NRI power of attorney in Gurgaon: the short answer

Short answer

An NRI power of attorney in Gurgaon lets a person in India act for you while you stay abroad. You sign it in your country of residence, either before an Indian embassy or consulate, or before a local notary followed by an apostille if that country is an Apostille Convention member. The UAE, Qatar and Kuwait are not members, so residents there use the Indian mission. When the original reaches India, it must be stamped within three months under Section 18 of the Indian Stamp Act. Your attorney can then use it at the Gurugram tehsil.

  • Sign abroad: Before an Indian embassy or consulate, or a local notary plus apostille in member countries.
  • Stamp in India: Within three months of the original first arriving in India, under Section 18 of the Indian Stamp Act.
  • Gulf note: UAE, Qatar and Kuwait use Indian mission attestation; Saudi Arabia, Oman and Bahrain issue apostilles.
  • Accepted at: Gurugram tehsils under Section 33(1)(c) of the Registration Act, then by HSVP, developers and banks.

Which POA should an NRI send to Gurgaon?

Distance changes the risk. When you cannot drop in at the tehsil or ring the builder's office during Indian hours, a tightly written POA protects you more than a broad one. For most NRI work in Gurugram, that means a special power of attorney for each job.

Send an SPA when

  • You are selling, buying or taking possession of one property
  • A bank needs signatures for a single home loan
  • You want the power to end once the job is done
  • The holder is a friend, a cousin or someone outside your immediate family

A GPA makes sense when

  • Your Gurgaon flat is let out and needs year-round care
  • Many small tasks recur: society, MCG tax, repairs, tenants
  • The holder is a parent, spouse or sibling you fully trust
  • You expect to stay abroad for several years

Developer and bank formats

Gurugram developers and lenders often send their own POA drafts. Use them as a checklist, not as the final word. If a developer's format asks for an irrevocable power, remember that Section 202 of the Indian Contract Act makes a power coupled with the holder's interest hard to withdraw.

OCI and PIO holders

OCI cardholders can give a POA for Gurugram residential and commercial property in the same way as NRIs. Agricultural land, farmhouses and plantation property are different: under FEMA rules, NRIs and OCIs generally cannot buy them, though they can inherit them. If your family holds farmland near Sohna or Pataudi, plan the POA around inheritance and sale, not purchase. Our guide on what NRIs can buy in India sets out the limits.

Tip

Write the attorney's full name, father's name, address and Aadhaar or PAN in the POA. Gurugram tehsils match these against the Web-HALRIS entry, and a missing detail means a fresh POA from abroad.

Country by country: how to sign your POA abroad

Section 33(1)(c) of the Registration Act 1908 lets a person living outside India have a POA executed before and authenticated by a notary public, a court, a judge, a magistrate, an Indian consul or vice-consul, or a representative of the Central Government. In practice, that gives you two routes.

Route A: Indian embassy or consulate

  • Book a consular attestation slot, often through the mission's outsourced service centre
  • Sign in front of the consular officer with your passport
  • No apostille needed afterwards
  • The only route for the UAE, Qatar and Kuwait

Route B: local notary plus apostille

  • Sign before a local notary public
  • Get an apostille from the designated authority of that country
  • India has been an Apostille Convention member since 14 July 2005
  • Works for the USA, UK, Canada, Australia, Singapore and many more
Where you liveUsual routePoints to note
USANotary plus apostille, or Indian embassy or consulateThe apostille comes from the Secretary of State of the state where the notary is commissioned
UKNotary plus apostille, or High Commission or consulateThe UK issues apostilles through its legalisation office

UAEIndian Embassy Abu Dhabi or Consulate General DubaiNot an Apostille Convention member; a local notarisation alone is not enough
Qatar and KuwaitIndian Embassy in Doha or Kuwait CityNot Convention members; use consular attestation
Saudi ArabiaNotary plus apostille, or Indian Embassy or ConsulateThe Convention has applied there since 7 December 2022
Oman and BahrainNotary plus apostille, or Indian EmbassyBoth are Convention members

UAE residents have extra steps around Arabic translation and local notary rules, covered in our page on a POA from the UAE for property in India and our guide for NRIs in Dubai.

