of attorney (GPA)

  • Lets the attorney do many acts: manage, let out, pay tax, sign, and, if written in, sell or mortgage.
  • The department publishes separate model GPAs for powers without sale, sale to family and sale to others.
  • Ends on your death and can be cancelled by you at any time, unless it is given for consideration.
  • Suits a trusted family member who will handle several tasks over months.

Special power of attorney (SPA)

  • Limited to one act or one deed, such as presenting a sale deed at the Serilingampally SRO.
  • Must be attested under Sections 32 and 33 of the Registration Act, 1908.
  • Easier for buyers and banks to accept because the scope is narrow.
  • Suits cases where you only need someone to sign or present one document.

Agreement of sale cum GPA (AGPA)

AGPA is common in Hyderabad when a buyer pays in full but the sale deed is deferred. It carries 6.5% stamp duty, of which 5.5% is adjustable against the later sale deed. It still does not make the buyer the owner. After the Supreme Court's 2011 ruling in Suraj Lamp and Industries v. State of Haryana, a transfer by GPA, sale agreement or will does not convey title.

Development agreement cum GPA

Landowners in Kokapet, Narsingi, Puppalaguda, Tellapur and the Outer Ring Road belt often sign a development agreement cum GPA with a builder. The GPA part lets the builder apply for permits and sell the builder's share of flats. Government stamp duty is 1% and it is not adjustable later.

What about an irrevocable or durable POA?

A POA can be irrevocable only when the attorney holder has an interest in the property, for example a buyer who has paid (Section 202, Indian Contract Act). Writing the word irrevocable on an ordinary family GPA does not make it so. India also has no durable POA in the US sense: an agency usually ends if the principal becomes of unsound mind, so plan early for ageing parents.

Tip

If the attorney holder will only sell one flat, choose a GPA limited to that flat and that sale. Narrow powers are easier to register and much harder to misuse.

GPA registration charges in Telangana: government stamp duty and registration fee

These are government charges paid to the Registration and Stamps Department, not professional charges. Stamp duty on a POA falls under Article 42 of Schedule I-A to the Indian Stamp Act, 1899 as it applies in Telangana.

DocumentGovernment stamp dutyGovernment registration fee
GPA to sell, construct, develop or transfer property, in favour of a family memberFlat duty of Rs 1,000 (department FAQ)0.5%, minimum Rs 2,000, maximum Rs 20,000

Sources: G.O.Ms.No.59 (Revenue, Registration) dated 20 July 2021, effective 22 July 2021, for AGPA and development agreement cum GPA duty; the Table of Fees under Section 78 of the Registration Act effective 2 September 2021; and the department's registration FAQ for the family and non-family GPA duty.

Who counts as family?

The fee table defines family as father, mother, husband, wife, brother, sister, son and daughter, and includes grandparents, grandchildren and adoptive parents or children. A nephew, son-in-law or cousin is outside the family and pays the 1% rate.

How market value is worked out

The 1% is charged on the government market value of the property, which you can look up on the department's market value search by district, mandal and village or locality. In high-value pockets such as Gachibowli, Jubilee Hills and Kokapet, that figure can be large, so check it before choosing a non-family attorney.

Watch

Some online guides show 5% or 7.5% for a POA. Those figures belong to a sale deed, not a power of attorney. Paying sale-deed duty on a GPA is a costly error that the SRO will not refund on its own.

GPA registration process in Telangana: registered, attested or notarised?

The Registration Act, 1908 does not list every POA as compulsorily registrable. In Hyderabad practice, though, how it is executed decides whether the SRO, a bank or a buyer's lawyer will accept it.

FormWhat it meansWhen it is enough
Registered GPAStamped, signed before the sub-registrar with two identifying witnesses, photo and thumb impression capturedSelling, mortgaging, developing or gifting property; most buyers and banks insist on it
SPA attested at the SROAttested under Sections 32 and 33 so the holder can present and admit a specific deedOne registration act, such as a sale deed or release deed
Notarised POASigned before a notary on stamp paper, not entered in SRO booksRoutine acts such as paying tax, dealing with tenants or a society office

Registration happens through the IGRS Telangana portal at registration.telangana.gov.in. You enter the document details in pre-registration (public data entry), pay duty through a challan, book a slot and then attend the SRO.

  • The deed must be presented within four months of execution; a late document can still be accepted within another four months with the District Registrar's permission and a penalty.
  • Two witnesses identify the executant; without them the registering officer may refuse registration.
  • A certified copy of a registered GPA can later be obtained by the executant, the attorney or an authorised agent.
Watch

A central draft Registration Bill released for comments in 2025 proposes compulsory registration of POAs relating to immovable property. It was still a draft at the time of writing, so register any property POA now and you will not need to redo it.

Where your Hyderabad POA gets registered and used

Greater Hyderabad spreads across Hyderabad, Rangareddy and Medchal-Malkajgiri districts, with western suburbs such as Tellapur and Ameenpur in Sangareddy. The SRO depends on the survey or house number, not the postal address, so confirm jurisdiction before you book a slot.

