NRI Power of Attorney in Delhi: The Short Answer
An NRI can give a power of attorney for Delhi property without travelling. Sign it before a notary and get an apostille if your country is a Hague Convention member, such as the USA, UK, Canada, Australia or Singapore, or sign it at the Indian Embassy or Consulate in countries like the UAE. Courier the original to Delhi and get it stamped within three months of its arrival. Choose your holder with care: since July 2026, Delhi sends GPAs in favour of anyone outside close family to the Collector of Stamps. For a sale, a special power for that one property is usually safest.
- Sign abroad: Notary plus apostille in Hague countries; Indian mission attestation in the UAE.
- Stamp in Delhi: Within three months of the original first reaching India.
- Holder: Parent, spouse, child or sibling keeps a GPA out of the 2026 referral.
- Uses: Sale, purchase, rent, NRI home loans, society, DDA and MCD work.
Your Situation Abroad, and the Delhi Power That Fits
Find the row that looks most like yours. The country you live in decides how you sign; the task in Delhi decides what the power must say.
| Your situation | Power that usually fits | How you sign it | Delhi catch to plan for |
|---|---|---|---|
| Living in Dubai, selling a DDA flat in Dwarka | Special POA for that one sale | At the Consulate General of India, Dubai, or the Embassy in Abu Dhabi | Society NOC and DDA conversion status checked before the buyer is found |
| Living in the USA, selling a builder floor in Greater Kailash | Special POA sale and receipt into your NRO account | US notary, then apostille from the state authority | Buyer must deduct higher TDS for an NRI seller unless you hold a lower deduction certificate |
| Living in the UK, renting out a house in Punjabi Bagh | Management GPA to a parent, spouse, child or sibling | UK notary, then FCDO apostille | Rent goes to an NRO account; tenant may need to deduct TDS on rent |
| Living in Canada, buying a resale flat in Vasant Kunj | Special POA for purchase | Notary plus apostille, as Canada joined the convention in January 2024 | Payment only from NRE, NRO or FCNR accounts or inward remittance |
| Living in Singapore, taking an NRI home loan for a Saket flat | Bank-format SPA | Notary plus apostille, or the Indian High Commission | Lenders usually supply their own draft; a generic power is rejected |
| Living in Australia, parents' Rohini plot still leasehold | SPA for DDA work and sale | Notary plus DFAT apostille | DDA conversion often has to finish before a buyer's bank will lend |
| Living in Saudi Arabia or Qatar, property tied up in a family dispute | SPA for litigation | Indian Embassy, or apostille where the country is a member | Court may still need your evidence by video or in person |
| Heirs abroad after a parent's death in Delhi | Heir-specific power see our overseas heirs page | Depends on country | Heirship papers come before any sale |
If two rows apply, for example a sale and a loan closure on the same flat, we often prepare two short powers signed in one appointment. Offices in Delhi read narrow powers faster.
Not sure which row is yours? Most families are not. One call with an advocate settles it.
Book an assessmentWhat an NRI Power of Attorney Can Do for Your Delhi Property
A well-drafted power lets one trusted person in Delhi stand in for you at almost every office. It cannot change who owns the property, and it cannot outlive you. Within those limits, here is what it usually covers.
| Task | What your attorney can do | What still needs you | NRI point to remember |
|---|---|---|---|
| Selling | Sign and present the sale deed, hand over possession, apply for mutation in the buyer's favour | Your bank account for the money; your lower TDS application if you want one | NRIs can sell residential or commercial property to residents, NRIs or OCIs under FEMA |
| Buying | Sign the agreement and sale deed, pay from your account, collect keys and title papers | Funds from NRE, NRO, FCNR or inward remittance | NRIs and OCIs cannot buy agricultural land, plantation or farmhouse property |
| Renting | Sign rent agreements, do police verification, collect rent into your account, handle repairs | Decisions on long leases | Rent should go to an NRO account |
| Loans | Sign NRI home loan papers, create or release the mortgage, collect original deeds | Your KYC with the bank | Most banks insist on their own POA format |
| Society and DDA | Apply for society NOC or share transfer, file DDA conversion, sign undertakings | Sometimes a member's own affidavit | Dwarka and East Delhi societies are strict on wording |
| MCD and utilities | Pay property tax, apply for mutation, change electricity and water connections | Nothing, if the power is specific | Keep the MCD UPIC number in the power |

Choosing Your Attorney Holder After Delhi's July 2026 GPA Order
The person you name now matters more than the format. Delhi's 8 July 2026 order sends any property GPA in favour of someone outside a short family list to the Collector of Stamps before registration. That list is parents, spouse, sons, daughters, brothers and sisters.