Note

MEA's e-Sanad service is for Indian documents going abroad. It does not attest a POA you sign overseas for use in Gurugram, so do not wait for it.

Small things that cause big delays

  • Sign every page, not only the last one, and paste a recent photograph where the draft asks for it
  • Use the same name spelling as your passport, PAN and title deed
  • Attach a self-attested copy of your passport and, where relevant, your OCI card
  • Make sure the apostille certificate is fixed to the POA itself, not to a separate cover page

When the original reaches Gurugram: stamping within three months

Your signed POA is not ready to use the day it lands. Under Section 18 of the Indian Stamp Act 1899, which applies in Haryana with state amendments, a document executed only outside India may be stamped within three months after it is first received in India.

  1. Keep proof of arrival. The courier airway bill and delivery record show when the three months began.
  2. Work out the duty. The POA falls under Article 48 of Haryana's Schedule 1-A. A plain agency carries a fixed duty; a POA for consideration with a power to sell is charged like a sale deed.
  3. Pay through e-GRAS. Haryana stamp duty is paid online as an e-stamp linked to the document.
  4. Adjudication where needed. If the right duty is unclear, the Collector of the district (in Gurugram, the Deputy Commissioner's office) can determine it.
  5. Present it at the tehsil. Your attorney carries the stamped original, the arrival proof and their own ID when the sale or conveyance deed is booked on Web-HALRIS.

Missed the deadline?

An unstamped or late-stamped POA can be impounded, and the duty is then collected with a penalty. The Andhra Pradesh High Court, in a 2022 case about a POA signed in Canada, held that a late POA can still be validated by paying duty and penalty rather than being rejected outright. Haryana officers may take their own view, so treat the three-month window as firm.

Tip

Send the POA by a tracked courier to the attorney or to us, not by ordinary post. A lost original means signing again at the consulate.

Many Gurugram tehsils will also want to see that the foreign POA has been stamped and placed on record before they accept a sale deed under it. We confirm the exact practice with the office concerned before your attorney books a slot.

Tehsil guide for NRI-owned property in Gurugram

Your POA is signed abroad, so the question for you is where the property side will be handled. The sale deed or conveyance deed is registered at the tehsil or sub-tehsil for the property's revenue estate. The district's collector rate lists for 2026-27 group colonies like this.

Before any sale, your attorney will need the municipal No Dues Certificate, which Haryana links to Web-HALRIS, and for a small vacant plot in a notified urban area, the District Town Planner's Section 7A NOC. If you live in India part of the year, our power of attorney in Gurgaon page explains the resident route and the tehsil where a resident principal signs.

Worked examples: NRIs with Gurgaon property

Dubai: selling a DLF Phase 4 flat

The owner signs an SPA at the Consulate General of India in Dubai, because the UAE does not issue apostilles. The original is couriered to his sister in Gurugram, stamped within three months, and used at Wazirabad for the sale deed. The buyer deducts TDS and pays the balance into the owner's NRO account.

California: conveyance deed in Sector 84

A software engineer signs before a California notary and gets the apostille from the state's Secretary of State. Her father uses the SPA to pay the final demand, take possession and sign the conveyance deed at Manesar. The SPA also lets him apply for the property ID, so she does not need a second POA later.

London: letting a flat on Golf Course Extension Road

A couple wants their flat let and maintained, with rent going to their NRO account. A management GPA, notarised and apostilled in the UK, covers leases, tenant verification and society work. It gives no power to sell, which suits a long tenancy.

Toronto: a POA signed before and after January 2024

An older POA from Canada had needed legalisation through the Indian mission. Since Canada joined the Apostille Convention, a new POA was signed before an Ontario notary and apostilled. The family kept the old one on file but used the new one for the sale.