ShamshabadRangareddySRO for the Shamshabad areaAgricultural land near the airport is handled through Bhu Bharati and the Tahsildar, not the regular SRO

Municipal limits around the Outer Ring Road were reorganised in 2025 and 2026, so check which corporation now holds your property tax record before the attorney applies for mutation or a tax name change.

Hyderabad-specific checks before you sign

Flats in gated communities

In Gachibowli, Kondapur and Narsingi towers, the attorney will deal with the residents' welfare association for NOCs, maintenance dues and parking. Name the association and the unit number in the POA so the office bearers cannot refuse it.

HMDA layouts and LRS plots

Open plots in Kompally, Shamshabad, LB Nagar and Miyapur often sit in layouts approved by HMDA, or in unapproved layouts regularised under the Layout Regularisation Scheme. Add a power to apply for or pay LRS charges, because the SRO may ask for it before a plot sale is registered.

Agricultural land on the city edge

Farm land in Shamshabad, Moinabad, Shankarpally or Medchal is now governed by the Telangana Bhu Bharati (Record of Rights in Land) Act, 2025, which replaced Dharani. Registrations of such land are booked through the Bhu Bharati portal and handled by the Tahsildar as joint sub-registrar. Ask before drafting, because the agricultural route has its own checks.

Mutation after the sale

Under G.O.Ms. No. 155 (2016), the SRO can collect the mutation fee at registration and pass details to the municipality, so many sales are mutated without a fresh visit. If that does not happen, the attorney applies to GHMC. Our guide on GHMC mutation fees and timelines explains the steps, and this POA for mutation format shows the clause to include.

Tip

Give the attorney power to obtain an encumbrance certificate and certified copies from IGRS. Most Hyderabad buyers ask for a fresh EC before paying the balance.

Joint development deals: development agreement cum GPA in Hyderabad

Hyderabad's western suburbs grew through joint development, where a landowner gives land and the builder gives flats. The GPA is the most sensitive part of that deal.

Example: three siblings own 1,200 square yards in Puppalaguda. They agree a 40:60 share with a builder. The development agreement cum GPA lets the builder obtain permission and sell only the builder's 60% share. Stamp duty is 1% of the market value at the Gandipet SRO, and it will not be adjusted later.

  • List the landowners' flats by number in a schedule and bar the builder from selling them.
  • Keep a mortgage of part of the builder's share, or a release of the GPA by stages, as security for completion.
  • Tie the GPA to the project timeline and allow cancellation if construction stops for a stated period.
  • Make sure every co-owner signs; one missing sibling can stall the whole project.
Watch

If one co-owner has died, sort out heirship first. A legal heir certificate in Hyderabad or a multi-heir property transfer must come before the builder's GPA, or the SRO may refuse to register it.

POAs for elderly parents, joint owners and busy professionals

Many Hyderabad POAs are not about selling at all. They let one family member keep a house running while others work in Hitech City or live in another state.

What a management GPA usually covers

  • Collect rent and sign leave and licence agreements with tenants
  • Pay GHMC property tax, water and electricity bills
  • Deal with the society, association and repairs
  • Operate a property-linked bank account, if the bank accepts it
  • Apply for certified copies, EC and mutation

What it should not cover unless you mean it

  • Sale, gift or mortgage of the property
  • Signing as guarantor or borrower
  • Appointing a substitute attorney
  • Withdrawing deposits or closing fixed deposits
  • Settling court cases on your behalf

Example: a retired couple in Begumpet with a daughter in Kondapur gives her a registered GPA for their two tenanted flats. They keep sale out of it. When they later decide to sell one flat, they sign a narrow SPA for that sale alone.

Joint owners can each sign the same GPA in favour of one person, or each give a separate one. A single joint deed is neater at the SRO, but every owner must attend or be represented. For banks, check whether the branch wants its own POA format before you register a general one. The home loan POA guide lists what lenders usually want to see.

Tip

If a parent's memory is starting to fail, act early. A POA signed while the parent clearly understands it is far easier to defend than one signed later.

Why POAs get rejected in Hyderabad and how to avoid it

ProblemWhat happensHow we prevent it
Wrong stamp duty paid (sale duty or too little)SRO impounds or refers the deed; penalty can reach ten times the deficitCheck family status and market value first
Property schedule copied from an old brochureBuyer's lawyer or SRO refuses the sale deed laterCopy survey number, plot or flat number and boundaries from the registered deed and EC
Name spelt differently from Aadhaar or the sale deedIdentity objection at the SRO counterUse one spelling and add an also-known-as line where needed
No express power to sell, receive money or sign the sale deedAttorney cannot complete the saleSpell out each act, including receiving consideration and admitting execution
Witnesses without valid IDRegistration refused for want of identificationBring two adult witnesses with original ID
GPA to someone the buyer does not trustBuyers in Gachibowli and Kokapet ask for the owner in personUse a family attorney or an SPA, and keep the original deed ready
Old GPA, owner since diedGPA is no longer valid; the sale is open to challengeMove to heirship papers and a fresh deed by the heirs

An SRO can also refuse when the title chain is broken or the land falls under the restricted list kept under Section 22-A of the Registration Act. A quick check of the EC and the prohibited properties list saves a wasted slot.