Many NRIs name a cousin, a nephew, a family friend or a property manager because their close family is also abroad. That is still possible. It simply needs more care.
If your holder is close family
- A management GPA is usually fine
- Add sale power only if a sale is planned
- Keep proof of relationship ready, such as a birth or marriage certificate
- Still route sale money to your own account
If your holder is anyone else
- Prefer a special power for one property and one task
- No "irrevocable" wording, no possession handover, no payment to you for the power
- Expect the Collector's order to take up to 30 days if the document is presented as a GPA
- Build that time into your buyer's agreement
The press reports of the order speak of GPAs presented for registration. They do not say how the Collector treats a power signed abroad that comes in only for stamping. In our files we assume the same five warning signs will be read either way: consideration, possession, irrevocability, permanent power to alienate and any hint of ownership passing.
Two holders can be safer than one. You can name a sibling to sign and a parent as an alternate, with either one able to act, so a single illness in Delhi does not stall your sale.

Signing Abroad: The Route for Your Country
Section 33 of the Registration Act accepts a power signed outside India if it is authenticated by a notary public, a court, a judge or magistrate, an Indian consul or vice-consul, or a representative of the Central Government. India also accepts apostilles from Hague Convention countries. The practical route depends on where you live.
| Where you live | Usual route | Who authenticates | Note |
|---|---|---|---|
| USA | Notary plus apostille | Secretary of State of the state where the notary is commissioned | Indian Embassy or consulates also attest; appointments may run through an outsourced centre |
| United Kingdom | Notary plus apostille | FCDO Legalisation Office | High Commission of India and consulates also attest |
| Canada | Notary plus apostille | Global Affairs Canada or the competent provincial authority | Apostille available since 11 January 2024 |
| Australia | Notary plus apostille | Department of Foreign Affairs and Trade | High Commission and consulates also attest |
| Singapore | Notary plus apostille | Singapore Academy of Law | Apostille in place since September 2021 |
| UAE | Indian mission attestation | Embassy of India, Abu Dhabi, or Consulate General of India, Dubai | UAE is not in the Apostille Convention |
| Saudi Arabia, Oman, Bahrain | Apostille or Indian mission | National apostille authority, or the Indian Embassy or Consulate | Saudi Arabia joined in December 2022; Oman and Bahrain earlier |
| Qatar, Kuwait | Indian mission attestation | Embassy of India in Doha or Kuwait City | Confirm the current position with the mission |
| Germany | Indian mission attestation | Embassy or Consulate General of India | Germany objected to India joining the convention, so an apostille may not be accepted |
The MEA's e-Sanad and apostille service is for Indian papers going abroad, so it is not the tool for a power coming into Delhi.

Four Ways to Execute Your Power, Compared
NRIs with Delhi property usually pick one of four routes. Each one is valid when done properly; the right choice depends on time, travel plans and how the power will be used.
| Route | Suits | Time | Trade-off |
|---|---|---|---|
| Sign at the Indian Embassy or Consulate | UAE, Qatar, Kuwait and anyone who wants Indian authentication on the page | Depends on mission appointment slots | Travel to the mission city; some missions want a local notary first |
| Local notary plus apostille | USA, UK, Canada, Australia, Singapore and other member countries | Often quickest where apostille is processed fast | Two steps abroad; wording must suit Indian offices |
| Notary plus full legalisation chain | Non-member countries where the mission will not attest directly | Slowest | Several offices touch the document |
| Sign in person at a Delhi Sub-Registrar office during a visit | NRIs flying in for a wedding or holiday | One slot, if booked ahead | Needs you in Delhi with PAN, passport and OCI card if any |
Before your appointment abroad
- Final draft approved by us, printed single-sided
- Your passport, plus OCI or PIO card if you hold one
- Two witnesses if the notary or mission asks for them
- Passport photos for the photo page of the power
Before your visit to a Delhi SRO
- Delhi PAN verified on NGDRS
- e-Stamp bought for the right Article 48 clause
- Slot booked for your dates in Delhi
- Holder and two witnesses available on the same day
Example: a software engineer in Toronto wants to sell her late grandfather's floor in Rajouri Garden with her two brothers in London and Melbourne. She does not need a common appointment. Each sibling signs a separate apostilled power to the same cousin, and the three originals are couriered to Delhi together. Heirship must be settled first, which is where our overseas legal heirs POA in Delhi page comes in.