Riyadh: heirs settling a parent's house in Sushant Lok

Two brothers in Saudi Arabia need their share handled after their mother's death. Each signs an SPA with an apostille, which Saudi Arabia now issues. The POA lets their sister apply for heirship papers and sign either a release deed or the sale deed. See our guide to POAs for overseas heirs for the clauses.

Why NRI POAs for Gurgaon get stuck

Most problems with foreign POAs show up only when the attorney reaches the tehsil or the developer's office. These are the common ones.

Money, tax and FEMA points your attorney must get right

A clean POA can still lead to trouble if the money side is careless. Write these points into the deed and brief your attorney on them.

  • Where the sale money goes: into your NRO account in India, or NRE where the rules allow. Never into the attorney's own account.
  • TDS on an NRI sale: the buyer must deduct tax at source at rates that are higher than for resident sellers. Our note on TDS when buying from an NRI explains what your buyer will ask for.
  • Taking the money abroad: RBI rules let NRIs remit up to USD 1 million a financial year from NRO balances, including sale proceeds, with the usual tax forms from a chartered accountant. Read repatriation of sale proceeds before you sign.
  • Home loans: lenders in Gurugram usually want a specific loan POA. Our page on the NRI home loan POA lists what banks look for.
Note

India's new Income-tax Act took effect from 1 April 2026, and some section and form numbers have changed. Ask your chartered accountant for the current references before the sale date.

Cancelling or replacing a POA from abroad

If you no longer trust the holder, or the job has changed, act quickly and in writing. The steps mirror how you gave the power.

  1. Email the attorney at once saying the power is withdrawn, and send the same notice by registered post to their Gurugram address.
  2. Sign a cancellation deed abroad by the same route you used for the POA: Indian mission, or notary plus apostille.
  3. Stamp it in India within three months of arrival, as a cancellation instrument under Article 17.
  4. Register it at the Gurugram tehsil that has the original on record.
  5. Inform everyone who may rely on the old power: the developer, HSVP, the RWA, your bank and any buyer or tenant.
  6. Send a new POA if someone else must now act for you.

Our article on NRI POA validity lists when a power ends by itself, and our note on a POA during divorce proceedings covers a situation where cancellation is common.

Choosing your attorney in Gurugram

The person you name will sign in your place, stand at the tehsil for biometrics and talk to buyers and builders. Pick for reliability and availability, not only closeness.

A good attorney usually

  • Lives in Gurugram or Delhi and can reach the tehsil at short notice
  • Has Aadhaar and PAN with names that match their other records
  • Is comfortable dealing with developers, banks and the RWA
  • Will keep you updated in writing after each step

Think twice if the person

  • Is the buyer, the broker or anyone gaining from the deal
  • Travels often or may move cities soon
  • Is elderly and may not manage repeated visits
  • Wants the power to receive money in their own name

You can name two attorneys and say whether they must act together or either can act alone. Joint action is safer for a sale; either-or is more practical for rent and repairs.

Tip

Ask your attorney to send you a photo of every document they sign, on the same day. It takes them a minute and gives you a running record from abroad.

If the family property came to you after a death, check first whether heirship papers are needed. A POA from an heir cannot do more than the heir's own rights allow, and our page on NRI property inheritance explains the order of steps.

Frequently Asked Questions

How can an NRI make a power of attorney for property in Gurgaon?

+

Get the POA drafted for the specific task, then sign it in your country of residence before an Indian embassy or consulate, or before a local notary followed by an apostille if your country is a Convention member. Courier the original to India, have it stamped within three months, and your attorney can then use it at the Gurugram tehsil and with the developer.

Does an NRI POA need to be registered in Gurugram?

+

A POA signed abroad before a notary or Indian consul is authenticated under Section 33(1)(c) of the Registration Act, so it does not need fresh registration to let your attorney present a sale deed. It must still be stamped in India within three months. Some Gurugram tehsils like the stamped POA placed on record first, which we arrange.