GPA validity in Telangana, revocation and cancellation

A GPA has no fixed expiry unless the deed states one. It stays valid until the work is done, you cancel it, or one of you dies. The department's FAQ confirms that a GPA ends automatically on the death of the executant.

How to cancel a GPA in Hyderabad

  1. Draft a deed of cancellation that refers to the original GPA by document number, year and SRO.
  2. Register it at the SRO where the GPA was registered; the government fee for cancellation is a flat amount.
  3. Send a copy to the attorney holder by registered post and keep the proof.
  4. Inform your bank, the association and anyone the attorney was dealing with.
  5. For high-value property, publish a short notice in a Telugu and an English daily so buyers are on notice.

A POA given for consideration, such as one bundled with an AGPA where the buyer has paid, cannot be revoked by you alone. That needs the attorney holder's consent or a civil court order.

Read more on how long a power of attorney stays valid, and if the attorney holder has died, see POA versus letter of administration.

Watch

Cancelling does not undo acts the attorney already completed in good faith. If a sale has already been registered, you need a civil suit, not a cancellation deed.

Frequently Asked Questions

How do I make a power of attorney in Hyderabad?

+

Get the deed drafted for the exact task, pay stamp duty through a challan, enter the details on the IGRS Telangana pre-registration portal and book a slot. On the day, you, the attorney holder and two witnesses attend the SRO with ID and the title deed. The deed is admitted, photographed and returned as a registered document.

What does the government collect for GPA registration in Telangana?

+

For a GPA to sell or develop property, government stamp duty is 1% of market value if the attorney is outside the family, or a flat duty for close family. The registration fee is 0.5% with a floor and a cap that differ for family and non-family deeds.

Does a power of attorney need stamp paper in Telangana?

+

Yes. Every POA must carry stamp duty under Article 42 of Schedule I-A to the Indian Stamp Act as applied in Telangana. You can buy non-judicial stamp paper or pay through a challan during pre-registration. An unstamped POA cannot be accepted in evidence and may be impounded with a penalty.

Is GPA registration compulsory in Hyderabad?

+

The Registration Act does not make every POA compulsorily registrable. In practice, a GPA that allows sale, mortgage or development is registered at the SRO, because buyers, banks and the SRO itself will rely on it. SPAs for presenting a deed are attested under Sections 32 and 33.

What is the GPA validity in Telangana?

+

A GPA has no automatic expiry unless the deed sets one. It ends when the task is complete, when you cancel it, or when you or the attorney holder dies. A GPA given for consideration, such as to a buyer who has paid, cannot be cancelled by you alone.

Can a GPA holder sell my property in Hyderabad?

+

Yes, if the GPA clearly gives the power to sell, receive the sale amount and sign and present the sale deed. The attorney signs a sale deed in your name at the SRO. The buyer becomes owner only through that registered sale deed, never through the GPA itself.

Who is a family member for the lower GPA stamp duty?

+

The department's tables treat father, mother, husband, wife, brother, sister, son and daughter as family, and the fee table also includes grandparents, grandchildren and adoptive relations. A son-in-law, nephew or friend is not family and attracts 1% of market value on a GPA to sell.

What is an AGPA and is it safe in Hyderabad?

+

An agreement of sale cum GPA records a sale agreement and gives the buyer power to complete it later. It attracts 6.5% stamp duty, with 5.5% adjustable against the final sale deed. It does not make the buyer owner, so always follow it with a registered sale deed as soon as possible.

How do I cancel a power of attorney in Hyderabad?

+

Register a deed of cancellation at the SRO where the original GPA was registered, quoting its document number and year. Send a copy to the attorney holder, tell your bank and association, and for valuable property publish a newspaper notice. Acts already completed in good faith are not undone.

Can I register a POA at any sub-registrar office in Hyderabad?

+

A POA dealing with a specific property is usually registered at the SRO that covers the property, since duty is worked out on its market value there. Jurisdiction follows the survey or house number, so a Miyapur or Kompally plot may fall under a different office from what the postal address suggests.

Can a POA be used for agricultural land near Hyderabad?

+

Yes, but agricultural land is handled under the Bhu Bharati Act, 2025, with registrations booked through the Bhu Bharati portal and done by the Tahsildar. Check the land's classification on the portal first, because the regular SRO route does not apply to land still recorded as agricultural.

Can a power of attorney be used for a bank account in Hyderabad?

+

Often yes, but many banks insist on their own format or want to verify the principal. Ask the branch before you register a general GPA. For loans, the lender may need a separate POA that names the loan account and the property mortgaged.

What happens to a GPA when the owner dies?

+

It ends at once. Any sale signed by the attorney after the owner's death is open to challenge. The property then passes to heirs or under the will, who must sign their own deeds or give a fresh POA. Heirship papers such as a legal heir certificate usually come first.

Do both husband and wife need to sign a POA for a jointly owned flat?

+

Yes. Every co-owner must give authority for their share. Both can sign one joint GPA in favour of the same attorney, or each can sign a separate deed. If only one signs, the attorney can deal with only that person's share, which most buyers will refuse.