After the Courier Lands in Delhi: Stamping Within Three Months
A power signed abroad is usually not stamped when you sign it. Section 18 of the Indian Stamp Act gives you three months from the date the original is first received in India to get it stamped. Miss that and the document can be impounded, with a penalty on top of the duty.
- Day the courier arrives: your holder keeps the envelope and the delivery receipt. That date starts the clock.
- Within days: we check the power for any defect that would make the Collector refuse it, such as a missing apostille page or mismatched names.
- Stamping: the correct duty is paid through e-stamp and the power is presented to the Collector of Stamps for the district for endorsement or adjudication where needed.
- Collector's check: if the recitals look like a sale, or the holder is outside close family, the Collector may examine it under the 2026 approach before endorsing.
- Ready to use: the stamped original is then used at the Sub-Registrar office when the sale deed or other deed is presented.
A power authenticated under Section 33 is generally accepted for presenting documents without being registered again in Delhi. Some banks, DDA desks and housing societies still ask for a registered or certified copy, so we check with the office that will use it.
Send the original by a tracked courier to a named person, never to a building reception. Lost originals are the most common reason an NRI has to sign twice.
How long a power stays usable is a separate question; our guide to NRI power of attorney validity explains when it lapses.
NRI Hotspots in Delhi and What Each One Usually Needs
Each part of Delhi brings its own paperwork. These are the areas where most of our NRI clients own, and the clause or check that each one tends to need.
| Area | Common NRI situation | Clause your power needs | Local catch |
|---|---|---|---|
| Greater Kailash | Parents' plot rebuilt as floors with a builder | Power limited to your floor and the collaboration documents | Builder powers often trigger the Collector referral |
| Defence Colony | Old family house, siblings spread across countries | Power to deal with any lease or conversion record | Check whether title traces to an L&DO lease |
| Vasant Kunj | DDA flat let to tenants for years | Rent, eviction and DDA conversion powers | Leasehold status can delay a sale |
| Saket | Resale of a DDA flat | Sale, possession handover and society dues settlement | Buyer's bank wants freehold or a clear conversion trail |
| Hauz Khas | High-value floor sale | Sale with money only into your NRO account | Higher TDS on large consideration; plan the lower deduction certificate early |
| Dwarka | CGHS flat bought during an earlier posting in India | Society NOC, share transfer and DDA conveyance powers | Managing committees insist on member-specific wording |
| Rohini | Parents' DDA plot from the Rohini scheme | DDA conversion plus sale | Old GPA chains must be registered for DDA |
| Pitampura | Builder floor bought for retirement | Management and rent powers | MCD property tax arrears block mutation |
| Punjabi Bagh | Large kothi redevelopment | Collaboration agreement and floor allotment powers | Irrevocable builder powers need careful drafting |
| Rajouri Garden | Ground-floor shop and upper floors let out | Commercial lease and rent collection | Separate power for the shop often reads better |
| Janakpuri | DDA flat of ageing parents who want to move abroad | Sale and conversion | Parents' own powers may be needed too if they are co-owners |
| Mayur Vihar | CGHS flat in a society across the Yamuna | Society transfer and sale | Society dues and NOC timelines vary widely |
| Lajpat Nagar | Inherited rehabilitation-colony property | Heirship and L&DO work first, then sale | Mutation must follow heirship papers |
| Model Town | Family home held by siblings in India and abroad | Partition or release, then sale | One reluctant co-owner can stop everything |
The Sub-Registrar office for your sale deed is the one for the property's sub-division. Delhi now has 39 such offices under 13 districts, and NGDRS shows the right one for each address.