What is the time limit to stamp a POA executed abroad for Haryana property?

+

Section 18 of the Indian Stamp Act, which applies in Haryana, allows a document executed only outside India to be stamped within three months after it is first received in India. Keep the courier record as proof of the arrival date. After the window, the document can be impounded and duty collected with a penalty.

Is an apostille enough, or do I also need Indian embassy attestation?

+

If you live in an Apostille Convention country such as the USA, UK, Canada, Australia, Singapore or Saudi Arabia, a notary plus apostille is enough; embassy attestation is not needed as well. If you sign at the Indian embassy or consulate instead, no apostille is needed. Residents of the UAE, Qatar and Kuwait should use the Indian mission.

How do NRIs in Dubai make a POA for Gurgaon property?

+

Since the UAE is not an Apostille Convention member, sign the POA at the Consulate General of India in Dubai or the Embassy of India in Abu Dhabi, usually through their appointed service centre. Carry your passport, Emirates ID and the draft. Then courier the original to Gurugram and get it stamped within three months.

Can I sign the POA on Indian stamp paper and carry it abroad?

+

Some NRIs do this, but it rarely saves time. The document still has to be authenticated abroad, and Haryana now works with e-stamps linked to the document through e-GRAS. Most Gurugram tehsils are comfortable with a POA signed abroad on plain paper and stamped within three months of arrival, so we usually recommend that route.

Can my attorney sell my Gurgaon flat and send the money abroad?

+

Your attorney can sign the sale deed and collect the payment into your NRO account if the POA allows it. The buyer deducts TDS first. You can then remit up to USD 1 million a financial year from NRO balances with the required tax forms. The attorney should never take sale money into a personal account.

Do I need to come to India to sell my Gurgaon property?

+

No. With a properly executed and stamped SPA, your attorney can sign and present the sale deed at the Gurugram tehsil, give biometrics and complete the paperwork. You may want to be available on a video call for the buyer and bank, and you will need to sign tax forms for remitting the money abroad.

Can an OCI cardholder give a POA for Gurgaon property?

+

Yes. OCI cardholders give POAs the same way NRIs do and attach a copy of the OCI card and passport. They can deal in residential and commercial property in Gurugram. For agricultural land, farmhouses or plantations, FEMA rules generally allow OCIs to inherit and sell but not to buy, so the POA should be worded around those limits.

Can I give a POA by video call or e-signature from abroad?

+

No. The Information Technology Act 2000 excludes powers of attorney from the documents that can be executed with an electronic signature, so a POA still needs your physical signature before a notary or consular officer. Video calls help with drafting and briefing, but the signing must happen in person at the notary or mission.

What happens if my POA is stamped after three months?

+

The tehsil may impound it and send it for duty and penalty to be collected before it can be used. Courts have allowed late POAs to be validated this way rather than rejected, but the penalty and delay can upset a sale date. If you are close to the deadline, tell us at once so the stamping is prioritised.

Which Gurgaon tehsil will accept my NRI POA?

+

Any Gurugram tehsil can act on a properly authenticated and stamped foreign POA. What matters is that the sale or conveyance deed is booked at the office for the property's revenue estate, such as Wazirabad for DLF Phase 5, Badshahpur for Golf Course Extension Road or Manesar for sectors 83, 84 and 90. We confirm the office first.

Can I use my developer's POA format?

+

You can, but have it checked before you sign. Developer formats are written to suit the developer, and they may give the holder powers you do not want or miss a step the tehsil or bank needs, such as applying for the property ID or the No Dues Certificate. A short covering SPA can fill such gaps.

How do I cancel a POA I gave from abroad?

+

Email and post a written notice to the attorney immediately, then sign a cancellation deed abroad by the same route as the original. Stamp it in India within three months, register it at the Gurugram tehsil that holds the original record, and inform the developer, HSVP, the RWA, banks and any buyer or tenant.