Money, Tax and Repatriation When Your Attorney Sells
The power gets the deed signed. The money side has its own rules, and NRIs lose most time here.
- TDS on the sale: a buyer paying an NRI seller must deduct tax at a higher rate than for a resident seller. You can apply for a lower or nil deduction certificate before the sale if your actual gain is smaller. Read our TDS guide for NRI property deals for the detail.
- Where the money lands: sale proceeds should be paid into your NRO account in India, not to your attorney holder.
- Repatriation: RBI rules allow up to USD 1 million per financial year to be remitted from NRO balances, with a chartered accountant's certificate and the bank's forms. Our guide on repatriation of sale proceeds walks through it.
- Who can buy from you: a resident Indian, an NRI or an OCI can buy residential or commercial property from you. See who can buy property in India.
- Home loans: lenders treat the power as part of their security file. Use the bank's own draft and read our NRI home loan power of attorney guide.
Ask your attorney holder to send you scans of every page the buyer signs, the TDS challan and the sale deed registration slip on the same day. It makes your tax return and repatriation much simpler.
Why NRI Powers Get Stuck in Delhi
These are the problems that send NRIs back to the notary or the mission. Each one is far easier to prevent than to fix.
| Problem | Where it shows up | Prevention |
|---|---|---|
| Apostille on the notary page only, not the whole document | Collector of Stamps or Sub-Registrar | Ask the apostille office to bind it to the full power |
| Signed in the UAE before a local notary only | Delhi offices refuse to rely on it | Use the Indian mission route for the UAE |
| Stamped after the three-month window | Impounding and penalty | Record the courier delivery date and stamp early |
| Name on passport differs from title deed | Sale deed presentation | Add a "one and the same person" line, with proof |
| GPA to a friend with power to sell and keep proceeds | Collector referral, sale-level duty, buyer walks away | Special power, money into your NRO account only |
| Generic power used for a bank loan | Bank legal team | Get the lender's wording before you sign abroad |
| Delhi PAN not linked or not verified | NGDRS token at the SRO | Verify PAN details before your attorney books the slot |
| Photo page missing or photos not signed across | Registration counter | Follow our signing sheet page by page |
Mutation after a purchase or inheritance has its own format; see the NRI power of attorney for mutation guide and NRI property mutation.
Cancelling Your Power While You Live Abroad
You do not need to fly to Delhi to withdraw a power. You do need to follow the same path in reverse.
- Sign a revocation deed abroad using the same route you used for the power: apostille or Indian mission attestation.
- Courier it to Delhi and get it stamped within the three-month window.
- Register it at the Sub-Registrar office that registered the original, if the original was registered in Delhi.
- Send a copy to the holder by email and tracked post, and tell your bank, society, tenants and the MCD zone.
If you suspect misuse, act fast. Freeze bank instructions by email to your branch, ask the society not to issue any NOC, and speak to us about a public notice. Changes in a marriage can also make a power risky; our note on powers of attorney during divorce covers that case.
When a Power Is Not Enough, and Related NRI Services
A power ends on the death of the person who gave it. If the owner of the Delhi property has died, the heirs first need heirship papers, and only then can they give powers to sell. Our comparison explains why a power and a letter of administration are different tools.
- Resident in Delhi, or acting for a parent there? See power of attorney in Delhi.
- Heirs signing from abroad: POA for overseas legal heirs in Delhi and the Delhi registration process for overseas heirs.
- Heirship for NRIs: NRI legal heir certificate in Delhi, surviving member certificate and NRI succession certificate.
- After a death: property transfer after death for NRIs in Delhi and probate of a will for NRIs.
- Planning ahead: NRI will drafting and registration.
- Family members giving up shares: NRI release and relinquishment deeds.
- Before you buy or sell: NRI property due diligence and NRI property documentation.
- All NRI matters: NRI legal services.
NRI powers for other cities: Gurgaon, Mumbai, Bangalore, Hyderabad, Chennai and Kolkata.

Frequently Asked Questions
How do I get a power of attorney for Delhi property while living abroad?
+We prepare the draft in Indian format and you sign it in your country, either before a notary followed by an apostille, or at the Indian Embassy or Consulate. The original is couriered to your holder in Delhi, stamped within three months of arrival, and then used at the Sub-Registrar office or wherever the task needs it.
Can an NRI sell property in Delhi through a power of attorney?
+Yes. Your holder signs and presents the sale deed for you at the Sub-Registrar office for the property's area, while you stay abroad. The power must clearly cover that property and the sale, and you must be alive on the day of signing. The buyer pays into your NRO account and deducts TDS at the rate that applies to NRI sellers.
Is a power of attorney valid for buying property in Delhi for an NRI?
+Yes. A special power for purchase lets your holder sign the agreement and sale deed, pay from your NRE, NRO or FCNR account and take possession. FEMA still applies, so NRIs and OCIs cannot buy agricultural land, plantation property or a farmhouse through any power.
Does a power of attorney signed abroad need to be registered again in Delhi?
+Usually not for presenting a deed. Section 33 of the Registration Act accepts a power authenticated by a notary, an Indian consul or other listed authority abroad. It must still be stamped in Delhi within three months of arrival. Some banks and societies ask for a registered or certified copy, so check the office that will use it.
What is the time limit to stamp an NRI power of attorney in Delhi?
+Section 18 of the Indian Stamp Act allows three months from the date the original is first received in India. Keep the courier delivery receipt as proof of that date. After the window, the document can be impounded and a penalty added, so we stamp it as soon as it arrives.
Is an apostille enough, or do I need the Indian Embassy?
+If you live in a Hague Convention country such as the USA, UK, Canada, Australia or Singapore, a notary plus apostille is normally enough for Delhi offices. In the UAE, Qatar and Kuwait, use the Indian mission. Germany objected to India's accession, so Indian mission attestation is the safer route there.
How do I make a power of attorney from Dubai for Delhi property?
+The UAE is not part of the Apostille Convention, so sign the power at the Consulate General of India in Dubai or the Embassy of India in Abu Dhabi, usually through the mission's appointed service centre. Then courier the attested original to Delhi for stamping. A notary-only power from Dubai is likely to be refused.
Can I make a power of attorney in the USA for property in Delhi?
+Yes. Sign before a US notary public and get an apostille from the Secretary of State of the state where the notary is commissioned. Alternatively, sign at the Embassy of India or one of its consulates. Courier the original to Delhi and have it stamped within three months.
Does the July 2026 Delhi GPA rule apply to NRIs?
+The order applies to GPAs presented for registration in Delhi, whoever signs them. If your GPA names someone other than your parents, spouse, children, brother or sister and deals with property, expect the Collector of Stamps to examine it first. A special power for one task, with money paid only to you, reduces that risk.
Can an OCI card holder give a power of attorney for Delhi property?
+Yes. OCI and PIO card holders can give a power for Delhi property in the same way as Indian passport holders. Carry both your foreign passport and OCI card to the notary or mission, and make sure the name matches your title deed or add a one-and-the-same-person declaration.
Can my attorney in Delhi handle my NRI home loan?
+Yes, but banks usually want their own wording. Ask the lender for its power of attorney format before you sign abroad. The holder can then sign the loan papers, the mortgage and the sale deed for you. A generic power is a common reason for loan files getting stuck.
Can my power of attorney holder send the sale money abroad for me?
+The holder can help with the bank paperwork, but the money should be paid into your NRO account, not the holder's. Remittance from NRO balances is allowed up to USD 1 million per financial year, with a chartered accountant's certificate and the bank's forms. Your instructions to the bank usually need to come from you.
What is the stamp duty for an NRI general power of attorney in Delhi?
+For a GPA with no money paid and no power to sell for consideration, the government duty under Article 48 is small and fixed. If the power is given for consideration with authority to sell, Delhi levies duty as on a sale deed. The Collector of Stamps confirms the figure when your power is stamped after arrival.
Can I cancel my power of attorney from abroad?
+Yes. Sign a revocation deed using the same route as the original, apostille or Indian mission, courier it to Delhi, get it stamped and register it at the office that registered the power, if any. Then tell the holder, your bank, the society and any buyer or tenant in writing.
